SAN FRANCISCO Earlier this year, the U.S. Supreme Court rejected Robert Fairbank’s appeal of his death sentence for the 1985 rape and murder of college student Wendy Cheek. With that rejection, Fairbank joined at least 13 other death row inmates who have completed the decades-long capital punishment appeals process and are eligible for execution. Nonetheless, none of the 14 death row inmates who have “exhausted” their appeals will receive a lethal injection any time soon — even though 53 percent of the California electorate reinforced its support of the death penalty with the rejection of Proposition 34 on Nov. 6.

DOWNTOWN L.A. Attorneys for City Hall and the Santa Monica Nativity Scenes Committee are expected to meet in court Monday to hash out whether or not the contested nativity scenes will appear in Palisades Park this winter, as they have for nearly 60 years. Judge Audrey Collins will hear arguments for and against an injunction sought by the committee that would allow displays with only positive seasonal messaging, a move which would effectively ban several signs erected last year that referred to religion as a myth or compared Santa Claus to the devil. If granted, it would prevent City Hall from enforcing a nine-year-old ordinance prohibiting unattended displays in public parks. In June, the City Council voted to close a loophole that had allowed the dioramas depicting 14 scenes from the birth of Jesus Christ to be put up each year. The goal of the injunction is to maintain free speech rights while at the same time protecting the tradition of the displays, attorney William Becker has said. “Everyone’s free to express whatever they want to express, they just don’t have a right to counter a celebration with insults and protests,” Becker said in October. The injunction follows a lawsuit filed in October alleging that the City Council’s decision to end the tradition of the displays outright violated the committee’s free speech rights because the council members did so to avoid controversy rather than out of concerns about the tradition’s constitutionality. Included in the lawsuit are numerous references to testimony from June where each of the council members present — Councilmembers Bobby Shriver and Pam O’Connor were not — expressed concerns about the administration of the lottery system which staff created for the 2011 season when, for the first time in the history of the

Judge backs high-speed rail over farmers

SACRAMENTO, Calif. A judge denied a request Friday from Central Valley farmers who sought to halt work on California’s ambitious high-speed rail project, allowing work on the $68 billion project to continue at an aggressive pace. Sacramento County Superior Court Judge Timothy Frawley denied a request for a preliminary injunction, saying that the agency overseeing the project “acted reasonably and in good faith” in trying to comply with California environmental law. Groups representing Central Valley farmers had hoped to stop the California HighSpeed Rail Authority from all planning and engineering work because of their claims that the authority did not thoroughly weigh the potential environmental harms of the project. Frawley did not rule on the merits of their case, which is expected to be heard this spring, but said he was persuaded that the state generally sought to comply with California’s rigorous environmental laws, and that the potential harm to the state was much greater than the potential harm to farmers along the route. The rail authority’s chairman, Dan Richard, applauded the decision. “Both the voters and the Legislature have spoken on high-speed rail,” he said in a statement. “The judge’s decision ensures that we can continue to move forward with our preparatory work to build the first segment of high-speed rail in the Central Valley, with a plan to break ground next summer.” The initial section will be a 65-mile segment running from Merced to Fresno, in the heart of California’s agricultural industry. In making his ruling Friday, the judge acknowledged that California laws require an understanding of a project’s harm to the environment. Yet he said he did not feel there was sufficient reason to grant farmers a preliminary injunction, since actual construction is not slated to begin until July 2013. The rail authority argued in court that the potential harm to the state for halting the massive transportation project was far greater than the objections of Central Valley farmers and landowners — up to $3.2 billion

The sun has set on the “Twilight” franchise with one last blockbuster opening for the supernatural romance. “The Twilight Saga: Breaking Dawn — Part 2” sucked up $141.3 million domestically over opening weekend and $199.6 million more overseas for a worldwide debut of $340.9 million, according to studio estimates Sunday. The finale ranks eighth on the list of alltime domestic debuts, and leaves “Twilight” with three of the top-10 openings, joining 2009’s “New Moon” (No. 7 with $142.8 million) and last year’s “Breaking Dawn — Part 1” (No. 9 with $138.1 million). Last May’s “The Avengers” is No. 1 with $207.4 million. “Batman” is the only other franchise with more than one top-10 opening: last July’s “The Dark Knight Rises” (No. 3 with $160.9 million) and 2008’s “The Dark Knight” (No. 4 with $158.4 million). Though “Twilight” still is a female-driven franchise, with girls and women making up 79 percent of the opening-weekend audience, the finale drew the biggest male crowds in the series. Action-minded guys had more to root for in the finale as Kristen Stewart, Robert Pattinson and Taylor Lautner join in a colossal battle to end the story of warring vampires and werewolves. “Our male audience particularly has enjoyed this film,” said Richie Fay, head of distribution for Lionsgate, whose Summit Entertainment banner releases the “Twilight” movies. “With the action scenes in this one, we’re hoping the holdover business will reflect the fact that males have kind of found it out.” The movie also helped lift Lionsgate into the big leagues among Hollywood studios. Paced by its $400 million smash with “The Hunger Games” and now the “Twilight” finale, Lionsgate surpassed $1 billion at the domestic box office for the first time. Puzzling response Editor:
I’m puzzled over landlord and developer Jeff Segal complaining once again about someone else’s development project (”SMRR’S betrayal,” Letters to the Editor, Nov. 16). He carps about the loss of affordable housing which, of course, will be replaced one for one at the site. Maybe he’s really concerned about competition with his own projects and real estate holdings. But if he’s truly concerned about affordable housing, he can use his resources to provide it and put his money where his mouth is.

