PICO BOULEVARD After a nearly yearlong legal battle, a $1.6 million gift from the Peggy Bergmann estate has been released to the Pico Youth & Family Center. Amid internal strife over the mission of the organization and accusations of financial

mismanagement, former PYFC board chair Amanda Seward attempted to return the check, which has been held by the Bergmann estate’s attorney, Sonya Sultan, since. “We had a terrific legal team that was able to dispel all of the false allegations made against the PYFC and its staff,” said PYFC founder Oscar de la Torre. “Our victory in court is also more evidence that the

WASHINGTON The lingering federal shutdown is transforming a musty debate over the role of government in America into a coast-to-coast, prime-time reality show. With landmarks closed, paychecks delayed and workers furloughed, Americans are drawing dueling lessons from the rippling effects of the partial shutdown: The disruptions show that the feds are way too involved in people’s lives or that the government does a lot of vital things that people take for granted. Analysis: Many L.A. buildings at risk during quake THE ASSOCIATED PRESS LOS ANGELES More than 1,000 aging buildings in Los Angeles County could be at risk of falling down during a major earthquake, according to an analysis by the Los Angeles Times. The newspaper reported Sunday that the structures, some nearly a century old, are scattered across both wealthy and modest neighborhoods and include high-rise office towers, factories and residences. The buildings, mainly constructed of concrete, are susceptible because they do not contain enough steel reinforcing bars to sustain them during the sideways shaking triggered by a large earthquake. Gov. Brown signs two Bloom-sponsored bills Gov. Jerry Brown signed two bills sponsored by former Santa Monica Mayor, Assemblymember Richard Bloom (D-Santa Monica) into law last week. Assembly Bill 1068 allows access to the pupil records of students 14 and older who are both homeless and unaccompanied for individuals who have signed a caregiver’s authorization affidavit. Previously, the law required parental consent or a judicial order for a person to access pupil records. Assembly Bill 1213, Bobcat Protection Act of 2013, prevents the trapping of bobcats or the sale of bobcats in the area surrounding Joshua Tree National Park. — DAILY PRESS

McKeown named county Democrat of Year Santa Monica Councilman Kevin McKeown was named Democrat of the Year by Los Angeles County Democrats for the second time in three years. McKeown will represent the 50th Assembly District along with Melissa Grant of Pacific Palisades. “Democratic values of social justice and affordable housing sometimes play out most personally at the local level, and I'm privileged to make a small difference as a Santa Monica City Councilmember,” McKeown said in an email. Rep. Henry Waxman, (D-Santa Monica) lauded McKeown for his response to homelessness and affordable housing in a release. “I am delighted to congratulate Kevin on his receipt of the Los Angeles County Democratic Party Democrat of the Year Award for the 50th Assembly District at their Roosevelt Dinner,” he said. “During his four terms as a Santa Monica City Council member, Kevin has established himself as a strong progressive who embodies Democratic Party principles” McKeown will be honored at a dinner on Oct. 20. — DP

The Warner Bros. astronaut adventure directed by Alfonso Cuaron and starring Sandra Bullock and George Clooney landed in the top spot at the box office for the second weekend in a row, according to studio estimates Sunday. “Gravity” earned $44.3 million, raising its domestic total to $123.4 million. “They say what goes up must come down, but that’s not really true with ‘Gravity,’” said Paul Dergarabedian, senior

Bruer, head of distribution for Sony Pictures. “This is the extraordinary kind of film that we think audiences will flock to over the next several months moving forward.” The animated Sony movie “Cloudy with a Chance of Meatballs 2” gobbled up third place in its third weekend with $14.2 million, bringing its domestic haul to $78 million. The weekend’s only other new release, “Machete Kills,” opened in fourth place with $3.8 million. The gun-toting sequel from director Robert Rodriguez and starring Danny Trejo and Michelle Rodriguez is the follow-up to “Machete,” which earned $11.4 million when it opened in 2010.

