Alzheimer’s, dementia program celebrates first year Second year will push for more patients, new management software BY ASHLEY ARCHIBALD Daily Press Staff Writer

WILSHIRE BLVD Supporters gathered at the Santa Monica-UCLA Medical Center Thursday to celebrate the one-year anniversary of a unique program that treats patients

with dementia and Alzheimer’s disease while backing up the people who care for them. The UCLA Alzheimer’s and Dementia Care program embraces not only the medical aspects of patient care, but also the mental health of the person suffering from the disease and their caregivers, often family that

help them day in and day out. It links families with medical care and community-based support services like adult day care and other programs that ensure the patient is getting comprehensive treatment that keeps them out of the hospital and even more expensive medical bills.

It also connects caregivers — be they family members of the patient or otherwise — with support groups coordinated by Patti Davis, the daughter of former President Ronald Reagan and long-time advocate for SEE PROGRAM PAGE 6

Talking eatery design, function with architect Francis Jones BY ILEANA NAJARRO Special to the Daily Press

OCEAN AVENUE Stephen Francis Jones, founder and CEO of SF Jones Architects, designed the recently opened Del Frisco’s Grille at Ocean and Colorado avenues, as well as the Redwood Grille at the Santa Monica Place mall. An architect with over 18 years of experience, Jones has worked on high-rise buildings in Boston to mixed-use housing projects in Barcelona as well as numerous restaurant projects. To commemorate his latest works in Santa Monica Jones spoke to the Daily Press on his local projects and the relationship between design aesthetics and culinary delights. DP: With such an expansive range of experience, what about architectural design got you hooked on the profession? Jones: I got hooked at a young age. I’ve always been very inquisitive about how things work and how to figure things out. Architecture seemed to be the perfect venue for a combination of art and science in terms of creating something and then figuring out the technical part of how everything goes together. Will ‘Whitey’ Bulger testify during murder trial? DENISE LAVOIE AP Legal Affairs Writer

BOSTON As lawyers for James “Whitey” Bulger begin to defend him against a massive racketeering indictment charging him in 19 killings, one big question remains: Will

he testify? Some lawyers not connected to the case say Bulger has too much baggage to testify, including a prior criminal record and a long reputation as an organized crime figure. But others say Bulger’s case is different because, at age 83, he knows he is likely to

Lawmakers alter votes on budget, gun bills LAURA OLSON Associated Press

SACRAMENTO, Calif. While the state Legislature remains in session most of the year, action on the most high-profile bills tends to be clustered in the days leading up to several deadlines. Unsurprisingly, it’s during those periods of fast-paced votes to approve state budget legislation and to keep bills alive by sending them to the opposite chamber that lawmakers most often want a do-over on their votes. Through the first half of this year’s legislative session, budget-related bills dealing corrections, the court system, mental health programs and dental care for low-income adults were among the measures that generated a significant number of altered or added votes after a bill’s fate had been decided. Gun-control measures also saw a handful of vote flips, as did various bills at the

end of May when the chambers considered dozens of bills during all-day sessions. The vote-switching practice, called to attention last year after an Associated Press investigation, has a long history in the Assembly and gives lawmakers political cover: They can vote one way on a bill or avoid voting altogether when it matters, only to add or change their vote after the fact. That allows them to present an official record to their constituents that may be at odds with how they acted at the time the bill passed or failed. In the Senate, only the two party leaders are allowed to change or add votes. Members of the Assembly are allowed to alter their vote before the end of the day’s session and only if the action does not change the outcome of the floor vote. The practice was used more than 5,000 times last year, the AP review found. Since the Legislature reconvened in January, every lawmaker in the Assembly has changed or added a vote at least once.

