Back then the fire department held annual masquerade balls that were the talk of the Los Angeles area. In the early 1900s, Santa Monica casinos and the church groups alike held massive late-night feasts.

SACRAMENTO, Calif. December has been one of the driest months in one of the driest years ever recorded in California, which is spurring some cities and counties in the Sacramento-San Joaquin Delta region to issue water conservation orders earlier than usual. The city of Folsom on Monday imposed a mandatory 20-percent water conservation order, while Sacramento County has also asked residents in unincorporated areas to reduce water use by 20 percent. The cities of Roseville and Sacramento are also likely to consider similar measures in early January, according to the Sacramento Bee (http://bit.ly/JCzjwZ). If no rain falls in the remaining days of 2013, it could rank as the driest calendar year in state history. The northern Sierra Nevada, an area where snowpack is key to the state’s water picture, has received only 10 percent of its average snowfall this month While a drought has not been declared by Gov. Jerry Brown, he has assembled a task force to monitor and advise him on the issue. It would take a series of big storms in 2014 to reduce the threat, leading most water experts to believe a drought declaration imminent. “Even if we pick up with normal weather conditions in January, soil moisture is so low that runoff will be low because the soil will just suck up a lot of that precipitation,” Jeanine Jones, interstate resources manager at the state Department of Water Resources, told the Bee. The issue of low water supply in reservoirs is not only bad news for people, but for fish too. Folsom Lake dropped below 20 percent of its capacity last week, an historic low. That means the U.S. Bureau of Reclamation is planning to reduce water releases from the dam into the American River, which could kill Chinook salmon eggs if the river’s levels drop too low. “From a fishery perspective, it’s a really tough balancing act,” Tom Gohring, executive director of coalition of local water agencies and environmental groups called Water Forum in Sacramento. “It’s not a stretch to say people are on alert.”

As Colorado prepares to be the first in the nation to allow recreational pot sales, opening Jan. 1, hopeful retailers like Williams are investing their fortunes into the legal recreational pot world — all for a chance to build even bigger ones in a fledgling industry that faces an uncertain future. Officials in Colorado and Washington, the other state where recreational pot goes on sale in mid-2014, as well as activists, policymakers and governments from around the U.S. and across the world will not be the only ones watching the experiment unfold. So too will the U.S. Department of Justice, which for now is not fighting to shut down the industries. “We are building an impressive showcase for the world, to show them this is an industry,” Williams says, as the scent of marijuana competes with the smell of sawdust and wet paint in the cavernous store where he hopes to sell pot just like a bottle of wine. Will it be a showcase for a safe, regulated pot industry that generates hundreds of millions of dollars each year and saves money on locking up drug criminals, or one that will prove, once and for all, that the federal government has been right to ban pot since 1937? Cannabis was grown legally in the U.S. for centuries, even by George Washington. After Prohibition’s end in the 1930s, feder-

LOS ANGELES Over the bustling postChristmas weekend, Peter Jackson’s “The Hobbit: The Desolation of Smaug” continued to lead the box office, landing in the No. 1 slot for the third weekend in a row. The Warner Bros. prequel earned $30 million, bringing the domestic gross to $190.3 million, according to studio estimates on Sunday. Disney’s animated adventure, “Frozen,” took the No. 2 position, earning $28.9 million over the weekend and $248.4 million domestically after six weeks at the multiplex. “’Frozen’ probably had the best release date of the year because they positioned
themselves to completely dominate the family film marketplace over the holidays,” said box-office analyst Paul Dergarabedian of Rentrak. “To be No. 2 in its sixth week is a total reflection of that.” Reigning box-office champion “Hobbit,” “really contributed to this record box office that we have at the end of the year,” he added. “With ‘Hobbit’ and ‘Frozen,’ we are talking $450 million at the box office between those two films alone. They are absolutely killing it here at the end of the year.” This year is poised to be a banner one at the box office, and it is projected to surpass 2012’s $10.8 billion by nearly 1 percent, making this the highest annual take ever. awards for the good, bad and downright insegrevious in Santa Monica. Both the Planning Commission and the City Council share the 2013 “No Taste” Sammy for approving the oversized “Orange County business park” for the Paper Mate site on Olympic Boulevard in Mid-City, the two cheap looking Bakersfield-modern hotels at the corner of Fifth Street and Colorado Avenue and a proposed, massive