COLORADO AVE There are still a handful of concerns from the Planning Commission and a local union on the proposed six-story Hampton Inn & Suites on Colorado Avenue and Courtyard Marriott on Fifth Street
spearheaded by South Carolina-based OTO Development. The Marriott planned for 1554 Fifth Street would include 136 guest rooms, while the Hampton at 501 Colorado Avenue would have 143 rooms. The two properties are directly across the street from each other. During the last Planning Commission
meeting, union and city officials were concerned the proposals are not addressing many of the community benefits associated with their development agreements. Rachel Torres, research analyst with Unite Here Local 11, the hospitality workers' union for the Los Angeles and Orange County region, said her group has issues

BOSTON After listening to nearly eight weeks of testimony, jurors in the racketeering trial of James “Whitey” Bulger are set to hear closing arguments from prosecutors and defense attorneys as each side lays out its view of the case. Closing arguments in the nearly twomonth trial are scheduled Monday in U.S. District Court, where jurors have heard sometimes gruesome testimony about 19 killings in which Bulger is accused of participating and numerous extortions, money laundering schemes and the hoarding of guns. Bulger, 83, is accused of committing a litany of crimes while leading the Winter Hill Gang in the 1970s and ‘80s. He fled Boston in 1994 ahead of an indictment and was one of the FBI’s most-wanted fugitives until he was captured with his longtime girlfriend in Santa Monica, Calif., in 2011. Judge Denise Casper has granted each side up to three hours and 15 minutes for its closing argument, but on Friday, she urged the lawyers to consider the jury’s ability to stay focused for such a long time. Cops stress motorcycle safety The Santa Monica Police Department will be out in full force on Sunday, Aug. 11,, to conduct a motorcycle enforcement operation, according to a press release. Extra officers will be on duty patrolling areas frequented by motorcyclists and where accidents commonly occur. Officers will be looking for violations commonly made by drivers of passenger vehicles and motorcyclist, which lead to many motorcycle collisions such as, driving under the influence of drugs or alcohol, speeding, making illegal turns, stop sign violations or any other dangerous violation. Motorcycle fatalities saw a phenomenal drop of 37 percent from 2008 to 2010, but rose nearly 18 percent in 2011. Operations like this are aimed at curbing any more rises in motorcycle deaths and sending the numbers back downward. California collision data reveals that primary causes of motorcycle-involved crashes include speeding, unsafe turning and impairment due to alcohol and other drugs. The SMPD is also reminding all motorists to be alert and watch out for motorcycles, especially when turning and changing lanes. The message to all drivers and motorcyclists is: share in the responsibility and do your part by safely “sharing the road.” Riders can get training through the California Motorcyclist Safety Program. LOS ANGELES The action-packed “2 Guns” is No. 1 at the weekend box office. The Universal film starring Denzel Washington and Mark Wahlberg pulled the trigger to capture the top spot with $27.4 million, according to studio estimates Sunday. The picture is based on a graphic novel of the same name and features Washington as a DEA agent and Wahlberg as a Naval Intelligence officer who must team up for an undercover operation involving drug traffickers and the CIA. Nikki Rocco, head of distribution for Universal, said “2 Guns” opened at the studio’s expectations and attributed the film’s success to Icelandic director Baltasar Kormakur and the first-time pairing of Washington and Wahlberg. “It was super casting,” she said. “There was remarkable chemistry. The two of them work so well together. You see it on screen.

While Sony’s kid-friendly computer-generated sequel based on the blue-hued cartoon franchise debuted below expectations in North America, “Smurfs 2” earned a bright $52.5 million in 43 international markets. “It is one of those films that seems to resonate on every continent,” said Rory Bruer, Sony’s president of worldwide distribution. “We have about 36 big territories to go, including China. They love the blue ones.” The Warner Bros. haunted house tale “The Conjuring” crossed the $100 million mark at No. 4 domestically after exorcising

Other smaller films continued to perform solidly at the box office, including Sundance winner “Fruitvale Station” with $2.7 million in 1,086 theaters and director Woody Allen’s “Blue Jasmine” with $2 million in 50 theaters. “Summer is not just about blockbusters,” said Paul Dergarabedian of box-office tracker Hollywood.com.“It’s also about Woody Allen. It’s about specialized films that challenge the audience — or are just different from the traditional, cookie-cutter, summer-style movie.” Overall ticket sales this weekend were up more than 15 percent over the same weekend last summer, Dergarabedian said.