Every night I venture out into the dense black of my street, 17th Street, Santa Monica, with my two dogs. There are no street lights. Perhaps one night there might be two or three lights flickering, but all around me is a sea of darkness, stretching to 16th, 15th and 14th streets (”Copper thieves cost taxpayers $25K,” Oct. 11, page 1). In the daylight I look around to see how that can be, an entire area of well-to-do houses in the darkness each night. The only night lights that we have now are the overblown Halloween decorations hanging off trees with small orange fairy lights illuminating ghosts, witches and skeletons. Remember we have thousands of visitors on Halloween night, all directed by police patrol cars. So far this is a two-week long black out. I asked the Santa Monica city repair team, who are heaving up cables from small concrete holes on the sidewalks, what is going on? They grin and say, “We have been hauling cable for weeks. More copper wiring is stolen every day. Pulled out by knowing thieves, perhaps electricians! The thieves are also on Yale and Harvard streets hauling out the valuable copper wires from street light to street light. … It is exhausting work hauling up the underground wires and replacing the copper wires that carry the electricity to the street lamps." Perhaps this is a case of the media paying attention. Before a dog walker or someone falls over in the dark and breaks their neck or ankle! Or an ambulance is called to an emergency in a blacked out neighborhood. I hope to find someone interested in this very strange event. Who would think of fishing through a concrete sidewalk hole to steal underground copper cables outside a row of private houses? Let me know if you can imagine who are the thieves? Apparently it has nothing to do with underground moles, chipmunks or fishermen!

Bad bus logic Editor:

My economics professor taught us “figures don’t lie, but liars figure.” The Big Blue Bus says only 3.8 percent of riders use transfers (”Big Blue Bus considers eliminating transfers,” Sept. 27, page 1). Ergo, in a long bus with 100 passengers 96 riders are poor folks whose home is luckily on the same line where their job is, and their doctor’s office is, and their child’s day care center is, and their grocery store is, and their emergency hospital is, and their favorite restaurant is, and the best discount store is, and they never need a transfer because so many lines now detour around giant construction sites, and they never leave Santa Monica and need a transfer to another bus system, yadda yadda yadda. Where is this magical address where you never need a transfer? The paradox in this theory is that double charging the tiny 3.8 percent of poor riders who need transfers will provide tons of money the Big Blue Bus needs to serve the remaining 96 percent of riders who don’t need any extra bus service in he first place. Huh?

Sorry, parking lot full I WAS EXCITED TO HEAR THAT SOMEONE

was going to renovate the classic, 1937-era Telephone Building at 1314 Seventh St. in Downtown. Alcohol permits have been applied for in conjunction with two proposed high-end eateries at the location. A 4,748-square-foot restaurant, the Seventh Street Bistro, will have 242 seats (170 indoor and 72 outdoor dining seats) and offer breakfast, lunch and dinner service. The applicant is requesting a Conditional Use Permit (CUP) to allow a Type 47 (on sale - general) alcohol license. A Type 47 CUP has also been requested for a smaller, adjacent 2,150-square-foot “hybrid” restaurant with 86 seats (49 indoor and 37 outdoor.) This will be a “a full-service restaurant, wine bar, and retail store with wine, beer, and food. The primary purpose of the business is to provide sit-down meal service with a heavy concentration on wine service,” reads the staff report for the Wednesday evening Planning Commission meeting The smaller establishment, currently named Seventh Street Café, will feature a retail component that will offer “the sale of wine, beer, and specialty gourmet retail items such as sandwiches, snack foods, and salads” for consumption off site and “is an example of the new hybrid of uses that have provided enhanced dining experiences and retail options for customers.” Ummm. It all sounds good to me. The area around Seventh Street and Arizona Avenue could use excitement and new activity. However, there’s a fly in the cabernet sauvignon and that’s the old bugaboo: parking. Current code requires restaurants to have one parking space for every 75 feet of customer dining area. The total seating for these two projects is 328 customers. Staff reports that the smaller “hybrid” restaurant requires 13 parking spaces which will be on site adjacent to the Telephone Building which has no underground parking. Code says the larger restaurant requires 34 parking spaces — of which eight will be provided on-site and the remaining 26 required parking spaces will be on a private parking lot “across the alley...” Add the employees required for the two operations and it’s obvious that well over 100 parking spaces should be required for the project, not 47. The problem is that the owner of the surface lot “across the alley,” NMS Properties, has plans to develop the site into a seven floor, mixed-use building. However, Phillip Orosco, managing director of Pacshore Partners, LLC (owner of the Telephone Building) assures me that he has signed lease arrangements for adequate parking space for the entire building at many surrounding parking lots including NMS’s site “across the alley” — including the subterranean garage when their new building (on Sixth Street) is built. Between the two eateries plus the needs of all the other building tenants, it’s obvious there should be a couple hundred parking

