Recipe for justice PERSON OF THE YEAR By Cam Lucadou-Wells “They are going to be held to account. We will get justice”. Those are the determined words of business owner Ian Cook - who is fighting a Davidand-Goliath battle against Greater Dandenong Council and the State Govermment. He says his Dandenong South commercial kitchen iCook Foods was effectively destroyed when it was shut down by health authorities and ‘named-and-shamed’ over the death of an elderly hospital patient. Mr Cook, who is Star Journal’s ‘2019 Person of the Year’, has led a loud and determined campaign to clear his name. He is pursuing $26 million in damages against the council and the Department of Health and Human Services over the 35-day shutdown in February. Eight months on, all 96 food-safety charges were dropped by Greater Dandenong Council. The council cited the $500,000-plus potential cost of pursuing the case. All too late for Mr Cook’s 41 staff who lost their livelihoods. And for the family business built over the past 30 years, the market leader for supplying Meals on Wheels services in Victoria, who had passed every previous audit, Mr Cook says. The charges and health inspection were “a set-up from day one”, he says.

ing on his case, including former police fraud squad detectives, accountants and metadata experts to “clinically and methodically” comb through the council’s evidence. Among the most dramatic accusations is that a visiting council inspector planted a slug on the factory floor - a claim that Greater Dandenong has “absolutely” rejected. “We’ll be sticks in the mud,” Mr Cook’s son and managing director Ben Cook says. “You don’t come in and think you can wreck a business. We have got the inner fortitude to stand up to a bully - you stand up to them and often they don’t fight back.” Victoria Police are also said to be probing whether the inspection evidence was fabricated. At the cost of $150,000, Mr Cook is applying to the Supreme Court for access to the inspector’s report - the supposed basis for the Chief Health Officer in shutting down the factory. So far, the department has rejected FOI requests for the report, Mr Cook says. Mr Cook says the council and State Government were, at the least, conflicted due to their links to rival business Community Chef. Greater Dandenong is a part-owner of Community Chef, which has received more than $10 million of state funding. Community Chef, like iCook Foods, supplies Meals on Wheels services. Mr Cook says the shutdown of his kitchen clearly benefited Community Chef to sweep up his lost contracts. “I hate conspiracy theories - but why else would you do something like that?” Greater Dandenong Council has been clearly unnerved by the campaign. Recently, it stated that iCook Foods was using media to “beat up” its claims. “If, as it frequently says to media outlets, it has evidence of some wrongdoing it should make that evidence available to council,” the council told A Current Affair. “The evidence to date confirms no wrongdoing of any kind by Greater Dandenong City Council.”

AFP threat By Mitchell Clarke A Dandenong man who allegedly threatened, offended and harassed an officer from the Australian Federal Police (AFP) could face nine years imprisonment if convicted. The 31-year-old appeared in the Melbourne Magistrates Court on Wednesday 8 January, following search warrants in Dandenong and Woodend. Officers were able to seize a number of electronic devices including several computer hard drives, USBs, mobile phones, laptops, a video camera, SD cards and a small quantity of cannabis during the warrants on Tuesday 7 January. In court, the man was charged with six counts of using a carriage service to “menace, harass or cause offence”, three counts of using a carriage service to “make a threat to cause serious harm” and one count of “threatening to cause harm to a public official, namely a pub-

lic law enforcement officer”. The AFP will allege the man made multiple “threatening, offensive and harassing” phone calls to the AFP and in some instances, allegedly impersonated a Commonwealth Prosecutor. It’s also believed the man targeted an individual officer and uploaded threatening material regarding the member online. Detective Superintendent Jayne Crossling said no one should be harassed or threatened in the line of duty. “We have a zero tolerance for those who would seek to menace our members and these charges are a reflection of this,” Det Supt Crossling said. “The safety and ability of our members to perform their vital work is of the utmost importance to the AFP.” If convicted, the man faces a maximum sentence of nine years imprisonment.

