LOS ANGELES Los Angeles politicians have struggled for more than five years to regulate medical marijuana, trying to balance the needs of the sick against neighborhood concerns that pot shops attract crime. Voters will head to the polls Tuesday to decide how Los Angeles should handle its high with three competing measures that seek to either limit the number of dispensaries or allow new ones to open and join an estimated several hundred others that currently operate. Election Day in the nation’s secondlargest city comes just two weeks after a pivotal state Supreme Court decision gave cities and counties the authority to ban pot shops. More than 200 local municipalities have bans, and some cities that were awaiting guidance from the state’s highest court have taken immediate action this month and begun shuttering clinics. While some cities have been able to manage pot collectives, Los Angeles fumbled with the issue and dispensaries cropped up across the city as a result. Councilman Ed Reyes said Los Angeles has run into trouble where other cities such as Oakland haven’t because of the sheer size of LA and a movement that is more organized and litigious. “The pie is so big here, so thick and rich, that we have many people making a run at it,” Reyes said. “Regardless of which measure you support, the city is going to have to focus on enforcement. I think as long as we don’t have enforcement, it’s just letters on paper.” City councilors passed an ordinance in 2010 to cut the number of shops from roughly 1,000 to 70. But numerous lawsuits were filed against the city by dispensaries and the ordinance was allowed to expire last year, leading to another surge of pot shops. Last summer, the city approved a ban, but two months later repealed it after enough signatures were gathered to get the measures

MID CITY Officials at Saint John’s Health Center have 99 concerns, but parking, they hope, isn’t one. As rumors about the future of the hospital swirl and offers to purchase it from its owners, the Sisters of Charity of Leavenworth Health System, percolate, officials have quietly been proceeding with its other constant battle — parking.

Hospital administrators have formally identified 210 new parking spots and beefed up contract provisions on others, changes they believe will satisfy City Hall’s requirements that the hospital provide the “functional equivalent” to a 438-space subterranean parking structure that was promised in a 1998 contract to rebuild the hospital after the 1994 Northridge earthquake. Fail to do so and the City Council could force the hospital to invest $25 million to build

‘Trek’ earns $70.6M but falls short of studio hopes DAVID GERMAIN AP Movie Writer

LOS ANGELES “Star Trek: Into Darkness” has warped its way to a $70.6 million domestic launch from Friday to Sunday, though it’s not setting any light-speed records with a debut that’s lower than the studio’s expectations. The latest voyage of the starship Enterprise fell short of its predecessor, 2009’s “Star Trek,” which opened with $75.2 million. Since premiering Wednesday in hugescreen IMAX theaters and expanding Thursday to general cinemas, “Into Darkness” has pulled in $84.1 million, well below distributor Paramount’s initial forecast of $100 million. The film added $40 million overseas, pushing its total to $80.5 million since it began rolling out internationally a week earlier. The “Star Trek” sequel bumped “Iron Man 3” down to second place after two weekends on top. Robert Downey Jr.’s superhero saga took in $35.2 million domestically to lift its receipts to $337.1 million. Overseas, “Iron Man 3” added $40.2 million, raising its international total to $736.2 million and its worldwide tally to nearly $1.1 billion. While “Iron Man 3” and “Into Darkness” did well overseas, they were outmatched by the debut of Baz Luhrmann’s “The Great Gatsby,” which followed its domestic debut a week earlier with a wide rollout internationally. “Gatsby” pulled in $42.1 million overseas, coming in a bit ahead of both “Iron Man 3” and “Into Darkness.” Domestically, “Gatsby” held up well at No. 3 with $23.4 million, lifting its total to $90.2 million. In today’s Hollywood of bigger, better sequels, follow-up films often outdo the box office of their predecessors, as each “Iron Man” sequel has done. While “Into Darkness” earned good reviews and is getting strong word-of-mouth from fans, the film did not quite measure up to the opening weekend of director J.J. SACRAMENTO, Calif. California businesses would be prohibited from firing or retaliating against employees who take advantage of the state’s paid family leave program under a job-protection bill moving through the Legislature. The legislation would protect workers who use the California Paid Family Leave insurance program, which allows qualified employees to take up to six weeks off with partial pay. Supporters say nearly 37 percent of workers who needed the leave did not apply for the benefit for fear of being fired, angering their employers or hurting their chances at promotion. They cited a 2011 study by the left-leaning Center for Economic and Policy Research based in Washington, D.C. “This is a right that employees pay into,”

