LOS ANGELES Every time Los Angeles exhales, odd-looking gadgets anchored in the mountains above the city trace the invisible puffs of carbon dioxide, methane and other greenhouse gases that waft skyward. Halfway around the globe, similar contraptions atop the Eiffel Tower and elsewhere around Paris keep a pulse on emissions from smokestacks and automobile tailpipes. And there is talk of outfitting Sao Paulo, Brazil, with sensors that sniff the byproducts of burning fossil fuels. It’s part of a budding effort to track the carbon footprints of megacities, urban hubs with over 10 million people that are increasingly responsible for human-caused global warming. For years, carbon dioxide and other greenhouse pollutants have been closely monitored around the planet by stations on the ground and in space. Now, scientists are eyeing large cities — with LA and Paris as guinea pigs — and aiming to observe emissions in the atmosphere as a first step toward independently verifying whether local — and often lofty — climate goals are being met. For the past year, a high-tech sensor poking out from a converted shipping container has stared at the Los Angeles basin from its mile-high perch on Mount Wilson, a peak in the San Gabriel Mountains that’s home to a famous observatory and communication towers. Like a satellite gazing down on Earth, it scans more than two dozen points from the inland desert to the coast. Every few minutes, it rumbles to life as it automatically sweeps the horizon, measuring sunlight bouncing off the surface for the unique fingerprint of carbon dioxide and other heattrapping gases.

That last may change, however, as the owner of the building in which the sports bar has stood for over 20 years contemplates a major change in the use of the
space, demonstrating the fundamental tugof-war between restaurants and retail in the high-end shopping district. If approved by the Santa Monica Planning Commission, the building with its tall ceilings, deep back end and expansive 7,500-square-foot basement will be converted from a 15,000-square-foot restaurant to one less than 10 percent of its size. California struggles with experiment to shift inmates DON THOMPSON Associated Press
SACRAMENTO, Calif. In response to a federal court order, Gov. Jerry Brown pushed a novel approach through the Legislature two years ago to dramatically reduce California’s prison population. People convicted of felonies that were considered nonviolent, non-sexual and non-serious would serve their sen-
tences in county jails rather than state prisons. Once released, they would be supervised by local probation officers instead of state parole agents. The shift in California’s penal system, referred to as “realignment,” is one of the nation’s largest criminal justice experiments and has done its job in at least one respect: The population in the state’s 33 adult prisons has dropped so much that the system now ranks second to Texas in the number of inmates, even though Texas has 12 million fewer
residents. But the change has not come without criticism. Many law enforcement officials, victims’ rights groups and Republican lawmakers say crime has increased because of Brown’s realignment law, as the wave of new inmates arriving in some county jails is leading to overcrowded conditions and the early release of dangerous felons. It’s like devils on the wall — big scary eyes and big scary teeth, and just the whole vibe is not what we’re used to,” Patti Negri, president of the Hollywood Dell Civic Association, told the newspaper. L.A. city code officials responded to complaints about the monster art and cited the “Run It!” singer $376 for unpermitted and excessive signage. Under city ordinances, it’s illegal to create murals on most private properties. Though that didn’t stop Madonna from painting her Hollywood Hills home in red and yellow stripes in the 1990s. Brown has been ordered to remove the goblin paintings within 30 days, but his attorney Mark Geragos said the musician is not backing down. “They are trying to suspend the First Amendment,” Geragos said. Geragos alleges neighbors are harassing Brown, and have also made parking complaints about him and called animal control. In a telephone interview with The Associated Press Saturday, Negri said all she wants is for Brown to “tone it down and be a better neighbor.” Brown’s tumultuous relationship with singer Rihanna and foul-mouthed Twitter presence have given him a bad boy reputation. Brown won a Grammy in 2011 for Best R&B Album with “F.A.M.E.” and was arrested shortly after the 2009 awards ceremony for assaulting Rihanna. “I know a $300 fine is probably pocket change. But hopefully and maybe, he’ll just see the light and decide to be a good neighbor,” Negri told the Times. “We’re happy to have him — if he just tones it down.”

