HISTORICAL DOCUMENTS Menston, Yorkshire 1

Two late thirteenth (or early fourteenth) century deeds relating to the land of William Attebeck of Mensynton written on vellum. The first being a grant by William, son of William Attebeck to Walter, Lord of Hawksworth of - the messuage and land in Menston which decended hereditarily to the grantor from his father. - a toft with croft in Menston called Fontayns Garth, between the messuage of Walter de Bayld[o]n on one side and that of John Stot of Menston on the other side. - The homage and service of the following individuals who hold land in Menston from the grantor, Walter de Bayld[o]n; Alexander de Brerhag; William son of Gilbert; William son of Richard fil. S[er]lonis; John Walker de Burlay; William Helbe (but excluding lands in Menston given by the grantor to his son John, and to William his son). Undated, but after 1290 (as to be held of the chief lord of the fee) and is probably a contemporary copy as it ends, “In cui[us] rei test[imonium] & c”; presumably omitting the customary list of witnesses, and allusion to sealing but with the seal or fragment now in a paper cover with binding cord. The second document is an quitclaim by Alice, widow of Alexander de Mensyngton, to William son of William Attebeck of Mensyngton of all rights in a toft with croft in Menston, between a toft of Walter de Haukesword west and a toft of William Attebeck senior east, which toft and croft Michael Attebek and the said William his son had by grant of Robert Stotte of Menston. Witnessed by Walter de Haukesword, Peter de Marthelay, Thomas de Monte also, Ralph de Ilketon, Robert de Burlay, Michael de Rondon and John de Carleton. With seal tag and medieval endorsement. Photo

Two small seals of Watson and his wife in red wax, largely complete; on seal tags cut from a document of the period. LETTERS PATENT GRANTED BY KING EDWARD VI

1552 (6 October) on one skin of vellum and written in an attractive official hand. A licence for 42s. 21⁄ 2 d. paid in the Hanaper to lady Elizabeth Fane (widow) to grant her tithes of grain and hay and other tithes within the ward of Hilden, commonly called Hilden Warde, within the parish of Tunbrydge (Tunbridge), Kent, late parcel of Tunbrydge rectory to Humphrey Dixson and John Dixson and their heirs and assigns of the said John. Witnessed at Westminster the 27th day of October 6. On the fold of this patent the costs are broken down as follows: 13s. 21⁄ 2 d for a fine or the tax, 20s. 4d for the seal, 4s. for the enrollment and further entries. The document bears the Great Seal of Edward VI which is in remarkably fine condition, clearly showing all of the lettering and the fine detail of the seal. A couple of minor edge knocks do not detract from this magnificent seal. This is the second seal of Edward VI used between 1548 and 1553. It shows the King enthroned, royal robes, tippet, crown, royal sceptre and orb, on carved throne, with shell shaped back, on which the initials E. R. beside king’s head with cherub’s head and wings above them, and circular baldachin having curtains at sides looped up in a large bunch, scroll work at sides (panels with trophies), carved footboard, on the arm piece on each side a lion. In the field on each side an ornamental shields of arms of France and England quarterly, encircled with garter inscribed with the motto and ensigned with the crown royal. EDWARDI SEXTI DEI GRATIA ANGLIE FRANCIE / ET HIBERNIE REX FIDEI DEFE[N]SOR ET IN TERRA ECCLESIE ANGLICANE ET HIBERNICE SVPREMVM CAPVT (Edward the Sixth, by the grace of God of England, France / and of Ireland King, Defender of the Faith, and on Earth, of the English and Irish Church, Supreme Head). The reverse is the King on a horse, plumed and crested helmet, shield of arms as before, sword held over head, horse trapping richly flowered, and having two shields of arms as before, one shoulder and one on thigh; greyhound running beside horse in foreground, between two lopped trees, Background ornamented with scrolls of foliage, four small fleur-de-lis, three cinquefoil roses, large rose ensigned with crown over tail of horse, and fleur-de-lis similarly ensigned, in front of horse’s head. October 8, 2015 - LONDON Hilden is a manor situated at about a mile’s distance from Tunbridge town, and was antiently part of the possessions of the family of Vane, written a-Vane in antient deeds, before the reign of King Edward III. One of them, John Vane, esq. had two sons of the name of Henry; the eldest of which left an only daughter and heir, married to Sir Peter Blondevil; the youngest Henry Vane, was of this place, esq. and had three sons; John Vane, esq. of Hilden, and afterwards of Tudeley, ancestor of the several branches of this family since enabled; Thomas, whose son Humphry died without issue; and Henry, who was father of Sir Ralph Fane, attainted in the reign of King Edward VI. By his will in the 34th year of King Henry VI he devised this manor to his eldest son John, and the parsonage of Hilden to his youngest son Henry. John Vane, esq. sold the manor in the 10th year of King Henry VII to Tattersal, one of whose descendants possessed it at his death in the 6th year of King Edward VI. anno 1551, when it was sound that he died possessed of this manor, and five hundred acres of land, in Hilden and I unbridge, held of the honor of Tunbridge, by knight’s service, and that John Tattersal was his son and heir. He alienated it to Humphry Dixon, who in that reign had purchased the parsonage of Hilden of Elizabeth, Lady Vane. He was the second son of Thomas Dixon, esq. of North-frith, in this parish, descended of a family of good account of this name in Scotland, who bore for their arms, or, a cross formee or palee throughout the shield, gules, between four eagles displayed, sable. John, the eldest, succeeded him in this manor, and resided here, he left two sons; Henry, who was of Hilden, esq. and justice of the peace; and William, who was of Darent, in this county. Henry Dixon, esq. the eldest son of Humphry, resided here, as did his grandson of the same name, who died in 1669, leaving two daughters his coheirs, who possessed this manor in undivided moieties. Jane, the eldest, married Nathaniel Booth, esq. and Sarah, the youngest, Percival Hart, esq. of Lullingstone. Percival Hart, esq. died in 1738, leaving an only daughter and heir Anne, then married to Sir Thomas Dyke, bart. of Horeham, in Suffex, who became possessed of one undivided moiety of this manor, as he did likewise of the other moiety on the death of Mrs. Jane Booth, widow, above mentioned, without issue, in 1743. Sir Thomas Dyke died in 1756, leaving his widow surviving, who possessed the whole of this manor till her death in 1763, when it descended to their only son and heir Sir John Dixon Dyke, bart. of Lullingstone, who procuring the authority of parliament, sold it, in 1767, to Thomas Harvey, esq. of Tunbridge, the son of Thomas Harvey, of Deal, descended of the family of Harvey, settled so early as King Edward the IV’s reign, at Tilmanstone, in East Kent, and afterwards dispersed over the several parishes in that neighbourhood, in the description of which parish a full account of them may be seen, whose arms being, Argent, on a chevron gules, three crescents or, between three lions gambs erased, sable, are likewife borne by this branch of it. Mr. Harvey, of Tunbridge, married Charlotte, youngest daughter of the Rev. William Davis, vicar of this parish, by whom he had two sons, Thomas, now of Redleaf, in holy orders, and William Thomas; and three daughters, Charlotte, Sophia, and Frances. He died in 1779, leaving his widow Mrs. Harvey, surviving, who is by his will possessor of this estate for her life, after which it will devolve, by his devise, to this eldest son, the Rev. Thomas Harvey. At a small distance from Hilden-green, stood the manor-house, the ruins of which were entirely erased some years ago, by Sir Thomas Dyke. A court baron is held for this manor. 1600 (2 September) on one piece of vellum, written in a very neat official hand. A licence for 53s. 4d. paid in the Hanaper to John Dixon gentleman and Joan his wife and Henry Dixon all their tithes of grain and hay and all other tithes whatsoever within the ward of Hylden in the parish of Tunbridge in the county of Kent late parcel of the rectory of Tunbridge. Held for the use and behoof of Mary Dixon wife of the aforesaid Henry during her natural life for her jointure and after her decease to the use of the said Henry. Granted to Peter Blower gentleman and William Blower gentleman and to the heirs and assigns of the said Peter. Witnessed at Westminster the 2nd day of September 42 Elizabeth. The document bears the Great Seal engraved by Nicholas Hilliard. Elizabeth I used this great seal during the second half of her reign - from 1586 to 1603. It is an impression from seal matrix made of bronze and was engraved by Nicholas Hilliard, who was famous for his small paintings or miniatures. The matrix was used to create wax impressions that were used to ‘seal’ documents. This was a means of proving that the accompanying document had been written or approved by the owner of the seal. Seals were widely used by statesmen, nobles, judges, churchmen and even ordinary people. The great seal was the most important of all as the monarch used it to approve public acts and announcements. It was a powerful political tool. The great seal of Elizabeth gives an insight into how the queen wanted to be seen. On one side, she is shown holding the sceptre and orb that are the traditional symbols of royal power. Heavenly rays above her head are a sign of her divine status. On the reverse side, Elizabeth is shown on horseback riding across a field of flowering plants. This symbolises hope and prosperity, as well as the queen’s femininity. Her image is one of strength, but unlike her predecessors she is not wearing military dress. She is flanked by the symbols of her lands: the Tudor Rose of England, the Harp of Ireland, and the Fleur-de-Lys of France. The inscription around the edge reads: ‘Elizabetha dei gracia Anglie Francie et Hibernie Regina Fidei Defensor’ (Elizabeth, by grace of God, Queen of England, France and Ireland, Defender of the Faith). The seal is in a superb state of preservation, with complete inscription and comes in its original leather and wood box which is lined by printed religious text and a piece of fourteenth century religious manuscript. Related to the same land as the previous Letter Patent, this is a very important item of Kent history. Photo

