ST. MONICA It was just another day at the office for Briana Harris. With a line of 30 points, six rebounds and four steals, Harris led her team to a victory Saturday night against the CantwellSacred Heart Cardinals, 52-43, in the second round of the CIF State Girls Basketball Championships. The St. Monica Mariners put their defensive stamp on the game early, forcing turnovers and jumping out to a 14-2 lead. But the Cardinals got going offensively, bridging the first and second quarters with a 12-2 run. The game was tied at 27 at the half. “[Harris] got a couple of fouls, we got a little off kilter, and they hit some good shots,” Mariners coach John Skinner said about his team’s second quarter. “They made a couple of adjustments to how we started the game.” The Mariners made adjustments of their own after halftime, allowing CantwellSacred Heart to score only seven points in the third quarter. Harris had nine of St. Monica’s 13 points in the frame, but a combined five missed free throws by her and center Melissa Maragnes prevented a potentially wider margin going into the fourth quarter. Harris dealt with foul trouble all night, picking up her fourth with 6:20 left in the fourth quarter, sending her to the bench. When she returned, she scored six points, helping to put away the Cardinals. Despite her struggles, Harris stayed confident. “As a player, I have to come out here and play my game,” she said. Maragnes had a difficult game offensively, scoring only five points, but was able to contribute 10 rebounds. “She’s still gotta realize how strong she is and be more aggressive offensively, but I really liked that she [had] another great defensive effort,” Skinner said of Maragnes. Cardinals coach Omar Villalta spoke of how difficult it is to stop St. Monica once they get going. “Every time we play them, we spot them points and it’s hard for us to come back,” he said after the game. “[They] have two key players and it’s hard for you to defend it straight up unless we start double-teaming. Their supporting cast is good enough to get it done.”

Report: State lawmakers skirt contribution limits ASSOCIATED PRESS SACRAMENTO, Calif. California lawmakers are circumventing campaign finance limits through “ballot measure” committees that set no caps on the amount donors can contribute, according to a report. The committees allow legislators to ask contributors for more than the $4,100 per election they can solicit for their own campaigns. The accounts must be used to support or oppose any ballot measure, but that can include proposals still in the development stage that might never see the light of day, the Sacramento Bee reported. Over the past two years legislators collected $2.7 million through these committees. A Bee review found some of those funds were used to pay for items with questionable connections to ballot measures — including thank-you gifts to donors, a lawmaker’s tuition and contributions to nonprofits. Some lawmakers spent the money on out-ofstate fundraisers. Filtering contributions through the committees can “kill two birds with one stone” for donors, said Jessica Levinson, a campaign finance and ethics expert at the Loyola Law School in Los Angeles. At least two dozen lawmakers maintained ballot measure committees in the two years leading up to the 2012 election. They say the committees allow them to help state and local efforts to shape policy and to communicate with voters on issues outside Sacramento. Assemblyman Isadore Hall’s “Inspiration and Hope for California” committee didn’t put the funds directly toward any proposals up for a vote in the last two years, the Bee said. But it did spend $6,800 for a seminar at Harvard University’s John F. Kennedy School of Government and $1,700 at the University of Southern California. Hall, a Compton Democrat, told the newspaper attending what he described as leadership seminars at Harvard and USC helped him play a greater role in formulating and supporting future measures on the ballot. He defended the committee, telling the Bee it creates “opportunity for exposure in terms of different ideas that would affect the state of California.” Phillip Ung, a policy advocate for California Common Cause, told the newspaper the ballot measure committees essentially are “political slush funds” that can be used to offset costs that would usually fall to the more strictly regulated re-election committees. “In the long term, they can’t continue the way they are because they’re just being abused by some elected officials,” he said.

The Sustainability Bill of Rights will soon be up for consideration by the Santa Monica City Council and needs support. Putting needs of people and natural ecosystems like water, food, energy, air, soil and climate above corporate interests lies at the heart of this measure. Issues like these are under attack by the emergence of the corporate world and corporate mentality, whose interests often don’t parallel that of citizens. This is particularly true now as the courts have given corporations free-speech rights, as if they were individuals. So, stand up for nature. Support the Sustainability Bill of Rights.