Since 1967

On every one of the 97 bills the Assembly passed on May 30, for example, at least one legislator revised his or her vote, with most of the changes coming from lawmakers who did not record a position in the initial tally. One of the bills considered that day, AB361, would allow California to receive federal money to pay for certain health services for those with chronic medical or substance abuse conditions. It passed on the Assembly floor with the bare 41-vote majority, but the final count shows 13 lawmakers later adding their support and another six adding an opposition vote. Charles Stewart, spokesman for bill’s author, Democratic Assemblywoman Holly Mitchell of Los Angeles, attributed the tardy votes to the day’s hectic schedule, not the bill’s provisions. “When members do see that a bill has enough votes, they may not run to their SEE VOTES PAGE 8

monsters and minions to debut atop the weekend box office. The Fox film featuring Hugh Jackman’s sixth turn as the claw-wielding superhero opened with $55 million in North America, according to studio estimates Sunday. Last weekend’s top movie, Warner Bros.’ low-budget horror “The Conjuring,” slipped to second place, adding another $22.1 million to its take. “Despicable Me 2” was in third with $16 million. The Universal animated sequel, with its cast of cute, yellow minions, has made more than $600 million worldwide since it came out four weeks ago. “The Wolverine,” which is set in Japan and features an international cast, earned another $86.1 million overseas. The film’s opening-week take surpassed the $120 million it cost to make, said Chris Aronson, Fox’s head of domestic distribution. “It’s a huge opening for the clawed one,” he said. “It played equally well from Maine to Maui.” Another Fox film, the animated snail-racing tale “Turbo,” was in fourth place with $13.3 million. Adam Sandler’s “Grown Ups 2” followed with $11.5 million. Woody Allen’s latest, “Blue Jasmine,” enjoyed a stellar opening of its own, though on a much smaller scale. Starring Cate Blanchett, the film opened in just six theaters but still collected $612,767. “It’s one of the biggest opening per-theater averages ever for a non-animated film,” said Paul Dergarabedian of box-office tracker Hollywood.com. Ticket sales this weekend were up almost 30 percent over the same weekend last summer, he said. “It was a good weekend to be a moviegoer because the choices just got a lot more interesting,” Dergarabedian said, noting a mix that includes animated, independent and big-budget action offerings. “Fruitvale Station,” the Sundance winner already generating Oscar buzz, expanded to theaters across the country and edged its way into the top 10, contributing to a summer box office that is up more than 10 percent over last year.

A little civility is needed Editor:

Let the church say, “amen” to the settlement in the case of the student who was slapped by a teacher at Malibu High School (”SMMUSD settles Malibu slap lawsuit, attorney reports,” July 25, page 3). I commend the family for disallowing the district to turn the lawsuit into the angry black woman show. The demeanor of the family was extremely dignified throughout the endeavor. Based on the experiences of several AfricanAmerican families in the district, I know that there is an effort to provoke that type of behavior from black female parents by district employees and other members of the community to discredit the claim and create a diversion from the issue at hand. The teacher did not have any business putting her hands on the student. Especially, slapping her in the face four to six times, replicating the behavior of a character in a movie. I was also highly disappointed in the initial response that came from the superintendent, Sandra Lyon. She called the slaps a “pat.” I could not believe that the high-powered law firm that represents the district did not provide her with a prepared public statement in an effort to build public trust, rather than dismissing the issue and shirking responsibility by downgrading the incident. This is not some mom-and-pop operation. SMMUSD is an organization that has a $150 million budget. I commend the board for stepping out of the comfort zone of hiring someone from the old boys network, but now that Ms. Lyon has broken the glass ceiling, she has to be willing to make the same tough decisions that a man would make. This is counter-intuitive for a woman, because we are nurturers by nature, and we are highly invested in how our actions make other people feel. Part of me would love to believe that this is the last time that SMMUSD will find itself in this type of mess, but my 12 years of experience in the district, including the year that I just got done serving as the chair of the special education district advisory committee tell me otherwise. The board has a history of failing to implement solutions. For example, there are five reports that tell the district how to fix special education that have never been implemented. One of those reports cost $79,000. Part of that report recommended a policy about civility and respect. That also was never implemented. Perhaps if it were, there would have been no slap. In the absence of those standards, a district administrator made the comment at my first meeting as the chair that “parents want a wonderful private school for their children, because they believe that their special needs child is more special than other special needs children.” This led to a verbal altercation with a member, and there were tears. When I said something to the administrator about being respectful, she just rolled her eyes at me like a 12-year-old. It was my worst nightmare realized. I knew that without a code of conduct that this was just the beginning of a crazy drama. I’m like Michelle Obama. I don’t do crazy and I don’t do drama. That led me to bring a meeting code of conduct from the city of Santa Monica to the table. Putting a code of conduct in place kept the drama out of the meetings. Without a code of conduct and a civility policy, this lawsuit is just a drop in the bucket. I can wallpaper my house with horror stories from families about the behavior of district employees. The inconvenient truth is that there are no shortage of attorneys who are willing to sue the district and settlement agreements don’t bring systemic change.