office/hotel/apartment/public plaza complex on Arizona Avenue and Fourth and Fifth Streets, Downtown. The clunky, oversized and completely outof-scale Village at Santa Monica in the Civic Center developed by the Related Companies and co-partnered by City Hall and Community Corporation of Santa Monica wins the 2013 “Ugliest Development of the Year” Sammy, barely nudging out the East Village on the site of the Village Trailer Park and the Bergamot Transit Village Center mess. City officials just opened a new “ecofriendly” parking garage on Second Street, Downtown. The eight-floor, 748-vehicle structure replaced a smaller, obsolete city garage. The layout of the new Structure 6 is spacious and bright. Exterior staircases make it easy to get to and from cars and a rooftop viewing deck provides a great view of Downtown. Studio Jantzen and Behnisch Architekten earn the “Well Done, Mate” Sammy for their stunning design and for proving that exciting projects can happen here. The “Money Grows on Trees” Sammy once again goes to our Planning Department and City Council for the overdone, $46 million, Tongva Park and Ken Genser Square in the Civic Center. A whole $46 million for a park? In the meantime, city officials are now talking about floating a $32 million bond to build a new fire station that will ultimately cost City Hall a total of $81 million. A new fire station is a legitimate need but instead, City officials squandered tens of millions of dollars for costly, unnecessary vanity projects like Tongva Park, the Colorado Esplanade and Michigan Avenue bicycle enhancements. The city manager and City Council must share the 2103 Sammy for “Chutzpah of the Year.” Have you noticed the road crews sandblasting traffic lanes and left turn pocket street markings to oblivion all over town to make room for dedicated bicycle lanes on heavily traveled, major streets? Motor vehicles outnumber bicycles by more than 100 to one on our streets. The removal of the lanes and pockets will cause more congestion and make streets less safe and harder to drive. Through traffic will back up behind persons trying to make leftturns and those waiting to turn left will be vulnerable to rear-end collisions. The 2013 “Need More Congestion” Sammy goes to the Planning Department’s transportation mis-managers — with a special nod to City Council for approving this crap. It’s one more reason to not do business in Santa Monica. The 2013 Sammy for “What Customer

Service?” goes to Big Blue Bus management. Buses on many of BBB’s busiest routes operate at capacity at peak hours and often don’t pick up riders at stops. I’ve experienced this with the No. 3 line on south Lincoln Boulevard numerous times. When I wrote about my experiences last month, Edward F. King, Big Blue’s Director of Transit Services e-mailed that they are constantly working to improve service. “For the upcoming February 2014 service change, we will be shifting more trips to peak direction travel and adding more running time to both the Route 3 and Rapid 3.” We’ll see. It’s been well over a year since the new “blue ribbon” Santa Monica Pier governing board made up of politically connected cronies and ex-city department heads was appointed. We’ve all been waiting for announcements concerning how this elite panel of community leaders is going to rejuvenate the aging Santa Monica Pier. Unfortunately, all they’ve come up with is a bunch of lame entertainment events. So, the 2013 “Dragging Our Heels” Sammy goes to the Santa Monica Pier Corporation. The “You Overstayed Your Welcome” Sammy goes to former, overpaid City Hall consultant Jeffrey Tumlin from NelsonNygaard Consulting Associates (N/N). Tumlin’s take on traffic and planning was from another world which is why he was a big hit with city planners. Tumlin claimed that all the hundreds of thousands of square feet of new development in the Bergamot area would generate “no net new car trips.” He also recommended reducing on-site parking requirements for new commercial and residential developments. Tumlin’s ego was his own undoing when he described Santa Monicans as NIMBYs on his firm’s website last Spring. He posted that NIMBYs dominated local politics and were using fears of increased traffic and congestion to stop development. Despite the brouhaha, Tumlin dug in his heels and Planning Director David Martin stood by his man. Eventually Tumlin was forced to withdraw as N/N’s lead consultant even though his firm soldiers on. The “Just Do It” Sammy for 2013 goes to the Beautify Lincoln (Boulevard) group and Evan Meyer, a board member for the Ocean Park Neighborhood Association. They’re spearheading a grassroots streetscape beautification project primarily through murals and street art. Evan and his team work with commercial businesses and property owners by offering to beautify local businesses for free. They coordinate wall space with artists, obtain the paint and supplies, assist in the painting and get the work done — all on a shoestring budget. I wrote last June that City Hall has been conspicuously absent from this project which is why it’s working so darned well and hasn’t cost $46 million. Happy New Year, everyone.