spots required. Luckily for everyone, it sounds like Orosco has more than met the parking challenge on his own. I asked associate planner Rachel Dimond who is assigned to this application, how a telephone central office-turned-bistro could be considered for a “grandfathered parking allowance” requiring only 34 spaces. She emailed me that the larger restaurant qualifies for a parking credit because “in a commercial zone district … the former use (a telephone exchange) has not been in operation for 12 months. Thus, the (restaurant) project was provided a one space per 300 square foot credit …” No wonder we have parking problems around Downtown. It would appear that once again, the planning department is playing with the numbers in order to encourage new developments that have woefully inadequate parking facilities. REMEMBERING ROGER LATER

I’m sad — and a little late — to report that Roger Dillon Later passed away on Aug. 11, 2013 at the age of 86. Roger was born in Santa Monica on Feb. 4, 1927 and grew up in Santa Monica and Venice. He graduated from Santa Monica High School in 1945 and joined the Navy where he served at weather stations in the Aleutian Islands for a year. After his Naval stint, he returned to Southern California where he attended and graduated from Cal Poly San Luis Obispo with a degree in heating and air conditioning engineering. He started Later Engineering and his firm’s clients included industrial accounts from all over the world as well as locally. He also owned a sister firm that serviced, repaired and maintained heating and air conditioning systems. That business held numerous contracts with the city of Santa Monica over the years. Later enjoyed mentoring young people and was a long-time member of the Santa Monica YMCA. He and his wife of 65 years, Evelyn Carson Later, loved to travel the world together with their five children — Roger, Terence, Angela, Janet and Cyndy. They especially enjoyed hiking and camping. There are 14 grandchildren. A brother, Ralph Later and a sister, Sue Tieman also survive. I’d known Roger for about five years. We would ride the stationary bicycles together early in the morning at the “Y.” Roger had a keen sense of humor and a razor sharp wit. He was a vast storehouse of stories, jokes, anecdotes and reminisces. We enjoyed swapping stories about the nefarious happenings and intrigues at City Hall. Roger always had an interesting and enlightening take on any and all subjects. He was unique, energetic and a joy to be around — a person who was impossible to forget. his insurance company for a year over what it would cost to rebuild his flood-damaged home, then gave up in frustration and tore it down. A week later, the money came through. Simone and Ken Dannecker fixed their flooded home themselves, deciding they couldn’t wait for insurance and government aid as green mold threatened to overrun it. Now, with the work nearly done, they are all but bankrupt — and still can’t afford to elevate the house they fought so hard to stay in. Gigi Liaguno-Dorr needs $2 million to rebuild the bayfront restaurant that was one of the town’s major employers; she has less than a quarter of that and says she has never felt so helpless. For these three families in Union Beach, a blue-collar enclave clinging precariously to the Raritan Bay, full recovery from Superstorm Sandy is still elusive nearly a year after the storm pummeled the state Oct. 29. That’s also true to thousands of others at the Jersey shore; in Ocean County alone, the county planning board estimated 26,000 people were unable to return to their homes as of last month. Michael Drewniak, a spokesman for Gov. Chris Christie, could not estimate how many storm-damaged homes remain unoccupied. Many families are living elsewhere while their homes are being rebuilt, and “a large number” of bungalows and small homes that were destroyed or severely damaged were second homes for people living in their primary residences, he said. The state taxation division said more than 40,000 properties suffered a total of $4.3 billion in lost value from storm damage. Joanne Gwin’s home in Silverton section of Toms River was wrecked by the storm. Her insurance company paid $101,100 on a $250,000 policy, and she is appealing that decision, still living in a rental a year later. “As of today, we are no closer to moving home than we were on Nov. 2, 2012,” she said. “We are paying taxes and insurance on a home we can no longer live in. We are now at a standstill, waiting for the next step. What IS the next step? Does anybody know? We are looking at another Christmas with a tabletop tree in an apartment instead of the 9-foot Christmas tree that has always been our tradition. We want to go home.” To be sure, remarkable progress has been made in recovering from one of the worst storms ever to hit New Jersey and the secondcostliest in the nation’s history at $65 billion, trailing only Hurricane Katrina’s $125 billion cost. Tens of millions of dollars have been spent rebuilding boardwalks and oceanfront attractions crucial to the tourist trade, and thousands of homes have been repaired, either