1667 (20 May) a Grant of Arms issued by Sir Edward Walker, Garter King of Arms to John Wadman of Brooke, Wiltshire, an attorney in the Court of Common Pleas. An English illuminated manuscript with three-sided foliated border and large foliate initial, granting his “Coate of Armes” which includes three roses argent. The Coat of Arms has been stitched onto the manuscript (some threads are broken) and with broken seal of Sir Edward Walker in tin skippet. Signed “Edw Walker, Garter” at foot. Some staining in the upper right corner, folded with some resultant soiling. Photo

1686 (23 June) an Exemplification of Common Recovery. A fine indenture on vellum with large printed head of the monarch with large initial capital, armorial animals and birds. The recovery is by Samuel Westerne from Nathaniel Bard of one messuage, four gardens, 200 acres land, 30 meadow, 300 pasture, 20 wood, 20 marsh, 200 scrub and heath, in Milborne Port, Goathill, Henstridge Ash and Bowen in Henstridge, Dorset and Somerset. The seal tag has been cut, offered with fragments of the seal. A very rare Recovery bearing the portrait of King James II as most Recoveries from this period are with the engraved coat of arms. 1689 (19 June) an Exemplification of Common Recovery. An indenture on vellum in Latin with engraved portrait of William and Mary (heads and shoulders) with large initial capital, nautical allegorical figures and armorial devices. The Recovery by Samuel Dodd from Bernard Whalley of the manor of Billesley, with one messauge, one dovecote, 6 gardens, 500 acres land, 100 meadow, 600 pasture, 20 wood, etc. in Billesley, Atherstone on Stour, Ullenhall and Walls Wotton, Warwickshire. Usual folding creases and some soiling; the seal tag has been cut. Photo

1712 (28 November) an Exemplification of Common Recovery. An indenture on vellum in Latin with printed Queen’s portrait without crown, large initial capital and royal arms and elaborate national emblems. The Exemplification is by John Dover from William Rudge of two messuages, 70 acres land, 44 meadow, 30 pasture and common pasture in Upton on Severn and Kersoe in Elmley Castle, Worcestershire. With complete papered seal ‘Appointed for Sealing of Writs’. This was not issued at Westminster but at the Great Sessions in Wales at Presteigne and the seal is of this court. 1814 (12 February) Exemplification featuring a portrait of the King, large initial capital with royal coat of arms with female allegorical figures; by Samuel Large from Thomas Tebbut the younger of the manors of Hackney Kingshold and Hackney Lordshold with 500 messuages, 100 tofts, 100 coachhouses, etc., two watermills, two quays, fishery in the River Lea, a ferry across the Lea etc. and other rights etc. in the parish of St. John Hackney, Middlesex. Written in a neat hand this is an important land transfer document. 1765 (10 December) Treasury Order for payments to Francis Earl of Hertford, “One of the Gentlemen of his Majesty’s Bedchamber”, signed by Thomas Townshend, J.Cavendish and William Dowdeswell, Lords of the Treasury. Single page (131⁄ 2 x 9 inches), cancelled with a broad pen stroke as is customary with these Exchequer documents, integral blank leaf, a few minor marginal tears only. Marked at foot as paid on 31st December 1765 and signed “Lincoln” Thomas Townshend, 1st Viscount Sydney (1733-1800) was brought back into office by Rockingham as a Lord of the Treasury on 12 July 1765. He became Secretary of State for the Home Office in July 1782, after a few months as secretary at war under Rockingham. In those days the home department included responsibility for the colonies. He is famous for his support of the plans for a convict settlement in New South Wales. On 26 January 1788 Arthur Philip named Sydney in New South Wales in his honour. 13

1793 (28 November) A.L.S. written in Portsmouth to Augustus Rogers, he is requesting that the guns and howitzers which he ordered be obtained from other stores (these not being available in Portsmouth), “Sir Charles Grey has left some of the sixteen Light Sixpounders attached to the Regiments with their amunition. He has also made over to me two 51⁄ 2 inch howitzers ...” and concludes, “Admiral Macbride is at Spithead. If, when I can converse with him on the subject I find that I must not reckon of the assistance of heavy cannon from the ship ...” and is signed “Moira”. Included with this letter is a reply from the Office of Ordnance to The Earl of Moira on the subject of the revised and agreed ordnance for the expedition and lists the guns, howitzers and mortars which are to be supplied from Portsmouth and from Woolwich. On the death of the first Earl, he became The Earl of Moira from June 1793 to 1816. He was a British soldier and colonial administrator. He served as Governor-General of India from 1813 to 1823. He had also served with British forces for years during the American Revolutionary War and in 1794 during the French Revolutionary Wars. He took the additional surname ‘Hastings’ in 1790 in compliance with the will of his maternal uncle, Francis Hastings, 10th Earl of Huntingdon Following the declaration of war in 1793 of France upon Great Britain, Rawdon-Hastings (as he was now known) was appointed major general, on 12 October 1793. Sent by the Pitt ministry, Rawdon-Hastings launched an expedition into Ostend, France, in 1794. He marched to join with the army of the Duke of York, at Alost. The French general Pichegru, with superior numbers, forced the British back toward their base at Antwerp. Rawdon-Hastings left the expedition, feeling Pitt had broken promises Grimston Yeomanry Cavalry 21

John Simpson ... to the Grimston Yeomanry, by the same printers. Both with central fold, the poster with a few other wrinkles and some soiling on the reverse; otherwise exceptionally fresh. Photo Thomas Grimston (1753-1821). In about 1781 he began rebuilding the family house at Grimston Garth (which still exists) to the Georgian Gothic design of John Carr of York and he then divided his time between Kilnwick and Grimston Garth. The threat of a French invasion of England loomed large during the years of the Napoleonic wars and so the bigwigs in the East Riding of Yorkshire set about raising companies of volunteers to swell the military numbers. In 1795, at a huge expence, established the Grimston Yeomanary Cavalry. He struggled to recruit enough men as there was no pay. However, for the next 20 years they charged up and down Holderness (East Yorkshire) coast looking for those demmed Frenchies. 1803 (16 August) an autograph letter signed, as Major-General sent from “Danbury Camp” to Colonel Stanley of the 1st Royal Lancashire Regiment about the disposition of regimental officers; some paper loss at seal opening, clear of signature, (9 x 7 inches) and affixed to old album page, light stains. An elusive Revolutionary War signature. Photo General Sir George Beckwith (1753-1823). Beckwith was commissioned into the 37th Regiment of Foot in 1771. He distinguished himself as a regimental officer in the American Revolutionary War. He fought with distinction in the New York and New Jersey campaigns in 1776, leading the British advance into Elizabethtown and Brunswick. In 1780 he took charge of British military intelligence in New York. After the war he worked for Sir Guy Carleton in Canada. His efforts were aimed at stirring up trouble in Vermont, Florida, Kentucky and Tennessee. At the time Britain thought the weak American government might ask for British help. He was then appointed Governor of Bermuda in 1797, Governor of Saint Vincent in 1806 and Governor of Barbados in 1810. He was made a K.B. for his Capture of Martinique in 1809 and also led a successful expedition against Guadeloupe, the last French possession in the area, in 1810. He attained the full rank of General in 1814. Sir George Beckwith was Commander-in-Chief, Ireland from 1816 to 1820. He has an entry in Spies, Wiretaps, and Secret Operations: An Encyclopaedia of American Espionage

Photo Lieutenant General Colin Campbell (1754-1814) was commissioned into the 71st Regiment of Foot in 1771 and then transferred to the 6th Regiment of Foot in 1783. In 1796 he went to Ireland and fought, two years later, at the Battle of Vinegar Hill. In 1810 he was appointed Lieutenant Governor of Gibraltar. During the Peninsular War he insisted on keeping Gibraltar well garrisoned and also regarded Tarifa as within his command and denied it to the French invading force there

John Yule, 4th Lieutenant in the Victory at Trafalgar, one of the carriers of the bannerolls of lineage at Nelson’s funeral and features in the “Death of Nelson” by Devis. Yule was promoted to Captain after Trafalgar and had served at the Battle of the Nile prior to joining the Victory in 1805. He retired in 1835 and died in 1840. There is a grade II listed house in Branscombe which was originally named “Trafalgar” and was built by Captain Yule

