Officials propose new emergency medical systems BY ASHLEY ARCHIBALD Daily Press Staff Writer

DOWNTOWN The Santa Monica Fire Department and Santa Monica-UCLA Medical Center are taking a preliminary look at a new partnership that could change

the way residents receive care after an injury. The model, called Community EMS (Emergency Medical Service), would empower emergency medical technicians (EMT) and paramedics to triage patients in the field and choose to bring them to an urgent care-type facility rather than an emergency room.

California law dictates that all 9-1-1 calls involve an emergency room visit, but the concept has been the subject of much attention since the passage of the Patient Protection and Affordable Care Act which puts a premium on cutting out unnecessary hospital costs and preventing return visits

for the same conditions. If allowed, it would mean that a paramedic or EMT would be able to treat someone for a relatively minor condition, like a sprained ankle, without taking them to the SEE SYSTEMS PAGE 12

the feared man who swaggered around South Boston and later became one of the nation’s most-wanted fugitives. At 83, the bright platinum hair that earned Bulger his nickname is all but gone and his reputed status as the leader of a violent gang has passed. But as Bulger’s long-awaited trial gets underway, it’s clear that the passage of time has done little to diminish Boston’s fascination with Bulger. “He’s a survivor. He’s had a very long shelf life in a profession where that is not typical,” said Dick Lehr, who has co-written two books about Bulger, including the biography “Whitey: The Life of America’s Most Notorious Mob Boss.” “The many faces of Whitey make him intriguing,” Lehr said. Those faces include his early image as a modern-day Robin Hood and harmless tough guy who gave turkey dinners to his working-class neighbors at Thanksgiving and kept drug dealers out of the neighborhood. That image was crushed when authorities began digging up bodies. Bulger would eventually be charged with playing a role in 19 murders but fled in late 1994 after former FBI Agent John Connolly Jr. tipped him off that he was about to be indicted. He remained a fugitive for more than 16 years before finally being captured in Santa Monica, Calif., in 2011.

wrapped up the first half of this year’s legislative session by advancing hundreds of bills addressing a wide range of issues, including gun violence, environmental protection, oil drilling and even whether prison inmates should have access to condoms. Lawmakers introduced 2,255 bills this year — 1,429 in the Assembly and 826 in the Senate. After Friday’s deadline to pass bills from their original house, the Senate had approved 514 while the Assembly advanced 755. Lawmakers have until mid-September to decide which of the remaining 1,269 bills to send to Gov. Jerry Brown. Details about each bill are available at www.leginfo.ca.gov . Among the hot topics are dozens of guncontrol measures intended to deter the sorts of mass shootings that took place recently in other states. “I think these bills put California at the head of the pack again in the nation” in regulating firearms, said Senate President Pro Tem Darrell Steinberg, D-Sacramento, after the Democratic majority advanced legislation limiting military-style assault weapons and large capacity ammunition magazines. Lawmakers also want to tinker with the state’s landmark environmental protection law. There was bipartisan support for changing the four-decade-old law as the Senate unanimously approved Steinberg’s SB731. Steinberg said he expects more changes in the Assembly as lawmakers work to find the proper balance to speed up worthwhile construction projects while protecting the environment. There is less consensus about regulating fracking, an increasingly popular method of extracting oil and gas. California has vast deposits that could once again make the state a leader in petroleum production at the same time it is taking aggressive steps to limit greenhouse gas emissions. But critics fear groundwater pollution from the chemicals injected into the earth and, at a minimum, want more disclosure. Several bills attempt to shine more light

IRVINE, Calif. Once the tears have dried and the hard feelings overcome, Santa Monica softball may find inspiration in a big loss that ended its title hopes. Hemet routed the Samohi Vikings, 16-2, on Saturday in the final of the CIFSouthern Section Division 4 playoffs in Irvine, Calif., but for some, there is reason to be optimistic come next season. “I’m just putting things in perspective,” Samohi head coach Debbie Skaggs said. “We’ve over-achieved this year. We didn’t expect to come this far.” Samohi’s path to the final was anything but dull. The Vikings entered the postseason as an unseeded team and upset the No. 1 and No. 4 seeds in the process. The Vikings escaped the first round with a walk-off sacrifice against Hesperia and followed that up by upsetting No. 1 seed Segerstrom, 7-2, on the strength of a pair of Sara Garcia home runs. A rout of Paloma Valley set up a show-

down with No. 4 seed Dos Pueblos last week. After 11 long innings, pinch runner Denise Reynoso stole second and third bases and scored on a wild pitch that propelled the Vikings to the cusp of its first softball title since 2010. It looked like some of that magic would roll over into the final against Hemet when sophomore catcher Annie Quinne blasted a triple deep to center field in the first inning. She would score on a sacrifice bunt by senior Marissa Padilla giving Samohi an early 1-0 advantage. Sophomore starting pitcher Whitney Jones would hold the slim lead through two innings, but that’s when the magic began to fade. Hemet’s Antonia Nauhulu and Jade Gandara beat out a pair of infield singles setting the stage for a big inning. After a strike out by Mackenzie Miller, junior shortstop Taylor VanZee raked a double to left field that plated two of her fellow Bulldogs. That’s when the flood gates opened. Hemet tacked on five more runs in the inning giving them what would prove to be an insurmountable lead. “We have to take our hats off to Hemet,”

A number of years ago due to a drought situation, restaurants did not serve water unless it was requested. We eat out in both coffee shops and nice restaurants frequently. Some of them serve water without being asked for it. I understand that it takes at least eight glasses of water to wash and rinse the glass used to serve the water. It is such a waste and I wish restaurants would not automatically serve water. They should do so only on request.

