Dad’s appeal rejected By JESSE GRAHAM AN APPEAL against a threeyear prison sentence for a father who killed his daughter in a buggy accident in Yarra Glen has been dismissed by the courts. On Monday 30 May, the Court of Appeal dismissed an appeal by Ricky Oliver Stephens against a three year and nine month prison sentence, handed down for the death of his nine-year-old daughter in a buggy accident. The accident occurred on 6 September, 2013, after Stephens tested a new all-terrain vehicle at his Yarra Glen property with his 11-year-old stepson, and nine-year-old daughter, Sophie. Though Stephens and his stepson were buckled into seats in the buggy, Sophie was unrestrained and sitting in her stepbrother’s lap. When Stephens drove over a dirt mound twice and attempted a burnout, the buggy flipped, throwing Sophie out before she was hit by the rolling vehicle. In October, 2015, Stephens pled guilty to charges of dangerous driving causing death and reckless conduct endangering life in the Melbourne County Court, and was sentenced to three years and nine months’ imprisonment with a non-parole period of two years and three months. The sentence was appealed on 18 May, with lawyers for Stephens arguing that the sentencing judge erred in finding Stephens’ moral culpability was ‘very high’. However, the Court of Appeal delivered a scathing rebuttal in its judgement on 30 May, with judges writing that Stephens “exposed the deceased

and his stepson to a high risk of injury which might properly be described as breath-taking”. The judges noted that Stephens was told repeatedly about the dangers of the buggy, ignored a safety DVD before driving, deliberately exceeded the passenger limit, and drove the buggy “in a manner calculated to cause the buggy to lose traction, and thus lose control”. “All of this was done deliberately,” the judges wrote. “We have examined the photographs of the buggy and the paddock that were taken following the incident. They more than underscore the grave and serious risk to which the appellant chose to expose the deceased.” Stephens’ lawyers made a submission that the sentence should have been lighter due to a lack of aggravating factors - such as being under the influence of drugs or alcohol, or being fatigued or sleep deprived. But the judges dismissed this argument, and added that although the buggy was travelling at a minimum speed of 34kmph, the buggy was still travelling at an “excessive” speed, and no error had been found in the previous judge’s sentencing. “We see no error in the judge’s conclusion that the appellant’s moral culpability in this case was of a very high level,” they wrote. “The appellant’s appeal must be dismissed.” The judges also found through the appeal that the range of sentences handed out for dangerous driving causing death in the state was “too low” after the maximum penalty was doubled to 10 years in 2008.

They’re doing it for Ray THE SALVOS raised more than $1000 over the weekend, on behalf of their beloved fund-raiser, Ray Ryan, who was struck down by a heart attack on Saturday 28 May. The Let’s Do It for Ray Red Shield Day on Saturday 4 June saw Salvation Army members raise $1300 for the annual appeal outside of the Healesville Jewellers, where Mr Ryan usually sits. The fund-raiser came about after Ray suffered a heart attack on 28 May - he was tended to by locals and paramedics, and is now recovering in hospital. The Salvation Army’s Eliza Owen and Healesville Jeweller’s Bruce Damman, pictured, were just some of the people involved in continuing Mr Ryan’s fund-raising while he recovers in hospital. Lieutenant Sarah Eldridge said that $10,435 was raised by the Healesville Salvation Army for the Red Shield Appeal, with $2122 of that from Mr Ryan’s area alone. (EVELYN MP) Christine Fyffe’s comments on ‘how easy it would have been for the Shire of Yarra Ranges to relocate to the Swinburne site’ - and save money - is so typical of the Liberals’ policies. Rather than see tertiary students of the Yarra Ranges area continue to use a modern, purpose-built campus, she and her ilk would have condemned them to cram into an inferior miniscule site in John Street in confined accommodation including recycled shipping containers. Didn’t (Dennis) Napthine use these for gaol accommodation? (Victorian Education Minister) James Merlino is to be congratulated for thrusting the future of tertiary education in the Yarra Ranges to the forefront. Eyes wide open for re-opening I HAVE heard on the ever-reliable Yarra Valley grapevine that the eye clinic is set to return to Yarra Ranges Health in Lilydale. While it is not confirmed, I sincerely hope this to be the case. In April, I asked a constituency question in parliament after contact from a number of residents about difficulties they faced getting treatment for problems including cataracts, glaucoma and retinal detachment since the closure. Most of us take our sight for granted. But when conditions are left untreated, the loss of personal freedom is profound. I hope that this is one rumour that becomes fact. Rainfall up in May RAINFALL was up in Healesville in the last month, with Healesville’s Alma Mitchell recording 93.1mm over 20 days, compared with 88.2mm over 18 days at the same time last year. ‘No change’ to our wards By JESSE GRAHAM PRESSURE from council and the community has prompted Local Government Minister Natalie Hutchins to overturn the Victorian Electoral Commission (VEC)’s proposed shift to a three-ward council. Yarra Ranges Mayor Jason Callanan announced on Facebook on Thursday 2 June that the minister had overturned the VEC’s proposed ward change that would have turned the Yarra Ranges’ nine wards into three, each with three councillors. Cr Callanan said that two wards had “very minor boundary movements” to accommodate population changes, but that the council structure of nine wards, nine councillors would be unchanged.