This shows that Chaplin, at the London Coaching Inn, booked fares value £72.12.0d. and incurred £56 expenses (of which £26.11.0d was tax). In Brighton Mr. Crunden took £125.14.0d in fares and had £4 in expenses. The combined profit was shared amongst the various innkeepers who horsed the coach on the Brighton road. William Chaplin was probably the most important of the great stage coach proprietors, with four major coaching inns and a stud of over 400 horses. This copy has the bookplate of Calvert Lord Baltimore with his coat of arms (who was probably at the Royal Wedding). Size 7” x 101⁄ 2 ”. 1870 (11 January) A.L.S. and envelope sent from his home in Avignon addressed to The Right Hon. Russell Gurney M.P. The letter gives an account reported in the Daily News of a policeman, William Smith, who was taken before a magistrate for striking a man with his staff after seeing him knock a woman down in the street at one in the morning. Sentenced to one month in prison, the policeman was dismissed from the force, loosing his livelihood. He argues that other policemen will be inhibited in their legitimate work if the risk of prosecution hangs over them and that William Smith should be restored to the force. The envelope bears Laureated Napoleon 40c. tied by gross chiffres with the despatch c.d.s. alongside; redirected on arrival the envelope bears a good strike of the diminutive “R.” in crowned circle (denoting the parliamentary privilege of no fee for redirection) and London E.C. An 1895 photograph 280 x 230mm of a large (family?) group of over sixty on an outing which includes Edith Cavell near the centre (believed to be unpublished) and a small photograph with Miss Cavell with the youngsters of the family. A very unusual and important group. Edith Cavell took a post as governess with the Francoise family in Brussels in 1890 and stayed there for five years. She became a family favorite. Photo

He served as a model Governor General of Canada, Viceroy of India, Secretary of State for War and Secretary of State for Foreign Affairs. James Knowles was later to serve as A.D.C. to Field Marshal Roberts

With the original envelope from Adelaide bearing one 4d. Official stamp (two others removed). Photo Colonel Ahmed ‘Urabi (1841-1911), widely known in English as Ahmad Arabi or Arabi Pasha, was a nationalist Egyptian and an officer of the Egyptian army. The first political and military leader in Egypt to rise from the fellahin, ‘Urabi participated in a 1879 mutiny that developed into a general revolt against the Anglo-French dominated administration of Khedive Tewfik. Signed by the trustees, one of whom was the Earl of Huntington. Includes a map of the property and a schedule of the lands (over 110 acres), the field system which survives today. With seal and complete impression of the Seal of King George V for the Duchy of Lancaster, in dark red wax with tin skippet Sir William Arthur Hamar Bass, 2nd Baronet (1879-1952) was a British racehorse owner and a significant contributor to the racing industry. 1913 (5 August) A.L.S. by Ernest Shackleton on letterhead from 4, New Burlington Street, Regent Street with the telegraphic address “ANTEXPEDI, LONDON”, written to a friend, Fell. “The gist of my long letter is that I want to be guaranteed £5000 for one year and I pay the interest to the Bank and deposit with the guarantors the securities I referred to so that there will be little risk and I can have and clear mind to go ahead ... Ernest Shackleton”. Central and other folds plus small paper split at top. An early fund-raising letter from The Imperial Trans-Antarctic Expedition (1914-17), also known as the Endurance Expedition, which is considered to be the last major expedition of the heroic age of Antarctic exploration. Photo Shackleton estimated that he would need £50,000 for this expedition. He did not believe in appeals to the public which he felt caused needless book-keeping worries. He chose to raise funds by soliciting contributions from wealthy backers, beginning this process early in 1913. The first significant encouragement came in December 1913, when the Government offered him £10,000, provided he could raise an equivalent amount from private sources. The Royal Geographical Society, from which he had expected nothing, gave him £1,000, Lord Rosebery, who had previously expressed his lack of interest in polar expeditions, gave £50. In February 1914 The New York Times reported that playwright J. M. Barrie - a close friend of Captain Scott - had confidentially donated $50,000. With time running out, contributions were eventually secured during the spring and early summer of 1914. Dudley Docker of the Birmingham Small Arms Company (BSA) gave £10,000, wealthy tobacco heiress Janet Stancomb-Wills gave a “generous” sum (the amount was not revealed), and, in June, Scottish industrialist Sir James Caird donated £24,000. Shackleton informed the Morning Post that “this magnificent gift relieves me of all anxiety” 39

1915 and 1922 two Grants of Dignity of the Knight Commander and Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, both signed by the King, “George R.I.”. With one copy of the statutes, both covering letters (one with even toning) and one distressed envelope addressed to the recipient in Canada. An appealing group. Photo Field Marshal Julian Hedworth George Byng, 1st Viscount Byng of Vimy, GCB GCMG MVO (1862-1935) served as Governor General of Canada. Known to friends as “Bungo”, he was born to a noble family at Wrotham Park in Hertfordshire, England, and educated at Eton College. Byng received a commission as a militia officer and thereafter saw service in Egypt and Sudan before he enrolled in the Staff College at Camberley. Following distinguished service during the First World War - specifically, with the British Expeditionary Force in France, in the Battle of Gallipoli, as Commander of the Canadian Corps at Vimy Ridge, and as Commander of the British Third Army - Byng was elevated to the peerage in 1919. In 1921 he was appointed as Governor General of Canada by King George V to replace the Duke of Devonshire as viceroy, and occupied that post until succeeded by the Viscount Willingdon in 1926. Byng proved to be popular with Canadians. After the end of his viceregal tenure, Byng returned to the United Kingdom and there served as the Commissioner of Police of the Metropolis and was promoted within the peerage to become Viscount Byng of Vimy. The first dated 18th October is a typewritten letter signed “A. Bonar Law” (later Prime Minister), “We have now heard that the Spanish Government have at last granted permission for the issue of the Rio Tinto Company’s loan in Spain. It has been a long and tiresome business ...The negotiations could not have been carried through without your help.” The second dates 17th December is a typewritten letter signed “J M Keynes”, “I have spoke to Sir John Bradbury since you were here, on the question of whether the time has not now come for exercising our option over a further 50,000,000 pesetas Tinto loan... We are not in any very urgent need for the proceeds of the loan and the exact date can therefore be left to suit your convenience”. The final letter dated 20th December is an autograph letter signed “J M Keynes”, “I am very glad the the King (or whoever acts for him) has heard the ... of the Treasury. But I am sure your real reward for the great trouble you took for us is that you were of assistance to the country at a moment when our financial affairs were not of the highest”. He built on and greatly refined earlier work on the causes of business cycles, and is widely considered to be one of the most influential economists of the 20th century. A wonderful insight into the problems on the ground of setting up these defensive units. Apparently this Garden was considered by the locals as a particularly poor choice as it was well wooded, not apparent from a scan of an Ordnance Survey map

The first letter, dated 3 February 1956 tells how he had handed a script to Simon and Schuster editor, but he did not like it. Also how much he enjoyed living in the country. It is signed “Plummy” The second letter dated 18 April he asks where the Macall book is that was promised and how they had just purchased the plot of land next to theirs to prevent building on it, “It was a very sound move, really, because land down here is getting more and more valuable”. He had also just finished a new novel but was astounded that The Ladies Home Journal turned it down as it was not funny enough! It is signed “Plum” with the postscript “I’m writing this on my new electric typewriter - wonderful machine” The final letter, dated 15 January 1975 he is full of his pending knighthood. These notes were prepared for the meeting at the Royal Festival Hall, London; he expressed concern that the British had lost their fighting spirit and was now confronting a very dangerous foe, the weakness from within. He quotes the words read out when the Africa Star was fastened to the Union Jack and concludes, “ ... a young schoolboy stood facing the Union Flag, and on behalf of his own generation affirmed their resolve to carry on the Spirit now handed to them. It was all very moving and brought tears to the eyes of Sir Winston Churchill who was sitting next to me.” Signed and dated at foot. An important and historic document. Photo 43

