OCEAN AVE Although his fastest days are behind him, Brad Knoernschild is one runner who wills himself to the finish line every year. Knoernschild, 55, is one of 185 Legacy Runners who have run and completed every Los Angeles Marathon since its inception 28 years ago. “I think it’s keeping the streak alive,” Knoernschild said on Sunday after completing the race. “We support each other,

it’s like a fraternity.” Along with Knoernschild, roughly 24,000 runners from 61 countries and all 50 states gathered for the annual L.A. Marathon on Sunday. “Every person that runs has their own story,” said former mayor of Santa Monica, Assemblyman Richard Bloom, who has been to every marathon since it came to Santa Monica four years ago. “I think it’s wonderful,” added Santa Monica Chief of Police Jacqueline SEE MARATHON PAGE 10

MONTANA AVE Malissa Feruzzi Shriver is a Santa Monica superwoman. Any given day you can find her taking tennis lessons, spending time with her family or lobbying for change in Washington, D.C. But, the 49-year-old wife of former Santa Monica Mayor Bobby Shriver wasn’t always part of the state’s social elite. “I’m not a Shriver, I married someone with that name,” she said. “I thought if I can make a difference and leverage that name I would.” Born Malissa Feruzzi to Italian parents, the California native realized at an early age the paramount importance of art and expression. “I think art was in my blood, I love art,” she said. So important was art that it became her life’s mission to protect it and insure that it has a place in society for future generations. “All the things I thought would disqualify me from being an effective advocate made me perfect for the job,” said Feruzzi Shriver, who retired as chair of the California Arts Council this year and feels art advocates have done a poor job in this country. “It’s sad, a lot of these kids don’t have an advocate, the future of this country is at risk.” While at UCLA, Shriver earned a degree in women’s studies in 1989. Shriver’s parents pressured her to earn a practical degree that would keep her financially secure. She chose a different route. “I was an artist, I never thought I would be a politician,” she said. Later in life, Feruzzi Shriver was appointed by her brother-in-law, then Gov. Arnold Schwarzenegger, as chair of the council in 2005 and served two terms. Feruzzi Shriver has tirelessly defended the arts, having been involved with myriad advocacy groups such as the California Alliance for Arts Education, the National Assembly of State Arts Agencies, and the Western States Art Federation. More impressive than her resume is the

OLYMPIC BLVD

Closed for construction Olympic Boulevard between 20th Street and Cloverfield Boulevard will be closed from March 25 through May 2 from 10 p.m. to 6 a.m. Sunday through Thursday for construction of a bridge for the Exposition Light Rail Line. Officials with the Exposition Construction Authority said construction crews will be erecting falsework using timber and steel forms as a mold for the castin-place bridge that will span Olympic Boulevard. The work will take place at night to limit traffic impacts. Construction will be phased so that eastbound and westbound traffic lanes on Olympic Boulevard will not be closed at the same time. The intersection of Olympic and Cloverfield will remain open to through traffic, however, turns onto westbound Olympic will be prohibited. Traffic will detour as follows: • Eastbound traffic on Olympic will be detoured at 20th Street. • Westbound traffic on Olympic will be detoured at Cloverfield. • All traffic lanes will be open to through traffic during the day. • Parking restrictions will be strictly enforced at all times. I’VE RAISED SOM E EYEBROWS WITH

my last two columns. First, I was enthusiastic about plans for the renovated Fairmont Miramar Hotel — including the 21-floor tower — at Wilshire Boulevard and Ocean Avenue. One week later, I praised the proposed 22floor, Frank Gehry-designed hotel planned for Ocean Avenue and Santa Monica Boulevard as the kind of project needed to reinvigorate Downtown Santa Monica. Both of these developments, although admittedly large by Santa Monica standards, are well thought out and will provide benefits that far exceed their negatives. Unlike previously approved (unbuilt) hotel projects, both the Miramar and Gehry developments (pending approval) promise to be first class. Some may argue that Gehry’s hotel (with its undulating walls) and the Miramar aren’t attractive, but they’re still head and shoulders over the approved 710 Wilshire mess with its 80-foot high vertical walls and cheap 1980s exterior, or the dated Motel 6-styled, 131-room Courtyard by Marriott and companion 138-room Hilton Hampton Inn proposed for opposite corners of Colorado Avenue and Fifth Street. All one has to do is look at the proposed rabbit warren of four- and five-floor apartment buildings set to replace the Village Trailer Park on Colorado. I’d rather have a well designed, high-rise tower surrounded by parks, gardens and public amenities than a crowded, cheek-by-jowl conglomeration like the East Village. City Hall had ample opportunity to cajole developers into building aesthetically pleasing buildings but completely abdicated that responsibility as long as they promised to pay hotel workers a “living” wage or build additional low-income housing. Many Santa Monicans feel that high rises have no place in this “iconic beach town.” But this hasn’t been an “iconic beach town” for 30 years. Get over your batophobia, folks. There’s nothing wrong with a few elegantly designed towers — as long as they’re Downtown. Even though a development may be tall, I look at its overall benefits. An open 1-acre park, as in the case of the Miramar? Paseos and an art museum as in Gehry’s project? Attractiveness? Sustainability? Minimal traffic increases? Functionality? Enhances the community? That is what counts with me. Unfortunately, City Hall’s planning process encourages dense, squat, low rise, unappealing, cookie-cutter buildings with articulated walls, jutting balconies and squared off, industrial looking design elements. Bland. Boring. Lifeless. No wonder so many folks here are anti-development. Still to come is a total renovation of the former Holiday Inn, now Wyndham, at Ocean Avenue and Colorado. Owner FelCor Lodging Trust Inc., has floated the idea of replacing the existing hotel with a building featuring a tower as high as 195 feet. I haven’t seen renderings of this project, so I have no opinion about FelCor’s plans. Because of the prime location across from the Santa Monica Pier bridge, FelCor must propose something truly spectacular if they expect any community support Three hotels are pending on Ocean Avenue with tall structural elements

