CITY HALL The debate on whether medical marijuana dispensaries have a place in Santa Monica is back in the news. The City Council Tuesday is expected to
decide whether or not to extend for one year the moratorium on medical marijuana dispensaries. Santa Monica currently does not have any dispensaries and City Hall does not recognize them as legitimate businesses. But there’s some concern among advocates who want to lift the moratorium, argu-
ing patients should have access to marijuana, which has been recognized as a medicine by the state but not by the federal government, which still considers it an addictive drug on the level of cocaine, LSD and ecstasy. For the first time in more than four decades of polling on the issue, a majority of
Americans favor legalizing the use of marijuana, according to a national survey conducted by the Pew Research Center earlier this year. Over 50 percent of those surveyed said that the use of marijuana should be SEE POT PAGE 10

CITYWIDE In a recent report from the Environment California Research & Policy Center, a statewide, citizen-based environmental advocacy organization, California ranked sixth in cumulative solar electricity capacity per capita, providing 75 watts per person. In terms of total solar electricity capacity, the report said California leads the nation with more than 2.9 gigawatts — more than one-third of the nation’s total. Santa Monica city officials said adopting solar energy as an alternative energy source has been quick to find root in the city by the sea, an environmentally conscious town, which is trying to rely less on fossil fuels and save money on electricity bills. Thanks to Solar Santa Monica, an initiative by City Hall that provides support to residents and businesses who are planning on investing in solar, there are a total of 455 solar installations in Santa Monica. The city has 3.6 megawatts of solar capacity installed right now, Matt Henigan, sustainable energy engineer for City Hall, said. “There’s been a steady interest, and now more and more interest,” Ted Flanigan, executive director of Irvine-based EcoMotion, Inc., a consulting company that manages Solar Santa Monica for City Hall, said. U.S. gas prices drop 8 cents over past two weeks Officials warn of upcoming 405 freeway closure ASSOCIATED PRESS
CAMARILLO, Calif. The average U.S. price of a gallon of gasoline has fallen about 8 cents over the past two weeks. The Lundberg Survey of gas prices released Sunday says the price of a gallon of
regular is $3.60. Midgrade costs an average of $3.78 a gallon, and premium is $3.92. Lundberg Survey President Trilby Lundberg says refiners are over-producing gasoline and slashing their wholesale prices to move product. Of the cities surveyed in the Lower 48 states, Charleston, S.C., has the nation’s
lowest average price for regular gasoline at $3.27 a gallon. Chicago and San Diego have the highest average price at $3.92. The lowest average price in California is $3.72 in Sacramento. The average statewide for a gallon of regular is $3.86, down 11 cents from two weeks ago.
ASSOCIATED PRESS ORANGE, Calif. Officials want Southern Californians to be prepared for another freeway closure that will route thousands of cars onto side streets next weekend. The Los Angeles Times reports that nearly four miles of the southbound 405 in Orange County will be closed for 20 hours starting late Saturday. A portion of the northbound 405 will also be closed. The so-called Bridge Bash closure is part of a $277-million project to link carpool lanes between three local freeways: the 405, 22, and 605. On an average weekend day in the summer, more than 300,000 vehicles pass through the stretch of freeway that will be disrupted by the bridge demolition. The project has experienced more than two years of construction-related delays and is scheduled to continue through next year.

ON JULY 9 OF LAST YEAR, I WROTE ABOUT
the problems I had in the Civic Center Parking Structure after the Main Street Fourth of July parade. City Hall officials thought it would be good community relations to charge all parade participants $3 to park. That was bad enough but there were those damnable payment machines. I wrote, “After the parade, I finally located the ticket machine … and looked for how to pay. Because there were no clear instructions, I probably put my credit card in the cash slot. “Nothing happened. I pushed ‘cancel.’ Parking ticket and credit card popped out. I repeated the process. Nothing. I pushed ‘cancel’ and the ticket spit out, but no credit card. I reinserted the ticket. Again, nothing. Nada.” Another customer approached and suggested that I push “cancel” again. Out popped the card. I let him go ahead of me and watched. “At least I knew what slots to use. So, I reinserted my parking ticket. It was rejected as ‘unreadable.’” Fortunately, I found a real, live human attendant at the adjoining surface lot who took $3 and handed me a coded ticket that enabled me to exit the structure. I wrote that comedian Larry David had a similar experience in a Downtown garage a couple months earlier. It made national news and cemented Santa Monica’s parking as being unwieldy and unfriendly. “Apparently, nothing’s changed,” I wrote. Thirteen months later and still nothing has changed. This time, it was a week ago Friday evening in Structure No. 9 north of Wilshire Boulevard on Fourth Street. My friend and I had returned from the Third Street Promenade. Yeah, I know, it’s a place I try to avoid, except my buddy thinks it’s festive and fun. There was a long line at the payment machine. Eight or nine, families, individuals and couples were behind a gentlemen who had also put his credit card in the cash slot and couldn’t get it back. He finally retrieved it and a good Samaritan gave him a dollar so he could leave the garage. The line moved up. Most folks had a problem although a few knew the drill. I wondered how many parkers got hit with an additional buck in overtime charges after standing in line eight or 10 minutes. By the time my friend and I finished, another eight or nine parties were behind us. “Welcome to Santa Monica where customer service is king,” I said as we walked back to our car. City Hall’s Finance Department oversees the municipal parking operations. My long-time readers know all about the Finance Department. These were the folks who decided that they didn’t have to follow California Department of Motor Vehicles regulations on procedures for administrating parking citation appeals a