decisions, politicians top the list. Two weeks ago city officials recommended that the City Council impose a modest $100 annual fee plus 15 percent of the gross revenue on professional athletic trainers who use our public parks to train clients. Because private trainers are often paid in cash and under-report their income, I wrote that council should just consider higher fees and forget the percentage of revenue. Councilwoman Gleam Davis suggested, and council approved, that city officials should study a 10 percent fee on (mostly undeclared) revenues. I think they shortchanged themselves. Head shake. There’s the “nanny” politicians like State Sen. Bill Monning (D-Carmel, Santa Cruz and Monterey), lead sponsor of SB 622. It would impose a penny per ounce tax on sweetened beverages like soda and energy drinks. The measure is now advancing through the state Legislature. Monning said, “This is the first time this state committee has passed a bill that would place a tax on sugary drinks and the first step toward stemming the epidemic of childhood obesity.” What about candy, salty snacks, cookies, doughnuts and other sugar- or saltladen foods? They’re not of concern to an obesity-obsessed senator who apparently has no real issues on his radar screen? How about State Sen. Ted Lieu who now represents Santa Monica in an expanded 28th Senate District (and who is up for reelection next year)? Lieu is pushing for a statewide statute that would require those who make bogus 911 emergency calls (called swatting) reimburse police for expenses in handling the calls — even though the pranks are mostly a Los Angeles phenomenon Lieu has authored SB 333 that requires that pranksters who “swat” celebrities and politicians’ homes (assuming they get caught) pay up to $10,000 in costs incurred by public safety responders. Why is this legislation pending on a state level? It makes much more sense for those jurisdictions where these incidents occur to pass their own laws, like the L.A. City Council is doing right now. After he announced the legislation last month, the press-hungry Lieu was himself a victim of swatting. The incident received extensive local news coverage. How convenient. I couldn’t help but wonder if Lieu had “swatted” himself for publicity. Others have asked me the same question. I’m sure he didn’t, however, public reaction to the incident says loads about how Lieu is perceived. By the way, how’s that State Senate study on airport air pollution coming along, senator? You know, the one where only one airport — Santa Monica Airport — was studied? Our former State Sen. Shelia Kuehl has officially announced she’s running for Zev Yaroslavsky’s seat on the L.A. County Board of Supervisors. Yaroslavsky is termed out in 2014. His district covers most of the Westside, including Santa Monica. Sheila Kuehl? Didn’t she vigorously oppose the failed Measure T on the Nov. 4, 2008 ballot in Santa Monica? The measure
called for a temporary cap on commercial development, which would thereby reduce traffic increases. She said, “I’ve concluded that it would not actually reduce traffic … .” Commercial development doesn’t create traffic? Sounds like the same kind of gibberish we hear from City Hall’s overpaid planning consultants It gets better, folks. Kuehl went on to state that the measure “could actually jeopardize the dwindling supply of affordable housing…” and “Measure T would have the effect of allowing, and even encouraging, landlords to demolish affordable apartments and displace renters… thereby putting our community’s working families and seniors at much greater risk.” Kuehl must’ve pulled this out of her behind because T had nothing to do with housing or demolishing apartments — affordable or otherwise. More than likely, she was just helping a close, close friend who was co-chairing the deep-pocketed, developer-backed committee opposing the measure. With that kind of thinking, Kuehl would be right at home on the development friendly county Board of Supervisors. But for sheer ignorance and stupidity, nothing beats a United States senator unless there’s more than one. Fifty-four senators recently shot down Manchin-Toomey, the gun control bill that would have closed loopholes in background checks for gun purchasers. It was just a few weeks ago when law enforcement officers captured accused Boston Marathon bomber Dzhokhar Tsarnaev. While Tsarnaev, a U.S. citizen, was clinging to life in a Boston hospital, Sens. John McCain (R- Arizona) and Lindsey Graham (R -South Carolina) were clamoring for him to be held as an enemy combatant and “interrogated” by military tribunal. Renowned Harvard law professor Alan Dershowitz commented, “There is absolutely no grounds to hold the suspect as an enemy combatant.” Dershowitz said McCain and Graham, “should go back to school and study their constitutional law.” Graham even helped write “The Military Provisions Act of 2009” that says people like Tsarnaev may not be tried as an enemy combatant and cannot be held as one. And, a