CALIFORNIA AT OCEAN It seems like every denizen of the Westside is empowered with a smartphone equipped with a camera, and they use them, for good or for ill. Pictures of the Santa Monica Pier abound, as do surreptitious shots of high-priced meals at fancy restaurants snapped before disapproving waiters can discourage the practice. All aspects of the world are processed through one of a multitude of flattering filters that can take your umpteenth photo of that neighbor kid’s kite and imbue it with the sepia-tinged tragedy of spent youth. Chris Blough takes a different
approach. Armed only with an iPhone, Blough documents the Westside with an eye for composition that puts some traditional photography to shame. He compiled a second book of his photos entitled “California at Ocean” referencing the intersection near his Santa Monica domicile and inspiration for many of the shots, which lean heavily on landscapes and static objects best captured through the phone lens. A light treatment with photoediting app Snapseed for color saturation and clarity, and the images are ready to go. His work has won widespread recognition within the Instagram photo community — one of the

Report: State parolees disarming tracking devices Associated Press

Calif. Thousands of California parolees, many of them sex offenders, are removing court-ordered GPS monitors, often with little risk of serving time because state prisons are too full to hold them, according to an investigation. More than 3,400 arrest warrants for convicts who tampered with tracking devices have been issued since October 2011, when the state began referring parole violators to county jails instead of returning them to its overflowing prisons, the Los Angeles Times reported.
Nearly all of the warrants were for sex offenders, who are the vast majority of parolees with GPS monitors, and many were for repeat violations, the newspaper said. “It’s a huge problem,” Fresno parole agent Matt Hill told the Times. “If the public knew, they’d be shocked.” The shift to county jails comes as part of Gov. Jerry Brown and the legislature’s “realignment” program, to comply with court orders to ease overcrowding in state prisons. But many counties have been under their own court orders to reduce the populations of their jails. Some counties have freed parole violators
within days, or even hours, of arrest rather than keep them in custody, the Times said. Some have refused to accept them at all. Before prison realignment took effect, sex offenders who violated parole remained behind bars, awaiting hearings that could send them back to prison for up to a year. Now, the maximum penalty is 180 days in jail, but many never serve that time. With so little deterrent, parolees “certainly are feeling more bold,” Jack Wallace, an executive at the California Sex Offender Management Board, told the newspaper. Rithy Mam, a convicted child stalker, was
arrested three times in two months after skipping parole and was freed almost immediately each time. After his third release, his GPS alarm went off and he vanished, law enforcement records show. Police say Mam menaced a 15-year-old girl and her 13-year-old sister, getting in their home by giving candy to a toddler, before authorities recaptured him in a local park. He is in custody on new charges of child molestation. Californians voted in 2006 to require that high-risk sex offenders be tracked for life with the monitors, which are attached to rubber ankle straps embedded with fiberoptic cable. The devices transmit signals monitored by a private contractor. Arrest warrants for convicts who tamper with their monitoring devices are automatically published online. The Times reviewed that data as well as thousands of jail logs, court documents and criminal histories provided by confidential sources. The records show that the way authorities handle violators can vary significantly by county. A proposal by Democratic state Sen. Ted Lieu would require that parolees who tamper with their GPS monitors be sent back to prison for up to three years. Other lawmakers have similar bills in the works, the Times said. The Santa Monica Conservancy this Sunday intends to give The Rehabilitation Award to Community Corp of Santa Monica (CCSM) for rehabilitating a number of older multi-family buildings in the city. Given CCSM’s history of destroying historical homes in the Pico Neighborhood, this is just shocking. Let’s look at recent history. Joe and Rosemary Kessler over time bought every home on High Place. It was lovingly referred to as Kesslerville by Pico Neighborhood residents. Almost all the homes on High Place were California craftsman bungalow houses that are on the city’s Survey of Historic Resources, some over 90 years old. In Ocean Park when developers threatened to buy up and tear down craftsman bungalows on Third Street south of Ocean Park Boulevard to build multi-family housing, City Hall stepped in. An historic district was created and these beautiful California craftsman bungalows were preserved. CCSM bought a craftsman bungalow at 2303 Fifth St. in Ocean Park and preserved it as rental housing. That is not what CCSM and City Hall did in the Pico Neighborhood. In 2002, City Hall gave CCSM the money to buy Kesslerville; all the craftsman bungalows on High Place and adjacent Virginia Avenue. CCSM evicted the tenants and demolished the eight to nine beautiful bungalow homes on the street to build highdensity rental housing. An organization that shows disrespect for the historical properties in the Pico Neighborhood does not deserve this award.

