shootings by the end of the following Tuesday — happened within the boundaries of the Pico Neighborhood, the poor side of an affluent community with a higher concentration of minority families than the rest of the city.

The city of angels declared war on the tech-driven car services this month, sending cease-and-desist letters to Uber, Sidecar and Lyft that threaten their drivers with a misdemeanor and 30 days without their cars if caught operating in the city. The tough approach has already landed four drivers in trouble with authorities, said Jonathan Hui, a transportation engineer associated with the Los Angeles Department of Transportation, or LADOT. Cities have struggled with how best to deal with the companies, which use a variety of business models and technologies to connect private drivers with passengers that have left regulators shaking their heads. Those programs and applications allow people to arrange rides through their smartphones practically anywhere, creating a pointto-point service that many argue falls under state jurisdiction rather than local control. LADOT instead considers Sidecar, Lyft, UberX and some regular Uber drivers “bandit cabs,” cars that charge people for rides outside of the taxi franchise system set up to protect the public from unscrupulous companies or unsafe situations. Local governments have the right to regulate taxi cabs, and many do, creating intricate franchise systems that impose insur-

Southwest braces for more sizzling temperatures

LAS VEGAS High temperatures brought discomfort to much of the Southwest on Sunday as many parts of the region were coming off several record-breaking heat days and bracing for more sizzling temperatures. Triple-digit heat struck again in the valleys and desert regions of Southern California, while metropolitan Phoenix saw just a slight drop in temperatures after experiencing record-breaking heat Saturday. Six half-marathon runners in Southern California were hospitalized Sunday for heat-related illnesses. A day earlier, paramedics responding to a Nevada home without air conditioning found an elderly man dead. Runners in the Southern California race who required medical attention were extremely dehydrated, and some experienced cramps, Pasadena Fire Department spokeswoman Lisa Derderian said. Several other runners were evaluated along the route but weren’t taken to the hospital, she said. Paramedics were deployed along the 13.1-mile race, and buses with air conditioning were provided for runners to cool off. The event was supposed to be a marathon, but it was downgraded due to low turnout last year. Hikers, bikers and dog walkers were scarce on typically busy trails in the Santa Monica Mountains above Los Angeles. At midday, two women and a panting German shepherd huddled in a rare sliver of shade along a fire road before striking out in the hot sun. Atop San Vicente Peak, cyclist Jeff Disbrow, 49, of Santa Monica was clad in black and lathered in sweat as he took a break and refilled his water bottle. “It’s not the best day to be out here — unless you want to suffer,” he said. “It’s like Arizona.” In Utah, a record 105-degree heat caused an interstate on-ramp to buckle in Salt Lake City, and hampered firefighters in their battle against three wildfires. The Interstate 215 on-ramp had to be closed for four hours

McCarthy brought “The Heat” against Channing Tatum and Jamie Foxx at the box office. The Fox action-comedy starring the funny ladies as mismatched detectives earned $40 million in second place in its opening weekend, topping the $25.7 million debut haul of Sony’s “White House Down,” according to studio estimates Sunday. The Disney-Pixar animated prequel “Monsters University” remained box-office valedictorian in its second weekend, earning $46.1 million in first place. As for “The Heat,” employing two female leads to buck the male-dominated buddycop formula paid off in ticket sales. “I think the fact that we have a femalecentric movie standing out in a forest of giant tent-pole movies is phenomenal,” said Chris Aronson, Fox’s president of domestic distribution. “Audiences really responded. We positioned this to be a female event movie, and we got the opening that we were hoping for this weekend.” “White House Down,” which features Tatum as a wannabe Secret Service agent and Foxx as the President of the United States of America, was inaugurated below expectations in fourth place. The film’s White House takeover plot is strikingly similar to FilmDistrict’s “Olympus Has Fallen,” which opened in March and starred Gerard Butler and Aaron Eckhart. “It turned out to be a very competitive weekend,” said Rory Bruer, Sony’s president of worldwide distribution. “We had hoped ‘White House Down’ did better, just from the standpoint that we love this film, but I feel very hopeful that with the July 4th holiday coming up, it will be the perfect film for audiences, and it’ll really add up for us.” Meanwhile, Paramount’s “World War Z” took another bite out of the box office in its second weekend domestically with $29.8 million. In a June 21, 2013 editorial, the Daily Press questions the wisdom of conducting a survey to determine how residents feel about development in Downtown (“Aren’t they listening at City Hall?” June 22-23). The editor wonders why the opinions expressed by those who have attended recent public meetings are not a sufficient gauge of where the community stands. We are not survey research experts, but we have been observers of and participants in Santa Monica public meetings for many years. In our experience, those who turn out to address our elected and appointed officials are usually those who feel most strongly about an issue, those whose work and family obligations make it possible to sit through lengthy meetings and, in some cases, those who have been actively encouraged to attend by friends, employers and/or organizations with an interest in the issue. It should come as no surprise that those who are dissatisfied are considerably more likely to express themselves on an issue than those who are not. Turnouts for recent meetings have been impressive and the views held by those who have taken the trouble to attend must certainly be addressed. Social scientists, however, would caution that the input at a public meeting is from a “self-selected” sample, a circumstance that constitutes a common source of bias. In other words, we cannot be certain that the voices raised are truly representative of the demographically diverse community in which we live. How do opinions on future development choices differ by age and income, among homeowners and renters, between pedestrians and bicyclists, by race and ethnicity? Only competently conducted survey research can provide policy makers with this information. Critical decisions are pending on acceptable land uses, heights, massing, and transportation modes to implement the principles adopted in the LUCE (Land Use and Circulation Element). Our elected officials should have the best possible information and the widest possible input in reaching decisions. We expect the city to select a reputable pollster whose survey research techniques represent best practices. The results of the survey should be of interest to every community member as well as to our elected and appointed officials.