Against the long standing objections of the neighbors, 70 foot poles with high intensity stadium lights have been installed in Malibu. Among the arguments made in favor of permanent lights is that the funding is borne entirely by the Shark Fund. This is false. If one examines the budgets and spending of the SMMUSD as I have, you will note that the soft costs associated with the stadium lighting come in at just under $500,000. These “soft costs” have been borne by all taxpayers in the district. In one especially noxious expenditure a lobbyist was paid very close to $100,000 for her efforts to persuade the Coastal Commission to adopt language permitting the lights. The 2012-2013 SMMUSD budget, (conveniently released after the council’s approval of 70-foot poles for stadium lighting), shows a $2.54 million budget shortfall. This will precipitate cuts across the board. Especially hard hit will be special education. Special education will see a cut of $692,500. Yes, the monies for the stadium lights have already been spent. However, the district is currently still spending with its exhaustive efforts to impede the community efforts to adopt temporary lights. Which special interest group do we have a greater moral obligation to serve? Do we, as a community, have a greater obligation to the 16 young men who play on the varsity football team or to the many students with special needs? In this extraordinary time of fiscal hardship, is this really where our limited dollars should be going? What is true is that we have a moral obligation to educate all students to the best of their abilities. Cutting $692,500 while spending $500,000 is not going to help us meet that obligation.

