BILL DESCRIPTIONS

Message From the President We are excited to present the 2017 Legislative Scorecard. The Chamber’s annual scorecard keeps businesses informed as to how their legislators voted on the issues that matter most. 2017 has been a year of success for the South Carolina business community. From passing a long-awaited solution to our state’s infrastructure crisis, to addressing the workforce needs of our growing economy, the legislature tackled issues of major significance during this year’s legislative session.

S.27: Superintendent of Education (Sponsors: Campsen and others) - Support of Bill on 2nd or 3rd Reading (Weighted at 10%) This bill provides enabling legislation for S.137, an effort to amend the constitution to allow the Governor to appoint the Superintendent of Education. The Senate passed the bill by a vote of 41-0 on 2nd Reading and 39-0 on 3rd Reading. Chamber Vote: Aye, Votes #S-22 and S-27, 2/1/17 and 2/2/17. S.218: Employee Benefits (Sponsors: Massey and others) - 2nd Reading (Weighted at 10%) This bill reserves the right to establish and mandate employee benefits to the General Assembly, passed both houses, and was signed into law on 4/5/17. The Senate voted to approve this measure by 32-8. Chamber Vote: Aye, Vote #S-31, 2/7/17. S.118: Civil Jurisdiction of Magistrate Court (Sponsors: Campsen and others) - 2nd Reading (Weighted at 10%) By a vote of 40-0, the Senate passed this measure to raise civil jurisdiction of magistrate court from $7,500 to $10,000. Chamber Vote: Aye, Vote #S-57, 2/16/17.

The business community applauds those legislators whose leadership, hard work and courage led to the passage of a sustainable, recurring revenue stream to fix South Carolina’s roads and bridges. The final bill, a compromise between the House and Senate, represents the legislature’s ability to put the needs of South Carolinians over politics. Please be sure to thank the legislators that supported this solution. In addition to infrastructure, the legislature took on a variety of other essential issues important to the business community this session. Both bodies took major steps to address our state’s skills gap by passing legislation to establish the Education and Economic Development Coordinating Council and to conform to the Education Accountability Act. Other vital business issues arising this session included ex-offender workforce reintegration, agribusiness and rural job creation, nuisance suits against existing manufacturing facilities, and an attempt to repeal our Right to Work laws. Our 2017 Legislative Scorecard is issued to keep you informed and hold legislators accountable for their votes.

Senate Votes

S.105: Automatic Stay (Sponsors: Rankin and others) - 2nd Reading (Weighted at 10%) S.105 removes indefinite automatic stay provisions and was passed by the Senate by a vote of 26-6. Chamber Vote: Aye, Vote #S-108, 3/8/17.

H.3358: Real ID (Sponsors: Willis and others) - 2nd Reading (Weighted at 10%) Signed into law on 4/5, this bill ensures that South Carolina driver’s licenses will be updated in order to comply with federal law. The Senate voted unanimously for the passage of H.3358. Chamber Vote: Aye, Vote #S-144, 3/22/17. H.3516: Infrastructure Funding (Sponsors: Simrill and others) Ultimately passed into law, this legislation raises over $600 million in recurring revenue for roads and bridges, reforms the SCDOT, and provides tax relief. The Senate passed an amended version of this bill on 4/26 by a vote of 33-10. The bill went on to be taken up by a Conference Committee, with the Senate approving the committee report by a vote of 32-12. The Senate again voted to override the Governor’s veto of the bill on 5/10 by a vote of 32-12. 2nd Reading (Weighted at 5%) Chamber Vote: Aye, Vote #S-347, 4/26/17. Adopt Free Conference Report (Weighted at 10%) Chamber Vote: Aye, Vote #S-396, 5/8/17. Override Veto (Weighted at 15%) Chamber Vote: Aye, Vote #S-417, 5/10/17. H.3969: Education Accountability Act (Sponsors: Felder and Allison) - 3rd Reading (Weighted at 10%) The Education Accountability Act is a single statewide education accountability plan that meets federal accountability Every Student Succeeds Act (ESSA) requirements. The Chamber supported this bill but opposed any minimization of career readiness assessments. The Senate passed this bill on 3rd Reading by a vote of 44-0. Chamber Vote: Aye, Vote #S-413, 5/10/17.

House Votes H.3220: Education & Economic Development Coordinating Council (Sponsors: Allison and others) - Passage of Bill (Weighted at 10%) This bill reestablishes the Education & Economic Development Coordinating Council, a collaborative effort between the education and business communities to strengthen our state’s workforce. The House passed H.3220 by a vote of 101-1 and the bill was signed into law on 5/11. Chamber Vote: Aye, Vote #H-41, 1/31/17. H.3146: Superintendent of Education (Sponsors: Delleney and others) - Passage of Joint Resolution to the Constitution (Weighted at 5%) This joint resolution amends the constitution to allow the Governor to appoint the Superintendent of Education. The bill passed the House by a vote of 87-24. Chamber Vote: Aye, Vote #H-91, 2/22/17. H.3516: Infrastructure Funding (Sponsors: Simrill and others) Ultimately passed into law, this legislation raises over $600 million in recurring revenue for roads and bridges, reforms the SCDOT, and provides tax relief. H.3427: Computer Science Education Initiative (Sponsors: Lucas and others) - Passage of Bill (Weighted at 5%) This bill states that, beginning in fall 2018, public high schools and charter high schools will offer computer science coursework. It also states that the State Board of Education will adopt grade appropriate standards for Computer Science coursework. The House passed H.3427 by a vote of 106-1. Chamber Vote: Aye, Vote #H376, 3/21/17.

H.3653: Nuisance Suits (Sponsors: Forrester and others) - Passage of Bill (Weighted at 10%) By a vote of 78-27, the House passed this bill to protect manufacturers and industrial facilities from nuisancerelated lawsuits. Chamber Vote: Aye, Vote #H-388, 3/22/17. S.218: Employee Benefits (Sponsors: Massey and others) - Passage of Bill (Weighted at 10%) This bill reserves the right to establish and mandate employee benefits to the General Assembly, passed both houses, and was signed into law on 4/5/17. The House voted to approve this measure by 73-29. Chamber Vote: Aye, Vote #H-391, 3/22/17. H.3209: Ex-Offender Workforce Reintegration (Sponsors: Pope and others) - Passage of Bill (Weighted 10%) This bill addresses our state’s workforce shortage by improving pathways to employment for those previously incarcerated and was amended to include perfecting language on expungements and to add employer liability protection. The House passed this bill by a vote of 1030. Chamber Vote: Aye, Vote #H-493, 4/5/17. H.3929: Agricultural Animal Facilities (Sponsors: Hiott and others) - Passage of Bill (Weighted at 5%) Passed by the House by a vote of 77-12, H.3929 establishes finite setbacks for facilities and states that permits can only be contested by affected persons with standing in order to make South Carolina poultry farms more competitive with neighboring states. Chamber Vote: Aye, Vote #H-649, 5/9/17. H.3029: Freedom of Employment Contract Act (Sponsors: Cobb-Hunter and Robinson-Simpson) - Sponsoring Bill (5% Deduction) Co-sponsored by Representatives Cobb-Hunter and Robinson-Simpson, this bill sought to repeal South Carolina’s Right to Work laws. Chamber Vote: Nay, Introduced 1/10/17. H.3565: Automatic Stay (Sponsors: Fry and others) - House Judiciary Committee Vote (5% Deduction for Nay Votes) This bill removes indefinite automatic stay provisions. The House Judiciary voted to amend and pass the bill out of committee on 2/14 by a vote of 17-7. Those committee members who voted against the bill receive a 5% deduction.