provision in the National Defense Authorization Act (NDAA) approved by Congress in 2011 defines who can be declared an enemy combatant and exempts U.S. citizens entirely. For two United States senators to ignore basic citizen rights, it’s unforgivable. To think, McCain was almost elected president. And, obstructionist Graham is one of the chief reasons why Congress is so dysfunctional. But this had nothing to do with justice or citizen rights. It was about trying to sound tough on terror. had a sinking feeling that something was wrong with their home when cracks began snaking across their walls in March. The cracks soon turned into gaping fractures, and within two weeks their 600square-foot garage broke from the house and the entire property — manicured lawn and all — dropped 10 feet below the street. It wasn’t long before the houses on both sides collapsed as the ground gave way in the Spivey’s neighborhood in Lake County, about 100 miles north of San Francisco. “We want to know what is going on here,” said Scott Spivey, a former city building inspector who lived in his four-bedroom, Tudor-style dream home for 11 years. Eight homes are now abandoned and 10 more are under notice of imminent evacuation as a hilltop with sweeping vistas of Clear Lake and the Mount Konocti volcano swallows the subdivision built 30 years ago. The situation has become so bad that mail delivery was ended to keep carriers out of danger. “It’s a slow-motion disaster,” said Randall Fitzgerald, a writer who bought his home in the Lakeside Heights project a year ago. Unlike sinkholes of Florida that can gobble homes in an instant, this collapse in hilly volcanic country can move many feet on one day and just a fraction of an inch the next. Officials believe water that has bubbled to the surface is playing a role in the destruction. But nobody can explain why suddenly there is plentiful water atop the hill in a county with groundwater shortages. “That’s the big question,” said Scott De Leon, county public works director. “We have a dormant volcano, and I’m certain a lot of things that happen here (in Lake County) are a result of that, but we don’t know about this.” Other development on similar soil in the county is stable, county officials said. While some of the subdivision movement is occurring on shallow fill, De Leon said a geologist has warned that the ground could be compromised down to bedrock 25 feet below and that cracks recently appeared in roads well beyond the fill. “Considering this is a low rainfall year and the fact it’s letting go now after all of these years, and the magnitude that it’s letting go, well it’s pretty monumental,” De Leon said. County officials have inspected the origi-
nal plans for the project and say it was developed by a reputable engineering firm then signed off on by the public works director at the time. “I can only presume that they were checked prior to approval,” De Leon said. The sinkage has prompted county crews to redirect the subdivision’s sewage 300 feet through an overland pipe as manholes in the 10-acre development collapsed. Consultant Tom Ruppenthal found two small leaks in the county water system that he said weren’t big enough to account for the amount of water that is flowing along infrastructure pipes and underground fissures, but they could be contributing to another source. “It’s very common for groundwater to shift its course,” said Ruppenthal of Utility Services Associates in Seattle. “I think the groundwater has shifted.” If the county can’t get the water and sewer service stabilized, De Leon said all 30 houses in the subdivision will have to be abandoned. The owners of six damaged homes said they need help from the government. The Lake County Board of Supervisors asked Gov. Jerry Brown to declare an emergency so funding might be available to stabilize utilities and determine the cause of the collapse. On May 6, state Sen. Noreen Evans, D-Santa Rosa, wrote a letter of support asking Brown for immediate action. The California Emergency Management Agency said Brown was still assessing the situation. On Wednesday, the state sent a water resources engineer and a geologist to look at the problem. Sen. Dianne Feinstein sent a representative the next day. Lake County, with farms, wineries and several Indian casinos, was shaped by earthquake fault movement and volcanic explosions that helped create the Coast Ranges of California. Clear Lake, popular for boating and fishing, is the largest fresh water lake wholly located in the state. It is not unusual for groundwater in the region to make its way to the surface then subside. Many natural hot springs and geysers receded underground in the early 1900s and have since been tapped for geothermal power. Homeowners now wonder whether fissures have opened below their hilltop, allowing water to seep to the surface. But they’re so perplexed they also talk about the land being haunted and are considering asking the local Native American tribe if the hilltop was an ancient graveyard.