An album compiled by Lieut. Col. F.R. Trench-Gascoigne; a quarto sized album bound in dark green, straight-grain Morocco leather (some wear, particularly at the extremities) with gilt title. One of the initial photographs in the album include the colonel with twelve other military officers, a diplomat and some wives. There are a total of 27 panoramic images (7 x 21⁄ 4 inches) taken with a Kodak Panorama no.1 camera, which include other views of the tented camp with various civilians or soldiers, five views of the procession route including pictures of some of the elephants, and nine showing the military displays. There are six large plate images (11 x 8 inches) with the elephant procession near Jama Masjid (2), the Durbar stands with the mounted heralds in position, a view of the eastern stand (9 x 7 inch), a view of the audience hall in the Red Fort and a good view of the Chief’s elephant at rest, a close up of two elephants with their mahouts. There are also invitations, tickets, etc, each centrally mounted, with an invitation to the Delhi Durbar (block B), two tickets, one pasted face down to show the plan of the amphitheatre, invitations to the Chapters of the Orders of the Star of India (2), the Delhi Coronation Assembly (creased) plus a dinner menu and dance card for the same event, illustrated Delhi Durbar military display plus others. An impressive, four bound volumes, being Correspondence concerning particulars, equipment and maintenance of the Camp of the Lieutenant-Governor of Bengal at the Imperial Coronation Durbar at Delhi in 1902-03. This unique collection with correspondence, plans, photos and ephemera relating to the Delhi Durbar of 1903 was collected by Major J. Strachey, Private Secretary to the Lt.-Governor of Bengal. This is an astonishing and comprehensive collection, mostly printed documents relating to all aspects and requirements for the good operatin of this important event. It covers all aspects from committee reports, ordering of native flags, the organising of the military, seating arrangements and protection of dignitaries along with background information about them, arrangements of temporary telegraph offices, camp plans and maps, parade strengths and regulations. A huge amount of information with regard to the camp with orders for tents and fittings, furniture, stoves, eating utensils, etc. Railway transport with examples of the different labels used, a train plan with the seating arrangements for the dignitaries plus the shipment of horses and carriages. A mine of information about the financial accounts with a pencil note indicating that the total cost was R,253,196: receipts from the Army & Navy Co-operative Society, detailed lists of the amount of individual items of food consumed for each day of the camp, guest lists for various dinner parties. A booklet of Notes and Information for Guests, examples of special postmarks, further Camp plans and blueprints, lighting including a plan of a street lamp and examples of the special camp stationery. The final volume with ephemera including postage stamps cancelled by the special postmark, special playing cards (court cards from all four suits), examples of illustrated menus and a fine selection of photographs, both large and small, including the procession, including local dignitaries on elephants, mounted soldiers; general views of the Viceroy’s Camp, Bengal Camp, group picture of the European dignitaries with key, the ‘Drawing Room’ and ‘Dining Room’, group pictures of the Mutiny Veterans and a similar for the native soldiers; a wide range of pictures of the procession at the Durbar with the dressed elephants, elaborate carriages and others. George, Prince of Wales: 1906 part autograph letter, with envelope, to Major Fritz Ponsonby. The royal letterhead is printed “Prince of Wales’s Camp, India.” in black. “with much regret, where we spent a delightful & most interesting time. We certainly had very hard work, but if our visit has been a success & it has done some good we are amply rewarded. I think what Sir H. Fowler said about Curzon is quite correct. He may have done some good things but he also made a great number of mistakes & certainly was one of the most unpopular Viceroys India has had for years. Wait till we meet & I can tell you a lot about it. One of his greatest mistakes was his speech at Bombay just before we left + his letter to the Times was about as bad. Hoping to see you soon & that you are all well at home. Believe me my dear Fritz very sincerely yrs George”. The envelope, carried in the diplomatic bag is addressed to St. James’ Palace and redireced to Buckingham Palace, and initialled “G” in lower corner. Also 1906 (27 Feb.) an autograph signed letter from The Princess of Wales on her special letterhead titled “Prince of Wales’s Camp, India” thanking the recipient for their explanation of all the special buildings in Agra and signed “Victoria Mary”. The letter thanks the Begam for her letter asking to call on the Viceroy in Simla before he left India, he suggests, “ ... It would give Your Highness an unnecessary amount of trouble and discomfort to make this long and tedious journey from Bhopal to Simla at this season of the year”, he adds, “ ... my train shall be stopped at Bhopal station at 3-35 p.m. on 29th April in order that, if the hour will not be inconvenient to your Highness, I may have the pleasure of meeting you there”. Translations of the notes, “My dear colleague, I will happily receive you on whatever day you like, at 6 o’clock, Sunday excepted. Cordially, Émile Zola” and “I shall only be home tomorrow, Monday, after 8 in the evening, and will be pleased, sir, to shake your hand if you can step out at such a late hour. Émile Zola”. It is possible that these invitations were to discuss arrangements for that autumn’s production of Thérèse Raquin in London. Photo Émile Zola (1840-1902), a French novelist, critic, and political activist who was the most prominent French novelist of the late 19th century. He was noted for his theories of naturalism, which underlie his monumental 20-novel series Les Rougon-Macquart, and for his intervention in the Dreyfus Affair through his famous open letter, ‘J’accuse.’ Jacob Thomas Grein moved to London in 1885 and became a naturalised British subject in 1895. His greatest achievement was founding the Independent Theatre Society in 1891. Their first production was Henrik Ibsen’s Ghosts in 1891. Their performances were held as “private” subscription performances, which allowed them to present plays that were not officially licensed by the Lord Chamberlain’s Office. In 1892 the Society produced George Bernard Shaw’s first play, Widowers’ Houses.[2] Grein married the actress Alice Augusta Greeven in 1904; she later wrote and edited a biography of him under the pseudonym Michael Orme WWW.SPINK.COM

This was then sent to Einstein for his signature, and is signed “A.Einstein” at left in a greenish black ink. Photo While Albert Einstein was visiting the United States in 1933, the appointment of Adolf Hitler as chancellor took effect and the Jewish theoretical physicist decided he would not return to his home in Germany where he had been a professor at the Berlin Academy of Sciences. Einstein had been in the US for a visiting professorship at the California Institute of Technology in Pasadena at the time. He and his wife Elsa returned by ship to Belgium in March 1933 to find that that their cottage had been raided. Einstein turned in his passport to the German consulate and formally renounced his German citizenship. By the summer, Einstein learned that his name was on a list of assassination targets. He resided in Belgium for some months and then moved to England for a short period. On October 17, 1933, he returned to the US and took up a position at the Institute for Advanced Study at Princeton, New Jersey. The Princeton agreement required he stay for six months. The letter is signed “De vossa Majestade Boa irma e Prima” (of your majesty good sister and cousin) with her signature “A Rainha” (The Queen). The envelope bears a superb example of her wafer seal. Fresh and fine. Photo Dona Maria II (1819-53) “the Educator” or “the Good Mother”. She was Queen regnant of the Kingdom of Portugal and the Algarves from 1826 to 1828 and again from 1834 to 1853. When Maria’s grandfather King João VI died in March 1826, there was a succession crisis in Portugal. The king had a male heir, Pedro, but Pedro had proclaimed the independence of Brazil in 1822 and he was then Emperor Pedro I of that country. The late king also had a younger son, Miguel, but he was exiled in Austria after leading a number of revolutions against his father and his liberal regime. Before his death, the king had nominated his favourite daughter, Isabel Maria, to serve as regent until “the legitimate heir returned to the Kingdom” - but he had failed to specify which of his sons was the legitimate heir: Peter, the liberal Emperor of Brazil, or Miguel, the absolutist exiled prince. 89

Usual creasing and wafer seal at foot. Photo King Philip II (1527-98) was King of Spain from 1556 and of Portugal from 1581 (as Philip I, Felipe I). From 1554 he was King of Naples and Sicily as well as Duke of Milan. During his marriage to Queen Mary I (1554-58), he was also King of England and Ireland. From 1555, he was lord of the Seventeen Provinces of the Netherlands. Known in Spanish as “Philip the Prudent”, his empire included territories on every continent then known to Europeans, including his namesake the Philippine Islands. During his reign, Spain reached the height of its influence and power. This is sometimes called the Golden Age. The expression, “the empire on which the sun never sets,” was coined during Philip’s time to reflect the extent of his dominion. With the original envelope and an additional portrait card which he has also signed and dated. Photo Sven Anders Hedin (1865-1952) was a Swedish geographer, topographer, explorer, photographer, travel writer, and illustrator of his own works. During four expeditions to Central Asia, he made the Trans-himalaya known in the West and located sources of the Brahmaputra, Indus and Sutlej Rivers. He also mapped Lake Lop Nur, and the remains of cities, grave sites and the Great Wall of China in the deserts of the Tarim Basin. 1870 (c.) short letter on her special stationery which features the embossed crown of Egypt in red and gold displayed by the corner folded back with a printed pin and elaborately letters “Nazli” printed in gold. She writes, “Dear Mrs Goshen, I shall be most happy to see you tomorrow at about 4 p.m. Yours sincerely Nazli - Monday afternoon.” Folded vertically and some minor crumpling toward the foot. A fine example of this delightful and charming letterhead. Photo Princess Zainab Nazli Khanum Effendi (Princess Nazli Fazl) (1853-1913) was an Egyptian princess from the dynasty of Muhammad Ali of Egypt. She was born in Istanbul, the eldest child of Mustafa Fazl Pasha, son of Ibrahim Pasha of Egypt and brother of the future Khedive Isma’il Pasha, and Dilazad Hanim. Her mother was Dil-azad Khanum Effendi. At the age of 13, she left Egypt for Istanbul upon her father’s falling out with his brother, the Khedive, in 1866. In Istanbul, she was highly educated, against prevailing tradition, and entertained foreign visitors. A well educated and cultured lady who spoke Turkish, Arabic, French and English, and also Italian and German. In December 1872, she married Turkish ambassador Halil Serif Pasa (Khalil Bey), and moved briefly to Paris with him in 1873 WWW.SPINK.COM

1906-08 a group of five intimate letters to the Khedive of Egypt. Written in her bold hand on different personal paper, two are registered to Franzensbad in Austria with her wax seal on the reverse, a deep blue letter-card from Palais de Koubba and one without envelope. Written in French, the letters are signed “Coco” (3) or “Fa petite Filly”. The last letter is from letterhead of Koubbeh les Bains and is with the original envelope (stamp removed). A delightful group. Photo Marianna Török de Szendro (1877-1968). Daughter of Sofie Countess Vetter von der Lilie and stepdaughter of Hungarian inventor Tivadar Puskás. She spent most of her youth at Wassen Castle South of Graz, Austria. Her elder brother Count József Török de Szendro (1873-98), following Austrian tradition, was enrolled at the Theresianum, where he befriended Abbas Bey, an Egyptian prince. Marianna and Abbas met at a ball given by the Academy. Shortly thereafter, he was made ruler in Egypt. They met the second time in Paris in 1900, where they fell in love, and Abbas invited her to Egypt. The visit developed into a long romance culminating into a secret marriage contracted in Alexandria’s Montazah Palace, witnessed by two sheiks. The official marriage took place on February 28, 1910