Was the City Council’s naming of the $45 million boondoggle Tongva Park an act to inspire the locals to embrace wisdom, or some other lesser reason? (”Turf war rages over name of Tongva Park,” March 4, page 1.) If it truly was the community’s park built in the Tongva tradition and ways, it would not cost $45 million. It would be built by the community, not outside contractors. There would be gardens with free food, not concrete. There would be free healthcare and education for all. Members of the community would gather and socialize all speaking the same language. No one would be excluded or homeless. The elders of the community would meet daily to reflect on the past and ensure that they were guiding the community into the future harmoniously with nature. There would be no crime, pain or suffering. They would trade harmoniously with their neighbors. As Jerry Rubin and others have stated, the $45 million should have gone into the historic Santa Monica Civic Auditorium. The city doesn’t need a white knight, they need a competent manager of this valuable resource. Beware, proposed restorations can be politically influenced for financial gain for those on the inside, leaving the community with a project that will fail. The Tongva’s historical land at the Ballona Wetlands is currently being threatened to be developed by the Annenberg Foundation. If we do not act soon, a significant amount of land will be developed in the name of education. How do you spend $150 million restoring 600 acres of land? You destroy all the life, change the way it looks, and live with a lifetime of guilt. That’s not the Tongva way.

Gehry delivers the ‘wow factor’

David Paul Associates have announced a major, new Downtown development. It’s a 22-story luxury hotel designed by Santa Monica’s own world famous architect Frank Gehry. Yowza! The proposed development will have 125 hotel rooms, 22 condominiums and plenty of street level retail space. The “Ocean Avenue Project” will be bounded by Santa Monica Boulevard, Ocean Avenue and Second Street. It’ll include a 36,000-square-foot art museum that will incorporate a landmark Spanish Colonial house and a Victorian house on Ocean Avenue. A four-level, underground garage will accommodate 460 vehicles. The site will include affordable housing to replace 19 rent-controlled units that will be demolished when construction commences. But, it’s the 244-foot-tall, main tower that has everyone buzzing. It’s trademark Gehry with white, undulating, twisty walls similar in concept to Disney Hall or the wavywalled, 76-floor “New York” condo tower in Manhattan. At ground level, Gehry’s tower will be on the interior of the site set back from surrounding streets. A public viewing deck is planned for the top. The tower will be embraced by two- to five-floor buildings housing shops and eateries. Pedestrian paseos would flow throughout the site. In addition to making a striking architectural statement guaranteed to attract worldwide attention, the project will create hundreds of new jobs and generate millions of dollars in new tax revenue for the city. I predict this will redefine Santa Monica, which, with a few exceptions, is known for its bland, derivative architecture. Best of all, the principals involved are long-time community members unlike some out-of-town developers from Texas and elsewhere with large developments pending here. Gehry’s family home is on 23rd Street and he’s lived there since the late 1970s. He designed the original Santa Monica Place (since renovated) and the Edgemar Center on Main Street. Co-developer David Paul Associates has owned a substantial portion of the project site since 1977. There’ll be a lengthy planning and approval process. Developers have told the news media that they think they have a good development and are looking forward to working with the community to make it better. That’s always a good sign. I’m really excited about this project. Yes, it’s a major development but it has many great things going for it. I feel it will be a breathtaking architectural Downtown centerpiece representing a progressive, forward thinking and creative Santa Monica. Umumm!

more traffic congestion and affects City Hall’s ability to reach the sustainability goals stated in the recently adopted Land Use and Circulation Element of the General Plan. Last week, a local architect e-mailed this: “In his ‘Shape the Future 2025’ presentation, Tumlin attempts to separate large-scale development from traffic problems. But, there’s no practical way to decouple traffic from project size, especially in situations where development agreements allow projects to balloon out of all reasonable proportion, “[Tumlin’s] decoupling of parking recommendation simply becomes a screen behind which developers would be allowed to build what they want, so long as they provide the traffic-reduction measures (traffic demand management programs, encourage walking, bicycling and mass transit use, free bus and rail passes, bike racks, parking buyouts, car-pooling, etc.) that Tumlin advocates.” Basically, Tumlin is saying, “Rather than limiting development to limit traffic, limit traffic directly.” Therefore, the e-mail continued, “Once you’ve limited traffic, there’s no need to limit development, which could then proceed unhindered.” Tumlin’s starry-eyed proposals have exacerbated our traffic congestion and parking problems but when he described Santa Monicans as NIMBYs (Not In My Back Yard) on his firm’s website, the crap hit the fan. Tumlin posted that NIMBYs dominated local politics and used fears of increased traffic and congestion as their primary tool for stopping development. He couldn’t be talking about the Santa Monicans for Renters’ Rights council members who approve his contract, could he? When fed up residents called for Tumlin’s firing, he responded with a song and dance about the term (NIMBY) applying to the local reaction to development in 2005, but not today. Nevertheless, he refused to remove the NIMBY reference from his online resume. Diana Gordon, co-chair of Santa Monicans for a Livable Community said, “If Mr. Tumlin sincerely has changed his mind about residents, he wouldn’t now be proposing ideas that will only benefit developers, such as taking away our parking and supporting more and greater density development …” Despite the brouhaha, Tumlin has dug in his heels. Planning Director David Martin is standing by his man and predictably, nobody on either the Planning Commission or City Council has even suggested reviewing Tumlin’s contract. It’s bad enough that Martin and his department have fantasy world consultants like Tumlin and Neal Payton on the payroll, but with this fiasco, they’ve lost all remaining credibility.