New bus for Springvale SDS By Taylah Eastwell Students of Springvale Park Special Development School have been gifted a new coach by children's charity Variety. The new Variety Sunshine Coach will cater to over 228 students with moderate to profound intellectual disabilities and enrich them with learning experiences outside the four walls of the classroom. Valued at over $165,000, the coach has been modified with a wheelchair ramp and some of the interior seating removed to accommodate for students in wheelchairs. With enrolments increasing every year, the new bus will allow more students to participate and engage in

New station By Mitchell Clarke A "cutting-edge" new ambulance branch in Dandenong is set to make a big difference for Dandenong paramedics, who are currently operating from a nearby CFA building. Dandenong MP Gabrielle Williams visited the site on Stud Road, Dandenong on 19 December to turn the first sod, marking the beginning of construction. The new branch will feature a five-bay garage for vehicles as well as modern facilities for paramedics including four rest and recline rooms, a kitchen, training room and staff car parking spaces. The State Government boosted $299 million into the 2019/20 budget to deliver more paramedics, more vehicles and more stations, which is set to provide peace of mind for locals. Currently, the average wait time for an ambulance to reach the scene of a Code One emergency in the City of Greater Dandenong is just less than 10 minutes, with 91.5 percent

"Ambulance response times were the worst on the Australian mainland, but we fixed that by investing more than any government in Victoria's history," she said. "We are kick starting building works so that local families can rest assured that when an emergency strikes, life-saving paramedics will be just around the corner. Health Minister Jenny Mikakos added: "We are putting Dandenong families first and building a new ambulance station to give paramedics the bigger, modern facilities they need to do what they do best - save lives."

Workplace death laws By Tina Toutzaris-Sabo, Senior Associate, Adviceline Injury Lawyers As at 19 December 2019, 157 Australians were killed at work compared to 144 workers in 2018. 70 per cent of workers who died last year worked in the transport, postal and warehousing; agriculture, forestry and fishing; and construction industries. Following these tragic losses, the State Government unveiled the Workplace Safety Legislation Amendment (Workplace Manslaughter and Other Matters) Bill 2019, which is due to commence no later than 1 July 2020. These new laws will make fundamental amendments to the OHS Act through the introduction of workplace manslaughter as a criminal offence in Victoria together with tough new penalties. The purpose of the new workplace manslaughter offence is to hold those with power and resources to improve safety to account. It is for that reason that these new laws will apply to employers, self-employers and company officers, those armed with the highest decision making and financial power. The objectives of the offence are to prevent workplace deaths; to deter employers from breaching their OHS obligations; and to draw attention to the gravity of such conduct which causes death or serious injury at work. The offence will capture negligent conduct which causes the death of an employee and/or a member of the public. Negligent conduct is defined as an act or omission which “involves

a great falling short of the standard of care” of a reasonable person in circumstances involving a high risk of death or serious injury. Adviceline Injury Lawyers expect that the workplace manslaughter offence will apply to the most serious and extreme cases, such as: - Three people died in 2013 after a timber billboard and the brick wall it was attached to fell on Swanston Street. Neither of the defendents sought an assessment to determine the structural integrity of the wall, they failed to get a permit for the sign and did not test the impact that wind would have on a wall built in 1971. Their breach was considered to be of the most serious kind. - In 2011 Brodie’s Law was introduced in response to the death of Brodie Panlock who took her life following relentless bullying at work. The proposed new offence will apply to cases such as Brodie’s, where an employer fails to provide a safe workplace and support for workers who are subjected to this behaviour. The new laws will allow courts to impose maximum penalties which include a jail term of up to 20 years, fines of up to $16,522,000 for corporations and fines of up to $1,650,000 for officers. These penalties send a strong and clear message that the safety of Victorian workers is paramount and will not be compromised, said Tina Toutzaris-Sabo, Senior Associate at Adviceline Injury Lawyers in Springvale. No one is likely to take exception to those who wish to use the white wash brush in writing 1920 on the footpaths. However, people fail to join in the joke when their buildings and fences received a coat of paint - the wrong color - or have to look in the next street to find their gates which have been lifted off the hinges.

50 years ago 8 January 1970 Council seeks Trots Track Talk The establishment of a top class trotting track in Dandenong is a step nearer reality and appears a strong possibility in 1970. The latest move by Dandenong Council has strengthened hopes that a metropolitan standard trotting track will be in operation at Greaves Reserve. Council has decided to ask Premier Sir Henry Bolte to receive a deputation from Dandenong Trotting Club and representatives of council. Meanwhile, a Bill to allow trotting in Dandenong is still on the notice paper of the Legislative Council. With the Government still smarting from its defeat in the local by-election, it appears that the Liberal Party will give far greater consideration to allowing the Bill through. There is no doubt the Government is "softening" on the question of another trotting track in the Melbourne metropolitan area. Most Dandenong people are in favour of the track, but there have been some opponents. In view of council's support of the trotting club, it is obvious that the majority of councillors are in favour of the proposal.