Field Marshal Horatio Herbert Kitchener, 1st Earl Kitchener (1850-1916) was a senior British Army officer and colonial administrator who won fame for his imperial campaigns and later played a central role in the early part of World War I, although he died halfway through it. Having become Sirdar (Commander-in-Chief) of the Egyptian Army with the local rank of brigadier in April 1892, he won victories at the Battle of Ferkeh in June 1896 and the Battle of Hafir in September 1896 earning him national fame in the United Kingdom and promotion to major-general on 25 September 1896. He achieved further successes at the Battle of Atbara in April 1898 and then the Battle of Omdurman in September 1898. He quite possibly prevented war between France and Britain when he dealt firmly but non-violently with the French military expedition, under Captain Marchand, intending to claim Fashoda, in what became known as the Fashoda Incident (See Spink auction 15 November 2013, lot 2098) 151

1907 (4 April) autograph letter to the Khedive from Lord Cromer on British Agency letterhead, written in French and signed “Cromer”. With the original, stampless envelope with Cromer’s initial in the corner. Photo Evelyn Baring, 1st Earl of Cromer (1841-1917), was a British statesman, diplomat and colonial administrator. He was British controller-general in Egypt during 1879, part of the international Control which oversaw Egyptian finances after the khedives’ mismanagement, and during the British occupation prompted by the Urabi revolt, agent and consul-general in Egypt from 1883 to 1907. Cromer ran the territory with great drive and his effective governance inhibited British intentions to withdraw from Egypt

General Sir Francis Reginald Wingate, 1st Baronet (1861-1953) was a British general and administrator in Egypt and the Sudan. As director of military intelligence he served in the campaigns of 1896-98 which resulted in the reconquest of the Sudan. In 1917, Wingate succeeded Sir Henry McMahon as High Commissioner in Egypt, a post he held until 1919. He was not a successful administrator in the very different political climate in that country

He thanks the Khedive for his good wishes and notes, “ ...It is a great pleasure to me to spend Xmas in this charming country where I experience so much kindness on all sides”. With the original letter which was hand delivered. Some minor age marks. Photo Sir Eldon Gorst KCB (1861-1911) was Consul-General in Egypt from 1907-11. After the Liberal Party came to power, the British government sent Gorst to replace Cromer with instructions to give Egyptians greater responsibility to manage their internal affairs. 1944 (9 March) a letter from the King of Jordan to all his subjects. It reads, “From Abdullah bin al-Hussein, Prince of East Jordan, by God’s grace and success. To our beloved subjects (including non-Muslims without exception). We are prepared to announce our wish of PEACE. The Dutch Government has appointed Mr H.D. Bornstein as Honorary Consul for Holland in East Jordan, in compliance with the order of October 28th 1943. We approve this appointment and inform you of our wish for a successful meeting for Mr H.D. Bornstein and help his mission regarding the discussions, rights and privileges with the participants in that meeting. This document is issued from our office in the Jordan Palace on Thursday 14th of the 3rd month of the Muslim year of 1363, corresponding to 9th of March 1944 in the Christian calendar. According to the Royal Order signed Taufic Pasha Prime Minister & Foreign Minister Signed Sir Harold Macmichael The High Commissioner of Great Britain in the Middle East” Signed in red ink at top by the King. A rare and important document related to the early attempt to divide Mandate Palestine into two States. Photo King Abdullah bin Al-Hussein, 1883-1951, founder of the Hashemite Kingdom of Jordan. The King supported the Peel Commission’s report of 1937 which proposed that Palestine be split into a small Jewish state (20% of the British Mandate for Palestine) and the remaining land be annexed to Transjordan. The Jews reluctantly accepted this but the surrounding Arab countries rejected it. This document is a reminder of the attempts in the interim to move towards peace with the Jewish Colonies (The Yishuv), in Palestine. When the United Nations supported a partition of Palestine in 1947, Abdullah was the only Arab leader to support the decision. Abdullah, alone among the Arab leaders of his generation, was considered a moderate by the West. It was possible that he may have been willing to sign a separate peace agreement with the pre and post State of Israel

Also two similar size documents to The Great Governors of Tangiers and Mogador informing them that General Seager had been appointed to present their congratulations to the Imperial Majesty’s the Emperor of Morocco. Also two supporting documents, one signed by John Richard Summers Vine that he witnessed the signatures on the previous document, also signed by the Lord Mayor with Justice Room 1/6d. revenue and impressed general duty 2/6d., and another document signed by Andrew Lusk, the Lord Mayor with the Mayor’s seal. 1843 (6 February) letter written in Portuguese, to “The Very High and Very Powerful Prince Fernando II, King of the Two Sicilies, my good cousin brother and brother in law”, signed “Pedro”. The wrapper without postal markings and with plain red wax seal on the reverse. A rare letter from Pedro the magnificent who ruled Brazil for 58 years. Photo Dom Pedro II (1825-91), nicknamed “the Magnanimous”, he was the second and last ruler of the Empire of Brazil, reigning for over 58 years. Born in Rio de Janeiro, he was the seventh child of Emperor Dom Pedro I of Brazil and Empress Dona Maria Leopoldina and thus a member of the Brazilian branch of the House of Braganza. His father’s abrupt abdication and flight to Europe in 1831 left a five-year-old Pedro II as Emperor and led to a grim and lonely childhood and adolescence. Obliged to spend his time studying in preparation for rule, he knew only brief moments of happiness and encountered few friends of his age. His experiences with court intrigues and political disputes during this period greatly affected his later character. Pedro II grew into a man with a strong sense of duty and devotion toward his country and his people. On the other hand, he increasingly resented his role as monarch

1929 special menu card for a celebration dinner at The Ambassador, Los Angeles. The menu entitled “Banquet in Honor of Dr Hugo Eckener, The Officers and Passengers of the Graf Zeppelin, Tendered by Los Angeles Examiner and Affiliated Hearst Publications at The Ambassador, Los Angeles, During the course of the epoch-making Hearst Zeppelin Around the World Flight”. The front cover is a silver embossed illustration of the Zeppelin and Arms of the Hotel. On opening the menu, there are some signatures and comments by guests. The centre page, in gothic script, each course dedicated to an individual on the flight. On the left of the page is the signature of Lieutenant Commander Kusaka Ryunosuke. Size 6” x 9”; folded. Photo Lieutenant Commander Kusaka Ryunosuke had graduated from the Japanese Naval Staff College in 1925 as a specialist in Naval Aviation. By 1941 he had commanded two of Japanese Aircraft Carriers (Hoso and Akagai) but was promoted to Chief of Staff of the 1st Air Fleet in April taking part and being instrumental in the strategic and tactical planning for the Pearl Harbour attack. TERMS AND CONDITIONS FOR BUYERS These conditions set out the terms on which we (Spink and Son Limited of 69 Southampton Row, Bloomsbury London WC1B 4ET (company no. 04369748)) contract with you (Buyer) either as agent on behalf of the Seller or as principal if we are the Seller. You should read these conditions carefully. 1

DEFINITIONS The following definitions apply in these conditions: Auctioneers’ Margin Scheme means a VAT margin scheme as defined by HM Revenue & Customs; Buyer’s Premium means the charge payable by you as a percentage of the Hammer Price, at the rates set out in clause 5.1 below; Certificate of Authenticity means a certificate issued by an Expert Committee confirming the authenticity of a Lot; Expert Committee means a committee of experts to whom a Lot may be sent for an extension in accordance with clause 3.4.3; Forgery means a Lot constituting an imitation originally conceived and executed as a whole with a fraudulent intention to deceive as to authorship, origin, age, period, culture or source where the correct description as to such matters is not reflected by the description in the catalogue and which at the date of the auction had a value materially less than it would have had if it had been in accordance with the description in the catalogue. Accordingly, no Lot shall be capable of being a Forgery by reason of any damage and/or restoration work of any kind (including re-enamelling); Hammer Price means the amount of the highest bid accepted by the auctioneer in relation to a Lot; Lot means any item deposited with us for sale at auction and, in particular, the item or items described against any Lot number in any catalogue; Reserve the amount below which we agree with the Seller that the Lot cannot be sold; Seller means the owner of the Lot being sold by us; Spink Group Spink and Son Limited, our subsidiaries and associated companies. VAT value added tax chargeable under VAT and any similar replacement or additional tax; and VAT Symbols means the symbols detailing the VAT status of the Lot details of which are set out at the back of the catalogue.

3.4.3 If we accept a request for an expert opinion or Certificate of Authenticity we will submit the Lot to the Expert Committee. You acknowledge and accept that the length of time taken by an Expert Committee to reach an opinion will vary depending on the circumstances and in any event is beyond our control.

