CITY HALL Cities like Santa Monica do not just form, they are planned and in the city by the sea, much of that planning is happening right now. City officials have begun to add details to the Land Use and Circulation Element,

or LUCE, a document that lays out the policies by which Santa Monica will develop over the next 20 years. The Bergamot Area, Bicycle Action, Pedestrian Action, Memorial Park and Downtown Specific plans represent a handful of those efforts, ones that will dictate the heights, densities and even types of buildings allowed in those areas of the city.

At the same time, a flood of large projects rolled in at the end of 2012, leading some community members to worry that the housing, office space and other construction planned for two decades of development would come online in just a few years and before the rules for the areas had even been determined. Officials have recently focused on the

Downtown Specific Plan, which creates rules for the area that falls between Ocean Avenue, Interstate 10 and Wilshire and Lincoln boulevards. The thinking for that piece of the city includes special plans for eight parcels in the Downtown, which officials call “opportunity sites” for their potential to SEE MARTIN PAGE 8

SACRAMENTO, Calif. California prisoners have unprotected sexual contact, forced or consensual, even if both are illegal, and this reality often leads to the spread of HIV and other diseases in prisons and in communities where felons are paroled. Setting up a difficult conversation, one state lawmaker says it’s time to give inmates a way to practice safe sex behind bars to reduce an infection rate that experts say is much higher than that of the general population. The proposal from Oakland Democratic Assemblyman Rob Bonta comes despite a law prohibiting any sex between inmates, which creates a conflict that concerns both supporters and opponents of the legislation. “It’s a felony for prisoners to have sex while they’re in prison, so I don’t think it’s good government for the state to encourage inmates to break the law,” said Republican Assemblyman Dan Logue of Marysville. Bonta’s proposal would require the California Department of Corrections and Rehabilitation to make condoms available in five prisons by 2015 and expand the program to each of the state’s 33 adult prisons SEE CONDOMS PAGE 7

Crews gather clues after fireworks accident ASSOCIATED PRESS SIMI VALLEY, Calif. Fire crews have combed a community park northwest of Los Angeles in search of clues after a July Fourth fireworks explosion injured dozens of revelers. The Ventura County Fire Department completed its evidence collection Saturday at a Simi Valley park where between 8,000 and 10,000 spectators gathered days earlier to watch fireworks. Crews also gathered evidence in nearby Ojai, where a pyrotechnics operator was injured by a premature blast. “We’ve collected everything we need to collect” from the Simi Valley site 40 miles northwest of Los Angeles, Ventura County fire spokesman Mike Lindbery told the Ventura County Star in Sunday’s editions. A state fire official was due in town this week to join county fire officials on the investigation. The community park remained closed after Thursday’s mishap. Some three dozen spectators, ranging from 17 months to 78 years old, were injured in the fireworks explosion. Fire and hospital officials said some had burns and shrapnel cuts while others were trampled on as the crowd rushed to safety. Police initially said it appeared a firework detonated prematurely shortly after the show began, creating a cascading effect. But fire officials later said they needed more eyewitness accounts and details from the pyrotechnics company before determining a cause. Crews spent the past several days at the park, collecting unexploded fireworks, photographing the site and transporting evidence to another location. Others studied the scorched grounds to determine how far debris flew. Investigators also planned to review cellphone videos taken by revelers in the chaotic aftermath, Lindbery told The Associated Press. In nearby Ojai, a fireworks show at a high school ended 15 minutes early after a pyrotechnics operator was struck by exploding fireworks. The state Division of Occupational Safety and Health told the Star the unidentified man suffered serious injuries to his face, left arm and left leg.

NEW YORK The minions of “Despicable Me 2” ran away with the July 4th box office, leaving the Johnny Depp Western “The Lone Ranger” in the dust. According to studio estimates Sunday, the Universal animated sequel took in $82.5 million over the weekend and $142.1 million across the five-day holiday window. Gore Verbinski’s reimagining of the iconic lawman bombed for the Walt Disney Co., opening with just $29.4 million over the weekend, and a disappointing $48.9 million since Wednesday. The trouncing for Disney was especially painful because of the high cost of “The Lone Ranger,” which reportedly cost at least $225 million to make. Made by the same team that created the lucrative Disney franchise “Pirates of the Caribbean” (the four film series that grossed $3.7 billion worldwide) the Western drew bad reviews and failed to capture the attention of younger moviegoers.