Springvale’s biggest annual celebration Lunar New Year Festival is back on Sunday 19 January 2020 and is entering its 28 year anniversary of organising this event. Regarded as one of the biggest event outside Melbourne CBD, the festival in central Springvale will bring in the Year of the Rat in style. Organised by Springvale Asian Business Association (SABA) since 1992, the event has gone from strength to strength. “It’s one of a major event in the City of Greater Dandenong and Springvale,” SABA president Daniel Cheng said. “We’re expecting crowds of up to 100,000. It attracts people driving up to five hours to Springvale to attend the event. “It has put Springvale on the map.” During the day, there will be three traditional lion dances - at the opening ceremony, 3pm and 8pm. The energetic dancers will be accompanied by rounds of fire-crackers to scare the bad spirits away for the new year. This year an extra item has add in is that Saba decided to use this one whole day to collect Gold Coins from Festival Patrons and hope will be able to raise some funds to the recent impacts of the cruel of the natural disasters BUSHFIRE. The opening ceremony will run from 11am - 1pm which includes a lion dance and live hip-hop dancing. Main stage entertainment is non-stop, including Japanese drumming, hip hop dancing, live bands, Chinese, Cambodian and Vietnamese dance and opera. Children will enjoy a wide range and new assortment of rides and games, dozens of food stalls will serve cuisine from around the world. There will also be merchandise and sponsor stalls throughout the festival. Willis and Desmond, Anisha and Samanda together with the president of saba Mr. Daniel Cheng are set to usher in the Year of the Rat ahead of the Springvale Lunar New Year Festival. At 9pm, the festival is rounded off with a fireworks display. Springvale is rich with Chinese, Vietnamese and Cambodian communities - each who celebrate the Lunar New Year. The vibrant festival however attracts “all different cultures”, Mr Cheng says. The event is the result of three months’ hard work and focus from SABA volunteers. It is also supported by City of Greater Dandenong and Victorian Multicultural Commission. Crunch time is looming By Nick Creely While there's still so much cricket left to play, and so many twists and turns inevitable, it appears as if the Dandenong District Turf 1 premiership race is now down to four clubs following the returning round after the Christmas break. Reigning premiers Buckley Ridges, Springvale South, Berwick and Turf 1 newcomers Narre South sit comfortably inside the topfour, with the Lions sitting two games clear of Hallam Kalora Park in fifth with five games to play. Down at Lois Twohig Reserve, Buckley Ridges dominated its clash with North Dandenong, but it has come at a cost. Just how much it will impact on the Bucks' fortunes, only time will tell. In the win, the Bucks lost the returning superstar Daniel Watson to a re-occurrence of his hamstring strain, while veterans Wes Nicholas and Susa Pradeep also went down with injury throughout. Batting first, the champs lost veteran batsman Paul Rudd in the opening over, caught behind off impressive seamer Nimesh Kariyawasam (2/43). But it brought together the might of Daniel Watson, returning from a hamstring strain, and skipper David White, who continues to dispatch DDCA bowlers at every turn. The pair combined some crafty stroke play with some utterly brutal shots that sailed well over the ropes. Pairing up for a brutal 154-run stand, the Maroons finally brought an end to the dominance, with Watson - on 93 - looking to clear the mid-wicket boundary but instead finding Syed Shah who held on to an outstanding catch in the ring. The skipper White - who made scores of 80 and 99 prior to Christmas to continue another golden season in Australia - held his nerve to build a partnership with Susa Pradeep, who immediately got busy to push the ball into the gaps. White looked an almost certainty to register his first century of the season, skipping through the 80s with two enormous sixes off consecutive balls down the ground, and with just six left for the three figures, the South African looked to bring up the milestone in style. But instead, White holed out to the longoff boundary to continue a rare run without a ton despite another dominant season, with a 1000-run season well and truly in the cards after skipping past 600 for the year in the knock. The Maroons rallied late to hold the Bucks back somewhat, with the visitors still reaching