Lincoln Blvd. bus lanes another planning disaster SEVEN YEARS AGO, THE CITY COUNCIL
approved a plan to convert curb parking lanes for “bus and bicycle only” use on Lincoln Boulevard from the city border with Venice to Michigan Avenue. I wrote about it numerous times in 2005, saying it was a dumb idea. Parking would be eliminated on northbound curb lanes during morning rush hours and the southbound curb lanes during evening rush hours. I noted that only eight Rapid/Regular No. 3 Big Blue Buses ran on the 1.5 mile-stretch at peak hours and there just wasn’t enough bus use to justify the lanes. City staff claimed the lanes would save up to eight minutes of bus time. I figured a minute or two. It turns out that I was correct because staff hadn’t included passenger boarding and disembarking times in their original figures. In the meantime, staff was waiting for a similar scheme to be implemented on the Venice/Marina del Rey stretch of Lincoln before implementing its plan. Lincoln business owners complained that eliminating street parking would inconvenience customers. Because of their complaints and the realization that the “the overall public benefit of a very short bus-only travel lane does not significantly reduce the travel time for customers riding the service compared to the impact of traffic delays created in the segment” the plan is now on indefinite hold. While it may be dead for the time being, traffic jammers in City Hall promise the proposal could be resurrected if bus/bike lane plans were to be implemented further down on Lincoln. It seems that city traffic planners just can’t let go of stupid ideas and bad planning that only increases traffic congestion. TUMLIN STILL FOOLING HIMSELF
The Planning Commission held two public hearings this month on the Bergamot Area Master Plan. The eastern border area around Olympic Boulevard and Colorado Avenue has become the “neighborhood du jour” for developers despite citizen opposition over more traffic congestion. Enter one of city planning’s favorite unicorn chasers: Jeffrey Tumlin, a principal in Nelson-Nygaard Consulting Associates, Inc., based In San Francisco. His urban and traffic planning consultancy has received multiple city contracts totaling millions of dollars. When it comes to non-sensical and outlandish solutions to traffic and development issues, Tumlin wins the prize. Tumlin’s disdain for residents is open and obvious. In his resume posted on NelsonNygaard’s website, he describes cities — Seattle, San Francisco, Abu Dhabi and Santa Monica — where he’s solved traffic and urban planning problems unique to each location. Under “Santa Monica,” he posts, “For decades, Santa Monica politics had been dominated by NIMBYs (SIC) who used traffic fear as their primary tool for stopping development …” Aside from being absurd, the statements are offensive. I’m calling Tumlin out on his rudeness and lack of
respect for his clients. Tumlin ignores that Santa Monica has been dominated by social engineering politicians who, for decades, have shoved traffic calming and wishful thinking that’s created our traffic nightmares down everyone’s throats. Tumlin came up with a cockamamie theory that various sustainable practices would negate traffic increases from new development. It was “no new peak hour car trips.” However, even he realized that was ludicrous, so he amended it to “no net new p.m. peak hour car trips.” Only, that’s a fantasy, too. While still clinging to a leaky boat that’s going down fast, Tumlin actually told the Planning Commission on Feb. 13, that the proposed Bergamot Area Plan would result in a reduction of 700 p.m. peak hour daily car trips. About two-million total square feet of new projects are in the pipeline for the Bergamot area with just the pending development applications. Yet, 20,000 projected daily car trips are projected in the various applicants’ Environmental Impact Reports. City Hall planners and politicos need to do what most of us “NIMBY’s” have already done and that’s to stop listening to this mess. Time to cancel Nelson-Nygaard’s contracts. If City Hall’s decision makers want hokum and fairy tales, there’s the children’s reading room at the library — and it’s free.

