Rice Women of Today has Easter eggs to go around

With most lawns still covered with piles of snow, Easter fun on Saturday found its way indoors.

The Rice Women of Today hosted its Easter event April 1, where scattered plastic eggs dotted the oors of Old Village Hall in Rice. The two-hour event was not a race but instead a test of stamina. Little ones and their families got their ll of bags, buckets and baskets of empty eggs that were exchanged for prizes. Kids returned to the activity over and over as they wished while others moved on to register for door prizes, have their faces painted and take photos with the Easter bunny.

The Benton County Board of Commissioners met in special session on March 15, 2023, at Minden Townhall, 2989 Golden Spike Road NE, Sauk Rapids, MN 56379. Call to order by Chair Scott Johnson was at 6:30 PM followed by the Pledge of Allegiance to the ag. A roll call showed Commissioners Beth Schlangen, Scott Johnson, Steve Heinen and Ed Popp present. Commissioner Gapinski was absent. Chair Johnson noted the absence excused.

Chair Johnson requested to conduct a public hearing on the revocation of County Road 50 right-of-way. The County has expressed an interest in revoking County Road 50 rightof-way to Minden Township. Such revocation will then allow the City of Foley to pursue the acquisition of land area needed for its odor control facility (a component of the wastewater project to connect the City of Foley to the St. Cloud regional wastewater treatment plant). The public hearing opened at 6:30 PM. Jack Brosh of 453 Stanley Drive, Foley, MN, representing the City of Foley, spoke in favor of the revocation of County Road 50 right-of-way. No one else spoke at the public hearing. The public hearing closed at 6:31 PM. There were no emails, letters or other communications to be read into the record. There were no comments or concerns from State agencies, cities or townships on this agenda item. No of cial action was required by the Township. Motion by Johnson and seconded by Heinen to approve the revocation of County Road 50 right-of-way to Minden Township. Motion carried unanimously. County Administrator Montgomery Headley noted that the Resolution, evidence of civil process, and the Af davit of Posting was led with the Auditor-Treasurer on March 14, 2023, and the easement is complete. Also, Headley will record an underlying Quick Claim Deed associated with that process on March 16, 2023.

Chair Johnson adjourned the Regular Board Meeting at 6:34 PM.

County Administrator Montgomery Headley requested to amend the agenda to add Consent Agenda item # 6 to consider the Management Representation Letter for Auditor-Treasurer Agreed Upon Procedures (Transition “Audit”); and to add Regular Agenda item to consider a Resolution of Support: Pope/Douglas Solid Waste Management’s Application for Capital Assistance Program (CAP) Grant funds for Phase II of their project to retro t and expand the existing waste diversion/recycling processing facility as the third item under Land Services Director Roxanne Achman at 9:50 AM. Motion by Popp and seconded by Heinen to approve the amended agenda. Motion carried unanimously.

Next, Schlangen requested to pull Consent Agenda item #4 to consider the request for unpaid leave for an employee from 3/03/2023 through 7/20/2023. Motion by Popp and seconded by Heinen to approve Consent Agenda items 1-3, 5 and 6: 1) Approve the Regular Meeting Minutes of February 21, 2023 and authorize the Chair to sign; 2) approve the Regular Meeting Minutes of March 7, 2023 and authorize the Chair to sign; 3) approve a Collective Bargaining Agreement with AFSCME Council 65, Representing Human Services Employees, for the Period of January 1, 2023 through December 31, 2025 and authorize the Chair to sign; 5) approve the 2023 SCORE Grant Applications Round I; 6) approve the Management Representation Letter for Auditor-Treasurer agreed upon procedures (Transition “Audit”) and authorize the Chair to sign. Motion carried unanimously.

Next, Schlangen requested a correction on Consent Agenda item # 4 to change the wording in the body of the Agenda item request for unpaid leave from March 1, 2022 to July 20, 2023 to March 1, 2023 to July 20, 2023. Motion by Schlangen and seconded by Johnson to approve Consent Agenda item # 4 to approve a request for unpaid leave from March 1, 2023 to July 20, 2023. Motion carried unanimously.