It’s a matter of public health Editor:
Wow, that’s quite a story. I’ve learned plenty about [John Zawahri’s] family and his troubles. I’d like to say a few words about his perceived successes (”Treating the whole family the key to kids’ success,” Your Column Here, Aug. 1). He appears to have chugged right along, passed your class and all the others he attended right on through high school, even enrolled in Santa Monica College until he was killed in the SMC Library on June 7. In the matter of public health, the services provided by this organization are basically assessment. I had to avail myself of such services as I began post grad work to complete dissertation, thesis on a subject began while an undergraduate. I learned first-hand that they provide a very neutral, non-invasive assessment that is meant to orient the client and themselves as providers with the core concerns of the client and how to address them. You, as an instructor, could have referred him and/or his family. Even had they chose not to avail themselves of the service, you could have requested guidance in developing an evaluative process that would allow you to monitor his progress from information they have readily available. However, it does not appear he had any difficulties with his learning or assignments. You don’t mention that here. Still the service they provide is transferable and applicable to children on varying learning levels. Poverty has been experienced by a good number of people who nevertheless prevail in the areas they choose to pursue. The same can be said of un(der)appreciated wealth or an overabundance of capital. From your missive, I can see that he continued in school, prevailing to graduate despite “those problems.” I believe that all appointive, elective, political civil service workers should start out their work with a mental health evaluation assessment. For others such as yourself — teachers, police, firefighters — I believe the nature of the work they must perform should and necessarily does call for periodic reviews and should be done by an organization such as Public Health, because their ability to maintain neutrality, essential to their line of work, is impressive. That is not to discount peer or supervisorial review, but to ensure that such workers’ public perception remains unadulterated and that clarity of their awareness of their work is perceivable by the community. You are, after all, front-line workers for the public and the public deserves your best. As for Public Health Services, my life was way too dull, unexciting, uneventful to occupy any sufficient amount of their time and they let me know. I don’t think you can fool them, though it may very well be that some have tried. I hope this missive raises your awareness about public health, poverty and the responsibility of the community to be able to act for the benefit of the community on information that is verifiably correct and subject to timely review as the incident of June 7 is still sketchy, patchy, and not entirely correctly reported in some publications I have perused. As the matter continues to remain open to review and consideration, it may be time to ask for help from Public Health or the Justice Department. Thank you for your letter to the SMDP, it was wonderfully informative.