couple of years ago. After they took a lot of flak from me and the public about their mishandling of the appeals, City Hall actually had the gull to issue a press release saying they were improving their customer service. After being sued and ending up on the wrong end of a judgment, they finally cleaned up their act. How difficult is it to put some stickers on the ticket machines that say “Insert credit card HERE” or “Insert cash in HERE?” How about signage that tells first time visitors how to pay for parking — in English and Spanish? I know it’s a lot to ask. It’s just one more example of how City Hall responds to suggestions from the public and shows how indifferent the bureaucrats can be when coping with even small problems. You’d think the Chamber of Commerce, the Convention and Visitors Bureau and Downtown Santa Monica, Inc., folks would be all over this. Visitors and residents alike have enough problems with traffic and parking without enduring another frustrating, negative experience. It’s why many just don’t come back and go elsewhere “next time.” Speaking of parking, effective Oct. 1, the cost for annual resident parking zone permits are going up — way up. The first permit jumps from $15 to $20. The second permit jumps from $15 to $25, the third from $15 to $40. Additional permits will be $60 each. Annual visitor permits are going from $15 to $30 each, maximum of two. If you get two resident parking permits and one visitor permit, it’ll cost you $75 instead of $45. Thanks again to the Finance Department (which should take lessons from the City Clerk’s office on customer service) and your City Council for approving the increases. If City Hall can’t respond to complaints about their parking garage payment machines why would we expect it to respond to big, important stuff like restricting new building heights or improving Santa Monica’s driving experience? But, not all is totally bad. I cruised by Adelaide Drive last week. On July 29, I wrote that the 500 block of Adelaide Drive has become a workout heaven for trainers and their clients. There was so much activity and equipment that the sidewalk was impassable, necessitating stepping into the street to get around the congestion. Last week, there was only one small group — four or five women were stretching and sitting on one section of the narrow sidewalk. Did someone from City Hall respond to my comments about keeping the sidewalk clear for pedestrians? Or, was it because it was around lunchtime and most of the trainers and their clients had left?

PORTLAND, Maine A shell disease that has plagued the southern New England lobster industry for years by making lobsters unsightly and in some cases unmarketable appears to be creeping northward to the lobster-rich grounds off the coast of Maine. The number of lobsters suffering from shell disease remains tiny in Maine — only three out of every 1,000 lobsters sampled last year had the disease. But scientists and lobstermen are concerned because the prevalence grew fivefold from 2010 to 2012. The disease, which is not harmful to humans, first became noticeable in southern New England waters in the 1990s. About one in every three or four lobsters caught in waters off southern Massachusetts and Rhode Island in recent years has been diseased. Carl Wilson, the state lobster biologist with the Department of Marine Resources, said people should be concerned — but not alarmed — by the numbers. People who look only at the percentage increase could get spooked and say, “Oh, my god, that’s a huge increase,” he said. “But it’s not, considering all the sampling we have and all the caveats of our sampling design,” Wilson said. Lobster is one of the most important fisheries in Maine and New England, valued at more than $400 million to fishermen and hundreds of millions more to coastal communities. The fishery in southern New England waters has already been hurt by the so-called epizootic shell disease, which is caused by bacteria that eat away at a lobster’s shell, leaving behind ugly lesions. Diseased lobsters can still be processed but are unmarketable in the more valuable live market. The disease stresses lobsters and can sometimes kill them but doesn’t taint their meat. When biologists first began sampling for the disease in Rhode Island, the prevalence was small: less than 1 percent in 1996 and 4 percent in 1997. But in 1998, the percentage jumped to nearly 20 percent; since then, it’s ranged from 18 to 34 percent a year. A similar story has played out in Massachusetts south of Cape Cod, where an average of 22 percent of sampled lobsters have been diseased from 2000 to 2011. The rate peaked at 38 percent in 2011. Shell disease could be linked to a number of pressures such as rising water temperatures, pollution and low oxygen levels in the water, said Kathy Castro, a fisheries biologist at the University of Rhode Island Fisheries Center. Young lobsters can molt out of the disease when they shed their shells and grow new ones; egg-bearing females have the