Package delivery companies like FedEx and UPS have come a long way in a relatively short time regarding sustainability, but they still have considerable room for improvement. While there is only so much these companies can do to reduce their huge carbon footprints-given their reliance on emissions-heavy air transport-they’ve made great strides in greening their ground fleets, optimizing their choices of modes and otherwise streamlining energy use. For its part, UPS was an early adopter of cleaner vehicles, and today operates upwards of 2,500 low-emission vehicles that run on alternative fuels and technologies. The company is particularly jazzed about a new generation of hydraulic hybrid package delivery trucks unveiled in the fall of 2012 in partnership with the U.S. Department of Energy’s Clean Cities program. These new truckswhich employ a diesel combustion engine along with a hydraulic high-pressure accumulator that stores energy captured during braking-get 35 percent better fuel economy and generate as much as 30 percent fewer greenhouse gas emissions as compared to the non-hybrid diesel-powered vehicles they are replacing. While these trucks may cost UPS $7,000 apiece more than their traditional counterparts, the company estimates the upgrade will save $50,000 or more, while substantially reducing emissions, over the lifetime of each vehicle. UPS has also been blazing new trails in operational efficiency via intermodal shifting, e.g., using the most fuel-efficient transport mode (airplane, train, truck or ship) or combination of modes to meet customer needs. A concerted effort by the company to
streamline its operations in 2011 led to savings of two million metric tons of greenhouse gas emissions by moving delivery volume from air (the most emissions-intensive mode by far) to ground, and another 800,000 metric tons by shifting volume from ground to rail. Meanwhile, FedEx, with one of the largest hybrid-electric fleets in the industry and upwards of 2,000 alternative energy vehicles in service worldwide, is no slouch either when it comes to green streamlining. Back in 2008 the company worked with the Environmental Defense Fund (EDF) in setting the ambitious goal of improving the fuel efficiency of its worldwide fleet of Express delivery vans and trucks by 20 percent within a dozen years. Then early in 2013 the company announced that it had already exceeded its goal seven years ahead of schedule (with an overall savings of 22 percent so far) but was also upping its goal to a 30 percent fleet-wide efficiency gain by 2020. With a strong commitment to swapping out older vehicles with newer more efficient ones, the company is well on its way. It now operates 360 hybrid-electric trucks and 200 electric vehicles and is replacing many of its delivery trucks with “right-sized” Sprintertype vans that are as much as 100 percent more fuel efficient than their predecessors. FedEx has also been upgrading its fleet of Express diesel trucks to cleaner-burning models, and is making similar upgrades in its Freight and Ground divisions as well. Likewise, the company is well on its way toward reducing greenhouse gas emissions from its airplanes by 30 percent by 2020. PROMENADE FROM PAGE 1 was too big to comfortably support a restaurant. “The street in general is better served when it’s moving forward, not staying static,” Tucker said. In truth, the tale of Yankee Doodle’s possible departure is one that plays out frequently in the restaurant industry, particularly in a high-rent environment like the promenade with its deep blocks not necessarily conducive to the food business. Although the promenade’s high foot traffic could attract restaurateurs looking to cash in on the tourists that flock to the outdoor shopping district, it also means high overhead from rent that can’t be mitigated through lower employee costs, said Nima Samadi, a restaurant industry analyst for IBISWorld, a Los Angeles-based industry research firm. Restaurants have challenges worked into their business model, like the need to create menus that appeal to lunch and dinner crowds that also don’t become stale over time. Unlike retail stores which usually do not have to worry about their products going bad and shoppers can guide themselves through the shopping experience, restaurants must combat food wastage and require more employees like wait staff and bus boys to supplement the kitchen staff turning out meals, Samadi said. Although industry average profits can be a healthy 6.3 percent for a chain and 6.2 percent for a single location, that still pales in comparison to the 8.1 percent return on a women’s clothing store. It’s also notoriously difficult to keep a restaurant going. Research has shown the 90 percent failure rate on restaurants touted by media to be a myth, a study published in 2005 suggested that almost 60 percent of