TUMLIN CONTROVERSY CONTINUES

Weeks ago, I wrote about Jeffrey Tumlin, one of City Hall’s key planning consultants. NARAHA, Japan Two years after the triple calamities of earthquake, tsunami and nuclear disaster ravaged Japan’s northeastern Pacific coast, debris containing asbestos, lead, PCBs — and perhaps most worrying — radioactive waste due to the crippled Fukushima Dai-Ichi nuclear plant looms as a threat for the region. So far, disposal of debris from the disasters is turning out to have been anything but clean. Workers often lacking property oversight, training or proper equipment have dumped contaminated waste with scant regard for regulations or safety, as organized crime has infiltrated the cleanup process. Researchers are only beginning to analyze environmental samples for potential health implications from the various toxins swirled in the petri dish of the disaster zone — including dioxins, benzene, cadmium and organic waste-related, said Shoji F. Nakayama of the government-affiliated National Institute for Environmental Studies. Apart from some inflammatory reactions to some substances in the dust and debris, the longer-term health risks remain unclear, he said. The mountains of rubble and piles of smashed cars and scooters scattered along the coast only hint at the scale of the debris removed so far from coastlines and river valleys stripped bare by the tsunami. To clear, sort and process the rubble — and a vastly larger amount of radiation-contaminated soil and other debris near the nuclear plant in Fukushima, the government is relying on big construction companies whose multilayer subcontracting systems are infiltrated by criminal gangs, or yakuza. In January, police arrested a senior member of Japan’s second-largest yakuza group, Sumiyoshi Kai, on suspicion of illegally dispatching three contract workers to Date, a city in Fukushima struggling with relatively high radioactive contamination, through another construction company and pocketing one-third of their pay. He told interrogators he came up with the plot to “make money out of clean-up projects” because the daily pay for such government projects, at 15,000-17,000 yen ($160-$180), was far higher than for other construction jobs, said police spokesman Hiraku Hasumi. Gangsters have long been involved in industrial waste handling, and police say they suspect gangsters are systematically targeting reconstruction projects, swindling money from low-interest lending schemes

for disaster-hit residents and illegally mobilizing construction and clean-up workers. Meanwhile, workers complain of docked pay, unpaid hazard allowances — which should be 10,000 yen, or $110, a day — and of inadequate safety equipment and training for handling the hazardous waste they are clearing from towns, shores and forests after meltdowns of three nuclear plant reactor cores at Fukushima Dai-Ichi released radiation into the surrounding air, soil and ocean. “We are only part of a widespread problem,” said a 56-year-old cleanup worker, who asked to be identified only by his last name, Nakamura, out of fear of retaliation. “Everyone, from bureaucrats to construction giants to tattooed gangsters, is trying to prey on decontamination projects. And the government is looking the other way.” During a recent visit to Naraha, a deserted town of 8,000 that is now a weedy no-man’s land within the 20-kilometer (12-mile) restricted zone around the crippled nuclear plant, workers wearing regular work clothes and surgical masks were scraping away topsoil, chopping tree branches and washing down roofs. “They told me only how to cut grass, but nothing about radiation,” said Munenori Kagaya, 59, who worked in the nearby town of Tomioka, which is off-limits due to high radiation. Naraha’s mayor, Yukiei Matsumoto, said that early on, he and other local officials were worried over improper handling of the 1.5 trillion yen ($16 billion) cleanup, but refrained from raising the issue, until public allegations of dozens of instances of mishandling of radioactive waste prompted an investigation by the Environment Ministry, which is handling decontamination of the 11 worst-affected towns and villages. “I want them to remind them again what the cleanup is for,” Matsumoto said in an interview. “Its purpose is to improve the environment so that people can safely return to live here. It’s not just to meet a deadline and get it over with.” The ministry said it found only five questionable cases, though it acknowledged a need for better oversight. Another probe, by the Health, Labor and Welfare Ministry found rampant labor violations — inadequate education and protection from radiation exposure, a lack of medical checks and unpaid salaries and hazard pay — at nearly half the cleanup operations in Fukushima. About half of the 242 contractors involved were reprimanded for violations, the ministry said.