All sales undertaken by us either at auction or privately are undertaken either as agent on behalf of the Seller or from time to time, as principal if we are the owner of the Lot. Please note that even if we are acting as agent on behalf of the Seller rather than as principal, we may have a financial interest in the Lot.

3.4.4 We will not accept a request for an extension on account of condition. Any Lot described in the catalogue as having faults or defects may not be returned even if an expert opinion or Certificate of Authenticity cites other faults or defects not included in the catalogue description, other than in the case of a Forgery.

The contract for the sale of the Lot will be between you and the Seller.

BEFORE THE SALE 3.1

Examination of goods You are strongly advised to examine personally any goods in which you are interested, before the auction takes place. Condition reports are usually available on request. We provide no guarantee to you other than in relation to Forgeries, as set out in clause 5.13 of these Terms and Conditions.

3.4.5 Should Spink accept a request for an extension under the foregoing provisions of this paragraph, the fact may be stated by the Auctioneer from the rostrum prior to the sale of the Lot. 3.4.6 It should be noted that any stamp accompanied by a Certificate of Authenticity is sold on the basis of that Certificate only and not on the basis of any other description or warranty as to authenticity. No request for an extension will be accepted on such a stamp and the return of such a stamp will not be accepted.

Catalogue descriptions 3.2.1 Statements by us in the catalogue or condition report, or made orally or in writing elsewhere, regarding the authorship, origin, date, age, size, medium, attribution, genuineness, provenance, condition or estimated selling price of any Lot are merely statements of opinion, and are not to be relied on as statements of definitive fact. Catalogue and web illustrations are for guidance only, and should not be relied on either to determine the tone or colour of any item. No lot shall be rejected on the grounds of inaccurate reproduction. No lot illustrated in the catalogue and online shall be rejected on the grounds of cancellation, centring, margins, perforation or other characteristics apparent from the illustration. Estimates of the selling price should not be relied on as a statement that this price is either the price at which the Lot will sell or its value for any other purpose. 3.2.2 Many items are of an age or nature which precludes their being in perfect condition and some descriptions in the catalogue or given by way of condition report make reference to damage and/or restoration. We provide this information for guidance only and the absence of such a reference does not imply that an item is free from defects or restoration nor does a reference to particular defects imply the absence of any others.

3.4.7 If you receive any correspondence from the Expert Committee in relation to the Lot, including but not limited to a Certificate of Authenticity, you must provide us with copies of such correspondence no later than 7 days after you receive such correspondence. 4

AT THE SALE 4.1

Refusal of admission Our sales usually take place on our own premises or premises over which we have control for the sale, and we have the right, exercisable at our complete discretion, to refuse admission to the premises or attendance at an auction.

4.2

Registration before bidding You must complete and sign a registration form and provide identification before making a bid at auction. Please be aware that we usually require buyers to undergo a credit check. If you have not bid successfully with Spink in the past, or you are registering with us for the first time, we reserve the right to require a deposit of up to 50% of the amount you intend to spend. Such deposit will be deducted from your invoice should you be successful. If you are unsuccessful at auction, your deposit will be returned by the same means it was paid to Spink. Some lots may be designated, prior to the auction, as “Premium Lots”, which means a deposit may be required before placing a bid on the item for sale. Information will be posted on our website in such an event.

4.3

Bidding as Principal When making a bid (whether such bids are made in person or by way of telephone bids operated by Spink, commission or online or email bids), you will be deemed to be acting as principal and will be accepting personal liability, unless it has been agreed in writing, at the time of registration, that you are acting as agent on behalf of a third party buyer acceptable to us.

4.4

Commission Bids If you give us instructions to bid on your behalf, by using the form provided in our catalogues or via our website, we shall use reasonable endeavours to do so, provided these instructions are received not later than 24 hours before the auction. If we receive commission bids on a particular Lot for identical amounts, and at auction these bids are the highest bids for the Lot, it will be sold to the person whose bid was received first. Commission bids are undertaken subject to other commitments at the time of the sale, and the conduct of the auction may be such that we are unable to bid as requested. Since this is undertaken as a free service to prospective buyers on the terms stated, we cannot accept liability for failure to make a commission bid. You should therefore always attend personally if you wish to be certain of bidding.

3.2.3 Other than as set out in clause 5.13, and in the absence of fraud, neither the Seller nor we, nor any of our employees or agents, are responsible for the correctness of any statement as to the authorship, origin, date, age, attribution, genuineness or provenance of any Lot nor for any other errors of description or for any faults or defects in any Lot. Every person interested should exercise and rely on his own judgment as to such matters. 3.3

Your Responsibility You are responsible for satisfying yourself as to the condition of the goods and the matters referred to in the catalogue description.

3.4

Extensions – Stamps only 3.4.1 If you wish to obtain an expert opinion or Certificate of Authenticity on any Lot (other than a mixed Lot or Lot containing undescribed stamps) you must notify us in writing not less than forty-eight hours before the time fixed for the commencement of the first session of the sale. If accepted by us, such request shall have the same effect as notice of an intention to question the genuineness or description of the Lot for the purposes of clause 5.13 (Refund in the case of Forgery) of these Terms and Conditions and the provisions of clause 5.13 (Refund in the case of Forgery) shall apply accordingly. 3.4.2 Notice of a request for an expert opinion or Certificate of Authenticity must give the reason why such opinion is required and specify the identity of your proposed expert which will be subject to agreement by us. We reserve the right, at our discretion, to refuse a request for an expert opinion or Certificate of Authenticity including (without limitation) where the proposed expert is not known to us.

4.5

On-line Bidding We offer internet services as a convenience to our clients. We will not be responsible for errors or failures to execute bids placed on the internet, including, without limitation, errors or failures caused by (i) a loss of internet connection by either party for whatever reason; (ii) a breakdown or problems with the online bidding software and/or (iii) a breakdown or problems with your internet connection, computer or system. Execution of on-line internet bids on www.spink.com and Spink Live is a free service undertaken subject to other commitments at the time of the auction and we do not accept liability for failing to execute an online internet bid or for errors or omissions in connection with this activity. Buyers who acquire lots on the-saleroom.com will have a fee of 3% on the hammer price added to their invoice for using this facility.

4.6

Telephone Bids If you make arrangements with us not less than 24 hours before the sale, we shall use reasonable endeavours to contact you to enable you to participate in bidding by telephone, but in no circumstances will we be liable to either the Seller or you as a result of failure to do so.

4.7

Currency Converter At some auctions, a currency converter will be operated, based on the one month forward rates of exchange quoted to us by Barclays Bank Plc or any other appropriate rate determined by us, at opening on the date of the auction. Bidding will take place in a currency determined by us, which is usually sterling for auctions held in London. The currency converter is not always reliable, and errors may occur beyond our control either in the accuracy of the Lot number displayed on the converter, or the foreign currency equivalent of sterling bids. We shall not be liable to you for any loss suffered as a result of you following the currency converter.

4.8

Video images At some auctions there will be a video screen. Mistakes may occur in its operation, and we cannot be liable to you regarding either the correspondence of the image to the Lot being sold or the quality of the image as a reproduction of the original.

4.9

4.10 Bidding by Spink 4.10.1 We reserve the right to bid on Lots on the Seller’s behalf up to the amount of the Reserve (if any), which will never be above the low estimate printed in the auction catalogue. 4.10.2 The Spink Group reserves the right to bid on and purchase Lots as principal. 4.11 The Auctioneer’s Discretion The auctioneer has the right at his absolute discretion to refuse any bid to advance the bidding in such manner as he may decide to withdraw or divide any Lot, to combine any two or more Lots and, in the case of error or dispute, to put an item up for bidding again. 4.12 Successful Bid Subject to the auctioneer’s discretion, the striking of his hammer marks the acceptance of the highest bid, provided always that such bid is higher than the Reserve (where applicable), and the conclusion of a contract for sale between you and the Seller. 4.13 After Sale Arrangements If you enter into any private sale agreements for any Lot with the Seller within 60 days of the auction, we, as exclusive agents of the Seller reserve the right to charge you the applicable Buyer’s Premium in accordance with these Terms and Conditions, and the Seller a commission in accordance with the terms of the Seller’s agreement. 4.14 Return of Lot 4.14.1 Once your bid has been accepted for a Lot then you are liable to pay for that Lot in accordance with these Terms and Conditions. If there are any problems with a Lot then you must notify us within 7 days of receipt of the Lot, specifying the nature of the problem. We may then request that the Lot is returned to us for inspection. Save as set out in clause 5.13, the cancellation of the sale of any Lot and the refund of the corresponding purchase price is entirely at our sole discretion. We will not normally exercise that discretion if the Lot is not received by us in the same condition that it was in at the auction date. 4.14.2 No lot may be returned on account of condition if the condition was stated by a third party grading company (including, but not limited to PCGS, NGC, ANACS, ICG, PMG, WBG). 5

AFTER THE AUCTION 5.1 Buyer’s Premium and other charges In addition to the Hammer Price, you must pay us the Buyer’s Premium at a rate of 20% of the final Hammer price of each lot, a fee of 3% on the hammer price total for using the-saleroom.com and a fee for paying by credit card.

