They also will be working with a governor of the same political party, a combination that means they can unilaterally increase taxes, pass emergency legislation and put constitutional amendments before voters. As the legislative session opens Monday, Democrats’ lengthy agenda includes state environmental laws, K-12 and higher education funding, and making sure California is prepared for federal health care reforms. No longer can Democrats blame minority Republicans for blocking their priorities. “We have no more excuses,” said state Sen. Michael Rubio of Bakersfield, a Democrat who is leading what promises to be a spirited debate over tweaking the state’s pioneering environmental protection laws. “The debate changes because the answers are within our caucus.” Gov. Jerry Brown will set the stage on Thursday when he plans to release his proposed budget for the fiscal year that begins July 1. California is on better financial footing than at any time since the recession began after voters approved Brown’s Proposition 30, which will raise an estimated $6 billion a year from temporary tax increases. The state’s nonpartisan budget analyst projects a deficit of less than $2 billion through the next fiscal year and the possibility of surpluses after that. The relatively rosy outlook after years of multibillion dollar deficits will let Brown call for changing the way the state provides money to schools. He is expected to propose sending more money to poorer districts and to programs for students learning English as a second language, while giving local districts more spending flexibility. He also is expected to call a special legislative session to address administrative changes required to fully implement the national Affordable Care Act.

Neither had ever seen the inside of a model shop before, and for someone in their generation it’s not easy. Evett’s is the last model shop on the Westside, the rest having fallen long ago to the pressures of the Internet and video games. Both boys were clutching make-yourown glider kits in their hands, a nod to when children sought out toys specifically because assembly was required. “It’s awesome,” McPherson said. “I can’t believe he built all of this.” The “he” is 93-year-old Colby Evett of Evett’s Model Shop, which celebrated its 65th anniversary in Santa Monica on Saturday. The store has been serving up the ingredients many found necessary for childhood since 1948, and the community turned out to celebrate the store and its owners, Colby and Yvonne Evett, with cake, laughter and memories. ‘Chainsaw 3-D’ carves out No. 1 debut with $23M NBC execs say it’s DAVID GERMAIN AP Movie Writer
LOS ANGELES It took Leatherface and his chainsaw to chase tiny hobbit Bilbo Baggins out of the top spot at the box office. Lionsgate’s horror sequel “Texas Chainsaw 3-D” debuted at No. 1 with $23 million, according to studio estimates Sunday. The movie picks up where 1974’s “The Texas Chainsaw Massacre” left off, with masked killer Leatherface on the loose again.
Quentin Tarantino’s revenge saga “Django Unchained” held on at No. 2 for a second-straight weekend with $20.1 million. The Weinstein Co. release raised its domestic total to $106.4 million. After three weekends at No. 1, part one of Peter Jackson’s “The Hobbit” trilogy slipped to third with $17.5 million. That lifts the domestic haul to $263.8 million for “The Hobbit.” The Warner Bros. blockbuster added $57.1 million overseas to bring its international earnings to $561 million and
its worldwide total to about $825 million. Also passing the $100 million mark over the weekend was Universal’s musical “Les Miserables,” which finished at No. 4 with $16.1 million, pushing its domestic total to $103.6 million. NBC executives said Sunday they are conscious about the amount of violence they air in the wake of real-life tragedies like the Connecticut school shooting, but have made no changes in what has gone on the air or what is planned. NBC isn’t a “shoot-’em-up” network, said network entertainment President Jennifer Salke. The level of violence on television, in movies and video games has been looked at as a contributing factor — along with the availability of guns and a lack of mental health services — in incidents such as the Dec. 14 attack in a Newtown, Conn., school where 20 first-graders and six educators were killed. Like many in Hollywood, NBC questioned a link between what is put on the air and what is happening in society. “It weighs on all of us,” said NBC Entertainment Chairman Robert Greenblatt. “Most of the people at this network have children and really care about the shows that we’re putting out there. It’s always something that’s been on our mind but this brought it to the forefront.” NBC hasn’t needed to take any tangible steps like minimizing violence in its programming or deemphasizing guns, Salke said, because NBC didn’t have much violence on the air. It might be different “if we were the ‘shoot-’em-up’ network, she said. She didn’t name such a network, but said violence might be an issue on a network that airs many crime procedural shows. That’s a staple of CBS’ lineup. Greenblatt, who was head of Showtime when the “Dexter” series about a serial killer was developed, said CBS’ “Criminal Minds” is “worse than ‘Dexter’ ever was.” Within an hour after both executives spoke, NBC showed reporters at a news conference highlights of its show “Revolution” that included a swordfight, a standoff between two men with guns, a bloodied man, a building blown up with a flying body and a gunfight. Later clips of the upcoming series “Deception” featured several shots of a bloodied, dead body. In Ashley Archibald’s Jan. 3, 2013 SMDP nativity scene cover story (”Nativity scenes case appealed”) there needs to be one correction. She closes her excellent article with this statement: “Other plans to resurrect the tradition in a new form in Palisades Park fizzled when the concept of ‘live’ nativity scenes hosted by the churches never successfully got off the ground.” Actually Models For Christ in conjunction with YWAM (Youth With A Mission) did put on a live nativity in Palisades Park from Dec. 3 to Dec. 7. There was a live depiction with Mary, Joseph, a real baby, three Wise Men and two Angels. In addition there were carolers singing and a staff serving hot chocolate and coffee. Serene Branson of CBS and KCAL 9 covered it as well as several newspapers and Fabian from SantaMonicaCloseup.com. Jay Leno even mentioned it in his monologue one of the nights. The highlight of the “live” nativity occurred on the Friday when a man who had planned to commit suicide that very night, walked by the event and ended up talking to a person from Youth With A Mission. After a long conversation the man changed his mind and a life was spared because the live nativity was in Palisades Park that night.
watching you more than in Santa Monica. In October, the City Council approved an ordinance that prohibits smoking in private apartments and condos. It’s the latest in a long list of smoking prohibitions that includes common areas of multi-family dwellings as well as the beach, parks, restaurants and most public areas. According to a press release issued by Adam Radinsky in the City Attorney’s Office, the ordinance states all vacated units in multi-unit residential properties are forever declared “non-smoking.” Anyone now moving into a vacated apartment or condo in Santa Monica is prohibited from smoking in them. By Jan. 21 all landlords and condo homeowners’ associations (HOA’s) are required to survey current occupants, who must designate their domiciles as either “smoking” or “non-smoking.” Smokers (as of Nov. 22, 2012) can smoke inside their units only if they’re designated “smoking” units. Here’s where privacy goes out the window. Once the survey is completed, landlords and HOA’s must provide occupants, prospective renters or buyers and anyone who asks for it a copy of each unit’s smoking status The ordinance says, “if a person persists is smoking inside a ‘non-smoking’ unit after getting a written notice, the person may be taken to small claims court and is liable to pay damages starting at $100.” Anyone can enforce the law and sue. Property owners/managers are only required to conduct the survey and maintain updates. They’re not required to enforce violations of no-smoking rules. The lesson here is to designate your unit as a “smoking” unit whether you smoke of not. I’m not a smoker, but I’ll register my apartment as a “smoking” unit because there’s no risk or penalty for smoking in a unit that’s designated “smoking.” If your unit is “non-smoking,” any time a visitor lights up, it’s a violation of Santa Monica Municipal Code, Section 4.44.040. And, that includes roommates — fiancé, relatives or friends — who might move in. If you’ve signed a lease that says there’s “no smoking in your unit” and someone does, you could also be subject to eviction for failure to adhere to the terms of your lease. Even medical marijuana isn’t exempt. If the occupant can’t take marijuana in a nonsmokable form, smoking might be permissible under the “reasonable accommodation” standard for persons with disabilities with a doctor’s request. There’s so much wrong with this unwieldy and unenforceable ordinance, I don’t know where to begin. The ordinance is designed to protect the public’s health from harmful pipe, cigarette and cigar smoke. But, what’s next? Public disclosure of peanut butter in your home because a neighbor may be allergic to it? How about protecting vegans by listing tenants who store and cook meat? Let’s list all pets to protect people who react negatively to animal hair or bird feathers. Let’s require documentation of noisy ten-

