The second post implementation review (PIR) of the Control of Asbestos Regulations 2012 was launched on May 21st and closed on June 11th. A PIR is a requirement of the legislation and is carried out every 5 years. A PIR provides the analysis required to establish whether, and to what extent, the regulation has achieved its original objectives, has objectives which are still valid, is still required and remains the best option for achieving those objectives, and whether the regulations can be improved to reduce the burden on business and overall costs. Stakeholders’ views about the effectiveness of the regulation were sought via a short online survey. A statutory review report to accompany the PIR is expected to be published in April 2022. Another major occurrence since the previous issue of ARCA News was the publication of HSG 248 ‘Asbestos: The Analysts’ Guide’ Revision 2 on May 14th 2021.

would not normally write a Chief Executive Comment for ARCA News this close to publication date, but today is June 15th, the day after the Prime Minister’s announcement that the lockdown is to be extended for a further 4 weeks, therefore rather than restrictions being lifted on June 21st they will now hopefully be lifted on the July 19th. In the last issue of ARCA News, I explained that despite the June regional meetings being arranged for post June 21st, there was still uncertainty as to whether all restrictions would be lifted by that date, and as a result we had decided to conduct these meetings remotely. As it has turned out, and due to the Asbestos Network meeting being rescheduled to July 7th, the regional meetings have been pushed back to July 14th, 15th and 16th, which will still be in the extended lockdown period, and confirming our decision to hold this round of meetings remotely was the correct one. Having said that, we are in the process of booking meeting rooms at the usual hotels and venues for us to hold face to face ARCA regional meetings once again in November. The details of these meetings are on the ARCA website and in the Diary Dates section on page 8.

The guide also states that analysts should not clean up any dust or debris as part of the 4-stage clearance, as this is work with asbestos and potentially a licensed activity. Clean ups should only be carried out by the licensed contractor. Further details of the 4-stage clearance procedure contained within The ‘Analysts’ Guide’ can be found on pages 28/33 in this issue of ARCA News. As well as changes and clarification to technical and personal safety issues, sampling and 4-stage clearances, for the first time Revision 2 of The Analysts’ Guide’ also includes information to assess the presence of asbestos in soils and made ground. Following the success of ARCA’s online training delivery, we have now adapted the training that accompanies the RSPH Analysts and Surveyors qualifications so that it can be delivered remotely one day a week over 3 or 4 days depending on the qualification. The candidate then attends an ARCA/ATaC centre to undertake the assessments which need to be completed successfully to gain the qualification. This is seen as a more flexible and cost-effective method of delivery that may suit some candidates and businesses. Furter details on this remote training option can be found on page 34/35 of this issue of ARCA News. We are still planning to showcase the new Site Audit Portal, an online portal showing a compilation of member’s site audit reports, results and trends, and the Asbestos Labour Feedback App for member’s directly employed operatives, at the regional meetings in July. The next issue of ARCA News should be published in time for the Associations AGM which is scheduled for 1st October 2021 at Lords Cricket Ground. Lets hope by then our way of life has returned more or less to the way it was prior to March 2020.

ARCA Site Audit update 2021 T

he ARCA in-house Audit Team completed over 280 site audits in the first five months of 2021. This high number is due to members now undertaking 3 site audits in a membership year as part of the Site Audit Accreditation Scheme (SAAS) and an increase in additional site audits being booked by member contractors. The SAAS audits, a requirement of membership, are unannounced so inevitably ARCA Auditors arrive at some sites which are not at a stage for an audit to be conducted. However, ARCA continues to take that financial hit (time and resource) as the

underlying reason for the unannounced element is to demonstrate high audit standards are maintained across the ARCA membership. Also, over 340 internal audits were conducted by member contractors during January to May 2021 using the ARCA Member Internal Audit App. This is extremely positive as ARCA developed the App so members could use the ARCA site audit question set for their own internal audits, enabling direct comparisons of external and internal audit results, therefore providing a stronger management tool.

ARCA strengthens in-house Audit Team T

he Association has strengthened its in-house Audit Team employing a third auditor due to the increase in the number of membership audits required. Auditors Matt Lambert and Duncan Williams welcomed Juliette Church into the team earlier this year. Juliette is an experienced auditor with knowledge of the asbestos industry and regulations, so was soon undertaking site audits of ARCA members. “I am excited to be working with the team at ARCA and sharing my knowledge and experience with our members. ARCA is held in high regard within the asbestos industry, so it is a privilege to have joined such an industry leader,” commented Juliette Church, ARCA Auditor. What audits do the team undertake? Auditors arrive on site unannounced to monitor the performance of member asbestos removal contractors three times per membership year, as part of the Association’s Site Audit Accreditation Scheme, and conduct additional site audits requested by members as part of their own management programmes. Also, the team undertake annual audits for scaffolding and equipment maintenance members who hold an HSE licence. Further information on ARCA audits can be found at arca.org.uk

Labour Agencies recognised on Governing Council

ARCA to exhibit at O Contamination Expo 2021 O

n the 22-23 September ARCA will be exhibiting and speaking at Contamination Expo 2021 at the NEC, Birmingham. At the event, the Association will promote awareness of asbestos, and how this hazardous material should be managed to reduce the health risks to workers and the public. ARCA will communicate how it has taken further steps to promote professionalism and high standards in the industry. Including how member contractors now require not two but three satisfactory unannounced (no prior notice) site audits each year to maintain membership. Also, the Asbestos Labour Feedback App (ALFA), will have a presence on the stand, to communicate how this App enables member contractors to rate the performance of agency operatives working on their sites. With an operative’s overall performance rating providing added reassurance of competency to the contractor. “Having platforms to promote good practices when managing asbestos in buildings and demonstrating how ARCA and members can support premises owners and duty holders, is important to support the health and safety of workers and the public alike,” commented Steve Sadley, Chief Executive of ARCA. ver the past two years the number of Labour Agencies (Labour Supply Members) joining the Association has increased significantly. The Labour Agencies within the asbestos removal industry play an important part as they provide a labour resource that ARCA Licensed Asbestos Removal Contractors (LARCs) can tap into when demands are placed on their own in-house labour during busy periods, such as the summer months. Labour Agencies have joined ARCA in significant numbers recently to take advantage of being involved in the Asbestos Labour Feedback App (ALFA) project, the scheme whereby agency labour is rated by ARCA member LARCs utilising the labour, and then these ratings are made available to other LARCs prior to them agreeing to utilise them on their asbestos removal sites. In fact, without the participation and cooperation of the Labour Agencies ALFA would not have been possible.