highest prevalence because they don’t molt while they’re carrying eggs. Lobsters can die when the infection gets particularly bad and prevents them from properly molting. Shell disease is much less prevalent in the colder waters of the Gulf of Maine, which stretches from Cape Cod to Nova Scotia, than it is in southern New England. But it’s still around. In Massachusetts waters north of Cape Cod, about 3 percent of sampled lobsters have had the disease since 2000, with no upward trend. Tracy Pugh, a fisheries biologist with the Massachusetts Division of Marine Fisheries, isn’t overly concerned about the Gulf of Maine lobster stock because the waters are cold. “It’s certainly something to keep an eye on. But in terms of our perspective of Gulf of Maine shell disease, we don’t see it as something to get particularly concerned about,” she said. From 2008 to 2010, observers found about one diseased lobster for every 2,000 sampled in Maine. In 2011, that rate rose to four diseased lobsters in 2,000, and in 2012, it rose to six. It’s not a large number, but it’s high enough to get lobstermen’s attention. “From talking to fisherman from Massachusetts on up, it seems like each year it’s moving its way north a little bit,” said South Bristol lobsterman Arnold Gamage Jr., who’s been fishing all his life. Still, he tries to keep it in perspective. “If we go all day long and I see a few that have shell disease, I think to myself, ‘That’s a lot,’” Gamage said. “And I suppose it is a lot compared to none. But it’s still a very small number; it’s way less than 1 percent.” Given the sudden increase in shell disease over a short period in southern New England, Maine’s lobstermen, scientists and regulators have good reason to be worried, said Jeffrey Shields, a marine science professor at the Virginia Institute of Marine Science. His advice: “Keep an eye on it. Keep monitoring it. Lobby federal and state agencies to fund research to understand more about it.” For now, it’s too soon to say if the uptick in Maine is the beginning of something more or simply an anomaly, given the record-high ocean temperatures of 2012, said Wilson, the state of Maine lobster biologist. But he’s confident that the incidence of shell disease in Maine won’t replicate what happened in southern New England. Still, with lobster accounting for 65 percent of the value of the Maine’s commercial seafood harvest, it’s understandable that fishermen are keeping a close eye on the disease. “I think when you have such a high dependence on single fishery, how could you not have a concern?” Wilson said. “There can be threats to the lobster population that are completely out of the influence of the fishermen, so any change is going to be a concern.”

The convergence of environmental awareness and consumer culture has created a whole new movement today whereby sharing is cool. Indeed, some environmentalists view sharing as key to maintaining our quality of life and our sanity in an increasingly cluttered world. “Sharing is a relatively simple concept and a basic part of human life,” reports Janelle Orsi on Shareable, an online magazine that tells the story of sharing.“What’s new is that people are applying sharing in innovative and far-reaching ways, many of which require complex planning, new ways of thinking and organizing, and new technologies. In short, people are taking sharing to new levels, ranging from relatively simple applications of sharing to community-wide sharing initiatives-and beyond.” “In a shareable world, things like car sharing, clothing swaps, childcare coops, potlucks, and cohousing make life more fun, green, and affordable,” reports Shareable. “When we share, not only is a better life possible, but so is a better world.” The non-profit Freecycle Network, which runs a Craigslist-style website where people can list items they want to give away, pioneered using the Internet to facilitate diverting reusable goods from landfills when it launched back in 2003. To date, more than nine million individuals across 5,000 different regions have used the group’s freecycle.org website to find new homes for old items. According to Shareable, other examples such as Zipcar, Wikipedia, Kiva and Creative
Commons show how successful sharing can be. “They show what’s possible when we share. They show that we don’t act merely for our own good, but go out of our way to contribute to the common good. They show that we can solve the crises we face, and thrive as never before. They show that a new world is emerging where the more you share the more respect you get, and where life works because everyone helps each other.” Shareable and the Center for a New American Dream, a non-profit that highlights the connections between consumption, quality of life and the environment, have collaborated on the production of the new “Guide to Sharing,” a free downloadable booklet loaded with practical ideas about exchanging stuff, time, skills and space. Some of the ideas in the guide include: organizing a community swap; starting a local toy, seed or tool library; launching a skills exchange where community members can swap professional skills like carpentry or grant-writing; or setting up a food, transportation or gardening co-op. Some other sharing tips include car-sharing, gift circles, sharing backyard chickens with neighbors and launching a “free market” where people meet to trade skills and stuff. For her part, Janelle Orsi envisions a future where public land is dedicated to community gardening, public libraries also lend tools, equipment and other goods, and citywide bike sharing, carpooling and wifi programs are all the rage. Orsi and others warn we had better get used to sharing, as it is here to stay. SACRAMENTO, Calif. A component of California’s landmark offensive against greenhouse gas emissions is not sitting well with some environmental groups. Under the measure, companies would be able to meet the state’s strict greenhouse gas restrictions in part by purchasing offsets, or credits that are generated when