5.4

Value Added Tax Other than in respect of Zero-rated Lots (o) VAT is chargeable on the Hammer price and the Buyer’s premium of daggered (†) and (Ω) lots at the standard rate (currently 20%), and on lots marked (x) at the reduced rate (currently 5% on the Hammer price and 20% on the Buyer’s premium). VAT on Margin scheme lots (identified by the absence of any VAT symbol next to the lot number) is payable at 20% on the Buyer’s premium only. VAT Refunds General 5.3.1 As we remain liable to account for VAT on all Lots unless they have been exported outside the EU within 3 months of the date of sale, you will generally be asked to deposit all amounts of VAT invoiced. However, if a Spink nominated shipper is instructed, then any refundable VAT will not be collected. In all other cases credits will be made when proof of export is provided. If you export the Lot yourself you must obtain shipping documents from the Shipping Department for which a charge of £50 will be made. 5.3.2 If you export the Lot you must return the valid proof of export certificate to us within 3 months of the date of sale. If you fail to return the proof of export certificate to us within such period and you have not already accounted to us for the VAT, you will be liable to us for the full amount of the VAT due on such Lot and we shall be entitled to invoice you for this sum. 5.3.3 To apply for a refund of any VAT paid, the proof of export certificate must be sent to our Shipping Department clearly marked ‘VAT Refund’ within 3 months of the date of sale. No payment will be made where the total amount of VAT refundable is less than £50 and Spink will charge £50 for each refund processed. VAT Refunds - Buyers from within the EU 5.3.4 VAT refunds are available on the Hammer Price and Buyer’s Premium of Daggered (†) and Investment Gold (g) Lots. You must certify that you are registered for VAT in another EU country and that the Lot is to be removed from the United Kingdom within 3 months of the date of sale. 5.3.5 Where an EU buyer purchases a Lot on which import VAT has been charged, no refund of VAT is available from us. It may be possible to apply directly for a refund on form VAT 65 to HM Revenue & Customs Overeseas Repayment Section, Londonderry. VAT Refunds – Buyers from outside the EU 5.3.6 Where a Lot is included within the Auctioneers’ Margin Scheme and evidence of export from the EU is produced within 3 months of the date of sale, the VAT on Buyer’s Premium may be refunded. 5.3.7 Where the Lot is marked as a Daggered (†) or Investment Gold (g) Lot the VAT charged on the Hammer Price may be refunded where evidence of export from the EU is produced within 3 months of the date of sale. A refund of VAT charged on the Buyer’s Premium can also be made on receipt of proof of business as a collectibles dealer. 5.3.8 Where the Lot is marked as an Omega (Ω) Lot or an Import VAT (x) Lot and evidence of export from the EU is produced within 3 months of the date of sale, the VAT charged on both the Hammer Price and Buyer’s Premium may be refunded. Where required, we can advise you on how to export such Lots as a specific form of export evidence is required. Where we advise you on the export of the Lots, please be aware that the ultimate responsibility in respect of obtaining a valid proof of export certificate will lie with you and we will not be responsible for your failure to obtain such certificate. Payment 5.4.1 You must provide us with your full name and permanent address and, if so requested, details of the bank from which any payments to us will be made. You must pay the full amount due (comprising the Hammer Price, the Buyer’s Premium and any applicable VAT) within seven days after the date of the sale. This applies even if you wish to export the Lot and an export licence is (or may be) required. 5.4.2 You will not acquire title to the Lot until all amounts due have been paid in full. This includes instances where special arrangements were made for release of Lot prior to full settlement. 5.4.3 Payment should be made in sterling by one of the following methods: II(i) Direct bank transfer to our account details of which are set out on the invoice. All bank charges shall be met by you. Please ensure that your client number is noted on the transfer. i(ii) By cheque or bank draft made payable to Spink and Son Ltd and sent to Spink at 69 Southampton Row, Bloomsbury, London WC1B 4ET. Please note that the processing charges for payments made by cheques or bank drafts drawn on a non-U.K bank shall be met by you. Please ensure that the remittance slip printed at the bottom of the invoice is enclosed with your payment. (iii) By Visa or Mastercard. A fee of 2% will be applied. Payments made by American Express are subject to a 4% fee. Payments exceeding £5,000 can normally only be made by the card holder in person whilst on our premises. 5.4.4 Payments should be made by the registered buyer and not by third parties, unless it has been agreed at the time of registration that you are acting as an agent on behalf of a third party.

Invoices Invoices may consist of one or more pages and will show: Zero rated Lots (o); no symbol Lots sold under the Auctioneers’ Margin Scheme; Lots marked (g) special scheme Investment Gold; Daggered Lots (†), imported Lots marked (x) and (Ω), (e) Lots with Zero rated hammer for EU VAT registered buyers. 5.6 Collection of Purchases 5.6.1 Unless specifically agreed to the contrary, we shall retain lots purchased until all amounts due to us, or to the Spink Group, have been paid in full. Buyers will be required to pay for their lots when they wish to take possession of the same, which must be within 7 days of the date of the sale, unless prior arrangements have been made with Spink. Without prior agreement, lots will not be released until cleared funds are received with regard to payments made by cheque. 5.6.2 Unless we notify you to the contrary, items retained by us will be covered in accordance with our policy which is available for inspection at our offices from the date of sale for a period of seven days or until the time of collection, whichever is sooner. After seven days or from the time of collection, whichever is the earlier, the Lot will be entirely at your risk. 5.6.3 Our policy will not cover and we are unable to accept responsibility for damage caused by woodworm, changes in atmospheric conditions or acts of terrorism. 5.7 Notification We are not able to notify successful bidders by telephone. While Invoices are sent out by mail after the auction we do not accept responsibility for notifying you of the result of your bid. You are requested to contact us by telephone or in person as soon as possible after the auction to obtain details of the outcome of your bids to avoid incurring charges for late payment. 5.8 Packing and handling 5.8.1 We shall use all reasonable endeavours to take care when handling and packing a purchased Lot but remind you that after seven days or from the time of collection, whichever is sooner, the Lot is entirely at your risk. Our postage charges are set out at the back of the catalogue. 5.8.2 It is the responsibility of the Buyer to be aware of any Import Duties that may be incurred upon importation to the final destination. Spink will not accept return of any package in order to avoid these duties. The onus is also on the Buyer to be aware of any Customs import restrictions that prohibit the importation of certain collectibles. Spink will not accept return of the Lot(s) under these circumstances. Spink will not accept responsibility for Lot(s) seized or destroyed by Customs. 5.8.3 If the Buyer requires delivery of the Lot to an address other than the invoice address this will be carried out at the discretion of Spink. 5.9 Recommended packers and shippers If required our shipping department may arrange shipment as your agent. Although we may suggest carriers if specifically requested, our suggestions are made on the basis of our general experience of such parties in the past and we are not responsible to any person to whom we have made a recommendation for the acts or omissions of the third parties concerned. 5.10 Remedies for non-payment or failure to collect purchases 5.10.1 If you fail to make payment within seven days of your stipulated payment date set out in your invoice, we shall be entitled to exercise one or more of the following rights or remedies: 5.10.1.1 to charge interest at the rate of 2% per month compound interest, calculated on a daily basis, from the date the full amount is due; 5.10.1.2 to set off against any amounts which the Spink Group may owe you in any other transaction the outstanding amount remaining unpaid by you; 5.10.1.3 we may keep hold of all or some of your Lots or other property in the possession of the Spink Group until you have paid all the amounts you owe us or the Spink Group, even if the unpaid amounts do not relate to those Lots or other property. Following fourteen days’ notice to you of the amount outstanding and remaining unpaid, the Spink Group shall have the right to arrange the sale of such Lots or other property. We shall apply the proceeds in discharge of the amount outstanding to us or the Spink Group, and pay any balance to you; 5.10.1.4 where several amounts are owed by you to the Spink Group in respect of different transactions, to apply any amount paid to discharge any amount owed in respect of any particular transaction, whether or not you so direct; 5.10.1.5 to reject at any future auction any bids made by you or on your behalf or obtain a deposit from you before accepting any bids. 5.10.2 If you fail to make payment within thirty-five days, we shall in addition be entitled: 5.10.2.1 to cancel the sale of the Lot or any other item sold to you at the same or any other auction; 5.10.2.2 to arrange a resale of the Lot, publicly or privately, and, if this results in a lower price being obtained, claim the balance from you together with all reasonable costs including a 20% seller’s commission, expenses, damages, legal fees, commissions and premiums of whatever kind associated with both sales or otherwise, incurred in connection with your failure to make payment;