Doing away with tuition Editor:
We can end tuition at UCLA and SMC, and all public colleges and universities, for California residents, with either of two new taxes that will not cost 99 percent of taxpayers anything. One: An oil severance tax. California is the only major oil producing state without one. In 2006, oil companies spent $100 million to defeat an oil tax initiative. Two: An asset tax on the super-rich 1 percent who own(s) 99 percent of the assets. When Pat Brown was governor, public colleges and universities were tuition-free. California was rich because educated talent attracted Silicon Valley and the defense and aerospace industries. Gov. Ronald Reagan imposed tuition to reduce tax support of higher education by his wealthy supporters. During Jerry Brown’s 10 years as governor, high tuition continues and is increasing under his current administration and students graduate with crushing debts. The Legislative Analyst informs me that California students spend $4 billion annually on tuition at (the) UC, state universities and community colleges. Now I hope the Legislature, with its Democrat supermajority, will enact an asset tax on the super-rich 1 percent who own(s) 99 percent of all assets, or an oil severance tax, to abolish penny-wise (and) pound-foolish, counter-productive tuition.

Palihouse fuels distrust of City Hall DEBATE

Santa Monica is usually centered on the large projects that threaten to increase traffic and congestion and radically change our neighborhoods. Small developments often go unnoticed except for the immediate neighbors who have to deal with their fallout. An example of that is the refurbishment of the 1927-era Embassy Hotel and Apartments at the corner of Third Street and Washington Avenue purchased recently by Paligroup, a developer of vintage, hip, boutique hotels. Renamed the Palihouse, it’s undergone partial renovation and recently opened for business. Palihouse owners filed applications for an on-premises restaurant as well as for alcohol service to hotel guests only in its lounge/bar and to provide alcohol in minibars in guestrooms. The request to serve alcohol could be the straw that’ll break the neighbors’ backs. They’re already upset about noise, hotelrelated parking on residential permitrestricted streets, valet operations and other activity that intensifies a “non-conforming” use that’s incompatible with a quiet, residential neighborhood. The real possibility of even more noise — especially at night — traffic and parking problems and other issues arising from inebriated patrons in or around the hotel have further raised anger levels. Last Monday, city officials issued a report that declared that there was no evidence that Palihouse had violated any laws or regulations (“Officials give thumbs up to hotel near homes,” June 25). Maybe. Maybe not. However, the serious community livability issues will get much worse for sure if Palihouse’s request for an alcohol conditional use permit (CUP) is approved by City Hall and an alcohol consumption license is granted by the California Department of Alcoholic Beverage Control (ABC). The whole Palihouse brouhaha amplifies the growing discord between residents and City Hall. All over town folks are being increasingly alienated by planning policies that negatively impact their neighborhoods. In addition, slipshod enforcement of city zoning codes and CUPs has added to the distrust and anger. It’s a common belief that City Hall officials are looking at income first and the people second. Many are saying, “It’s the money and revenue that counts, we don’t matter anymore.” Perhaps it’s the pension and benefits that city employees want to protect by bringing in more cash. Decisions made in the coming months concerning Palihouse will either sustain that widely held belief or indicate to neighbors that City Hall does care about its citizens. GONE ‘BONKERS’
My column last week about the antiFairmont renovation folks “going bonkers” created much controversy. I commented on some of the outright fabrications and ridiculous statements made by people and groups opposed to the hotel’s remodeling plans including owners, representatives and associates of the Huntley Hotel across the street. I received an e-mail from a reader who didn’t like me referring to some antiFairmont folks as “bonkers,” extremists or
liars. I’m sorry that some individuals took it personally. But, if you’re going to make public statements that aren’t true or that are complete nonsense, you have to expect that folks will have an opinion about them — and you. I also heard from neighborhood activist Susan Scarafia who wrote, “The ‘takeover’ of Wilmont was started by me, not by Sue Burnside or any Huntley operatives.” Thanks for the clarification, Susan. However, Huntley forces were very active behind the scenes encouraging and facilitating the takeover of the Wilshire-Montana Neighborhood Coalition. A source from Unite HERE! informed me that Huntley House isn’t a unionized hotel and has resisted organizing efforts for many years. My source wondered why Rohnda Ammouri, a political coordinator with the Service Employees International Union (SEIU), was doing community outreach for Huntley's management and advocating for something that could jeopardize the jobs of hundreds of Unite HERE! Local 11 workers to be employed at the reconstructed Miramar. “If that hotel doesn’t get built, 300 union employees will be out of work,” I was told. The union is looking into Ammouri’s relationship with the Huntley House. JOIN THE PARADE
