While issues of women’s property rights remain at the grassroots level, many women in Malaysia are seen to be taking major strides in the property industry.

Property ownership by women

The United Nations has drawn up 17 Sustainable Development Goals to be achieved by 2030, including one that calls for gender equality. Among others, the goal of “achieving gender equality and empower all women and girls” involves property ownership and control over land. It is to address the fact that many women around the world are victims of religious and customary systems that deny them their rights to property ownership. While religious and customary laws have granted equal ownership of property to couples, women are often found to be treated unjustly based on custom and tradition. This then raises the following questions: • Why do women still face unequal share of inheritance of land and property? • Why are women still struggling to claim ownership of what is rightfully theirs? • Why do many women still need to register their property under the names of their husbands, brothers, fathers or sons? It is to be noted that Malaysian common law as well as religious laws grant equal rights to women when it comes to land and property ownership. According to Prof Siraj Sait, University of East London Director of Research and Director of the Centre for Islamic Finance, Law and Communities, religions and customary traditions across the globe are often multi-layered and can lead to misinterpretation of women’s property rights. “The approach towards women’s property rights is shifting from needs to rights approach. The shift is from a charity approach to needs approach followed by empowerment approach to the rights-based approach,” he said at a training session during the World Urban Forum 2018 held in Kuala Lumpur in February. Titled ‘Human Rights-Based Approach to Women's Land and Property Rights in the Mus-

lim World’, the session was participated by stakeholders and women rights champions from countries including Sudan, Saudi Arabia, Ethiopia, Indonesia, Jamaica, USA and South Africa.

Religious and customary laws In some cases, the misinterpretation of religious laws and the enforcement of customary laws have resulted in women being denied their rights to property ownership. Land and property rights were assumed to be exclusive to men because of the patriarchal nature of the society and the ancient social beliefs the women are forced to follow. As time passed, land and property exclusivity to men became the norm and accepted by both men and women. Steps being taken by government and private bodies to educate women on property ownership are often limited to urban areas. Women in rural areas, without access to education and information, are often left with nothing.

Significance of owning property 1. Financial freedom from property ownership Property is seen as a durable asset and low-risk investment. Often, women are limited to liquid assets that are highly likely to be sold off first in the face of tribulation. Owning property gives them long-term economic assurance and a nest egg for their old age. 2. Property as an empowerment tool Women with property ownership have rights to decision-making on various aspects of their lives. Owning properties will give them social status and respect in the community that might be lacking otherwise. With decision-making rights come

However, this was not the case in the 1980s when women were deemed incompetent to purchase properties and finance loans. As a result, women were reluctant to venture into the property industry. Property investor and author Dr Renesial Leong recounted her experience in the 1980s when she was scouting for a sub-sale unit. “I remember setting an appointment to view a unit, and the male owner told me point blank that he would only proceed with the viewing if my dad, the decision-maker, came along!” Today, the property scene in Malaysia has progressed to be more inclusive of women. However, many women still lack the courage to enter the industry. “One of the main reasons might be not understanding the game enough to have the courage to take that first step,” said Dr Leong. “I strongly urge all women out there, regardless of their age, to consider owning properties as one of their main investments. Done correctly, the benefits are profound and financial security is long-lasting,” she said in emphasising the fact that property is indeed an empowerment tool for women. > So dear women, clear the cloud of societal norms this Women’s Day and get a grip on your property rights.

If it is a serviced suite, should the landlord expect the tenant to be around and help out during the cleaning? A3: Whether or not the tenant’s presence is required during the cleaning operation depends on the terms in the cleaning agreement or service agreement done between the landlord and the tenant.

I would like to know how to calculate the cost to renew my leasehold property as I plan to resell it. My house is in Shah Alam and currently has 39 years left in the lease.

A4: If you intend to extend the lease of your property for the purpose of selling it subsequently, you need to pay the premium for the lease extension. Currently, the Selangor government is giving a 30% rebate on the rate of premium under this option. The formula for the calculation of the rate of premium is as follows: Premium=0.25 x 0.01 x Market Value of land (sq ft) x number of years to renew x land area (sq ft) Assuming you intend to extend the lease for a 2,000-sq-ft residential property in Shah Alam with 39 years remaining on the lease, and assuming your property is valued at RM80 per sq ft by the authorities, the premium is 0.25 X 0.01 X 80 X 60 X 2,000 = RM24,000. Leases are usually renewed to 99 years. In your case, you need only pay for an extension of 60 years (99-39 years). After deducting the 30% rebate, the premium payable will be RM16,800.