Next, Marion Larson of the Central MN Emergency Medical Services Region provided a presentation to the County Board. This was for informational purposes only.

Next, the City of Gilman of cials discussed the City’s wastewater system project with the County Board. Gilman Mayor Adam Mueller, Council Members Jeremiah Dahler and Andy Schommer, along with Kevin Szafranski presented to the County Board. This was for informational purposes only.

Next, the County Board considered participating in the “Mighty Mississippi River Clean Up Challenge” between April 15th and May 15th this year. Goodhue County Commissioner Linda Flanders encourages counties to sponsor cleanup events during this timeframe. Property Management Director Jeff Dingmann stated he will contact local Boy Scout/Girl Scout Troops to help with clean-up along the river and will look into costs of obtaining a dumpster to be placed at the park.

The Regular County Board meeting was recessed at 9:40 AM to conduct a Human Services Board Meeting.

The Regular Board meeting reconvened at 9:47 AM.

Next, Headley requested the County Board to select two members to a County Engineer Selection Committee (to review applications, interview nalists and recommend a hiring decision to the County Board). Three Board members volunteered to be on the Committee, and there was a consensus among the County Board to table this until the next Board Meeting to allow time to decide who would be the best t for the County Engineer Selection Committee. Motion by Popp and seconded by Gapinski to table this topic until the Tuesday, April 4, 2023 Regular Board Meeting to select two Board members to be on the County Engineer Selection Committee. Motion carried unanimously.

Next, Headley asked the County Board to consider a Resolution to af rm participation in a national settlement with supply chain distributors of opioids. The Resolution was provided by AMC and af rms Benton County’s endorsement of and participation in a national lawsuit settlement with opi- oid supply chain distributors (e.g., retail pharmacies such as Walgreens). Motion by Popp and seconded by Gapinski to approve the Resolution to af rm participation in a national settlement with supply chain distributors of opioids. Motion carried unanimously.

Next, Headley requested the County Board consider an agreement with Employee Strategies. The County’s Management Team recommends entering into an agreement with Employee Strategies to conduct employee surveys and to work with the Management Team to develop employee retention strategies. Employee Strategies was recommended by the Association of MN Counties. The overall goal of obtaining the services of Employee Strategies is to identify what might be causing employee turnover and then develop strategies to address those causes. Headley added that the cost to conduct the survey would be about $15,000, and we have a suf cient employee training budget to cover the cost. Motion by Heinen and seconded by Popp to approve the agreement with Employee Strategies. Motion carried unanimously. Headley added that he will work with the Management Team to nd the best timeframe to conduct the surveys within the next 6 months.

Next, Property Management Director Jeff Dingmann requested the County Board consider an agreement with Hennen Enterprises for a forestry management project at Bend in the River Park, as recommended by Forester Bob Perleberg and the Benton County Park Commission. Mr. Perleberg has obtained bids from commercial loggers to complete the forestry management project at Bend in the River National Park. Mr. Perleberg recommends the contract with Hennen Enterprises. The project will involve selected thinning of pine tree stands on the east side of the park (approximately 20% - 30% removal) to improve the health of the remaining trees. In a few instances, pine tree stands will be removed completely due to the species nearing end of life. The nal forestry management plan was presented to the Park Commission, which supports the plan as recommended by Mr. Perleberg. Mr. Perleberg informs us the logger expects to begin work around April 10th. During the project, the East side of the Park will be closed. The County will put up barricades on entrances to the East side and will post signage. We will also send out news releases. Based on the estimated tree removal, the County should receive approximately $39,335 from the logger. The Forester will receive 13% of this amount, per his agreement with Benton County, leaving a net of $34,221 to the County. Headley recommends depositing these funds to the Parks CIP fund to be used for stump removal and prairie grass seeding where trees have been removed. Motion by Gapinski and seconded by Popp to approve the agreement with Hennen Enterprises for a forestry management project at Bend in the River Park, and to deposit the funds to the Park’s CIP fund to be used for stump removal and prairie grass seeding where trees have been removed. Motion carried unanimously.