said Sen. Mark DeSaulnier, D-Concord, the author of SB761. “So all the bill says is you can’t retaliate for people taking it.” The leave is part of the State Disability Insurance program, which is funded through employee paycheck deductions. Employer groups including the California Chamber of Commerce and the California Restaurant Association oppose the bill. It would transform an employeepaid insurance program meant to replace lost wages into a protected leave of absence, a move that increases costs to all employers, especially small businesses, said Jennifer Barrera, a lobbyist for the chamber. Barrera noted that the state already has existing job-protection laws. “When you are out on a separate statutory leave of absence or an employer-provided leave of absence, you can access these wage replacement benefits to compensate you if it’s an unpaid leave,” she said. “By

itself, it is not an independent right to a leave of absence from work.” California established the Paid Family Leave program in 2002 as a way to allow parents time to bond with a newborn or newly adopted child, or to care for a seriously ill family member. An estimated 13 million California workers who are covered by the disability insurance program also have some coverage for paid family leave, according to the state’s Employment Development Department. Generally, an employee will receive 55 percent of his or her wages, and the six weeks of leave does not need to be taken all at once. Employee advocates say the existing system needs to be expanded because only half of California’s workforce is covered by other job-protection laws, even though almost all private employees in the state

Why so large? Editor:

I’m a 34-year Santa Monica resident. Does the Miramar really need to expand its size to over 500,000 square feet to make a profit or achieve its goals as a business? To put that into context for everyone, that’s about the size of Santa Monica Place, on a much smaller land parcel. We haven’t seen a plan that proposes a lower density that’s in keeping with the LUCE and the current version of the Downtown Specific Plan — without the condos, for example. The [environmental impact report] should include a study of an alternative site plan with lower density, particularly without the 120 condos.

It’s curtains for the Civic TH E FUTU RE OF TH E SANTA MON ICA

Civic Auditorium was debated at a community meeting held at the Main Library last Monday. The late 1950’s era, multi-purpose facility has been operating in the red for years. City officials plan to mothball it on June 31 then decide whether to renovate or demolish it. The auditorium and large, adjoining east room was a major show place when it opened in 1958. It hosted the Academy Awards from 1961 through 1968 and was a major regional concert and show venue for decades. As time rolled on, the Civic lost favor. In 1969, the Oscars moved to the swankier Dorothy Chandler Pavilion in Los Angeles. Touring shows, rock and pop acts moved to the Forum, Whisky A Go Go, Aquarius Theater, Hollywood Bowl, Universal (Gibson) Amphitheater and a host of other venues. At 3,000 seats, the Civic is too small for headline acts and too large for lower tier events. Punk and rap concerts were banned in the 1970s because of fears over unruly crowds. Aside from an occasional concert by the Santa Monica Orchestra or “Stairway to the Stars” student showcase, the facility today basically hosts table top exhibitions/trade shows such as the “Jewelry Expo,” craft markets and architectural lighting exhibition — and runs up to $2 million in the red, annually. City Hall officials estimate it would cost over $50 million to upgrade the facility including seismic retrofits, heating/air conditioning upgrades, modern restrooms and reconfiguration of the auditorium. Still, it would be like gussying up an aging sow’s ear. And, the result still wouldn’t be a silk purse. With the loss of redevelopment agency money last year, there’s nothing in the kitty to even pay for the work. Ten years ago, Santa Monica College’s Madison Theater (now the Broad Stage) was in the planning stages. The 500-seat theater and adjacent performance space would have been a perfect complement to the larger Civic. A combined Civic and Broad complex in the Civic Center would have provided the anchor for a top-notch performing arts center. With the addition of art galleries, small outdoor amphitheater and a café or two, we would have had a “world class” arts venue. Instead, college officials built their theater on leased school district property at Santa Monica Boulevard and 11th Street. A fabulous opportunity to provide a heart and purpose to the Civic Center evaporated. As it is, the Civic Center is a monument to “shoehorn” planning. There’s no focus. Suggestions to renovate the Civic and add amenities needed to create an “arts and entertainment” center among the random mix of government buildings, parking lots, RAND’s corporate headquarters, a hotel, 324 units of housing, a seven-acre public park and a pending childhood development center are too little and way too late. Alone and forlorn at the far end of the