others achieve carbon emission reductions. Those others could be a tree planter on California’s North Coast or an Arkansas company that destroys gaseous coolants from old refrigerators, the Sacramento Bee reported (http://bit.ly/14lH6Cw). Some environmental groups are critical of offsets, saying they allow companies to get credit for greenhouse gas cuts that would have occurred anyway instead of cutting their own emissions further. “What we actually need is straightforward, meaningful reductions in emissions,” said Mark Reynolds of Citizens Climate Lobby, one of two groups that sued the state last year to prevent the use of offsets. The case was dismissed in January, the Bee reported. State officials say offsets give companies flexibility in how they meet the requirements of California’s 2006 climate-change law. That flexibility, they say, will help companies save money. “Offsets are a low-cost mechanism,” said Rajinder Sahota, manager of the California
Air Resources Board climate change program evaluation branch. Offsets are part of the so-called “cap-andtrade” system adopted by California in 2011 to provide financial incentives for polluters to reduce greenhouse gas emissions. That system is a key part of the state’s landmark 2006 global warming law, AB 32, which seeks to reduce the emissions to 1990 levels by 2020. The “cap-and-trade”rules currently apply to more than 400 manufacturers, food processors and other big industrial firms, the Bee reported. They can get their emissions under the cap by reducing their carbon footprint or buying state-issued emission permits that allow for a specified amount of greenhouse gases each year, with the amount declining over time. Companies that cut emissions and have extra allowances can then sell the permits in a marketplace; greenhouse gas emitters can purchase those allowances if they fail to cut emissions. In the future, a company will be able to meet up to 8 percent of its emissions reduction obligations by purchasing offsets. The Air Resources Board has not approved any offsets yet, but is evaluating more than 60 different projects, the Bee reported. Decisions are expected by the end of summer, said ARB spokesman David Clegern. State officials say industries will be allowed to use offsets from carbon reductions that have already taken place.
Ancient dwelling still divides archaeologists KEVIN BEGOS Associated Press
AVELLA, Pa. A fluke rainstorm at an ancient rock shelter in western Pennsylvania has brought a renowned archaeologist back to the site of where a furious debate was launched in 1973 over when the first humans came to the Americas. As a young archaeologist, Jim Adovasio found radiocarbon evidence that humans had visited the Meadowcroft site 16,000 years ago. To archaeologists it was a stunning discovery that contradicted the so-called Clovis first theory, which dated the first settlement in the Americas to New Mexico about 13,000 years ago. The question is important because it ties into bigger questions on how and why so many different cultures developed in the Americas, and whether they all descended from one group that came across from Asia or arrived in multiple waves. On that question, Adovasio’s theory of multiple visits has mostly won out since other pre-Clovis sites have been discovered in North and South America. The picture of early humans in the Americas “is so much more complicated than we ever thought it was 40 years ago,” said Adovasio, a Mercyhurst University professor who returned to Meadowcroft after a decayed tree root let heavy rain flow into a part of the enclosed dig area in late July. The damage was unfortunate but presented an opportunity to re-examine the site, he said. Meadowcroft is located on the banks of a small stream, about 7 miles upstream from the Ohio River. The overhanging sandstone ledges provided a perfect place for roving band of early humans to shelter from the elements. “It has all the attractions of a prehistoric Holiday Inn, and that’s why they used it,” Adovasio said, noting that some early groups stayed for only a few days, but the spot was
passed down through oral histories and people returned, eventually for longer periods. The site was discovered when local historian Albert Miller found artifacts in a groundhog hole on family land in 1955, and he sought out professional archaeologists to investigate. Dennis Jenkins, a leading archaeologist from the University of Oregon, agrees with Adovasio’s broader points about the Clovis debate, but said some still have questions about Meadowcroft’s exact age. Jenkins said the main concerns are whether the earliest plant remains that helped date the Meadowcroft site are accurate, but he added that it looks like Adovasio “has done very meticulous work at Meadowcroft.” A recent poll of archaeologists found that opinions on Meadowcroft are still divided, with about 38 percent agreeing with Adovasio’s dates, the same number unsure, and about 20 percent saying it isn’t that old, according to a study published last year in the Society for American Archaeology. Regardless, it is clear Meadowcroft has helped to change the way some younger archaeologists think. Instead of holding onto Clovis, they’re open to multiple possibilities. “I like archaeology because it keeps changing,” said Anne Marjenin, the 28-yearold director of the Mercyhurst Archaeological Center lab, as she recorded details of the new Meadowcroft dig last week. “I don’t think we should just dismiss any kind of evidence because there may not be a lot of it.” At Meadowcroft, archaeologists scrape away at layers of sand and dirt with razor blades, bagging each layer for separate laboratory analysis. The current dig is examining the flooddamaged section in hopes of uncovering more details about the layers of the site that date from roughly 3,000 to 7,000 years ago, Adovasio said.