“There was a great amount of work behind the scenes by councillors, staff and the community,” he wrote. “Our council structure will remain the same for the next four years!” The announcement comes after the VEC concluded its review of the council’s electoral structure last year and proposed that the council change to three large multi-councillor wards. Numerous councillors made submissions against any proposed change as part of the review, with many expressing concerns after the final recommendation was released. Mt Evelyn Environment Protection and Progress Association’s Franc Smith, posted on the Mail’s Facebook page that he, Jan and Jean Edwards

wrote and submitted “formal appeals” to Ms Hutchins. Though he submitted in favour of a changed ward structure, he wrote that the final recommendation from the VEC was not one of their three discussed options, and “cut Mount Evelyn in half along Hereford Road”. “Who wrote it, who mapped it, but more seriously who authorised it?” he wrote. “Unless there is due diligence, Mount Evelyn in the future Electoral Representation Reviews will be cut to ribbons and will lose its identity.” Ms Hutchins, in a letter to Cr Callanan, said that though she believed the VEC’s review was “undertaken with objectivity, impartiality and

rigor’, she was not convinced there were sufficient grounds to change the council model. Ryrie Ward councillor Fiona McAllister, who was against the change, said she was “really pleased” with the minister’s decisions. She said Ms Hutchins and Deputy Premier and Monbulk MP James Merlino had “understood” the council’s concerns with the change when meeting with them - particularly the geographic size of the wards. The proposed new O’Shannassy Ward would have covered the entire Yarra Valley from Healesville to Warburton and Lilydale - with the other wards covering the urban area of the council and the Dandenong Ranges. “It would have been a really significant shift to go to the three-by-three,”

Cr McAllister said. “That model’s been much more successful in the smaller but much denser urban areas in metropolitan Melbourne. “I can certainly see the benefits of having multi-member wards but I can also see the benefit of retaining the structure we’ve got.” Cr McAllister said she also had concerns about the changes being so close to the council election at the end of the year. “To have declared a change of that significance so close to the election would have been really problematic for a lot of people,” she said. AFTER raising thousands of dollars for the Cancer Council, what do you do next? Try to double your effort, of course. At least, that’s the approach of Yarra Glen’s Concetta Rizza, who is hoping to follow up on the hugely successful Biggest Morning Tea in 2015 with an event on 25 June. From 10.30am on the Saturday, residents and visitors are expected to flock to the Yarra Valley Racecourse on Armstrong Grove for a day of entertainment for a good cause. Ms Rizza, who organised the event, said the whole town had come on board, with primary school children designing posters to promote the event and local celebrity Bonnie Anderson set to perform at the racecourse. The Steels Creek Association together with businesses in town are supporting the event. “It’s wonderful to see the community get together, because the community is really behind it,” she said. “Every day, I’m getting people who are coming in and offering their assistance.” She said that farm animals, face painting and live performances were part of the attraction to the event, with personal trainer and threetime cancer survivor Andy Zagami speaking on the day. Copies of his books will also be on sale, with $5 from each copy donated to the Cancer Council of Victoria - which will also receive the money raised on the day. Ms Rizza raised $8700 last year at a Biggest Morning Tea event in town, and said she hoped to double that amount this year - as well as push the attendance up from 200 to 500 people. “At the end of the day, if we get