Civic Center, the Civic is an uninviting, large, white monolith. The odd-shaped auditorium is uncomfortable and dated. It was designed as a multi-purpose room and has the unpleasant ambiance of a middle school cafeteria. Seating consists of folding chairs on a flat floor. Its warehouse-like exterior is a large, unattractive, windowless mass hidden in front by a 1950’s-era concrete screen. Those trying to “Save the Civic” would have a hemorrhage if someone proposed building this today with its plain walls, height and clumsy massing. There’s talk of using the Civic’s one saving grace, the 1,100 car surface parking lot next door, for other purposes. Moving parking to behind the courthouse would be the final nail in the Civic’s coffin. Even if rehabbed, it would still face operating losses every year. Those trying to save the Civic Auditorium need to get real and say “goodbye” because City Hall should tear it down and replace it with something new, fresh and exciting. I’m thinking a modestly sized, outdoor amphitheater or architecturally exciting, flexible, indoor creative space for community meetings, music, dances and performances. Including cafes and art galleries would be icing on the cake. If all else fails, there’s always more housing.

A few weeks ago, I wrote that the AMF Bay Shore Lanes at 234 Pico Blvd. — directly behind the Civic Auditorium — was slated for redevelopment as a four floor, mixed use building with 91 apartments and retail space. Last Monday night, the Landmarks Commission voted to consider designating the 1959 bowling alley as a city landmark. Landmarking would require that property owner 234 Pico PS LLC/GRT Portfolio Properties Santa Monica, LLC maintain the building’s façade and classic 1950’s signage but would not require it to keep the 24 bowling lanes or interior furnishings. Congratulations to all involved in finally considering landmark status for a significant example of Santa Monica’s cultural history. The matter will be back before the Landmarks Commission in about two months for review and a decision. I don’t know about you, but I’d much rather have a bowling alley there than another ugly, cookie cutter mixed use apartment building. And, the family-owned Norm’s Restaurant at Lincoln Boulevard and Colorado Avenue will serve its last meal on July 17. After 49 years of feeding Westsiders, it’ll be demolished and replaced by … can you guess? Of course you can. Yet, another multifloor, mixed use/apartment building — one of four contiguous projects called “The Lincoln Boulevard Collection” slated for the east side of Lincoln. Maybe one of them will have a coffee shop. Wanna bet breakfasts won’t be cheap?

alerted officials that the drinking water at Camp Lejeune was contaminated, long before authorities determined that as many as a million Marines and their families were exposed to a witch’s brew of cancer-causing chemicals. But no one responsible for the lab at the base can recall that the procedure — mandated by the Navy — was ever conducted. The U.S. Marine Corps maintains that the carbon chloroform extract (CCE) test would not have uncovered the carcinogens that fouled the southeastern North Carolina base’s water system from at least the mid1950s until wells were capped in the mid1980s. But experts say even this “relatively primitive” test — required by Navy health directives as early as 1963 — would have told officials that something was terribly wrong beneath Lejeune’s sandy soil. A just-released study from the federal Agency for Toxic Substances and Disease Registry cited a February 1985 level for trichloroethylene of 18,900 parts per billion in one Lejeune drinking water well — nearly 4,000 times today’s maximum allowed limit of 5 ppb. Given those kinds of numbers, environmental engineer Marco Kaltofen said even a testing method as inadequate as CCE should have raised some red flags with a “careful analyst.” “That’s knock-your-socks-off level — even back then,” said Kaltofen, who worked on the infamous Love Canal case in upstate New York, where drums of buried chemical waste leaked toxins into a local water system. “You could have smelled it.” Biochemist Michael Hargett agrees that CCE, while imperfect, would have been enough to prompt more specific testing in what is now recognized as the worst documented case of drinking-water contamination in the nation’s history. “I consider it disingenuous of the Corps to say, ‘Well, it wouldn’t have meant anything,’” said Hargett, co-owner of the private lab that tried to sound the alarm about the contamination in 1982. “The levels of chlorinated solvent that we discovered ... they would have gotten something that said, ‘Whoops. I’ve got a problem.’ They didn’t do that.” Trichloroethylene (TCE), tetrachloroethylene (PCE), benzene and other toxic chemicals leeched into ground water from a poorly maintained fuel depot and indiscriminate