restaurants fail within three years of opening. That gives landlords an incentive to switch out of the uncertain, sometimes messy restaurant business and into retail, which has a nearly built-in demand based on economic studies of the area. A report released in 2012 suggests that the Downtown market will support between 100,000 and 200,000 square feet of new retail space, largely spurred by spending from international travelers, although roughly 50,000 of that could also be grocery stores to support new apartments in the area. If that new space is not developed, rents on the promenade, already among the highest in the nation, are expected to increase. Given restaurants’ importance to the delicate balance Downtown, in 2006 the City Council stepped in to prohibit ground floor restaurants from converting to retail spaces without a conditional use permit, what the Tucker Investment Group will request from the Planning Commission on Wednesday. Despite their challenges, restaurants are recognized as a key player in making the Downtown a vital place to be, said Kathleen Rawson, CEO of Downtown Santa Monica Inc., a public-private agency that manages Downtown for City Hall. The organization has a retail consultant on hand to help guide landlords in their selection of new tenants, keeping in mind the requirement imposed by City Hall and the overall health of the street — landlords sink or swim together on the promenade, and the mix of businesses and restaurants is a critical element of that equation. Outdoor diners bring life and movement to the street, she said. “We’re not a private shopping mall, we’re an authentic urban street, and the weather is perfect for it,” Rawson said.

My Personnel File: Why Do I Want it and How Do I Get a Copy? T
he permanent record from our youth may have been a ruse cooked up to keep children in line, but these days, we are close to having permanent records due to our rapidly all encompassing digital world.Thankfully, personnel files are not yet in digital format.While we still can, we should at least always be prepared to have access to these records to check and to fix any wrong information.We may also want access when we think we should get a raise and want to use former evaluations, client letters, or training records to get it. Thee Why: More often than not, employees do not even know how to access this information until they talk to a lawyer.And if you are talking to a lawyer about work, something's already gone wrong. Lawyers want to see what your performance record is, any personnel actions and the basis, or any other records that could help determine whether, say, a termination was legally wrongful or justifiable in light of the bigger history. Most of these employment cases turn on performance, the reason the employer gives for the termination, versus whatever you as a plaintiff will show. For example, one good way to maintain better records in your file is to put in writing what you disagree with, such as in a negative evaluation. Later when these are reviewed, and the employee has these notes, it will be more difficult for a bad employer to justify their wrongful behavior through performance issues. Another reason to keep track is that personnel records can be subpoenaed by a third party,which is something that could happen in any type of legal action where you are involved.The law does require that you are given a notice and opportunity to object to the subpoena.If any of it is relevant to whatever legal action is happening,not necessarily even an employment case,then usually the subpoena is allowed.
Thee How: There are no federal laws about these records, but California has very clear laws. Still, some employers do not know them or follow them properly so it is better to know your rights and educate your employer if needed. Here are the types of records that you are legally entitled to get: Pay Records: Employers have to keep for at least three years of your pay records and give their employees a copy within 21 days of request or face civil penalties (Labor Code 226).Personnel Files: Employers have to keep records and give you access to them within a reasonable time (Labor Code 1198.5).All documents you signed:These are the ones signed at hire or as continuing term and condition of employment (not documents signed in the course of conducting business). (Labor Code 432). Tips: Though these requests do not have to be in writing, it is usually better so that you can keep track of the response time. Employers may have part of your personnel file in different offices. Be sure to know where yours is kept so when the time comes you know how to find it without being given the run around. Ask for or make copies of all personnel documents as they come up and hold on to the hiring paperwork so that you have your own set for comparison later.