It was an even battle between bat and ball with the Bears winning the toss and electing to bat, registering 7/176 off its 40 overs, with allrounder Ruwantha Kellepotha (46) and Matt Robertson (48) combining beautifully through the middle to set up the total. In reply, in-form opener Morteza Ali threatened to take the game away in one foul swoop

to race to 36 off 39 balls, but his wicket - courtesy of the searing pace of James Wilcock (2/33) - got the Bears going. With the game in the balance, Ashan Wijayakumara held firm on one end with the blade, but the Bears managed a steady flow of wickets, with the scalps of dangerous duo Jonty Jenner and Scott Phillips putting the home side into the box seat. But as the Lions have done all season, they refused to roll over, with Wijayakumara combining for a series of handy partnerships on his way to a solid half-century. Bringing the game down to the final over, with 11 runs needed and with the ball in the hands of Jarrod Goodes (3/27), the veteran managed to snare the final two wickets and deliver a thrilling eight-run win to the home side. Springvale South was another side that escaped with a last-over win, holding off a brave Heinz Southern Districts at Reedy Recreation Reserve. Skipper Ateeq Javid (65) once again led the way to compile yet another half-century as

the Bloods recovered from a middle-order collapse to post 7/176, a strong total on the pitch. While the great Craig Slocombe (2/32) did some fine work early to help put the Cobras in a tough position at 4/84, the home side managed to scramble a vital partnership through skipper Kaushalaya Weeraratne (43) and Chandima Abeykoon (36), who got the team within 20 runs for victory and with six wickets in the shed. With just 15 runs needed from the final three overs, the Bloods dug deep, somehow restricting the Cobras to 8/171, just five runs shy of victory. Left-arm tweaker Jarryd Straker was once again enormous, snaring 3/26, while the bowling of Nathan King (2/12) late also proved vital. In the remaining match, Hallam Kalora Park (4/175) managed to keep itself within touch of a finals position after a comfortable win against St Marys (7/174) at Carroll Reserve. Ryan Hillard (63) and Leigh Booth (52) were outstanding for the Hawks in the victory.

Under-pressure Panthers suffer yet another cruel loss By Tyler Lewis It was another cruel loss for Dandenong as it fell millimetres from victory in its first encounter after Christmas. Unfortunately for the Panthers it has been a similar story to many games through this season, and it very well could be the margin between them and finals cricket. In its match on Saturday against FitzroyDoncaster, the Panthers were sent in on a slow green track in overcast conditions. After losing openers Brett Forsyth (10) caught behind and skipper Tom Donnell (seven) LBW, the Panthers were in need of a rebuild. Ed Newman and Cam Forsyth slowly but surely resurrected the innings before Newman was victim of the sensational arm of Victorian Premier Cricket champion Peter Dickson. With a consistent fall of wickets inside the first 15 overs, Forsyth combined with James Nanopoulos to build a competitive total. When Nanopoulos rocked back and pumped a short ball to the fence only metres off the ground; the games trajectory, as it has seemed all season, was in his hands. Shortly after the drinks break was the passage of 10 overs that cost the Panthers dearly, losing the set Forsyth and Nanopoulos before the reliable Comrey Edgeworth also found himself in the shed, as Dandenong lost 3 / 4. A fighting performance with the bat from Jacques Augustin against his old side and Pete Cassidy nudged the Panthers to 144, short of the mark the Panthers would have wanted at drinks, but something for the bowlers to work with. The Christmas break proved to have no impact on Nanopoulos as he continued on his merry way with the ball, claiming three of the first four wickets to equal the Dandenong Cricket Club record of 313 victims. The Lions coasted along ticking over the run rate until Pete Cassidy gave his side a sniff, snagging two wickets in one over to inject some life into the Panthers. Unfortunately for Dandenong, the season of heartbreaking losses continues into the New Year as the Lions hung on to a two-wicket victory - the third defeat of the season by two wickets or less. Dandenong will face Ringwood at Shepley Oval this weekend, and finals may be a difficult feat for the Panthers, but with several teams in the run home on the brink of the eight, they can certainly shake some team's finals aspirations.