This year’s Fourth of July Parade will be held on Thursday, July 4, of course. It’ll start promptly at 9:30 a.m. in front of the Santa Monica Civic Auditorium and make its way down Main Street to the Venice border. This year's theme is "Heroes." If you're the type to don a little red, white and blue for Independence Day, you can go to the parade dressed as Superman, Wonder Woman, Supergirl, Captain America, a Power Ranger or even as City Manager Rod Gould. The parade is sponsored by the Ocean Park Association and it’s the seventh annual staging of the parade. It will feature floats, bands, community groups, antique cars and marchers. Participants consist of folks from private enterprises, neighborhood organizations, nonprofits, the Santa Monica police and fire departments as well as representatives from other civic and governmental organizations. Whoopee! I’m excited already! We all have special reasons to celebrate at this year's parade. The U.S. Supreme Court ruling last week that said sponsors of Proposition 8 (that outlawed same-sex marriages in California) had no legal standing to appeal lower-court decisions that had determined it was unconstitutional. And the Supreme Court decided that the Defense of Marriage Act (DOMA) — which denied federal benefits to same-sex couples who are legally married in states where they reside — was also unconstitutional. Both decisions are historic benchmarks reaffirming equality and freedom in America. This parade has become one of my favorite community events. A good time will be had by all who attend. I guarantee it. So, round up the family, join the patriotic crowd and show your spirit!

In what’s being billed as the greatest environmental initiative of his presidency, Barack Obama announced on June 25, 2013 that his administration is instituting stringent mandatory restrictions on greenhouse gas emissions by power plants, factories and other industrial sources. These sources combined account for roughly 40 percent of all greenhouse gas emissions across the U.S. The goal is to reduce overall greenhouse gas emissions nationally by four percent below 1990 levels within the next seven years. The new policy also directs the Department of Interior to approve enough renewable energy projects on public lands to power six million homes by 2020 and offers up $8 billion in loan guarantees for energy efficiency and advanced fossil fuel projects. And while Obama helped shepherd in a doubling of gas mileage standards for automobiles, SUVs and pickups during his first term, he is now calling for much more stringent standards for heavy duty truck models introduced in 2018 and after. Because the U.S. Supreme Court ruled in 2007 that the Environmental Protection Agencypart of the executive branch under the White House-can regulate carbon dioxide under the Clean Air Act just like it does soot, lead and other types of air pollution, Obama’s new plan does not need Congressional approval, although Congress will certainly play a role in determining just how the emissions cuts are implemented. “We limit the amount of toxic chemicals
like mercury and arsenic and sulfur in our air and water,” says Obama. “But power plants can still dump unlimited amounts of carbon pollution into our air for free. That’s not right, that’s not safe, and it needs to stop.” Most environmentalists are happy that Obama is finally committing to decisive action to reduce the nation’s carbon footprint. “This is the change Americans have been waiting for on climate,” says the Sierra Club’s Michael Brune. “President Obama is finally putting action behind his words.” “It’s clearly time to act,” Gene Karpinski of the League of Conservation Voters (LCV) adds, “and [Obama is] setting out a bold, ambitious, comprehensive plan for what he can do without needing to rely upon Congress.” But other greens aren’t so bullish on the new strategy. The Center for Biological Diversity, a leading non-profit committed to species protection, calls Obama’s plan “modest” and warns that it falls short by failing to set a nationwide pollution cap for carbon dioxide. “We’re happy to see the president finally addressing climate change, but the plain truth is that what he’s proposing isn’t big enough, and doesn’t move fast enough, to match the terrifying magnitude of the climate crisis,” says Bill Snape, the center’s Senior Counsel, adding that the plan wouldn’t be enough “to avert catastrophic temperature rises.” Likewise, Saleemul Huq of the International Institute for Environment and Development points out that the climate problem “has become much bigger while the U.S. was ignoring it” and that what Obama is proposing now is too little too late.