with the help of government aid or through a mix of private insurance and savings. As of Sept. 30, $5.6 billion in aid had been paid out to New Jersey storm victims, including $3.5 billion from the National Flood Insurance Program and $415 million in FEMA grants to individuals or households. Sutton, who works for a regional sewerage authority, fought with his insurance company for nearly a year over the damage to his Union Beach home. Finally, he gave up in frustration and tore it down. After inking a contract for nearly $10,000 to pay for the tear-down out of his pocket, Sutton and his wife, Sue, watched as heavy equipment smashed it to bits in less than 40 minutes. Sue fought back some tears but held it together as the house came apart. “We cried for weeks,” she said. “We dragged our entire life’s possessions out onto the front lawn and cried as we watched it all get hauled away. After fighting with the insurance company for a year, this is actually progress. An empty lot gives us a place to start rebuilding our lives. A lot of the tears come when no one is around. This is actually a good day. We just want to go home.” A week after they tore the house down, the $68,000 over which Sutton had been battling, and which could have saved his home, was approved by the federal flood program. He’ll use the money to help build a new home. Not far away, the Danneckers fixed their flooded house themselves. Ken is a carpenter and realized mold was moving faster than the bureaucracy of insurance companies and government aid. “Financially, we’re in ruins,” Simone Dannecker said. “We took everything we had in the bank and put it into our house.” She works part time at a bank and spends the equivalent of another part-time job dealing with paperwork for insurance and aid money she’s hopeful will eventually arrive. Doors are the dominant theme of LiagunoDorr’s new restaurant, in rented space about a mile inland from the bayfront business that was annihilated by the storm. She salvaged dozens of doors from destroyed homes in Union Beach, restored them and marked each with the address where it once stood and uses them as wall space and tables for her new eatery. It will cost $2 million to rebuild the restaurant — money she does not have. Business was depressingly slow over the summer. “There’s nobody here, nobody in this town,” she said. “You drive around at night and it’s dark. And so quiet!” Dorr has yet to receive a penny in government assistance despite applying for several programs. She will soon be on her eighth adviser for just one particular grant application. “I have never felt more helpless than I do right now,” she said. “We’re struggling. And I’m not alone. Everybody I know is like this.”

