School of Law
Law, whether as a discipline or a profession, is in a state of flux. While there are those who see only uncertainty underlying this change, we here at the SMU School of Law see opportunities. Whether the focus is on the harmonisation of Asia’s commercial laws, or the legal implications of the Internet of Things, smart contracts, or the liberalisation of Singapore’s legal sector, you can find our faculty providing thought leadership. The SMU School of Law has a stable of carefully curated programmes aimed at nurturing intellectual curiosity and creativity, while at the same time meeting the demands and standards set at international and leading law firms. It offers two qualifying degrees (the LLB and the JD programmes), a selective taught LLM with a corporate and commercial bent, and a popularly subscribed professional educational seminar series through the SMU Law Academy. It is no secret that Singapore’s openness to ideas includes receptiveness to legal innovations from beyond: many of our laws take inspiration from North America, North and South Europe, East Asia, and Down Under. This is also true of our faculty: they are drawn from these jurisdictions and more. Our distinguished faculty are educated at such reputable universities as Oxford, Cambridge and Harvard, just to name a few. Our research agenda and publications are equally top class. The SMU School of Law prides itself as being a different “U”, and indeed, once you’ve been here, you leave a different “U”. Recruiting partners often say our graduates are distinct in that they are technically capable and socially engaged. There is no denying our mooting prowess, or our success on the world stage. We see ourselves as not only facilitating our graduates’ entry into the market but also unlocking their potential to give back to society. With an alumni network numbering more than a thousand and growing steadily, current students truly benefit from networking and job opportunities. This year, the SMU School of Law marks its foray into its second decade. While we celebrate the many happy memories and events that mark our growing maturity, our eyes are firmly fixed on the next ten years, as we realise our vision of a dynamic and forward-looking Asian law school whose faculty and students will make a meaningful impact on the law, the legal profession, and the community, through their research and professional training.

HISTORY OF THE SCHOOL OF LAW
The SMU School of Law traces its origins to 2000 as a Law Department within the Lee Kong Chian School of Business.

Formally established in 2007, the School proudly welcomed its first batch of Bachelor of Laws (LLB) students. Commencing the LLB programme with an initial intake of 107 students, the School progressively increased its annual intake to 180 students.
The School expanded its degree offering and welcomed its first intake of Juris Doctor (JD) programme students in 2009, and Master of Laws (LLM) programme students in 2012.

The SMU School of Law has achieved numerous milestones in its first decade under the leadership of its founding Dean, Professor Michael Furmston, and its second Dean, Professor Yeo Tiong Min SC (Hon), who succeeded in 2012. Associate Professor Goh Yihan, who assumed the position of deanship in 2017, is the youngest person to have been appointed a dean at SMU. The School celebrated its 10th anniversary in 2017, a year made more exciting by the completion and opening of its new building and the Kwa Geok Choo Law Library.

LONG-TERM VISION AND MISSION The SMU School of Law strives to be a law school that anticipates and embraces change in a rapidly evolving world, without losing sight of the moral imperatives, the need for integrity, and the essential role the noble legal profession plays in society. Our mission is to profess the nobility of the law while equipping our students to deal with possible legal futures.
I N N OV ATIVE AND PR ACTIC E- REL EVA N T L EGAL T RA I N I N G As the SMU School of Law embarks on its next decade of legal education, it will continue to enhance the breadth and depth of the curriculum, build on its expertise and experience to develop the skills-set to produce practice-ready law graduates and provide continuous legal training, against the backdrop of an increasingly challenging environment resulting from globalisation and the advent of disruptive technologies. In addition to imparting the rigours of the law in the books and the law in context, we will imbue in our students a sense of calling for their future vocation by sensitising them to the role of law in society and how law impacts real people and real lives. As law is ubiquitous and impacts its subjects profoundly, the human touch cannot be neglected. Our students must understand and empathise with the human condition, and leave with an aspiration to harness the law in that noble way to mend relationships and seek out truth, justice and fairness.
M E A N I NG F ULLY IMPACTF U L RESEARCH Dedicated to the pursuit of knowledge, the SMU School of Law’s research agenda is to provide thought leadership on emerging areas of the law in a manner that is both forward-looking and transnational. The main areas of focus are Law and Technology, Transnational Commercial Law in Asia and Dispute Resolution. We study and teach the law in all its contexts, while never forgetting its role as the glue that keeps society and the economy together. We recognise the differences and build on them.
S E R V I CE TO CO MMUNITY In its pursuit of excellence, the SMU School of Law remains mindful of the importance of collegiality, compassion and service to the community through public interest and pro bono work.