Local trainers muscling folks off sidewalks, out of parks A LETTER IN THE WEEKEND DAILY PRESS

caught my eye: (”Shutup (in a Zen way!),” July 13-14, Pg. 4). Nancy Deville wrote about people exercising on Adelaide Drive and the stairs leading down to Santa Monica Canyon. It’s a popular workout area — especially since City Hall placed restrictions on exercising on the Fourth Street median between San Vicente Boulevard and Adelaide a few years ago. I walk Adelaide at least once a week so I know what Deville is saying when she addresses loud banter, singing, car radios, people with dogs and gaggles of trainers and clients hogging the sidewalk with yoga mats, dumbbell sets and work-out equipment. The 500 block of Adelaide is particularly problematic. The sidewalk is narrow — about four feet wide — and there’s so much exercise gear and so many people working out in this 70 yard stretch, pedestrians have to walk in the street just to pass. The mansions adjacent to this stretch of sidewalk are being remodeled, so there are no residents to complain. Besides, the construction workers seem to appreciate the buffed female bodies in short shorts and stretchy exercise outfits. Last Monday, at least three trainers were on this popular sidewalk with their clients. One trainer appeared to be working with five or six women. He had enough workout gear to equip a small gym on what is supposed to be a pedestrian right-of-way. Other trainers were hanging out and chatting it up with the ladies. Some were leaning against SUVs or trucks working their iPhones. The sidewalk has taken on a meat market atmosphere with shapely women hovering around fit guys as they check out the welltoned ladies. Add tourists to the mix, like the chubby little honey in a red sedan that practically ran me over when she drove from Adelaide into opposing traffic on Fourth Street and then threw her car into reverse before nearly hitting me as I was crossing. Don’t get me wrong, I’m all for working out. I’ve been a member of numerous private gyms that cater to private trainers and their wealthy/celebrity clients. The advantage in using a public park or sidewalk is not having to pay gym fees or purchasing club memberships for themselves or their clients. This can easily save a fitness instructor thousands of dollars a year. But, engaging in activities on a city sidewalk that results in blocking public access needs to be controlled or curtailed. City Hall is asking for suggestions on “how to improve the pedestrian experience?” Try being pro-active in checking the licenses and permits required of trainers using public space and issue citations when sidewalks are blocked — which is most of the time on Adelaide. Speaking of private trainers, the Parks and Recreation Commission came up with recommendations to regulate the instructors

using public parks. One recommendation was to allow trainers to work with clients in the parks from 6 a.m. to 11 p.m. Most parks are near homes and apartments. Allowing private trainers and fitness instructors to conduct early morning and post-sunset activity which results in car alarms going off as people arrive and depart and instructing clients — including counting down reps and shouting “one more, one more” — is a big mistake. The use of public parks as private gyms comes before City Council in early October. Council needs to limit supervised workout hours from 8 a.m. to 6 p.m. so that neighbors and visitors may enjoy our parks — especially Palisades Park — for their beauty and serenity. MORE STOP SIGNS, MORE CONGESTION