Essential oils are more popular than ever for medicinal and therapeutic purposes as well as in fragrances and flavorings for food and drinks. Typically produced by harvesting and distilling large amounts of various types of plant matter, essential oils are in many cases all-natural and can take the place of synthetic chemicals in many consumer applications. But some wonder whether our fascination with essential oils is so good for the planet, now that their popularity has turned them into big business. “It often takes hundreds of pounds of plant material to make one pound of essential oil,” reports aromatherapist and author Mindy Green of GreenScentsations.com. She adds that it takes 50-60 pounds of eucalyptus to produce one pound of eucalyptus oil, 200-250 pounds of lavender for one pound of lavender oil, 2,000 pounds of cypress for a pound of cypress oil and as many as 10,000 pounds of rose blossoms for one pound of rose oil. Production of these source crops takes place all over the world and is often organized by large multinational corporations with little regard for local economies or ecosystems. “Growing the substantial quantities of plant material needed to produce essential oils results in a monoculture style of farming, with large swaths of land dedicated to a single species,” says Green. “These systems are most efficiently managed by intense mechanization, and irrigation is frequently used for optimal oil production of the plants.” “As global citizens we have not learned how to equitably distribute vital resources like food, and water resources are trending toward a crisis of the future,” adds Green, “so

there are deep ethical concerns about devoting croplands to essential oils destined for use in candles, bath oils, perfumes, or lavish massage and spa purposes.” Green also warns that many essential oils are not produced from sustainable sources. “Some species are at risk, particularly those occupying marginal habitats such as dwindling tropical forests,” she reports, adding that the poverty-stricken in developing countries will harvest and sell whatever they can, in order to put food on their own tables. Cropwatch, a non-profit that keeps tabs on the natural aromatics industry, maintains a list of wild species threatened by the fastgrowing essential oil trade. Of particular concern are essential oils derived from rosewood, sandalwood, amyris, thyme, cedarwood, jatamansi, gentian, wormwood and cinnamon, among others, as they may well be derived from threatened and illegally harvested wild plant stocks. Also, some essential oils must be treated as hazardous if spilled and should be kept out of sewers and local waterways. Mountain Rose Herbs, a leading retailer of essential oils, reports that if its tea tree oil spills, it should be absorbed with inert material and sealed it in a container before disposal at a hazardous waste collection site. Such information is included on the company’s Material Safety Data Sheet for every essential oil and includes information about flammability and chemical composition. Consumers would be well served to check the MSDS for any essential oils they might like-Mountain Rose will supply them to customers by request-to make sure they are using (and disposing of) them correctly. SHUTDOWN FROM PAGE 1 much, or how little, people are personally affected as the shutdown drags on. “It definitely has brought to life what’s going on,” says Pamela Jones, a lawyer from Richmond, Calif., who’s noticing the shutdown’s effects all around her, in closed national parks, disrupted weddings, shuttered restaurants and “life moments and events destroyed.” Jones, 54, a Democrat and fiscal conservative, finds herself torn in the too-much, too-little debate over the federal government, and says the shutdown at least is giving “more information to the common man, so to speak.” Jim Chenye, a former marketing manager in Birmingham, Ala., sees no argument for the importance of government in the shutdown’s rippling effects. “I’m never an advocate of a larger federal government,” says Chenye, 64, a Republican. The shutdown and debt ceiling debate show the government’s broken, Chenye says, but he figures the annoyances of the moment will be long forgotten before people vote in the 2016 elections. Politicians of all stripes are trying to use the shutdown to buttress long-held positions on the role of the federal government. Arguing for an activist government, President Barack Obama talks up the plight of hard-working federal workers and the importance of government loans to farmers and small businesses. He laments the shuttered monuments and locked offices, the benefit checks delayed, the veterans awaiting help, the little kids who’ve “been sent home from the safe places where they learn and grow every single day.” “This is something that is concretely affecting real people,” Obama argues. Republican leaders in Congress say they, too, want to see the government reopened. But there’s a prominent subtext in which many in the party take a far more unforgiving view of the bureaucracy. “People are going to realize they can live with a lot less government,” Rep. Marsha Blackburn, R-Tenn., predicted early on. Polls show people long have been divided