Now is the time to begin closing the barn door and start framing zoning regulations to prevent additional high-rise infill, control excessive heights in other projects to come and avert a dreaded wall along our ocean front. I would also suggest reducing the maximum height recommendation mentioned in the Downtown Specific Plan for the Third Street Promenade to 45 feet to avoid walls of 84-foot high buildings there, too.

REMEMBERING CLIFFORD HAYDEN, JR.

When one lives in a place like Santa Monica for a period of time, the folks we do business with, like the great mom-and-pops, often become good friends, too. It’s why I fondly remember the proprietors of stores who served me well for decades and who finally closed their businesses, retired or passed away. A couple months ago, Carlson’s Appliances went out of business. Colby Evett, owner of Evett’s Model Shop passed away last month at 92 years. Lincoln Appliances closed last November a few weeks after its founder and owner Clifford Hayden, Jr. passed away at age 85. Clifford Hayden, Jr. was born and raised in Santa Monica. His father was a motorofficer for the Santa Monica Police Department in the late 1920s. After graduating from Santa Monica High School, Clifford, Jr. joined the Navy. He served in the Pacific near the end of World War II. He married his high school sweetheart Helen Andrews and they had three children: Laurie, Doug and Jan. In the early 1950s, he went into the construction business and was successful enough to begin buying real estate in his beloved Santa Monica. In 1964-65, he opened an appliance store on the 1400 block of Lincoln Boulevard, which he called Lincoln Appliances. Three years later he purchased property at Olympic Boulevard at 20th Street and moved his store, but kept the “Lincoln” name. It became famous as “The place that looks like Sears blew up” because of signs posted on the store’s exterior. For the next 44 years, Clifford, Jr. sold Whirlpool and other name-brand washers, dryers, refrigerators, stoves and major appliances to tens of thousands of satisfied local shoppers. And, he raised his family and served his customers. He was a man of great integrity and gave everyone a fair deal. Lincoln Appliances is gone but Clifford Hayden, Jr. has left a legacy of unsung community service along with friends, family and former patrons who remember him fondly. R.I.P. be to replace chlorine with chloramine, an ammonia derivative that doesn’t dissipate into the environment as rapidly as chlorine and has a much lower tendency to interact in bad ways with organic compounds in the water. However, traces of chloramine in the water may not be to everyone’s liking either, because it causes rashes after showering in a small percentage of people and can apparently increase lead exposure in older homes as it leaches the heavy metal off old pipes. Another option, though somewhat costly, would be to purchase a machine to purify the water. Ozonation units, which disinfect by adding ozone molecules to water and leave no residues, start at around $9,000. Another choice would be a UV light treatment machine — at $6,000 or more — which cancels out viruses and bacteria by passing the water through UV light rays. The Clean Water Store is a reputable vendor and good online source for such water treatment equipment. Perhaps the most sensible and affordable approach is to filter the water at the faucets and taps. Carbon-based tap- or pitchermounted filters can work wonders in removing impurities from drinking water. They can even be installed on shower heads for those with sensitive skin. If your water is from a well, there are expensive ways to remove it close to the source, but the most affordable approach is to filter it at the faucet or with a pitcher-mounted filter.