Due to the important role played by Labour Agencies in general, and in ARCA’s latest initiative in particular, the Association wanted to recognise this by allocating a dedicated seat on the ARCA Governing Council to a Labour Agency representative. Initially it was decided to second an agency representative onto the Governing Council with a view to this becoming a fully elected seat at the AGM this year. In February, the Labour Agencies were asked to vote as to who they wanted as their seconded representative, and Dominic Fagan of DKF Recruitment Ltd was selected. Work has now begun to amend the Articles of Association to provide for a Labour Agency representative who shall be voted in by the membership at the AGM and have full voting rights at the ARCA Governing Council. It is anticipated members will be contacted soon to be asked to adopt the revised Articles of Association and allow a Labour Agency representative to be elected to the ARCA Governing Council at the AGM on 1st October 2021.

RCA held a further round of regional meetings remotely in February, reaching over 100 member employees. In July the regional meetings will again be held remotely, and the Association will cover developments including the Member’s Site Audit Portal and ALFA for LARC Employees, as well as the latest

revision of the ‘Asbestos: The Analysts’ Guide’. Don’t miss your opportunity to join this communication forum. ARCA has scheduled face to face regional meetings for November 2021, with the hope that these will be able to go ahead. A remote meeting will also be held. Dates are available on page 8.

ARCA Site Audit Portal

UPDATE I

n the last issue of ARCA News, we brought you news of an exciting development with regards to the ARCA Site Audit Accreditation Scheme, that is the introduction of a Site Audit Portal.

How is work progressing?

What will be available to members? Once the Site Audit Portal goes live, each member will be able to log into the system and view the results of audits applicable to their own company. That is, results of both audits carried out by ARCA auditors (audits under the Site Audit Accreditation Scheme and additional audits) and audits carried out by the company’s own auditors using the ARCA Member Internal Audit App. There will also be the option to view or download pdf reports, of both the audit report and the audit action report, that are currently emailed to members following an ARCA audit. and Check, will allow members to be able to monitor progress, identify areas of good performance and any areas that may need attention, so completing the Act phase of the Plan, Do, Check, Act process. This graph will be able to be filtered by date range and audit type to allow a more in-depth analysis. A list of priority actions will also be generated along with a mechanism to produce an Action Plan for any nonconformances. Actions taken to address any non-conformances will be able to be recorded against the Action Plan, as well as the date when the Action Plan is closed as completed.

In summary, the ARCA Site Audit Portal will enable members to analyse the results of ARCA audits and internal audits, act on the findings and keep end to end records of the process. Thereby demonstrating a Plan, Do, Check, Act approach to continuous improvement and health and safety management. We are still on target to be able to showcase the prototype Site Audit Portal at the forthcoming remote regional meetings to be held on the 14, 15 and 16 July.

Garage door installer fined for asbestos safety failings

A

garage door installation company has been fined after failing to manage asbestos safely during work on a house in Bamber Bridge. Preston Magistrates’ Court heard how on 9 October 2019, two employees of Garage Doors (Northern) Ltd, were carrying out work to remove an existing integrated garage door and fit a new door at a property in Brownedge Lane, Bamber Bridge. The workers removed old fittings from the side of the garage door with an angle grinder and some of the ceiling fittings with a crowbar. Holes were drilled into the ceiling to fit new roof bars and in doing so they caused damage to the ceiling, which was made of Asbestos Insulating Board (AIB).

The resulting dust containing asbestos fibres was spread through the house via the central heating system, resulting in the homeowner having to leave his home, and live in an hotel for eleven months, whilst the house was deep cleaned to remove all traces of asbestos fibres. An investigation by the Health and Safety Executive (HSE) found that despite undertaking work on a building built before 2000, a suitable and sufficient assessment to establish whether asbestos was liable to be present in the premises, and what type of asbestos containing material may have been present, was not carried out prior to the start of the job. Subsequent testing of the material came back positive for Chrysotile and Amosite.

Garage Doors (Northern) Limited of Aspden Street, Bamber Bridge, Preston pleaded guilty to breaching Regulation 6 (1) of the Control of Asbestos Regulations 2012 and Section 3(1) of the Health and Safety at Work etc. Act 1974. The company was fined £10,000 and ordered to pay costs of £1,589. Speaking after the hearing, HSE inspector Stuart Hadfield said: “Exposure to asbestos is a serious health issue and without companies fully assessing the risk when carrying out intrusive work they are potentially putting their workers and members of the public at risk. “This incident could so easily have been avoided by identifying the presence of asbestos and putting in place the correct control measures and safe working practices to prevent the release of, and exposure to, asbestos. “Companies should be aware that HSE will not hesitate to take appropriate enforcement action against those that fall below the required standards.”

