Adult prison term By Jesse Graham A TEENAGER has been sentenced to five years in adult prison over the August 2015 crash that killed 16-year-old Yarra Glen boy Cooper Ratten. The 18-year-old man, who was 17 at the time of the crash and cannot be named, was sentenced to five years in jail with a non-parole period of three years by County Court Judge Howard Mason on Friday 12 August. The man pleaded guilty to culpable driving causing death in an April court hearing for the crash, which took place on Glenview Road in Yarra Glen on Sunday 16 August. The man was driving a stolen Volkswagen Tiguan at around 100km/h through dense fog with no headlights on while under the influence of drugs and alcohol when he failed to negotiate a bend on the road and crashed, flipping the car end-on-end. Cooper, who was the rear passenger and not wearing a seatbelt at the time, was thrown 65 metres from the car and died at the scene. Judge Mason said the driver broke his neck in the crash and narrowly avoided becoming quadriplegic, but had now recovered from his injuries. In his sentencing remarks, Judge Mason said that, despite an early guilty plea and a high chance of rehabilitation, the man had a “significant moral culpability” over the crash and would receive an adult sentence. He said that Cooper, the driver and a friend had been drinking at the friend’s house prior to a function at the Yarra Glen Football Clubrooms on the night of Saturday 15 August. The group then went to the clubrooms and drank more alcohol “prior to and at the function“, before returning to the friend’s house with others at 12.15am, Sunday 16 August. About 2am, the trio went to drive a car which belonged to another friend’s sister, but were stopped by another man and the driver’s brother, who took and hid the car keys, calling the group “idiots“ and warning the group not to take the car and not to drive. Just before 3am the group found the car keys and stole the car, heading out on the ill-fated drive. At the time of the crash, the man had MDMA (ecstasy) in his system and had a blood alcohol content of 0.084 - over the limit for fully-licensed drivers. Cotinued on page 3

The musical, an adaptation of the 2001 comedy movie Legally Blonde, opens at 7pm on Thursday 25 August, for a weekend of shows at the Healesville High School’s Ion Whykes Theatre. Healesville High School students Isabelle, Hannah and Waularna, pictured with director Trent Morison, will perform in the musical, which tells the story of Elle Woods, who goes to Harvard Law School to try and win back her ex-boyfriend. Plan for Healesville By JESSE GRAHAM YARRA Ranges Council has finalised and adopted the Healesville Structure Plan, after three and a half years of consulting with residents about the future of the town. Councillors unanimously agreed on Tuesday 9 August to adopt the Healesville Structure Plan, a document that maps out the future direction for the town and the council’s strategies over the next 20 years. Ryrie Ward councillor Fiona McAllister moved an amended motion to adopt the Structure Plan, with minor changes to the document to “review the appropriateness of current planning controls” and zoning at the RACV Healesville Country Club. Cr McAllister said she was “a bit sad” that no members of the community were in the public gallery at
the council meeting to see the document adopted, but acknowledged that the plan had been through “a process of very intense consultation” since 2013. “The deliberations in the community and around the Community Reference Group Table have, at times, been heated and that’s been great because it means that passion has led to really thorough consideration of some really challenging issues,” she said. “Trying to get that balance right between maintaining the community feel of our beloved town with an incredible history and beautiful environment, the need for some development and ... about, in a Structure Plan, how do you deal with the issue of bushfire risk? “The Healesville Structure Plan
cut our teeth in dealing with that issue in a very structured, strategic way in this context for the first time.” The document itself outlines a number of strategies and actions the council plans to take around the area in coming years, taking on feedback from a number of community consultations and surveys. One of the objectives in the plan includes creating a “greater diversity” of housing to meet residents’ needs and amending the Planning Scheme to allow consideration of subdivision of some Low Density Residential Zone lots into 0.2 hectare lots, provided sewerage is available. Advocating for Yarra Valley Water to complete connection of currentlyunconnected lots to reticulated sewerage, and to seek funding for a redevelopment of the town’s pool into an
Briefly Driver flees crash site HEALESVILLE police are appealing for witnesses after a hit and run on the Black Spur over the weekend. Leading Senior Constable Jarrod Rollason told the Mail that at about 11am on Saturday, 13 August, a couple were driving up the Black Spur on the Maroondah Highway towards Narbethong, when they were passed by a white four-wheel-drive heading in the opposite direction. Leading Sen Const Rollason said the four-wheel-drive was towing a trailer with two motorcycles, one of which fell off and hit the couple’s car. After both parties stopped to assess the damage and get the motorcycle back onto the trailer, the two groups agreed to stop at a safer place further down the road - but the four-wheel-drive’s driver then fled, driving towards Healesville. Leading Sen Const Rollason said a man was driving the four-wheel-drive with a woman passenger, and one of the motorcycles was blue and white, but that few other details were provided. Though the couple’s car was not writtenoff in the crash, Leading Sen Const Rollason said they would have to cover their insurance payments if the other driver cannot be found. He said anyone who may have witnessed the incident, or who saw the four-wheeldrive, should contact Healesville Police on 5962 4422 or Crime Stoppers on 1800 333 000.