dumping on the base, as well as from an offbase dry cleaner. Nearly three decades after the first drinking-water wells were closed, victims are still awaiting a final federal health assessment — the original 1997 report having been withdrawn because faulty or incomplete data. Results of a long-delayed study on birth defects and childhood cancers were only submitted for publication in late April. Many former Lejeune Marines and family members who lived there believe the Corps still has not come clean about the situation, and the question of whether these tests were conducted is emblematic of the depth of that mistrust. Marine Corps officials have repeatedly said that federal environmental regulations for these cancer-causing chemicals were not finalized under the Safe Drinking Water Act until 1989 — about four years after the contaminated wells had been identified and taken out of service. But victims who have scoured decades-old documents say the military’s own health standards should have raised red flags long before. In 1963, the Navy’s Bureau of Medicine and Surgery issued “The Manual of Naval Preventive Medicine.” Chapter 5 is titled “Water Supply Ashore.” “The water supply should be obtained from the most desirable sources which is feasible, and effort should be made to prevent or control pollution of the source,” it reads. At the time, the Defense Department adopted water quality standards set by the U.S. Public Health Service. To measure that quality, the Navy manual identified CCE “as a technically practical procedure which will afford a large measure of protection against the presence of undetected toxic materials in finished drinking water.” Also referred to as the “oil and grease test,” CCE was intended to protect against an “unwarranted dosage of the water consumer with ill-defined chemicals,” according to the Navy manual. The CCE standard set in 1963 was 200 ppb. In 1972, the Navy further tightened it to no more than 150 ppb. In response to a request from The Associated Press, Capt. Could it really be true that we are in the midst of the worst drought in the United States since the 1930s?

Indeed we are embroiled in what many consider the worst drought in the U.S. since the “Dust Bowl” days of the 1930s that rendered some 50 million acres of farmland barely usable. Back then, drought conditions combined with poor soil management practices to force some 2.5 million Americans away from the Great Plains, only wreaking further havoc on an already devastated Great Depression economy. The lack of native prairie grasses or cover crops to keep the soil in place meant large swaths of formerly productive agricultural land turned to dust and blew away in so-called “black rollers.” While we have learned a lot about maintaining soil quality since, drought conditions today are nevertheless taking a heavy toll on agricultural productivity, fresh water supplies and the economy-especially as the effects of global warming start to kick in more seriously. The current drought started in 2012, the hottest year on record in the U.S. with several weeks in a row of 100-plus degree days in various regions. The result was drought conditions for two-thirds of the country. Economists estimate that the dry spell cost Americans some $50 billion in agricultural losses-staple crops including soy, corn and wheat have all been devastated-as well as forest fire destruction and other financial casualties. In fact, this ongoing drought has caused more economic damage all told than Hurricane Sandy. While winter precipitation eased the conditions somewhat, federal researchers believe that more than half the country is still gripped by drought with no foreseeable end in sight and another hot dry summer just around the corner. To wit,

California experienced its driest January and February on record, and average winter temperatures across the continental U.S. were 1.9 degrees Fahrenheit above the average for last century. The National Oceanic and Atmospheric Administration (NOAA) predicts that drought conditions are likely to remain in the central and western sections of the U.S. while expanding in California, the Southwest, the southern Rockies and Texas. The Florida panhandle is also expected to see drought conditions moving into summer. Along with crop losses, the expanding drought promises to bring more wildfires to the west as well as to parts of Minnesota and even Iowa. While it may not feel like we are living in a dust bowl, the drought does affect all of us, primarily in the pocket book. Reduced crop harvests means higher prices for food items of all kind. Likewise, the cost of piping drinking water to our homes’ faucets is on the rise with freshwater reserves becoming a hotter and hotter commodity. And our tax dollars pay for emergency response missions in the case of wildfires and other warming-related weather disasters. And just as drought conditions affect each and every one of us, we each have the power to help fix the situation by reducing our own carbon footprints. Only through individual and collective efforts to drive and fly less and switch over to renewable nonpolluting fuels can we stem the tide of global warming that is either causing or exacerbating what is beginning to feel like a drought with no end. BILL FROM PAGE 3 contribute to the Paid Family Leave program through the short term disability payments taken out of their paychecks. “Everyone who pays into the tax is covered by the Paid Family Leave Act, but that act doesn’t contain an anti-retaliation provision,” said Julia Parish, an attorney with the San Francisco-based Employment Law Center, which is sponsoring the bill. While Family Paid Leave is intended to replace some lost wages, supporters say the program has a hole because not all employees have the same job protections if they want to take it. Under the separate California Family Rights Act, which mirrors the federal Family Medical Leave Act, people employed by businesses with 50 or more workers can take an unpaid leave of up to 12 weeks if they have to take time off because of a serious medical condition of a family member or to care for a newborn or adopted child. Their jobs are protected for the 12-week duration. Employees also must meet certain wage and employment requirements. But small businesses are exempt from that job-protection law, meaning there is no legal requirement that they hold a job for an employee. There also is no guaranteed job protection for a worker at any company of any size under California’s paid family leave program. According to the state Employment Development Department, 96 percent of California’s 1.4 million businesses had fewer than 50 employees. Those businesses employ roughly 41 percent of all employees, or 6 million out of 14.7 million workers. Parish said it’s why a majority of the 1,600 calls the Employment Law Center received last year dealing with work and family issues came from people who could not take their paid family leave. She said workers who contribute to the program should have a right to access the benefit. “We hear from people on almost a daily basis that want to bond with their new baby, but their employer says they can’t. They have to go right back to work,” Parish said. “They have to risk their job if they’re going to take care of them.” Sabrina Lowell, 30, lost her accounting assistant job at a small office last year. The