ants for persons who may be traumatized by hearing a neighbor’s TV, phone conversation or love making? The prohibitions could go on and on. If we’re going to protect people’s well being, why stop at smoking? While I sympathize with the argument that second-hand smoke is detrimental to the health of non-smokers, especially children, what about fireplaces and barbecues whose carcinogen-laden smoke is also harmful? At night, wood smoke from multiple neighbors’ fireplaces drifts into my third floor apartment causing watery eyes, throat irritation and coughing. A couple years ago when the person living below me was a two to three pack a day smoker, her second-hand cigarette smoke seeped into my place through wall plugs, the fireplace and around door and windows frames constantly. I wasn’t bothered nearly as much by it as my neighbor’s fireplace and barbecue smoke. One of the major advocates of the antismoking ordinance was Esther Schiller, director of the Smokefree Apartment House Registry, a nonprofit that helps people find non-smoking complexes. The group lobbied hard for the ban. During recent discussions on the proposed ordinance, the council was repeatedly assured by Schiller that her group wasn’t seeking eviction for violating the ordinance. However, an e-mail from Schiller to her supporters after the ordinance was adopted reveals her disappointment that eviction wasn’t included for violations. She wrote, “The down side is that the city will not enforce the law ... Another down side is that landlords are not permitted to evict tenants for smoking.” For the record, Kevin McKeown and Pam O’Connor opposed the ordinance. Bob Holbrook, Gleam Davis, Terry O’Day, (then) Mayor Richard Bloom and Bobby Shriver supported it. The possibility of eviction still bothers McKeown. I’m always concerned when “do-gooders” want to prevent me from doing something that’s totally legal and within my rights. I have no problem with a landlord or HOA declaring their property’s common areas smoke-free. However, blacklisting smokers is as wrong as creating and distributing lists of tenants who have medical or mental issues or are alcoholic. It’s nobody’s damn business. I’m getting fed up with the self-appointed nannies who want to ban cigarettes, “Big Gulp” sodas, chocolate drinks, greasy foods and more. Enough! It’s one thing to say, “Don’t do it.” It’s another thing to pass ordinances. Government must stop acting like our mothers or doctors.

