A grand major ity of graphic designers do not understand or

implement contracts within their work. Contracts are the basic level of

protection for graphic designers. The current fight against this dilemma

12

is Online templates ; great for those who already understand contracts,

13

but leaving many readers scratching their heads.

through understanding, develop the ability to read contracts presented

to them and wr ite outgoing contracts for freelance client work. This new

W hile many publications, most noticeably the AIGA STA NDA R D

FOR M OF AGR EEMENT FOR DESIGN SERV ICES, are great resources,

they are not teachers (Graphic Artists...). 83% of designers sur veyed by

25

Terr y Stone, in 2006, do not use the AIGA standard for m. There is a fear

26

and discomfort from the design community, from the recent college grad

27

to the long ter m freelancer. Designers want to lear n more about contracts

28

for the simple fact that; designers get screwed by contracts.

Strategy

Design Agreement is presented through a 2 day design

conference. The f irst day is planned around teaching the basics of a contract, common contract clauses, and being able to defuse ‘ legalese.’ The focus of the second day is workshops based upon where designers have a lack of understanding. Workshops will also be focused on wr iting contracts for certain projects, the differences between a web contract and a logo contract. Partner ing with local design communities is essential in the holding of events.

The template is the current overarching solution. W hile this is a usable item, it ignores hands-on lear ning. Design Agreement is focused on understanding contracts, and that requires hands-on lear ning. Without building the basic understanding of a contract, a template is void and potentially dangerous. Through a convention of workshops and lectures, designers will work from a basic understanding to contract autonomy. The final step is comfort. W hen a designer is able to competently represent themselves legally, the contract changes from a for m to be feared to a protector of their work.

The main challenge for Design Agreement was choosing an

appropiate name without too much length. As contracts have been heavily

11

covered by a multitude of sources, many names are already out and

12

about. Contracts for Creatives, Design Contracts, Contracts for Graphic

13

Designers, etc. were already within use.

repugnant logos combined with questioning looks as to what the logo

16

actually was, I realized my own humorous style was a barr ier to a

17

ser ious logo for the project. Playing to my own strengths, as well as the

18

aesthetics of designers, I decided to shoot for a ty pe only solution, which

19

would keep the brand simple and easily approachable. A fter a long search

20

Simplicit y is the name of the game. I used t y pographyforlaw yers.

com to choose a font family with both a design histor y and a law histor y

(see page 10 for more details). With simplicit y in mind Design Agreement

uses just a wordmark with an optional box surrounding it. Left air y and

13

open, the brand felt as though it was too crowded with a logo, and the

14

logo often left viewers more confused in the case of a brand such as this,

15

which mi xes law and creativit y. Oil and water. The optional box around

16

the wordmark is based upon old contracts, which would have a box

17

drawn around them, and current invoicing procedures, in which the box

18

is the general symbol of separation between categor ies and inputs.

The beef and potatoes of the brand. Combining the design

histor y of Caslon, with the moder n and creative approach of Benguiat,

24

it is a ty pe that can be pushed around like Helvetica, but with a classic

25

older look. Pushing the leading to a huge 250, and setting all caps helps

26

to complete the look of a contract title.

A combination of the need for simplicity with my own

inadequacies. A nything beyond a simple wordmark caused a busy look

with an already lengthy feeling name. My own mark mak ing trends toward

cartoony and humorous, thus my logos were not an appropr iate fit.

Design Agreement uses ITC Caslon 224 as its only ty peface.

With a basis of mak ing contracts simple, it was found that a simple single

11

ty peface solution would prove suitable. A rework ing of William Caslon’s

12

ty pe work (“William...”) by Edward Banguiat (“Edward...”), Caslon 224

13

has deep roots within design histor y. The discover y of this font was due

14

to font recommendations on ty pographyforlaw yers.com, in which Matthew

15

Butter ick demonstrates Williams Caslon. Caslon has a higher contrast

16

between its thick and thin lines within its ser if than Williams Caslon.

The wordmark for Design Agreement uses Caslon in all caps,

medium, and with a massive 250 track ing. Title usage is also in all caps,

22

however in bold and with 200 track ing. In body Caslon is generally

23

limited to 75 track ing, and used in either black, medium, or medium

24

italic, and never in all caps. This usage is based upon the general layout

25

and for matting of ty pe within legal documents.

Based on the aesthetic of a contract, the color palette is plain. The goal is

to show contracts as simple and easy to use words. Graphic designers are

13

familiar with the visual laden side of words as well as work ing with their

14

There are two based tones which needed to be presented.

Graphic design is one of the lowest paying jobs to be expected

Designers don’t understand contracts and have to pay for it. Want proof that designers don’t understand contracts, just look at the many books based on the subject, or the thousands of websites. 43 million hits on graphic design contract on Google alone. A nd the financial costs for not understanding or not using a contract can range from getting paid $50 total instead of $50 / hour to having to pay a multi-thousand dollar penalty for a design due to a week late deliver y date.