“We thought it would appeal to a broader audience than it did,” Dave Hollis, head of distribution for Disney, said. Based on the long-running radio program begun in 1933 and the TV series that debuted in 1949, the “Lone Ranger” brand proved a musty one. The audience for the film skewed heavily toward older moviegoers, with 68 percent of its audience older than 25. “You think that you have everything in place,” said Hollis, listing the proven boxoffice commodities of Depp, Verbinski and producer Jerry Bruckheimer. “Even when you have all the ingredients for what you think will be a four-quadrant, ‘everybody’ picture, sometimes it doesn’t work out that way.” The poor performance of “The Lone Ranger” called to mind a previous bomb for Disney: last year’s similarly-budgeted sci-fi adventure “John Carter,” which opened with $30.1 million. But “The Lone Ranger,” which stars Armie Hammer as the masked lawman, will likely fare better than that disappointment,

since Depp’s international star power should bring in better worldwide business. It started with $24.3 million abroad, opening in about 30 percent of its planned international market. While critics skewered the film, it did earn a B+ CinemaScore grade from moviegoers. But “The Lone Ranger” is nevertheless likely to be a sizeable write-down for Disney and could impact the company’s stock price when markets reopen Monday. “Everybody beat up on ‘The Lone Ranger’ pretty hard,” said Paul Dergarabedian, analyst for box-office tracker Hollywood.com. “Everything was just not going in its favor.” On the other hand, Universal made “Despicable Me 2” for the comparatively small amount of $76 million (a figure that doesn’t count a huge marketing budget). A fountain of trouble Editor:

I have been walking by the Civic Center park project nearly every other day for the last year watching the construction progress. It seems that there are some serious leakage problems with the new multi-tiered fountain project in front of City Hall. I have noticed that the contractor has been attempting numerous techniques to stem the leaks from the precast top sections which trickle down the supporting wall structures. It appears that there might be a serious design flaw in the fountain or a serious mistake in the construction assembly process. Since this is a signature piece of the park design, I am wondering how these problems are affecting the opening timeline for the entire park? Might you have time to report on this issue and alert the citizens of the city to how their precious tax dollars are being spent? My questions are: 1) Is this a bad design issue? 2) Is this a poor construction and assembly issue? 3) Who is going to pay for the construction overages? 4) What techniques are being attempted to fix the leaks? 5) Who is going to pay for any ongoing maintenance issues in the months and years to come? 6) How can we as citizens guarantee that the city won’t be stuck with a fountain that eventually gets turned off and becomes an ugly concrete dinosaur in front of our main civic building? This situation seems like a giant mess and one that might not be possible to fix since water always likes to take the lowest path of least resistance. It seems that a quick fix of epoxy or grout will be just that, a quick fix to get the city to sign off on the contract and leave us taxpayers with our fingers in the dike.

Not another survey Editor:

Unlike the former mayor and city manager whose letter appeared in this paper, I agree with your recent editorial which questions the need for a new survey to determine how residents feel about development Downtown (”Aren’t they listening at City Hall?” June 21). Dedicated resident stakeholders have attended several recent public meetings and voiced their overwhelming displeasure at the scale and pace of development and their opposition to projects like the Miramar, which would double in size and rise 300 feet on a block zoned for 45 feet. We residents, time and again, have made our wishes known at meetings, in e-mails and in letters to the editor, only to have our concerns dismissed and discounted. We do not get paid, but the same cannot be said of the army of developers, attorneys and PR people who are paid to advance development projects. For a former mayor and city manager to suggest our opinions are somehow not representative and genuine, is inexcusable. But let’s have another survey anyway. Let us also make certain the process is truly transparent, and the survey itself is fair and asks honest questions and collects honest answers, because we all know what can happen when the fox guards the hen house. Let’s also remember what happened long ago when a small group of citizens began standing tall against leaders who did not listen to them. That small group of people created the United States of America. I don’t think anyone reading this needs a poll to figure out how those Founding Fathers felt. Our city leaders don’t need a new poll, either. They just need to listen.