Santa Monica’s parking nightmare still haunting WITH THE CITY COUNCIL’S RECENT

approval of parking restrictions for 36 more mid-Wilshire/Montana (Wilmont) neighborhood blocks, parking for residents may actually become even more difficult. I’ll have to hand it to City Hall. Officials and politicians alike realize that lack of neighborhood parking is a huge quality of life issue. The frustration of finding a place to park even in the off hours such as evenings and weekends has many folks stressed out and angry. How well City Hall deals with the problem is up for debate. The blocks affected (maybe I should say “infected”) include Lincoln Boulevard and Ninth through 14th streets between Idaho and California avenues. Additional blocks include 15th, 16th and 17th streets between Idaho and Washington avenues and 18th and 19th streets between Montana and Washington avenues. Montana and Idaho avenues between 17th and 20th streets and Washington Avenue between Lincoln and 17th are also included in the new zone. Restrictions for new permit parking blocks will call for “two-hour parking 9 a.m. to 6 p.m. daily with no parking 6 p.m. to 2 a.m. daily, except by permit” on some streets. Other streets will have “two-hour parking 9 a.m. to 10 p.m. daily, except by permit.” The above mentioned blocks were analyzed by City Hall’s transportation staff. The parking restrictions they devised to ease the parking crunch were approved by the City Council in March. At least two-thirds of the residents (one per dwelling unit) on each of these blocks must petition City Hall’s Transportation Management Division to have parking restrictions implemented on their block. A few blocks in mid-Wilmont such as the 900, 1200 and 1300 blocks of Idaho and 800 blocks of 11th through 14th streets and 16th Street (between Montana and Idaho) have had zone restrictions for years. They limit non-permit holders to a maximum of two hours parking from 9 a.m. to 9 p.m, Monday through Saturday. There are no evening or Sunday restrictions. Residents of the 1000 block of 14th Street (between California and Washington) recently submitted their petition. It’s a block impacted by John Adams Middle School on the east side of the street and persons who work on Wilshire Boulevard a block south. This block, as well as blocks of residential streets immediately north of Wilshire from roughly Euclid to 18th Street, are also impacted by Santa Monica-UCLA Medical Center employees and visitors. Implementing a “permit required” zone in the evening makes sense for these blocks. I think it’s overkill to require a permit to park between 6 p.m. and 2 a.m. in most of the newly “pre-approved” blocks in the mid-Wilmont neighborhood. For example, residents on the 900 block of Euclid (between Washington and Idaho) have submitted their petition and are waiting for the implementation of parking restric-

tions that will include needing a permit to park at all between 6 p.m. and 2. a.m., daily. The 900 block of Euclid is six blocks from the nearest hospital. Sixteen blocks between Washington and Idaho qualified for 6 p.m. until 2 a.m. “permit only” requirements. They’re two blocks north of Wilshire and one block south of Montana and neither street has much night activity. So what’s the point? There is none. Vehicles parking in the 50 street spaces on Euclid’s 900 block belong to the block’s residents as well as to neighbors residing on nearby residential blocks. I don’t see any hospital and little Montana Avenue parking there with maybe the exception of the Aero Theatre a block and a half away when a few movie-goers may park for a few hours two or three evenings a week When restrictions are implemented in a few weeks, it’ll be fun to watch how the parking dynamic changes. Neighbors within two blocks with valid zone permits will still be able to park in new zones even if the restrictions are different. Unfortunately, if the new changes exacerbate neighborhood parking problems, they will be nearly impossible to fix. There’s not enough street parking for residents in many of the city’s neighborhoods. Many tenants use their garages for storage. This means more cars park on the streets. Some landlords are now leasing their on-site tenant parking garages for up to $225/month. In my mid-Wilmont neighborhood, some apartment garages are rented to outsiders such as Montana Avenue shopkeepers who use them to warehouse inventory. Multiple occupants in even single and one bedroom apartments each have their own vehicles. This contributes to high street parking demand. And, a few residents have more than one vehicle; one for work, another for the weekends. I’m willing to bet that three fourths of Santa Monica’s streets now have some sort of parking restrictions — and almost all of the Wilmont area. Unfortunately, all the restrictions and “fixes” haven’t improved the parking situation for most of us, yet. Instead we get a crazy network of permit parking zones and confusing regulations. The latest scheme: parking meters on residential blocks adjacent to major commercial thoroughfares. While city officials seem to think that meters will discourage shoppers from parking in residential neighborhoods, it’ll drive them deeper into neighborhoods where there are no meters. Let’s call this turkey what it really is: an attempt by City Hall’s finance department to scam more money from residents. In light of all this, any thoughts of decoupling parking from housing in new construction or reducing parking requirements in future residential and commercial development is also a really bad idea fostered by dreamers and ignoramuses.

size of a basketball court lies buried in the sandy soil of southeastern Washington state, an aging remnant of U.S. efforts to win World War II. The tank holds enough radioactive waste to fill an Olympic-sized swimming pool. And it is leaking. For 42 years, tank AY-102 has stored some of the deadliest material at one of the most environmentally contaminated places in the country: the Hanford Nuclear Reservation. This complex along the Columbia River holds a storied place in American history. It was here that workers produced the plutonium for the atomic bomb dropped by the U.S. on Nagasaki, Japan, in 1945 — effectively ending the second world war. Today Hanford’s legacy is less about what was made here than the environmental mess left behind — and the federal government’s inability, for nearly a quarter-century now, to rid Hanford once and for all of its worst hazard: 56 million gallons of toxic waste cached in aging underground tanks. Technical problems, mismanagement and repeated delays have plagued the interminable cleanup of the 586-square-mile site, prolonging an effort that has cost taxpayers $36 billion to date and is estimated will cost $115 billion more. Add to that the leaks involving AY-102 and other tanks at the site, and watchdog groups, politicians and others are left wondering: Will Hanford ever really be free of its waste? If not, what will its environmental impact be on important waterways, towns and generations to come? “One corner of our country and my state acted as a stalwart during World War II and the Cold War and did the right thing,” Washington Gov. Jay Inslee said in a recent interview. “We want the federal government to fulfill its obligation to our state.” There is no greater challenge at Hanford today than its underground tank waste. The leaks inside AY-102, a double-walled tank that was supposed to provide more protection against spillage — as well as newer leaks found this year in six other single-walled tanks — show how critical the situation has become. Put simply: Time is running out on Hanford’s deteriorating tanks and, in turn, for completing work on a more permanent solution to store what’s in them. The federal government created Hanford at the height of World War II, moving 50,000 people to sagebrush fields, dotted with small farms, near the Washington-Oregon border

