Council to vote on outdoor fitness ordinance BY DAVID MARK SIMPSON Daily Press Staff Writer
PALISADES PARK City Council will vote Tuesday on regulations for fitness companies operating in public parks. All parks will be subject to the regulation
but Palisades Park is the focus of the ordinance. The park has seen an increase in fitness trainers in recent years, said Parks and Recreation Commissioner Phil Brock, who first brought the issue to City Council. “A lot of those trainers started using the park five, six hours a day,” he said. “We ended
up with trainers not only using it as their place of business but also attaching resistance bands to light posts and to the fence. Then we further started having trainers who started bringing weights, sometimes in large pickup trucks.” The proposed ordinance would split
Palisades Park into four quadrants and allow only 20 permits. Class sizes are set at a maximum of 15 students. Permits will cost the trainers 15 percent of their annual revenue. All other city park permits require a 10 SEE FITNESS PAGE 8

AHAHEIM, Calif. Tea party activists made an energetic showing Saturday at a California Republican Party convention, promoting resolutions to block the state’s high-speed rail project and require voters to show photo identification at the polls as part of a push to influence the direction of the struggling state organization. The loosely formed tea party has long been uncomfortable with traditional party politics. But Mark Meckler, a co-founder of the Tea Party Patriots, told a room packed with cheering supporters at an afternoon meeting that the state GOP could be revitalized by tea party activists and he stood with those trying to make a change. “I’ve been to a lot of tea parties, but I’ve never been to a Republican Party convention before,” Meckler said, noting that he withdrew from the GOP more than a decade ago after becoming disillusioned with its direction. Meckler said he’s listened to much debate about whether activists should become involved in the GOP but “the reason I decided to be here is because the people who are here are fighting ... for the heart and soul of the Republican Party in California.” The meeting represented the best organSEE GOP PAGE 9

Brown signs law limiting detention of immigrants ASSOCIATED PRESS SACRAMENTO, Calif. A package of immigration-related bills earned Gov. Jerry Brown’s signature Saturday, including a bill that prohibits local law enforcement agencies from detaining people for deportation if they are arrested for a minor crime and otherwise eligible to be released from custody. AB4 by Assemblyman Tom Ammiano, DSan Francisco, creates a statewide standard for how local agencies comply with the federal Secure Communities program, which requires law enforcement officers to check the immigration status of people who are arrested and to hold for 48 hours anyone whom federal authorities wish to detain. The law Brown signed allows state and local police and sheriff ’s departments to detain immigrants only if they have been arrested for or convicted of certain serious or violent felonies. People could also be held if they were convicted of a misdemeanor crime that carries a felony equivalent, or if they are registered as sex offenders. Supporters argued that limiting California’s participation in Secure Communities was necessary because the program subjects people who are not criminals and victims caught up in domestic violence investigations to deportation. “Soon, immigrant Californians and their family members will have the confidence that minor or unjustified arrests for things like selling food without a permit or having dogs that bark too loudly will not lead to extended and costly detentions in our local jails for deportation purposes,” said Reshma Shamasunder, executive director of the California Immigrant Policy Center. The governor vetoed a similar measure last year because it did not let officials detain people convicted of crimes such as child abuse and drug trafficking. That was changed in this year’s version. The California District Attorneys Association remained opposed to the legislation, however, expressing concern it “could result in the inappropriate and untimely release of potentially dangerous offenders” SEE LAW PAGE 11

Raising money for schools A Malibu-based financial adviser is challenging its employees to donate money to help fund education, sports and arts programs for public schools in the Santa Monica-Malibu Unified School District. The Dun & Bradsheet Credibility Corp. will provide a $250,000 investment to the Santa Monica-Malibu Education Foundation if people contribute $150,000 through the company’s EdAhead initiative. The EdAhead program enables D&B Credibility to match an employee’s contribution to the company’s 529 plan, effectively doubling the amount the employee puts into his or her college savings account. The same amount of a contribution is donated to the school district. The grant will fund the company’s high school summer internship program and it will also fund scholarships, technology and staff. “This is a remarkable demonstration by Dun & Bradstreet Credibility Corp. of how corporations can support their local public schools, provide their employees a