‘FREEDOM MEMORIAL’ AN EXCELLENT IDEA
A lot of people think I complain a lot. So, for a change of pace, here’s something worthy of my praise. Congratulations to council persons Bob Holbrook and Kevin McKeown for suggesting a memorial to recognize the men and women from Santa Monica who served in our military services and gave their lives in defense of our freedom. Based on some excellent research by City Hall intern Ginamarie Vollucci, 97 persons have already qualified for listing on an honor wall to be erected at the mausoleum in Woodlawn Cemetery. There’ll be room for additional names to be added including those who may die in Afghanistan along with those from earlier wars who may have been overlooked or whose military records were lost or missing. Holbrook came up with the idea for the memorial and McKeown was a strong advocate for it. At their last meeting, the City Council unanimously approved establishing a private fundraising effort to raise money to pay for a “Peace Memorial.” An estimated $7,500 to $10,000 should do the trick. A public fundraising campaign will kick off at the annual Memorial Day services in Woodlawn Cemetery on May 27. I can understand the political correctness involved in not wanting to call it a “War Memorial,” but calling it a “Peace Memorial” is not accurate, either. After all, these heroes died fighting wars. LANSING, Mich. Michigan lawmakers want to crack down on can and bottle smugglers they say are scamming Michigan for undeserved recycling refunds, corrupting a generous 10-cent per container payback policy once infamously portrayed in a “Seinfeld” episode and which beverage officials now claim costs the state millions of dollars annually. “Seinfeld” characters Kramer and Newman failed miserably in their comedic attempt to cash in on the refund, when they loaded a mail truck full of cans and bottles in New York and attempted to drive them to Michigan. But lawmakers say it’s a serious problem, especially in border counties, and they want to toughen penalties on people who try to return unmarked, out-of-state cans and bottles for refunds. “If you are intending to defraud ... then you should be held accountable for it,” said Republican Rep. Kenneth Kurtz of Coldwater. He recently introduced legislation aimed at cracking down on scammers who drive car and truck loads of cans from Indiana, Wisconsin and Ohio — states that do not offer refunds — to stores across the border in Michigan. His legislation would make an attempt to return between 100 and 10,000 non-returnable containers punishable by up to 93 days in jail and a $1,000 fine. Current law sets penalties only for those who actually return fraudulent containers. Michigan’s 10 cent-per-container refund — the highest in the country — was enacted more than 30 years ago to encourage recycling. Many say it’s worked. The state’s recycling rate for cans and bottles was nearly 96 percent in 2011. By contrast, New York, one of nine states with nickel deposits on most containers, saw only a 66.8 percent redemption rate in 2007, the most recent figure available. Despite measures Michigan lawmakers have taken over the years, including tougher penalties for bottle scammers and new machines that kick out fraudulent cans, store owners and distributors along the border say illegal returns persist. Mike Hautala owns Hautala Distributing, which services Gogebic and Ontonagon counties in the western part of the Upper Peninsula near the Wisconsin border. He said for every case of beer his distributorship delivers to a store along the border, it picks
up about seven more cases of empty cans. The state loses $10 million to $13 million a year to fraudulent redemptions, according to most recent 2007 estimates from the Michigan Beer and Wine Wholesalers Association. Angela Madden, the association’s director of governmental affairs, said that number has likely gone down slightly because of changes implemented since, but not by much. Bill Nichols, store director at Harding’s Friendly Market in Niles about three miles from the Indiana border, said the store takes in about $6,000 worth of cans a week. He said every week he kicks out people for trying to return large garbage bags full of cans from Indiana, a state that offers no refund. “You can go into the parking lot and look at the license plates and see that it says Indiana,” he said. Distributors pick up the containers people drop off at stores and pay the store a dime for every container. If the distributor picks up more bottles and cans than it left — the likely result of fraudulent redemption — the distributor is left in the hole, Madden said. If the distributor picks up fewer cans than it dropped off, the money that does not go back to the store is sent to the state. Twenty five percent of that money is sent back to retailers and 75 percent is put in a fund that pays for things like environmental cleanup, she said. Hautala said he lost about $25,000 last year picking up more returned containers than he delivered. He said his company will recover some of that money from distributors who sell more containers than they pick up. In 2008, Michigan passed laws aimed at cracking down on bottle fraud. One of the primary components required manufacturers to place a special mark on Michigan cans and bottles and said those containers could only be sold in Michigan or other states that have deposit laws. A report the Department of Treasury delivered to Michigan lawmakers last fall estimated that the technology may have helped reduce redemptions of out-of-state containers by nearly 4 percent. But that reduction could also come from decline in sales, the report said. As containers were given Michigan-specific marks, vending machines used in stores to count the cans and bottles were formatted with new technology to read the mark and reject cans that come in from across the border.