CITY CAMPUS
Purpose-built on over 45,000 square metres of prime Singapore land, SMU’s campus is designed, integrated and constructed in the heart of a fully developed cityscape. Surrounded by museums, theatres, cafés, restaurants and a range of retail outlets, it is designed for the new millennium while remaining connected to the historical origins of this important district. The location of the SMU School of Law near the courts, Parliament, and the Central Business District presents a unique proposition for learning the law in context. It gives our students the opportunities to experience first-hand how laws are created, how legal disputes are adjudicated,
and how laws affect businesses. Judges and practitioners frequently share their experiences with our students and even teach full courses. This proximity also allows the School to better engage the legal profession by offering courses through the SMU Law Academy. In 2017, the SMU School of Law moved into its new state of the art building. A key feature of the new building is the Kwa Geok Choo Law Library, named in memory of the late Madam Kwa Geok Choo (wife of the late former Prime Minister Lee Kuan Yew). The new building also houses the David Marshall Moot Court, the Pro Bono Centre supported by the RHT Rajan Menon Foundation, and other research centres.

RESEARCH Research at the SMU School of Law has a strong focus in three main inter-related areas (Law and Technology, Transnational Commercial Law in Asia and Dispute Resolution) which are in turn supported by the School’s nine Research Clusters, Research Centres and the Kwa Geok Choo Law Library. The Faculty are actively involved in journal publications, conferences and policy-making, and contribute in no small measure to the development of law in the courtrooms and within the legal profession. There are numerous workshops and seminars by local and foreign academics and practitioners held throughout the year as its Visiting Academics Programme welcomes thought leaders and experts to SMU.
L A W A N D TECHNO LO G Y The SMU School of Law, Law and Technology Advisory Council was set up in 2017 to provide advice and support to the Deanery in order to enhance legal education and research in Law & Technology. It comprises senior and experienced academic experts, regulators and policy-makers, private sector leaders, lawyers and legal counsel, as well as founders of start-ups in the area of Law & Technology. There is significant potential for the School to engage in research to leverage on cutting-edge developments in technology and the natural synergy with the Applied Research Centre for Intellectual Assets and the Law in Asia (ARCIALA), and the work of the School’s Innovation, Technology and the Law Cluster. In 2018, following a competitive application process open to all Institutes of Higher Learning in Singapore, the SMU School of Law was awarded a research grant of S$4.5 million from the National Research Foundation (NRF) and the Info-communications Media Development Authority (IMDA) to lead a major Research Programme on the Governance of Artificial Intelligence and Data Use. This 5-year Research Programme will comprise three integrated streams – AI and Society, AI and Industry, and AI and Commercialisation.

SOL VISITING ACADEMICS PROG RAMME
The SOL Visiting Academics Programme is mainly intended for academic faculty from other universities and legal professionals (senior practicing lawyers and consultants, judges and government legal officers) who wish to spend a period of time at the SMU School of Law pursuing research on a particular topic. This programme is designed to accommodate visiting scholars with a broad range of legal experience and qualifications and to encourage interactions and collaborations with the SMU School of Law faculty on legal and interdisciplinary research. Visiting Academics are generally expected to offer faculty seminars and/or contribute to the SMU School of Law’s working paper series or similar compilations. They may be appointed for short-term visits to conduct seminars and/or research collaborations, for longer-term research projects and collaborations and/or to teach courses in the SMU School of Law programmes.
The SOL Visiting Professorship in Law & Technology, as part of the SOL Visiting Academics Programme, seeks to attract leading academic faculty from reputable universities who wish to spend a period of time at the SMU School of Law pursuing research on Law and Technology in collaboration with the SMU School of Law faculty. The SMU School of Law aims to be at the forefront of research at the intersection of Law and Technology in the following areas: artificial intelligence, Fintech, smart contracts, data protection and privacy, internet law, big data, and online dispute resolution. Academic experts with strong technical expertise and knowledge in these technology-related areas in addition to legal expertise are especially welcome.