burros will be restricted under new rules announced Friday by the U.S. Bureau of Land Management after an investigation into the sale of more than 1,700 horses to a Colorado livestock hauler who supports the horse meat industry. “It is a response to that inquiry, which is being conducted right now by the Office of the Inspector General of the Interior Department,” said Tom Gorey, BLM spokesman for the wild horse program in Washington, D.C. Wild horse advocates said the rules amount to “window dressing” and won’t keep large numbers of mustangs out of the hands of so-called kill buyers. The inspector general is investigating what became of 1,777 horses sold since 2009 to Tom Davis. Wild horse advocates fear the animals were taken to Mexico for slaughter. “He’s the biggest buyer among all of our buyers over the years,” Gorey said of Davis. Since 2005, when the BLM first allowed people to buy horses in bulk as opposed to adopting them, the agency has sold 5,400 animals, Gorey said. An investigation of Davis’ wild horse purchases was published by ProPublica in September. Gorey said the inspector general is “looking into all aspects of the sales to Davis, including the whereabouts of the horses.” He said it’s unknown when the investigation will be finished. Wild horses are protected under federal law, and selling them for slaughter is illegal. Davis signed agreements with the BLM promising none of the horses would be sold for slaughter, and he maintains he’s done nothing wrong. Local authorities in Colorado also are investigating whether Davis violated brand inspection laws by shipping some horses out of state, according
to published reports. Under the new rules, sales of wild mustangs and burros will be limited to no more than four within a six-month period unless prior approval is obtained from a BLM assistant director. Buyers also must describe where they intend to keep the animals. Requiring BLM approval for large sales won’t protect mustangs, said Suzanne Roy, director of the American Wild Horse Preservation Campaign. Roy said it is “outrageous” to put the decision of who gets more than four horses “in the hands of the very same BLM managers who were exposed as being responsible” for wild horses ending up with buyers like Davis. She added the new policy allows the BLM “to look the other way after six months.” Laura Leigh, an advocate with Wild Horse Education, said the BLM should rescind its policy that allows horse sales. “Sales authority itself may be unconstitutional, and until it’s repealed, our wild horses will remain vulnerable to sale into the slaughter pipeline,” Leigh said. About 37,000 wild horses roam Western states. About half are in Nevada. The BLM, which is charged with managing wild horses and burros, has struggled to keep populations on the range in check. Hundreds if not thousands of horses are rounded up yearly and placed for adoption or sent to long-term holding pastures to live out their days. Officials say there are now more horses in captivity — more than 45,000 — than remain on the range. From about 2005 until now, people who wanted 20 horses or more could buy them for $10 per horse and have them delivered by the BLM. Smaller numbers could be purchased for prices ranging from $25 to $75, said Heather Emmons, BLM spokeswoman in Reno. “Most of the horses are older, and the majority would be sold for $25,” she said.

How is it that climate change is negatively affecting the health of rivers and, by extension, the quality and availability of fresh water?

Global warming is no doubt going to cause many kinds of problems (and, indeed, already is), and rivers may well be some of the hardest hit geographical features, given the likelihood of increased droughts, floods and the associated spread of waterborne diseases. For one, rivers are already starting to lose the amount of water they channel. A 2009 study at the National Center for Atmospheric Research (NCAR) found that water volume in the Columbia River in the Pacific Northwest declined by 14 percent since the 1950s. This trend is similar in major rivers all over the world. “Many communities will see their water supplies shrink as temperatures rise and precipitation patterns shift,” reports the nonprofit American Rivers, adding that a rise in severe storms will degrade water quality and increase the risk of catastrophic floods. “Changes in the timing and location of precipitation combined with rising levels of water pollution will strain ecosystems and threaten the survival of many fish and wildlife species.” These shifts will have dramatic impacts, threatening public health, weakening economies and decreasing the quality of life in many places. In the U.S., the number of storms with extreme precipitation has increased 24 percent since the late 1940s-and the trend is expected to continue. Another certain impact on rivers is more pollution as more frequent and powerful storms increase runoff from urban and agricultural areas that contain fertilizers, pesticides, chemicals and motor oil. “In older communities where storm water and sewage
are transported together in one pipe, heavy storms can overwhelm the system and send raw sewage and polluted storm water into nearby streams and rivers,” says American Rivers. “These combined sewer overflows will grow more frequent as extreme storms increase.” Lower water flows and rising temperatures compound problems caused by more runoff. “More frequent droughts and shifting precipitation patterns lower water levels in rivers, lakes and streams, leaving less water to dilute pollutants,” says the group. “Higher temperatures cause more frequent algal blooms and reduce dissolved oxygen levels, both of which can cause fish kills and do significant harm to ecosystems.” American Rivers reports that the health of our rivers in the face of increasing warming will depend largely on community preparedness. Municipalities that fail to address aging infrastructure “will experience greater increases in storm water runoff and sewer overflows.” And communities that have damaged their wetlands, forests, streams and rivers will have fewer natural defenses to protect against the effects of climate change. There is much we can do to protect rivers besides reduce our carbon footprints. American Rivers is promoting green infrastructure-an approach to water management that protects, restores or mimics the natural water cycle-as the way to bolster the health of rivers. “It means planting trees and restoring wetlands rather than building a new water treatment plant. It means choosing water efficiency instead of building a new water supply dam. It means restoring floodplains instead of building taller levees.”. Fishermen hoping for help with Sandy storm losses WAYNE PARRY Associated Press