Next, Land Services Director Roxanne Achman requested to conduct a public hearing on the proposed changes to the Benton County fee schedule. At the February 21, 2023 County Board meeting it was recommended by the Board to bring forward the recommended fee for the AgBMP Septic Loan Application (a new application and program) and to hold a public hearing in accordance with MN Statutes. The proposed application fee is $100.00. The public hearing on proposed changes to the Benton County fee schedule opened at 10:06 AM. No one was present virtually or in-person to speak. The public hearing closed at 10:07 AM. Achman reported that there were no emails, letters or other communications to be read into the record. The Department has not received any comments or concerns from State agencies, cities or townships on this agenda item. No of cial action was required by an affected Township. Motion by Gapinski and seconded by Heinen to approve the revised Benton County fee schedule effective March 21, 2023. Motion carried unanimously.

Next, Achman requested to consider a Resolution adopting the AgBMP Loan Terms and Lien Agreement for Eagle View Commons Community Septic Repair/Replacement. Achman stated that the County Board must set the terms of the loan. In accordance with Minn. Stat. §17.117 Subd. 11, the county shall set loan terms that do not exceed a term length of 10 years or exceed an interest rate of 3% per year. Since the February 21, 2023 Board meeting there has been additional discussion on the interest rate and the cost to the County for managing the AgBMP Loan Program. Achman provided a memo with additional details about the cost to the county, the letter from Eagle View Commons HOA, the March 22, 2022 Committee of the Whole minutes, a copy of the lien document applicants would be required to complete as part of the loan application, and the resolution outlining the terms of the AgBMP Loan. The project is anticipated to cost an estimated $444,000. This cost is only an estimate and is subject to change. It will not be nal until all invoices have been received from the contractor for work completed. Motion by Johnson and seconded by Heinen to set the interest rate of the loan at 1.75% of the AgBMP Septic Loan agreement. Motion carried unanimously.

Next, motion by Johnson and seconded by Heinen to have the loan due and payable in full upon any sale, conveyance, or other transfer of property. Motion carried on a 4 to 1 vote, with Commissioner Schlangen, Heinen, Johnson, and Gapinski voting “aye” and Commissioner Popp voting “no”.

Next, motion by Heinen and seconded by Gapinski to approve the term of ten (10) years for the AgBMP Loan for parcels within the Eagle View Commons development. Motion carried unanimously.

Last, motion by Johnson and seconded by Heinen to adopt the resolution outlining the terms of the AgBMP Septic Loan and Lien Agreement for Eagle View Commons Community Septic Repair/Replacement. Motion carried unanimously.

Next, Achman requested the County Board to approve the Resolution of Support: Pope/Douglas Solid Waste Management’s application for Capital Assistance Program (CAP) Grant funds for Phase II of their project to retro t and expand the existing waste diversion/recycling processing facility. Achman stated that Pope/Douglas Solid Waste Management is submitting an application for grant funds to the MPCA for Phase II of their project. In 2019, Tri-County signed a letter of support for a grant application that Pope/Douglas submitted to the MPCA. Due to the total project cost, the MPCA advised that the funding request be submitted in phases. Phase I of the project included the construction of a Source Separated Organics Facility. Funds were awarded and the facility was opened in September 2022. The resolution is in support of the Phase II of the project, which involves retro tting and expanding the existing waste diversion/recycling processing facility. Achman noted that there is no scal responsibility to the County by adopting this resolution. Motion by Popp and seconded by Johnson to approve the Resolution of Support: Pope/Douglas Solid Waste Management’s Application for Capital Assistance Program (CAP) Grant funds for Phase II of their project and to retro t and expand the existing waste diversion/recycling processing facility. Motion carried unanimously.