for a top-secret construction project. The influx quickly made this area Washington’s fourth-largest city, but most workers didn’t even know exactly what they were building — the world’s first full-scale nuclear reactor — until the bomb was dropped on Nagasaki. In ensuing years, workers built eight more reactors to produce plutonium for the nation’s nuclear weapons arsenal. They also built hundreds of ancillary projects, including large canyons where toxic chemicals were used to reprocess the plutonium and extract uranium. All of this work produced massive amounts of radioactive and toxic waste, as reprocessing of the spent nuclear fuel created byproducts that were far too dangerous for human contact. Workers poured some of that waste directly into trenches in the ground at Hanford, but most of the deadliest waste was stored in 177 underground tanks, grouped into areas known as tank farms. There isn’t much to see at these tank farms. Gravel fields cover the tanks themselves. Exhaust pipes jut out of the ground above each of them. Underground, they hold a bubbling, brewing stew of radionuclides, hazardous chemicals and nitrates. Two radionuclides comprise much of the radioactivity: cesium137 and strontium-90. Both take hundreds of years to decay, and exposure to either would increase a person’s risk of developing cancer. The first storage tanks, 149 of them, were built between 1943 and 1964 with just a single, stainless-steel wall. They were designed to last only 10 to 20 years, because they were intended as a stopgap measure until a more permanent solution could be found to deal with the waste. Turns out the tanks were susceptible to corrosion; some even buckled from the extreme heat radiated by the waste. As early as 1956, workers suspected one tank was leaking. Between 1959 and 1968, the U.S. Energy Department confirmed that 12 tanks were leaking. Around that time, workers started building 28 double-walled tanks to provide better protection, then began pumping the most dangerous liquid waste out of the leaking tanks into these vessels. By 1995, they had gotten as much of the liquid out as possible, leaving behind sludge the consistency of peanut butter. AY-102 was the first double-walled tank, put into service in 1971 with an intended lifespan of 40 years. The tank contains chunks of solids — many common metals, including aluminum, nickel, lead, silver, copper, titanium and zinc — as well as other common elements. It also holds more than a dozen radionuclides, such as plutonium,

All One Ocean is a non-profit campaign launched in 2010 by long-time author, activist and organizer Hallie Austen Iglehart with the goal of reducing the amount of plastic and other trash that ends up in the ocean where it compromises the health of marine wildlife and ecosystems. Iglehart was incensed to learn that a million seabirds and 100,000 marine mammals and turtles die each year from ingesting plastic in the water column-and created All One Ocean to do something about it. Contrary to popular myth that most ocean pollution is oil spilled from ships, most of it is land-based litter. “The most dangerous litter is our throw-away plastic because of its longevity and capacity to increase in toxicity, eventually returning to the human food chain in a more lethal form,” reports Iglehart. “Much of our plastic ends up in the ocean in giant collections of trash called gyres, created by circular ocean currents,” she adds. “They trap debris for decades where it continues to break into ever smaller, more toxic pieces, never fully biodegrading.” Of particular concern to Iglehart is the fact that much of this carelessly discarded plastic winds up in the bellies of marine life, contaminating not just ocean ecosystems but in some cases the very seafood on our dinner plates. The main project of All One Ocean is the creation and maintenance of permanent, community supported Beach Clean Up Stations, which are essentially boxes containing reusable bags for beach visitors to use in picking up trash during their time on the sand and in the surf. The idea is to empty any garbage into a trash can somewhere (so