According to the U.S. Environmental Protection Agency (EPA), chlorine levels of four parts per million or below in drinking water — whether from a private well or municipal reservoir — are acceptable from a human health standpoint. Inexpensive home drinking water test kits (from $5 on up) that can detect levels of chlorine and other elements in water are widely available from online vendors. Administering the tests is easy and can provide parents with a way to involve kids in science for a practical purpose right at home. Chlorine was first used in drinking water to reduce waterborne infectious diseases in Jersey City, N.J. more than a century ago. It was so effective at destroying potentially harmful bacteria and viruses that the practice soon spread far and wide. Today some 98 percent of water treatment facilities in the U.S. use some form of chlorine to clean drinking water supplies. The American Water Works Association (AWWA), a trade group representing water utilities across the country, credits the presence of chlorine in drinking water with a 50 percent increase in life expectancy for Americans over the last century. Indeed, some consider the chlorination of drinking water to be one of history’s greatest public health achievements. But others aren’t so sure that any chlorine in drinking water should be considered safe. Opponents of chlorination point to studies linking repeated exposure to trace amounts of chlorine in water with higher incidences of bladder, rectal and breast cancers. The problem lies in chlorine’s ability to interact with organic compounds in fresh water to create trihalomethanes (THMs), which when ingested can encourage the growth of free radicals that can destroy or damage vital cells in the body. Besides cancer, exposure to THMs has been linked to other health issues including asthma, eczema, heart disease and higher miscarriage and birth defect rates. Those with their own private wells who are skittish about chlorine have other options for disinfecting their water. One baby step would

After losing to Loyola twice during the regular season — and once during a scrimmage — it seemed that the Cubs had Samohi’s number. That would have been the case if not for Mathews, who led the Vikings with a 24point per game average this season and has proven to be the team’s undisputed leader. “I honestly have been thinking about that all week, what if it comes down to that,” Mathews said. “We’re not going to lose to them three times, not three times.” Hecht couldn’t have agreed more. “Great players make great shots,” Hecht said of Mathews’ last-second heroics. In fact, she said, she had written conversion times from miles to kilometers all over her hands and forearms so she could pace herself properly. She started in a pack of four, fell back in mile 3, caught up and took the lead at mile 4. Duliba and Ethiopian Zemzem Ahmed broke away from the pack in mile 11. Ahmed seemed content to draft off Duliba for much of the next eight miles, but Duliba left her in mile 19 and later said she was surprised Ahmed didn’t stay with her. “I was expecting her to run fast,” Duliba said through an interpreter. “I was surprised she stayed behind me. I was asking (her) to go in front.” Ahmed finished second in 2:30:32. A spot on the Belarus team isn’t assured for Duliba until the end of April because others might run faster. “I’m so happy. It was my dream to run this time, to set the national record,” Duliba said. “The last 10 kilometers, I had in mind, ‘Keep the same pace. Keep pushing, keep pushing.’ “ Mose and Julius Keter raced as part of a pack of 10 runners for the first 15 miles. By mile 22, the pack had thinned to six, and before the mile was up, the two broke away. Mose left Keter in mile 25. Keter finished in 2:10:31, followed by Nicholas Chelimo of Kenya in 2:10:43.

When I found myself at 25 ... I felt strong and happy.” Deena Kastor, the 2004 Olympic bronze medalist who came into the race with the fastest marathon time among the elite women, fell back in mile 5 and never threatened. She finished third in 2:32:39. Kastor, who raced even though she is planning to run in the world cross country championships next week in Poland, attributed her performance to an upset stomach and a little tightness. “I felt definitely like I was prepared to run,” the 40-year-old said. “My husband told me it’s getting 100 percent out of yourself on a less-than-100-percent day. I gave a 100 percent effort on an 80 percent day.”

Her efforts have not gone unnoticed by those in her field. “I cannot emphasize enough the incredible work that Malissa has done on behalf of the arts and for arts education in the state of California,” said California Arts Council Director Craig Watson. “Her dedication, passion, and extraordinary effort in this unpaid position is unprecedented.” To Feruzzi Shriver, art education is disappearing from California schools in an alarming manner. “If I see that threatened it riles me up,” she said. Since the benefits of art are easily felt but hard to quantify, decisive action must be taken to insure its future. “I don’t know why people, as citizens, don’t feel an obligation to protect art,” she asked. “I would not be considered a successful student without painting, drawing, and arts and crafts.” A fallacy found when reasoning against art is that only artists and those seeking art degrees benefit from learning how to sculpt, or play an instrument. Aside from promoting creativity, it teaches your mind the process of inquiry. Studying art is training your mind to think critically, she

believes. “What art is and how important it is, is misunderstood and undervalued,” Feruzzi Shriver said. “It’s about values, you don’t invest in what you don’t value.” Although art programs have been universally cut around the nation, the downtrodden subject is still a college requirement and necessary for transfer. “If it weren’t important curriculum it wouldn’t be in schools,” she said. Having grown up around artists and her father a sculptor, the mother of two now encourages artful thinking around the house and among her own family. Bobby Shriver plays guitar in his spare time. The former mayor also has a passion for photography, and the Shriver’s eldest daughter Natasha is a singer and songwriter. “I have to do it, as my duty,” said Feruzzi Shriver. This sense of devotion is what distinguishes Shriver from other advocates. The conviction can be felt in her words and echoed in her actions, the moral imperative to act is inescapable. “That’s the ineffable thing about art, you feel it, but you don’t know why you feel it.” Feruzzi Shriver’s contributions to California’s arts education have been meaningful and numerous as she continues to be a champion for creativity. Look for her this year to start a new ad campaign with famed architect Frank Gehry in her ongoing effort to spark interest in art. “People react and respond to beautiful things,” she said. “They’re attracted to it, it’s sexy and young. It’s art.”