Unemploymentt Benefits:: Do o I Qualify? The news is not getting better about the economy and the unemployment office has to be really picky when it comes to claims.You were not laid off, but instead quit or were terminated. How can you file for unemployment and be approved? This is one of the most often asked questions from my clients. Some who are still working want to know if they should quit or wait to be terminated.The decision will vary from person to person to situation.The decision can also be personal or health related or that you just want to be out of there. Here are some legalities to consider in your decision. Thee Quit: In a situation with a quit, there is generally just one type of circumstance that will get you these benefits. If you can show that you quit because the work conditions were such that no reasonable person could be expected to work there, then you can still qualify for the benefits.This is a high standard limited to what the law requires of the workplace, such as safe conditions, free from harassment, being paid, and free from retaliation.This is not an easy showing to make and so arguments based on personality, rudeness, bad bosses, etc, will not fly. on: Thee Terminatio Most people think that if you have been terminated, there is no unemployment for you. However, there are exceptions to this. Of course, if you have been terminated based on policy violations, gross misconduct, and other severe actions, then you are disqualified. One way to overcome that, if the facts are there, is the exception that the conduct may not have been appropriate but it was an isolated instance of poor judgment, or something excusable that happened the one time for a good reason. Criminal activity at work or assault or harassment is never excusable. Thee Wrongfull Termination: If you have been "wrongfully terminated" in the legal sense,you may still qualify for unemployment.Most employees who file lawsuits have been terminated.If the facts are there for a lawsuit,then they should be there to qualify you for unemployment.You need to show that the termination was not based on whatever the employer is claiming,but because of some legal violation they have committed.For example,if you complain of sexual harassment,then a week later,you are terminated for some work issue that happened two months ago,then the termination was retaliation.When an employer retaliates for your report of a prohibited workplace activity,that employer just violated anti-retaliation laws. Tip: If you are unemployed but develop a disability and you can't work, then you no longer qualify for unemployment.At this point, apply for State Disability Benefits.Again, these is not easy to get and you will need medical proof, but it is one safety we are lucky to have here in California.

Santa Monica Pier: Renewal Project The city of Santa Monica is rejuvenating the structure of the Santa Monica Pier. The original structure was built in the early 1900s and has been through several remodels over its 100-plus year life. The pier renewal will upgrade a significant portion of the pier stretching from the edge of the sand to approximately 365 feet westward over the Pacific Ocean, providing increased structural soundness and extending the pier’s service life. The Pier Renewal Project will involve: • Construction of a 20-foot wide pedestrian trestle on the south side of the pier, beginning at the western edge of the Newcomb Pier and extending 175 feet west around the construction zone. • Installation of new concrete columns. • Removal of the existing timber columns, timber substructure, and installation of the new concrete substructure. • Installation of the new timber decking. Construction is expected to begin April 25 and conclude in spring 2014. The pier and its businesses will remain open during construction. STUDY FROM PAGE 1 In a storage room next door, commercially available instruments that typically monitor air quality double as climate sniffers. And in nearby Pasadena, a refurbished vintage solar telescope on the roof of a laboratory on the California Institute of Technology campus captures sunlight and sends it down a shaft 60 feet below where a prism-like instrument separates out carbon dioxide molecules. On a recent April afternoon atop Mount Wilson, a brown haze hung over the