it can find its way to a landfill instead of out into the ocean) and then ideally return the bag empty to the box. Each clean-up station also provides a sign with information on the extent of the problem and other ways individuals can help. The idea, according to Iglehart, is to provide “a simple, doable way for people to have fun cleaning up trash as they enjoy their beach activities.” “The Beach Clean Up Station is a practical way to insure that clean up is happening everyday on all our beaches,” says Iglehart. “Like ‘adopt a highway’ campaigns, Beach Clean Up Stations create community around care for and education about these clean up hubs.” She would like to see Beach Clean Up Stations in place at coastal and even freshwater beaches all around the world, but for now the group is starting out in Northern California. The first one was put in place at Limantour Beach at the Point Reyes National Seashore in Marin County there, with several following at other San Francisco Bay area beaches. Iglehart hopes the campaign will encourage people to reconsider their consumption of single use plastics, since the production and distribution of such items contributes not just to the demise of the oceans but also to increased global warming. Last fall, at 41 years of age, AY-102 was found to be leaking into the space between its inner and outer shells. So far, no waste has escaped the outer shell to the soil surrounding the tank, and a video review of six other double-shell tanks that began holding waste in the 1970s showed none of them was leaking. “None of these tanks would be acceptable for use today. They are all beyond their design life, and yet they’re holding twothirds of the nation’s high-level nuclear waste,” said Tom Carpenter of the watchdog group Hanford Challenge. There has since been more bad news involving still more tanks. On Feb. 15, federal officials revealed another single-shell tank was leaking. A week later, the governor said that actually six of the single-walled tanks were leaking. Officials now estimate that those tanks could be releasing as much as 1,000 gallons of waste a year into the soil. In all, since that very first leak in the 1950s, at least 69 tanks are known to have excreted more than 1 million gallons of waste — and possibly far more — into the soil. Add to that a concern that hydrogen gas could build up inside the tanks and possibly cause an explosion that would release radioactive material. The Defense Nuclear Facilities Safety Board recommended additional monitoring and ventilation of the tanks last fall to avoid such a disaster, and federal officials are working to develop a plan to implement the recommendation. So what does all of this mean for the environment and the safety of nearby communities? The groundwater at Hanford already is contaminated, but scientists gauge the risks to be minimal because it would take decades for contaminants already in the soil to reach the Columbia River, the largest waterway in the Pacific Northwest. The closest tank sits 5 miles from the river, home to endangered fish and a source of drinking water for some 175,000 people immediately downstream. “From the standpoint of worrying about an immediate hazard, we’re not there,” said Ken Niles of the Oregon Department of Energy. “But the problem is that resolving these issues at Hanford takes so long.” The Energy Department previously built a $230 million plant to treat contaminated groundwater near the tank farms. The agency also is studying how best to handle the leak in AY-102, including whether to empty the tank immediately into another tank, said Kevin Smith, who heads the Energy Department’s Office of River Protection in Richland. Smith acknowledged, however, that the doubleshell tanks are nearing capacity. One problem is knowing exactly what is in each tank. A database listing the contents of each is only a best-guess, relying on historical information about the site and waste samples that are very limited, said Cheryl Whalen of the state Department of Ecology. Drawing a single sample and analyzing it, which requires exhaustive safety precautions, costs about $1 million, and it doesn’t show everything that’s inside, Whalen said. The sample might include liquid, but not the solids floating around inside or the sludge at the bottom. Whalen also said some elements that are in very small quantities, but could be very hazardous, aren’t even recorded. In addition, some of the radionuclides inside produce altogether new elements under the right conditions. “The tanks create their own chemical environment. Between the heat and the

radionuclides and the chemicals that are already in there, they’re just their own nuclear reactors,” Whalen said. “They’re generating their own little world in there.” What officials do know is that the tanks are so thermally and radioactively hot that workers must wear white hazmat suits, often with supplied air tanks, when working nearby. To date a total of 10 single-shell tanks have had their contents emptied into double-walled vessels, and another five tanks are scheduled to be emptied by September 2014. The permanent solution to eradicating Hanford’s waste is a plant being built that would encase the waste in glass-like logs for disposal deep underground. The vitrification plant is among the largest industrial construction projects nationally, both in cost and sheer size. Originally bid at $4.3 billion, the price tag has since grown to more than $12.3 billion, a figure that is expected to rise even further. The Energy Department fired its original contractor in 2000 amid mounting delays and costs. In 2006, construction was suspended for 22 months after an independent review concluded the department underestimated the force of ground movements at the site should a severe earthquake occur. Construction has been put on hold in some areas of the plant while the Energy Department works to resolve problems. Once targeted for completion in 2011, the plant now won’t be operating before 2019. That pushes a deadline for treating all of the waste from 2028, under the original agreement, to 2047. Removal of contaminants from groundwater and long-term stewardship of the site will continue for at least two decades longer. Ernest Moniz, the nation’s new energy secretary, vowed during his confirmation hearings to visit Hanford and work to get the money needed to ensure the cleanup job is finished. The Energy Department spends roughly $2 billion each year on Hanford cleanup, or one-third of its budget for nuclear waste cleanup nationally. The federal government also directed $2 billion in stimulus money to speed up some Hanford projects. “Clearly, I support trying to meet the milestones (for completing the work) and that will require having the budget to do it,” Moniz told the Senate Energy and Natural Resources Committee in April. But as part of the federal spending cuts known as sequestration, some 250 Hanford workers have received pink slips while hundreds of others will be required to take weekslong furloughs. Despite the many challenges, there has been some progress in the 24-year cleanup of Hanford. Workers have removed spent nuclear fuel from two leak-prone pools near the Columbia River. They’ve dug up hundreds of waste sites and demolished contaminated buildings. Five of the nine reactors have been mothballed, and workers continue to monitor and treat groundwater tainted by radionuclides and toxic chemicals. Today, the communities closest to the Hanford site comprise a science and technology hub that is among the fastest-growing regions in the country, where Hanford cleanup and a national laboratory drive the economy. Locals celebrate their contribution to the U.S. defense effort. In Richland, a brewery offers “Half-Life Hefeweizen” and “Plutonium Porter” on tap. Richland High School adopted a mushroom cloud as its mascot and students are known as “the Bombers.” The risks that come with the cleanup project are taken in stride by those whose livelihoods still depend on Hanford. “There’s an inherent risk to what we do. But I live here, and I’ve never been fearful of anything,” said Dave Molnaa, who has worked at Hanford for 34 years and serves as president of the Hanford Atomic Trades Council, a union representing 2,800 workers.