VICFORESTS will be taking submissions on its upcoming Timber Release Plan until 19 August, seeking comments from community members on proposed changes to logging coupe boundaries. The logging body announced on Tuesday, 26 July that it had begun consultation on the updated TRP, which will affect harvesting in the Central Highlands area and other areas of the state. General Manager of Planning Nathan Trushell said the five-year plan was updated annually, and this year’s update included modification of logging coupe boundaries “based on improved planning information”. Mr Trushell said the body was seeking comment from residents about the timing of logging, the use of haulage routes, proximity of coupes to private property or public use areas, and identifying and protecting “other forest values” within harvesting sites. Judge Mason said the sentence issued had to reflect the “court’s condemnation” of the kind of offending that had occurred on the night. He said the man had several favourable character references, which showed him as a “popular and well respected young man,” that he had showed remorse towards his actions and showed good prospects for rehabilitation. “Nevertheless, your conduct of driving in the circumstances in which you did is obviously seri-
ous,” Judge Mason said. “The result is that a decent, talented, much-loved young man with his adult life just ahead of him has needlessly been killed. “Family and friends have been broken hearted and lives will never be quite the same again.” Judge Mason said the severity of the crash required a custodial sentence, one that exceeded the maximum sentence of three years for minors. The maximum sentence for culpable driving causing death is 20 years in jail for adults or three years for minors. “Because of the serious nature of this offence, and your culpability, I consider that a sentence is necessary which, by its effect, will exceed the maximum period available for a youth justice cen-

DETECTIVES are asking residents to report suspicious behaviour, after a trio of breakins around the Mooroolbark area over the weekend. Yarra Ranges Crime Investigation Unit Senior Constable Chris Moloney said that three break-ins occurred between 9am and midnight on Saturday, 13 August, around the Mooroolbark area. The first break-in occurred in Hayrick Lane, where jewellery and a mobile phone were stolen from a residential property. Shortly afterwards, a coin collection, jewellery and a computer were stolen from a Partridge Way property, before a break-in at another property on the street. Sen Const Moloney said the third breakin triggered an alarm, so the thief fled emptyhanded. He said that rear windows were smashed in to gain entry in all three break-ins, and urged anyone who may have seen suspicious activity to call Crime Stoppers on 1800 333 000.