city, the accumulation of dust and smoke particles in the atmosphere. “There are some days where we can see 150 miles way out to the Channel Islands and there are some days where we have trouble even seeing what’s down here in the foreground,” said Stanley Sander, a senior research scientist at the NASA Jet Propulsion Laboratory. What Sander and others are after are the pretty much invisible greenhouse gases spewing from factories and freeways below. There are plans to expand the network. This summer, technicians will install commercial gas analyzers at a dozen more rooftops around the greater LA region. Scientists also plan to drive around the city in a Prius outfitted with a portable emissionmeasuring device and fly a research aircraft to pinpoint methane hotspots from the sky. (A well-known natural source is the La Brea Tar Pits in the heart of LA where underground bacteria burp bubbles of methane gas to the surface.) Six years ago, elected officials vowed to reduce emissions to 35 percent below 1990 levels by 2030 by shifting to renewable energy and weaning the city’s dependence on
out-of-state coal-fired plants, greening the twin port complex and airports and retrofitting city buildings. It’s impractical to blanket the city with instruments so scientists rely on a handful of sensors and use computer models to work backward to determine the sources of the emissions and whether they’re increasing. They won’t be able to zero in on an offending street or a landfill, but they hope to be able to tell whether switching buses from diesel to alternative fuel has made a dent. Project manager Riley Duren of JPL said it’ll take several years of monitoring to know whether L.A. is on track to reach its goal. Scientists not involved with the project say it makes sense to dissect emissions on a city level to confirm whether certain strategies to curb greenhouse gases are working. But they’re divided about the focus. Allen Robinson, an air quality expert at Carnegie Mellon University, said he prefers more attention paid to measuring a city’s methane emissions since scientists know less about them than carbon dioxide release. Nearly 58 percent of California’s carbon dioxide emissions in 2010 came from gasoline-powered vehicles, according to the U.S. Energy Department’s latest figures. In much of the country, coal —usually as fuel for electric power — is a major source of carbon dioxide pollution. But in California, it’s responsible for a tad more than 1 percent of the state’s carbon dioxide emissions. Natural gas, considered a cleaner fuel, spews one third of the state’s carbon dioxide. Overall, California in 2010 released about 408 million tons of carbon dioxide into the air. The state’s carbon dioxide pollution is SEE CARBON PAGE 11

Gregg Marland, an Appalachian State University professor who has tracked worldwide emissions for the Energy Department, said there’s value in learning about a city’s emissions and testing techniques. “I don’t think we need to try this in many places, but we have to try some to see what works and what we can do,” he said. Launching the monitoring project came with the usual growing pains. In Paris, a carbon sniffer originally tucked away in the Eiffel Tower’s observation deck had to be moved to a higher floor that’s off-limits to the public after tourists’ exhaling interfered with the data.
So far, $3 million have been spent on the U.S. effort with funding from federal, state and private groups. The French, backed by different sponsors, have spent roughly the same. Scientists hope to strengthen their ground measurements with upcoming launches of Earth satellites designed to track carbon dioxide from orbit. The field experiment does not yet extend to China, by far the world’s biggest carbon dioxide polluter. But it’s a start, experts say. With the focus on megacities, others have worked to decipher the carbon footprint of smaller places like Indianapolis, Boston and Oakland, where University of California, Berkeley, researchers have taken a different tack and blanketed school rooftops with relatively inexpensive sensors. “We are at a very early stage of knowing the best strategy, and need to learn the pros and cons of different approaches,” said Inez Fung, a professor of atmospheric science at Berkeley who has no role in the various projects.