People often ask me what to do if a landlord does not make repairs to a rental unit. Let me start with something a tenant should not do. DO NOT T WITHHOLD D RENT Under certain limited circumstances, a tenant may withhold rent. But, it is never a good idea to withhold rent. If a tenant does not pay the full rent, when due, the landlord would most likely serve the tenant with a three day notice to pay or quit. Once a three day notice to pay or quit expires, the landlord does not have to accept the money even if the tenant offers the full amount.The landlord can refuse the payment and proceed with an unlawful detainer action (eviction case). An unlawful detainer action is very stressful.Also, the tenant would have the expense of litigation costs and probably attorney fees.A tenant does not have to retain an attorney to defend an unlawful detainer action, but it would be very wise to do so. If a tenant loses an unlawful detainer case, the tenant would be evicted and owe all of the back rent and possibly the landlord’s attorney fees and litigation costs. Further, the unlawful detainer judgment would probably appear on the tenant’s credit reports as well as reports kept by landlord agencies which could make it difficult to rent a new home in the future. For all of the above reasons, a tenant should never withhold any rent. GIVE E LANDLORD D A LIST T IN N WRITING The first thing a tenant should do is give the landlord a list in writing of items which need to be repaired.The list should be hand-delivered or mailed to the landlord.The tenant must keep a copy of that list and keep track of when and how the list was delivered to the landlord (the specific date when the list was mailed or hand-delivered). A tenant must give the landlord a reasonable period to make repairs.What is a “reasonable period”is defined on a case by case basis.Usually,a tenant should give the landlord 30 days to make repairs.But,if the condition is serious (i.e.:no electricity, no hot water,hole in the roof),a reasonable time would be much shorter. A tenant should list all items which need repair, in detail. Failure to notify the landlord of a specific problem may prevent a tenant from being compensated later for the defective condition. CONTACT T GOVERNMENT T INSPECTORS If the landlord does not make the repairs within a reasonable period, the tenant should contact appropriate government inspectors. In Santa Monica, the first office to be contacted should be the Santa Monica Code Compliance Department: (310) 458-4984. The Code Compliance Department will not come to a rental unit to perform a general inspection.The tenant must have a specific list of items which need repair. In addition to the Code Compliance Department, a

tenant should call the County of Los Angeles Department of Health Services.To arrange for an inspection, a Santa Monica tenant would call: (310) 665-8484. The advantage of government inspectors is that the government agency may order the landlord to make repairs.Also, if the tenant is in trial with the landlord (or a hearing with the Santa Monica Rent Control Board), the government inspectors’ reports may be admissible as evidence. PETITION N FOR R RENT T DECREASE E If the landlord does not make the required repairs, a tenant may file a petition for rent decrease.The petition is filed with the Santa Monica Rent Control Board, located in Santa Monica City Hall, 1685 Main Street, Room 202, Santa Monica, CA 90401; (310) 458-8751.The petition for rent decrease may be filed 30 to 180 days after service of the written notice to the landlord of items which need repair. If the petition is granted, the rent will be reduced. But, the rent reduction is prospective (from that point forward).The Rent Control Board does not have the authority to award any money to compensate the tenant for past conditions or reduced services. SMALLL CLAIMSS COURT T If a tenant wishes to be compensated for the defective conditions or reduced services in the past, the tenant would have to file a lawsuit.A suit could be filed in superior court.Although an attorney is not required for superior court, it is likely that the landlord would retain an attorney.When one party has an attorney and the other does not, it is a big advantage. If the tenant retains an attorney, the expenses might make such a suit in superior court impractical. Usually, the most economical way to proceed is to file a lawsuit in small claims court.A person can sue in small claims court for up to $7,500.00.And, there are no attorneys in small claims court.Thus, the expenses are greatly reduced. CONSULT T WITH H AN N ATTORNEY Even if the tenant is not going to retain an attorney on a fulltime basis, it is usually a good idea to at least have a consultation with a tenants’ rights attorney, especially before filing suit in small claims court or filing a petition for rent decrease.

Guatemalan mine dispute militarizes region, creates strife SONIA PEREZ DIAZ Associated Press

SAN RAFAEL LAS FLORES, Guatemala The neighbors of the San Rafael silver mine no longer come out of their homes for fear of the machine-gun toting troops and police who man checkpoints in these green, wooded mountains. The plaza in the town of San Rafael Las Flores, where the community used to mingle, is now deserted. The fear that rules this terrain, where residents are mostly Xinca Indians, recalls the bad old days of the country’s three-decadelong civil war, which killed as many as 200,000 people. But what’s brought in the troops this time are protests over plans by Vancouver-based Tahoe Resources Inc. to tap what the company says is one of the five largest silver deposits in the world. Protesters say the project, called El Escobal, will drain or pollute the local water supply, and hundreds of people have blocked roads and burned buildings to stop it from going forward. That’s tested President Otto Perez Molina, who sent in hundreds of troops and suspended the right to hold public gatherings in four townships near the mine in early May. It was the second time during his 16 months in office that he has declared a state of siege in response to protests against a foreign-run mining project. With violence rising, the mine protests have now emerged not only as a threat to Perez Molina’s young administration but also a warning to other foreign companies seeking to invest in the region. The residents of San Rafael, however, say they’re been left with no choice but to fight. They also accuse the government of favoring foreign investors over communities. “This is affecting us, we feel intimidated,” said 18-year-old Miriam Munoz, whose nervous parents didn’t want her to go to school because of all the soldiers and police outside. “The situation isn’t going to change until the president comes to deal with it.” The company and its supporters deny the town’s accusations, saying the mine will instead bring jobs and tens of millions of dollars to local governments and communities. Andres Davila, the mine’s coordinator of corporate communications, said the metal will be extracted through a flotation process in which the ore is passed through water. The process involves the chemical reagent zinc cyanide, which Davila said “is not discharged into rivers because it is reused at the same site.” “Half of the (mine’s) employees are from San Rafael and 95 percent are Guatemalans,” Davila said. “For every dollar, 35 cents will stay in Guatemala for taxes, royalties and voluntary contributions.” Claudia Samayoa, director of Guatemala’s Human Rights Defense Unit, said the political damage has already been done. “One interesting thing we have been finding in San Rafael Las Flores and the communities affected by the state of siege is that people who supported the president are telling us they no longer back him,” Samayoa said. A new poll by CID Gallup shows approval of Perez Molina’s presidency nationwide falling 20 percentage points over the past year, from 68 percent in May 2012 to 48 percent this May. The poll, which was conducted between May 2-9 and had a margin for error of 3 percentage points, cites street violence and a lack of jobs for the fall. Such conflicts are breaking out all over Latin America, where local resistance to foreign-driven mining projects have paralyzed