meaningful benefit and show genuine commitment to the community in which it operates,” said Linda Greenberg Gross, executive director of the Santa MonicaMalibu Education Foundation. Gross is hopeful that other companies will join D&B Credibility’s EdAhead initiative to help fund public schools. “We are pleased to partner with Dun & Bradstreet Credibility in fundraising for the district’s Vision for Student Success initiative, and expect that our base of supporters will grow as a result of this matching gift challenge.” said Gross. — BRIAN ADIGWU

Expo work continues The Exposition Construction Authority announced that construction along Colorado Avenue for the future light rail line will continue through Mar. 31, 2014. The construction takes place between Second and 17th streets and will include the removal and relocation of existing
underground utilities at various points along the street. Activities will include saw-cutting and removal of asphalt, excavation of soil, installation of new utilities, backfilling and asphalt restoration. Work during nights will be scheduled intermittently. The construction won’t affect the eastbound and westbound traffic lanes on Colorado Avenue, but it may restrict left turns throughout the work area. Various intersections will be closed during night hours and electronic message boards will be used to notify drivers to help detour traffic. Various alleys off of Colorado Avenue will be restricted and traffic will be redirected to Broadway or Olympic Boulevard as needed. Impacted businesses will be notified directly. Parking restrictions will be strictly enforced. Work hours will be 8 a.m. to 6 p.m., Monday through Friday, and 9 p.m. to 6 a.m. Sunday through Thursday. Greg Asciutto’s news brief article on Sept. 30, “Sierra Club endorses park at SMO,” indicates a real departure from the club’s traditional stance. Evidently protecting and preserving wild spaces for future generations is no longer a sufficient mission for John Muir’s venerable organization. Now, by jumping on the band wagon and advocating the replacement of Santa Monica Airport with a “great” park, they become mere opportunists who would destroy one community asset they evidently don’t understand with another type with which they are more familiar. Shame on them! They have apparently been wandering in the wilderness too long. At the very least, it is naive to believe this land will be anything other than a massive development project should it cease to be an airport. One need only look at the current crop of development projects in the city to appreciate the certain fate of 400 acres of the last remaining prime real estate in Los Angeles County or recall the aborted attempt at a business park in the mid 1980s by Henry Lambert and Reliance Development out of New York City. In the current cri de coeur over SMO, safety is cited ad nauseam as a justification for closing the airport. Acre for acre, SMO is safer than other places in the city when you factor in all causes of injury and death, although the incidents, when they do occur, tend to garner more than their fair share of attention. People are hit by cars, fall off their bikes, and are injured in their homes every day. They are also subject to rampant random crimes which are pretty much nonexistent at the airport. A park will not improve safety overall. A “great” park comes with an assortment of great problems. Just ask Los Angeles about Griffith Park or New York about Central Park. Parks have their own share of injuries, deaths, crime and pollution, and unlike an airport they do not carry their weight economically. They do not make money — they cost money — a lot of money, too. Would those who are currently agitating for closure be willing to see a per capita charge levied on park use sufficient to offset the economic loss incurred by shuttering the airport? I doubt that the city or its citizens could or would afford to do that. This airport is not some piece of under-utilized or obsolete wasteland waiting for a chance to be re-purposed. It is, rather, a fully developed asset that fulfills a vital role in the national transportation system, our economy, and the health and safety of the surrounding communities. It is an exemplar in noise mitigation for the entire country and with its public benefit, flying organizations like the Emergency Volunteer Air Corps, which stands ready to fill a critical need during natural disasters, and Angel Flight West, which transports people who would otherwise fall through gaps in the health care net, the airport meets vital needs that otherwise would go un-addressed. The proponents of this airport-to-park non-sense are proposing to replace the bread-and-butter benefits of civil aviation with pie in the sky and nothing more. We should give them their just desserts.