HEALESVILLE elders gathered to celebrate a milestone birthday for the University of the Third Age (U3A) last week, with 90 people packing into the town’s Senior Citizens Hall. On Thursday 2 June, the group gathered for an all-day birthday celebration, featuring live music, lunch and speakers to commemorate the organisation’s 10th year. President Julian Higgs said the day was a success, with founding president Dr Ian Tinney and Yarra Ranges councillor Fiona McAllister speaking and paying tribute to the U3A. “From our point of view, it was a huge success,” Mr Higgs said. “We had a lot of really good feedback from people who were there - they really enjoyed it. “The buzz in the place was just fantastic.” Dr Tinney ran the attendees through the history of the U3A’s formation, a task spear-headed by Luisa Williams, and its growth over the coming 10 years. “We used to have meetings around at our lounge room at home. I don’t know if much work got done, but a lot of laughter was had by everyone,” he said. “They were the early days, but look what it’s done now. Things have just snowballed since then, and, I suppose, you’ve got to ask why. “And I think the answer is pretty simple - the why is because everybody really gets a benefit out of it - they get enjoyment out of it, they have fun.” Cr McAllister spoke about her parents’ involvement in the U3A in New Zealand, and how it was improving their lives. “I hear their experiences of friendship and lectures and workshops and outings and I have to admit, quite sincerely, I can’t wait until I can join U3A,” she said. “The truly wonderful and remarkable

in the catchment area. This ultimately leads to bitter disappointment. I have seen some parents go as far as selling their homes and moving to a new area to scrape into the desired school’s catchment - a measure that seems somewhat unnecessary to me. Perhaps it is because I am in the unique and privileged position of having visited all the schools in my electorate many times over that I have a more tempered and broad view of our educational standards. Honestly, I am yet to find an example of a bad school in Evelyn. I have been in classrooms during lessons and seen first-hand how happy our students look, the effort put in by teachers to personalise the learning experience so that information is retained and the dedication to improving student interaction and socialisation. It is true that many of our schools have older buildings - and buildings that reflect the more rural nature of our community. However, I encourage parents not to judge a school by its buildings.

Schools that have older buildings with fewer ‘optional extras’, or have a more country feel, are often immediately dismissed as an option. What about the curriculum and the teachers? Once these parents have identified a school that has commercial and reputational appeal to them, they come to my office wanting help to lobby their preferred schools to take their child, or children. With Victoria’s population growing around 100,000 people a year, parents sometimes forget most schools reach capacity quickly through accommodating just students who already live with-

Pink ladies call out By JESSE GRAHAM THE Yarra Valley Ladies in Pink are calling for help to raise $14,000 for a member’s cancer treatment, teaming up with Upper Yarra community banks to gather funds. YVLiP, a cancer support group based in the valley announced on its Facebook page that it would be running a fund-raiser for Mount Evelyn resident Paris George to try and raise $14,000 for the cancer treatment drug Olaparib. The drug is not currently on the Pharmaceutical Benefits Scheme (PBS), and is needed to stave off a return of Ms George’s primary peritoneal cancer - her third cancer diagnosis in the last 10 years. She has been using Olaparib for the last two months, but needs to pay for her coming three

months of treatment and the following three months - then she said the drug will be provided for free ongoing. By the end of June, the group need to raise $6816 - and then raise the same sum three months down the track. Donations through GoFundMe and the YVLiP have raised about $2000 towards the drug, but the group is now appealing for residents to help out, opening an account at the Seville Bendigo Community Bank. Ms George said she was told that, after that, the drug will be provided free until it’s listed on the PBS. YVLiP member, Judy Sturt, said that residents had been forthcoming with donations, but that the Ladies in Pink were hoping to keep the momentum going over June to get Ms George over the line. “It doesn’t matter how big or small, that’s what I put on the Facebook,” Ms Sturt said. “Even five dollars - it builds up,” Ms George added.