World’s very first pop-art satellite headed to space JOHN ROGERS Associated Press
LOS ANGELES If aliens ever target Earth, Jon Gibson and Amanda White are counting on them having an appreciation for pop art and a sense of humor. The duo created an elaborate, Andy Warhol-like design that has been etched into a satellite’s panel, transforming the spacecraft into a replica of an oversized electrical charging device. “If someone is going to invade our planet, presumably they’re going to come in some sort of electronic, electricity-powered ship,” Gibson notes whimsically. “Maybe this will make them stop for a moment and say, ‘These guys are nice. We’re not going to destroy their planet.’” At the very least, it will give them the opportunity to pause briefly and check out what may be the world’s first orbiting work of art. Of the 1,000 or so functioning satellites that race around Earth every day, there isn’t one he knows of that also doubles as art, says veteran satellite builder Craig Clark, who runs the Scotland-based company preparing to launch this one from Kazakhstan on Oct. 29. “No one else is crazy enough,” the CEO of Clyde Space Ltd. said during a recent phone interview from his office in Glasgow. In building the small satellite that will monitor atmospheric conditions and send back photos and other information from 373 miles above Earth, he turned to Gibson and White and their popular iam8bit gallery in Los Angeles. Their previous works include such esoteric efforts as overseeing a performance-art, paint-by-numbers project in 2010 that had 20,000 people affixing 2-inch-by-2-inch pixels to a wall to create a splashy, colorful mural for a conference of video game developers. A film of their efforts now resides in an art museum in Denver. “Hopefully, by doing some kind of quirky things like this we’ll get some kids interested in space. Rather than going on to doing war, they can do something that helps change the world and makes it a better place,” said Clark, who received a Member of the British Empire medal for his work this year from Queen Elizabeth. After some brainstorming, Gibson and White decided they wanted to do something directly related to space travel.

Using Computer Generated Imagery to make the satellite look like an electrical charger circling Earth turned out to be pretty easy. Putting such a design on a 2-pound, shoebox-sized gizmo filled with wires, antennas, sensors, solar panels and other sensitive equipment proved far more challenging. First, something that would stand up to the wear and tear of being fired into space, then orbiting the Earth at 17,000 mph for 25 years had to be used. And it couldn’t be paint, either, which would deteriorate over time and give off gas that could fog the satellite’s camera. So the images of computer buttons and a USB port, along with the words, “Greetings Beleaguered Space Traveler. Welcome to the Universe’s First Celestial Charging Station,” had to be etched right onto the satellite’s side. That limited the use of color to the orange, black and white that the satellite’s panels really look like. Still, Gibson and White managed to come up with a splashy, colorful and surprisingly realistic looking charger; one with white buttons and a USB port contained on a bright, meticulously detailed orange background. Unfortunately, it’s unlikely anybody on Earth will ever see the work once it enters orbit. It’s etched onto the side of the satellite that will be pointing heavenward, Clark said, and even if it wasn’t, tracking something the size of a loaf of bread at that speed would be no easy task. “But we’ll take plenty of pictures before we launch it,” he said with a laugh. Whether the result will be absolutely the world’s first orbiting space work is open to some debate. Harvard astrophysicist Jonathan McDowell notes that American Alan Bean, the fourth person to walk on the moon, is an accomplished painter. So is Russian Alexey Leonov, the first person to walk in space. Either might have doodled while they were up there. He also noted that a South Korean artist’s home-built satellite was launched in February. There was no artful design attached to it, but it did contain lights that were supposed to illuminate in a colorful, artful pattern. Unfortunately, from what space watchers can see, those lights don’t appear to have ever come on since it left Earth.

When You Hear About a Personal Injury or a Personal Injury Lawsuit, What Does It All Mean? A
personal injury is a type of harm that an individual suffers as a result of someone else’s wrongful act or omission (failure to act when they should have).The types of injuries suffered vary depending on the circumstances and can include,among others,broken bones,lost sight,severed limbs,and death.Also,the wrongful injury causing event could be something caused without fault or intentionally.An example of an unintentional harm is when somebody accidentally rear ends the car in front of them because they simply were not paying attention.This is commonly referred to as negligence.Negligence,in a nutshell,means that a person either did something or did not do something, which resulted in someone else getting hurt.The actual legal requirements are a little more complex,but this simplified explanation will work for now. Regarding personal injuries caused by the intentional or reckless acts of others,intentional acts include rape, assault,battery,and other types of physical and emotional abuse.Examples of reckless conduct that can cause harm to innocent people are drunk driving,discharging a firearm in public or detonating explosives in public places. Whether we are talking about personal injuries caused by negligent,intentional or reckless acts,the law generally provides that victims of such conduct who suffer harm are entitled to compensation.And in some instances,victims are also eligible to receive punitive or exemplary damages to ensure that the person or business that caused the harm in the first place does not repeat its bad conduct.More about punitive damages in a minute.For now,let us talk about injury compensation. What can the law do for you if you have suffered personal injuries caused by someone else? In a perfect world, the need to bring a lawsuit to receive compensation for your injuries would not be necessary because the person who caused the harm would apologize and then endeavor to pay for the damage they caused.The current Court system requires,and actually prefers,that those responsible for harming someone else accept responsibility and pay to the victim reasonable compensation. Reasonable compensation includes such things as lost wages,lost future wages if the hurt person can no longer do their job,the payment of past and future medical bills,and the costs of future and ongoing care if the person can no longer care for themselves.There are additional items that constitute reasonable compensation but the list can be infinite because each person and each harm is unique.