Trio of major development issues coming up this week A TRIO OF IMPORTANT MEETINGS ARE

coming up this week. The City Council will review and make recommendations on the proposed Downtown Specific Plan (DSP) and related Program Environmental Impact Report (PEIR) at Tuesday night’s meeting. Issues such as heights, densities and opportunity sites will be discussed and are subject to direction from the council. The DSP will meet specific goals in the Land Use and Circulation Element (LUCE) which calls for “a thriving, mixed-use urban environment that provides multiple opportunities for living, working, entertainment and enrichment.” Because LUCE set the tone for design, land use and traffic planning efforts over the next 25 to 30 years, the DSP must be consistent with those parameters. City staff began working on the DSP in 2011. Since then, there have been numerous community meetings involving stakeholders, the public, Downtown property owners, developers and businesses. This resulted in concepts to assure that the final DSP will support positive economic health, reduce new vehicle (car) trips, preserve the city’s unique character and historic assets, follow good sustainability practices and better interconnect Downtown the Civic Center, the Santa Monica Pier and the beach. The DSP will determine revised Downtown development standards including the establishment of varying height limits, density and floor area ratios. One recommendation is to allow higher (84 feet) heights and greater floor area ratios on some blocks. Another recommendation is for a 135foot maximum height limit at eight “opportunity sites.” The Council is expected to review options for developments already in the pipeline such as the new Wyndham, the Frank Gehry-designed hotel and the renovated Miramar — all along Ocean Avenue. These flagship developments offering “extraordinary site-specific community benefits” may be able to bypass any newly established height and density standards if the developer files for an amendment to the final DSP and conducts its own environmental analysis as called for by state law. Public reaction to many aspects of the proposed DSP have already been negative. Opposition is centered around complaints about making it too easy to develop highrises, worries about more traffic congestion and concerns that Downtown is becoming another Disneyland for tourists offering less for residents. Following the council’s direction, staff will conduct additional community outreach, continue work required by the California Environmental Quality Act (CEQA) and return to the Planning Commission and City Council with a draft DSP down the road. On Wednesday evening, July 10, the Planning Commission will review the final draft of the Bergamot Area Plan, which contains the goals, policies and regulations that will guide all future investment within that neighborhood’s boundaries. “The plan will

guide the area’s transition to a mixed-use, pedestrian-oriented neighborhood focused on connectivity with the future Exposition (Expo) Light Rail station and the Bergamot Art Center,” reads the staff report for the meeting. Because the commission will be making recommendations to the City Council you all should show up to observe and comment. Decisions made will affect substantial parts of the city regarding traffic congestion and development standards. And, if anyone says that Expo Rail will cure the traffic problems, ask them what they’ve been smoking. The Rent Control Board meets Thursday night. July 11. They’re set to vote on developer Marc Luzzatto’s application to remove the 99 rental spaces — or mobile home pads — from his Village Trailer Park (VTP) at 2930 Colorado Ave. Luzzatto hopes to replace the funky, old trailer park with the East Village, a dense, mixed-use/housing project. The last hurdle he must overcome before East Village becomes a reality is getting permission to remove the pads from the city’s housing inventory. On April 9, the City Council gave their final approval to a revised development agreement that allows Luzzatto to construct 377 units of “all rental” housing. In the final plan, the affordable units on site jumped from the 16 units in the previous plan to 38 units including three “extremely low-income units.” Luzzatto must also keep 10 trailer pads for 10 years, then he can develop the space as more multi-family housing. Most of you know how much I despise this development. And, while folks may carp and complain about three proposed hotel high-rises along Ocean Avenue, this “future slum” will have a much more deleterious effect on the community. Talk about getting the cart before the horse. Take note that this major development was proposed, amended and “OK’d” far before the official area plan for the Bergamot area was finished. Unfortunately, the pro-development majority on the council has backed another bad development in return for a few extra units of affordable housing. For the record, Gleam Davis, Bob Holbrook, Terry O’Day and Pam O’Connor supported this mess. Luzzatto got off cheap and the rest of us got the shaft. There was quibbling about details such as “how much extremely low vs. low income housing” and “community benefits,” nevertheless this pig finished up as it always was: fat, ugly and sassy. Many Santa Monicans, including the handful of VTP residents still living at the park, are hopeful that the Rent Control Board will deny the removal permit. While City Hall staff and politicians alike talked about “listening to the people,” this was a done deal from the get-go. I’m betting the family Prius that the Rent Control Board won’t derail the train. The only way to avoid huge mistakes like this in the future is to replace a couple of council members in next year’s election.