It’s not often that I agree with local bicyclists but we concur that City Hall’s Traffic Engineering Department’s plans to install more stop signs in the residential area of Broadway, east of 26th Street is a really dumb idea. Two of six intersections in that stretch of Broadway currently have four-way stops. The others have two-way stops on streets intersecting Broadway. City traffic managers originally recommended that all six intersections be four-way stops. After bicyclists complained that they would be inconvenient for cyclists (meaning lots of stopping and starting up) and impede traffic on this major east/west thoroughfare, traffic managers are now considering fourway stops at just two more intersections and are asking for public input on the matter. City Hall traffic engineers claim the new stops will decrease collisions in the neighborhood which they say happen at a “higher than average” rate. What? Because there’s not enough stop signs? Give me a break. A few years ago, City Council approved placing planted medians on Broadway, east of 26th to the eastern city limits. Their presence has resulted in narrower traffic lanes that force moving cars dangerously close to bicyclists and severely restricts views of cross streets. I drive Broadway frequently and I can easily say that the medians are a major contributor to the “higher than average collision rate.” Like other planted medians ill-advisedly installed around town over the last decade or so (on 23rd Street, Wilshire Boulevard, Montana Avenue and more), they congest traffic and impede views of vehicles and pedestrians coming from side streets. Traffic is the number one resident complaint. However, traffic managers/engineers want to screw it up more by installing more stop signs which most motorists (and bicyclists) will run anyway. Instead of stop signs, how about stepping up traffic enforcement? There’s nothing like a police officer with a ticket book to deter bad driving and reduce accidents. Bill can be reached at mr.bilbau@gmail.com.

In April 2012, USA TODAY published a series entitled “Ghost Factories,” a report on an investigation into lead contaminated soil in hundreds of neighborhoods around the U.S. where lead factories once operated. The investigation addressed the lack of action taken by the U.S. Environmental Protection Agency (EPA) to test and clean up these sites despite having been warned in 2001 about the dangerous levels of lead contamination around the areas of these old facilities. The factories, which used a process called smelting to melt down lead, were in operation from the 1930s until the 1960s when they began to shut down. While the factories themselves may now be gone, their toxic legacy remains, as they have left behind significant amounts of poisonous lead particles in surrounding soils. The lead particles are particularly dangerous for children who live and play in these areas. “Lead poisoning occurs when lead builds up in the body, often over a period of months or years,” reports the Mayo Clinic, adding that even small amounts of lead can cause serious health problems. “Children under the age of 6 are especially vulnerable to lead poisoning, which can severely affect mental and physical development [and] at very high levels...can be fatal.” Environmental scientist William Eckel warned government officials of the dangers of old lead factories in his research article “Discovering Unrecognized Lead-Smelting Sites by Historical Methods,” which was published in the American Journal of Public Health in April of 2001. Eckel used EPA databases along with lead industry directories to compile a list of more than 400 possi-

ble factory sites around the country that may have been unknown or forgotten over time. In an effort to create some urgency for federal regulators, he paid to have the soil around eight of the sites tested and all but one exceeded the EPA’s hazard level for residential areas. More recent soil tests done by USA TODAY revealed that all 21 areas that were examined in 13 states had potentially dangerous enough lead levels that children should not be playing in that dirt. This meant, of course, that cleanups of these sites had not been done. In response to Eckel’s findings and the USA TODAY series, EPA has initiated work with states to survey the majority of the sites on the 2001 list, although records for many of the affected areas are incomplete. “I am convinced we have addressed the highest-risk sites,” reports Elizabeth Southerland, director of assessment and remediation for the EPA’s Superfund program. She says her agency is open to reassessing sites that may need another look thanks to more recent information uncovered by USA TODAY. Unfortunately, ongoing federal budget woes mean that resources are severely limited. In fact, the EPA lacks funds to complete even previously scheduled Superfund remediation projects. In the meantime, individual homeowners can determine whether or not they live near a former lead smelter and can apply pressure to local authorities accordingly. USA TODAY has posted a free online map to help people figure out exactly where the danger zones might be.