I expected to see ignorance and fear of contracts from my classmates, generally based on a lack of histor y within the design industr y, but the sur pr ise came mainly from teachers and professionals. Many teachers understood contracts in general, but were not acquainted with specific clauses or felt comfortable editing a contract they were given. More so, it was shown that most professionals told me that they were able to find their way in the world of contract through getting screwed by them, k nowing only what to look for based on what they had been histor ically financially screwed by.

Most harrowing was look ing at how little designers on average

make, and how much law yer fees are, mak ing it cost prohibitive to use a law yer unless that law yer is a fr iend giving you a good discount rate.

Most work ing designers have a histor y with contracts. A nd from

sur vey: it is mainly a negative based histor y. There is a long standing

histor y of designers who do not like, or, even more often, fear or resent

contracts. Two basic needs must be met. First is convincing those with

a short histor y of contracts that contracts are actually an item they can

use to protect themselves, through a show of the benefits of contracts.

There is a long histor y of the conf using contract. Out of fear of

misunderstanding the contract itself designers tend to shy away, however the contract is meant for clar ification. Thus by pushing forward a style of contract wr iting based on understanding basic law vocabular y mixed with wr iting a contract with your own personal voice, we show designers that a contract can be used simply and clearly.

The histor y of design and its lament of contracts was a histor y I shared at a personal level. Through discussions with work ing professionals I was dismayed at how my previous fear matched the current for work ing designers. W hat changed my histor y? Business Law 1 at Champlain College, in which I was given the depth of how contracts were wr itten. I took this class as a double major, but my personal identity was still f ully aligned as a graphic designer. Thus I took the class as one, and was elated at how much it pertained to me as a designer. For me personally, this section became evident then, almost 3 years ago.

The biggest nightmare that any graphic designer can have is their

Ownership did not come to my mind immediately, as it is many

times not supremely recognized. Many designers use stock art without consent, or have their art used in such a similar way and feel as though they have no control over its theft. The common example I was given was what is an average communication between desigenrs and clients :

them and respond with changes for the next round of mock-ups.� - Designer

A nd no response, no payment, no communication at all. Then

the designer sees the prelimar y design in use. From online examples to personal accounts, this is a standard within the design industr y. This happens far too often. New just came the designer recognition that they could have done something about the problem before it happened in order to protect against it. Nothing feels worse than losing something and k nowing it was because you didnt f ight to protect it in the f irst place.

Unforeseen : Positive

This actually had to be told to me by another student, but, better laws for designers, and more protection for design work in the legal sphere. This project could possibly inspire young graphic designers to persue a career in legal work, and possibly push his all the way into copyr ight law or intellectual property law.

Unforeseen : Negative

One unforeseen negative consequence would be that contract

law yers would have slightly less work, however it is still recommended that a designer visit a contract law yer with dependance on the monetar y scale of the project.

W hen it came to the posters for Design Agreement, the main

concept was eye-catching dystopia of contracts. Through the use of copy

as patter n rather than simply words I was able to shift the contract into

a visual understanding rather than a legal one. In order to keep the

contract aesthetic, from a designer perspective, I added contract layout,

14

heav y overly wide columns, justified ty pe, and overall busy and heav y

15

layouts.

Simplicity was the name of the game. I pur posely chose so little

to illustrate within the book to allow for an easy openness. The openness

11

was essential. Graphic designers often feel overburdened by lengthy

12

contracts, and thus this publication needed to feel fr iendly. The cover

13

and back were given the most freedom for creative direction, and, as the

14

show was happening in Burlington, I looked into how to incor porate that

15

aesthetic and make the book pop on the cover.

The outside of the publication is built on two divided aspects.

The first is the showing of the logo outside of pockets. The publication is

just large enough to peek out of pockets and such gives an opportunity to

show our logo. The second is a creative yet bold composition on the front

and back to interest the designer to open the publication. I gave myself

some artistic license with this, and re-pur posed one of the poster designs

28

to carr y through the brand.

to find the fr iendliest professional appear ing design possible. I copied

a children’s book as a joke and loved it. With the ty pe it allowed for

fr iendly yet professional. I then moved that ty peset around until the

One of the most difficult part of reading through a contract and

editing it, possibly one of the most difficult actions a person could ask

11

for a designer to do, is the vocabular y. Beyond the use of conf using and

12

intentially obscure wr iting is the wr iting of definitions of this vocabular y.

Equally conf using descr iptions are given to already cr pytic words and

14

phrases.

The website started with a page listing and what should be on

each page. I then began work ing out what the basic design pr incipals for

it should be. Websites have a distinctively different aesthetic based upon

12

the activity which it can have, as well as no standard media size and have

13

to be reactive.

In this day and age, its necessar y to have a web presence, even

more important in Design Agreement for managing ticket sales for

attendance. By mak ing a site that is purely made for the sales of the

Design Agreement tickets, the site allows for an incredible clean view and

open comfort.