prevent another tragedy like this in the future? The answer to this question is the key. We are experiencing a collective déjà-vu, thrusting us back into the Sandy Hook aftermath, where the tragedy is picked apart and analyzed in the countless interviews, articles, and press conferences that ensue, and where, interestingly, no one is talking about gender. In the words of Jackson Katz — whose work is the inspiration behind the Male Violence Prevention Project — you can’t change a social phenomenon until you can identify and name it. And as long as we continue to neglect the connections among guns, violence and American ideals of manhood, we will continue to miss the boat. It must be pointed out that gender is the one common denominator, more common than any other factor, that unites 61 of the 62 mass killings that have happened over the past 30 years. Katz reminds us that, while much of the dialogue lingers around the seeming “senselessness” of the shootings, these incidents are not senseless at all ... to the shooter. Katz, speaking to the incidents of June 7, “The recent tragedy in Santa Monica fits a larger pattern that is all-too familiar in our society: a young man with grievances goes on a violent rampage to avenge offenses against him, settle scores or express his rage, not only at individuals he knows but at people in general. Not surprisingly the young man had experienced violence in his family. We can develop better mental health screening and implement all manner of security measures. But until we find better ways to teach boys and young men to respond to abuse, loss and trauma without violence, we’re fated to keep revisiting these sorts of tragedies over and over again, with no end in sight. There has to be a better way.” One thing is clear — we have all had enough of the violence. People in our community are looking to take action, and will galvanize at times like this and expend much time, energy and money on things that, ultimately, will not work ... certainly not on their own. Sandy Hook Elementary, we find ourselves mourning once again. One is struck by the layered emotional response experienced after an incident like this — shock that this has happened again, and so close to home; helplessness around what seems like a never-ending string of violence; and surprise at the realization that it was never a matter of if something like this would happen here, but just a question of when. There are many things we don’t know about John Zawahri and the motivation behind the shooting rampage he unleashed upon our city that calm Friday afternoon. The typical public response to a situation like this is an endless re-examining of the life of the shooter, to try and pinpoint a place where we, his community, missed some sign of things to come. In our line of work, we often refer to our knowledge of our clients’ experiences as the “tip of the iceberg,” in that we will probably never know the full scope of what they have gone or are going through. The same is true for the Zawahri/Abdou family. However, there are two things we know for certain in this case: 1) John Zawahri was a boy who lived with a violent father; and 2) he grew into a man who acted out his pain and suffering through gun violence. We also know of the ripple effects of these types of life experiences — family violence is directly linked to violence in the community; what happens to people when they are children, particularly if they are exposed to violence, can have lasting impacts on their quality of life; and finally, we know that the vast majority of all forms of violence is committed by men. So, what could have been done differently? How could this tragedy have been prevented? Well, these are two very different questions, with two very different answers. As to that first question, people will propose the same solutions that were dominating the public discourse after Sandy Hook, including stricter gun control, improved mental health screening and access to services, and increased security on and around school campuses. But while asking these critical questions will likely improve our intervention efforts, none of these questions get us to what will ultimately solve the problem. What lies quietly beneath these symptoms that we so skillfully learn to assess, is a much larger and more nefarious cultural paradigm that allows for violent incidents like these to persist. There is one element that always gets missed. That leads us to the second question: how could this tragedy have been prevented? And perhaps even more importantly, how can we

Sting of pollution Dear EarthTalk: Is there a link between the recent spread of mosquito-borne diseases around the world and environmental pollution?