PROGRAM FROM PAGE 1 Alzheimer’s care and research. One year in, the program is already having a profound impact on the roughly 350 patients that have enrolled, said David Reuben, chief of the UCLA geriatrics division. Reuben pointed to a patient that attended the event, Carole, as an example of its power. Before enrolling in the program, Carole kicked, screamed and fired caregivers. One of three dementia care managers in the program took her under her wing, and Carole began attending arts classes at an adult day care three days a week. The care manager helped her caregiver identify and deal with symptoms, and worked with Reuben, the doctor, and Carole’s psychiatrist to make sure the entire care team was pointed in the right direction. “This lady, a year ago, was in a hospital,” Reuben said. “Now she’s laughing and smiling. It doesn’t get any better than that.” Dementia is a general term for a decline in mental ability severe enough to interfere with daily life, and Alzheimer’s is the most common form of that condition, according to the Alzheimer’s Association, an organization that supports care, support and research into the disease. Alzheimer’s impacts an estimated 5.4 million people in the United States, and roughly 480,000 Californians, particularly the elderly. According to UCLA, nearly half of people 85 years of age and above will suffer from the disease. Alzheimer’s symptoms include difficulty remembering new information, and can lead to mood and behavior changes, confusion about time and events, suspicions of family members and even difficulty speaking, walking or swallowing. While the impact on the patient is severe and often debilitating, it also has a huge effect on the person that helps the patient through daily activities, many of which can be unusually challenging. That takes a toll on people, something Davis can speak to from experience. Davis watched her father decline in a time that Alzheimer’s and dementia barely received discussion, much less press. That left many people struggling with a situation beyond their control without the benefit of help or even a listening ear. “They probably don’t realize how stressful the situation is on caregivers,” Davis said. “Statistically, caregivers will die before the person with Alzheimer’s or dementia

because of the stress of what they’re going through.” Davis’ experience led her to work with the UCLA Reagan Medical Center in Westwood to create a support group for caregivers that later shifted to the Santa Monica UCLA campus. She helps somewhere between 20 and 22 people when they can break away from their role as caregivers. The ability to delve into the stresses of the disease helps the families, but it also helps Davis who is still working through some of the issues raised during her father’s illness. “I often feel that I get as much from it as other people,” Davis said. For those unable to make it to the Tuesday and Thursday night groups, UCLA is debuting a teleconference-style support group so that people can actually call in from their homes or other locations to talk out their problems. Although a year has passed, the program and those involved still have a lot on the horizon to make it a success. It received $3.3 million in funds from the federal government through the Patient Protection and Affordable Care Act because of its potential to increase quality of care and patient outcomes while decreasing cost, mainly by avoiding hospitalizations, Reuben said. Other funding comes from payments for medical services and donations from Robert Draine, James and Carol Collins and Chip Goodman, according to Ted Braun, director of marketing and public relations for the UCLA Health System. Still, it needs 1,000 participants and it has fewer than 400, Reuben said. The program has also run into challenges in coordinating the different groups that provide care to a single patient. The UCLA team thought it would be a simple task to get computer software that could keep patient care information in one spot, but it apparently doesn’t exist and costs hundreds of thousands of dollars to create. Reuben produced a photo of a yellow legal pad with notes about calls received and returned that belongs to one of the dementia care managers. “We can make e-mail referrals and phone call referrals, but there are no tracking mechanisms,” he said. Still, he has a lot of confidence that the program can succeed, and the patients with it. “I won’t say that we didn’t’ know what we were doing, but we’ve learned a lot,” Reuben said. ashley@smdp.com