While Superstorm Sandy did highly visible damage to homes, boardwalks and roads, it also walloped the Northeastern fishing industry, whose workers are hoping for a small piece of any future disaster assistance that Congress might approve. The storm did millions of dollars’ worth of damage to docks, fish processing plants and restaurants. But it also caused millions more in lost wages to boat employees who couldn’t work for two to three weeks, to truck drivers who had nothing to transport, and to other assorted industries that service commercial fishing. The $9.7 billion measure to fund the National Flood Insurance program, passed by Congress on Friday, did not include anything for the fishing industry; a bill the Senate passed in December would have allocated $150 million for that purpose. Some of the worst damage to fisheries in the region occurred at the Belford Seafood Cooperative on the Raritan Bay shoreline in Middletown, where the pounding waves destroyed a 75-foot-long dock, gutted a popular restaurant, and ripped away all five garage doors and parts of the exterior of office and storage buildings. The co-op’s manager, Joe Branin, estimates the damage at close to $1 million. “We went three weeks before we were able to pack a fish,” said Branin, whose business was still without electricity in midDecember. “We lost almost all our equipment. It was three weeks before anybody could do anything.” The restaurant, where diners could eat scallops and fillets literally right off the boat, had provided $5,000 to $8,000 a week in revenue that is now gone. The co-op supported 50 families who either work directly for it or in supporting roles. Many of those workers simply did without a paycheck for weeks afterward. The situation was the same at New Jersey’s Viking Village port on Long Beach Island’s Barnegat Light, where boats were idled after the storm. “We couldn’t get to work for two weeks because the infrastructure was all torn up here,” said Bob Brewster, who owns three of the port’s 45 fishing boats and estimates he lost between $10,000 and $20,000 in lost catch. “We were just twiddling our thumbs, waiting to get back out on the water. Everybody wants to make a living, and for a while, we couldn’t.” In Hampton Bays, N.Y., Doug Oakland estimated two marinas he owns suffered between $800,000 and $1 million in damage. He estimates about a dozen other marinas in the eastern Long Island community were similarly affected. “The marinas got beat up pretty hard. There’s a 75-foot section of our pier that’s just gone,” he said. “There was about three to four weeks right after the storm where all the fish kind of disappeared,” he said. “The first two weeks, fishermen couldn’t even get out because a lot of their gear was buried in sand. With the gas shortage, there were no fuel trucks, and there really was no market to sell the fish to because nobody had power. There was no sense in even trying to catch them.” Though most of the individual boats up and down the East Coast escaped damage,
they were forced to stay at the dock because of a combination of problems. That included damage to their home ports; torn-up roads that forced street closures and kept workers, truck drivers, and customers from reaching the docks; the disruption to normal fishing patterns after the storm that saw many profitable species chased away until the following year; and even difficulty in getting in and out of ports because of new sand bars. A strong nor’easter a week after Sandy just made things worse. “We couldn’t get trucks to transport the product,” said Dwight Kooyman, who manages two of Viking Village’s scallop boats. “I have five guys that work for me that couldn’t work that entire time. If they don’t work, they don’t get paid.” They’re all waiting to see whether Congress includes them in the billions of dollars in storm reconstruction aid it is considering. Less than three weeks after the Oct. 29 storm, the U.S. Commerce Department declared a fishery resource disaster for New Jersey and New York. But all that did was authorize the federal government to disburse any aid that Congress approves. Specific plans for applying for and distributing any aid to fishermen still have to be formulated. Dale Parsons is a fifth-generation fisherman at the Jersey shore, who owns a shellfish business in Tuckerton, and who used to own a commercial hatchery for tiny clams and oysters on the edge of Barnegat Bay — until Sandy destroyed it, causing several hundred thousand dollars’ worth of losses. “It was millions of oysters and clams that won’t be spawned next year,” he said. “Even if we rebuild right now, it will take a good year, year and a half to get it together. It’s going to take a long time coming.” The damage to seafood processors and docks is only part of the industry’s problems, Parsons said; he also fears reduced business from restaurants who see fewer tourists this summer and order less seafood. “I’m just waiting to see what kind of business there’s going to be in the spring,” he said. “No one knows yet.” Sandy also affected recreational fishing businesses, including coastal bait and tackle shops that were flooded. New Jersey officials are soliciting damage reports from individual businesses to help make the case that they need direct federal grants, not just loans. The state’s recreational fishing industry estimates it lost $160 million from the storm. Bonnie Brady, executive director of the Long Island Commercial Fishing Association, said charter fishing boats suffered greatly because people were just not taking fishing trips in the weeks following the storm. “The trains weren’t running, there was no gas to get out to the docks, so I’d say they lost substantial income,” she said. In some places, Sandy actually appears to have helped, rather than hurt, the fishing industry. Maryland environmental officials say an influx of fresh water into the Chesapeake Bay may benefit the oyster population by helping to keep the disease known as dermo in check. Gibby Dean, president of the Chesapeake Bay Commercial Fishermen’s Association, said the oyster harvest is the best it’s been in a long time — so good that people are giving up crabbing to go after oysters.

“We respect the talent and like what he is doing, so we are standing behind him,” Salke said. She said there’s been a spate of programs about creepy killers because they’ve been such indelible characters. Greenblatt said he wasn’t trying to be glib, but one of the best tonics for people upset about real-life violence is to watch an episode of NBC’s “Parenthood.” He said it’s a great example of a family that loves each other and grapples with many issues. “Ultimately, I think you feel good at the end of the day,” he said.

Bills enacted in special sessions take effect in 90 days, while regular session bills cannot take effect until the following year. Open enrollment on the exchanges is scheduled to start in October. Dooley said legislation will be needed to set eligibility rules for Medi-Cal, the state’s program for the poor, and to make sure California’s rules for pre-existing medical conditions comply with federal law. Despite their supermajorities, some Democratic say they want to move cautiously, fearing a backlash if they can’t restrain the most liberal members of their party. Assembly Speaker John Perez, D-Los Angeles, has said he sees little change in direction. But Senate President Pro Tem Darrell Steinberg of Sacramento already has embraced proposals by two Senate Democrats to tinker with Proposition 13, the landmark 1978 property tax initiative, which also increased the number of votes needed to pass local tax increases. Democratic Sens. Mark Leno of San Francisco and Lois Wolk of Davis want law-
makers to put constitutional amendments before voters that would lower the vote threshold to raise taxes for school districts and some other local governments from the current twothirds to 55 percent. Meanwhile, Assemblyman Tom Ammiano of San Francisco is proposing a change that would require businesses to pay higher property taxes. Steinberg also is working with Rubio to hash out changes to the California Environmental Quality Act. They, and Brown, say the four-decade-old law provides valuable protections but has been used to unduly delay worthwhile projects, costing California jobs. “Being green and promoting growth in California are not mutually exclusive,” Rubio said. The proposal could end up splitting the Democratic caucus between its liberal and moderate wings, he said, forcing businessfriendly Democrats to form an alliance with Republicans who otherwise will play little role in the two-year legislative session. Republicans are so powerless that even business groups are pinning their hopes on moderate Democrats to block legislation they say would harm the state’s economy. California’s new top-two primary system lets business organizations throw their financial support behind the more moderate candidate in same-party runoff elections in November, said Rob Lapsley, president of the California Business Roundtable, which represents the state’s major employers.
They are counting on that political investment to pay off as Democrats consider raising taxes on businesses, boosting the minimum wage and making it easier for lawyers to sue businesses — all topics that Lapsley expects to arise this year. New senators had not even been sworn into office when a 20-minute Democratic caucus last month erupted into a discussion of whether Democrats’ new supermajorities indicated a voter mandate to make sweeping changes or reflected rare and possibly fragile victories in what traditionally have been Republican-leaning areas. Sen. Lou Correa of Anaheim is among those urging caution. Democrats benefited from a strong re-election showing by President Barack Obama, a one-time flurry of online registrations by young voters and energetic labor opposition to a ballot measure that would have prohibited unions from collecting money for political purposes through payroll deductions. To keep their supermajorities, “we need to focus on deregulation and encouraging jobs to stay in California while protecting the environment,” Correa said. “I think it will be a very strong, healthy debate in our caucus over where we want to go.” Members will devote the early weeks of the legislative session to introducing thousands of bills that will be considered in committees this spring. Among some of the early proposals: • Students majoring in science, technology, engineering or math would be eligible to earn