If by pollution you mean greenhouse gas emissions, then definitely yes. According to Maria Diuk-Wasser at the Yale School of Public Health, the onset of human-induced global warming is likely to increase the infection rates of mosquito-borne diseases like malaria, dengue fever and West Nile virus by creating more mosquito-friendly habitats. “The direct effects of temperature increase are an increase in immature mosquito development, virus development and mosquito biting rates, which increase contact rates (biting) with humans,” she reports. To wit, the U.S. Centers for Disease Control and Prevention (CDC) reported a record number of West Nile virus infections in the continental U.S. in 2012 with some 5,674 documented cases including 286 deaths. The virus uses insects as hosts where they reproduce and then are transmitted to humans via mosquito bites; it can also be transmitted via blood transfusions, organ transplants and breast feeding. While it’s still far less common, U.S. cases of mosquito-borne dengue fever-also known as “breakbone fever” for the feeling it gives its victims-rose by 70 percent in 2012 as compared with 2011. The CDC reports 357 cases of dengue fever in the continental U.S. in 2012, up from 251 in 2011. The majority, 104, was in Florida, but New York had 64 and California 35. Most of the infections were imported on people travelling to the U.S.-Puerto Rico played host to 4,450 dengue fever cases in 2012, up from only 1,507 in 2011. But some of the cases in Florida likely came from mosquito bites there. The virus behind dengue fever thrives in tropical and sub-tropical environments. The increased warming predicted for the

southern U.S. along with increased flooding means dengue fever will no doubt be spreading north on the backs of mosquitoes into U.S. states that never thought they would have to deal with such exotic outbreaks. West Nile and dengue fever aren’t the only mosquito-borne diseases on U.S. public health officials’ radar. Chikungunya, which hitches a ride on the ever expanding Asian tiger mosquito and can cause high fever, fatigue, headache, nausea, muscle and joint pain, and a nasty rash in humans, comes from tropical Africa and Asia. But cases have started appearing in Western Europe in recent years and are expected to make it to the U.S. East Coast at anytime. Likewise, Rift Valley fever, which brings with it fever, muscle pain, dizziness, vision loss and even encephalitis, was limited to Kenya only a decade ago but today has spread across the entire African continent and is expected to make an appearance in Europe and the U.S. soon. While researchers are hard at work to find vaccines against these diseases, concerned Americans can take some basic precautions to minimize their chances of getting mosquito bites. Keep screens on all the windows and doors in the house that can open. Outside, wear long pants and long sleeved shirts when possible and cover up with an insect repellent-the U.S. Environmental Protection Agency (EPA) says only those formulations containing the chemical DEET have been proven effective but there are plenty of all natural alternatives out there. In the meantime, our best defense against these diseases may be keeping our carbon footprints down, as the less global warming we cause, the less we’ll have to deal with an onslaught of tropical mosquito-borne diseases. If it becomes law, California would be the second state behind Vermont, which has a fraction of the inmate population, to provide condoms to all prisoners. Canada, most of the European Union, Australia, Brazil, Indonesia and South Africa already take that step, according to legislative researchers. Currently, condoms are contraband in California prisons, though the state has tried a distribution program before but on a temporary and limited basis. Then-Gov. Arnold Schwarzenegger vetoed a 2007 bill that would have allowed nonprofit and health organizations to provide condoms to state prisoners. But in his veto message, the Republican governor instructed the corrections department to test a condom distribution program in one prison. About 800 inmates in California State Prison, Solano, located about 30 miles southwest of the state capital, had access to free condoms in vending machines for a year starting in November 2008. Public health officials’ report on the pilot program, published in September 2011, found few problems and recommended the program be expanded. Today, California state prisoners have very limited sanctioned access to condoms. Spouses and domestic partners are allowed to bring as many as 10 on overnight family visits with lower-level offenders who qualify for the incentive program, said corrections department spokeswoman Terry Thornton. But the condoms must be accounted for and are not permitted outside visiting areas. In Mississippi, the state has provided condoms for at least 20 years, but only to the roughly 10 percent of inmates who are married and qualify for conjugal visits. The Vermont Department of Corrections has been making condoms available throughout its prison system since 1992. The department’s health services director, Dr. Delores Burroughs-Biron, said the state’s 2,200 inmates can request one condom at a time from a nurse. The program has created no security issues, she said, while giving nurses a chance to counsel inmates and advise them that they should seek help if they are being coerced into having sex. On a lower-level, condoms have been available to jail inmates in San Francisco since 1989 and in Los Angeles County since 2001. Jails in New York City, Philadelphia and Washington, D.C., also distribute them. “It’s really turned out to be not a big deal, and hopefully it’s fostering some good practices on the outside and saving some families’ lives,” said Susan Fahey, spokeswoman for the San Francisco Sheriff ’s Department. Critics initially worried that handing out condoms would encourage an increase in voluntary or forced sexual activity, that the