Q&A FROM PAGE 1

TRIAL FROM PAGE 1 Santa Monica, Calif., following 16 years on the run as one of the nation’s most-wanted fugitives. Bulger told his friend he wanted to set the record straight because he was not an FBI informant, as prosecutors and many witnesses at the trial have claimed, and second, he did not kill women, according to a book called “Whitey Bulger: America’s Most Wanted Gangster and the Manhunt That Brought Him to Justice” written by Boston Globe reporters

fun contrasted against a dark wood color that allowed them to be more prominent. In Redwood Grille the client wanted a little more sophisticated, tailored look. The name of the restaurant evoked to me a feeling of being in a redwood forest. When you look at the trunks of the trees and the scale of the trees, they’re so big. Really what you’re seeing is different trees being lit differently so you see a lot of vertical lines that have dark and light spots. It’s almost like reading a barcode. I tried to emulate the figure ground that you would see looking at a redwood forest without being too literal. I also have this huge 22-foot-long redwood tree that was sliced down the middle that’s referencing the name and creating a really spectacular table that opposites a floor to glass ceiling exhibition kitchen which is basically the energy, and what I call the ribcage of the restaurant, where you can see what’s going on to produce the food. DP: What is the significance of a restaurant’s design to the culinary experience? Jones: In my mind for a restaurant to be successful you have to be making A’s in all three of these elements: atmosphere, the food, and the service. You take one of those three elements out, the other two have to work harder to overcome the missing piece. There have been some restaurants in Boston and New York that I’ve been to where the atmosphere is not really what’s played up but the food is so fantastically great and the service too that it kind of makes up for it. Design can only go so far. In my mind, people go to restaurants because they want to be entertained. It’s not just a place to go to eat; it’s also for a different experience. When you get all those three elements together, the food tastes better, your company is better, and you’re in a good mood. editor@smdp.com

Shelley Murphy and Kevin Cullen. “This whole trial is an effort on his part to overcompensate for his informant label,” said Boston attorney Anthony Cardinale, who helped expose the corrupt relationship between the FBI and Bulger while he represented former New England Mob boss Francis “Cadillac Frank” Salemme. “He’s doing anything he can to have some shred of a reputation left,” Cardinale said. But despite the impulse to want to rebut testimony that he ratted on the Mafia and members of his own gang, Bulger would open himself up to even more damaging evidence if he decides to take the witness stand, Cardinale said.

space? Jones: In retail space it’s very formula driven. There’s a certain amount of distance you need to have from the exits of your mall and there’s a grid that usually lays out tenant spaces. In restaurants it’s a lot more organic, much more free-flowing in terms of creating an environment that is not just derived from formulas but derived from creating a spirit, a mood, a sense of place. I often compare it to designing a Ferrari, or a sports car, where you have a very sexy body that has to look wonderful, but then you also have this big engine which is the kitchen and it has to be fine-tuned and run at top speed at all times. DP: What makes designing in Santa Monica unique from any other city that you’ve worked in? Jones: A big thing about Santa Monica is obviously the ocean and the views and the energy. Del Frisco’s Grille is literally across the street from the Santa Monica Pier. For the design that I came up with on that, I made sure that the bar was as close as I could get it to Ocean Avenue so that you would be able to feel as if the whole energy of the Santa Monica Pier, the iconic sign and the ocean in the background were as much a part of the space as it could be. Redwood Grille is in the Santa Monica Place mall at the end of the Third Street Promenade with the same kind of energy that happens at Del Frisco Grille but different. Santa Monica is a very unique environment and tourist destination that allows for an active and vibrant environment. DP: Can you walk me through some major design elements of Del Frisco’s and Redwood Grille that customers should look for when they go in? Jones: For Del Fresco’s I would say the bar engages the exterior and engages the street. We have a windscreen around the patio so there is a sense of enclosure but you’re at eye-level with people walking by so you’re in the mix. The bar scene is very important to [the restaurant owners] and so we tried to introduce a lot of color. We introduced the color in the furnishings and the artwork and also with the wines. We have glass wine cases that have red backdrops to them; you see the pops of red between the bottles. The color was very important. I thought the red, the gold, the yellow were colors of the sunset and evoked