But to get a hundred-million-plus opening weekend, unless you’re ‘Twilight,’ you really have to cross over to all audiences.” Paramount points out that overseas business is up in many markets, though, so that worldwide, the sequel is off to a better start. “Because of the nature of the franchise, because of how many movies have been made and the various forms of the TV shows, I’m not sure that ‘Star Trek’ goes by the rules of normal sequels. I think each movie stands on its own, because it’s a unique franchise,” said Don Harris, Paramount’s head of distribution. “My goal was always that we grow the franchise. We’re clearly seeing by today’s numbers that the

One has autism and another has attention deficit hyperactivity disorder. “Time after time, I talked to them about the boys’ transition and how they were behind in school and their behavior needed my attention and support,” she said. “When they told me that they would not approve it, I ... felt I didn’t have a choice (but) to take it given their troubles at school and troubles at home. When I did, I lost my job.” But Barrera, from the state chamber, said DeSaulnier’s bill would create a burden on small businesses. As the bill stands, there is no limit on the amount of compensation an employee can demand in a lawsuit and no minimum length of time the worker will have needed to be employed to qualify for the benefit. An employer with three employees could have all three workers take a leave at once, she said. “If I say, my business can’t continue to operate if you’re gone for six weeks, I can file a lawsuit now against you for retaliation or discrimination by denying you that leave,” Barrera said. “It is a huge burden to small businesses.” If employees of small businesses are concerned about paying into a benefit they cannot access, Barrera said state lawmakers can tweak the law so they are exempt from contributing to the Paid Family Leave insurance program. DeSaulnier, a former restaurant owner, acknowledged parts of his bill still need work. While he believes there needs to be an enforcement mechanism, DeSaulnier said he recognizes the complication for small-business owners. He suggested the state could impose a fine or establish an appeals process to avoid lawsuits. The issue is worth exploring because the Paid Family Leave program has been beneficial for working families. Supporters also say businesses benefit by experiencing less turnover. “I’m not unsympathetic; I don’t want to create a lot of lawsuits, either, that leverages employers,” he said. “But having said all that, this is a balancing act. Proposition D would cap the number of collectives that opened prior to 2007 — about 135 — and raise taxes slightly; Proposition E also would do the same but raise no new taxes; Proposition F wouldn’t limit the number of pot shops but put stringent controls such as audits and background checks on employees. It also raises taxes. The proposition with the most votes wins, but only if it collects a majority. If none of the measures receives more than 50 percent, the issue could bounce back to the City Council. Proposition E is essentially dead on arrival because its supporters are now backing Proposition D, which has been endorsed by several council members. Proposition D backers said the initiative meets the criteria of neighbors and the medical marijuana industry by limiting the number of clinics. “There’s been absolutely no control, and

that’s what has hurt the city,” said Brennan Thicke, who runs a pot clinic called the Venice Beach Care Center. “At this point, voters need to finally decide this issue. There’s been an overwhelming belief in this city that medical marijuana should not go away.” Those who support Proposition F say the medical marijuana industry should be an open market, and the measure does more to regulate the industry than its counterpart. They also note that if some of the 135 clinics under Proposition D later close, they won’t be replaced. “There are bad apples in both groups,” said attorney David Welch, who has represented dispensaries in various lawsuits. “The idea that the (older) collectives are angels and everyone else are the devils is just plain wrong. They don’t want competition, and they want to control the supply and demand.” Regardless of the election’s outcome, dispensary owners still are under the specter of the federal government, which maintains marijuana is illegal and has raided clinics, prosecuted owners and filed lawsuits against landlords.