a bachelor’s degree for just $10,000 under a pilot program proposed by Assemblyman Dan Logue, R-Linda. His AB51 counts on students earning some college credits while in high school, then heading to community college before finishing up at California State University campuses. Annual tuition at CSU campuses is about $5,470, plus an additional $2,000 for fees and books. • Campaign donors would have to reveal more information and the Fair Political Practices Commission would gain more power under several bills introduced by Democrats. The measures respond to an $11 million donation from an obscure out-ofstate organization during the last campaign. AB45 by Assemblyman Roger Dickinson of Sacramento would require that large donors’ identities be revealed, while SB52 by Sens. Mark Leno of San Francisco and Jerry Hill of San Mateo would require more disclosure of groups funding political ads. SB3, by Sens. Leland Yee of San Francisco and Ted Lieu of Torrance, would require nonprofits to reveal the donors behind large contributions. • California would establish a Homeless Person’s Bill of Rights under a bill by Assemblyman Tom Ammiano, D-San Francisco. AB5 responds to local laws against urban camping, sleeping, loitering and even sitting and lying down. It would protect the homeless from discrimination by police, employers or in obtaining public benefits, while giving them the right to use public spaces and retain their personal property.

SHOP FROM PAGE 1 Colby Evett’s completed versions of the planes hang caught in perpetual flight from the ceilings. It’s the kind of place that not only sells last-minute gifts, but wraps them for you too on the way to the party. Colby Evett is a frail 93, but continues to go into the shop every day. Although poor eyesight means he can no longer take an active role in sales and repairs, Evett’s mind is still sharp and he fields questions about the many bits and bobs in his store with ease. Grateful patrons, many of whom have been coming to the store since they were too small to see over the counter, waded through a crowd of visitors to greet Colby and Yvonne. It felt like a family reunion — cries of “Oh my god, darling!” echoed through the store as childhood friends rediscovered each other and reminisced about the days of five-cent Hershey’s chocolate bars and the old five-and-dime shop. John Wilson, a lifelong Santa Monica resident, got his start at the store building World War II-era model airplanes. He still pops in occasionally, despite the fact that his model-building tendencies veer toward ships in bottles these days. Evett came to California from South Carolina for the Golden State’s burgeoning aviation industry. He got a job at the Douglas Aircraft Company where he worked for 13 years. Evett’s first wife, Mary, opened the shop in 1948 when Evett was still working at the Douglas Aircraft Company in Santa Monica. It took seven years, but he left a secure and lucrative job as a plant foreman to run the store full time. “I spent a life playing with my hobbies,” Evett said. Evett was himself, an enthusiast. He built the model aircraft from the ground up, spending months at a time constructing the delicate creations out of light wood and thin paper. His experience with real airplanes and his love of flight inspired him to do what was, at the time, a revolutionary act — pairing radio technology with his planes, which allowed him to control the aircraft from the ground. “I felt that was the future,” Evett said.

Released by Focus Features, “Promised Land” stars Damon as a salesman pitching rural residents on fracking technology to drill for natural gas. The film widened to 1,676 theaters, averaging a slim $2,573 a cinema, compared with $8,666 in 2,654 theaters for “Texas Chainsaw.” Hollywood began the year where it left in

He also helped found Apollo Field, a model aircraft airspace, in the valley as well as the Valley Flyers club. In 1955, the shop moved from its original location on Pico Boulevard to its current storefront on Ocean Park Boulevard. Cathy, Evett’s daughter, practically grew up in the store with her mother and father. “I learned math counting change in the cash register,” she said. Yvonne and Evett Colby married in 2000, and she began helping out with the shop. The mother of seven had never played with models before, but she enjoyed the interaction with the customers and learning the business. Things have changed since Cathy Evett was learning her numbers at the counter, and even since Yvonne came on board to man the storefront. Kits come practically pre-assembled, depriving kids of the chance to spend time exploring the way the components come together to make the models work. It’s still a step up from the big box stores and online retailers, the small store’s chief competition. Luke Orrins, a radio-controlled model enthusiast and all-around model MacGyver dismisses those trinkets as “disposable” because they come glued together in such a way that they can’t be disassembled and repaired. It’s in small stores like Evett’s where the magic still happens, he said. Despite the enthusiasm some in the community still hold for the store, it has had difficulty holding on as the ease of online purchasing has made it more convenient for model builders to order things online rather than come to the store. “The Internet has done a number on us,” Yvonne Evett said. Their suppliers undercut them in online sales, making it more expensive to frequent the shop than to take your chances with the digital stores. Still, the store gets by on its holiday sales, spare parts and solid customer service where so many others have failed. Yvonne Evett doesn’t plan to close anytime soon. “We’re going to keep the doors open as long as we can,” she said. ashley@smdp.com

Overall business this weekend came in at $149 million, up 7 percent from the same period last year, when “The Devil Inside” led with $33.7 million, according to box-office tracker Hollywood.com. But with strong business on New Year’s Day last week, Hollywood already has raked in $254.2 million, 33 percent ahead of last year. Box-office results ebb and flow quickly, so that lead could vanish almost overnight. But with a steady lineup of potential hits right through December, studios have a chance at another revenue record this year. “The month that we had at the end of last year that led us to a record year continued right through New Year’s and on now to the first official weekend of 2013,” said Hollywood.com analyst Paul Dergarabedian. “We’re looking for an even stronger year this year. That’s in the realm of possibility. But we have 51 weekends to go.” Estimated ticket sales for Friday through Sunday at U.S. and Canadian theaters, according to Hollywood.com. Where available, latest international numbers are also included. Final domestic figures will be released Monday.