Raise a toast to SES By KATH GANNAWAY YARRA Valley Smaller Wineries are punching above their weight when it comes to supporting local emergency services. YVSW president Tim Cullen, of Payne’s Rise Wines, handed over a cheque for $3800 to the Upper Yarra SES last month, taking to $60,000 donations made to emergency services from proceeds of the annual Shedfest Festival and The Shortest Lunch. The events, which have been running for 14 and 18 years respectively, highlight the unique aspects of the valley’s smaller wineries - with the added benefit of supporting the emergency service volunteers. Upper Yarra SES Controller Steve Green said the $3800 donation was a great help to the unit.

“We have to update our vehicles very soon and these funds can go towards that,� he said. “We would struggle to survive if we didn’t get people like those involved in the Yarra Valley Smaller Wineries raising money through their events, and, of course, being so generous with it.� Mr Cullen said YVSW members were very happy to be able to support the Upper Yarra SES, and other local emergency services, made possible in turn by the public’s support to make the events such a success each year. ‘Drive to the conditions’ By PETER DOUGLAS LOCAL police are among many authorities urging drivers to stay safe this Queen’s Birthday long weekend. The extra day off encourages many in the state to head off for a well-deserved break. However, the recent wet conditions and the danger of driver fatigue should be at the forefront of drivers’ minds. Leading Senior Constable Tim Stewart, from Healesville Police, warned drivers to heed the warning, particularly after a crash Saturday afternoon along Maroondah Highway, just outside of Healesville. Leading Sen-Const Stewart said the crash occurred near the water tanks

(near the Black Spur, just out of town), when a car heading towards Healesville and a car heading towards Eildon collided. The vehicles were badly damaged, though the drivers didn’t suffer any injuries. Leading Senior-Constable Stewart encouraged drivers to adjust to the conditions. “Take it a bit more easy, because those roads were super slippery up there,” he said. That incident comes after a series of car crashes along the Warburton Highway, between Seville and Woori Yallock. Yarra Ranges Highway Patrol said

about five to six crashes occurred on the highway, involving about eight cars. Fortunately, only one injury was recorded, with a woman in her thirties taken to Maroondah Hospital in a stable condition. Meanwhile, according to the Transport Accident Commission, 126 people have already lost their lives on Victorian roads in 2016, which is an overall increase of 15 when compared to last year. This figure is well up on the fiveyear average of 116, with the highest during this period coming in 2011 with a figure of 134. Of the road users, drivers lead this category by some margin, with 59 drivers losing their lives (compared to 55

last year), with motorcyclists (31), passengers (16) and pedestrians (17) making up the other major categories. In particular, motorcyclists have showed a worrying trend, with a 138 per cent increase on last year. Particularly during a long weekend, it’s more important than usual to be mindful of things like changing road conditions and driver fatigue. Fatigue is suspected to be a primary cause of more than 20 per cent of road fatalities, according to the TAC. Driver Reviver sites will be set up across Victoria throughout the long weekend, offering tired drivers a chance to pull over and refresh. While it might seem like only a

small thing, using these facilities, or even pulling over for a 15-minute power nap, could save your life. How to beat driver fatigue: Get a good night’s sleep before heading off on a long trip; Don’t travel for more than eight to 10 hours a day; Take regular breaks - at least every two hours; Share the driving wherever possible; Don’t travel at times when you’d normally be sleeping; Take a 15-minute powernap if you feel yourself becoming drowsy. The festival will open on Friday 17 June with its ‘Show us your Shorts’ program, screening short films by young film-makers in the Yarra Ranges and beyond. The short films will run from 1pm to 5pm, before awards are handed out to the best of the lot, and the Official Grand Opening will begin at 6.30pm. From there, Putuparri and the Rainmakers will be screened, following the story of one man struggling to fulfil his destiny in the face of Australia’s Indigenous history. The film’s director Nicole Ma will take part in a Q&A session after the film. In total, the festival boasts nine feature films, made in France, Germany, Australia, the United Arab Emirates, the United Kingdom and Brazil, among other countries. A dinner and trivia event will also be held on Saturday 18 June, before the festival’s final day on Sunday. The Yarra Ranges Film Society (YRFS), in partnership with Yarra Ranges Council and the Upper Yarra Community Enterprise, has organised the festival, which is in its 33rd year. Belgrave got its second win and have moved up to 8th position, while Healesville had a great win over Olinda and now share equal second with three other clubs. Wandin flexed its muscles and sit second on percentage. Upwey enjoyed a solid performance against Mount Evelyn, while Monbulk had a come-frombehind win to knock off Woori Yallock. Gembrook now sit equal second with Kinglake after their win over Yarra Junction, while Alexandra continue to improve, beating Seville. Yarra Glen are now two games clear on top and the only undefeated side. Wandin sit one game clear on top of the A Grade netball; Seville and Yarra Glen share top spot but meet each other next week for what will be the game of the round. Maria laps Australia MARIA Lissenburg, 55, celebrated the final lap of a ‘virtual’ run around Australia on Saturday, with the celebrations taking place at Lilydale Lake in front of a huge band of supporters. The mother of three, who hails from Castella, finished a 14,080km run, which is the distance it would take to run around Australia. In completing the required distance on Saturday, which, incredibly, has taken her less than two and a half years, Lissenburg is just the third person to finish Run Down Under since it was established in 2014. Run Down Under is an online virtual run around Australia, requiring participants to submit the distance of each run or walk they complete. Lissenburg said she was chuffed to have achieved the distance. “When I first started, I thought it would take longer to finish,” she said. “To come third overall is pretty special. “Before joining Run Down Under, I was running about 35km per week, with my longest run ever being 25km.