Center, roughly half a mile from the hospital at 2600 Colorado Ave., and an additional 125 spaces at the adjacent Held Parking Structure. Those spaces, along with spots at Saint Anne’s Catholic Church, all include 10-year leases, wrote Stephen Sharrer, vice president of Human Resources at the hospital, bringing the total 90 spaces above the 210 required by City Hall. Between the new spots and the entry plaza and west lot — supposedly open in March, but now delayed until July 2013 — the parking situation at the hospital will be “substantially improved,” Sharrer wrote. The submission comes in response to an April 29 missive from Planning Director David Martin informing the hospital that its plan to provide parking for the 266-bed facility was not up to par after the hospital was booted from its 450-space lease at the Colorado Center. The hospital was informed of the change at the end of 2012 and began identifying new parking spaces even as it contested the eviction with the Colorado Center. An analysis performed by Walker Parking Consultants concluded that although the hospital had lost a huge number of the spaces that it had been leasing — sometimes illegally — for years, hospital workers had never used more than 94 of those spaces at any given time. The Walker report showed a peak parking demand of 1,160 spaces on its busiest day of operation, which is under the 1,208 spaces that

Martin’s response indicated that the total number wasn’t enough to meet the hospital’s obligations under its contract with City Hall, and that it needed to find 210 spaces that were at least as secure as those previously under contract at the Colorado Center. He also requested a new parking study after the entry plaza and west lot, both on the Saint John’s campus, were completed. In his May response, Sharrer said the hospital would do it, but City Hall would have to wait three months after the entry plaza and west lot opened to get the information, putting the report out until roughly October 2013. “Since Saint John’s has demonstrated it will have sufficient parking to meet its peak parking demand, and since Saint John’s has now satisfied the city’s request for 210 additional functionally equivalent spaces, Saint John’s doesn’t believe the city is legally entitled to request this report,” Sharrer wrote. City Hall has 60 days from the end of April to respond. The Saint John’s parking question has recently taken a backseat to news about the hospital’s potential sale. The L.A. Times reported Friday that the Sisters of Charity of Leavenworth Health System entered exclusive negotiations with Providence Health & Services, another Catholic hospital company. If the sale goes through, Providence will have beat out competing bids from multibillionaire Patrick Soon-Shiong, who had the backing of the Saint John’s Health Center Foundation, doctors and the nearby John Wayne Cancer Institute, and the UCLA Health System. ashley@smdp.com

n these tough economic times many people are finding themselves out of work, sometimes for the first time in their lives. More than three million Americans are fired each year. After the initial shock of being fired has worn off, the practicalities of having to navigate the unemployment insurance system come into sharp focus.

Generally, you are entitled to unemployment benefits if you are unemployed through no fault of your own, for example, if you were laid off, fired for a reason other than misconduct, or quit your job for good reason. Once the Employment Development Department (EDD) has received your application for benefits, it usually conducts a telephone interview with you, and also with your employer, to find out why you were fired. Unfortunately, some unscrupulous employers challenge their former employee’s application for benefits even when that employee was fired through no fault of his or her own. In this case, the employer usually claims that the employee was fired for misconduct. If your application for benefits is denied, you have 20 days to file an appeal. If you believe that your benefits were unfairly denied, it is very important that you file a timely appeal. You will receive a hearing date about 4-6 weeks later. Sometimes, the employer does not even bother to show up to the appeal hearing; they were counting on the fact that you wouldn’t fight the denial of your benefits. The hearing is your chance to explain your side of the story to an Administrative Law Judge. It is natural to feel nervous before the hearing, but you will feel better if you are properly prepared to present your case. You should ask to review the EDD’s file on your case, which will include the interview notes with your employer. This means you will get a chance to see what your employer said about why you were fired. You can also send a written request to your employer asking to inspect your personnel file pursuant to Labor Code Section 1198.5. You can ask witnesses who can corroborate your version of events to come with you to the hearing. If they can’t come, you can ask them to give you a written statement to take along with you. You

can also ask the EDD to subpoena witnesses for you. Finally, you should familiarize yourself with the law that applies to your case. A good starting place is the “Benefit Determination Guide” on the EDD website: http://www.edd.ca.gov/UIBDG/default.htm. You don’t have to bring an attorney with you to the hearing, although you may feel more confident with the support of an attorney experienced in this area.