My Personnel File: Why Do I Want it and How Do I Get a Copy? T

he permanent record from our youth may have been a ruse cooked up to keep children in line, but these days, we are close to having permanent records due to our rapidly all encompassing digital world.Thankfully, personnel files are not yet in digital format.While we still can, we should at least always be prepared to have access to these records to check and to fix any wrong information.We may also want access when we think we should get a raise and want to use former evaluations, client letters, or training records to get it. Thee Why: More often than not, employees do not even know how to access this information until they talk to a lawyer.And if you are talking to a lawyer about work, something's already gone wrong. Lawyers want to see what your performance record is, any personnel actions and the basis, or any other records that could help determine whether, say, a termination was legally wrongful or justifiable in light of the bigger history. Most of these employment cases turn on performance, the reason the employer gives for the termination, versus whatever you as a plaintiff will show. For example, one good way to maintain better records in your file is to put in writing what you disagree with, such as in a negative evaluation. Later when these are reviewed, and the employee has these notes, it will be more difficult for a bad employer to justify their wrongful behavior through performance issues. Another reason to keep track is that personnel records can be subpoenaed by a third party,which is something that could happen in any type of legal action where you are involved.The law does require that you are given a notice and opportunity to object to the subpoena.If any of it is relevant to whatever legal action is happening,not necessarily even an employment case,then usually the subpoena is allowed.

Thee How: There are no federal laws about these records, but California has very clear laws. Still, some employers do not know them or follow them properly so it is better to know your rights and educate your employer if needed. Here are the types of records that you are legally entitled to get: Pay Records: Employers have to keep for at least three years of your pay records and give their employees a copy within 21 days of request or face civil penalties (Labor Code 226).Personnel Files: Employers have to keep records and give you access to them within a reasonable time (Labor Code 1198.5).All documents you signed:These are the ones signed at hire or as continuing term and condition of employment (not documents signed in the course of conducting business). (Labor Code 432). Tips: Though these requests do not have to be in writing, it is usually better so that you can keep track of the response time. Employers may have part of your personnel file in different offices. Be sure to know where yours is kept so when the time comes you know how to find it without being given the run around. Ask for or make copies of all personnel documents as they come up and hold on to the hiring paperwork so that you have your own set for comparison later.

The news is not getting better about the economy and the unemployment office has to be really picky when it comes to claims.You were not laid off, but instead quit or were terminated. How can you file for unemployment and be approved? This is one of the most often asked questions from my clients. Some who are still working want to know if they should quit or wait to be terminated.The decision will vary from person to person to situation.The decision can also be personal or health related or that you just want to be out of there. Here are some legalities to consider in your decision. Thee Quit: In a situation with a quit, there is generally just one type of circumstance that will get you these benefits. If you can show that you quit because the work conditions were such that no reasonable person could be expected to work there, then you can still qualify for the benefits.This is a high standard limited to what the law requires of the workplace, such as safe conditions, free from harassment, being paid, and free from retaliation.This is not an easy showing to make and so arguments based on personality, rudeness, bad bosses, etc, will not fly. on: Thee Terminatio Most people think that if you have been terminated, there is no unemployment for you. However, there are exceptions to this. Of course, if you have been terminated based on policy violations, gross misconduct, and other severe actions, then you are disqualified. One way to overcome that, if the facts are there, is the exception that the conduct may not have been appropriate but it was an isolated instance of poor judgment, or something excusable that happened the one time for a good reason. Criminal activity at work or assault or harassment is never excusable. Thee Wrongfull Termination: If you have been "wrongfully terminated" in the legal sense,you may still qualify for unemployment.Most employees who file lawsuits have been terminated.If the facts are there for a lawsuit,then they should be there to qualify you for unemployment.You need to show that the termination was not based on whatever the employer is claiming,but because of some legal violation they have committed.For example,if you complain of sexual harassment,then a week later,you are terminated for some work issue that happened two months ago,then the termination was retaliation.When an employer retaliates for your report of a prohibited workplace activity,that employer just violated anti-retaliation laws. Tip: If you are unemployed but develop a disability and you can't work, then you no longer qualify for unemployment.At this point, apply for State Disability Benefits.Again, these is not easy to get and you will need medical proof, but it is one safety we are lucky to have here in California.

Attracting bees and butterflies to a garden is a noble pursuit indeed, given that we all depend on these species and others (beetles, wasps, flies, hummingbirds, etc.) to pollinate the plants that provide us with so much of our food, shelter and other necessities of life. In fact, increased awareness of the essential role pollinators play in ecosystem maintenance-along with news about rapid declines in bee populations-have led to a proliferation of backyard “pollinator gardens” across the U.S. and beyond. “Pollinators require two essential components in their habitat: somewhere to nest and flowers from which to gather nectar and pollen,” reports the Xerces Society, a Massachusetts-based non-profit that protects wildlife through the conservation of invertebrates and their habitat. “Native plants are undoubtedly the best source of food for pollinators, because plants and their pollinators have coevolved.” But, Xerces adds, many varieties of garden plants can also attract pollinators. Plant lists customized for different regions of the U.S. can be found on the group’s website. Any garden, whether a window box on a balcony or a multi-acre backyard, can be made friendlier to pollinators. Xerces recommends providing a range of native flowering plants that bloom throughout the growing season to provide food and nesting for bees, butterflies and other pollinators. Xerces also says that clustering flowering plants together in patches is preferable to spacing individual plants apart. “Creating foraging habitat not only helps the bees, butterflies and flies that