A Construction firm fined after workers exposed to asbestos

construction company has been fined after workers were exposed to asbestos whilst refurbishing a flat in St John’s Wood, Westminster. Westminster Magistrates’ Court heard that between 14 May and 31 August 2018, ASAI Construction Ltd, the Principal Contractor for the project, failed to obtain a Refurbishment and Demolition asbestos survey prior to commencing work on site. During the project ASAI Construction Ltd was made aware by a subcontractor that there was asbestos containing material (ACM) within the flat, however the company allowed work to continue and failed to ensure that the ACMs were removed safely. As a result, several people were exposed to asbestos fibres over a prolonged period. An investigation by the Health and Safety Executive (HSE) found that ASAI Construction Ltd failed to take reasonably practicable steps to prevent

the people working on site being exposed to asbestos. ASAI Construction Ltd of Harrowdene Road, Wembley pleaded guilty to breaching Section 3(1) of the Health and Safety at Work etc Act 1974. The company was fined £30,000 and ordered to pay costs of £2,837. Speaking after the hearing, HSE inspector Owen Rowley said: “There are currently more than 5,000 asbestosrelated deaths each year in the UK. Any asbestos on site should be identified before refurbishment or demolition work takes place and suitable steps must be taken to control the risk of exposure. “In this case ASAI Construction Ltd’s failure to manage the risk of exposure to asbestos was compounded by their lack of response when concerns were raised regarding its presence on site. “Companies should be aware that HSE will not hesitate to take appropriate enforcement action against those that fall below the required standards.”

Asbestos ‘Cleans’ (Environmental Cleaning) The following is a summary of the Asbestos Network Technical Working Group (AN TWG) discussions and conclusions on Asbestos Environmental Cleans (Appendix 1a/21). This information aims to provide clarity of certain terms used in asbestos cleaning and removal activities, including, ‘environmental clean’, ‘re-clean’ and ‘preclean’, as well as providing guidance on the application of these terms and their licensing position.

Category and Type of Work In all situations where asbestos containing materials (ACMs) are involved, any work activity is ‘work’ with asbestos and is subject to the requirements of the Control of Asbestos Regulations 2012 (CAR 2012). There is no regulatory distinction between ‘cleaning up’ or ‘removal’ of ACMs, and these are all subject to CAR 2012. The nature and duration of the activity will determine the standard and type of controls that should be employed and whether the work is likely to be licensed or not. If the work activity is categorised incorrectly, it may lead to insufficient control, asbestos exposure and may not comply with legal requirements. It is the responsibility of the contractor to assess the nature and circumstances of the work as well as the likely duration, to establish if the work will be licensed or not.

Clearly there are different broad categories of asbestos work. These include: ‘removing’ ACMs from any location; removing remaining materials from a previous poor job often called, ‘re-clean’ and ‘cleaning-up’ of mostly loose material such as asbestos dust and debris; and some jobs may be a combination of these activities. The type of asbestos product involved, and the duration and nature of the work will determine the level of risk and the appropriate level of control, as well as whether the work is licensed or not. The work will be licensed where licensed ACMs are involved (defined in CAR 2012), unless the work meets the short duration and other exemption criteria. This applies irrespective of the nature of the work, including any ‘re-cleans’ or any type of ‘cleaning-up’ of ACMs. ‘Cleaning-up’ activities include simply lifting, picking up or wiping up or vacuuming up materials. Work will be licensable where licensed materials are involved and will also be licensable for other products where exposure is likely to exceed the Control Limit or the Sporadic And Low Intensity (SALI) limit. It is important to note that, if a suspect asbestos material or item is not clearly identifiable as one of the specified licensable products or it has only been identified as containing an asbestos constituent type, then any removal or cleaning activity would not necessarily be licensed work.

Environmental Cleans The term ‘environmental clean’ has been used in asbestos work to describe certain types of asbestos clean-up and related activities. The term has not been formally defined in Health and Safety legislation or associated ACOP’s and Guidance. The term has been used in some circumstances where there has been uncertainty as to whether a licence is required to carry out the work, this may result in the term being used incorrectly to classify licensed work.

guidance ‘Environmental cleans’ will be licensed work where licensable products are involved. However, the risk of asbestos exposure in these circumstances is likely to be lower than in most typical removal situations. The control regime for ‘environmental cleans’ will reflect these lower risks and should be established in the risk assessment.

Re-clean A ‘re-clean’ takes place where surface residues or other ACMs remain in place despite prior licensed removal work. For example, if previous removal work has been incomplete, but the material has been missed or was too stubborn to dislodge. ‘Re-cleans’ are asbestos removals and will be licensed unless the work meets the short-duration and other exemption criteria. Therefore, ‘re-cleans’ should be differentiated from ‘environmental cleans’.

Pre-clean

Non-Licensed Work

Cleaning-up or removal of displaced asbestos materials prior to the start of the main ‘removal’ process involving licensed ACMs is often referred to as a ‘pre-clean’ (or possibly an ‘environmental clean’). ACMs may have been dislodged or spread from previous damage or disturbance. This ‘pre-clean’ is essentially the initial phase of the licensed removal job. It is licensed work. A ‘pre-clean’ is defined in the Licensed Contractors Guide (HSG247). The ‘pre-clean’ is part of the inspection process to prepare a site/job for asbestos removal work. The proposed work area should be inspected and assessed, with the main purpose of the inspection to identify the need for a ‘preclean’ and to prepare the site for work. The inspection should be performed in the areas where clearance will be required.

There may be circumstances where asbestos removals including clean-ups will be non-licensed. In some clean-up situations, this work may also be described as an ‘environmental clean’, and it is the responsibility of the contractor to establish if licensed or non-licensed products are involved. A non-licensed clean-up/environmental clean would take place where non-licensed products are present, or the quantities of licensable material were relatively small, such that the duration of the work would meet the short duration and other exemption criteria.