Minefields ahead on the City Council agenda THREE ITEMS ON THE CITY COUNCIL
meeting agenda tomorrow night caught my eye. I’ve written about all of them previously. Item 7-A is the introduction and first reading of an ordinance amending the municipal code relating to commercial fitness training in city parks and on the beach. The ordinance includes suggestions for permit fees and use charges for coaches and instructors. Staff’s report to council wisely notes that fitness instruction should also include group activities, camps and classes such as tai-chi, yoga, soccer, karate, boxing and other types of athletic activities plus fitness training and conditioning. Staff recommends establishing activity zones in Palisades Park where various levels of commercial physical training would be conducted. “Classes” can include two to 15 participants. Some parks and/or parts of parks would be “off limits” for training sessions. Types and weight of equipment would be regulated and the number of training permits issued would be limited. Ocean Avenue residents across from Palisades Park asked to prohibit training before 8 a.m. because of noise. But, trainers and their clients complained that outlawing instruction before 8 a.m. would make it difficult to train before going to work. When it comes to conflict between residents and commerce, residents usually take it in the shorts. Staff recommends a 6 a.m. to 9 p.m. daily window when sessions could be held. It will be interesting to see which side — fitness trainers or residents — council will support. An annual trainer permit fee of $100 and a 15 percent of gross revenue charge to be paid quarterly has also been recommended. As I’ve pointed out previously, fitness instruction is mostly a cash business. Because virtually all coaches and fitness instructors under report earnings, city bureaucrats will not collect a true 15 percent of trainer earnings and shortchange themselves. I say better to raise the flat fee to $50 or $75 per month. It’s a bargain compared to the hundreds of dollars in monthly fees fitness coaches generally pay to access private gyms and athletic clubs. Item 7-D is based on a joint request by Ted Winterer, Kevin McKeown and Terry O’Day (an executive with a firm that distributes electric vehicle charging networks and has a huge conflict of interest going here) to permanently exempt low- or no-emission vehicles from paying for parking at city meters. This misguided and highly idealistic piece of legislation is designed to encourage the use of ultra-low emission, electrical, natural gas (CNG), liquid petroleum gas (LPG) and vehicles displaying state-issued clean-air decals. Wait a minute. Aren’t we working at cross purposes here? Isn’t traffic and congestion (which in itself is a major source of air pollution) the number one complaint by residents and visitors alike? Why are we rewarding people for driving personal vehicles after decades of encourag-
ing the rest of us to give up driving? An electric car adds to traffic congestion the same as a gas-guzzling SUV. So-called, low-emission vehicles are not pollution free or environmentally neutral. How about the oil and grease, rubber tires and huge, corrosive car batteries? Vehicle interiors are loaded with plastics and other toxic materials. McKeown, O’Day and Winterer are apparently ignoring recent news reports where air district officials charge that emissions from Vernon battery recycler Exide Technologies is exposing more than 250,000 people living in eastern Los Angeles County communities to a “chronic hazard” from arsenic and other toxins. And, how much revenue is being lost by giving free parking to a select class of motorists? City Hall’s Finance Department can’t (or won’t) say. I’ll bet the family Prius it’ll add up to tens of thousands of dollars annually. Since when is City Hall flush with cash and can afford to forego revenue? This scheme will contribute to traffic congestion, impact city revenue and isn’t even environmentally friendly, so continuing or expanding any free parking privileges is utter nonsense and completely ill conceived. Item 7-C asks council to introduce an ordinance for first reading for an amendment to a development agreement for a new, five-floor apartment building at 401 Broadway, Downtown. The project’s original plans omitted onsite car parking. Future tenants in 401 with cars were expected to rent parking space in a nearby city parking structure. The developer and some city officials stated (when this was originally approved on Dec. 13, 2011) that Expo Light Rail and the numerous adjacent Big Blue Bus and Metro bus services negated the need for cars and parking. “This was the wave of the future,” the unicorn-chasers boasted. Reality took over when the developer couldn’t find a bank that would make construction loans on a project without a garage. The amended development agreement will be for a building consisting of 56 residential units and 11,019 square feet of rentable commercial space on two levels, 706 square feet of outdoor dining area and 49 parking spots for resident parking, however