5.10.2.3 when reselling the Lot, place a notice in our catalogue stating that you successfully purchased the Lot at auction but have subsequently failed to pay the Hammer Price of the Lot; or 5.10.2.4 take any other appropriate action as we deem fit. 5.10.3 If you fail to collect within fourteen days after the sale, whether or not payment has been made, you will be required 5.10.3.1 to pay a storage charge of £2 per item per day plus any additional handling cost that may apply. 5.10.3.2 you will not be entitled to collect the Lot until all outstanding charges are met, together with payment of all other amounts due to us. 5.11 Uses of default information If you fail to make payment for a Lot in accordance with these Terms and Conditions: 5.11.1 We reserve the right to refuse you the right to make bids for any future auction irrespective of whether previous defaults have been settled; and 5.11.2 You consent to us disclosing details of such default to other auctioneers and live bidding platforms, which will include your name, address, nature of the default and the date of the default. Auctioneers or live bidding platforms who receive details of the default may rely on such information when deciding whether to enter into a transaction with you in the future. 5.12 Export Licence 5.12.1 If required we can, at our discretion, advise you on the detailed provisions of the export licensing regulations. Where we advise you in relation to export licensing regulations the ultimate responsibility in respect of any export will lie with you and we will not be responsible for your failure to apply for any necessary licences. 5.12.2 If the Lot is going to be hand carried by you, you may be required to produce a valid export licence to us or sign a waiver document stating that a licence will be applied for. 5.12.3 You should always check whether an export licence is required before exporting. Export licences are usually obtained within two or three weeks but delays can occur. 5.12.4 Unless otherwise agreed by us in writing, the fact that you wish to apply for an export licence does not affect your obligation to make payment within seven days nor our right to charge interest on late payment. 5.12.5 If you request that we apply for an export licence on your behalf, we shall be entitled to recover from you our disbursements and out of pocket expenses in relation to such application, together with any relevant VAT. 5.12.6 We will not be obliged to rescind a sale nor to refund any interest or other expenses incurred by you where payment is made by you despite the fact that an export licence is required. 5.13 Refund in the case of Forgery 5.13.1 A sale will be cancelled, and the amount paid refunded to you if a Lot (other than a miscellaneous item not described in the catalogue) sold by us proves to have been a Forgery. We shall not however be obliged to refund any amounts if either (a) the catalogue description or saleroom notice at the auction date corresponded to the generally accepted opinion of scholars or experts at that time, or fairly indicated that there was a conflict of opinions, or (b) it can be demonstrated that the Lot is a Forgery only by means of either a scientific process not generally accepted for use until after publication of the catalogue or a process which at the date of the auction was unreasonably expensive or impracticable or likely to have caused damage to the Lot. Furthermore, you should note that this refund can be obtained only if the following conditions are met: 5.13.1.1 you must notify us in writing, within seven days of the receipt of the Lot(s), that in your view the Lot concerned is a Forgery; 5.13.1.2 you must then return the item to us within fourteen days from receipt of the Lot(s), in the same condition as at the auction date; and 5.13.1.3 as soon as possible following return of the Lot, you must produce evidence satisfactory to us that the Lot is a Forgery and that you are able to transfer good title to us, free from any third party claims. 5.13.1.4 you must provide to us all evidence obtained by you that a Lot is a Forgery no later than 7 days after you receive such evidence. 5.13.2 In no circumstances shall we be required to pay you any more than the amount paid by you for the Lot concerned and you shall have no claim for interest. 5.13.3 The benefit of this guarantee is not capable of being transferred, and is solely for the benefit of the person to whom the original invoice was made out by us in respect of the Lot when sold and who, since the sale, has remained the owner of the Lot without disposing of any interest in it to any third party. 5.13.4 We shall be entitled to rely on any scientific or other process to establish that the Lot is not a Forgery, whether or not such process was used or in use at the date of the auction. 6

LIABILITY Nothing in these Terms and Conditions limits or excludes our liability for: 6.1 death or personal injury resulting from negligence; or 6.2 any damage or liability incurred by you as a result of our fraud or fraudulent misrepresentation.

USE OF YOUR PERSONAL INFORMATION 7.1 We will use the personal information you provide to us to: 7.1.1 process the bids you make on Lots (whether successful or otherwise) and other auction related services we provide; 7.1.2 process your payment relating to a successful purchase of a Lot; 7.1.3 arrange for delivery of any Lot you purchase, which will include passing your details to shipping providers and, on overseas deliveries, to customs where they make enquiries regarding the Lot; 7.1.4 inform you about similar products or services that we provide, but you may stop receiving these at any time by contacting us. 7.2 In accordance with clause 4.2, you agree that we may pass your information to credit reference agencies and that they may keep a record of any search that they do. 7.3 In accordance with clause 5.11, you agree that where you default on making payment for a Lot in accordance with these terms and conditions we may disclose details of such default to other auctioneers and live bidding platforms. 7.4 We are also working closely with third parties (including, for example, other auctioneers and live bidding platforms) and may receive information about you from them. COPYRIGHT 8.1 We shall have the right (on a non-exclusive basis) to photograph, video or otherwise produce an image of the Lot. All rights in such an image will belong to us, and we shall have the right to use it in whatever way we see fit. 8.2 The copyright in all images, illustrations and written material relating to a Lot is and shall remain at all times our property and we shall have the right to use it in whatever way we see fit. You shall not use or allow anyone else to use such images, illustrations or written material without our prior written consent. VAT You shall give us all relevant information about your VAT status and that of the Lot to ensure that the correct information is printed in the catalogues. Once printed, the information cannot be changed. If we incur any unforeseen cost or expense as a result of the information being incorrect, you will reimburse to us on demand the full amount incurred.

10 NOTICES All notices given under these Terms and Conditions may be served personally, sent by 1st class post, or faxed to the address given to the sender by the other party. Any notice sent by post will be deemed to have been received on the second working day after posting or, if the addressee is overseas, on the fifth working day after posting. Any notice sent by fax or served personally will be deemed to be delivered on the first working day following despatch. 11 ADDITIONAL PROVISIONS The following provisions of this clause 10 shall apply only if you are acting for the purposes of your business. 11.1 Limitation of Liability Subject to clause 6, we shall not be liable, whether in tort (including for negligence) or breach of statutory duty, contract, misrepresentation or otherwise for any: 11.1.1 loss of profits, loss of business, depletion of goodwill and/or similar losses, loss of anticipated savings, loss of goods, loss of contract, loss of use, loss of corruption of data or information; or 11.1.2 any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses. 11.2 Severability If any part of these Terms and Condition is found by any court to be invalid, illegal or unenforceable, that part may be discounted and the rest of the conditions shall continue to be valid and enforceable to the fullest extent permitted by law. 11.3 Force majeure We shall have no liability to you if we are prevented from, or delayed in performing, our obligations under these Terms and Conditions or from carrying on our business by acts, events, omissions or accidents beyond our reasonable control, including (without limitation) strikes, lock-outs or other industrial disputes (whether involving our workforce or the workforce of any other party), failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors. 11.4 Waiver 11.4.1 A waiver of any right under these Terms and Conditions is only effective if it is in writing and it applies only to the circumstances for which it is given. No failure or delay by a party in exercising any right or remedy under these Terms and Conditions or by law shall constitute a waiver of that (or any other) right or remedy, nor preclude or restrict its further exercise. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that (or any other) right or remedy. 11.4.2 Unless specifically provided otherwise, rights arising under these Terms and Conditions are cumulative and do not exclude rights provided by law.

11.5 Law and Jurisdiction 11.5.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by, and construed in accordance with, the law of England and Wales. 11.5.2 The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of, or in connection with, Terms and Conditions or their subject matter.

Value Added Tax (VAT) Charging of (VAT) at Auction The information shown on this page sets out the way in which Spink intends to account for VAT. i.

Auctioneers’ Margin Scheme 1. Where possible, we will offer Lots for sale under the Auctioneers’ Margin Scheme. Such Lots can be identified by the absence of any VAT symbol next to the Lot number in the catalogue and will not be subject to VAT on the Hammer Price. 2. Where Lots are sold using the Auctioneers’ Margin Scheme to UK VAT–registered businesses, the VAT on Buyers’ Premium is not recoverable as input tax. Upon request on sale day, we will issue invoices that show VAT separately on both the Hammer Price and the Buyer’s Premium. This will enable VAT-registered businesses to recover the VAT charged as input tax, subject to the normal rules for recovering input tax.

ii.

Zero-Rated Lots Limited Categories of goods, such as books, are Zero-rated (o) for VAT in the United Kingdom. Such Lots are offered under the Auctioneers’ Margin Scheme. In these circumstances no VAT will be added to the Buyer’s premium.

iii.

Daggered Lots Lots which are Daggered (†) in the catalogue are subject to VAT at 20% on both the Hammer Price and the Buyer’s Premium.

iv.

Imported and Omega Lots Lots which are marked (x) in the catalogue are subject to VAT at 5% on the Hammer price plus 20% on the Buyer’s premium. Lots which bear the Omega symbol (Ω) are subject to VAT at 20% on the Hammer Price and on the Buyer’s Premium. This VAT is payable on items imported from outside the EU. In these cases we have used a temporary importation procedure, which in effect means that the point of importation is deferred until the Lot has been sold. At this point the Buyer is treated as the importer and is liable to pay the import VAT due. We will collect the VAT from you and pay it to HM Customs and Excise on your behalf.

Investment Gold Lots Lots marked (g) in the catalogue are exempt from VAT on the Hammer Price and are subject to VAT at 20% on the Buyer’s Premium. A refund of VAT charged on the Buyer’s Premium can also be made on receipt of proof of business as a collectibles dealer outside of the EU.