desks to add on,” Stewart said. Assembly Speaker John Perez, D-Los Angeles, defends the practice, saying in a statement that lawmakers “may be meeting in a committee off the floor while a vote is taking place, testifying in the Senate, or perhaps in a media interview that forces them to miss a vote.” But government watchdog groups say allowing lawmakers to change or add their vote after the fact hurts public trust and reduces transparency. Still, they see little public pressure to change the rule, either internally or through a ballot initiative. “There are no political ramifications for doing it,” said Phillip Ung of California Common Cause. Five Republican lawmakers flipped their votes on at least one measure related to the state budget last month. Lawmakers from both parties also added votes on the twodozen budget bills. Asked why he changed his vote on four budget bills, Assemblyman Mike Morrell cited the short timeframe lawmakers had to review the final legislation. “After casting my initial vote and after I have had time to review the bill, there are times I gain additional information that further shapes my opinion on the bill, therefore necessitating a change from my initial position,” Morrell, RRancho Cucamonga, said in a statement. There also were vote changes on several gun-control measures. Eight legislators later added support to SB140, which authorized $24 million for a program that seizes gun from felons and the mentally unstable. On a bill making it a misdemeanor to leave or store a gun where a child can access

We have you covered it, AB231, one lawmaker switched from “yes” to “no,” six added on in opposition and three added support after the bill was approved. Freshman Assemblyman Adam Gray, DMerced was among those adding his opposition to AB231 after it passed. He declined in an interview to discuss his rationale regarding specific measures, but said generally that he sees many of the bills for the first time when they arrive on the floor. “I’m not going to be pressured into voting until I’ve reviewed the bill,” said Gray, who added his vote to 65 measures on May 29, one of the Assembly’s busiest days. California is one of at least 10 state legislative bodies nationwide in which some lawmakers can amend their votes. Changing a vote requires unanimous consent from other Assembly legislators, which was revoked at least once this year. After a hard-fought victory on AB93, a bill sought by Gov. Jerry Brown to overhaul an economic development program, Perez announced that no additions or revisions would be allowed. A printout requested immediately after the vote shows Republican Rocky Chavez, of Oceanside, adding on as the 55th vote. But the final tally lists Chavez as “not voting” because of the speaker’s announcement. Assembly Minority Leader Connie Conway, who switched her vote on one of the budget trailer bills and on several other measures this session, said in a statement that reducing the number of bills under consideration would allow lawmakers to be better prepared for voting. Not all lawmakers have made a habit of changing their recorded positions. The only time freshman Assemblyman Jim Patterson, R-Fresno, altered his vote was on May 16, when his vote on the consent calendar did not record properly. He fixed the error after a staffer pointed it out.

D.U.I. Do's & Don'ts W

ith a slumping economy, ensuing global conflicts and our own personal dilemmas, a few drinks come as a welcome respite for many. But before you have that extra glass of wine at dinner, make sure you are aware of some new laws and issues that may drastically affect your driving privileges. California has some of the toughest DUI laws in the country, and while no one plans to get arrested for DUI, here are 5 helpful tips to remember if you find yourself at the wrong end of a DUI checkpoint this year.

1) Submitt To o FSTS: When arrested for DUI many people look for a quick and easy way out of it such as refusing to submit the officer's tests.Well, truth be told, this doesn't really work. Refusing to submit to field sobriety tests (FSTS) will almost always earn a year suspension from the DMV regardless what happens with your court case. Refusing to submit to FSTS might weaken the State's evidence against you, but is it worth risking an automatic one year suspension? This includes submitting a breathalyzer test at the scene of the arrest (called a PAS test).A PAS test might not even be admissible in the criminal case, but if you are below a .08 it will save you a ton of hassle…and probably earn a get out of jail free card. Submit to testing and let a skilled lawyer take it from there. Even if the test results appear "bad," by hiring the right attorney there are many legal arguments and challenges that can be made to the manner in which the tests weand administered, your statements, and the results of the tests. 2)) Requestt A Hearing: if arrested for DUI you will receive a temporary driver's license that is good for 30 days before your license is suspended. However, you have the right to request an administrative hearing with the DMV in order to challenge the suspension. This hearing might also yield valuable testimony from the arresting officers that could help you later on when fighting your case in court.Administrative hearings are conducted either in person or telephonically, are far less formal than a court proceeding, and have a lower evidentiary standard of proof required to sustain a suspension.Administrative hearings must be requested within 10 days of arrest, so make sure to act fast if you are arrested.A trained experienced lawyer is also advantageous in order to help navigate through the complexities of the DMV.