no commercial parking is provided. Unfortunately, parking will be unbundled from the residential units so parking is not included with market rate apartments. Want to park on-site? You’ll have to buy it unless living in a low-income unit. This means some tenants will park on nearby neighborhood streets (where no permit is required) and walk or bicycle to their car when they want to use it. Net result: even more cars parking on the streets. The moral of this story: social engineering makes problems worse because idealism always trumps common sense. warned that fracking can have disastrous consequences — ruined water and air, sickened people and animals, a ceaseless parade of truck traffic. Now some critics are doing what was once unthinkable: working with the industry. Some are even signing lucrative gas leases and speaking about the environmental benefits of gas. In one northeastern Pennsylvania village that became a global flashpoint in the debate over fracking, the switch has raised more than a few eyebrows. A few weeks ago, Victoria Switzer and other activists from Dimock endorsed a candidate for governor who supports natural gas production from gigantic reserves like the Marcellus Shale, albeit with more regulation and new taxes. Dimock was the centerpiece of “Gasland,” a documentary that galvanized opposition to fracking, and Switzer was also featured in this summer’s “Gasland Part II,” which aired on HBO. “We had to work with the industry. There is no magic wand to make this go away,” said Switzer, who recently formed a group that seeks to work with drillers on improved air quality standards. “Tunnel vision isn’t good. Realism is good.” For Switzer, the endorsement was a nod to reality; for some of her onetime allies, a betrayal. Either way, it was a sign that antidrilling activism is evolving, with some opponents shifting tactics to reflect that shale gas is likely here to stay. Plenty of anti-drilling activists still want nothing to do with the industry and continue to call for a ban on fracking, or hydraulic fracturing, the technique that drillers use to siphon gas from shale deposits more than a mile underground. In New York state, opponents have so far succeeded in blocking natural-gas development in the Marcellus Shale. But Pennsylvania residents concerned about drilling no longer have the luxury of simply calling for a ban, Switzer said. Not with the Pennsylvania and West Virginia portions of the Marcellus already yielding more than $10 billion worth of gas annually, making it the nation’s most prolific gas field. “It’s in full swing, and it’s simplistic to think you could just tell them all to stop,” said Rebecca Roter, another Pennsylvania activist. The enormous volume of gas flowing
from the Marcellus and other U.S. shale formations has turned energy markets upsidedown and led to wholesale prices that are about one-third of what customers in Europe or Asia pay. That’s led to lower costs for consumers and industry. And that, in turn, got the attention of Vermont’s anti-fracking governor. It was Gov. Peter Shumlin who, in early 2012, signed the nation’s first statewide fracking ban. But now he’s promoting the economic benefits of natural gas. Last month, Shumlin spoke out in favor of a $90 million expansion of the state’s natural gas pipeline system — which will transport fracked gas — saying the project was critical to industry, the environment and people who are struggling to pay energy bills. Some drilling critics, meanwhile, have become reluctant partners with an industry they dislike. Robert Donnan had been an outspoken critic of drilling in general and Range Resources, the company that sunk the first Marcellus well in 2004, in particular. In February, he leased his land to Range, according to public documents obtained by The Associated Press. Donnan didn’t respond to requests for comment, nor did members of the group to which he belongs, Marcellus Protest, whose stated goal is to “stop the destruction of our environment and communities caused by Marcellus drilling.” But one of Donnan’s cousins said family members felt they had little real choice, considering their 296-acre property southwest of Pittsburgh is already surrounded by drilling. “The choice is either sign the lease and have some control, or don’t sign and have no control” over what happens in the area, said Geoffrey Smith, adding the family will still keep an eye on everything the drillers do. “We’re watching for any spills, any violation of the lease, for any hanky-panky with the money,” said Smith, who praised his cousin for keeping the industry’s “feet to the fire” on environmental issues. Donnan is still speaking out, too. In the spring, he published a letter to the editor saying “gas production is filthy business.” He also denounced drilling at a public forum in Pittsburgh — though without telling the audience he had signed a lease. Range spokesman Matt Pitzarella said the company views Donnan’s decision to sign a lease after years of criticizing the industry “as an endorsement” of drilling, since he’s clearly aware of the risks involved.