City Hall has had a policy wherein developers obtain generous construction bonuses including extra height and density over that allowed by current zoning codes in return for providing community benefits such as affordable housing pursuant to a development agreement (DA). The Dorchester House at 1040 Fourth St. is a 1988 condominium building required by terms of its 1982 DA (one of the city’s earliest development agreements) to set aside 15 ground floor units out of a total of 42 units for low and moderate income rental housing which can only be occupied by income-qualifying tenants who lease from unit owners. In January, 2010, local attorney Stanley Epstein discovered that all 15 Dorchester units had been sold repeatedly over the years at market rates and were illegally occupied by owners, or illegally leased to family members and possibly others. There’s evidence that owners assumed City Hall would continue its 25-year history of not enforcing the DA and were ignoring the consequences of living in them, which is eviction. With none of the units appearing to be in compliance with the DA, Epstein brought the situation to the attention of Deputy City Attorney Gary Rhoades. As a result, the City Attorney’s office obtained documents from 11 of the 15 owners alleging that their units were in compliance because their condos were leased to non-related low and/or mid income tenants. It appears that nobody followed up to see if these documents were truthful and if the units were really in compliance. In February 2011, I filed a Freedom of Information Act (FOIA) request concerning proof of compliance which was denied by the City Attorney’s office. Meanwhile, staff repeatedly informed the City Council that the units were in compliance with the DA. One big problem: owners would lose big bucks when they lease their units at low to mid income rates because the rental income would be far less than the total of mortgage payments, home owners association (HOA) dues, repairs, maintenance, taxes, insurance, utilities and other expenses. The sale price for many of these units has been well into the $700,000s. One two-bedroom owner is currently asking $725,000. It defies rational belief that any owner would move out and take losses amounting to thousands of dollars a month in order to lease at less than market rates to non-relatives. And, everyone in City Hall knows this because they have the income and expense numbers. Of the remaining four units, the status of one of them hasn’t been resolved since 1988. In May 2010, City Hall sued Kathy Golshani and a related entity Bilet Properties, LLC. (that collectively owned the three remaining units) to enforce the Dorchester’s DA. Some 27 months later, City Hall entered into a settlement agreement stating the three units owned by Golshani or Bilet Properties
must be designated for rental only to low income persons as called for by the development agreement. Inexplicably, it also provided that "owner occupancy shall be allowed at each of the units ..." What? Isn’t this having your cake and eating it, too! “Owner occupancy” is the operative provision in this agreement and it clearly alters the development agreement on these three units, forever. On top of everything else, City Hall hasn’t even adhered to its own procedure for amending development agreements as required by law. The process of staff reports, public noticing, public meetings and input before the Planning Commission and City Council has been completely ignored. Therefore, a good legal argument will probably be made that the agreement is invalid. Stay tuned for more litigation. Making things worse, the City Council, Planning Department, City Attorney and City Manager have all been parties to the wrongful conduct relating to affordable housing at the Dorchester. In addition, the council never approved the settlement, although, in closed session, it authorized the City Attorney to end legal proceedings against the two defendants. The comedy of errors continues. When Epstein learned of the settlement two weeks ago, he asked if it was approved by the council and if the public had been notified. Last week City Attorney Marsha Moutrie — 11 weeks after the fact — finally disclosed during the City Council meeting only that a settlement had been reached on the Golshani/Bilet units. City Hall’s number one priority is affordable housing. Through bungling, inattention, manipulation, incompetence, fraud and lack of interest, 15 units of existing affordable housing were lost. And, all or substantially all of the 15 deed-restricted Dorchester units are still in violation of the development agreement. Epstein called Santa Monicans for Renters’ Rights (SMRR) in 2010 to enlist SMRR’s help in the fight to save the affordable housing. Co-chair Patricia Hoffman wouldn’t comment and hung up on him. That’s how SMRR protects its socalled “top priority.” Slam down the phone. Nobody seems to care that 15 units of valuable low/mid income housing are being occupied by well-heeled owners instead of the low or mid income families for which they were intended. I’m thinking the reason this was handled so badly was because staff and politicians alike didn’t want owners tossed out of their homes even though there’s ample evidence the owners were well aware their units were deed restricted. Right now, the fumbling of the Dorchester House DA and all the prevarication surrounding it has made City Hall’s “number one priority” a number one fauxpas. drought-tolerant, producing tons of biomass per acre. It thrives even in poor soil and is a self-propagating perennial, so it requires little investment once established. To people in the renewable fuels industry, Arundo donax — also known as “giant reed” — is nothing short of a miracle plant. An Oregon power plant is looking at it as a potential substitute for coal, and North Carolina boosters are salivating over the prospect of an ethanol bio-refinery that would bring millions of dollars in investment and dozens of highpaying jobs to hog country. But to many scientists and environmentalists, Arundo looks less like a miracle than a nightmare waiting to happen. Officials in at least three states have banned the bamboolike grass as a “noxious weed"; California has spent more than $70 million trying to eradicate it. The federal government has labeled it a “high risk” for invasiveness. Many are comparing Arundo, which can reach heights of 30 feet in a single season, to another aggressive Asian transplant — the voracious kudzu vine. More than 200 scientists recently sent a letter to the heads of federal agencies including the Environmental Protection Agency and the Departments of Agriculture and Energy, urging them not to encourage the commercial planting of known invasives like Arundo. “Many of today’s most problematic invasive plants — from kudzu to purple loosestrife — were intentionally imported and released into the environment for horticultural, agricultural, conservation, and forestry purposes,” they wrote Oct. 22. “It is imperative that we learn from our past mistakes by preventing intentional introduction of energy crops that may create the next invasive species catastrophe particularly when introductions are funded by taxpayer dollars.” Mark Conlon, vice president for sector development at the nonprofit Biofuels Center of North Carolina in Oxford, hates the comparison with “the weed that ate the South.” “There’s no market for kudzu,” says Conlon, who is among those promoting a proposed $170 million, 20 million-gallon-ayear ethanol project here — and Arundo’s role in it. “There’s no reason to manage it. It was thrown out in the worst places you can think of and left there.” His message about Arundo: It’ll be different this time. We can control it. But Mark Newhouser, who has spent nearly 20 years hacking this “nasty plant”
from California’s riverbanks and wetlands, has his doubts. “Why take a chance?” he asks. The back wall of the North Carolina biofuels center’s lobby is dominated by a large timeline, beginning with the General Assembly’s 2006 recognition of the state’s potential as a biofuels leader. The display ends with a panel declaring “10% in 10 Years” — meaning that by 2017, a decade after the center’s creation, officials hope companies here will be producing the equivalent of a tenth of the liquid transportation fuels consumed in the state annually, or 600 million gallons of renewable biofuel a year. “An extraordinarily audacious goal,” W. Steven Burke, the center’s president and CEO, says proudly. Near the middle of the timeline is this: “November 2011: 50-acre energy grass propagation nursery established with Arundo donax.” The center’s staff has explored a variety of biofuel raw materials, from food crops like corn, sugar beets and industrial sweet potatoes, to cottonwood and loblolly pine trees. Even pond scum — or duckweed. All were either hard to raise in quantity, too expensive or more valuable for other uses. The staff also studied so-called “energy grasses” — giant Miscanthus, coastal Bermudagrass, switchgrass. Out behind the center, farming director Sam Brake planted test plots of four varieties of sorghum. But for hardiness, ease of cultivation and maintenance, and, above all, yield per acre, none comes even close to Arundo donax. “Wow! Exclamation point,” says Burke, who, in his matching gray suit and shirt and with his snow-white hair and beard, evokes the evangelical preacher. Believed to have sprung from the Indian subcontinent, Arundo has spread around the globe. Europeans have been using it for centuries in the production of reeds for woodwind instruments. Like kudzu, which came to the United States as part of Japan’s exhibit at the 1876 Centennial Exposition in Philadelphia, Arundo arrived here in the mid- to late 19th century. And also like kudzu, Arundo was once touted as a perfect crop to help stem erosion. In California and Texas, farmers, ranchers and government workers enthusiastically planted it along waterways and drainage ditches. Shallow rooted, the canes would break off and move downstream, starting new stands. Arundo has become “naturalized” in 25 warmer-weather states, according to a USDA weed risk analysis released in June.