After completing her marathon, Maria Lissenburg joined other runners for another run around Lillydale Lake. 155153 “In the first week of this new challenge, I went all out ... then I saw I was coming third. “At this point, my competitive side kicked in ... and if I wasn’t running, I’d go for a walk to increase my kilometres.” Lissenburg said her journey kicked off other ambitions. “I had a goal to run a marathon, too, but kept thinking the distance was too much,” she said. “So I decided to walk the length of the Lilydale to Warburton rail trail, which is about 40km.”

Run Down Under founder and director, Travis Ireland, was at the Lilydale finish on Saturday. Mr Ireland made a special presentation to recognise her amazing achievement. He said she chose her local Lilydale Lake run because she could complete the distance with many of her running friends. He said she also would’ve clocked many kilometres around Lilydale Lake. Motoring Batteries hate the cold, too battery power. “If your battery is more than three years old, it could be time to replace it.” To avoid battery trouble this winter, RACV members can call an RACV battery specialist for free anywhere across Greater Melbourne and Geelong to: Check the overall condition of your battery, including the vehicle’s charging system; Make sure you’ve got the right type of battery for your car; Run some basic preventative maintenance, such as cleaning your battery, checking fluid levels (if required), and ensuring your battery is secure in its housing. Warning signs: The vehicle cranks slowly when trying to start. A grinding, clicking or buzzing can be heard when you turn on the ignition. The headlights dim while you idle. The vehicle’s battery is more than three years old. Reasons why: Cold weather can slow the chemical reactions that take place inside the battery, reducing the power output,

sometimes resulting in your vehicle not being able to start and ultimately shortening the battery’s life. Increased use of vehicle’s headlights, wipers, heater, heated seats and rear-screen heaters put additional strain on the battery. More battery power is required to over-ride the impacts from cold weather on the fuel and ignition systems. Typical lifespan of a battery is between three and five years, after which the performance will diminish. What motorists can do: Make sure your vehicle’s service history is up to date before the cold weather hits. Make sure you have the right type of battery for your car (rated according to your manufacturer’s specifications). Keep the top of your battery and terminals clean and free of built-up dirt, if accessible. Also look out for corrosion on your terminals as it can inhibit the flow of current. Consider getting an expert to check the condition of your battery, that you’ve got the right type of battery for your car and run some basic preventative maintenance.

However, RACV has urged motorists not to forget their car battery could be struggling, too. “Getting old is hard - especially when the cold weather comes around,” RACV Motoring and Mobility general manager Gordon Oakley said. “In the same way that we’re having trouble getting started in the morning and the cold weather makes some of us go a bit slower, car batteries are also feeling the cold.” Last winter, RACV Emergency Roadside Assistance received more than 100,000 calls for help from motorists experiencing battery problems. Some of these emergencies can be avoided by following a few simple tips. “It is important that the battery you have fitted is in accordance with the manufacturer’s specifications. “If possible, park your car indoors or under cover to keep it as warm as possible overnight. “Keeping the top of your battery clean can prevent dirt build-up from draining your