Beach erosion is a huge issue for coastal areas in the U.S. and elsewhere. According to the non-profit American Shore & Beach Preservation Association (ASBPA), all beaches endure storms and other natural disturbances that cause them to lose sand, but the causes of beach erosion are not always the same. “On the West Coast, beaches are sand-starved when river dams block the flow of sand,” the group reports. That contrasts with Eastern beaches, they say, which often lack sand because inlets or navigation projects interrupt the movement of sand along the shore. “Things as disparate as storm-driven waves or a simple change in an offshore sandbar may cause one coastal area to lose sand while another gains.” “Ultimately, a beach erodes because the supply of sand to the beach can not keep up with the loss of sand to the sea,” says Ken Rubin, Assistant Professor of Geology and Geophysics at the University of Hawaii.“Most sand is transported from inland via rivers and streams. The damming of most waterways in the U.S. has thus prevented a major supply of sand from getting to our beaches.” He adds that beach erosion can be exaggerated during periods of rapid sea level rise, such as that which we are expected to experience soon as a result of global warming melting the polar ice caps. “When the encroaching sea comes against people’s property, the tendency is for people to try and stop the encroaching sea,” Rubin reports. “They armor the shoreline with seawalls, revetments, jetties, etc. [which] have a negative effect on beaches because once sea water reaches them, it ‘bounces’ off them
with more energy than a wave washing back off a normal sand beach.” The result is that more sand is carried off shore, promoting additional beach loss. And the increased severity and frequency of storms due to climate change only serves to further stir up the remaining sand at many beaches. Unfortunately, beyond keeping our carbon footprints in check, there isn’t much that individuals can do to prevent beach erosion. Building bulkheads in front of individual homes, or along entire beachfronts, may provide some short-term relief from beach erosion, but as often as not these actions can cause worse problems in the long run. And land use regulations that require homes and buildings to be built with a big buffer zone to the beach can go a long way toward protecting personal property and home values in coastal areas, but they won’t help prevent beach erosion. According to ASBPA, physically adding sand to beaches to replace losses is really the best fix: “Coastal scientists have years of experience with beach restoration projects and have learned that adding sand in the right quantities, properly engineered and maintained, can make a beach last forever.” Of course the best solution to any problem, including beach erosion, is to address the causes, not the symptoms. Concerted global efforts to curb the emissions that are driving climate change and the elimination of dams along inland waterways are both urgently needed lest we want to keep spending millions of dollars on remediation projects that just have to be repeated over and over again in what is essentially a losing battle. Erin Dick, head of the Santa Monica Outdoor Fitness Coalition, said the ordinance is an example of the democratic process working. “The city has listened to us, council has listened to us,” she said. “We were not close together in position back in February when we started this. Now here we are with a compromise that, I think, is very favorable to both the city and these small business owners.” At Tuesday’s meeting, Dicks plans to ask council to remove the 20 permit cap, something that Raisa Lilling, owner of Fit 4 Moms, Santa Monica, agrees is important. “What if my daughter is sick and I can't get down there to get a permit and end up being number 21,” Lilling said. and they’re number 16.” Brian Burke, of Friends of Palisades Park, is pushing for a moratorium of fitness at the park and seeks grass restoration. He said fitness classes are partially responsible for grass erosion at the park. “It’s not a treadmill, it’s not a gym, it’s a living, breathing organism,” he said. Burke said they should let the grass regrow before considering the slow reintroduction of fitness groups. “There’s no scientific study being done on what is best for the park,” he said. “They are going to allow these boot camps of up to 15 people and there’s really no way of enforcing that.” Burke plans to be at the meeting to express his views. Brock, who originally pushed for a total ban, is happy with the proposal but plans to offer a few changes at the council meeting. He wants to lower the Reed Park fee to 5 percent in order to encourage trainers to activate a park that is sometimes occupied by the homeless. Democrats hold every statewide office, dominate both chambers in the Legislature and hold a commanding 2.7 million-voter edge in statewide registration. The state GOP is looking for ways to recruit new GOP voters, especially among minorities, women and the young, while keeping the peace between uneasy conservative and centrist factions. The day highlighted many challenges. Conservatives said the party had drifted too far to the center. A divide emerged over the party’s image when a committee waded into a debate involving transgender children and schools and party leaders faced criticism for accepting donations from public employee labor unions they typically oppose in campaigns. In August, California become the first state to enshrine certain rights for transgender students in law, requiring public schools to allow those students access to whichever restroom or locker room they want to use. A potential ballot question in November would rescind the new law. Gregory Gandrud, a regional vice chairman for the party, warned members of a committee considering backing the repeal to be cautious about the message the party is sending at a time when it’s trying to broaden its membership. To build the party “we have to be very careful how we portray ourselves publicly,” he said, adding that there could be other ways to deal with the issue. He urged members to consider “the message that comes out of this convention.” The committee approved a resolution supporting the repeal on a split vote. The three-day convention took place with a backdrop of the partial government shutdown in Washington, D.C., with party members eager to place the political fault on Democrats. Texas Gov. Rick Perry told reporters at the convention Friday that President Barack Obama is to blame. “This is on him,” Perry said.