utting a value on every object is the norm in today’s world. For the property industry, a professional valuation is particularly crucial as it ensures that all parties – buyer, seller and banker – are getting a fair price. And this is achieved through the services of the valuer, who is an independent, honest and professional third party. A valuer is someone who is responsible for determining the fair worth of a property, which includes land, buildings and houses. In Malaysia, a valuer is usually appointed by the bank or an individual during the transaction of a property. This profession is governed by the Valuers, Appraisers and Estate Agents Act, 1981 (Act 242). As part of the Career in Real Estate series, StarProperty.my interviewed CBRE|WTW managing director Sr. Foo Gee Jen to gain an insight into this valuable occupation. “A valuer is crucial in maintaining a

balanced economic banking ecosystem. Before applying for the housing loan, the bank needs to ensure that the valuation of the property matches the market price, which is based on certain criteria including the property type and location. “They will appoint an independent valuer to assess the property and provide an estimated value,” said Foo. “The role of a valuer is necessary for the banking system to protect their interest. If the lendee is unable to pay the loan and the house goes into auction, the bank can get back the money that was lent out. “It also serves as a prevention measure against the previous owner or developer to mark up the housing price for extra profits,” explained Foo. “If the bank lends a person RM500,000 for purchasing a house without appointing a valuer, and it turns out that the real value of the house is only RM400,000, it will cause the bank a loss of RM100,000.” Valuers have a significant responsibility because they are the ones putting the signature on the valuation report before handing it to the bank or the individual. They are legally responsible for the

information provided, and their liability in an approved valuation report is up to seven years. Besides Act 242, valuers also have to comply with the standards set by the Board of Valuers, Appraisers, Estate Agents and Property Managers. “To become a licensed valuer, one must practise in the field for two years under the supervision of a registered valuer before being qualified to submit the Test of Professional Competency (TPC) logbook to the board. An interview will then be arranged, and the practitioner has to pass it to become a licensed valuer,” explained Foo. As a graduate of Estate Management from University Technology Malaysia (UTM), Foo elaborated that the course is a multi-discipline programme encompassing the real estate principles, the principles of land law, the Local Government Act, the

Town Planning Act, the principles of the national land code, and more. “On top of that, we also learn about building technology, accounting, property and facilities management, and contract law,” he said. The degree prepares the student to become a valuer, an estate agent or a property manager. In his case, Foo was trained in all three fields before he went through the TPC logbook submission and interview. “These fields are interrelated and having a thorough industry knowledge will help you become a well-rounded property consultant,” said Foo. Take proactive steps to accommodate the visually impaired in your premises

Malaysia’s blindfriendly facilities are gradually increasing with the implementation of rubberised walkways but there is still room for improvement in terms of awareness.

osing one’s eyesight is one of the most terrifying experiences anyone could go through, especially when we all rely so heavily on our vision every day. Life will no longer be the same once a person becomes visually impaired because of the adjustments that have to be made to cope with the disability. The transition is never an easy one. The lack of awareness, the limited amount of things one can do without help, and the massive lifestyle changes can be overwhelming. Though the number of visually impaired people accounts for a small percentage of the general population, it is important for us to take proactive steps to better accommodate them. You can do a few things in your property to ensure that it’s blind-friendly.

Stairway railing The simple act of climbing up and down the stairs can be hazardous for those with bad eyesight. The staircase can be dangerous if there are no indicators to alert the visually impaired. One preventive measure is to make sure that each step is painted with alternating contrasting colours to create a striking Zebra pattern. This allows people who have poor

eyesight to perceive some level of depth when climbing. To help those who are completely blind, a railing with a strong grip is best as it provides strong support.

Colour contrast When it comes to choosing cutlery or dinnerware, ensure that the colours contrast each other so that the visually impaired can figure out where every item is. This also applies to towels in your bathroom.

Natural lighting Most if not all those who are visually

impaired usually prefer natural lighting when carrying out their daily tasks. However, this is subject to their preference. Thus it is important to observe their reaction to the lighting in your house or property.

Large signs Signs are helpful to the visually impaired because they serve as a guide. Signs that are extra-large with high contrast text are most welcome. Nevertheless, it would be courteous to have braille points that are at the average hand-reachable level. Another way is to have a talking sign that is activated by a button.

Clear walkways

Cluttered and messy walkways can make it difficult for the visually impaired to navigate through. Clutter acts as hindrances to those who can’t see very well. Also make sure that your furniture and decorations are arranged in such a way as to not block their path. This means not having a chair in the middle of the room or a huge table next to the entrance.

This classic material has undergone cycles of aesthetic revolution, yet it remains popular in the modern household. Undeniably, the emergence of new, cheaper and easy-to-obtain substitutes such as moulded plywood, plastic and fibreglass has changed the furniture industry but solid wood is here to stay. The beauty of solid wood furniture lies in its strength, durability and natural textures. A high-quality piece can last for decades or even centuries with proper use. However, some furniture may look great in the showroom but their flaws will only be revealed once you bring them home for use. The following tips will help you spot a real solid wood piece.

1. Price tells the quality The plantation solid wood usually takes 15 to 25 years to grow before it can be harvested. Besides the investment in wood-drying equipment, the idea and design generation process and craftsmanship define the value of the solid wood furniture.