LOS ANGELES California regulators have allowed hundreds of toxic waste polluters walk away from contaminated sites and dozens of waste facilities to operate with expired permits while reducing enforcement, it was reported Friday. The Department of Toxic Substances Control also has drastically reduced fines against polluting firms and reduced the number of cases it sends to prosecutors, the Los Angeles Times said, citing interviews and records from courts, the department and other agencies. The department is responsible for regulating more than 100,000 businesses that generate hazardous waste in the state. However, the Times review concluded that: — A quarter of California’s 118 major hazardous waste facilities are operating on expired permits. — Hundreds of companies have walked away from contaminated sites, leaving the cleanup costs to taxpayers. The department has acknowledged that it did not even try to collect $140 million in such costs from 1987 through last year, although it has now recovered about $16 million under a new billing procedure. — The department has drastically reduced its use of fines in recent years. Companies agreed to pay a total of $2.45 million a year on average from 2008 to 2012 — half the average of the previous five years. — The department has sharply reduced the number of cases it submits to prosecutors for possible criminal charges — an average of four per year in the past five years compared to more than 40 a year in the previous five years. Problems have been blamed on staff cuts, inconsistent standards for regulations and enforcement, high turnover at the top; it’s had seven directors in 10 years. Department Director Debbie Raphael declined to be interviewed for the Times story, but she has previously said the agency is working to correct inherited issues. “We are committed to owning up to the problems and taking the steps necessary to ensuring they are fixed once and for all,” she said in a statement posted on the agency’s website. Two cases illustrate the department’s
sluggish response: In 1992, nitric acid leaked from a tank at Electro-Forming Co., a metal plating company in the San Francisco Bay Area city of Richmond, and created a toxic cloud that reached nearby homes. “People were coughing. They were gasping for air,” recalled Denny Larson, who went to the scene. More than 125 people were taken to hospitals. More than 20 years later, a study that the department ordered to determine the extent of contamination from the site still has not been completed. In Southern California, public outcry recently arose over Exide Technologies, a battery recycler in the southern Los Angeles suburb of Vernon. The plant has been smelting the lead in batteries for decades with a temporary permit that was only intended to give it time to meet legal standards for disposing of toxic materials, the Times said. In March, the South Coast Air Quality Management District reported that arsenic emissions created an elevated risk of cancer for as many as 110,000 people. The state finally tried to suspend the plant’s operations, but a judge this summer allowed operations to resume. Earlier this year, Exide agreed to set aside $7.7 million to pay for new filters to lower its emissions. In return, the state dropped efforts to shutter the plant, although the air quality district still is seeking to close the plant until its air pollution control systems are improved. “The department has unfortunately had a long history of constant turnover and uncertain standards — a situation that has left permittees frustrated with frequently shifting oversight, guidance, requirements and deadlines,” said Bud Desart, a senior director of Exide’s recycling group. However, Exide officials are now working to obtain a permanent permit, he said. Raphael has called the department’s record on Exide “an embarrassment.” “There is a systemic problem with enforcement of regulations to protect the public,” said state Sen. Kevin de Leon, DLos Angeles, whose district includes Vernon. “It’s the agency’s main responsibility to ensure that these facilities pose no harm, and the reality is, that is not happening.”