Indeed, some 31 million American kids participating in the federally supported National School Lunch Program have been getting more whole grains, beans, fruits and vegetables in their diets-whether they like it or not. The change is due to new school meal standards unveiled by the U.S. Department of Agriculture (USDA) last January, per the order of 2010’s Healthy, Hunger-Free Kids Act. The new standards are based on the Institute of Medicine’s science-based recommendations, and are the first upgrade to nutritional standards for school meals since 1995 when low- and no-fat foods were all the rage. The non-profit Environmental Working Group (EWG) believes the new standards represent an important milestone in efforts to improve the dietary habits and health of increasingly obese American kids. “Schools’ misguided reliance on processed foods for speedy, low-labor cost production, industry’s $1.6 billion in child-targeted advertising and a lack of faith in our children’s dietary curiosity [have] created a generation of ‘picky eaters’ with dull palates,” reports the group. “With nearly 17 percent of America’s children now clinically obese and a staggering 32 percent overweight, the time is long past to address the unhealthy food environments our children live in.” The new standards limit calories per meal to 850 for high school meals, 700 for middle school and 650 for elementary and more than double the mandated minimum servings of fruits and vegetables while reducing the sodium, saturated fats and trans fats in school kids’ diets. Whole-grain foods, beans
and dark green and orange vegetables such as broccoli, spinach, carrots and sweet potatoes have replaced things like pizza and French fries as staple items in schools that follow the program. Of course, not everybody likes the changes. Lunch strikes, Facebook protest pages, Twitter campaigns, YouTube parody videos and other means have been utilized coast-to-coast to voice opposition to the healthier meals. Some affected cafeterias blame the new smaller portions and healthier fare for causing as much as a 70 percent drop-off in school lunch program participation since the new standards took effect. Psychologists understand that kids may not come around to new foods right away but will eventually eat them-so the federal government and most participating schools are sticking to their guns. And the USDA says that if a school “encounters significant hardships employing the new calorie requirements, we stand ready to work with them quickly and effectively to remedy the situation with additional flexibilities.” The benefits of the new standards far outweigh the costs. “School meals can help children develop healthy eating habits-or they can prime them for a life of poor health and unnecessary suffering,” says EWG. EWG lauds the new standards for significantly expanding access to and appreciation of nourishing food. Whether they can help shift eating norms across the country remains to be seen, but regardless millions of American kids will likely now get their healthiest meals of the day on a tray in their school cafeterias. PLANT FROM PAGE 5 In banning it, California, Nevada and Texas have said the plant crowds out native species and consumes precious water. The Tennessee Exotic Pest Plant Council lists it as a “Significant Threat.” Virginia officials have labeled it “moderately invasive.” The West Virginia Division of Natural Resources has categorized giant reed as “occasionally invasive.” But that might change if it were to be promoted as a commercial crop, says Elizabeth Byers, a vegetation ecologist with the agency’s wildlife diversity unit. “I certainly wouldn’t want to see any invasive species used as biomass,” she says. “Because they can escape.” North Carolina is keeping an eye on Arundo, but the folks in Oxford say past need not be prologue. Earlier this fall, Chemtex International christened the world’s first commercial-scale cellulosic ethanol plant in the northwest Italian city of Crescentino. Turning inedible biomass into sugars, the company hopes to produce up to 20 million gallons of fuel a year. By mid-2013, Chemtex wants to break ground on a like-sized plant that would employ 67 people in North Carolina. It has set its sights on the little city of Clinton, in the heart of hog country. David Crouse, a soil scientist at North Carolina State University, says energy grass production and the Tar Heel State are “a logical match” — depending on which grass it is. Spread across the state’s coastal plain are about 100,000 acres of so-called sprayfields, onto which industrial farming operations pump millions of gallons of hog and chicken waste per year. In order to comply with federal clean water regulations for runoff of nutrients such as nitrogen, many of those fields are already planted with energy grasses, chiefly coastal Bermudagrass. In terms of yield, Arundo far outpaces the competition — up to 20 dry tons per acre, versus 3 to 6 tons for Bermuda. So planting Arundo would require far less land to supply Chemtex’s fiber needs. The problem is, the fields’ owners also need to worry about absorbing the nitrogen in the manure and the jury is still out as to whether Arundo would be a good fit. “If it’s not, it’s not where we need to be on the swine farms,” Crouse says. Brake and his colleagues in Oxford are trying to figure that out. On a farm a few miles from the biofuels center, a dense patch of what look like anorexic palm trees waves in the light autumn breeze. They tower over the 6-foot2 farming director. Brake planted this quarter-acre plot of Arundo donax in 2010. He’s been applying fertilizer at four different rates — zero to 120 pounds per acre — to gauge the plants’ nutritional needs, as well as their ability to absorb nitrogen. Even in the tightly packed, red-clay soil, they have thrived. Brake steps into the thicket and struggles to wrap his arms around a clump. “It’s about maybe 3 foot in diameter,” he says. So far, yields from North Carolina test plots have averaged from 5.8 dry tons per acre at the Oxford site to just over 11 tons in the sandy loam soils in which most Chemtex suppliers would be planting, though NCSU soil scientist Ron Gehl notes these are not yet “mature stands.” Brake grabs an Arundo stalk and walks until it’s parallel with the ground. Tiny seeds cascade to the ground, clinging to a visitor’s wet shoes. “You afraid of becoming Johnny donaxseed?” he asks with a chuckle. The seeds are sterile, he says reassuringly.