Note 1: Short duration work is defined in (CAR 2012) Regulation 2(3) and explained in L143 ACOP as the total time spent by all personnel working on asbestos insulation and AIB does not exceed two hours in a seven day period (including time spend setting up, cleaning and clearing up) and, also no one person works for more than one hour in a seven day period. Note 2: Work with asbestos insulation and AIB is licensable unless the work is short duration and the Control Limit and Sporadic And Low Intensity (SALI) limit will not be exceeded. Any work on asbestos coating is always licensable, there is no short duration exemption.

Driving for Work D

riving for work is the most dangerous activity most employees ever undertake. Employees who drive on business are more likely to be killed at work than those employed as deep sea divers or coal miners.(1) Why? There are hundreds of thousands of injuries on the roads every year and literally millions of collisions that result in expensive damage to vehicles and property. Around a third of these are thought to involve drivers who were at work, and almost all are avoidable. In the hazardous industry of asbestos abatement, the risks from driving are often insufficiently addressed, perhaps because most of the focus is on controlling site risks and not the risks of getting to site and going home again. However, organisations have a legal duty to put in place suitable arrangements to manage health and safety. This is a wide-ranging requirement and includes driving for work, for which the Health and Safety Executive (HSE) encourages a common-sense and practical approach(2). It should be part of the everyday process of running an organisation and part of good management generally. As with other health and safety issues, the Health and Safety at Work etc. Act 1974 (particularly sections 2,3, 7 and 8) apply to driving for work, together with

the Management of Health and Safety Regulations 1999 (particularly reg. 3 on risk assessment). Many organisations provide further useful guidance, such as the HSE (publication INDG382, Driving at Work)(2), and Driving for Better Business (a governmentbacked Highways England programme). There is also a strong business case for managing work-related road safety. Fewer road incidents mean: w fewer days lost to injury w fewer repairs to vehicles w fewer missed orders w reduced running costs While there is no legal requirement to have a specific Driving Policy, many organisations do have one, in order to make clear to company drivers, and others, the seriousness with which it considers driving risk, its commitment, what the organisation expects from its drivers, the resources to be made available, and the role drivers themselves have in reducing workplace driving risk. Health and safety law does not apply to people commuting (i.e. travelling between their home and their usual place of work), unless they are travelling from their home to somewhere which is not their usual place of work. However, the laws of the road will always need to be followed, and the principles of safer driving should be embraced by commuters regardless of whether health and safety law applies or not.

The HSE has set out a ‘Plan, Do, Check, Act’ approach(3) to help organisations put suitable arrangements in place to address driver risk. Plan – Describe how you manage health and safety in your organisation and plan to make it happen in practice w Assess the risks from work-related road safety in your organisation. w Produce a health and safety policy covering, for example, organising journeys, driver training and vehicle maintenance. w Make sure there is top-level commitment to work-related road safety in your organisation. w Clearly set out everyone’s roles and responsibilities for work-related road safety. Those responsible should have enough authority to exert influence and be able to communicate effectively to drivers and others. Do – Prioritise and control your risks, consult your employees and provide training and information w In larger organisations, make sure departments with different responsibilities for work-related road safety co-operate with each other. w Make sure you have adequate systems to allow you to manage work-related road safety effectively. For example, do you ensure your vehicles are regularly inspected and serviced according to manufacturers’ recommendations?

safe driving w Make sure you involve your workers or their representatives in decisions. This is a good way of communicating with them about health and safety issues. w You must provide training and instruction where necessary. Check – Measure how you are doing w Monitor performance to ensure your work-related road safety policy is effective and has been implemented. w Encourage your employees to report all work-related road incidents or near misses. Act – Review your performance and learn from your experience w Make sure you collect enough information to allow you to make informed decisions about the effectiveness of your existing policy and the need for changes, for example targeting those more exposed to risk. w Regularly revisit your policy to see if it needs updating.

Driving Risk Assessments Risk assessments for driving can be formulated using the same format as standard risk assessments, which leads to assessing who might be harmed and how, and what control measures are already in place to reduce the risk. As with all risk assessments, the crucial part is deciding what (if any) further controls will be required to reduce the risks to a level that is acceptable and/or as low as reasonably practicable. In other words, you will need to assess and manage the risks. As with all risk assessments, you will need to make sure it is carried out by someone who: w is competent to do so (has the right skills, knowledge and experience) w involves your workers in the process w understands when specialist help may be needed When assessing the risks from driving for work, a common-sense approach is to focus on ensuring: w Safe drivers w Safe vehicles, and w Safe workplaces / traffic routes (which will include all work-related journeys)

Safe Drivers Are your drivers competent and capable of doing their work in a way that is safe for them and other people? This would include determining what levels of skill and expertise are required to do the job safely and how you ensure these are met. Do you arrange for drivers to be trained – giving priority to those at highest risk, e.g. those with high annual mileage, poor accident records, or those new to the job? Do you ensure the appropriate training for drivers who are required to tow (e.g. decontamination units), or transport waste, and are the training providers you select competent to deliver the training you require? Do you ensure your drivers have clear instructions about how to keep themselves safe while on the road, and what do you do to ensure these instructions are followed? This would include routine vehicle checks, driver seat adjustment, what to do in the event of a breakdown, your alcohol and drugs policy and your mobile phone policy. Are your drivers sufficiently fit and healthy to drive safely and not put themselves or others at risk? This would include reporting any health issues or use of medications that may affect driving, as well as advice on managing tiredness by taking sufficient breaks on longer journeys.

Safe Vehicles Are your vehicles fit for the purpose for which they are used, and maintained in a safe and fit condition? This includes the selection of the vehicle to be suitable for the intended purpose and the ongoing maintenance in accordance with the manufacturers’ recommendations. This would also include a procedure for reporting defects so they can be remedied promptly, and that unsafe vehicles should not be driven.