SO-CALLED DARK FACTORIES-OTHERWISE
known as “lights out” or “automatic” factories-are manufacturing facilities that do not depend on human labor to get work done. While they may have some benefits for the environment they are certainly not beneficial overall considering the impact widespread adoption would have on needed jobs. Without human line workers, such factories can operate without lights, heating and cooling and other “amenities” required by human workers. Of course, very few such facilities are completely automated, as human workers are usually required to set up equipment or remove completed parts. And some run “lights-out” between human labor shifts or as separate shifts to meet increasing demand or save money. And while the up-front costs of setting up automated work routines manned by robots and other machines may be higher than setting up a traditional factory, on-going expenses can be significantly less given the lack of human payroll and other humancentric outlays. The first dark factories started appearing in Japan in the 1980s as companies there started to take advantage of improvements in the technology of robotics and automation to get around the high costs of human labor. At that time, business analysts predicted then that as technology improved and qualified workers became harder to find and more expensive to support, dark factories would become more prevalent around the world. But in the interim the spread of manufacturing to developing nations with cheap human labor may have temporarily forestalled the rise of dark factories. Also, General Motors’ unsuccessful implementation of automated manufacturing in the 1980s-quality declined and sales fell accordingly-soured many big companies on the concept back then. That said, there are many thriving examples of dark factories around the world. Many machine shops in the U.S. run “unattended” all or part of the time. Robots are commonplace now in the auto industry despite GM’s faltering early on. Amazon.com makes extensive use of robotic systems in its distribution centers and last year even acquired the company behind the technology, Kiva Systems, for $775 million in cash. In Japan, FANUC Robotics operates a lights-out factory employing robots to make other robots. Japanese camera giant

Canon recently announced that it is phasing out human workers at several camera factories by 2015. And in the Netherlands, Philips produces electric razors in a facility with 128 robots and nine human quality assurance workers. While widespread adoption, lights-out manufacturing could deliver substantial energy savings and thus be environmentally beneficial, but analysts wonder whether replacing human laborers with computers, machines and robots is a good thing for humanity overall. Pro-gas interests decry NY’s inaction on fracking MARY ESCH Associated Press
ALBANY, N.Y. Born of the energy crisis of the 1970s, gas driller Lenape Resources flourished in western New York for more than three decades — until the revolutionary technology that sparked the nation’s shale gas boom brought the industry to a screeching halt in New York under a moratorium now in its sixth year. Today, Lenape has just five employees, down from 100 in years past. “Those five, we’re trying to give them work in Pennsylvania,” said John Holko, the company’s president. “We’re not going to be here much longer.” As another year closes with a moratorium on hydraulic fracturing for natural gas in New York and no timetable for Gov. Andrew Cuomo to decide whether to lift it, drilling interests have all but given up on the state, and environmental groups are pressing for a permanent ban. Advancements in horizontal drilling and fracking — which releases gas from rock by injecting a well with a mix of water, sand and chemicals at high pressure — have yielded so much gas from the Marcellus Shale underlying much of the Mid-Atlantic region that gas prices have plummeted. As a result, the less productive vertical wells still allowed in New York are no longer in demand, Holko said. While other states have allowed shale development even as they scramble to draft regulations, New York has had deep shale drilling on hold since it started developing new rules in 2008. Amid intense pressure from anti-fracking groups, Cuomo has said he wants his health and environmental commissioners to take all the time they need to decide whether fracking can be done safely. Critics of fracking cite potential air and water contamination and disruptive industrial activity near population centers, while supporters say state regulations mitigate the risks. At the same time, dozens of towns have enacted their own bans or moratoriums in case the state does approve fracking — although most are outside the region along the Pennsylvania border considered most profitable for gas exploration. Some drilling proponents, including industry and landowners hoping to profit from leases, are putting up a fight in state courts over town bans and the state’s stalled regulations. The state’s highest court will decide this spring whether two town bans, in Dryden and Middlefield, are legal. Norse Energy, the Norway-based company fighting the Dryden ban, is in the final