Brake points to a joint on the stalk where a small sprout or “node” peeks out. “Each node is a potential plant,” he explains. “That makes it easy to propagate.” And that’s what gives so many pause. In the 16 years since Arundo was first identified in California’s Sonoma Creek Watershed, Mark Newhouser has developed an attack strategy. First, workers spray the mature cane with herbicide, then move in with the large flail mowers. If that doesn’t do the trick, it’s time for chain saws. “And then you’d still have all of these stumps of cane sticking up everywhere,” he says. “You can’t even walk through there.” The cost: Up to $25,000 per acre. To address such concerns in North Carolina, state agriculture officials teamed up with the biofuels center last year to craft a set of “best management practices” for energy crops. Among them are not planting directly adjacent to streams and irrigation canals, and establishing buffer zones of at least 20 feet around production fields. They are listed as “voluntary.” But anyone wishing to do business with Chemtex would have to sign a contract agreeing to certain ground rules, says executive vice president Paolo Carollo. He points out that a $99 million USDA loan guarantee announced this spring also came with certain mitigation measures. Noting that Chemtex has already made conditional agreements to plant 10,000 acres near Clinton, Carollo points to a factory near Venice, Italy, that, from 1937 to 1962, used Arundo grown on 12,000 nearby acres in the production of fabric, including Rayon. “And they never had issues of spread,” he said in a phone interview from the company’s headquarters in the coastal city of Wilmington. When production ceased, he said, those acres were converted back to pasture land. Attempts to commercialize Arundo donax in other parts of the U.S. have met with limited success. When a company proposed to use Arundo for power generation in Florida, the state Department of Agriculture and Consumer Services drafted regulations requiring permits for plots larger than 2 acres. Although some permits have been issued, the large-scale project that prompted the regulations never materialized. And when Portland General Electric decided to convert a power plant from coal to biomass, Oregon state agriculture officials conducted a risk assessment for Arundo. Last year, the state authorized a 400-acre “control area,” prohibiting plantings within a mile of water bodies and requiring growers to post a $1 million eradication bond. In a statement released last March, the Native Plant Society of Oregon accused the state of understating the risks. It cited research suggesting that Arundo’s sterile seeds might, through “genetic modification,”become fertile. When Chemtex announced its plans for North Carolina, the Environmental Defense Fund and others petitioned the state to have Arundo declared a noxious weed, and to ban it. Officials expect to make a decision by early next year. Federal action could take longer. In January, the EPA gave Arundo preliminary approval under the federal renewable fuel standard program — meaning producers could qualify for valuable carbon credits. When environmental groups complained that the decision was at odds with an executive order aimed at preventing the spread of invasive species, the agency agreed to reevaluate the crop. Without the EPA’s renewable fuels designation, Arundo would be less profitable to grow. And without Arundo in the mix, says Conlon, “I would be greatly concerned” about the Chemtex project — and the state’s grand plans.

The president is in a real bind,” said Charles Ebinger, director of the energy security initiative at the Brookings Institution, a Washington, D.C., nonprofit. “I think the question is what does he want his legacy to be?” Ebinger said that if Obama fully embraced the boom in gas drilling the nation could see “incredible” job gains that could lead to “a re-industrialization of America.” Possibilities like that are tempting to any president, and perhaps even more so in the current economy. “But really embracing this stuff is going to bring him squarely in conflict with some of his environmental supporters. It’s not without some possible peril, particularly if he gets to be seen too cozy with the oil and gas folks,” Ebinger said. Hydraulic fracturing, or fracking, has made it possible to tap into deep reserves of oil and gas but has also raised concerns about pollution. Large volumes of water, along with sand and hazardous chemicals, are injected underground to break rock apart and free the oil and gas.
Environmental groups and some scientists say there hasn’t been enough research on water and air pollution issues. The industry and many federal and state officials say the practice is safe when done properly, and that many rules on air pollution and disclosure of the chemicals used in fracking are being strengthened. The Sierra Club is already trying to slow the gas rush, which began in Texas and has expanded to Pennsylvania, Colorado and other states. It’s started a nationwide “Beyond Natural Gas” campaign to push for more regulation on an industry it describes as “Dirty, Dangerous and Run Amok.” “We need to avoid replacing one set of problems with a new but very different set of problems,” said Michael Brune, the Sierra Club’s executive director, referring to coal and natural gas. Investing in green energy makes more economic and environmental sense, he said. The Sierra Club knows natural gas will be a part of the nation’s energy future.“How much a part is a big fight right now,” Brune said. PENALTY FROM PAGE 1 Lawsuits in federal and state courts have halted executions since January 2006 and it will take months, maybe years, to resolve the litigation. Judges have ordered a halt to executions and lawyers with the state’s attorney general’s office have promised not to pursue any executions until the cases are resolved. Still, a growing number of prosecutors, law enforcement officials and capital punishment proponents are pushing for the quick resumption of execution, citing the defeat of Proposition 34 as a mandate from the voters. They’re calling for an end-run around the legal hang ups, calling for the scrapping of the three-drug lethal injection at the center of the litigation and replacing it with a single-drug execution. Six other states have already abandoned the three-drug process and adopted the single-drug execution. In recent months, Los Angeles County District Attorney Steve Cooley and San Mateo County District Attorney Steve Wagstaffe have formally asked local judges for death warrants for three death row inmates and an order to execute them with a single, lethal dose of pentobarbital, a drug previously used to euthanize animals. But a Los Angeles judge rejected Cooley’s
motion and Wagstaffe is expecting the same treatment in San Mateo Superior Court, conceding his legal maneuver to have Fairbank’s executed soon is more symbolic than realistic. “I am simply trying to get the system moving,” Wagstaffe said. “I’m trying to shake the tree a little bit to get people to pay attention. He does deserve death for what he did to Wendy Cheek.” Fairbank has been on death row since 1989, the other 13 inmates eligible for execution have been there longer, including Stevie Fields who arrived in 1979. Fields was convicted that same year of going on a “oneman crime spree” around the USC campus that included the rape and murder of a student librarian two weeks after his parole from prison on a manslaughter conviction. Others on the list of inmates ready for execution include Michael Morales, who came within hours of his execution for the rape and murder of a teen before a judge blocked it in 2006 because of his lawsuit. Morales alleges the state’s process for administering the three-drug lethal cocktail is so flawed that inmates run the risk of suffering cruel and unusual punishment. In response to a judge’s order prompted by Morales’ lawsuit, prison officials spent nearly $1 million to construct a sparkling new lethal injection facility that looks and feels like a high-tech hospital room, replac-
ing the dark and decades-old gas chamber that was used in the past. They’ve also trained a new team of guards to carry out executions and revised their protocols and say the state is now ready to resume executions. Morales lawyers argue that the state still hasn’t done enough to ensure California’s executions are constitutional. A federal judge plans to hold a hearing on the matter later before making a decision, which could lead to the resumption of executions. But a growing number of death penalty supporters like the Criminal Justice Legal Foundation in Sacramento say Gov. Jerry Brown and lawmakers can hasten executions if they move quickly to change state’s death penalty to a single drug. “The State of Washington carried out an execution six months after adoption of the new method,” said Michael Rushford, president of the foundation, “and California can also.” Rushford also said new laws limiting death penalty appeals and the admittance of more defense attorneys deemed qualified to handle such cases will also speed up the process. McGregor Scott, a former U.S. Attorney in Sacramento and a leader of the campaign against Proposition 34, said death penalty supporters would attempt to put a measure of their own in the 2014 ballot if lawmakers