Safe Workplaces / Traffic Routes Do you plan routes in consultation with drivers, taking account of, for example, the need for rest breaks and access to toilets and washing facilities? Are work schedules realistic? Some projects may demand driving 7 days per week, often with long journeys in peak traffic either side of the working day. Effective planning and consultation with workers may result in coming up with solutions that alter schedules or rotate drivers. Journey times will need to take account of road types and conditions, and allow for rest breaks. The Highway Code recommends that drivers should take a 15-minute break every two hours. Do you consider poor weather conditions, such as snow or high winds, when planning journeys, and would your drivers feel pressured to complete journeys where weather conditions are exceptionally difficult? Other considerations may need to be taken into account that are specific to particular circumstances. Amidst COVID restrictions, and the lifting of such restrictions, there will be drivers returning to the roads who haven’t driven much recently, and those who have driven during the restrictions will be experiencing much more traffic than they have become accustomed to. These factors alone may lead to increased risks. Also, some vehicles may not have been driven much, and therefore potentially not been maintained for a good while, which may also increase risk. Remember that to get your workers to and from sites safely is an equal priority and legal obligation as it is to keep them safe whilst at their workplace. It makes good business sense too, as well as being morally correct. Managed well, and in consultation with your drivers, your actions may well reduce the stresses of driving for work and therefore improve overall mental health and wellbeing of your employees too.

Asbestos Network appendices on Asbestos Guidance available Appendices are produced by the Asbestos Network Technical Working Group when a topic discussed requires further explanation and clarification to support the asbestos industry. The following appendices are currently available.

l Appendix 1a/2021 - Asbestos Cleans (Environmental Cleaning) The term ‘environmental clean’ is often used in the asbestos management industry to describe certain types of asbestos clean-up and related activities, it can sometimes be used interchangeably with, or as a substitute for the term ‘pre-clean’. This appendix aims to clarify the meaning and licensing position of certain terms used in asbestos cleaning and removal, including ‘environmental clean’, and ‘pre-clean’.

l Appendix 2/19 - Calculating NPU Airflow Allowing for the right amount of air to enter the asbestos enclosure is as important as ensuring the correct amount of air is extracted. A Negative Pressure Unit (NPU) is used to extract air from asbestos enclosures, and the inward flow is a measure of the performance of the NPU. This appendix aims to provide information on how to calculate the inward airflow of a NPU, using an anemometer.

l Appendix 6/17 - Abrasive Blasting Removal Systems ACMs are typically removed using low dust emission methods such as manual removal with hand tools along with wet injection or spray wetting. These methods comply with legal requirements to minimise worker exposure and to prevent the spread of dust. However, in certain circumstances it may be necessary to adopt more abrasive methods to remove ACMs. This appendix provides guidance on the use of abrasive blasting systems. There are a variety of commercially available systems which all use blasting media such as garnet. In addition, there are other ‘wet’ type systems which can use ice for blasting and there are also dry ice systems.

l Appendix 5/17 - Enclosures for AIB Soffit Removal AIB soffit removal is generally licensed work (unless the short duration exemption applies) and therefore a full enclosure (FE) would be expected unless it is not reasonably practicable. The main criteria for establishing if a FE is reasonably practicable is as follows: (i) the potential for fibre release and spread during the removal (ii) the relative ease with which an enclosure can be constructed.

l Appendix 4/17 - Asbestos Dust/Wipe Sampling Asbestos fibres are ‘naturally present’ in extremely low levels in the air and surfaces of buildings which contain asbestos products. Therefore, where dust sampling (and spectra analysis) is carried out, asbestos fibres will be detected from time to time on the surfaces in the normal occupancy areas of buildings. This presence is not unexpected. Speculative dust sampling is not advised particularly where there is no incident, debris or suspect material. As already pointed out random asbestos fibres may be detected on occasions. Such sampling is actually often unhelpful and can lead to incorrect conclusions on exposure and risk.

l Appendix 3/17 - Work with Asbestos Paper Asbestos paper, when applied is a thin sheet(s) (<1mm) to pipework, vinyl floor tiles or boards etc, was primarily intended as a vapour barrier rather than for thermal/acoustic insulation purposes. Therefore, this type of asbestos paper would not be considered a licensable material as defined under Control of Asbestos Regulations 2012 (CAR 2012) Regulation 8. In addition, as asbestos paper will generally break into fragments and pieces (i.e. not fine particles of dust), exposure and fibre levels associated with controlled work on these forms would not be expected to exceed the Control Limit or the STEL.

l Appendix 2/17 - Asbestos in Soil: Classification of Work Asbestos materials in soil will often have physically degraded and have changed appearance and therefore may not be readily identifiable as its original source material (e.g. lagging, insulation etc.). For this reason, the definition of asbestos products used in Control of Asbestos Regulations 2012 (CAR 2012) as a means of establishing licensable work cannot always be applied. Most work on degraded asbestos materials in soils will be non-licensed.

l Appendix 1/17 - Asbestos Enclosure Ventilation Research The purpose of the new research was to address the issues raised by industry. The research was also designed to provide further information on the supply, management and measurement of airflow within asbestos enclosures in order to ensure a better understanding of the factors which influence airflow and containment.

e would encourage employers to take some simple steps to better support their workers whilst also limiting the potential negative impact of absence or reduced productivity too. In particular, we would suggest that employers seek to identify which employees may already be facing medical issues and/or delays for treatment, and then aim to support those individuals by actively signposting them towards any support options already available within the employer-sponsored benefits and wellbeing offering. But it would also be a good time to remind all employees of the full range of support tools that may be available to them. Often overlooked options include remote GP appointments and Employee Assistance Plans, although Howden has recently identified more than 50 different wellbeing services that might be available to employees depending on the “core” Employee Benefit offerings provided by the employer.