stages of bankruptcy liquidation, having invested all its resources in New York leases it has been unable to develop. The company is now suing the state over its ban. Membership in the Independent Oil and Gas Association of New York has dropped by about 20 percent in the past year, said Brad Gill, its president. “Numerous service companies have set up shop across the border in Pennsylvania,” Gill said. “We’ll never get those jobs back.” Holko was working for an oil and gas services company in the early ‘70s when the energy crisis hit and state and federal subsidies were poured into new technologies to tap unconventional fossil fuel deposits like shale and sandstone. He worked on some experimental Marcellus Shale wells funded by the state. “That was the start of the shale revolution,” Holko said. “It’s just taken a long time for the industry to apply the proper technology to make it happen.” Even if Cuomo green-lights drilling, Gill said, the industry is wary of investing in New York because of what he calls regulatory and legislative hostility. “The cost of regulatory compliance could be up to $1 million more per well than in Pennsylvania,” Gill said. While companies can seek their fortune elsewhere, pro-drilling landowners won’t see any lease-signing bonuses or royalty checks if Cuomo decides against shale gas development, said Victor Furman, who heads a landowner coalition in Chenango County. “The delay isn’t hurting me financially,” said Furman, a retired technical writer for IBM. “But I know as a coalition leader that there are landowners who have lost homes that could have been saved if Cuomo had moved forward” with gas development. But many landowners want Cuomo to ban shale gas development. “We initially leased our farm back in 2006, before we’d ever heard of fracking,” said Kathie Arnold, an organic dairy farmer and former Cortland County legislator. The lease expired during the state’s moratorium, to Arnold’s relief. “A lot of farmers think this can be done safely, but I don’t think the science supports that it can truly be done safely for the people that are here now and for future generations,” Arnold said, citing potential air and water pollution, heavy truck traffic on rural roads, and potential contamination from well casing failures decades in the future. “There’s something very wrong with the economics of farming if you have to mine your mineral resources to survive,” Arnold said. “That’s just not a sustainable way to keep your farm.”

POT FROM PAGE 3 al authorities turned their sights on pot. The 1936 propaganda film “Reefer Madness” warned the public about a plant capable of turning people into mindless criminals. Over the years, pot activists and state governments managed to chip away at the ban, their first big victory coming in 1996 when California allowed medical marijuana. Today, 19 other states, including Colorado and Washington, and the District of Columbia have similar laws. Those in the business were nervous, fearing that federal agents would raid their shops. “It was scary,” recalls Williams, who along with his brother borrowed some $630,000 from parents and relatives to open Medicine Man in 2009. “I literally had dreams multiple times a week where I was in prison and couldn’t see my wife or my child. Lot of sleepless nights.” That same year, the Justice Department told federal prosecutors they should not focus investigative resources on patients and caregivers complying with state medical marijuana laws — but the department reserved the right to step in if there was abuse. In Colorado, the industry took off. Shops advertised on billboards and radio. Potgrowing warehouses along Interstate 70 in Denver grew so big that motorists started calling one stretch the “Green Zone” for its frequent skunky odor of pot. The city at one point had more marijuana dispensaries than Starbucks coffee shops, with some neighborhoods crowded with dispensary sign-wavers and banners offering free joints for new customers. Local officials