The city-approved definition of the neighborhood lies between Centinela Avenue to the east, Pico Boulevard to the south, Lincoln Boulevard to the west and Santa Monica Boulevard to the north up through 20th Street, at which point the boundary jogs south to Colorado Avenue. A smaller area bounded by Interstate 10, Pico Boulevard, Lincoln Boulevard and Centinela Avenue is used separately by the Santa Monica Police Department because of “entrenched crime concerns” there, said Sgt. Richard Lewis, SMPD spokesperson. Between 1980 and 2013, that area saw 75 of the 212 “incidences of homicide” that occurred in Santa Monica, Lewis said. That term does not refer to the total number of people killed because multiple people could be killed in a single incident, Lewis said. The smaller portion of the Pico Neighborhood, which activists call the “Red Zone,” accounted for 51 of those homicides. The numbers did not surprise Oscar de la Torre, a longtime Pico Neighborhood resident and founder and former executive director of the Pico Youth & Family Center, a program that received money from City Hall to work with at-risk youth. In opinion columns to the Daily Press and in City Hall, de la Torre and his supporters put forward 62 deaths in the area since 1986, although it’s difficult to say where the discrepancy lies between that number and the police department’s given the different methods of calculation. de la Torre has long held that while the rest of Santa Monica moved forward into economic prosperity, lifted by the rising tide of tourism and the blossoming tech industry, the Pico Neighborhood was left behind. Many residents there feel the same, pointing to a new library under construction at Virginia Avenue Park as a promise almost 20 years in the making, and one that almost got the ax when state officials made a grab for funds held by the former Redevelopment Agency. “We’ve had this problem of young people losing hope in the Pico Neighborhood, losing hope in life,” de la Torre said. Those feelings of hopelessness and incidences of deadly violence took a front seat in the public debate after 23-year-old John Zawahri killed his father, his brother and three strangers before police took him out on the Santa Monica College
campus. The young man was armed with an automatic weapon, handgun and 1,300 rounds of ammunition when he took off through the Pico Neighborhood that day, spraying bullets, destruction and death. The following Sunday, a man in his 30s was shot, but not killed while riding a bicycle in what police described as a gang-related crime. Just two days later, Gil Verastegui, 29, was shot and killed in an alley off of Michigan Avenue near 15th Street. Three men, all young, were arrested in connection with that shooting by the end of the day, continuing SMPD’s track record of clearing murder cases in which 25 of the last 27 murders have been cleared by arrest or other means. The men were arrested in an area dominated by the Sotel gang, and Verastegui himself was also a gang member, according to reports. The Pico Neighborhood still harbors some gang activity. Between 1991 and 2013, 36 incidences of homicide occurred in and immediately around the “Red Zone.” Of those, 22 were gang-related, Lewis said. A new community response called the Cradle to Career initiative has brought together organizations and agencies throughout the city in an attempt to tackle the multi-faceted social problems that push young people onto paths of violence, or allow them to fall through the cracks. The City Council budgeted over $200,000 to support those efforts at its most recent meeting, and an anonymous donor gave $50,000 to help target youth violence and mental health issues. Those gains come at a loss to the PYFC, which retained two-thirds of its funding for the next year to serve as a drop-in and referral center rather than the case management services it offers now. de la Torre sees that as a mistake. “This is not the time for the city to regress in sustaining youth violence prevention initiatives,” he said. Officials in City Hall maintain that the new “whatever it takes” strategy will advance the cause by breaking down boundaries between different service providers and allowing them to target resources at children and families that need it most. “Individual institutions did what they could,” said Jonathan Mooney, a Santa Monica resident and Cradle to Career consultant, at a press conference on June 18. “Solving any social problem is about doing it collectively.” ashley@smdp.com