PRISONS FROM PAGE 3 on preliminary FBI crime statistics to argue both sides of the issue. Though still low in comparison to previous decades, property and violent crimes increased in 40 of California’s 69 largest cities in the first six months of 2012, the largest such increase in 20 years, and the Sacramentobased Criminal Justice Legal Foundation said realignment is clearly to blame. But the San Francisco-based Center on Juvenile and Criminal Justice said violent crime rates dropped in five counties that received a lion’s share of the lower-level offenders who previously would have gone to state prisons, showing that counties can handle the influx without a corresponding rise in crime. The law’s opponents have highlighted individual cases such as a parole violator on early release who beat his girlfriend so badly she suffered brain damage and another charged with raping and killing his 76-yearold grandmother. Inmates who serve time in county jails often are not being monitored at all after being set free, and the number of paroled sex offenders who are fugitives rose 15 percent after Brown’s realignment law took effect. Moreover, the law firms that previously sued the state are now targeting counties for the same conditions that led to a federal court takeover of some state prison operations, oversight that has cost the state billions of dollars. An expert who has been studying the prisoner shift, Stanford University law professor Joan Petersilia, said the policy is serving as a national experiment about whether prison populations can be reduced significantly without posing a threat to public safety. More than 100,000 offenders have been affected by the law, which took effect in October 2011. More than $2 billion has been allocated by the state to help local governments handle their new responsibilities, while another $1.7 billion in state bonds is going to build more county jail space. For all the upheaval, the frustration for Brown is that the shift of tens of thousands of prisoners still has not been enough to satisfy the panel of three federal judges. The state had no choice but to reduce prison crowding after the judges ruled that it was the primary cause of unconstitutionally poor inmate medical and mental health care. The U.S. Supreme Court upheld the decision in 2011, forcing the state to reduce its state inmate population. The realignment law is responsible for reducing the state prison population by 25,000 inmates, to about 119,000. Yet the federal courts say another 9,300 must go by year’s end and have threatened to hold Brown in contempt if he doesn’t comply. California prisons now hold 43,000 fewer inmates than they did at their peak in 2006 — a 25 percent drop. The inmate reduction is larger than the entire prison populations of 42 other states, according to the latest U.S. Bureau of Justice Statistics figures.
“That’s a historic change,” said Corrections Secretary Jeffrey Beard, who took over California’s system in January after heading Pennsylvania’s prison system for nearly a decade. “It’s huge. Nobody else in the nation has done that.” But the realignment law, known as Assembly Bill 109, has emboldened Republicans, the state’s minority party. It passed without GOP support, and now those lawmakers are taking an I-told-you-so approach as they seek legislation to repeal or overhaul it. “In every county of this state, citizens of California have suffered and been victimized by the AB109ers, as we call them,” Republican state Sen. Jim Nielsen, who once headed the state’s parole board, said during a recent Capitol news conference. “I’ll argue (that) no bill ever passed by this Legislature has had more dire and severe and egregious consequences.” Some Democratic state lawmakers also say several problems need to be fixed, even as they support the overall goal of moving more offenders closer to rehabilitation services in the communities where they committed their crimes. “I don’t think you need to be seen as a bomb-thrower to be saying realignment, AB109, warrants tweaking,” said freshman Assemblyman Ken Cooley, a Democrat from suburban Sacramento who is the author of two bills that would send some criminals back to state prisons instead of placing them in county jails. “I think that’s the public policy conversation in California at this moment.” Much of the focus has been on two areas: the increase in long-term inmates now housed in jails, which were designed for short stays; and the ability of paroled sex offenders in some overburdened counties to remove their satellite-linked tracking devices with impunity. Sheriffs and attorneys representing inmates’ welfare say the long-term inmates are aggravating problems in overcrowded jails, where officials already were having trouble providing services to inmates with mental or physical illnesses or disabilities. An Associated Press analysis earlier this year of figures from the state corrections department showed a nearly 60 percent increase in the number of warrants issued for fugitive paroled sex offenders under realignment. Offenders now have less incentive to behave because the realignment law reduced the penalty for removing or disabling their ankle bracelets. Before, parole violators could have been sent back to state prison for up to a year. Now they can be sentenced to up to six months in county jails, but many are released within days because local jails are overcrowded. Brown has said he is open to “tweaking” the law. But he also has said it is a responsible middle ground between the federal judges who want fewer criminals in the state’s prisons and critics who say the state has gone too far. “I think it’s the boldest move in criminal justice in decades,” Brown said, “and it’s long overdue.”

The citation read, "Failure of driver ... to keep right." The station's meteorologist noted that winds that day were gusting to 40 mph and that the woman might simply have been trying to control her car.