whole regions and claimed dozens of casualties. At the same time, such projects have become ever more popular as world prices for copper, iron ore and other metals have boomed, driven in large part by growing demand from China. In Peru, such protests have presented a major challenge to President Ollanta Humala, while similar outrage over foreign exploitation of local resources helped defeat presidents in Bolivia. Activists say problems at the Guatemala mine began in 2007, when the owner at the time, Canada’s Goldcorp Inc., came to San Rafael with an exploration license. In 2010, the mine was sold to Tahoe Resources. “Since then the problems have aggravated,” said Oscar Morales, president of the Community Development Council, which serves as a link between locals and political authorities. He spoke with the AP from a secret location where he has been in hiding since authorities raided his and family members’ homes searching for arms. He said nothing turned up in the searches. Morales said eight community consultations of 4,222 adults found that nearly all of them opposed the mine. He said he wants to hold another legally binding community consultation about the mine, but municipal governments have refused. Yet the violence only grows more destructive the longer the dispute remains unresolved. On Sept. 17, 2012, mine workers transporting tubes for electrical cables on the main highway in the region were stopped and held by townspeople opposed to the mine. The following day, unknown attackers set fire to mine warehouses and a patrol car. About two months later, enraged townspeople burned a hotel and stole dynamite belonging to the mine when authorities blocked a community meeting about the project in the nearby town of Mataquescuintla. The deadliest clash occurred on Jan. 11, when a shootout between protesters and mine security guards left one farmer and two guards dead. Then, on March 17, unidentified gunmen abducted four members of the Xinca parliament in confusing circumstances. One ended up dead. Faced with the growing violence, the national government announced the creation of a mediation commission, and on April 3, the government granted a 25-year exploitation license to the San Rafael mine “after it fulfilled all the requisites set by law,” according to Davila. The mine has the necessary permits but is not yet operating. After another protest left a policeman dead and six locals wounded, Perez Molina declared a 30-day state of siege that banned public gatherings and other civil liberties in four townships around the mine in Jalapa and Santa Rosa states. Some 500 police officers and 2,000 soldiers were sent to the area. The president later lowered the alert to a state of prevention, saying troops could no longer detain or arrest people without justification. “It is not only because of problems at the mine, but also because of organized crime” that the emergency was decreed, said Perez Molina, but human rights organizations called the move a “criminalization of the legitimate demands of the population opposed to the mine.” Tahoe Resources vigorously defends the San Rafael project, which it expects to start operating before the end of the year. It says it has reached out to 2,000 locals to explain the benefits the mine brings.

TRIAL FROM PAGE 1 Bulger’s trial, set to begin this week with jury selection, promises to have all the glamour and gore of a TV mob drama. Prosecutors plan to call a collection of infamous mob figures, including Bulger’s former partner, Stephen “The Rifleman” Flemmi, who is now serving a life sentence for 10 murders and admitted pulling the teeth out of some of the gang’s victims, including his own girlfriend. Former hit man John Martorano, who admitted killing 20 people, will also take the stand, as will Kevin Weeks, a former Bulger lieutenant who eventually led authorities to half a dozen bodies. Bulger’s lawyers have made it clear that they will attack the credibility of men they describe as “once-reviled criminal defendants” whom prosecutors have eagerly transformed into “loyal government witnesses.” “The government now offers these men as witnesses against James Bulger with no apparent regard for their complete lack of credibility,” attorneys J.W. Carney Jr. and Hank Brennan wrote in a recent court filing. Bulger, who grew up in a South Boston housing project, earned his first arrests as a juvenile and went on to serve time in Alcatraz and other federal prisons for bank robberies. He became one of the most notorious criminals in Boston, while his younger brother, William Bulger, became one of the most powerful politicians in Massachusetts, leading the state Senate for 17 years. William Bulger is expected to attend his brother’s trial. “If you go back to his childhood, he was nothing more than an incorrigible juvenile who was destined to go on to live a life of criminality, and that’s exactly what he did,” said Tom Duffy, a retired state police major who was one of the lead Bulger investigators. Bulger, an inspiration for the 2006 Martin Scorsese film, “The Departed,” headed the Winter Hill Gang, a largely Irish gang that ran loan-sharking, gambling and drug rackets. “I think his basic credo was to live your life in a Machiavellian way. As a result of that, he put a great emphasis on intimidation and deception. He was a master at deception,” Duffy said. After Bulger went on the run, the public learned that he had been working as an FBI informant for years, providing information on the New England Mob — his gang’s main rivals — even while he was committing a long list of his own crimes, including murder, prosecutors say.