CHART FROM PAGE 1 Here’s how it works: During any routine check of vital signs, a nurse or medical assistant asks how many days a week the patient exercises and for how long. The number of minutes per week is posted along with other vitals at the top the medical chart. So it’s among the first things the doctor sees. “All we ask our physicians to do is to make a comment on it, like, ‘Hey, good job,’ or ‘I noticed today that your blood pressure is too high and you’re not doing any exercise. There’s a connection there. We really need to start you walking 30 minutes a day,’” said Dr. Robert Sallis, a Kaiser family doctor. He hatched the vital sign idea as part of a larger initiative by doctors groups. He said Kaiser doctors generally prescribe exercise first, instead of medication, and for many patients who follow through that’s often all it takes. It’s a challenge to make progress. A study looking at the first year of Kaiser’s effort showed more than a third of patients said they never exercise. Sallis said some patients may not be aware that research shows physical inactivity is riskier than high blood pressure, obesity and other health risks people know they should avoid. As recently as November a government-led study concluded that people who routinely exercise live longer than others, even if they’re overweight. Zendi Solano, who works for Kaiser as a research assistant in Pasadena, Calif., says she always knew exercise was a good thing. But until about a year ago, when her Kaiser doctor started routinely measuring it, she “really didn’t take it seriously.” She was obese, and in a family of diabet-
We have you covered ics, had elevated blood sugar. She sometimes did push-ups and other strength training but not anything very sustained or strenuous. Solano, 34, decided to take up running and after a couple of months she was doing three miles. Then she began training for a half marathon — and ran that 13-mile race in May in less than three hours. She formed a running club with co-workers and now runs several miles a week. She also started eating smaller portions and buying more fruits and vegetables. She is still overweight but has lost 30 pounds and her blood sugar is normal. Her doctor praised the improvement at her last physical in June and Solano says the routine exercise checks are “a great reminder.” Kaiser began the program about three years ago after 2008 government guidelines recommended at least 2 1/2 hours of moderately vigorous exercise each week. That includes brisk walking, cycling, lawn-mowing — anything that gets you breathing a little harder than normal for at least 10 minutes at a time. A recently published study of nearly 2 million people in Kaiser’s southern California network found that less than a third met physical activity guidelines during the program’s first year ending in March 2011. That’s worse than results from national studies. But promoters of the vital signs effort think Kaiser’s numbers are more realistic because people are more likely to tell their own doctors the truth. Dr. Elizabeth Joy of Salt Lake City has created a nearly identical program and she expects 300 physicians in her Intermountain Healthcare network to be involved early this year. “There are some real opportunities there to kind of shift patients’ expectations about the value of physical activity on health,” Joy said.

WASHINGTON Congressional leaders on Sunday showed no signs of emerging from their corners to resolve the next step in the financial crisis, with Democrats still talking about higher taxes on the wealthy and the Senate’s top Republican suggesting that a crippling default on U.S. loans was possible unless there were significant cuts in government spending. “It’s a shame we have to use whatever leverage we have in Congress to get the president to deal with the biggest problem confronting our future, and that’s our excessive spending,” said Sen. Mitch McConnell, R-Ky. Last week’s deal to avert the combination of end-of-year tax increases and spending cuts known as the “fiscal cliff ” held income tax rates steady for 99 percent of Americans but left some other major pieces of business unresolved. By late February or early March, the Treasury Department will run out of options to cover the nation’s debts and could begin defaulting on government loans unless Congress raises the legal borrowing limit, or debt ceiling. Economists warn that a default could trigger a global recession. Also looming are deep automatic spending cuts expected to take effect at the beginning of March that could further erase fragile gains in the U.S. economy. Then on March 27, the temporary measure that funds government activities expires, and congressional approval will be needed to keep the government running. It’s one more chance to fight over spending Lawmakers said debt talks will consume Congress in the coming weeks, likely delaying any consideration of an expected White House proposal on gun restrictions in the wake of the Connecticut school shooting. Republicans say they are willing to raise the debt ceiling but insist any increase must be paired with significant savings from Medicare, Medicaid and other government benefit programs. President Barack Obama has said he’s willing to consider spending cuts separately but won’t bargain over the government’s borrowing authority. “One thing I will not compromise over is whether or not Congress should pay the tab for a bill they’ve already racked up,” Obama said in his weekly radio and Internet address. Democrats said further tax increases for the wealthiest Americans were still possible as Congress looks to close the gap between revenues and expenditures. Democrats point out that Obama has already agreed to significant spending cuts, and that the latest deal only gets the nation to about half of the revenue it needs to resolve the red ink. “Trust me, there are plenty of things
within that tax code — these loopholes where people can park their money in some island offshore and not pay taxes. These are things that need to be closed. We can do that and use the money to reduce the deficit,” said Illinois Sen. Dick Durbin, the secondranking Senate Democrat. House Democratic leader Nancy Pelosi of California said she, too, wants to put “everything on the table from the standpoint of closing loopholes.” But McConnell bluntly declared that the “tax issue is over” after last week’s agreement. “We don’t have this problem because we tax too little; we have it because we spend too much,” McConnell said. Making the rounds on the Sunday talk shows, McConnell was asked repeatedly whether Republicans were prepared to see the nation default on its spending obligations. McConnell said that wouldn’t be necessary, so long as Obama agrees to the spending cuts. But at one point, when asked by NBC’s David Gregory whether the GOP strategy will be to hold the debt ceiling “ransom” in exchange for spending cuts, McConnell said it was a “shame we have to use whatever leverage we have” to get the president’s attention. “None of us like using situations like the sequester (automatic across-the-board spending cuts) or the debt ceiling or the operation of government to try to engage the president to deal with this,” McConnell said. Sen. Lindsay Graham, R-S.C., didn’t dismiss the idea of allowing a partial shutdown of government until an agreement can be reached. Texas Sen. John Cornyn and other Republicans have floated the idea of a shutdown as a way of winning deeper spending cuts. “I believe we need to raise the debt ceiling, but if we don’t raise it without a plan to get out of debt, all of us should be fired,” Graham said. Maryland Rep. Chris Van Hollen, the top Democrat on the House Budget Committee, said the Republican strategy amounted to: “Give us what we want ... or we’re going to tank the United States economy.” Pelosi said she believes the president has enough authority under the 14th Amendment to raise the debt ceiling without Congress’ blessing. But the White House has said previously that it does not believe that the amendment — which says the “validity” of public debt shouldn’t be questioned — gives the president that power. McConnell spoke on NBC’s “Meet the Press,” ABC “This Week” and CBS “Face the Nation.” Pelosi was on CBS. Durbin and Graham appeared on CNN’s “State of the Union” and Van Hollen was interviewed on “Fox News Sunday.”