Like it or not, change is coming to Santa Monica A FRIEND TOLD ME LAST WEEKEND
that the new, mostly young people moving to Santa Monica are probably less critical of what’s going on than many of us who’ve lived here for 20, 30 years or longer. “They have no frame of reference. To them, everything is new and taken for what it is, not what is was. Because they’ve chosen to come here, they obviously like what they see,” he said. “The young and the new aren’t complaining about development or high rises — it’s the older residents. You see traffic jammed streets and hordes of tourists. It doesn’t bother them. They like the excitement and energy. “Where you see stacks of ugly apartments, they see new, modern, efficient homes. The younger, working people coming here like living where they can walk, bicycle or climb on a bus to get to work, shopping, school, a favorite eatery or entertainment venue.” He continued: “Add great weather, the beach and regional amenities such as professional sports teams and Los Angeles’ cultural, educational and recreational opportunities — it’s why Santa Monica is paradise.” Us “old-timers” lament the loss of the laid-back lifestyle and favorite haunts such as the Fireside Market, Norms, Bob Burns Restaurant, Shakey’s Pizza, Pacific Ocean Park, The Wilshire, Mayfair and Criterion Theaters, Woolworths, the Downtown post office, the ‘old’ Santa Monica Place and numerous book stores, gas stations and car repair shops that are gone, to name a few. But, will any of us really miss the weedstrewn lot with the rat-infested huts and rusting storage containers at Ninth Street and Broadway? Isn’t the new, five-floor, 97 unit, Luxe Apartments a better alternative? Is the now-closed Norm’s restaurant at Lincoln Boulevard and Colorado Avenue preferable to the five-floor, 100 unit, mixeduse apartment building planned for the site? How about the cookie cutter apartment building proposed for the AMF Bay Shore Lanes bowling alley property at 234 Pico Blvd.? What’s the alternative for the closed Paper Mate site at Olympic Boulevard and 26th Street? A draft environmental impact report released last week examines the latest version of the much maligned Bergamot Transit Village Center (BTVC) from Texas megadeveloper Hines. The developer proposes five buildings. Maximum height would be 81 feet. The development has a total of 766,094 square feet of space including creative office space, a residential complex and retail/restaurant space. The 7.1-acre site would include nearly two acres of open space along with underground parking for 1930 cars and 931 bicycles. Nebraska Avenue would extend from Stewart Street to 26th Street. Two new streets would transect the site from Nebraska to Olympic where two additional traffic signals would be added (to congest Olympic traffic even more).
Hines has “announced their intention to pursue the Residential Project Alternative that was studied in Chapter 6 of the EIR,” notes the staff report that accompanies the draft EIR. The alternative proposal would have the same overall square footage but consist of less office space (374,423 square feet in two buildings) and less retail/restaurant space (29,391 square feet) The alternative version contains much more housing (363,095 square feet or 498 apartments in three buildings) as opposed to 224,272 square feet (325 units) in two buildings per the original revision. An unspecified number of low income apartments are included. Subterranean parking for between 1,900 and 2,100 cars would still be provided along with bicycle parking and 2.05 acres of open space. The 9,648 page draft EIR is available on the city website. One problem is that the majority of the housing units in all of these projects are compact studios or one bedrooms. Two bedroom units are unusual and three bedroom units are as rare as unicorns. Nevertheless, the projected 948 new Santa Monicans living in BTVC will love their new homes and probably not miss my long gone favorite places or streets that were once much less congested. While I and others have criticized City Hall’s development philosophy of shoehorning tiny apartments together in crowded complexes, BTVC residents will probably be “OK” with it — just as I didn’t mind living with a roommate in a cramped, no-amenity, one bedroom apartment in Brentwood as a UCLA graduate student. Similarly, the dense East Village development replacing the Village Trailer Park in the 2900 block of Colorado Avenue will feel downright comfortable to those who chose to live there — even through it too reminds me of my crowded and uncomfortable student digs in Brentwood and in Westwood Village before that. Looking into my crystal ball, I see major developments of a similar nature all along the Wilshire corridor in the decades ahead as the purple line or “Subway to the Sea” becomes a reality. Property values will soar and there will be great demand for taller and denser developments and they will be built. There’ll be more pressure on the Downtown area. Despite protestations, more and bigger high rises will come as the number of “opportunity sites” will expand over time. Expect major changes along the Pico and Lincoln corridors as land values and bus lines combine to make them way overdue for major redevelopment. And, Santa Monica Airport land? The sky’s the limit. Are dark days coming or does the future look bright and exciting? It depends on your point of view. Development is in our future. There has never been a better time to renovate green, given the abundance of Earthfriendly building material choices as well as contractors well-versed in energy- and resource-efficiency. Many homeowners don’t realize that they can save money in the long run, despite the up front costs, by choosing materials and strategies that will lower utility bills and reduce maintenance and replacement costs moving forward. For starters, look for building materials that contain post-consumer or post-industrial recycled content that can be easily recycled later. Also, make sure the materials are sustainably sourced-such as wood certified as sustainably harvested by the Forest Stewardship Council (FSC). And try to minimize the distance any building materials need to travel to help reduce overall greenhouse gas emissions. In areas of the renovation that are not a complete tear-down and re-build, tighten things up by plugging holes, patching or replacing roofing or siding as needed and adding weather-stripping around doors and windows. Also, switch out older single-pane windows with more efficient modern double or triple pane styles. This can pay for itself in energy savings within just a few years while improving comfort. Also replace or add insulation to walls, attics and other spaces to keep heat inside and cold out (and viceversa). And you can save lots of energy by swapping out old appliances with newer models that qualify for the U.S. Environmental Protection Agency’s EnergyStar label. Such appliances must be 20-30 percent more energy efficient than
standard models, and will reduce not only your carbon footprint but also utility bills. Talking over projects and options with a design professional at a retail green building supply store like Green Depot, with locations in 10 states, can also help homeowners source cutting edge materials that will save energy and money in the long run. He also will have to go over the charges: 32 counts in all. Wyshak will have to convince the jurors they can believe at least some of the testimony of three key witnesses against Bulger, all gangsters-turned-informants who admitted committing heinous crimes, including murder, and agreed to testify against him in plea deals with prosecutors. Defense lawyers J.W. Carney Jr. and Hank Brennan will split the defense closing argument. During the trial, they spent much of