Not surprising Of course a backlog of patients awaiting initial diagnosis and signposting to treatment pathways is anything but surprising. For not only are there more than a years’ worth of cancelled and missed appointments across all sectors of UK society to be rescheduled in the months ahead, but we also have a wave of new medical issues to face too. Long Covid is of course a major challenge to be addressed, and then there is a rising tide of mental health problems accumulated over many long months of fear and isolation to be resolved as well.

A gateway to treatment Yet the truth is that an initial visit to the local GP is often just the entry point to the national healthcare system. Should the condition or illness require further investigation or treatment then the patient will usually be referred-on to another specialist area, and with waiting lists across the NHS now representing huge numbers of people – and indeed record highs in some areas – it is unlikely that patients will be treated as quickly as they (or indeed the health service itself ) would ideally like.

The impact on employers These words were reported by the BBC last month, and were said by a General Practitioner (GP) in Doncaster. And, with NHS England reporting an almost record high of GP appointments booked in March alone, it is likely that this one family doctor is far from alone in being overwhelmed.

And of course all of the above is likely to represent another unwanted headwind to employers, and this at a time when so many organisations are desperate to return their businesses to pre-pandemic normality and profitability.

The reality is many of the people now seeking or awaiting medical treatment will be from the working-age population, and at least some of this grouping may be unable to work until the end of their treatment. And even where attendance at work can be maintained, it’s possible that the employee’s output and productivity might well be reduced until treatment is concluded.

Finally Employers should try and extend those vitally important core benefits – typically life cover, income protection, medical insurance, and pension provision – to all grades of staff to ensure that the same support tools and protections are available to all workers. The reality is that a tsunami of undiagnosed and untreated conditions may well be facing the UK in the months and years ahead, and this will doubtless have a knock-on effect to employees and their employers too. So it is in everyone’s interest to ensure that all the employee benefits tools provided are well understood and used during the potentially challenging period ahead. wners and managers of a premises, whether an office, shop, factory or school, must understand their legal duties as a duty holder under Regulation 4 of the Control of Asbestos Regulations 2012, as the failure to effectively manage asbestos can and does lead to enforcement action from the Health and Safety Executive (HSE). If the premises you manage or own was constructed prior to the year 2000, you need to know if asbestos is present and manage the associated risks, as you are responsible for ensuring that employees and non-employees are not exposed to health risks as a result of the presence of asbestos. Asbestos is a hidden danger as asbestos containing materials could be found in

numerous places within a building, such as pipe lagging, insulation board, vinyl floor tiles and cement products. Being aware of where asbestos can be found, and how to manage the risks, is vital to reducing the health risks faced by workers and the public. Legal duties are covered in the Health and Safety at Work etc. Act 1974, Control of Asbestos Regulations 2012 (CAR 2012) and Construction (Design and Management) Regulations 2015 (CDM 2015). w Locating asbestos containing materials (ACMs), through an asbestos survey, therefore assessing the amount and condition of the ACMs. This information should be recorded, referred to as an

asbestos register, and kept up to date. w The duty holder will also need to produce a management plan, detailing how the risks from asbestos will be managed. w If ACMs need to be removed clients need to appoint a competent asbestos removal contractor. w After removal an analyst will need to verify that a work area has been thoroughly cleaned prior to handover for re-occupation or demolition work. Maintenance of Equipment -

Company needs to hold a licence to work with asbestos ARCA has been informed by Associate Members, who carry out maintenance of equipment used during asbestos removal works, such as NPU’s and H Class Vacuums, that there are some companies doing this type of work without a licence, even when this work falls under the regulatory definition of licensed work with asbestos, and therefore the company must hold a licence to work with asbestos (a licence issued by the HSE).

Regulation 3(3) of the Control of Asbestos Regulations 2012 (CAR 2012) states: Where a duty is placed by these Regulations on an employer in respect of employees of that employer, the employer is, so far as is reasonably practicable, under a like duty in respect of any other person, whether at work or not, who may be affected by the work activity carried out by that employer except that the duties of the employer— (a) under regulation 10 (information, instruction and training) do not extend to persons who are not employees of that employer unless those persons are on the premises where the work is being carried out; and (b) under regulation 22 (health records and medical surveillance) do not extend to persons who are not employees of that employer. Regulation 3(3) of CAR 2012 extends the licence holder’s duties (except for Regulations 10 and 22) for their own employees to all other persons; this includes the persons who are

carrying out the maintenance activities if they constitute licensed work. This amplifies the overarching duties in Sections 2 and 3 of HSWA which also apply. Regulations 11 and 16 are the main goals of CAR 2012 (prevention of exposure to asbestos and prevention of spread of asbestos) and Regulation 3(3) extends these duties to those who are not employees. Licensed asbestos removal companies therefore have a legal duty, so far as is reasonably practicable, to ensure that any maintenance work, which constitutes licensed work with asbestos, carried out on their equipment by a third party, does not lead to exposure to, or spread of, asbestos. A reasonably practicable way of achieving this is by using the services of a maintenance company who has been assessed by the HSE as competent to carry out this type of work. That is, a maintenance company that holds a licence to work with asbestos issued by the HSE. Members of ARCA which hold a Maintenance License are listed on page 54.

he construction industry is a sector which is ever evolving and over recent years, there is the need for equipment to be sustainably run. Thermac Hire, after an intense period of research and development, are now proud to launch the UK’s first fully electric Welfare Decontamination unit. These units are typically run-on LPG, although LPG is sustainably greener than other gases, it can contribute to air pollution and has a higher calorific value than premium grade petrol. Our new electric powered unit is not only sustainably better for the environment, helping to reduce our carbon footprint but it has been designed with the user in mind. Asbestos: The Analysts’ Guide (HSG 248, Revision 2)