have since ratcheted back such in-your-face ads. But the marijuana movement didn’t stop. Voters in Colorado and Washington approved recreational pot in 2012, sold in part on spending less to lock up drug criminals and the potential for new tax dollars to fund state programs. The votes raised new questions about whether the federal government would sue to block laws flouting federal drug law. Colorado Gov. John Hickenlooper famously warned residents not to “break out the Cheetos or Goldfish too quickly,” and activists predicated a legal showdown. That didn’t happen. In August, the DOJ said it wouldn’t sue so long as the states met an eight-point standard that includes keeping pot out of other states and away from children, criminal cartels and federal property. Colorado law allows adults 21 and older to buy pot at state-sanctioned pot retail stories, and state regulations forbid businesses from advertising in places where children are likely see their pitches. Only existing medical dispensaries were allowed to apply for licenses, an effort to prevent another proliferation of pot shops. Only a few dozen shops statewide are expected to be open for recreational sales on New Year’s Day. Legal pot’s potential has spawned businesses beyond retail shops. Marijuana-testing companies have popped up, checking regulated weed for potency and screening for harmful molds. Gardening courses charge hundreds to show people how to grow weed at home. Tourism companies take curious tourists to glass-blowing shops where elaborate smoking pipes are made. One has clients willing to spend up to $10,000 for a
week in a luxury ski resort and a private concierge to show them the state’s pot industry. Dixie Elixirs & Edibles, maker of potinfused foods and drinks, is making new labels for the recreational market and expanding production on everything from crispy rice treats to fruit lozenges. “The genie is out of the bottle,” says company president Tripp Keber. “I think it’s going to be an exciting time over the next 24 to 48 months.” It’s easy to see why the industry is attracting so many people. A Colorado State University study estimates the state will ring up $606 million in sales next year, and the market will grow from 105,000 medical pot users to 643,000 adult users overnight — and that’s not counting tourists. Toni Fox, owner of 3D Cannabis Center in Denver, anticipates shoppers camping overnight to await her first-day 8 a.m. opening. She’s thinking of using airportsecurity-line-style ropes to corral shoppers, and suspects she’s going to run out of pot. A longtime marijuana legalization advocate, she knows it’s a crucial moment for the movement. “We have to show that this can work,” she says. “It has to.” The challenges, activists and regulators say, are daunting in Colorado and Washington. One of the biggest questions is whether they have built an industry that will not only draw in tens of millions of dollars in revenue but also make a significant dent in the illegal market. Another is whether the regulatory system is up to the task of controlling a drug that’s never been regulated. There are public health and law enforcement concerns, including whether

wide availability of a drug with a generations-old stigma of ruining lives will lead to more underage drug use, more cases of driving while high and more crime. As state officials watch for signs of trouble, they will also have to make sure they don’t run afoul of the DOJ’s conditions. To stop the drug from getting smuggled out of state, regulators in both states are using a radio-frequency surveillance system developed to track pot from the greenhouses to the stores and have set low purchasing limits for non-residents. Officials concede that there’s little they can do to prevent marijuana from ending up in suitcases on the next flight out. The sheriff in the Colorado county where Aspen is located has suggested placing an “amnesty box” at the city’s small airport to encourage visitors to drop off their extra bud. To prevent the criminal element from getting a foothold, regulators have enacted residency requirements for business owners, banned out-of-state investment and run background checks on every applicant for a license to sell or grow the plant. Whether the systems are enough is anyone’s guess. For now, all the focus is on 2014. This being Colorado, there will be more than a few joints lit up on New Year’s Eve. Pot fans plan to don 1920s-era attire for a “Prohibition Is Over!” party and take turns using concentrated pot inside the “dab bus.” Williams says he’s done everything he can, including hiring seven additional staffers to handle customers. All he has to do is open the doors. “Are we ready to go? Yes,” he says. “What’s going to happen? I don’t know.”