A P P L I E D R ES EAR CH CENTRE F O R I N T ELLECTUAL AS S ET S A N D T HE LAW IN AS IA ( A R CI A L A) Taking a multi-faceted and cross-disciplinary approach, ARCIALA’s research focus includes annotating and contrasting leading IP cases from major Asian jurisdictions, deciphering the intersection both between IP and competition law and between IP and trade law, and understanding the relationship between innovation, economic development and IP. We engage in thought-provoking research projects in areas of practical and regional importance, to promote interest, academic research and cooperation on intellectual assets and the law in Asian economies, to nurture promising young scholars on Asian IP law, and to publish a series of edited volumes and monographs on Asian IP law.
T H E CE N TR E F O R CR O S S -BORDER COMM ERCI A L L AW I N ASI A ( CE B CL A) The Centre for Cross-Border Commercial Law in Asia (CEBCLA) facilitates research in all areas of commercial law, with focus in the Asian context. CEBCLA aims to be the leading Asian centre of research in commercial law which is informed by a variety of research methods including doctrinal, theoretical, empirical, historical and comparative perspectives. One of CEBCLA’s key objectives is to serve as the meeting point and first port of call for scholars, leading practitioners, governments and policy makers pursuing rigorous, informed and significant research in commercial law in Asia. Through such interactions and dialogues, CEBCLA seeks to support the development of regional thought leadership in commercial law and research collaborations. T H E S I NG APO R E I N T E R NATIO NAL D IS PUTE R E S OL U TIO N ACAD EMY (SIDRA) The Singapore International Dispute Resolution Academy (SIDRA) is a subsidiary of the Singapore Academy of Law and the Singapore Mediation Centre and is located in the SMU School of Law. SIDRA provides a unique space that gives Asian voices a strong presence in global conversations on negotiation, mediation and Appropriate Dispute Resolution. The SIDRA platform connects dispute resolution stakeholders across a range of jurisdictions, cultures, and disciplines to exchange ideas and experiences with a view to growing a shared vision for international dispute resolution. As such, the Academy’s ambitions lie beyond “best practice” as it seeks to identify "next practice” in the field in three ways: Firstly, thought leadership and think tank events, secondly, research and development, and finally, strategic training and in-house consultancies.

KWA GEOK CHOO LAW LIBRARY Legally trained librarians offer a reference service, legal research programs, and workshops on demand to the SMU School of Law faculty, students, and the SMU Community at large. Institutional Knowledge (InK) at Singapore Management University showcases the research and scholarly work of the SMU community. The librarians provide research and publishing support to the faculty such as citation count, journal impact, author identiďŹ cation, publishing, rankings, and statistical analysis of research publications. The Law Research Navigator created and maintained by the librarians serves as an excellent starting point for legal research. The collection at the Kwa Geok Choo Law Library is designed to provide resources necessary to support teaching and research by the SMU School of Law and courses in Law taken by undergraduate and postgraduate students of other schools. As well as Singapore primary and secondary sources, it includes access to materials of the main jurisdictions of the common law that have inuenced Singaporean law. CURRICULUM AND TEACHING The SMU School of Law's law programmes are carefully designed and curated to nurture intellectual curiosity and creativity, and to meet the demands of the ever-changing market, while at the same time helping our graduates find their proper place as leaders in society. At a practical level, we aim to produce law graduates who are practice-ready by arming them with contextualised legal expertise and the ability to think across disciplines and geographical borders.
CU R R I CULUM The Bachelor of Laws (LLB), the SMU School of Law’s flagship programme, is a 4-year meritorious honours programme with 36 courses. The LLB curriculum, originally formulated by legal academics and practitioners after extensive discussions and endorsed by Ministry of Law and Singapore’s Board of Legal Education, is being constantly revised to meet new demands and challenges. The available courses comprise a good blend of Law core courses, Law electives and Law-related courses; in addition to university and general courses. To equip students with a strong commercial skillset, Commercial Conflict of Laws, Financial Accounting for Law, and Finance for Law are designated as compulsory courses. The University core courses, on the other hand, are designed to enhance general knowledge, inculcate ethics and social responsibility, and impart soft skills. Internships with law firms, legal departments in businesses, and government bodies are an integral mandatory component of our degree courses. Our LLB students are required to complete at least 10 weeks of internships, and our Juris Doctor (JD) students at least 6 weeks of internships, before graduation. Our students generally intern in several firms or organisations in order to gain greater exposure to the practical workings of different aspects of the legal system and different forms of legal work. Through our network of partnerships, students may also intern overseas, for example, at various New York firms, particularly those with multi-jurisdictional operations and practice in line with our Memorandum of Understanding with the New York State Bar Association in 2009 – the first such agreement between an American bar association and a Singaporean university. The SMU School of Law has collaborated with the Singapore Academy of Law’s (SAL’s) Future Law Innovation Programme (FLIP) on student and curriculum development which includes student internships at SAL and firms under FLIP as well as FLIP’s consulting projects leveraging on SMU’s multidisciplinary SMU-X curriculum.