The revelations of the corrupt relationship embarrassed the FBI and led to Connolly being convicted of racketeering. Law enforcement officials who felt thwarted for years as they investigated Bulger say the trial may give them a long overdue sense of justice. “We were frustrated because he was being protected by the FBI, but we didn’t know to what extent,” said retired state police Detective Lt. Bob Long, who investigated Bulger in the ‘70s and ‘80s. Bulger’s lawyers planned to use an immunity defense at his trial, arguing that federal prosecutor Jeremiah O’Sullivan, now deceased, granted Bulger immunity from prosecution for his crimes. But Judge Denise Casper rejected that request, finding that any purported immunity agreement is “not a defense to the crimes charged.” Bulger’s lawyers have also denied that he was an FBI informant. They’ve said Bulger will take the witness stand to testify in his own defense. The defense is sure to emphasize for the jury how Martorano, Weeks and Flemmi all struck deals with prosecutors for reduced sentences in exchange for their cooperation. The defense has also indicated it plans to emphasize that Justice Department lawyers depicted the men as unreliable while defending lawsuits accusing the FBI of facilitating Bulger’s crimes, but they are now using them as their star witnesses against Bulger. “Mr. Bulger believes that he will have a fair trial if he is able to present the whole truth concerning his relationship with the Department of Justice and FBI, including that he was never an informant,” Carney said in an email. Prosecutors declined to comment before Bulger’s trial. For some of the victims’ families, the trial is a chance to get answers. Billy O’Brien was born four days after his father, William O’Brien, was gunned down in March 1973. Authorities say Bulger and his gang killed O’Brien and 10 others in a dispute with members of a rival group. O’Brien never got to meet his father, but growing up in South Boston, he would see Bulger around the neighborhood. “You’d have all this crazy stuff that runs through your head. You’re seeing someone that’s responsible for killing your father. You have all these things that come to you that you want to say, but I’m a kid then. What was I going to do?” O’Brien said. “I want to know the reason why my father was killed,” he said. “I’m still looking for that to this day.”

emergency room, which is an expensive and time-consuming proposition, said Wally Ghurabi, medical director of the Nethercutt Emergency Center at the Santa MonicaUCLA Medical Center. That would free up “wall time,” or time the ambulances spend waiting to leave a patient with the emergency room. “In Santa Monica we are blessed, we move faster and are more efficient than most places, but there are wall times in Los Angeles that last more than three or four hours,” Ghurabi said. The program would also include a housecall like service in which a medical professional would visit a recently released patient to check on their progress and help them manage their illness before another ambulance ride became necessary. It would also provide patients more choices about their own health care, some of which are considerably cheaper than a visit to the emergency room. Emergency rooms have become the destination for health care for low-income people, many of whom use the hospital because they cannot be turned away, according to a study by the RAND Corporation, a Santa Monica-based think tank. Four percent of doctors who staff the country’s emergency rooms see 28 percent of all acute care visits, half of all the acute care provided to Medicaid and the Children’s Health Insurance Program beneficiaries — two programs for low-income individuals — and two-thirds of acute care provided to the uninsured, according to the study. Not only are the hospitals widely used, they are extremely expensive for the system because roughly 55 percent of emergency services go unpaid.

Other jurisdictions that have already put the program in place have had success, like Salt Lake City, which created two pilot programs. The system uses a trained nurse dispatcher to decide whether or not an ambulance needs to respond to a call, instead sending people to their primary care physicians or making other, less costly arrangements for transportation. The pilot programs in Salt Lake City saved almost $130,000 at the two locations alone, according to a report. Likewise, a community paramedic model in Dallas saved its health care system $1,393,544 in costs, according to the report. There is some hope that success seen elsewhere could be replicated here, said Fire Chief Scott Ferguson. “It’s the right person, right place, at the right time delivered to the right spot,” he said. “The greatest benefit is to the patient. We want to make sure that they’re provided with the absolute best possible care in the most efficient and most cost effective manner. That’s important to us, and the system now doesn’t always afford that.” There is still a long way to go before any such system takes root in Santa Monica. The legislation around 9-1-1 calls would need to change, or pilot projects would have to be green-lighted to test the system out. Locally, paramedics and EMTs may need additional training to provide all of the services that would be required of them, and a new clinic may have to be established to provide another location for treatment than the emergency room. There may also be local resistance that needs to be overcome, like doctors upset at the loss of patients. It’s all a long way off, but could provide benefits to patients, should it get underway, Ghurabi said. ashley@smdp.com

One would require increased disclosure in political ads, while another would make it more difficult for contributors to hide their identity by laundering their money through nonprofit groups. That bill responds to a secretive $11 million donation funneled last year through Americans for Responsible Leadership, an Arizona nonprofit corporation. Then there are more specific bills, like the one that would require the state corrections department to distribute condoms in prisons. Assemblyman Rob Bonta, D-Oakland, said his AB999 would save the state money in the long run by reducing the spread of HIV and other sexually transmitted diseases, which he called “a tragic reality of life in prison.” A pilot program has already been conducted at the state prison in Solano. A report based on that pilot program says condoms are currently available in the prison systems of two states, Vermont and Mississippi, and in five county jail systems in the U.S. That includes Los Angeles County, where they have been available since 2001, and San Francisco, which has distributed them to inmates since 1989. Other bills that advanced to the next house include: — SB38 by Sen. Kevin de Leon, D-Los Angeles, would give gun owners on the state’s Armed and Prohibited Persons list a window to turn in their illegally held weapons under an amnesty program. The state Department of Justice says about 40,000 weapons are owned by individuals who bought them legally but are no longer allowed to own them. — SB39 by Sen. Kevin de Leon, D-Los Angeles, and AB39, by Assemblywoman Nancy Skinner, D-Berkeley, would give poorer schools, those in more extreme climates and those with older, energy-wasting buildings priority for $450 million to be spent on energy-efficiency projects at schools. The bills differ from Gov. Jerry Brown’s proposal on how best to spend money generated by voters’ approval in November of Proposition 39, which closed a corporate tax loophole. — SB61 by Sen. Leland Yee, D-San Francisco, would limit the use of solitary confinement in state prisons and county juvenile correctional facilities. Six other states ban solitary confinement as punishment for youths. Yee’s bill would allow its use only when a youth is deemed to pose an immediate and serious risk and other options have been exhausted. — SB69 by Sen. Carol Liu, D-La Canada Flintridge, includes Senate Democrats’ plan for changing the way California funds its schools, challenging the proposal offered by Gov. Jerry Brown, who wants schools with high numbers of poor students, English-learners and foster children to receive additional state aid. Senate Democrats say their plan is better than Brown’s because it would help more low-income students. The Senate’s move sets up negotiations with the Assembly and the Democratic governor as lawmakers rush to meet a June 15 deadline for passing a budget. — SB108 by Sen. Leland Yee, D-San Francisco, would require gun owners to lock up their weapons whenever they leave their property. Failing to lock a handgun could bring a fine of up to $1,000 for a first offense. — SB135 by Sen. Alex Padilla, D-Los Angeles, would create an $80 million statewide earthquake early warning system. — SB160 by Sen. Ricardo Lara, D-Bell Gardens, requires school districts and charter schools to report cases of teacher misconduct toward a child to the state