HEALESVILLIANS will be able to see a piece of Olympic history up close at their library, with the venue hosting the 2000 Sydney Olympic Torch that was brought through the town 16 years ago. Yarra Ranges councillor Fiona McAllister brought the torch to the Healesville Library on Wednesday 10 August, to be displayed at the venue while the Rio Olympic Games and Paralympics are held. Presenting the torch to the library’s weekly storytime attendees, Cr McAllister told a group of children and parents that the torch was carried through the town 16 years ago, on 10 August, 2000.
“This is actually our special torch for Healesville,” Cr McAllister said, as the torch was brought around for the children to look at. Her son, Cassius, told the group that the torch “went around the world before we were born”. Healesville Library staff confirmed the torch would be on public display for one month, on loan from the Yarra Ranges Council. Storytimes are held at the library from 9.30am and 11am on Wednesdays. Toast to speech queens THE future is in good hands judging by the quality of young people taking part in the Primary Schools’ Speech Contest, according to Healesville Rotary and Toastmaster members officiating at the annual contest last week. The contest was held at the Healesville High School Performing Arts Centre on Wednesday 10 August. Students from Woori Yallock, Yarra Glen, Healesville, Badger Creek and Dixons Creek schools spoke on topics as diverse as why we should all watch The Simpsons, to how they would change the world, the academic benefits of daydreaming (in class), just being happy, and on people they admire.
Each student spoke for three minutes on their chosen topic, delivering not only their views, but with the challenge of presenting their speeches in a way that informed and entertained the audience. Master of Ceremonies, Toastmaster Marlene Sinclair, said the judges had a hard time choosing just three winners. First place was awarded to Sukey Russell from Woori Yallock, second to Chloe Bronstring, also from Woori Yallock, and third to Healesville Primary School’s Heidi Graupner, all three speaking on how they would change the world, but from very different perspectives. Healesville Toastmaster chief judge, Linda House, said among the attributes that stood out were the structure and flow
of the speeches and the confidence, enthusiasm and excellent use of language. Contest co-ordinator, Healesville Rotarian Michelle Shafran, congratulated all the students and their teachers on presenting an excellent night of speeches. Ms Shafran said while she always loved to see some humour in a speech, one of the things that stood out across all the speeches was the knowledge of world issues and the passion shown on subjects that covered animal rights to world poverty, gun control and gender equality. “Rotary is very proud to host an event that consistently delivers a very high standard of public speaking from our local Grade 5 and 6 students,” she said.

THE AFL Pride Match between St Kilda and Sydney this Saturday night marks a high point in an incredible journey for Yarra Glen footballer Jason Ball. Ball, who was the first Australian Rules player at any level to come out as gay, has received enormous support from his club, which has now hosted three Pride Cups in the AFL Yarra Ranges league. Over the weekend, the concept of a Pride-themed football match reached a wider audience than ever before, with the aim of celebrating the AFL community’s LGBTI fans, players and staff. Ball said to the AFL’s credit, they had ensured the Yarra Glen football club had been included in promotion of the Round 21 match. Yarra Glen Football Club players formed a guard of honour for the AFL players. The club’s coach, Dean de Munk, has attended a St Kilda training session this week, as well as speaking with players, coaches and staff about the importance of the event. Ball, too, featured on the front cover of the round’s AFL Record, as well as tossing the coin before the match. “It’s an exciting time, so much work has gone into this and it’s great to see it happen on an AFL stage,” he said. Ball said he couldn’t be more pleased with the AFL’s promotion of the event. This had included St Kilda player Sam Gilbert taking on a spokesperson role, as well as coverage of the story of Saints’ legend Nicky Winmar and his gay son, Tynan. Winmar is known as much for his football deeds as for his stance on racism, which Ball said resonated with AFL fans. “It’s a great story, this is what we need, for the legends of the game to come out in support of the Pride match,” he said.

EVERYONE in the Yarra Valley understands the significance and importance of the Yarra River to our local region and to the city of Melbourne. The river is the lifeblood of the Yarra Valley, servicing our industry and providing the beautiful environment we live in and share. That’s why it is important for locals to have their say about the future of the river - how it is managed and protected. The Victorian Government has appointed a Yarra River Protection Ministerial Advisory Committee to generate discussion and promote debate about the river’s future. This committee has now completed a series of community workshops and listening posts, inviting community feedback on its discussion paper. Unfortunately, this process has been rushed through so the govern-
ment can have its agenda implemented, leaving the community with no time to have their say. Locals have not been given enough time to prepare submissions, with the closing date for written submissions being before the last listening post session. Locals in the Yarra Valley are bitterly disappointed the government is making little attempt to hear their views. Therefore, it is understandable that locals have no confidence in this process, feeling shut out and undervalued. Therefore, I urge the Andrews Labor Government to commit to real consultation by engaging further with the Yarra Valley community to ensure our river can be better looked after into the future. It’s an Elle of a show By JESSE GRAHAM High HEALESVILLE School students will be taking to the stage at the end of the month to present a musical rendition of Legally Blonde, with four shows set to be performed. Legally Blonde the Musical will be performed from Thursday, 25 August to Saturday, 27 August, with 30 high school students to perform their version of the 2001 hit comedy. The story follows Elle Woods as she heads to Harvard Law School to try and win back her ex-boyfriend - along the way she decides instead to prove herself as a serious law student.
Director Trent Morison said the school had been preparing for the production since auditions in February and that, with two weeks to go until the show opened, it was all starting to come together. “The kids have been working really hard, especially in the last few weeks,� he said. “I’ve got some amazing people around me who are putting it into action.� He said the production was chosen by the students and that, though the film itself was not a musical, it followed the same storyline. “It’s still about Elle following her ex-boyfriend to