pollinate these plants, but also results in beautiful, appealing landscapes.” Along these lines, gardeners should plant a variety of colors in a pollinator garden, as color is one of the plant kingdom’s chief clues that pollen or nectar is available. Master gardener Marie Iannotti, an About.com gardening guide, reports that blue, purple, violet, white and yellow flowers are particularly attractive to bees. She adds that different shapes also attract different types of pollinators, and that getting as much floral diversity of any kind going is a sure way to maximize pollination. Another way to attract pollinators is to provide nest sites for bees-see how on the xerces.org website. The group also suggests cutting out pesticides, as these harsh chemicals reduce the available nectar and pollen sources in gardens while poisoning the very insects that make growing plants possible. Those looking to go whole hog into pollinator gardening might consider investing $30 in Xerces Society’s recently published book, Attracting Native Pollinators: Protecting North America’s Bees and Butterflies, which provides a good deal of detailed information about pollinators and the plants they love. Gardeners who have already encouraged pollinators can join upwards of 1,000 others who have signed onto Xerces’ Pollinator Protection Pledge. And the icing on the cake is a “Pollinator Habitat” sign from Xerces stuck firmly in the ground between two flowering native plants so passersby can learn about the importance of pollinators and making them feel welcome. JAPAN FROM PAGE 5 An Environment Ministry official in charge of decontamination said the government has little choice but to rely on big contractors, and to give them enough leeway to get the work done. “We have to admit that only the major construction companies have the technology and manpower to do such large-scale government projects,” said the official, who spoke on condition of anonymity, citing the sensitivity of the issue. “If cleanup projects are overseen too strictly, it will most likely cause further delays and labor shortages.” Minoru Hara, deputy manager at a temporary waste storage site in Naraha, defended the 3,000 workers doing the work — the only people allowed to stay in the town. “Most of the cleanup workers are working sincerely and hard,” Hara said. “They are doing a good job of washing down houses and cleaning up gardens. Such criticism is really unfair, and bad for morale.” Labor shortages, lax oversight and massive amounts of funds budgeted for the clean-up are a recipe for cheating. And plenty of money is at stake: the cleanup of a 20-kilometer (12-mile) segment of an expressway whose worst contamination exceeds allowable radiation limits by 10 times will cost 2.1 billion yen ($22.5 billion), said Yoshinari Yoshida, an Environment Ministry official. “While decontamination is a must, the government is bearing the burden. We have to consider the cost factor,” said deputy Environment Minister Shinji Inoue as he watched workers pressure wash the road’s surface, a process Yoshida said was expected to reduce contamination by half. The cleanup is bound to overrun its budget by several times, as delays deepen due to a lack of long-term storage options as opposition among local residents in many areas hardens. It will leave Fukushima, whose huge farm and fisheries industry has been walloped by radiation fears, with 31 million tons of nuclear waste or more. Around Naraha, huge temporary dumps of radioactive waste, many football fields in size and stacked two huge bags deep, are scattered around the disaster zone The cleanups extend beyond Fukushima, to Iwate in the north and Chiba, which neighbors Tokyo, in the south. And the concerns are not limited to radiation. A walk through areas in Miyagi and Iwate that already were cleared of debris finds plenty of toxic detritus, such as batteries from cell phones, electrical wiring, plastic piping and gas canisters. Japan has the technology to safely burn up most toxins at very high temperatures, with minimal emissions of PCBs, mercury and other poisons. But mounds of wood chips in a seaside processing area near Kesennuma were emitting smoke into the air one recent winter afternoon, possibly from spontaneous combustion. Workers at that site had high-grade gas masks, an improvement from the early days, when many working in the disaster zone had only surgical masks, at most, to protect them from contaminated dust and smoke. Overall, how well the debris and contam-