fail to adopt a one-drug injection for California. “Other states have corrected the same problems, and it is now time for California to do the same,” Scott said in a prepared statement Nov. 7 after Proposition 34 was officially declared a loser. “If the Legislature continues to abandon its responsibility by refusing to implement common-sense reforms then we will put our full support behind a ballot initiative to get the job done in 2014.” On the other side of the debate, supporters of the ballot measure vowed to continue fighting to end capital punishment in California. They said they would support the pending lawsuits and oppose attempts to restart executions with a single drug while working toward another campaign to end the death penalty, either through the Legislature or the ballot box. Proposition 34 campaign officials said that support for the death sentences is eroding in California, noting that 71 percent of the electorate voted to reinstate capital punishment in 1978 compared to the 52 percent who voted against Proposition 34 on election day. “We are going to move forward with the voters,” said Natasha Minsker, an ACLU attorney who managed the Proposition 34 campaign. “Fifty-two percent of the vote is not a mandate.”

City Attorney’s motion to dismiss. It specifically references nearby Beverly Hills which found itself at the wrong end of a lawsuit when it allowed a menorah to be displayed in a local park after banning unattended displays. “The city is a coastal, visitor-serving community with very crowded public spaces, including its parks,” the motion reads. “The City Council has appropriately exercised its legislative discretion to balance use of public spaces and ensure shared usage.” Despite the loss of the displays, religious groups in Santa Monica have proposed an alternative plan to the permanent displays, instead opting to assign two-hour slots to various churches during the month of December so that the Christmas story can be displayed in public, live. The Santa Monica Nativity Scenes Committee is not the only group to find itself restricted by the ordinance. Downtown Santa Monica Inc., formerly Bayside, an organization that manages the Third Street Promenade for City Hall, has had a Christmas tree on the promenade during the holidays for over a decade. That practice may be banned under the ordinance, as would a menorah set up by the Santa Monica Chabad House.

According to testimony by Wendy Pietrzak, a senior administrative analyst with City Hall, staff from the Community and Cultural Services Department spent 245 hours corresponding with applicants for the spaces, conducting the lottery and responding to questions from the public. Amongst the roughly 120 comments and inquiries that staff responded to, “many were hostile and some were threats to their personal safety,” according to Pietrzak’s testimony. The lawsuit also claims that the City Council showed prejudice against the Christian faith for shutting down the event. The City Attorney’s Office filed a motion to dismiss the case outright on Monday, Nov. 12. In that 30-page document, the City Attorney asserts that the plaintiff ’s claims have no basis in fact, and that the argument claiming that the City Council succumbed to the “heckler’s veto” in ending the tradition also held no water. Courts have consistently found that although people are generally free to speak, government has the ability to place restrictions on how and when, according to the

The Hollywood film Promised Land is scheduled for release in December, starring Matt Damon, with a story line about drilling from best-selling novelist Dave Eggers. But even before its release, critics pounced on the fact that some financing for the project came from a company in the United Arab Emirates — a country that stands to lose money if the U.S. gets more of its energy needs at home. Brune agreed that “you have to acknowledge that there are benefits to home-grown energy.” Critics say many states haven’t been tough enough on the industry, which has objected to the idea of national drilling regulations. Some state officials oppose such proposals, too. “Yes, we are concerned,” said Patrick Henderson, energy executive for Pa. Gov. Tom Corbett. “Upwards of 10 federal agencies are seeking to put their proverbial nose under the tent with regard to oil and gas development.” He added that federal intrusion “is a surefire way to impede job growth. We’ll be vigilant of proposed federal rulemakings.” The U.S. Environmental Protection Agency is conducting one major national review of drilling and potential drinking water impacts, but it won’t be finished until 2014. Jack Gerard, president of the American Petroleum Institute, which lobbies for the industry in Washington, is hoping Obama’s campaign rhetoric doesn’t change. “He has evolved on the oil and the gas issue, and today, he gives it a full-throated endorsement in terms of the need to produce it to create jobs, get our economy back on track,” Gerard said in a postelection conference call.