Addressing delegates Saturday night, Perry broadened his criticism of the president’s tenure, blaming him for the nation’s mounting debt and a wayward Middle East policy while predicting the national health care overhaul would damage the economy. “America cannot sustain its current fiscal course,” Perry said. “The downgrading of our credit, for the first time two years ago, shouldn’t have surprised anyone.” The day also showcased the party’s efforts to attract new voters. According to the independent Field Poll, 9 of 10 new voters in the state in the last decade have been Hispanic or Asian and in the last presidential race Obama received more than 70 percent of the Hispanic and Asian vote. “We need a whole new set of warriors in communities we haven’t had before,” Republican National Committeeman Shawn Steel told a group of Asian officeholders. A later panel highlighted GOP Hispanics and efforts to reach into Latino communities. At a panel discussion on technology, strategist Chandra Sharma told delegates that most Republican campaigns tend to rely on mail advertising and phone calls that don’t reach people under 35 years old. More emphasis and investment needs to go online, he said. “We have a lot of catching up to do,” he said. Party Chairman Jim Brulte defended the union donations, which included $15,000 from a local of the Service Employees International Union. He said the local has a significant GOP membership and he intended to work with those members to advance Republican candidates and causes. Party leaders have said they welcome the tea party activists, who also are pushing a slate of resolutions. One urges the Legislature to enact a law that would require voters at the polls to show identification with a photo, similar to requirements being contested in other states. The proposal could place leadership in an uncomfortable spot, at a time when they are trying to lure more minority voters. Critics argue the restrictions are intended to discourage students, lower-income people and minorities from voting, groups that typically lean Democratic.

White snuck in the endzone with a 1-yard quarterback keeper with 1:51 left in the second quarter to cut into what had been a commanding Samohi lead. “That’s a dangerous quarterback over there,” Samohi head coach Travis Clark said of White. “That guy is going to be playing on Saturdays one of these days.” The two teams played a scoreless third quarter, giving Samohi hope that its 14-7 lead would hold. But, White wasn’t done. The fleet-footed quarterback ran up the middle of the Samohi defense for a 30-yard touchdown that tied the game at 14-0 just minutes into the fourth quarter. The next Samohi possession proved to be a boon for Hart. Samohi’s Basile threw an interception to Chase White, who returned it 51 yards for a score. After a blocked extra point, Hart held a 20-14 advantage and wouldn’t look back. Brady White connected with Trent Irwin for a 37-yard scoring strike that padded Hart’s lead, 26-14. Samohi fell to 2-3 on the season in defeat. Hart improved to 5-0. Representatives from U.S. Immigration and Customs Enforcement were unavailable to comment Saturday because of the federal government shutdown, according to a voicemail greeting at the agency. The guidance spelling out when officers would comply with the federal deportation program was one of eight immigration-related measures Brown signed as he faces an Oct. 13 deadline for approving or vetoing legislation.
The governor also approved a bill allowing lawyers to be admitted to the California bar and licensed to practice law in the state even if they are living in the U.S. illegally. The legislation, by Assemblywoman Lorena Gonzalez, D-San Diego, was inspired by the case of law school graduate Sergio Garcia, 36, who passed the state’s bar exam but entered the country illegally 20 years ago to pick almonds with his father. A federal law passed by Congress in 1996 bars immigrants in the country illegally from receiving “professional licenses” from government agencies or with the use of public funds unless state lawmakers specifically vote otherwise. The package of bills also included a measure stating that someone who threatens to report an immigrant’s illegal status to authorities could be charged with criminal extortion. A related law subjects employers who retaliate against workers on the basis of immigration to fines and the loss of their business licenses.