Department of Education within 30 days of an employee’s dismissal. Currently, Lara says fired employees can simply move to a new district without detection. The bill responds to reports of child abuse within the Los Angeles Unified School District. — SB209 by Sen. Ted Lieu, D-Torrance, responds to an appeals court ruling and subsequent California Franchise Tax Board decision requiring 2,500 small business owners and investors to pay retroactive income taxes on business investments. Those facing retroactive capital gains tax bills would be reimbursed for 75 percent of their tax loss. — SB274 by Sen. Mark Leno, D-San Francisco, would let a judge declare that a child has more than two parents if the court finds that recognizing only two parents is detrimental to the child. Gov. Jerry Brown vetoed a similar bill last year. — SB380 by Sen. Alex Padilla, D-Los Angeles, would require public agencies to obtain court orders before shutting down or interrupting cellphone service in most cases. The bill responds to Bay Area Rapid Transit Agency’s shutdown of mobile services during public protests in 2011. Gov. Jerry Brown vetoed a previous similar bill. — SB391 by Sen. Mark DeSaulnier, DConcord, would impose a $75 fee on the recording of most real estate-related documents, with the revenue matching federal money to build and preserve homes for lowand moderate-income families. — SB686 by Sen. Hannah-Beth Jackson, D-Santa Barbara, would prohibit car dealers and rental car companies from selling used cars that are under a federal safety recall until they’ve been fixed. Federal law already prohibits car dealers from selling new cars when they are under a federal safety recall; this bill would extend the same prohibition to the sale of used cars. — SB770 by Sen. Hannah-Beth Jackson, D-Santa Barbara, would strengthen California’s Paid Family Leave program by allowing workers to receive benefits while caring for seriously ill relatives. — SB809 by Sen. Mark DeSaulnier, DConcord, would impose a fee on medical providers to fund the state’s prescription drug database, which lets doctors and pharmacists quickly review patients’ records to deter drug abuse and to make sure patients are not taking harmful combinations of drugs. But the bill includes no money for Attorney General Kamala Harris to hire Department of Justice investigators to crack down on abuse. A related bill, SB670 by Senate President Pro Tem Darrell Steinberg, D-Sacramento, lets the California Medical Board inspect medical records of dead patients without a court order or relatives’ consent to determine if the death resulted from a doctor violating the law. The board also can limit a doctor’s authority to prescribe drugs during an investigation. — Several measures are designed to protect workers who are in the country illegally. SB666 by Senate President Pro Tem Darrell Steinberg, D-Sacramento, and AB263 by Assemblyman Roger Hernandez, D-West Covina, would protect employees from retaliation for reporting workplace safety concerns, regardless of their immigration status. AB524 by Assemblyman Kevin Mullen, DSan Mateo, would make it a crime to extort money from a person by threatening to report their legal status. — AB149 from Assemblywoman Shirley Weber, D-San Diego, would require county probation officials to provide parolees with information on registering to vote. — AB351 from Assemblyman Tim Donnelly, R-Twin Peaks, would prohibit state agencies, employees and the California National Guard from enforcing a federal law allowing for indefinite detainment.

Thus far, it’s been fantastic.” He then sought the help of Westley Koenen, senior vice president of Mastercard Worldwide, who joined the project immediately. So far, the company’s clients have included “The Tonight Show,” “Jimmy Kimmell Live,” various ad agencies, producers of YouTube content, and “a handful of Disney shows,” Shockley said. A lot of business comes from kid-themed television shows. “Kids love animals,” he said. “I just think there’s something about it and even when adults see animals, it brings out the kid in us. They’re just so wonderful.” Shockley said that the bear was the most requested animal, followed by the lion and the elephant. “Adding a lion or a grizzly bear in your video, man, it increases your production value like tenfold,” he said. Movie studios often elect to use animals in films, a practice that can sometimes result in injury for the four-legged actors. To minimize injuries, Green Screen Animals works with the American Humane Association to ensure that no animals are harmed during the production process. The association has been supervising films that use animals since 1939, providing movie sets with “Certified Animal Safety Representatives” that

have extensive experience with “animal-related work,” according to their website. Shockley feels buying stock footage saves filmmakers time, energy and money. “Quite often when somebody’s in that production mode, they just need it now,” he said. Salvador Carrasco, professor of film at Santa Monica College, agrees with Shockley. “The biggest advantage of the green screen technology is cost-effectiveness,” Carrasco said. “As a filmmaker, you need to find a balance between authenticity and practicality. If you want to have animals in your film but can’t afford it, it would be more advantageous for you to use stock footage than to cut the scene out entirely.” While Carrasco said that there is “definitely” a market for this type of footage, he feels the authenticity of having an animal actually on set “cannot be beat.” For Shockley, seeing the finished product on a commercial makes it all worth it. “I really get excited when I see people using this stuff,” Shockley said. “That, to me, is the biggest payoff.” Shockley said his team films one or two shoots ever year. In between, the company focuses on getting the clips online-ready and selling them to clients. “It’s funny because people have this image of us doing all this fun animal stuff all the time,” Shockley said. The online library of critters and creatures, which currently has close to 4,000 clips in full HD, 2K and 4K resolution, is updated once a year.
