זכויות אדם במשפט הבינלאומי פרופסור דוד קרצמר בשיתוף ד"ר נעמה כרמי מאז מלחמת העולם השנייה מתבסס מעמדן של זכויות אדם בזירה הבינלאומית .נתקבלה שורה ארוכה של אמנות בדבר זכויות אדם ,אזוריות ובינלאומיות ,והוקמו מוסדות מיוחדים לניטור התחייבויות המדינות על-פי אמנות אלו ולמתן סעד לפרטים שזכויותיהם נפגעו .בקורס זה נעמוד על ההגנה על זכויות אדם במישור הבינלאומי בשלושה מישורים: בעיות עקרוניות .האם ניתן לקבוע נורמות בעלות תחולה אוניברסאלית? איך מתחשבים במאפיינים ייחודיים של מדינות שונות ? האם ניתן לתת עדיפות לזכויות מסוג מסוים ,כגון אזרחיות ומדיניות ,על פני זכויות מסוג אחר ,כגון זכויות כלכליות וחברתיות? האם ההגנה ניתנת רק לזכויות הפרט ,או שמא יש להגן גם על זכויות קבוצתיות ,כגון הזכות של עם להגדרה עצמית ? האם רק מדינות מחויבות לקיים זכויות ,או שמא יש להטיל חובה לכבדן גם על גופים אחרים ,כגון חברות רב-לאומיות? הכרת האמנות העיקריות והמוסדות המרכזיים בתחום .יושם הדגש על אמנות שמדינת ישראל הצטרפה אליהן ,ובראשן האמנה הבינלאומית בדבר זכויות אזרחיות ומדיניות ,האמנה הבינלאומית בדבר זכויות כלכליות ,חברתיות ותרבותיות ,האמנה בדבר ביעור כל הצורות של אפליה גזענית ,האמנה בדבר ביטול אפליה נגד נשים על כל צורותיה ,והאמנה נגד עינויים וצורות אחרות של יחס או עונש אכזריים ,בלתי אנושיים או משפילים .נכיר הן את הוועדות המנטרות אמנות אלה הן מוסדות לניטור זכויות אדם הפועלים עפ"י מגילת האו"ם. סוגיות נבחרות בזכויות אדם :הזכות לחיים ,האיסור על עינויים ,זכויות אדם במצבי חירום ובעת מלחמה ,זכויות פליטים ומבקשי מקלט ,ועוד.