3)) Know w The e Penalties: In most Los Angeles County courtrooms a "standard" first time DUI conviction carries with it a $390 fine, 3 month alcohol program, 3 year probation, and mandatory installation of an ignition interlock device (a new 2010 law that L.A. County D.A.'s and C.A.'s are widely enforcing). Typically, prosecutors will not seek jail confinement on a 1st time conviction. In addition to the fines, the court will add on various penalty assessments and fees that could raise your final bill to upwards of $1,750. Depending on the circumstances of your case (under 21, high blood alcohol, refusal) the court could also order you to complete community service, caltrans work, attend AA meetings, and complete a MADD or hospital/morgue program.A first time DUI conviction is priorable, meaning it will be used to enhance punishment on any subsequent DUI in a 10 year period.A second time DUI begets similar punishment with heightened fines and a mandatory minimum of 96 hours (4 days) in jail. Of course, all of these penalties and punishments are subject to change based on varying circumstances, and it should be noted that there are additional restrictions that the DMV can enforce on top of all the court required punishments. 4)) Be e Polite e & Courteous: No matter what crime you are arrested for, be it for DUI or some other offense, dealing with police officers in a calm, respectful, and appropriate manner is always the best approach and will reward you in the end. Officers will note your behavior in their reports, and any belligerent outburst or tirade will likely be used against you as a sign of intoxication and could also earn you additional charges. Of course the opposite is also true meaning if you are calm and collected it could be used as a sign of non-impairment. Even if you didn't do anything wrong always remember that you attract more bees with honey! 5)) Don'tt Drive!: The easiest tip of all...drink to your heart's content and enjoy the holidays, and when you're done take a cab, ride a bus, or call a friend...just don't drive!

GETTING STARTED There are many strategies to solving Sudoku. One way to begin is to examine each 3x3 grid and figure out which numbers are missing. Then, based on the other numbers in the row and column of each blank cell, find which of the missing numbers will work. Eliminating numbers will eventually lead you to the answer.

SOLUTIONS TO YESTERDAY’S PUZZLE

■ Although Khalid Sheikh Mohammed (the alleged 9/11 mastermind) was waterboarded 183 times among several extreme interrogation techniques, he and his CIA captors eventually reached a moderated state. In 2003, though still housed in a "black site" in Romania, "KSM" asked permission to design a household vacuum cleaner, and the highest echelons of the agency cooperated, according to a former senior CIA analyst, speaking to the Associated Press in July. In reality, when a detainee exhausts his intelligence value, the agency's main mission is to keep him "sane," in case he is later put on trial, and the vacuum cleaner project was thought likely to engage KSM, who, 15 years before the murders of nearly 3,000 people on Sept. 11, had earned a mechanical engineering degree from North Carolina A&T State University. ■ The gourmet lollipop company Lollyphile announced its latest flavor in June: Breast Milk Lollipops (four for $10). Owner Jason Darling said it "slowly dawned on" him that his friends were "producing milk so delicious it could turn a screaming, furious child into a docile, contented one. I knew I had to capture that flavor."

TODAY IN HISTORY – Korean War: After four days, the No Gun Ri Massacre ends when the US Army 7th Cavalry Regiment is withdrawn. – The International Atomic Energy Agency is established. – U.S. President Dwight D. Eisenhower signs into law the National Aeronautics and Space Act, which creates the National Aeronautics and Space Administration (NASA).