P E D A G OG Y The SMU School of Law is a prime mover in the legal education landscape. Pioneering small class teaching and superior learning experience, the SMU School of Law continues to bridge the distance between instructor and student. The students invest substantial efforts in pre-class preparatory reading and thinking, and participate in vibrant class discussions. Group presentations form part of our experiential and interactive participative learning culture. Through this, the students develop to become dynamic, articulate, confident, and analytically agile individuals, with crucial attributes for excelling in the legal and corporate world. Through clinical work and industry collaboration, the SMU School of Law has gone beyond the traditional teaching of theory to incorporating practical experience in the classroom. Judges and practitioners are frequently invited to share their experience with the students, with some even teaching full courses. While striving to train practice-ready law graduates, we continue to view law as a noble calling, and therefore it is the SMU School of Law’s responsibility to inculcate in the students the value of giving back to society. Presciently, the SMU School of Law is the first law school in Singapore to require students to complete at least 80 hours of community service before graduation, of which 20 hours constitute pro bono work. This became such a success that pro bono hours thereafter became mandatory for law schools nation-wide.

The SMU School of Law encourages meaningful participation in co-curricular activities for an active and balanced life. Our students may choose to join a number of student-run law clubs. The SMU Law Society, fondly known as The Bar, is the representative body for students and organises a variety of events. There are also seven sub-clubs, each of which provides the opportunity to engage in more specific areas of interest. They include the Corporate and Commercial Law Club, Constitutional Law and Criminal Justice Club, SMU Law International Relations Club, Law Outreach Club, Moot Court Club and the SMU Law Athletes. Lexicon: An SMU Law Student Publication serves to provide students with a platform to express their opinions on Singapore's ever-progressing legal landscape.
The “Law as Calling Lunch Series” gives our students an opportunity to be inspired by people who have persevered in doing good, to facilitate their understanding of the role that law and the profession play alongside other structures in society, and helps them to see the “human” side of law. This Series is fully sponsored by the faculty members of the School, who hope that students will see law not merely as a practice, but also a calling. The SMU School of Law sponsorship conveys to the students that the School cares about more than academics, and that the School wishes to contribute to their development as people. The speakers include: • Jason Wong, former Deputy Director/Chief of Staff of Singapore Prison Service who initiated the Yellow Ribbon Project, on helping prisoners and ex-offenders and changing society’s mindset about ex-offenders. • Gregory Vijayendran, the Law Society of Singapore’s inaugural Pro Bono Ambassador and current President on pro bono work.