My Personnel File: Why Do I Want it and How Do I Get a Copy? T
he permanent record from our youth may have been a ruse cooked up to keep children in line, but these days, we are close to having permanent records due to our rapidly all encompassing digital world.Thankfully, personnel files are not yet in digital format.While we still can, we should at least always be prepared to have access to these records to check and to fix any wrong information.We may also want access when we think we should get a raise and want to use former evaluations, client letters, or training records to get it. Thee Why: More often than not, employees do not even know how to access this information until they talk to a lawyer.And if you are talking to a lawyer about work, something's already gone wrong. Lawyers want to see what your performance record is, any personnel actions and the basis, or any other records that could help determine whether, say, a termination was legally wrongful or justifiable in light of the bigger history. Most of these employment cases turn on performance, the reason the employer gives for the termination, versus whatever you as a plaintiff will show. For example, one good way to maintain better records in your file is to put in writing what you disagree with, such as in a negative evaluation. Later when these are reviewed, and the employee has these notes, it will be more difficult for a bad employer to justify their wrongful behavior through performance issues. Another reason to keep track is that personnel records can be subpoenaed by a third party,which is something that could happen in any type of legal action where you are involved.The law does require that you are given a notice and opportunity to object to the subpoena.If any of it is relevant to whatever legal action is happening,not necessarily even an employment case,then usually the subpoena is allowed.
Thee How: There are no federal laws about these records, but California has very clear laws. Still, some employers do not know them or follow them properly so it is better to know your rights and educate your employer if needed. Here are the types of records that you are legally entitled to get: Pay Records: Employers have to keep for at least three years of your pay records and give their employees a copy within 21 days of request or face civil penalties (Labor Code 226).Personnel Files: Employers have to keep records and give you access to them within a reasonable time (Labor Code 1198.5).All documents you signed:These are the ones signed at hire or as continuing term and condition of employment (not documents signed in the course of conducting business). (Labor Code 432). Tips: Though these requests do not have to be in writing, it is usually better so that you can keep track of the response time. Employers may have part of your personnel file in different offices. Be sure to know where yours is kept so when the time comes you know how to find it without being given the run around. Ask for or make copies of all personnel documents as they come up and hold on to the hiring paperwork so that you have your own set for comparison later.
Unemploymentt Benefits:: Do o I Qualify? The news is not getting better about the economy and the unemployment office has to be really picky when it comes to claims.You were not laid off, but instead quit or were terminated. How can you file for unemployment and be approved? This is one of the most often asked questions from my clients. Some who are still working want to know if they should quit or wait to be terminated.The decision will vary from person to person to situation.The decision can also be personal or health related or that you just want to be out of there. Here are some legalities to consider in your decision. Thee Quit: In a situation with a quit, there is generally just one type of circumstance that will get you these benefits. If you can show that you quit because the work conditions were such that no reasonable person could be expected to work there, then you can still qualify for the benefits.This is a high standard limited to what the law requires of the workplace, such as safe conditions, free from harassment, being paid, and free from retaliation.This is not an easy showing to make and so arguments based on personality, rudeness, bad bosses, etc, will not fly. on: Thee Terminatio Most people think that if you have been terminated, there is no unemployment for you. However, there are exceptions to this. Of course, if you have been terminated based on policy violations, gross misconduct, and other severe actions, then you are disqualified. One way to overcome that, if the facts are there, is the exception that the conduct may not have been appropriate but it was an isolated instance of poor judgment, or something excusable that happened the one time for a good reason. Criminal activity at work or assault or harassment is never excusable. Thee Wrongfull Termination: If you have been "wrongfully terminated" in the legal sense,you may still qualify for unemployment.Most employees who file lawsuits have been terminated.If the facts are there for a lawsuit,then they should be there to qualify you for unemployment.You need to show that the termination was not based on whatever the employer is claiming,but because of some legal violation they have committed.For example,if you complain of sexual harassment,then a week later,you are terminated for some work issue that happened two months ago,then the termination was retaliation.When an employer retaliates for your report of a prohibited workplace activity,that employer just violated anti-retaliation laws. Tip: If you are unemployed but develop a disability and you can't work, then you no longer qualify for unemployment.At this point, apply for State Disability Benefits.Again, these is not easy to get and you will need medical proof, but it is one safety we are lucky to have here in California.