Regarding punitive damages, the imposition of punitive damages is designed to prevent more people from getting hurt.The prevention aspect of punitive damages is to create a “sting” to the defendant.A proper “sting” is only effective if the defendant feels it financially. Stated differently, generally, punitive damages are determined on an ability to pay basis. So do not be surprised when you hear or read about a jury that made a big punitive damage finding because it likely means that someone got hurt real bad or died, the defendant did something really bad, and the defendant has the financial wherewithal to pay the damages. As a public service announcement, be leery of the argument and those promoting it that customers pay when there are big punitive damages awards. This is not really accurate because safe business practices actually save money in the short and long terms.And do not forget, we live in a civilized society and quick profits should never trump personal safety and well-being. Pass it on. Why personal injury or victim compensation lawsuits? A lawsuit is necessary because sometimes those responsible for causing harm do not take responsibility for the harm.The Court case is designed to address issues of fairness. If the bad person caused the harm, the jury is empowered by law to tell that bad person to fix it.The concept is simple and injury victims should not be frowned upon because they were forced to file a lawsuit in the first place.After all, they did not ask to get hurt. One more thing,if you have been hurt be someone else,or you know of someone who has been hurt by someone else,make sure medical attention is the first thing on everyone’s mind.Take care of the injuries first.Worry about lawyers and lawsuits as a last resort and trust that the person or business that caused the harm will fix it.If not,then call a lawyer.To ensure that you receive what the law provides for your situation and injuries,be sure to seek the assistance of a lawyer.

Parking Structure No. 6 There will be periodic sidewalk closures on Second Street between Broadway and Santa Monica Boulevard through Aug. 17. The film launched internationally in a handful of markets, including Russia, taking in $10.9 million overseas. With the added star power of Damon and Foster, “Elysium” should be a bigger draw than “District 9” was abroad. “International is going to be the big, big win on this film for us,” said Bruer. The weekend was enough to push the box office just past the pace of last year, which means that despite several spectacular flops this summer, Hollywood’s 2013 is currently equal to its 2012. The year-to-date gross of $7 billion is even with last year, although attendance is down 2.9 percent. “Yes, there’s been some high-profile fail-
ures,” said Chris Aronson, head of distribution for Fox. “But the summer’s been fantastic despite the gloom and doom some in the media have portrayed.” The market was crowded with family films, including new releases “Percy Jackson” and “Planes,”as well as holdovers like Sony’s “Smurfs 2” ($9.5 million in its second week) and Fox’s “Turbo” ($2.3 million in its fourth week). With the box office led by two R-rated films, it made for a diverse weekend of movie-going. “It used to be called the dog days of August — and you still get some junk thrown in to August,” said Paul Dergarabedian, analyst for box-office tracker Hollywood.com. “But it can also be the land of opportunity for films that aren’t cookie-cutter for audiences that are burned out by blockbusters.” Estimated ticket sales for Friday through Sunday at U.S. and Canadian theaters, according to Hollywood.com. Karen O’Keefe, director of state policies for the Marijuana Policy Project, said the City Council has stalled for too long and it’s time to take action. The Marijuana Policy Project is a Washington, D.C.-based organization that wants to legally regulate marijuana. O’Keefe wrote a letter to the City Council in favor of marijuana dispensaries. O’Keefe said it would be a shame if Santa Monica continued to treat “this important medicine” as if it was wrong or shameful. “At long last, I hope Santa Monica’s medical marijuana patients will be able to obtain a medicine that improves their quality of life in their own city. I urge you to enact an ordinance this summer to allow and regulate a limited number of medical marijuana dispensaries,” O’Keefe wrote. Last October, the City Council passed a 45-day moratorium against dispensaries, which was later extended to allow planners time to poll the community and research how best to approach the issue. The question of medical marijuana dispensaries in Santa Monica re-emerged last year when Richard McDonald set up a medical marijuana testing facility on Pennsylvania Avenue. Rather than selling marijuana, McDonald was testing pot brought in by other dispensaries to provide information about possible pesticide contamination and even what kinds of symptoms the medicine would best treat. City Hall refused to issue him a business license, and McDonald opened without one. He’s currently fighting a legal battle with City Hall to win the right to re-open. In the meantime, McDonald decided to compromise. If he could not open a testing facility with any ease, he would open a dispensary, which was legal under California law, if not federal law. Santa Monicans have in the past shown signs of support for the use of marijuana, or at least the decriminalization of it. In 2006, Santa Monica voters passed a measure that made marijuana smoking by adults in their own homes the lowest law enforcement priority, even under barking dogs. That means the Santa Monica Police Department has to