Most experts agree that Obama faces four big choices about the gas boom: whether to back nationwide EPA rules; whether to keep pressuring coal-fired power plants to reduce emissions (which benefits gas as an alternative fuel); whether to allow large-scale exports of liquefied natural gas; and whether to support a national push to use compressed gas in commercial vehicles. One expert in Texas predicted that Obama won’t go to extremes. “I don’t think the administration will do anything to halt development,” said Kenneth Medlock III, a professor at Rice University’s Center for Energy Studies in Houston, adding that there will be “some attempts” to move regulations into federal hands. Medlock expects Obama to keep the pressure on the coal industry, but go slowly on the natural gas export issue. The industry says exports have the potential to be highly profitable, but some members of Congress fear exports will just drive up domestic prices, depriving consumers and other industries of the benefits of cheap natural gas. Others see an opportunity for the president to stake out a middle ground. “A lot of the industry guys are pretty shaken by the anti-fracking movement,” said Michael Shellenberger, president of the Breakthrough Institute, an Oakland nonprofit that promotes new ways to address environmental issues. “That might make them a bit more open to regulatory oversight.” Shellenberger said natural gas could also be a “big opportunity” for Obama as part of a broader campaign to address greenhouse gas emissions. Bears’ Campbell gears up for big stage facing 49ers BJANIE MCCAULEY AP Sports Writer
SAN FRANCISCO When Jay Cutler got hurt last November, the Chicago Bears’ promising season fell apart fast, with no capable backup behind him. The Bears went from 7-3 and looking toward the playoffs to losing five of their final six to finish 8-8 and with no postseason berth. Chicago acquired an insurance policy during the offseason, and now the Bears (72) will see if that move pays off. Jason Campbell is set to make his first NFL start in more than a year in place of the concussed Cutler in a key NFC showdown with the San Francisco 49ers (6-2-1) on Monday night at Candlestick Park. It’s not like Campbell hasn’t been in big games before. He has 70 career starts to his name in eight NFL seasons. “It’s a tough opponent we have Monday night. No one said it was going to be easy,” Campbell said. “So, we’ve got to go there, we’ve got to fight and play together as a unit.” That was something Chicago couldn’t do when Cutler broke his right thumb last fall, with Caleb Hanie playing in his place. The Bears can’t afford a repeat of their late-season demise, and that’s why they brought in Campbell. “We didn’t handle last year well,” coach Lovie Smith said. “Of course, it’s documented we didn’t. That’s why we went out and we felt like we’ve upgraded the position. I know the guys have a lot of confidence in Jason. He’s played a lot of football, started a lot of games, so yeah, we’re hopeful. That’s why we can’t wait to get to this game. Injuries do happen, and we’ll see exactly where we are, but we think we’re going to be OK. Campbell went 10-5 over his last 15 starts with the Oakland Raiders, completing 60.3 percent of his passes with 17 touchdowns, eight interceptions and an 89.6 passer rating. He missed the final 10 games with a broken collarbone, then became a free agent and joined the Bears. San Francisco is fully aware of his resume, and the Niners’ defense doesn’t expect many new looks with Campbell under center. “We’re going to take it as he’s the starter, and we’re going to go out there and do what we’re supposed to do,” 49ers safety Donte Whitner said. “He’s a veteran guy with a big, strong arm. I never felt he got his fair shake in Washington, the guys he had around him, and Oakland, also. Once he got injured, they just shipped him out and brought another guy in. We understand that he can make plays, and we can’t go into this game thinking we have it made and the backup quarterback is in there. “That’s when you get embarrassed.” For San Francisco, all signs point to quar-
terback Alex Smith starting after he also sustained a concussion last week in a 24-24 tie with St. Louis. He was still listed as questionable in Saturday’s formal practice report, and spent the week practicing in a non-contact black jersey. The decision on Smith’s status might not be made until Monday, within hours of kickoff. And Lovie Smith insists all Chicago can do is prepare for the position, not one quarterback or another. Colin Kaepernick is Smith’s backup. This week, 49ers running back Frank Gore was rooting for both starting quarterbacks to get healthy in a hurry. “We want their best, like they want our best,” Gore said. “I know they will want Alex Smith to play. We want Cutler to play.” San Francisco got another scare when coach Jim Harbaugh missed most of Thursday to undergo a minor procedure for an irregular heartbeat. He returned Friday, energized and eager to get back to work. Harbaugh said he spent extra time studying Chicago at home to make up for the halfday he missed. “You’re not here and the rest of the team’s out here practicing, that’s not a good feeling,” he said. “It’s like, I’ve had that dream before many times where it’s like you’re supposed to be taking a test, or the team’s out there practicing and you’re not out there.” San Francisco’s defense knows it must slow down wideout Brandon Marshall, because Campbell will certainly target him with his 67 catches for 904 yards and seven touchdowns. “He’s their best receiver by far,” 49ers defensive coordinator Vic Fangio said. “And I’m sure he’ll be looking for him.” Gore still has memories of Cutler’s fiveinterception day in a 10-6 San Francisco win at home the last time these teams met three years ago — and Gore’s 14-yard touchdown run during a 104-yard night accounted for the lone TD of the game. Plenty has changed since then. “Both teams were down that year, both teams didn’t have a good team. Now, we’re doing good, they’re doing good. It will be a good game,” Gore said. “They’re coming off a loss. We tied. Both teams want to come out on top. Two good teams get to see how it goes on Monday.” For Campbell, getting off to a fast start would be ideal against one of the NFL’s top defenses. Everybody knows it could be a lowscoring night with two teams allowing fewer than 15 points per game. “It’s all about coming out in the first quarter and trying to set a tempo,” Campbell said. “As a quarterback, you got to not try to dictate the game, but do everything you possibly can to get your own rhythm, by not forcing things and everything like that. “But, at the same time, just have fun. You got to let it hang out in a game like this.”