inants are being handled depends largely on the location. Sendai, the biggest city in the region, sorted debris as it was collected and sealed the surfaces of areas used to store debris for processing to protect the groundwater, thanks to technical advice from its sister-city Kyoto, home to many experts who advised the government in its cleanup of the 1995 earthquake in the Kobe-Osaka area that killed more than 6,400 people. But Ishinomaki, a city of more than 160,000, collected its debris first and is only gradually sorting and processing it, said the U.S.-educated Nakayama, who worked for the U.S. Environmental Protection Agency before returning to Japan. “There were no technical experts there for the waste management side,” he said. “They did some good work with chemical monitoring but in total, risk assessment, risk management, unfortunately they did not have that expertise.” Ultimately, just as they are choosing to live with contamination from chemicals and other toxins, the authorities may have to reconsider their determination to completely clean up the radiation, given the effort’s cost and limited effectiveness, experts say. Regarding the nuclear accident, “there has been so much emphasis on decontamination that no other options were considered,” said Hiroshi Suzuki, a professor emeritus at Tohoku University in Sendai and chairman of the Fukushima Prefectural Reconstruction Committee. Some places, such as playgrounds, obviously must be cleaned up. But others, such as forests, should just be left alone, since gathering or burning radioactive materials concentrates them — the opposite of what is needed since the more diluted they are, the better. To a certain extent, policy is being dictated by politics, said Suzuki. Before the accident, residents believed they were completely safe, he said. “The authorities want to be able to tell them once again that the area is safe. To do this they need to return it to the state that it was in before the accident.” Naraha resident Yoshimasa Murakami, a 79year-old farmer, said he has low expectations. A month after the government started cleaning his spacious home he has not seen a major decrease in radiation, he said while sitting on a balcony overlooking his traditional Japanese garden. He set a dosimeter on the grass. It measured radiation nearly five times the target level and almost the same as the 1.09 microsieverts per hour found when officials surveyed it in December. Murakami had come to the house for the day. He, his wife and daughter now live 50 kilometers (30 miles) away in Koriyama city. He visits a few times a week to keep an eye on the cleanup workers. At nearly 80, Murakami says he doesn’t mind about the radiation, but his wife does. And if he returns, his other relatives and grandchildren will be afraid to visit. “Then, what’s the point?” he said. “I don’t think decontamination is going to work,” Murakami said. “The nuclear crisis is not fully over, and you never know, something still can go wrong.”

Cause of off-color, fetid water eludes town KEVIN BEGOS Associated Press

PITTSBURGH What causes clear, fresh country well water to turn orange or black, or smell so bad that it’s undrinkable? Residents of a western Pennsylvania community have been trying for more than a year to get that question answered in their quest to get clean water back. Some of them say the water was spoiled by drilling deep underground for natural gas. Others point to pollution from old coal mines. They’ve also been told it could even be a baffling mix of natural and manmade reasons that change the water over time, like the leaves change on trees. But no one knows for sure, and they say the uncertainty is maddening. In late 2011, the drinking water for about a dozen residents in the Woodlands, a rural community about 30 miles north of Pittsburgh, began to change. At first, the families blamed gas drilling, or fracking, being done 2000 feet away. But state tests showed the water wasn’t contaminated by drilling, and even more confusingly, many of their neighbors reported no problems. Families with bad water then turned to federal officials. But last summer the U.S. Environmental Protection Agency quietly sent a letter to one resident, Janet McIntyre, saying the agency agreed with the state finding, since most of the chemicals found in the water could have occurred naturally. McIntyre wasn’t satisfied, noting that the EPA “never set foot on my property to test the water themselves.” The EPA didn’t

respond to a request for comment on why the agency didn’t retest the water. Still, the residents with water problems were hopeful that the Atlanta-based U.S. Agency for Toxic Substances and Disease Registry was looking at the issue. But last month the agency said it “is not actively investigating complaints from this area.” “I’m just very, very frustrated,” McIntyre said. So was John Stolz. He’s the director of the Duquesne University Center for Environmental Research in Pittsburgh. Stolz said state and federal agencies failed to do detailed reviews, so a Duquesne team has been monitoring water quality and surveying households in the Woodlands, in what is one of the most in-depth surveys of alleged impacts of gas drilling in the nation. With funding from two foundations, a team has regularly tested area water for more than a year. “We’ll see black water, we’ll see orange water, there’s often times an odor,” Stolz said. Overall, about 50 out of the 150 households in the community have complaints. “There are certain areas that clearly don’t have any problems,” Stoltz said. And, he added, a well that has bad water one month may be clear the next, and a few homeowners even say that their well water improved after gas drilling began. Even in areas with no nearby oil and gas drilling, the water quality in some aquifers changes naturally, groundwater experts say. “It varies even within the same aquifer. It can vary from the top of the aquifer to the bottom, and from one side to the next,” said Mike Paque, executive director of the Oklahomabased Ground Water Protection Council.

CERT FROM PAGE 1 ders in the event of a major catastrophe. Over the course of three weekends, they learn how to search damaged buildings, administer basic first aid and even some rescue techniques. While only the most ardent couch potato could classify the L.A. Marathon as a “disaster,” any mass grouping of people has the potential to become a big problem for a small number of emergency responders. Paul Weinberg, Santa Monica’s emergency services coordinator, remembers well marathon day in 2011 when the rains came, leaving thousands of runners hypothermic. Emergency responders had their hands full getting people warming blankets and monitoring their condition as other members of the community — particularly luxury hotels immediately adjacent to the race course — stepped up to care for stricken runners. “The partnership with the hotels is something that I talk about at every training,” Weinberg said, noting it’s a rare place where emergency personnel can go to exclusive, expensive hotels and co-opt their ballrooms and still be offered coffee. Even with that generosity, things could have gone smoother. Medical personnel like firefighters and paramedics were caught up doing much-needed, but basic, tasks when they could have been out on the front lines caring for worse-off individuals who needed their skills more.