After three years, Alvarez finally put her inner demons to rest by completing a new personal best and successfully qualifying for the Boston Marathon. “It’s amazing, I loved it,” she said. The marathon is not so much a race as it

is a happening. “It’s like a cultural experience,” said Samuel Bennett, who completed his first ever marathon. “It was difficult for everyone. Everyone who finished had to push themselves.” As he was wincing and rubbing his tired legs, Bennett said that he had tried a couple of half marathons and thought it would be fun to race in the big event. But, after going through the rigors of completing all 26.2 miles he admitted that maybe it would seem like a fun idea after the soreness went away. Andrew Gonzalez experienced some leg pains of his own.

“A year ago, I broke my leg,” Gonzalez said. Complete with a seven inch plate, and nine screws in his left leg doctors told him to take it easy. Not wanting to be hampered by the past, Gonzalez had something to prove to himself on Sunday. “It’s something I’ve always aspired to do, I did it,” he said. While a marathon is a once-in-a-lifetime accomplishment for many in attendance, for Joao Miranda it’s simply a part of his day-to-day training. Miranda who ran two SEE L.A. PAGE 11

n these tough economic times many people are finding themselves out of work, sometimes for the first time in their lives. More than three million Americans are fired each year. After the initial shock of being fired has worn off, the practicalities of having to navigate the unemployment insurance system come into sharp focus.

WIND/WEATHER High pressure will migrate over the western US during the next couple days. This will set up favorable local wind, as well as a warming trend over the next few days. For Wednesday through the end of the work week we will see light and variable to light NE/offshore flow in the morning, shift light to moderate onshore WNW in the afternoon. Similar conditions look likely as we head into the weekend at this time.

Generally, you are entitled to unemployment benefits if you are unemployed through no fault of your own, for example, if you were laid off, fired for a reason other than misconduct, or quit your job for good reason. Once the Employment Development Department (EDD) has received your application for benefits, it usually conducts a telephone interview with you, and also with your employer, to find out why you were fired. Unfortunately, some unscrupulous employers challenge their former employee’s application for benefits even when that employee was fired through no fault of his or her own. In this case, the employer usually claims that the employee was fired for misconduct. If your application for benefits is denied, you have 20 days to file an appeal. If you believe that your benefits were unfairly denied, it is very important that you file a timely appeal. You will receive a hearing date about 4-6 weeks later. Sometimes, the employer does not even bother to show up to the appeal hearing; they were counting on the fact that you wouldn’t fight the denial of your benefits. The hearing is your chance to explain your side of the story to an Administrative Law Judge. It is natural to feel nervous before the hearing, but you will feel better if you are properly prepared to present your case. You should ask to review the EDD’s file on your case, which will include the interview notes with your employer. This means you will get a chance to see what your employer said about why you were fired. You can also send a written request to your employer asking to inspect your personnel file pursuant to Labor Code Section 1198.5. You can ask witnesses who can corroborate your version of events to come with you to the hearing. If they can’t come, you can ask them to give you a written statement to take along with you. You

can also ask the EDD to subpoena witnesses for you. Finally, you should familiarize yourself with the law that applies to your case. A good starting place is the “Benefit Determination Guide” on the EDD website: http://www.edd.ca.gov/UIBDG/default.htm. You don’t have to bring an attorney with you to the hearing, although you may feel more confident with the support of an attorney experienced in this area. Depending on the circumstances of your termination, you may also wish to seek legal advice to determine whether you have any legal claims arising out of your discharge. Although most workers in California are “at will” employees, which means they can be fired for any reason or for no reason at all, even “at will” employees cannot be fired in certain circumstances. For example, an employer cannot fire its employee for a discriminatory reason; or because s/he made a health and safety complaint; or because she took time off to perform jury duty. This is a complex area of the law, and an attorney can advise you on whether you may have grounds for a wrongful discharge suit. Upon investigation of the circumstances of your termination, an attorney may also identify violations which took place during your employment. For example, you may have an overtime claim if your employer did not pay overtime pay (time and a half) for all hours over eight in a day, and forty in a week, or a claim for meal period premium pay if you were unable to take an uninterrupted 30 minute meal break per five hours worked. Exploring potential claims with an attorney may help to give you some peace of mind in this difficult time.