An AP-GfK poll this month found that 60 percent of Americans favor a “smaller government providing fewer services” while 35 percent want a bigger government that does more. A Gallup poll in early September found that 53 percent of Americans thought “the government is trying to do too many things that should be left to individuals and businesses,” while 40 percent said the “government should do more to solve our country’s problems.” As the shutdown continues, a key question is how long people will hold firm to their old positions on the role of government. Republican analyst Rich Galen said people who started out disliking the federal government are likely to look at the shutdown’s effects and say, “See, the world is still spinning on its axis, even with these shutdowns and those 800,000 people furloughed. Apparently we don’t need them. They’re not critical.” But Galen added that every type of government spending “has a champion, and these are services that we are demanding.” “When it’s your house that’s underwater or your house that got blown over by a tornado, boy, do you want FEMA there,” referring to the federal disaster relief agency. William Galston, a former Clinton administration official, agreed that, at least initially, people were apt to see the shutdown through their own ideological prism. But he added, “There is a real world out there. And as the consequences of the shutdown spread, as more and more normal government functions simply are unavailable and as people encounter problems that they didn’t expect, they will perhaps respond differently.” Galston had his own example to cite, noting that a document he needs for research on a paper he’s writing suddenly became unavailable when the Library of Congress took down its website. “I think a lot of people are going to discover that routine functions that they weren’t thinking about are going to be unavailable and the zone of inconvenience is going to expand,” he said.

financial errors and that PYFC owned the mistakes. Earlier this year, de la Torre said he would step down as executive director after the City Council considered defunding the program. “My working in the organization, it has nothing to do with this funding,” he said. “But it’s a decision that the board of directors gets to make. I don’t get to choose. It’s in the hands of the board of director. But, there is an opportunity for staff members to be funded without any city dollars.” Ultimately, council redirected about onethird of PYFC funding to the Cradle to Career initiative. PYFC will be able to access up to $165,000 per year for the next 10 years of the gift. “It’s supposed to be set up as an endowment for the group,” said Bruce Sultan, a Bergmann estate attorney. “There are certain limitations on the amount of money they can take out and it has to be used solely for the benefit of at-risk [youth] and not for any other purpose.” The Santa Barbara Foundation currently holds the funds and will disperse them over the next decade. The annual allowance is not enough to solely cover PYFCs budget, de la Torre said. “It provides a foundation for us to continue our path of relying less on public dollars,” he said. “We are probably the most recent youth serving nonprofit in the grantee menu. We’ve been around and funded by the city of Santa Monica since 2002 so it takes time for organizations to reach a

RISK FROM PAGE 1 Los Angeles officials have known about the dangers for more than 40 years but have failed to force owners to make their properties safer or to compile a list of endangered buildings, according to the Times. Mayor Eric Garcetti’s office says the mayor, who took office just three months ago, is interested in reviewing the newspaper’s findings. A team of scientists led by University of California, Berkeley, professor Jack Moehle has compiled a list of about 1,500 older concrete buildings that scientists conclude could be vulnerable. The team has declined to release the list publicly, however, because of fears of being sued by building owners. Moehle said he would likely give it to city officials if they asked. The Times compiled its own list using

many of the same methods the scientists did. The newspaper had a team of reporters research thousands of city and county records to identify older buildings. The reporters then visited the buildings themselves, checked building permits and interviewed owners to see what if any quake-safety upgrades had been made over the years. The analysis concluded that more than 1,000 structures are at risk, with more than 50 in Los Angeles likely to fall down, putting thousands of people at risk. Los Angeles’ 1971 Sylmar earthquake killed 65 people, injured more than 2,000 and toppled two hospitals constructed of concrete, as well as damaged other buildings. The city’s 1994 Northridge earthquake killed 60 people, injured more than 7,000 and flattened an apartment building and several freeway overpasses, including one that was rebuilt after falling during the 1971 quake. More than 40,000 buildings were damaged across Southern California.