We have you covered That’s where CERT comes in, Weinberg said. The 25 CERT members who will be on hand that Sunday will be playing one of three roles. The first will be “hotwalkers,” the first line of evaluators who meet runners at the finish line and assess their condition. Are they hypothermic? Do they just need water, or is that dizzy spell something more serious? The second task will be bus monitor. No, really. Buses line up on race day with either their heaters or air conditioners on to care for those the hotwalkers deem in need of a closer eye. In previous years, these buses would be staffed by firefighters or paramedics, Weinberg said. “We had people on buses, but the police and fire didn’t have enough hands,” he said. “If you have a trained CERT person, it’s better to have that person as a monitor rather than a paramedic. They’re a force multiplier, but if you have a fire person on the bus, that’s one less trained fire person in the field.” Finally, CERT members will be helping out with wheelchairs and gurneys at the emergency center on Ocean Avenue, normally the Senior Center. Although the focus Sunday won’t be on the 25 CERT members in their green vests, it is something of a coming out party for the program, the first event for which they have been called on to mobilize. Gould had in mind when he created the Office of Emergency Management and established the CERT program in Santa Monica. The idea comes from the Japanese model of emergency preparedness, Gould said. The small country is rocked by earthquakes several times a day, in some cases, and most recently had to contend with the earthquake and tsunami that took out its nuclear power plant. “Their idea is that they’ll never have enough public servants around to do everything necessary, so they have to step up and

help themselves,” Gould said. So far, three classes have gone through the CERT training program. Renato Akerman was a member of the second class, and will be there to help on race day. He’s excited for the opportunity, and sees it as a way to get the word out on the CERT program in Santa Monica. “It’s going to be our first assignment, the first time we’re seen as useful,” Akerman said. “It’s not just about training and drilling, it’ll be live action.” ashley@smdp.com

Maxwell Ulin, 18, a senior at Crossroads High School, has been a member of the Boy Scouts since he was 11 years old, but he can no longer remain silent about the policy, which he says not only discriminates, but is also a clear contradiction of the organization’s defining principles. The protests over the policy seemed to have gained some traction as members of the organization’s national board announced earlier this year that they were considering changing the policy to allow local charter organizations to make the call on allowing gay members. Then the board delayed that decision, announcing that it would take up the issue as part of its annual meeting to be held in May. This delay angered Ulin, who thought the organization he has grown to love was showing cowardice. By stalling, he felt the national board hoped the call for change would subside. Ulin decided then that it was finally time to act. “I hope that by adding my voice to the chorus I can make a difference,” Ulin told the Daily Press last week. “I have always been able to see both sides of an argument, but when it comes to discrimination and human rights, there’s the exception. The right thing to do is so abundantly clear. This is an issue I feel I can stand up for without a shadow of a doubt.” Ulin fired off a letter to the Boy Scouts of America in which he quotes civil rights leader Dr. Martin Luther King, Jr. “For all that finally earning Eagle last month meant to me, I know that I can only honor my own beliefs and personally uphold the 12th scout law by standing up against injustice to the fullest of my ability,” Ulin wrote. Earning the rank of Eagle Scout takes considerable commitment. It is the highest rank a scout can receive. Ulin earned his by helping spruce up a nearby elementary school by painting murals. Some members will see the fact that the Boy Scouts’ national leadership is even discussing a policy change as a softening of its

stance on gays and lesbians. But some scouts and their parents say that passing the decision to the local level, if that is what is decided, will have little effect on the ground because many troops, including Ulin’s Santa Monica Troop 2, have been ignoring the national policy anyway. They are calling for a change nationally, which would send a stronger message that discrimination against gays and lesbians is wrong. Some critics say the scouts have failed to make a change because of strong ties to organized religion.Approximately 70 percent of Scout troops are affiliated with some kind of church or religious group, according to the Scouts. Boy Scouts of America spokesman Deron Smith said the organization is a representation of the many diverse communities across the nation and understands that “not everyone will agree with any one position or policy.” “[We] respect their rights to express an opinion,” he said. Smith would not elaborate on discussions the national board is having regarding the policy. The protests were sparked last year after an Ohio Cub Scout leader was forced to step down from her position in her son’s pack because she is a lesbian. Ulin has the support of his troop and his parents. His father, Rob Ulin, said he couldn’t be prouder of his son for taking a stand, something he attributes to his son’s exposure to the civil rights movement. “I think he has been very moved by the stories of those who have fought for equal rights,” Rob Ulin said. “Now here’s a group that is still allowed to openly discriminate against a group of people. I think that upset him and he wanted to take a stand rather than just be silent. His mother and I are so proud of him.” Ulin has so far not received a response from the scouts and he doesn’t expect to. All he wants is a change in policy. “There are only so many moments you have to speak out on an issue, and I would like to be able to look back at my time in scouting and feel proud of what I’ve done, what I’ve stood for and that I was on the right side of history,” he said. kevinh@smdp.com