Talent runs deep for Jono By Nick Creely Now that Jonathan D'Rozario has had a taste of wearing the Victorian colours against the very best young talent Australia has to offer, all he wants is more. More improvement with his batting and bowling, more camaraderie with his teammates, and more opportunity to showcase exactly what he's capable of at the elite level. The 18-year-old Monash Tigers all-rounder and Buckley Ridges product has plenty of tricks up his sleeve, and after a successful Under 19 National Championships carnival with Vic Country just prior to the Christmas break, D'Rozario is hoping that can translate into club cricket and beyond for the remainder of the season. "It (the National Championships) was an amazing experience, I couldn't have asked for it to be any better, or any worse," he said. "Getting to play on the WACA in the end, and being able to learn and play against great players, the facilities, the coaches, it was all second to none. "The coaches were always talking to me about improving my game, just those little things that I can take and bring back to club cricket and hopefully it can help me progress my game." D'Rozario's carnival was strong, notching up scores of 38 and 40 throughout, before a sparkling 50 on the WACA in the final against NSW Metro almost helped Vic Country clinch the title. "I wanted to just go out there and enjoy the experience, and play hard cricket - that's the way I play, and I felt like I played my role," he said. "There were some limited opportunities at times, but as soon as I got the ball in my hand, or had the stick in the middle-order I was trying to get us over the line, and that's what I based myself off.

"I felt like I played a big role in a few of those games, but if you looked through a few of the players coming through the ranks, I like to look at myself like a Michael Bevan, he was able to finish off through the middle, which I unfortunately wasn't able to do, but I still felt I played a role while it would have been nice to help us over the line on a few occasions." With the ball, the youngster was just as vital, snaring six wickets at 23.3 and providing excellent spin coverage through the middle overs. "We had a very strong spin attack, so I knew it'd be competitive getting overs in, but when I did get the chance it was about getting wickets, and if not, being economical, which I think as a spin group we did really well," he said. "It was terrific being involved with the spin group." At club land for the Tigers in the Victorian Premier Cricket competition, D'Rozario has shown glimpses of his glittering talent in the first portion of the season with scores of 44, 79 and 60 in the middle-overs, while also contributing some handy wickets. But, the ambitious talent wants more. He wants to hopefully break in for a first XI debut for the end of the season, and help the team and club - win games of cricket. "Hopefully I can carry on some momentum from the first half of the season, I got a few scores here and there, but I want more consistency with the bat and to take more wickets with the ball, and I just want to try and contribute the best I can for the team," he said. "If I'm contributing to winning games for Richmond, I feel like I'm doing my part." The Tigers have enjoyed a stellar 2019/20 in terms of development, with teenager Jake Fraser-McGurk making his Shield debut for Victoria, quick Mitch Perry making his oneday debut for Victoria, while in total, seven youngsters represented the club at the Under 19 National Championships, including fellow Dandenong District prodigy Yash Pednekar. "There's no luck about that - the way Youngy (coach Shannon Young) is bringing us all through, his coaching program and the way he goes about it is unbelievable," he said. "From the first day we walked through the door at TNF cricket in Oakleigh, we all got to know each other and we could feel something special brewing." But home is where the heart is. D'Rozario moved to Buckley Ridges - the little club on Pultney Street that is a powerhouse in the DDCA - from Lynbrook when he was 14, finishing off his junior career at the Bucks, a place where his dad, Shane is revered as one of the club's greatest cricketers, and one of four to have won a Wookey Medal as the champion player in Turf 1. And what was even more memorable, the father and son even starred together in a Turf 3 flag for the club in 2016, with Shane belting 74, and Jono snaring 5/56. They even put on a vital 50-run stand that helped sway the game into Buckley's hands. Those memories of his dad's glory days at the Bucks are ones he'll never forget, and always hold dear to him.

"We watch cricket every day around the house, and I think Mum and my sister probably get fed up with it, but we're all the time talking about it, in the car on the way home from training, it's like having another coach 24/7. "And I was there at every Turf 1 game, always in the nets - he'd always bat down the order. I love hearing the stories about how he and Paul Rudd would come in at seven and eight and somehow save a Turf 1 game, it's brilliant. "He bowled offies, and I'm always asking about how he used to work out batsmen, but I remember him to be one of the better DDCA players going around. "The old man is very special."

And as for the club itself, D'Rozario couldn't have higher praise for the current Turf 1 champions, who have got a blend of star players, both home grown and from overseas. "I'm around the club as much as I can, and every person around the club, whether it's in the ones with DJ Watson, has been brilliant in trying to build great cricketers and help other people," he said. "That's the most important part of the club. "Even all the imports that have come through, Luke Fletcher, Dave White at the moment, and getting a chance to talk to those people, give you a chance to keep learning, and it's brilliant they're able to help me out, and help all the cricketers at different levels coming through the ranks. "The more time I get to spend there the better - they're just awesome people."