Groups calling for environmental justice Dear EarthTalk: I understand that the “environmental justice” movement seeks to protect the poor and non-white communities from being unfairly targeted to host activities like sewage treatment plants, landfills and polluting factories. The environmental justice movement was born in September 1982 when a group of poor residents of rural Warren County, North Carolina laid down in front of trucks transporting waste containing toxic PCBs to a nearby landfill. Those primarily African American activists eventually lost their battle to keep toxic waste out of the area, but their actions eventually led to an executive order by President Clinton in 1996 that institutionalized the U.S. government’s duty to identify and address “disproportionately high adverse health or environmental effects of its policies or programs on low-income people and people of color.” It also mandated that the federal government look for ways to prevent discrimination by race, color or national origin in any federally funded programs dealing with health or the environment. In the time since, many other low income or minority groups-Latinos, Asians, Pacific Islanders, Native Americans and others-have learned to raise their voices and stand up against the discriminatory locating of hazardous waste landfills and transfer stations, polluting factories and utilities, and other triggers for bad air quality and compromised waterways and soils across the U.S. and beyond. Some of the better known environmental justice groups came to be out of specific struggles in their own local neighborhoods. Concerned Citizens of South Central LA (Los Angeles) was created to fight the now infamous LANCER incinerator in the late 1980s, and today provides leadership on environmental and other social justice issues
throughout southern California. Likewise, Mothers of East LA, originally formed to stop the siting of a prison in an East Los Angeles community, has become a strong voice against incinerators and other waste processing and landfill facilities interested in moving to the area. Elsewhere, West Harlem Environmental Action formed in 1998 to fight (unsuccessfully) the building of the North River Sewage Treatment Plant in West Harlem in New York City. Despite that defeat, the group is now a leader on environmental justice issues around New York State. And the Deep South Center for Environmental Justice began with humble activist roots but is now in high demand helping rural communities in Louisiana’s “Cancer Alley” protect themselves from further degradation and harm at the hands of oil refineries and other heavy industry located there. Several national organizations now devote significant resources to these issues. The Center for Health, Environment and Justice (CHEJ), which emerged out of the 1970s Love Canal controversy when the U.S. government relocated 800 families from their polluted Niagara Falls, New York neighborhood, today functions as an activist clearinghouse for related issues. The Natural Resources Defense Council (NRDC) has devoted significant resources to environmental justice efforts, including helping to identify cancer clusters in poor communities near heavy industry. Many Sierra Club local chapters battle environmental discrimination in their neighborhoods. And the federal government today provides millions of dollars to environmental justice projects through the Environmental Protection Agency (EPA) and other agencies. California winery experiments with aging wine deep in ocean BY BRUCE SMITH Associated Press
CHARLESTON, S.C. An experiment in the age-old art of winemaking began on Wednesday as a California winery submerged four cases of Cabernet Sauvignon in Charleston Harbor to see how the ocean affects the aging of the wine. Mira Winery of St. Helena, Calif., placed the bottles of wine in yellow steel mesh cages and then submerged them offshore in an undisclosed location. In three months, the wine will be removed and subjected to chemical tests and tasting by experts to see what differences it has from wine aged on land. The winery could produce and sell underwater-aged wine in the future if the trial goes well. While wineries in Europe have experimented in recent years with ocean aging of wine, the idea is novel in the United States, said Jim “Bear” Dyke Jr., the Charleston resident who owns the Napa Valley winery. At least a handful of European wineries have produced underwater-aged wine, some of which has been sold in the U.S. Winemakers have long known wine recovered from sunken ships has a unique taste and the ocean is thought to have something to do with that. Dyke and his colleagues expect the water pressure, temperature and gentle swaying from currents to produce unique effects. He would not specify the depth of the water in which the wine will be submerged. “This is a very exciting thing for me as a winemaker,” said Gustavo Gonzalez, Mira’s winemaker. “When you make wine it’s pretty much the same thing for everybody. You can change it up a bit but and see what happens and your cabernet may taste a little bit different from your neighbor’s cabernet.” The idea is to find out if ocean aging has the potential to change that, he said. “We’ll pull it out in late May and see what the effect of the water temperature, the water pressure and, more interesting to me, the
swaying motion of the water does to the wine,” he said. Michael Kaiser, the director of communications for WineAmerica, the National Association of American Wineries, said he had not heard of aging wine in water. “It’s correct it does change the makeup of the wine. When you store wine it’s not supposed to be stored underwater and especially in salinized water,” he said. “But it’s interesting that someone would experiment with it to see what it’s like.” He also suggested that wine recovered from sunken ships may simply taste better because the wine is really old, although the water may affect it as well. The wine that was sunken on Wednesday has additional wax seals and the cages are made of marine steel to withstand the ocean environment. The mesh allows the water to move around the bottles. The four cages are chained together and equipped with GPS tracking devices so they can be located in case they are moved by the currents or if an unauthorized diver decides to have an early wine and cheese party Dyke called the experiment “a beginning for us. It’s the beginning of a testing process to see if we can do this in larger quantities for a longer period of time.” The winery was founded last year. Gonzalez said the wine submerged on Wednesday is a 2009 vintage that has already been aged in a wine cellar. Depending on how the experiment goes, the winery may age some of its 2013 vintage completely in a wine cellar and some of it completely in the ocean. Once the wine is pulled from the ocean it will be chemically compared to the wine aged in a wine cellar. It will also be tasted and compared by wine experts, Dyke said. Charleston Harbor was selected for the experiment because Dyke is from Charleston and because the city is increasingly known for its fine dining. “With our southern roots in Charleston and Charleston being an historic location what better place to do this?” Dyke asked.

