Navigating the rental storm SUMMER is just around the corner which means the storm season is also on its way.

Sometimes damage to a rental is unavoidable in times of natural disaster, but who’s responsible for the clean-up and repairs?
The property is partially damaged, can rent be reduced? If a property is damaged, the landlord and the tenant can come to an agreement to reduce the rent until the premises are returned to the condition prior to the disaster. The agreement should be put in writing and signed by all parties. If an agreement can’t be reached between the parties about a reduction in rent, or the amount of the decrease, then the RTA’s free dispute resolution service may be able to assist. Under the Act, tenants may ask for a rent reduction if:
The Residential Tenancies Authority (RTA) has answered the top five questions for what to do when disaster strikes.
Cleaning - who’s responsible? The landlord is responsible for the maintenance and repairs needed to bring the property back to a livable condition, as well as fences, gardens and pools. These repairs need to comply with health and safety laws. The tenant is responsible for removing or cleaning their possessions. Landlords and tenants are encouraged to communicate with each other over the clean-up.
· The premises are partly unfit to live in. · If services, facilities or goods to be pro-
vided to the tenant are no longer available.
· If the amenity or standard of the premises decreases substantially, so long as the damage was not caused by the tenant.
Can the tenant stop paying rent if the property is damaged? A tenancy agreement does not automatically end as a result of flooding (or natural disaster), even if the premises are totally destroyed. A tenant or landlord must give the other party a notice formally ending the agreement because the property is not livable. This notice will end the tenancy agreement on the day the notice is served. However, notice must be given within one month of the disaster occurring. Once the correct notice has been given, the agreement is ended and the tenant is no

What is non-livability?
Ever wondered who cleans up after a natural disaster? A property is considered unlivable if it has been destroyed, or made unfit to live in, for reasons other than a breach by the tenant or landlord. The premises may be considered unlivable when the property has become unsafe for health and safety reasons. However, each situation needs to be considered on a case-by-case basis. People
should also consider what outcome they’re after, for example does a tenant wish to end the tenancy and leave, or stay but negotiate some rent relief. For further information or to access forms mentioned, visit the RTA website www.rta. qld.gov.au