ith a slumping economy, ensuing global conflicts and our own personal dilemmas, a few drinks come as a welcome respite for many. But before you have that extra glass of wine at dinner, make sure you are aware of some new laws and issues that may drastically affect your driving privileges. California has some of the toughest DUI laws in the country, and while no one plans to get arrested for DUI, here are 5 helpful tips to remember if you find yourself at the wrong end of a DUI checkpoint this year.

1) Submitt To o FSTS: When arrested for DUI many people look for a quick and easy way out of it such as refusing to submit the officer's tests.Well, truth be told, this doesn't really work. Refusing to submit to field sobriety tests (FSTS) will almost always earn a year suspension from the DMV regardless what happens with your court case. Refusing to submit to FSTS might weaken the State's evidence against you, but is it worth risking an automatic one year suspension? This includes submitting a breathalyzer test at the scene of the arrest (called a PAS test).A PAS test might not even be admissible in the criminal case, but if you are below a .08 it will save you a ton of hassle…and probably earn a get out of jail free card. Submit to testing and let a skilled lawyer take it from there. Even if the test results appear "bad," by hiring the right attorney there are many legal arguments and challenges that can be made to the manner in which the tests weand administered, your statements, and the results of the tests. 2)) Requestt A Hearing: if arrested for DUI you will receive a temporary driver's license that is good for 30 days before your license is suspended. However, you have the right to request an administrative hearing with the DMV in order to challenge the suspension.This hearing might also yield valuable testimony from the arresting officers that could help you later on when fighting your case in court.Administrative hearings are conducted either in person or telephonically, are far less formal than a court proceeding, and have a lower evidentiary standard of proof required to sustain a suspension.Administrative hearings must be requested within 10 days of arrest, so make sure to act fast if you are arrested.A trained experienced lawyer is also advantageous in order to help navigate through the complexities of the DMV.
3)) Know w The e Penalties: In most Los Angeles County courtrooms a "standard" first time DUI conviction carries with it a $390 fine, 3 month alcohol program, 3 year probation, and mandatory installation of an ignition interlock device (a new 2010 law that L.A. County D.A.'s and C.A.'s are widely enforcing). Typically, prosecutors will not seek jail confinement on a 1st time conviction. In addition to the fines, the court will add on various penalty assessments and fees that could raise your final bill to upwards of $1,750. Depending on the circumstances of your case (under 21, high blood alcohol, refusal) the court could also order you to complete community service, caltrans work, attend AA meetings, and complete a MADD or hospital/morgue program.A first time DUI conviction is priorable, meaning it will be used to enhance punishment on any subsequent DUI in a 10 year period.A second time DUI begets similar punishment with heightened fines and a mandatory minimum of 96 hours (4 days) in jail. Of course, all of these penalties and punishments are subject to change based on varying circumstances, and it should be noted that there are additional restrictions that the DMV can enforce on top of all the court required punishments. 4)) Be e Polite e & Courteous: No matter what crime you are arrested for, be it for DUI or some other offense, dealing with police officers in a calm, respectful, and appropriate manner is always the best approach and will reward you in the end. Officers will note your behavior in their reports, and any belligerent outburst or tirade will likely be used against you as a sign of intoxication and could also earn you additional charges. Of course the opposite is also true meaning if you are calm and collected it could be used as a sign of non-impairment. Even if you didn't do anything wrong always remember that you attract more bees with honey! 5)) Don'tt Drive!: The easiest tip of all...drink to your heart's content and enjoy the holidays, and when you're done take a cab, ride a bus, or call a friend...just don't drive!

■ In October, state alcohol agents, assisted by local police in full riot gear, pointing their weapons, raided a bar in Largo, Fla., to shut down the latest gathering of the venerable Nutz Poker League, even though its players do not wager. (They meet at bars and restaurants, where management gives winners token gifts in exchange for the increased business.) A prosecutor told the Tampa Bay Times that Florida law defines illegal "gambling" as any game that permits players to win something -even if they don't have to "ante up." The raid (during which players were ordered to keep their hands where the officers could see them) came after a months-long undercover investigation. ■ Among the most creative illegal behaviors are those of clever smugglers -- or immigrants trying to enter a country illegally. In September, two Moroccans tried to smuggle a Guinean man into Spain at the Melilla border in north Morocco by disguising him as a Renault car seat. One Moroccan drove, with the passenger perched on a seat in which the foam had been removed to make room for the Guinean. A police spokesman called the attempt "novel."