By Jesse Graham YARRA Ranges residents are now allowed to landscape their nature strips, within reason, with the council accepting a new Nature Strip and Roadside Guideline on Tuesday 9 August. Councillors unanimously voted to adopt the new guideline at the meeting, after Chirnside Ward councillor Andy Witlox put forward a slight amendment to the document. The guideline, he said, would give residents certainty about how they were able to landscape their nature strip with plants and rocks, with community feedback helping to shape the document. “There’s a lot of good stuff in
turf or sculptures. Excavation is allowed under the guideline, through the document reminds residents to call Dial Before You Dig on 1100 to ensure they do not damage underground infrastructure. Yarra Ranges would still be responsible for the land, mayor Jason Callanan said. “We wanted people to have a bit of, say, ownership over what they could have outside of their place, understanding that the nature strip is still council’s land,� he said. “However, those residents have to live there every day and see that patch - this guideline strikes a good balance. “Yes, we’ve had some issues
around letterboxes, wanting to not be the middle-man and dictate what a letterbox should look like - as long as it doesn’t pose a risk to pedestrians, cars coming in or out of driveways or coming down the street.� The review to the guideline took place last year, after a Kalorama resident was forced to remove very large rocks from his nature strip in 2014. The resident spoke to the Mail and said there was “no consistency� in how nature strip by-laws were enforced. Under the new guidelines, the rocks would still not be permitted. Terrifying time trip on stage By KATH GANNAWAY HAVING blitzed the Victorian Drama League Awards with the ghost thriller ‘The Woman In Black’ in 2013, RedFox 3 Theatre Company is preparing to share the scare and put Yarra Valley audiences on the edge of their collective seats. Described variously as ‘a terrifying trip through time’ to a ‘theatrical spine-chiller’, Stephen Mallatratt’s stage adaptation of Susan Hill’s acclaimed ghost story has been produced in 40 countries and is now in its 28th year in London’s West End. It was the perfect choice for director Justin Stephens' newly-established Redfox 3 when Chris Mclean and Kieran Tracey performed at The Basin Theatre in 2013. The production took gold in best set, lighting, sound, actor in a drama (Chris Tracey), director in a drama (Stephens) and Best Drama Production overall. Chris McLean joins the original crew for performances at the Arts Centre in Warburton on 20 and 21 August, and at The

A ghost story like no other, the scene is set when a lawyer, obsessed with a terrible curse he believes haunts him and his family, hires a young actor to help unburden the memory of The Woman in Black. Stephens said delivering the chill down the spine of the audience relied on the storytelling of the actors.
Margot Robbie is endearingly unhinged as Harley Quinn, and fire-powered El Diablo (Jay Hernandez) and honourable hitman Deadshot (played by the ever-charismatic Will Smith) undergo some engaging character development. Davis is a cunning, amoral badass as Waller, and Cara Delevingne is appropriately entrancing as Enchantress, playing the millennia-old witch with sensual, malevolent gusto. But Jared Leto’s muchtouted take on the Joker is all surface-level quirk, and the narrative structure is an absolute mess.
SUICIDE Squad is another miss for DC Comics, but a promising miss nonetheless. Government agent Amanda Waller (Viola Davis) assembles a team of incarcerated supervillains to combat meta-human threats. Like Batman v Superman, Suicide Squad contains plenty of good elements begging for a better movie. Even though many of the members lack breathing room in the plot, the squad itself has outstanding chemistry.