City Councilmember Robert Holbrook said there are plenty of medical marijuana dispensaries close to Santa Monica along Venice Boulevard, giving patients alternatives. He said it would be problematic to have them in the city. “There’s … armed guards [and] tremendous amounts of cash involved,” Holbrook said. “[To] the best of my knowledge, the medical marijuana sold in these stores is not always obtained from some legal source. I don’t want to be involved in trafficking of drugs from illegal fields.” City Councilmember Ted Winterer said it makes sense to extend the ban for the short term and address the possibility of some restricted dispensaries in a very limited area of operation near the medical district, which is the area near Saint John’s and Santa Monica-UCLA Medical Center. Councilmember Kevin McKeown said every time the moratorium ordinance has been renewed, it’s not the intent of the council to prohibit dispensaries forever, but to give themselves time to learn from the mistakes Los Angeles and others have made and sort through legal issues. “The court ruling doesn’t prohibit marijuana dispensaries, it enables us to do them right, specifically because we don’t have to,” McKeown said. He said he was disappointed with the federal government on its stance on marijuana being inherently dangerous and criminal. Since the moratorium, City Hall held a community meeting in February to discuss pot dispensaries, and the California Supreme Court ruled that local jurisdictions could regulate or ban medical marijuana uses. Bill Leahy, spokesperson for Santa Monicans for Safe Access, a coalition of Santa Monica medical marijuana patients, said it was surprising the City Council is trying to extend the moratorium beyond Oct. 1. “A year has gone by and they’re asking for more time,” Leahy said. “I think they kind of wasted a lot of valuable time.” He said he was dismayed elected officials haven’t listened to their constituents. “The job of the council is to convey the will of the people,” Leahy said. “The people have spoken.” ameera@smdp.com

For business owners, Solar Santa Monica officials go out to the business, walk the property and analyze the solar potential and run a financial analysis of using solar energy. It uses a list of vetted contractors who then go out to install the solar equipment. City officials said all of the local public elementary schools have solar installations or projects currently under construction. City Hall is trying to make it easier for interested homeowners or businesses to use solar energy. Henigan said permits for solar projects are expedited and go to the front of the permit process line. He said permit fees are also waived. “We've done a lot of the groundwork to make it as easy and quick as possible and remove any of the barriers the city may have represented in the past,” Henigan said. City Hall also worked in conjunction with the Santa Monica Fire Department to streamline the inspection process to make sure the contractors, homeowners or business owners are aware of the requirements. Some of the requirements include access, a pathway, smoke ventilation and roof access in case of emergencies. Flanigan said savings depend on how big the installed solar system is, but savings aren’t seen right away. “What we’ve done in Santa Monica is you cover the annual consumption of the house or business. Instead of paying the utility at that point, you’re paying off your system,” Flanigan said. “Usually, you’re not saving

He took home four gold medals for sprinting events at the San Diego Senior Olympics last year, recently founded his own tour company for seniors and runs racehorses at tracks from Phoenix to Hollywood Park. But it hasn’t always been easy for Mindell. He wrote his book, called “The Closer,” about the dream he never got to live — one of playing big league baseball. “The Closer” is about a man named Terry who, in his 30s, finally gets the chance to play in Major League Baseball. Mindell, on the other hand, played baseball for three years at UC Berkeley, but wasn’t good enough to make it through the tryouts for the big leagues. This hasn’t stopped Mindell, however, from staying active. He heads over to the track at Santa Monica College about three times a week to practice sprinting. He swims once or twice a week, and dances both swing and zydeco, a type of dance that blends blues and Creole influences. Mindell said he hopes his persistence and success in staying active and not giving up will help fellow seniors from getting discouraged by age.