their time trying to rebut a claim from numerous prosecution witnesses that Bulger was a longtime FBI informant who ratted on the rival Mafia and people in his own gang. The defense also focused on attempting to rebut refute allegations that Bulger strangled two young women. The jury is expected to begin deliberations Tuesday after receiving instructions on the law from the judge. Bulger’s girlfriend, Catherine Greig, pleaded guilty last year to charges related to helping him stay on the run for more than a decade and was sentenced to eight years in prison. She tried to have her sentenced reduced, saying people who claim their relatives were killed by Bulger shouldn’t have been allowed to speak at her sentencing, but an appeals court panel found no basis to change the sentence.

VENICE FROM PAGE 1 woman on her honeymoon and hurt 11 others who only a moment earlier had been enjoying an afternoon near the beach at the height of vacation season. A couple of hours later, authorities arrested a man on suspicion of murder after he walked into a police station in neighboring Santa Monica and said he was involved. Nathan Louis Campbell, 38, of Los Angeles, remained jailed Sunday on $1 million bail. Police declined to discuss a motive but Deputy Chief Kirk Albanese said there was no indication that the attack was a terrorist act or that anyone else was involved. By the time it was over, the driver had covered about a quarter of a mile along the boardwalk before fleeing. The entire incident was over in minutes. Witnesses reported a horrifying aftermath. People were “ stumbling around, blood dripping down their legs, looking confused not knowing what had happened, people screaming,” said Louisa Hodge, who described “blocks and blocks of people just strewn across the sidewalk.” The Italian woman was identified as Alice Gruppioni, 32. Her family in Bologna told the Italian news agency LaPresse that she had been on her honeymoon after a July 20 wedding. Gruppioni worked as a manager for the family business Sira group, which makes radiators. Her father, Valerio Gruppioni, runs the company and was formerly president of the Bologna soccer team, according to LaPresse. The family declined to speak to The Associated Press on Sunday. Another person was critically injured. Two others were taken to hospitals in serious condition. Eight suffered less serious injuries, police said. According to security video and witness accounts, the driver parked next to the Cadillac Hotel and twice walked out to the boardwalk before getting into the Dodge Avenger. He carefully maneuvered between a storefront and metal poles that had been erected to prevent anyone from driving onto the boardwalk. Then he stepped on the accelerator and plunged into the crowd. “I heard a big ‘boom, boom,’ like the sound of someone going up and down the curb, it was super loud,” said Alex Hagan, who was working the desk at the hotel. The driver knocked over two mannequins and an ATM and started hitting people, swerving from side to side and often running straight into victims. Video showed the car struck at least three vendors — a fortune teller, a couple selling jewelry and a

Golestan Alipour was bartending at Candle Cafe & Grill when the menacing vehicle drew near. “The restaurant was full. Everybody ran,” Alipour said. It was not immediately clear how fast the car was going. The driver eventually turned up a side street and headed away from the ocean. The car was later found abandoned less than two miles away, police said. At the scene, detectives searched for evidence across the boardwalk, which is in a part of Los Angeles known for eccentricities. The 1.5-mile ribbon of asphalt — which runs along the sand a few hundred yards from the ocean — is home to galleries, restaurants, tattoo shops, skateboard parks and the famous outdoor weight room known as Muscle Beach. It can draw as many as 150,000 people on summer weekends. Hodge said she and her friend, Ashley Taylor, had noted the large number of people walking along the seaside. “It was a really nice day. There were tons of people out. In fact, we were talking about how packed it was, because we were having a hard time getting through all the people,” Hodge said. The two women stopped to buy ice cream and a couple of hats, which may have saved their lives. They stepped out of a store as emergency crews arrived. Hodge saw a man and woman lying next to each other, wearing head braces, barely able to move but grasping hands. Los Angeles Councilman Mike Bonin said there have been previous problems with motorists accidentally driving onto the boardwalk, especially during the evening, because many entrances aren’t blocked and there are no signs warning them about entering a pedestrian area. However, four yellow metal poles blocked the roadway used by the hit-and-run driver, who squeezed past the barrier by driving onto a sidewalk, authorities said. “The frightening part,” Bonin said, was that this part of the boardwalk was “one of the more protected streets.” The crash was not far from where an elderly driver sped through an open-air farmer’s market in Santa Monica in 2003, killing 10 people and injuring more than 70 others. Investigators said George Weller, who was 86 at the time, mistakenly stepped on the gas instead of the brake and then panicked. He was doing up to 60 mph when he plowed through the market. Weller was convicted of 10 counts of vehicular manslaughter with gross negligence and was sentenced to probation.