148,000 residents, what’s missing is political clout. As Latinos surpass whites as California’s largest racial or ethnic group early next year, more are getting elected to public office, including the mayors of Los Angeles and Sacramento, members of Congress, lieutenant governors and leaders of the state Legislature. Not so in Escondido — Spanish for “Hidden.” It is among a smattering of cities with large Latino populations that have eluded their grasp. The north San Diego suburb elected its first Hispanic to its City Council in its 125year history in 2008, not counting a oneterm member in the 1990s, Elmer Cameron, who played down his Mexican ancestry. Councilwoman Olga Diaz, the daughter of Mexican immigrants who learned English as a second language, is running for mayor next year in the first elections with district, instead of at-large, voting to the council. Escondido adopted district voting after getting sued under the California Voting Rights Act for its poor record of electing Latinos. Other cities — Modesto, Anaheim, Compton, Palmdale, Whittier — have faced similar challenges. Escondido’s doughnut hole, also called “the urban core,” makes up District 1, whose citizen voting-age population is slightly more than 50 percent Latino and is seen as more likely to elect one of its own. Arturo Vargas, executive director of the National Association of Latino Elected and Appointed Officials, rattled off the names of California cities that have elected Latinos to local office and noted that Hispanics occupy 27 of 120 seats in the state Legislature, up from seven in 1984. Yet Latinos are disproportionately ineligible to vote because they are either too young or are not U.S. citizens, Vargas said. Cities with large and growing Latino populations often have another majority group that is uncomfortable with changing demograph-
We have you covered ics, he said. Latinos make up 33 percent of the state’s adult population but only 17 percent of likely voters, according to the Public Policy Institute of California. They tend to be young, less educated, less affluent and lean Democratic. Whites comprise 44 percent of the adult population but 62 percent of likely voters. Jose Fragozo, who moved to the San Diego area from the Mexican border city of Mexicali when he was 12, credited the Escondido Union School District’s change to district voting for winning a seat on the school board in 2012 after two losses. He raised only $3,000 and knocked on every door in his downtown district, where signs at strip malls and churches mix English and Spanish and some quiet residential streets lack sidewalks and street lights. “I could finally afford to send a mailer and go door to door,” said Fragozo, 48, echoing a common argument for supporters of district elections. Councilwoman Diaz, 37, first ran for her seat in 2006, outraged by an ordinance that required landlords to check the immigration status of their tenants. She stepped to the microphone during a heated council meeting to tell leaders they were “nuts” and “either incompetent or malicious.” A federal judge later blocked the ordinance before it took effect. Diaz, a Democrat in a solidly Republican city, lost but won two years later, aided by higher name recognition, enthusiasm for Barack Obama’s presidential run and a visible presence as owner of two coffee shops. “They knew me well enough to know that I’m not a scary person,” said Diaz, who is married to a white Escondido police lieutenant but kept her maiden name. Diaz, who was easily re-elected last year, is often on the losing end of 4-1 votes and has failed to get any support for proposals such as sprucing up a barren flood control basin that crosses Latino neighborhoods and waiving home-remodeling permit fees for veterans. Latinos made up 48.9 percent of Escondido’s population in 2012 but relations remain strained with city leaders.

So plentiful, in fact, that the Santa Monica Police Department will be out in larger numbers, said Lt. Richard Lewis. He urged the public not to drink and drive or shoot guns into the air. Lewis wouldn’t say where specifically the force would be beefed up but said it would likely be in “areas around the city that serve alcohol and that are publicizing New Year’s Eve parties.” SMPD will have their hands full because the city is full of such parties. The Convention and Visitors Bureau (CVB) website, SantaMonica.com, has dozens of options posted. Prices for the events range wildly, from the cover charge-less DJ set with free midnight champagne at the Daily Pint to the $275 per person second seating at Melisse, which includes Maine lobster, lamb loin and caviar. While most restaurants are thankful that prohibition is over, Areal is heading back there with a Roaring ‘20s themed party. First seating costs $55 and the second $95. The Viceroy Hotel’s black and white ball will set you back $175 and include Asian rice bowls and KCRW DJs. The CVB doesn’t keep stats on New Year’s Eve business, but a representative said that they’ve heard the hotels are pretty full this year. Not everyone goes out to the bars and restaurants to ring in the new year, however.