One dead, five rescued in sailboat race accident DAISY NGUYEN Associated Press

LOS ANGELES Storm-churned seas during a sailing race off Southern California smashed a boat into island rocks, leaving one sailor dead, after the vessel’s crew first sent a mayday call but later waved off help from the Coast Guard and other boaters. Five other crewmembers of the Uncontrollable Urge were rescued after the 32-foot sailboat lost its steering and the craft began drifting toward San Clemente Island, where it broke apart, Coast Guard Petty Officer Connie Gawrelli said Saturday. On Friday night, the crew radioed the mayday call and also activated a feature on the boat that provides authorities with GPS coordinates and other crucial information, she said. But the crew then declined assistance and instead requested a tow boat. Stormy conditions, however, kept the tow boat from getting to them. “They were not in immediate danger and thought they would be able to manage completing the race and get assistance on their own,” said Chuck Hope, commodore of the San Diego Yacht Club who helped organize the Islands Race. “Then things got worse.” He said the crew couldn’t deploy a life raft or anchor the boat. They abandoned ship when the boat entered the surf line and broke apart. When the Coast Guard reached the crew, they found 36-year-old Craig Thomas Williams unresponsive in the water, the San Diego County Medical Examiner’s office said. He and the other five crew members were hoisted into a helicopter and flown to a hospital. Williams was a member of the Silver Gate Yacht Club in San Diego, where the Uncontrollable Urge is docked, the club’s commodore said. “This is a very difficult time for the Williams family, the skipper of Uncontrollable Urge and the other surviving crew members,” Carey Storm said. “(The club) and the entire Southern California rac-

ing community is a close family, and the loss of one of our members impacts us all greatly.” Storm declined to release further details. The Islands Race website listed James Gilmore as the owner of the Uncontrollable Urge. Gilmore tweeted Friday that he was taking the new boat on its first race, and noted that the forecast called for 25-knot winds. “Gonna see what this boat can do!” he tweeted. Hope said the Uncontrollable Urge was known within the sailboat racing circuit and that its crew and skipper were experienced. “Those guys been around, they’re very good sailors,” he said. “This was not a case of someone getting in over their head.” He said stormy conditions in the open seas caused equipment failures for two other boats, forcing their crews to drop from the race. The Uncontrollable Urge crew radioed that the boat’s rudder failed. “This was not an isolated incident,” Hope said. “Conditions were pretty fierce.” The overnight, 139-nautical-mile race began in Newport Harbor in Orange County on Friday and was to take participants around Catalina and San Clemente islands before finishing off in San Diego’s Point Loma. The death came nearly a year after four sailors died when their yacht crashed during a race from Southern California to Mexico. An independent review panel said it believes the 37-foot sailboat Aegean ran aground on North Coronado Island off the Mexican coast on April 28, 2012 during the Newport to Ensenada Race. That same month, five other sailors died in the waters off Northern California when their 38-foot yacht was hit by powerful waves, smashed into rocks and capsized during a race. Three sailors survived the April 14 accident near the Farallon Islands, about 27 miles west of San Francisco. The wreck prompted the Coast Guard to temporarily stop races in ocean waters outside San Francisco Bay.

■ A Verizon risk team, looking for data breaches on a client's computers, discovered that one company software developer was basically idle for many months, yet remained productive -- because he had outsourced his projects to a Chinese software developer who would do all the work and send it back. The employee earned several hundred thousand dollars a year, according to a January Los Angeles Times report, but paid the Chinese worker only about $50,000. The risk team eventually learned that sensitive company information was flowing to and from Chinese terminals, leading the company to suspect hackers, but that traffic was merely the U.S. employee (obviously, "ex-employee" now) sending and receiving his workload. The U.S. man showed up for work every day, but spent his time leisurely web-surfing. ■ One of Britain's most famous "madams" announced in January that she was coming out of retirement to set up a brothel exclusively catering to disabled people and the terminally ill. An ordinary brothel would be illegal in the town of Milton Keynes (45 miles from London), but Becky Adams insists that the government could not shut hers down without illegally discriminating against the disabled.