There have been some unintended and almost comical uses. Now some detainees use the condoms as hair ties or blow them up to use as pillows. “At first we thought this is sort of a wrong use for a condom, but then we felt this is a way of destigmatizing it,” Monico Klein said. Bonta’s bill cleared the Assembly on a 44-26 vote, with one Republican in favor and several Democrats joining Republicans in opposition. Logue, the Marysville Republican, said a better way to prevent the transmission of disease would be to enforce the law. He also noted that Bonta’s bill would require distributing condoms in every prison — including the state’s two prisons for women. “Who would be using those?” Logue wondered. “Would they be guards or people who work in prison to have sex with prisoners?” Illicit relations between employees and inmates have been an ongoing problem, according to the prison system’s inspector general. “That’s of course potentially possible, and we’ve seen incidents of it happening, although it’s illegal,” Bonta said in an interview. “I mean, sexual contact between prisoners is technically illegal. But it happens, and I think we need to deal with reality as it stands.” There has been not talk of changing the law to allow inmate sex. But his bill gives the corrections department the flexibility to provide safe-sex options in women’s prisons in addition to condoms. It also would require the condoms and dispensing machines to be donated to the state so taxpayers would not be paying for them. The University of California, San Francisco, projected that the rate of HIV infection among state prison inmates is about 10 times higher than in the population at large. California corrections officials estimate that more than 1,000 prisoners are infected, or about 1 percent of the state’s nearly 133,000 inmates. Steve Whitmore, a spokesman for the Los Angeles County Sheriff ’s Department, said testing of detainees in the nation’s largest jail system shows a noticeable decrease in the transmission of diseases since distribution of condoms and safe-sex counseling began there a dozen years ago. The condoms have caused no security problems, he said. “It’s against the law to have sex in jail, and the sheriff has said that when we know of it, we will take action,” Whitmore said. “But he’s also said, practically, it’s going to happen. We want to prevent people from becoming sick. We want to prevent people from dying.”

Hundreds of residents turned out to public meetings to protest the proposal, in particular three hotels ranging from 195 to 320 feet that many feel will turn Santa Monica into the much-maligned “Miami Beach.” Between developers who want to move on with their projects and residents concerned that their town is being built out willy nilly are the city’s own planners, which both draft the plans and negotiate with developers over projects that exceed zoning rules. With that in mind, the Daily Press caught up with Planning Director David Martin to talk about the ongoing work to guide Santa Monica’s growth and how best to balance all of the voices in the conversation. Daily Press: The City Council approved the Land Use and Circulation Element in 2010. Three years later, why haven’t we finished the plans that it requires? David Martin: So, the LUCE set up the requirement for all of these additional planning efforts to happen, and that was in July 2010. From our perspective, we are making our way through the development of those plans. We’ve already adopted the Bicycle Action Plan, we’re very close to the Bergamot Area Plan, we’re halfway through the Downtown Specific Plan and we are getting ready to start the Memorial Park Plan. I can understand from a community perspective it may seem like we’ve been working on these for a long time, but if you consider that we’re less than three years from when the LUCE was first adopted, we’re chipping away at them as expeditiously as possible given the complexity of the issues. It’s not as if we can say here’s what we see Downtown, here’s the plan. DP: Many are concerned that projects are coming forward while the plans are still being formed. Should the development agreements (contracts with City Hall that allow developers to exceed the zoning code) be put on hold until the plans are finished? DM: The Bergamot Area Plan does have development standards, maximum heights and (floor-area ratios). That’s all part of the LUCE, and the area plan was just to refine those and think about how the circulation and connections would work. It did set the parameters for the development that could occur. Based on that, the idea was that the projects could move forward because we already knew the outside envelope of what could be built. In the Downtown we don’t know that, so it’s a little bit different. What we were able to accomplish was to make sure as the projects were moving forward, they were going along in parallel with the development of the plan and we were constantly checking and making sure that the projects are consistent with the plan. Just that they’re informing each other as they go forward. DP: Should the projects be informing the plan, or should it be a one-way street?