What it means for the 4-Stage Clearance Asbestos: The Analysts’ Guide (HSG 248, Revision 2) is the authoritative source of asbestos analytical procedures within Great Britain. Revision 2 of this guidance, for analysts involved in asbestos work, was published online on 14th May 2021. It has been updated to include HSE findings and developments in analytical procedures and methodology. It provides clarification on technical and personal safety issues, especially in relation to sampling and 4-stage clearances, and new information on sampling soils for asbestos is included. Asbestos: The Analysts’ Guide is designed to support asbestos analysts in complying with their legal obligations and is also useful to other professionals; asbestos consultants, occupational hygienists, safety professionals, asbestos removal contractors, building owners and facilities managers.

In this article we concentrate on what Revision 2 means as far as the 4-stage clearance is concerned.

1. Scoping / Contract Arrangements The relationship between Licensed Contractor and Analyst is a formal contract under the Construction (Design and Management) Regulations 2015 (CDM 2015). The Licensed Contractor has legal duties to cooperate with the Analyst and provide the Analyst with adequate information in a timely manner. In addition, the Analyst has duties to provide information to the Licensed Contractor. The revised Analysts’ Guide addresses this via the following paragraphs: 6.7 If a pre-removal work site inspection does not occur, it will be essential for the analyst to be provided with a copy of the contractor’s POW before visiting the site for several reasons: to enable their own POW to be prepared, for the 4-stage clearance to be planned in advance (e.g., site plans prepared) and for the clearance to be properly scoped. The analyst should obtain a copy of the contractor’s POW when appointed or at the earliest opportunity. 6.10 To make sure there is no uncertainty or confusion over the outcome of the clearance procedures, separate copies of the Certificate of Reoccupation (CfR) are provided to the building occupier or owner and to the licensed contractor promptly on completion of the process. The licensed contractor should also be issued with a copy of the clearance certificate for the DCU, irrespective of who has employed the analyst. HSE regards the CfR and the clearance certificate for the DCU as the same clearance contractual process. The CfR and DCU clearance certificate can be issued as hard copies or electronically.

2. Analysts Cleaning during 4SC The risks to Analysts with regards to cleaning during 4-stage clearances (4SC) is that if there is residual material/dust still in enclosure at the 4SC then the risks associated with asbestos exposure are increased for Analysts. If there is residual material/dust still in the enclosure at the 4SC, then this means that the operatives have failed to clean up and the supervisor has failed to thoroughly inspect. In addition, Analysts are potentially carrying out licensed work when they carry out cleaning during the 4SC, which means that the Licensed Contractor’s actions are potentially responsible for Analysts causing a breach of legislation (in contravention of Section 36 of the Health and Safety at Work etc. Act 1974). Revision 2 of The Analysts’ Guide states on page 51 that: It is the licensed contractor’s legal duty to ensure that the work area is thoroughly cleaned after work is completed and the area declared clear of visible asbestos materials before the independent 4-stage clearance procedure is carried out by the analyst. This includes dust and debris on all surfaces, items and equipment. The licensed contractor should complete a handover document to confirm that the area has been inspected and is visually clean. If the handover

guidance document is not available or not completed or there is any doubt regarding the cleanliness of the site, the 4-stage clearance should not be started. Receipt of the handover form should be recorded in the Certificate for Reoccupation. and that: The analyst should NOT clean up any dust or debris as part of the 4-stage clearance. This is work with asbestos and is potentially a licensed activity. Clean-up should only be carried out by the licensed contractor.

3. Evidence-based 4SC Process There are new monitoring and managing procedures for asbestos removal work and 4SC: 3.1. Handover form To be completed by the Site Supervisor once the work area is ready for the 4-stage clearance to confirm that the following have been checked to ensure they are free from asbestos and visually clean: w ACM removal locations w Floors/surfaces/walls/ items w All rooms checked etc. The Supervisor is to sign the form to certify that the inspection has been completed. The Analyst is to sign to confirm receipt. The 4-stage clearance Certificate for Reoccupation (CfR) has been modified to include the Handover Form. The 4-stage clearance NOT to start until handover form is received and acceptable. 3.2. Visual inspection time to be specified in advance. Specifying the expected visual inspection time in advance makes commercial sense for Analysts as the estimated time can be budgeted for when quoting the work. There will be a process whereby the estimated time for conducting stage 2 of the 4-stage clearance (4SC) will be entered onto the CfR as well as a record of how long the 4SC takes. Factors to consider are (Illustrative list): w Room size, volume and layout w Room complexity w Extent of sheeting out w Items remaining w Voids (cabling)

w High level surfaces w Ducting w Tunnels/cavities w Potential unforeseen situations