People often ask me what to do if a landlord does not make repairs to a rental unit. Let me start with something a tenant should not do. DO NOT T WITHHOLD D RENT Under certain limited circumstances, a tenant may withhold rent. But, it is never a good idea to withhold rent. If a tenant does not pay the full rent, when due, the landlord would most likely serve the tenant with a three day notice to pay or quit. Once a three day notice to pay or quit expires, the landlord does not have to accept the money even if the tenant offers the full amount.The landlord can refuse the payment and proceed with an unlawful detainer action (eviction case). An unlawful detainer action is very stressful.Also, the tenant would have the expense of litigation costs and probably attorney fees.A tenant does not have to retain an attorney to defend an unlawful detainer action, but it would be very wise to do so. If a tenant loses an unlawful detainer case, the tenant would be evicted and owe all of the back rent and possibly the landlord’s attorney fees and litigation costs. Further, the unlawful detainer judgment would probably appear on the tenant’s credit reports as well as reports kept by landlord agencies which could make it difficult to rent a new home in the future. For all of the above reasons, a tenant should never withhold any rent. GIVE E LANDLORD D A LIST T IN N WRITING The first thing a tenant should do is give the landlord a list in writing of items which need to be repaired.The list should be hand-delivered or mailed to the landlord.The tenant must keep a copy of that list and keep track of when and how the list was delivered to the landlord (the specific date when the list was mailed or hand-delivered). A tenant must give the landlord a reasonable period to make repairs.What is a “reasonable period”is defined on a case by case basis.Usually,a tenant should give the landlord 30 days to make repairs.But,if the condition is serious (i.e.:no electricity, no hot water,hole in the roof),a reasonable time would be much shorter. A tenant should list all items which need repair, in detail. Failure to notify the landlord of a specific problem may prevent a tenant from being compensated later for the defective condition. CONTACT T GOVERNMENT T INSPECTORS If the landlord does not make the repairs within a reasonable period, the tenant should contact appropriate government inspectors. In Santa Monica, the first office to be contacted should be the Santa Monica Code Compliance Department: (310) 458-4984. The Code Compliance Department will not come to a rental unit to perform a general inspection.The tenant must have a specific list of items which need repair. In addition to the Code Compliance Department, a
tenant should call the County of Los Angeles Department of Health Services.To arrange for an inspection, a Santa Monica tenant would call: (310) 665-8484. The advantage of government inspectors is that the government agency may order the landlord to make repairs.Also, if the tenant is in trial with the landlord (or a hearing with the Santa Monica Rent Control Board), the government inspectors’ reports may be admissible as evidence. PETITION N FOR R RENT T DECREASE E If the landlord does not make the required repairs, a tenant may file a petition for rent decrease.The petition is filed with the Santa Monica Rent Control Board, located in Santa Monica City Hall, 1685 Main Street, Room 202, Santa Monica, CA 90401; (310) 458-8751.The petition for rent decrease may be filed 30 to 180 days after service of the written notice to the landlord of items which need repair. If the petition is granted, the rent will be reduced. But, the rent reduction is prospective (from that point forward).The Rent Control Board does not have the authority to award any money to compensate the tenant for past conditions or reduced services. SMALL L CLAIMSS COURT T If a tenant wishes to be compensated for the defective conditions or reduced services in the past, the tenant would have to file a lawsuit.A suit could be filed in superior court.Although an attorney is not required for superior court, it is likely that the landlord would retain an attorney.When one party has an attorney and the other does not, it is a big advantage. If the tenant retains an attorney, the expenses might make such a suit in superior court impractical. Usually, the most economical way to proceed is to file a lawsuit in small claims court.A person can sue in small claims court for up to $7,500.00.And, there are no attorneys in small claims court.Thus, the expenses are greatly reduced. CONSULT T WITH H AN N ATTORNEY Even if the tenant is not going to retain an attorney on a fulltime basis, it is usually a good idea to at least have a consultation with a tenants’ rights attorney, especially before filing suit in small claims court or filing a petition for rent decrease.