DM: Certainly the community could decide that we want to wait until the plans are in place before we start the projects, but that’s not how the city and the council decided to go. We were trying to move things along and make sure again that the projects were informed by the plan. I think we’ve been able to do that, and the projects that come forward will be consistent with the area plan. DP: The Planning Department is in the process of creating the zoning ordinance, which will determine planning standards for the city. In the meantime, every project over 7,500 square feet becomes a development agreement. Did you anticipate the large number of proposals City Hall would receive? DM: I don’t think we were expecting such a high number, but we did know that there would be some. Obviously, because of the way it was structured, many projects over 7,500 square feet would be a development agreement, so we knew that there would be a fair number of those. I think we were all surprised by the level of activity we’ve seen in the last couple of years. DP: Will the new zoning code fix that situation? DM: What we’re looking at in the zoning ordinance is taking the (development) tiers that are in the LUCE, and in most of the districts. Tier 1 is mostly ministerial projects, smaller projects. They would be allowed by right. Then you get into the Tier 2 category. That’s a discretionary process, but not a development agreement. That goes to the Planning Commission, and we have something called a development review permit that used to be much more common. But I think when the zoning ordinance is adopted we will have a much easier process for certainly Tier 1 and Tier 2 projects, and there will be a clear distinction and choice for applicants. DP: The LUCE called for the preservation of 96 percent of Santa Monica, meaning only some properties are really available for development. Does that create a situation where developers have to ask for the moon to get a return on investment for a project in that other 4 percent? DM: They might be. If they bought the property with that expectation, they would need to go for the maximum because that’s what they assumed. But, I think that’s where we will be much better off when we have a Tier 2 process, and can be clear about what you can do. This is what the standards allow, and the development agreement is an exception. If you want to go through that process it’s going to take a long time and you don’t know what the council’s going to ask for. We have high expectations, and it’ll be a difficult process. If you want to do it, fine, but we’re offering you an easier process. The other thing is we don’t know the answer because of the (interim zoning ordinance) and where we are, everything’s a development agreement. I can understand from a developer’s perspective, I have to do a SEE PLANNING PAGE 9

Why would you go for a project that’s Tier 2 when the entitlement process you’re required to do is the Tier 3 process? It does create a situation in which if you’re going to go through this difficult process and take the time, you might as well ask for Tier 3 and see what happens. DP: People are concerned that the large number of development agreements encompasses all of the development meant to happen in the next 17 years. How do you deal with that? DM: There is concern about the overall amount of development, because if you look at all of the projects, that seems like a lot. We look at all of that and we recognize and agree that it’s a lot, but we also know that we will go through this process and projects will fall out …. Not all of these projects will be built. DP: People are also worried about development in the Downtown, specifically at the so-called “opportunity sites.” What is an opportunity site? DM: As called for in the LUCE, we wanted to make sure that those sites were opportunities for something to generate a lot of community benefits and contributed to the advancement of the Downtown, and that they were thought through. DP: Will plans for these sites get approved in advance of the Downtown Specific Plan? DM: There was never an issue of whether those projects would come to the City Council for final approval prior to the Downtown Specific Plan. Even if we wanted

to do that, which we don’t, it’s not possible. Of all of those projects, the (Fairmont) Miramar is the furthest along, and even that one will be at least a year before it gets to council. So, I think the idea would be that we would continue with the Downtown plan and, as directed by council, we will keep processing those applications. DP: Residents often say that they feel cut out of the process, and that comments at meetings meant to solicit ideas for the city are often ignored. How does the Planning Department use input from meetings, and what if people can’t see their ideas reflected in a final document? DM: We try to keep an open-minded communication. And I think we do a good job of it, except that I know there’s … a frustration that some residents have that they’re not part of the process. I think they think there’s something they don’t know, or something we’re doing that they’re not aware of. We’re trying to be as open and up front as possible. I think it’s building that trust, but I don’t know how we get there. We seek input, and whatever input we get we carefully consider in the mix of everything else and then we come forward with our best recommendation. Our recommendation is influenced by the input that we get from neighbors, residents and everybody else. But that input may not change our recommendation. It’s part of the mix. And even if our recommendation changes, it might not change what happens at council. There’s that part of it, too. Nothing’s ignored, but it might not ultimately be reflected in our final recommendation or their final action. ashley@smdp.com