Kimber Maderazzo, of Santa Monica, is throwing a themed party at her place for the fifth year in a row. While the rest of the world moves into 2014, her party will go in the other direction. “This year it’s an ‘80s dance party,” she said. “Hopefully this one’s the best theme yet.” Local activist Jerry Rubin threw big New Year’s Eve parties for about 30 years, he said, but a few years ago he and his wife decided to give it a rest. “I’m probably planning staying up to 10 minutes after midnight, watch that ball come down, feed our pussycats, and hit the hay,” he said. Ripta Pasay isn’t sure what his plans are yet. He’s new to Santa Monica and is going to play it by ear. Charles Davis, who was waiting for a bus on Santa Monica Boulevard, said he’s going to DJ a house party at an undisclosed address nearby. SAN FRANCISCO The Oakland A’s yearslong quest for a new home is really a tale of three cities. Oakland is desperately trying to keep the team from moving out of a city already struggling with crime, financial woes and blow after blow to its public image. Oakland Mayor Jean Quan has made retention of the A’s a focal point of her re-election campaign. To the south in the heart of booming Silicon Valley, San Jose is seeking to bolster its profile and treasury with an aggressive campaign to win the A’s, including a legal challenge to Major League Baseball’s sacrosanct antitrust exemption that the mayor vows to take to the U.S. Supreme Court if necessary. Standing in the way are San Francisco’s Giants, who claim the lucrative Silicon Valley commercial market as their exclusive territory. And so far, the Giants are winning. On Nov. 25, the A’s announced the signing of a two-year lease to play in O.co Coliseum through the 2015 season. And court documents recently filed revealed that MLB Commissioner Bud Selig informed the A’s this summer that the league had rejected the team’s proposed move to San Jose. In court on Dec. 13, U.S. District Court Judge Ronald Whyte in San Jose asked MLB lawyer John Keker if the letter was an “unequivocal” denial. “What the A’s asked the commissioner to approve was unequivocally denied,” Keker replied. Selig’s letter itself wasn’t included in the court filing and no reason was disclosed for the rejection — though San Jose strongly suspects the league is acquiescing to the Giants commercial interests. The commissioner’s letter does not preclude the A’s ownership from resubmitting a new application for a move to San Jose. And the A’s still want to move from the Coliseum because of its state of disrepair and the fact that it shares the stadium — and revenues — with the Oakland Raiders of the NFL. In September, A’s players reported foul smells from the bathroom end of their dugout. That came after a June incident in which a clogged pipe caused a sewage backup and flooding on the bottom floor of the ballpark that sent the Seattle Mariners and A’s scrambling around in towels and heading
for higher ground in the Raiders’ locker room. After a hazmat crew inspected the affected areas, new carpeting was installed and other extensive repairs were made to the visiting clubhouse. Calling the Coliseum “a pit,” Selig has acknowledged the A’s need a new stadium, but has stopped short of naming or advocating a location. Historically, landing professional teams has done little to improve the winning city’s bottom line, says Nathaniel Grow, a University of Georgia law school professor and expert in the field of sports business. “The economics are usually overstated,” Grow said. “But there is an intangible civic pride element that national exposure brings with professional sports teams.” Nonetheless, San Jose and Oakland want the A’s. “If it wasn’t for the Giants, the A’s would be playing in San Jose,” said San Jose Mayor Chuck Reed, who figures the A’s will generate $5 million in tax revenues annually while bolstering the city’s civic pride. “It certainly would have a dramatic impact on our downtown.” The Giants have declined to discuss their role in the A’s proposed move to San Jose. But MLB says that the city is part of the Giants’ marketing territory which the league is able to protect through an antitrust exemption granted in 1922 by Congress. During San Jose’s five-year pursuit of the A’s, the team’s owners have been receptive. A’s Managing Partner Lew Wolff has even paid $100,000 for an option to buy six parcels of land in downtown San Jose from the city for $7 million to build a stadium near the home of the NHL’s San Jose Sharks. But frustrated with MLB’s apparent inaction on the A’s proposal to move to Silicon Valley, San Jose filed a federal lawsuit on June 18 seeking to invalidate the antitrust exemption and pave the way for the A’s to move there. Meantime, Oakland’s mayor is not letting the A’s leave without a fight. Quan says the city has at least two sites the A’s can use to build a new stadium or the current stadium can be repaired and remodeled to the A’s satisfaction. Quan said she believes the A’s will have difficulty moving to San Jose because of the Giants’ territorial rights. “The odds of them leaving have never been particularly good,” Quan said.

The citation read, "Failure of driver ... to keep right." The station's meteorologist noted that winds that day were gusting to 40 mph and that the woman might simply have been trying to control her car.