hotel, knowing they were running out of time to save their season. After 16 hours of tense talks, the NHL and its players finally achieved their elusive deal early Sunday morning, finding a way to restart a sport desperate to regain momentum and boost its prominence. Ending a bitter dispute that wiped out a large part of the hockey season for the third time in less than two decades, the league and its union agreed to the framework of a 10year labor contract that will allow a delayed schedule to start later this month. On the 113th day of a management lockout and five days before the league’s deadline for a deal, the bleary-eyed sides held a 6 a.m. news conference to announce there will be a season, after all. NHL Commissioner Gary Bettman and union head Donald Fehr both appeared drained, wearing sweaters and not neckties, when they stood side by side at the hotel and announced labor peace. “We have reached an agreement on the framework of a new collective bargaining agreement, the details of which need to be put to paper,” Bettman said. “We’ve got to dot a lot of Is, cross a lot of Ts. There’s still a lot of work to be done, but the basic framework of the deal has been agreed upon.” Lawyers will spend the next few days drafting a memorandum of agreement. The stoppage led to the cancellation of at least 480 games — the exact length of the curtailed schedule hasn’t been determined — bringing the total of lost regular-season games to a minimum 2,178 during three lockouts under Bettman. The agreement, which replaces the deal that expired Sept. 15, must be ratified by the 30 team owners and approximately 740 players. “Hopefully, within just a very few days, the fans can get back to watching people who are skating, and not the two of us,” Fehr said. Fehr became executive director of the NHL Players Association in December 2010 after leading baseball players through two strikes and a lockout. Players conceded early on in talks, which began in June, that they would accept a smaller percentage of revenue, and the negotiations were about how much lower. “It was a battle,” said Winnipeg Jets defenseman Ron Hainsey, a key member of the union’s bargaining team. “Players obviously would rather not have been here, but our focus now is to give the fans whatever it is — 48 games, 50 games — the most exciting season we can.” With much of the money from its $2 billion, 10-year contract with NBC back loaded toward the Stanley Cup playoffs in the spring — and now perhaps early summer — the league preferred to time the dispute for the start of the season in the fall. Management made its decision knowing regular-season attendance rose from 16,534 in 2003-04 to 16,954 in 2005-06 and only seven teams experienced substantial drops. Flyers chairman Ed Snider told The Associated Press he was glad a partial schedule had been salvaged. “I’m thrilled for our fans, I’m thrilled for all of our people that work around our sport that have been hurt by this,” he said. “I’m thrilled for the players, for the owners. I’m just sorry it had to take this long. The great thing is, we don’t have to look at it for hopefully 10 years, or at worst eight, and that’s
good stuff.” Still, the lockout could wipe out perhaps $1 billion in revenue this season, given about 40 percent of the regular-season schedule won’t be played. And while the stoppage was major news in Canada, it was an afterthought for many American sports fans. “They could have gotten here a lot sooner,” said Marc Ganis, president of Chicagobased sports business consulting firm Sportscorp Ltd. “They didn’t hear a hue and cry from the fans, especially in the United States, when hockey wasn’t played. That’s very distressing. That indicates there’s a level of apathy that is troubling. In contrast, in the NFL when there was a threat of canceling a preseason weekend, the nation was up in arms.” At downtown Detroit’s Rub BBQ Pub, manager Chris Eid said he was “ecstatic” when he heard the news. He said the settlement was a big topic of conversation among his afternoon customers. “Everyone misses hockey,” Eid said. Hockey’s first labor dispute was an 11day strike in 1992 that led to 30 games being postponed. Bettman, a former NBA executive under David Stern, became the NHL commissioner in February 1993. He presided over a 103-day lockout in 1994-95 that ended with a deal on Jan. 11, then a 301day lockout in 2004-05 that made the NHL the first major North American professional sports league to lose an entire season. The NHL obtained a salary cap in the agreement that followed that dispute and now wanted more gains. “It was concessionary bargaining right from the beginning,” Phoenix Coyotes captain Shane Doan said. “As the players, you kind of understand that and you accepted that. As much as you didn’t want to, we understand that the nature of professional sports has kind of changed with the last couple CBAs starting with football and basketball.” This deal was reached with the assistance of Scot Beckenbaugh of the Federal Mediation and Conciliation Service, a veteran of the 2004-05 NHL talks, then Major League Soccer’s negotiations in 2010 and NFL and NBA talks the following year. Beckenbaugh spent Friday walking back and forth between the league’s office and the hotel where players were staying, meeting with each side to set up the final talks. “Fans throughout North America will have the opportunity to return to a favorite past time and thousands of working men and women and small businesses will no longer be deprived of their livelihoods,” said George Cohen, the FMCS director. Sam Flood, NBC Sports’ executive producer, said his production team was “counting the seconds until the season begins.” NBC announcer Mike Emrick said players will have more pressure because of the shortened schedule. “The effect of even a two-game losing streak will be four,” he said The NHL’s revenue of $3.3 billion last season lagged well behind the NFL ($9 billion), Major League Baseball ($7.5 billion) and the NBA ($5 billion), and the deal will lower the hockey players’ percentage from 57 to 50 — owners originally had proposed 46 percent. This was the third lockout among the major U.S. sports in a period of just over a year. A four-month NFL lockout ended in July 2011 with the loss of only one exhibition game, and an NBA lockout caused each team’s schedule to be cut from 82 games to 66 last season.

■ Updating "The Smell of Napalm in the Morning": A cosmetics company in Gaza recently began selling a fragrance dedicated to victory over Israel and named after the signature M-75 missile that Hamas has been firing across the border. "The fragrance is pleasant and attractive," said the company owner, "like the missiles of the Palestinian resistance," and comes in masculine and feminine varieties, at premium prices (over, presumably, the prices of ordinary Gazan fragrances). Sympathizers can splash on victory, he said, from anywhere in the world. ■ The Philadelphia Traffic Court has been so infused with ticket-fixing since its founding in 1938 that a recent Pennsylvania Supreme Court report on the practice seemed resigned to it, according to a November Philadelphia Inquirer account. One court employee was quoted as defending the favoritism as fair (as long as no money changed hands) on the grounds that anyone could get local politicians to call a judge for him.