S T U D E NTS ’ ACHIEVEMENTS A N D A WAR D S The SMU School of Law is, as of today, one of the world’s top law schools for international moot court competitions. Our students regularly feature in the championship finals of major or “grand slam” moots such as the Jessup, Vis, Vis East, Price, Frankfurt, and International Criminal Court competitions. In just seven years after the International Moots Programme was launched, our mooters have placed in the top-three in international moots 63 times, winning 22 championships and more than a hundred memorial and oralist prizes. The SMU School of Law has also won five of the last six Jessup national rounds, and holds world records for the most number of international championships won in a moot season (5) and most number of international moot finals in a moot season (9). Much of this success is driven by the tremendous passion and commitment of our moot alumni, many of whom contribute in terms of adjunct teaching, coaching, judging, and donations. Many of our moot alumni go on to secure some of the most prestigious job offers as well as scholarships to further their studies abroad; some even continue the tradition of mooting by dominating competitions for young lawyers such as the SAL-ECC and MLAS moots. Our students are also active in law reform projects. In the Law Reform Essay competition organised by the Ministry of Law and AGC, our students have won the top prize for five years in a row. In 2016, when the Constitutional Commission was convened, a group of students made representations concerning the Elected Presidency. In 2018, when a Select Committee was formed to look into regulating deliberate online falsehoods, while another group of students made representations, and proposed various paradigms of legislation. For many of these student achievements, the SMU School of Law would like to express its gratitude and acknowledge the contributions and efforts of our alumni, who continue to return to teach, mentor and coach their juniors.

The SMU School of Law’s first cohort of students graduated in 2011. Based on a survey conducted in November 2017 on the SMU School of Law graduates, 97.6% of the respondents who were in the labour force were employed. Amongst a variety of career options, apart from joining the legal profession in private practice careers, our alumni have been Justices’ Law Clerks, joined the legal service in other roles such as deputy public prosecutors or assistant registrars, and pursued further studies at top universities. In 2016, the school also welcomed our first faculty member amongst the graduates. Upon graduation, many alumni remain connected with and invested in the School, returning to serve the School in a variety of ways, such as coaching students for mooting competitions, speaking at open house talks, giving advice to students on internships, and so on.

PRO FESSIONAL AND COMMUNITY ENGAGEMENTS The SMU School of Law is as local as it is global. Both the law profession as well as the community within which the law school is imbedded have contributed much to its flourishing. Law schools have traditionally confined themselves to the academic instruction of the law, serving society solely by producing lawyers. The SMU School of Law takes a different view: that a law school is a key part of a nation’s justice system, not only by developing future legal professionals, but also by directly engaging with the needs of the wider community. Therefore, our students play a direct role in the national effort to promote the ideal of equal access to justice for all parts of society. Our students are also engaged with the wider public in more innovative ways. In a recently launched collaboration with the Supreme Court of Singapore called the Supreme Court Initiative, our students report on judgments of the Court of Appeal in order to foster greater public awareness of these cases and their implications. The SMU School of Law faculty are very actively involved in the university, the global legal fraternity and in Singaporean society. Faculty members sit on the Editorial Boards of prominent publications worldwide, on the Board of Directors in various associations and organisations, on lists of arbitrators, and Committees (such in the areas of Law Reform, Legal Education and Studies, Continuing Education and Promotion of Singapore Law). They are appointed as Nominated Members of Parliament, and serve as consultants, advisers, registrars and panellists in tribunals, as well as other academic and professional appointments. Many faculty members maintain ties to the practice of the law, advising on transactions, accepting briefs from law firms, or appearing before the Courts as expert witnesses and amici curiae. Such was the case with the ‘Baby P’ case, in 2012, when our Dean, Associate Professor Goh Yihan, as amicus curiae, argued for the proposition that, without demeaning the value of life, damages can be awarded to the parents of a child conceived in an IVF mix-up. Others volunteer their time and expertise with civil society NGOs like CASE or contribute towards good corporate governance as board members of companies and charitable organisations.

T HE S MU LAW ACAD EM Y The SMU Law Academy (SMULA) has an established record of providing the legal profession with high-quality seminars and other opportunities to remain fully informed about contemporary legal developments in today’s fast-paced world. SMULA’s carefully curated programme is developed with the profession’s multi-faceted needs in mind, and meets the requirements of the mandatory Continuing Professional Development (CPD) scheme administered by the Singapore Institute of Legal Education (SILE). The SMU Law Academy’s Auditing Scheme enables members of the legal profession to consolidate and upgrade their understanding of the law in a more comprehensive fashion. For foreign lawyers, this programme offers an ideal opportunity to become intimately familiar with the workings of Singapore law in fundamental areas like contract, tort or IP.