CP FROM PAGE 1 of only a couple hundred people that the Instagram blog follows with regularity. “The reason I like mobile is that I’m not always going to carry this,” Blough said, pointing to a considerably more powerful — and consequently bulkier — Cannon 60D. “I don’t want to miss the perfect shot because I don’t have my camera.” The iPhone 4S and 5, Blough’s mobile instruments of choice, were like the breadcrumbs that led him back to photography after a 10-year detour through the “real world.” Blough’s day job involves marketing and ad sales for an entertainment website that targets the collegiate crowd (read: boob jokes, marijuana references, flash games), a far cry from the artistic bent of his hobby. He first learned the craft junior year of high school in the suburb of Chicago called
Rockford, Ill. on traditional equipment, developing film in old-school dark rooms that smelled heavily of chemicals and shone with red lights. By the time he went to college, Blough was well-versed in photography if not necessarily experienced. Rather than continue with the craft, he took up marketing as a major and joined the army of people attempting to monetize the sprawling playground that is the Internet. “I was scared at the idea of making photography a real job,” Blough said. Work with the Walt Disney Company and Myspace intervened. It wasn’t until Blough ditched his old phone and took up a fourthgeneration iPhone that he rediscovered the simple joy of photography. According to the Pew Research Center, some 45 percent of American adults have smartphones and the little cameras that go with them. While these ubiquitous products tend to be accessible and user-friendly, there is no app to transform the user into the next Ansel Adams, and Blough knew it. He got encouragement from family, friends, his girlfriend Chante Pradella and an unlikely source — the Internet itself. Instagram, the aforementioned photoediting app, holds weekly contests on its site called “Weekend Hashtag Project.” Each assignment comes with a general subject suggestion and a hashtag — the best photo submission gets displayed on the website. Blough threw in a photo of a wall with the words “ice cream” half-displayed in scrawling cursive type, a stark snapshot that

He now has several thousand followers, and constantly updates with new images of Los Angeles and the Westside that connects him to other weekend warrior photographers. Blough feels he has a skill set that sets him apart, however. While others concentrated on their photography skills or their careers, he was learning how to sell people on ideas and concepts. He hopes that will translate to selling himself as he tries to launch into the world of professional photography and take on people-focused projects with his more versatile Cannon. “It was 10 years, and I enjoyed the lull. It was necessary in the big picture,” Blough said. Blough will have an opportunity to display both his phone work and action photography at the Hangar Gallery at Santa Monica Airport through March 23, and will also have a spot in the annual Airport Artwalk on March 16.

Pistorius’ brother facing charge in traffic death RAF CASERT Associated Press
JOHANNESBURG The murder case involving Olympic star Oscar Pistorius took another unexpected turn Sunday with the news that his older brother, Carl, is himself facing charges for the death of a woman in a traffic accident. Carl Pistorius faces a charge of unlawful, negligent killing for a 2008 road death, “in which a woman motorcyclist sadly lost her life,” Kenneth Oldwage, the Pistorius family lawyer said on Sunday. The accident happened in Vanderbijlpark, south of Johannesburg. The charge of “culpable homicide” was dropped and then reinstated and will be challenged in court, the lawyer told The Associated Press. It is the second time someone associated with the Pistorius case has been found to face a serious charge that has been dropped and then reinstated. It was revealed that the chief police investigator in the case is facing charges of seven counts of attempted murder for shooting at a vehicle with seven passengers. Following the revelations, Hilton Botha was removed from the Pistorius inves-

■ Updates: The Treasury Department's inspector general for tax administration revealed in January that twice as many fraudulent income tax refunds were paid to inmates in 2011 (173,000) as for the tax year 2010. Soon, he will have earned a million dollars in salary and benefits since the board removed him from the classroom 13 years ago and dispatched him to a light-duty "rubber room" after complaints of fondling and sexual harassment in the one year that he actually taught. An arbitrator had found insufficient evidence for his termination, but the board refuses to let him back in the classroom, fearing he is a danger to students.
