The iconic 18-carat gold Melbourne Cup will make its way to the Upper Beaconsfield Pony Club on 18 October. Not only will it stop-by the pony club but Beaconhills College Pakenham campus, Cardinia Shire Council and Pakenham Racing Club are also marked on the tour map. "I believe the Upper Beaconsfield Pony Club is a real part of the community," committee member Helen Colliver said. "It has been a part of the community for a very long time." Ms Colliver said the cup visit may provide a stepping stone for the young riders into any aspect of the horse racing industry. The cup will arrive at the Upper Beaconsfield Pony Club in the morning for a photoshoot before heading over Beaconhills College for a presentation, photos and a talk by Victoria Racing Club officials. Afterwards, it will be transported to the Cardinia Shire Council offices in Officer. The cup will visit several other venues in the afternoon.
■ Mitsubishi ordered to pay almost $40,000 to car buyer after fuel economy fail
The road worrier Berwick Mitsubishi has been ordered to pay almost $40,000 to a disgruntled car buyer, in a landmark fuel efficiency case. The Victorian Civil and Administrative Tribunal (VCAT) has ruled that “both the dealer and the manufacturer engaged in misleading and deceptive conduct“ over a fuel consumption sticker on a new vehicle. Mitsubishi is already seeking to appeal. In 2017, Zelko Begovic purchased a new Mitsubishi MQ Triton from the Berwick dealership with hopes to improve fuel consumption, compared to his previous 2008 Mitsubishi Triton. The new Triton had a fuel consumption label stuck to the front windscreen of the vehicle but Mr Begovic claims the actual fuel consumption was different to the consumption listed on the
label and was therefore “misleading”. Although Mr Begovic was aware the fuel consumption would be higher given he was driving in varied conditions, a large reason for his purchase was due to the advertised fuel consumption. But the 2008 vehicle under the same condition of ‘Extra Urban’ used about 10 litres per 100km and therefore he expected the new vehicle to do 8.5 litres per 100km, when in fact it used 12.44 litres per 100km. Mr Begovic took the car to the dealership on three occasions in 2017 and then to Dandenong Mitsubishi in April 2018 but on all occasions, no faults were found. ABMARC Director of Engineering Andrea Winkelmann authored a report on 19 March 2019 which found the label information wasn’t true for the vehicle, with the report finding that 26.7 per cent more fuel was being used
than stated on the sticker. The Gazette contacted Berwick Mitsubishi who said they were “unaware and therefore unable to comment further”. Mitsubishi Motors Australia said they “strongly disagreed with the findings in the VCAT case”. In a statement, a spokesperson from Mitsubishi said the tribunal took into account test results provided by the customer of their used vehicle which was tested to a different methodology to the ADR81/02 standard outlined on the fuel consumption label, therefore using different standards to a achieve a result. “Mitsubishi Motors Australia does not agree with the testing underlying his claim, due to the many variations in the testing which makes the results presented by Mr Begovic to VCAT incomparable to the official ADR test cycle figures on the vehicle,” a spokesperson said. 12410931-ACM08-19

“In regards to the claim of Mr Begovic in the tribunal that his fuel consumption figures when he drove the vehicle exceeded the ADR mandated test figures: Mitsubishi Motors Australia note that real-world testing is different to laboratory testing. “The fuel consumption label on all vehicles states “actual fuel consumption and CO2 emissions depend on factors such as traffic conditions, vehicle conditions and how you drive” and this applies to all vehicles on the road today.“ Mitsubishi also made note that Mr Begovic had modified his vehicle, which could potentially lead to increased fuel consumption. Berwick Mitsubishi were ordered to pay Mr Begovic the sum of $39,500. Mitsubishi Motors Australia has separately applied for leave to appeal the Tribunal’s decision in the Supreme Court.