The Supreme Court ruled on Wednesday that Proposition 8’s backers lacked standing to defend the 2008 law because California’s governor and attorney general have declined to defend the ban. Then on Friday, the 9th Circuit appeared to have removed the last obstacle to making same sex matrimony legal again in California when it removed its hold on a lower court’s 2010 order directing state officials to stop enforcing the ban. Within hours, same sex couples were seeking marriage licenses. The two couples who sued to overturn Proposition 8 were wed in San Francisco and Los Angeles Friday. Organizers of the gay pride parade have invited newly married couples to a VIP reception at San Francisco City Hall on Sunday afternoon.

That comes at a significant cost to taxi companies that want to be part of the franchise system, a cost which these other companies have avoided in the absence of specific legislation from the state setting parameters for their businesses. In the meantime, it’s up to the California Public Utilities Commission, or CPUC, to establish rules for town cars and limousines, vehicles which can only offer pre-arranged rides and are prohibited from picking up passengers off the street. Santa Monica officials believe that the three companies in question operate under agreements with the CPUC that deny City Hall the right to impose rules or requirements on them. “L.A. may have some special provisions that provides it with the authority to regulate their (activities), but we are firm in our understanding of our authority and it does not extend to regulating these types of vehicles for hire,” said Salvador Valles, business and revenue operations manager with the city’s Finance Department. Los Angeles city officials actually checked with the CPUC in advance of sending out the cease-and-desist letters, said Michael Nagle, an attorney with the city. The agreements that the companies point to are settlement agreements that allow them to operate in the state while a judge considers the issues involved. That doesn’t make them town cars, or other CPUC-authorized vehicles, Nagle said. The one exception to that is the Uber service, which does license some of its limousines through the CPUC. They can continue to operate in Los Angeles without a problem, Nagle said.
The reason for the crackdown is to improve passenger safety, which officials feel can be compromised by companies that hire drivers using unknown criteria and may or may not inspect cars. “The companies say we check,” Nagle said. “Well, that’s not good enough. We do fingerprinting and check through Interpol. There are also insurance requirements.” Drivers for the various companies and their passengers are getting mixed messages about the situation in Los Angeles. Sidecar sent out an e-mail to its users assuring them that the company would continue on, business as usual without regard for the cease-and-desist letter. “We want to let you know that we’re not going anywhere,” the e-mail reads. Nick Ostrogovich, a Sidecar driver and co-founder of the Santa Monica Surf School, was under the impression that he could keep driving, but the threat of arrest and police impounding his car was enough to curb his desire. The surfer and serial entrepreneur drives for both Sidecar and UberX when he’s not teaching lessons. He actually uses the driving business to network for new surfing clients. “It’s definitely a great extra income for me,” Ostrogovich said. “I give 10 to 15 hours averaging 40 to 50 bucks an hour.” He’s planning on investing in a town car so he can drive a licensed Uber vehicle. Ostrogovich is not just a driver, he’s also a client. He finds the people who drive for Uber and Sidecar to be pleasant and personable. One Lyft driver offered crackers and sparkling water for the drive, which still cost less than a traditional taxi. “I hope it still continues, I use it all the time,” Ostrogovich said. ashley@smdp.com

The 119-degree high in Phoenix on Saturday marked the fourth-hottest day in metro Phoenix since authorities started keeping temperature records more than 110 years ago. The high temperature for the metro area hit 115 on Sunday. Temperatures could drop slightly in
Phoenix within the coming days as monsoon storms are expected to make their way through the state. Such storms could bring cloud cover but could produce more humidity and possibly contribute to dust storms. Several Southern California communities set same-day record highs Saturday including Palm Springs, where the mercury peaked at 122 degrees. Death Valley, the hottest place on the planet, reached 127 degrees Saturday. In Las Vegas, temperatures were on the rise again after the city reported a record overnight low of 89 degrees Sunday. With the temperature at 111 degrees early Sunday afternoon, National Weather Service forecaster Dan Berc said Las Vegas could also break its record high of 117 degrees set in 2005 and 1942. Forecasters are calling for the high to reach 116 degrees. On Saturday, a man died and another was hospitalized in serious condition in Las Vegas heat-aggravated incidents as the temperature soared to 115 degrees.