The exhibition by the Wandin Blacksmiths' Group opened on Saturday with exactly the diverse range of pieces you would expect when you empower four men and one woman with a hammer, a blazing forge and the challenge of creating amazing metalwork. The individual approach to the craft of the artisans, Fritz Rappold, Paul Cacioli, Evelyn Young, Terry Marshall, and Oscar Huecherig, makes for an

For much of the film, it’s frustratingly unclear where the squad is going or what they’re even trying to accomplish. As a result, the pacing feels slow and erratic. Enchantress’s plan is nebulous, and the action is short and uninspired, with few chances for the squad members to unleash their unique skills. Suicide Squad isn’t a bad movie – it’s entertaining enough, if only for the fun, diverse characters – but isn’t the much hoped-for salvation of the DC Expanded Universe. In Division 2, Yarra Glen enjoyed a big come-from-behind win in the last quarter against Seville to hold on to second spot on the ladder. Gembrook and Alexandra share second spot, but sit third and fourth respectively. Emerald was able to get out to a great lead and was never headed all day - 4.3 to 3 straight gave them a ninepoint lead at quarter time. Long Tan is remembered By Jesse Graham RESIDENTS from around the Yarra Ranges and beyond gathered at the Knox War Memorial to pay their respects to fallen soldiers over the weekend, marking the 50th anniversary of the Battle of Long Tan. On Sunday, 14 August, RSL representatives, MPs and residents gathered at the memorial in the Tim Neville Arboretum in Ferntree Gully for the Yarra Valley and Outer Eastern Melbourne Vietnam Veterans Day. Outer Eastern Melbourne Vietnam Veterans Association of Australia (OEMVVAA) president Aff Binnoore introduced the day’s speakers, Casey MP Tony Smith and Knox School Year 12 student Nathan Reed. Mr Reed said the group had gathered to honour the Australian soldiers who served during the Vietnam War, especially during the Battle of Long Tan, which took place on 18 August, 1966. “Thinking of the brave individuals who join us here today and those who are here only in spirit, one can’t help but feel awed by the enormity of what we encounter,” Mr Reed said. “We find ourselves in the midst of patriots and the family and friends of those who have nobly served. “Standing on the shoulders of giants, who have given us so much, we remember those who have sacrificed so much for their country.” He spoke about the soldiers who fought in the Battle of Long Tan, where 108 Australian soldiers fought about 2000 Viet Cong and North Vietnamese soldiers in a rubber plantation. Despite being outnumbered, the Australian troops’ fighting led the Vietnamese forces to retreat. “Your presence here today and that of the people gathering across the country is a tribute to those troops and to their families,” Mr Reed said. “It is a way to say we remember - to those soldiers who shivered, crouching in the rubber plantation at Long Tan, we remember and honour you.” Adrienne Bray performed The Last Post and Rouse on the bugle after Mr Binnoore recited The Ode, before attendees were invited to lay a poppy and join a sausage sizzle with the other attendees.

Hills are a challenge By Jamie Strudley THE venue was Mountain Road Reserve, Cockatoo. The event was the annual Hills Challenge, which is run by Cockatoo Little Athletics Club. After overnight rain, the normally water-logged and muddy course held up fairly well, with no shoes lost this year. One rival club, Pakenham, set the tone for the day by having their runners run in more than one race to maximise points in this points-
driven event; so when asked to step up and take on multiple races, Yarra Ranges’ chargers were eager and more than willing to go above and beyond. The club spirit was terrific as usual, and every runner was encouraged and applauded over the line; all this was enough to see Yarra Ranges Athletics win for the third year in a row and take home the perpetual Hills Trophy. A massive thank you to all who supported this event.

A back seat safety check KIDSAFE Victoria has welcomed the announcement this month that General Motors in the US will be introducing a ‘Rear Seat Reminder’, an industry first feature designed to remind drivers to check the back seat as they exit their vehicle. The Rear Seat Reminder will be included as a standard feature in the new 2017 GMC Acadia in the US. The reminder works by monitoring the car’s rear doors and is designed to remind drivers to check the back seat as they exit their vehicle under certain circumstances. Drivers will be reminded by five audible chimes and display a message in the driver information centre that reads; “Rear Seat Reminder / Look in Rear Seat”, if the back doors have been opened and closed 10 minutes before the car is started or while the engine is running. Jason Chambers, General Manager of Kidsafe Victoria, said they welcomed any technology which increased safety for children. “While technology can’t