Your savings are coming after those years.” Officials said the cost of solar has dropped 30 percent for residential systems in recent times. For example, Herb Mendelsohn, vice president of sales and marketing for PermaCity, Inc., a company that’s contracted with City Hall to install solar panels in Santa Monica, said a year ago it cost $30,000 to install solar in homes, and now it’s $20,000. Mendelsohn said there are good leasing or financing options for homeowners while businesses have tax credits as an incentive to install solar panels. Ted Winterer, who sits on the City Council, said he would see a return on his investment from using solar thermal panels, which heat cold water, and photovoltaic panels, which generate electricity years from now. He installed the solar thermal panels in 2009 and the electric panels the following year. He said the solar panels supply hot water for washing dishes and bathing and during the winter, heats the floors of the house. “Renewable energy is the way to go,” Winterer said. “We live in a place with a lot of abundant sunshine.” Henigan said he sees the growth of solar leases on the horizon that will completely change the solar energy industry. “A lot of folks, who have thought about solar in the past and thought it was too expensive, are now back in the market and can take advantage of it,” Henigan said. “When you can really speak to someone on your block who’s done it and has benefited I think it gathers momentum that way.” ameera@smdp.com
Often, staying active isn’t a matter of physical fitness, but of a person’s mindset, said Grace Cheng Braun, president and CEO of WISE & Healthy Aging, a nonprofit that provides services to seniors. Cheng Braun said age doesn’t have to stop anyone from living an active life, as long as that person takes charge of his or her health and has the right perspective. Seniors can swim, bicycle, dance, walk or do any number of activities to be active and, just as importantly, be social, Cheng Braun added. “I think it’s a mindset. Those who look at the glass as half full, look at life as ... wow, another day to get active,” Cheng Braun said. “Mindset has a great deal of influence.” It is this mindset of not giving up that Mindell hopes his book will portray to his readers and to fellow seniors. In his writing, he always gives his characters significant problems to overcome. “The Closer,” for instance, is not just a baseball story, but a love story about Terry and the woman he falls in love with. He finds that she has a lifethreatening condition, and they are met with obstacles they need to overcome together. “But (the characters) always make the most of it. first major title with a two-stroke victory over Jim Furyk at the PGA Championship. Dufner bogeyed the final two holes Sunday for a 2-under 68 that was good enough to hold off the 2003 U.S. Open champion. The winning score was 10-under 270. Henrik Stenson finished three shots back. Dufner made up for the heartache of the 2011 PGA, when he went to the 15th tee with a four-stroke lead in Atlanta. He dunked that shot in the water, squandered the advantage and lost to Keegan Bradley in a playoff. There was no such collapse on another warm, sunny day at Oak Hill. From tee to green, Dufner was nearly perfect. If not for a bit of a shaky putter, the margin would’ve been even more. Furyk went into the final round with a one-shot lead, and it looked as if this might be his day when he rolled in a 40-footer across the sixth green for a birdie. But Dufner seized control just before the turn. With the final group tied at 10 under on the eighth hole, Furyk appeared to have a slight edge when his approach plopped down about 12 feet left of the flag. But, in quite a display of one-upmanship, Dufner’s shot spun back from above the hole and came to a stop about a foot from the cup. Furyk missed his birdie try. Dufner tapped his in to edge back ahead. When Furyk made bogey at the ninth, Dufner had a two-stroke lead heading to the back side. Furyk never got any closer. They matched birdies at the 16th, where Furyk rolled in a 12-footer and Dufner tapped in again after another brilliant iron shot. They matched bogeys at the 17th, where Dufner three-putted and Furyk needed two shots to escape the thick rough ringing the green. Finally, at the 18th, Furyk’s second shot found the rough again, leading to another bogey and a 71 total. Dufner also came up short with his second shot, chipped on and putted twice for the victory. He actually
pumped both fists, about as much emotion as he’ll ever show. Stenson closed with an even-par 70 and finished at 7 under, missing a chance to become the first Swedish male to capture a major championship. Countryman Jonas Blixt was another stroke back, also closing with a 70. The 43-year-old Furyk was trying to give golf another middle-aged champion. Three weeks ago, Phil Mickelson captured the British Open at age 43. The last time golf had back-to-back major champions in their 40s was 1986, when Jack Nicklaus won the Masters and Raymond Floyd followed with a victory in the U.S. Open. Instead, it was Dufner winning his first at age 36. Now he’ll be known for something more than that memorable picture of him slumped against the wall of an elementary school during a charity appearance — arms stiffly at his side, eyes glazed over — which led to the craze known as “Dufnering.” Mickelson wasn’t a factor at Oak Hill. He shot 72 to finish 12 over, tied for 72nd position when he headed for home, his day done before the guys in contention for the Wanamaker Trophy even teed off. Tiger Woods was an also-ran, as well, wrapping up his fifth straight year without a major title. He did play well down the stretch, making birdies on three of the last six holes. But all that got him was a 70, leaving him at 4-over 284 for the week. He never shot in the 60s, despite much easier scoring conditions the first two days and warm, sunny weather the last two. Woods is 0 for 18 in the Grand Slam events since winning the U.S. Open in 2008, leaving him at 14 major championships in his career and still four behind the record held by Jack Nicklaus. Coming off his fifth PGA Tour victory of the year, a seven-stroke runaway at the Bridgestone, Woods never got anything going in the final major the year. Tim Clark had the shot of the day among the early starters, a hole-in-one at the 11th. He knocked it in from 220 yards with a hybrid.