Paragraph 6.8 of Revision 2 of The Analysts’ Guide gives further detail. 6.8 The analyst should estimate and record the expected time for the thorough visual inspection. The time estimate should be established through discussion of the site conditions with the licensed contractor. The analyst will also apply their own knowledge and experience of thorough visual inspections (Figure 6.2). Factors which can affect inspection times include: the layout and design of the area, items present, extent and location of surfaces, obstructions, inclusion of ceiling voids, and extent of cables in voids. Factors to consider for the inspection time estimate are set out in Box A5.3 (Appendix 5) and examples of inspection times are given in Table A5.4 (Appendix 5). The time estimate should be inserted into the CfR at stage 1 and the licensed contractor (and the client where practical) advised of the estimated time. 6.9 The time that the thorough visual inspection actually took should be recorded on the CfR at the end of stage 2. Where there is a greater than 20% difference (i.e., less than or more than) between the estimated and actual time, a very short explanation should be provided on the CfR. Building occupiers are liable to be concerned and challenging where the inspection time seems unusually short. The analyst should build up a data set of estimated and actual times to inform their estimates in the future. In addition, the analyst should provide photographic evidence in the CfR that the correct procedures have been followed; for example, that the negative pressure unit (NPU) has been capped, and that the areas have been thoroughly cleaned. The CfR form has been redesigned accordingly (see Appendix 6). More information on these matters is given in paragraphs 6.17–6.18. Appendix 5 paragraph A5.21 also states that: A5.21 The estimated time should be inserted into the front page of the CfR and the client and/or licensed contractor should be advised of the expected time. Once the thorough visual inspection has been completed, the actual time taken should be recorded. Where the difference between both times is significant (e.g., less than or more than 20%), an explanation should be provided (e.g., access is easier or more difficult than expected; remedial cleaning required). The analyst should build up a data set of estimated and actual times to inform their estimates in the future.

A5.28 The analyst will have to make judgements on the extent and significance of dust and debris found during the inspection: whether it is minor and can be cleaned up during the course of the inspection, or whether it is more substantial and shows that the final clean has not been sufficiently thorough. It is the duty of the contractor to undertake the final clean and carry out a thorough visual inspection before requesting a 4-stage clearance. If it is clear that this has not been done or been sufficient, the analyst should withdraw and fail the enclosure, citing what needs to be done before another inspection is undertaken. The visual inspection should be failed where the analyst estimates that the cleaning will take more than 10 minutes in total. Where the visual inspection has been failed, the analyst should withdraw from the enclosure to allow cleaning to take place. The failing may be due to several likely occurrences of minor contamination or one significant incident (see Box A5.4). Analysts are required to record if additional cleaning is required. 3.3. Photographic evidence of conditions and completeness 6.17 The analyst should provide visual confirmation through suitable proportionate and identifiable photographic evidence that all the criteria required for the 4-stage clearance to proceed have been met and that the removal areas are free from asbestos and that the enclosure has been thoroughly cleaned and is visually asbestos dust- and debris-free. This means that larger removals will normally need more photographs than smaller jobs. This evidence will help provide reassurance that the premises are safe for reoccupation or demolition. Photographs should be in colour and can be inserted into the relevant sections of the CfR. Photographs should contain a caption explaining their content and should be sufficiently detailed to enable close examination of the feature highlighted. The required photographs (with time and dates on the photographs) are set out in Tables 6.1 and 6.2. 6.18 Photographs should also be taken of the items and areas that are the reason for any failure of the clearance procedures. These photographs should be entered into the appropriate section of the CfR. The 4-stage clearance procedure and the procedures for inspection of the DCU are set out in detail in Appendix 5. Photographs are to be included as part of the CfR and the template for the CfR has been amended to include recording that this has been done at the appropriate stages. 3.4. Video evidence Video evidence of the 4-stage clearance is desirable, and the video should cover the key stages - transit and waste routes, external area around the enclosure, internal areas of the enclosure (airlock, baglock, enclosure sections etc), capped NPU, sampling pumps etc. The video should be issued to the Client and the Licensed Contractor. 6.19 It will also be beneficial for a video recording of the 4-stage clearance to be made to provide evidence that the clearance criteria have been met. The video recordings will also be useful for training purposes. Video recordings can be made on mobile cameras, phones or other suitable devices. 6.20 The video should show key features only of the clearance process: i.e. the transit and waste routes, the external area around the enclosure, the internal areas of the enclosure (airlock, baglock, enclosure sections etc), capped NPU, sampling pumps and the area after the enclosure has been dismantled. Video footage can also be used to show locations where additional cleaning was required and visual dust/failures were identified. The video can be submitted on memory stick or other suitable storage format. Video recordings should be presented to both the building client and the licensed contractor irrespective of who engages the analyst. The video recording is in addition to the CfR. 3.5. Analysts Appropriate PPE for 4-stage clearance The Analyst should be dressed to go through the full decontamination procedures, and these should be set out in their written procedures, including procedures for entering and exiting enclosures. Analysts should not be wearing their “own” clothes, they should be wearing two sets of coveralls and disposable undergarments. RSPH Level 3 Award in Asbestos Surveying Asbestos surveyors who have gained sufficient knowledge and experience in the workplace, and on site, can have their competency recognised by gaining the RSPH Level 3 Award in Asbestos Surveying. This Royal Society for Public Health (RSPH) qualification is based on the ‘HSG248 Asbestos: The Analysts’ Guide’ document and recognised by UKAS in its document ‘RG 8’. How can you gain this qualification? Depending on your knowledge and experience, as well as time available to study, ATaC offers three options to gain this RSPH qualification.

Centre-based training

and exam day

If you have prior knowledge of all areas defined within the syllabus, you can choose to spend three consecutive days at an ATaC centre. The first two days will cover the theory and practical elements of the four units of the syllabus. On the third day you will be assessed on your practical competence, which is followed by a written examination.

Remote training and centre-based exam day This option provides you with all the theoretical knowledge required by this qualification via one day of remote training over three consecutive weeks This gives you time to read further and gain the practical experience you need, both at your workplace and on site, before undertaking another remote training day. s n io t a c fi li a u Q in a g o t s Analyst RSPH Level 3 Award in Air Monitoring and Clearance Procedures Asbestos analysts who have gained sufficient knowledge and experience in the workplace, on site and in a laboratory, can have their competency recognised by gaining the RSPH Level 3 Award in Air Monitoring and Clearance Procedures. This Royal Society for Public Health (RSPH) qualification is based on the ‘HSG248 Asbestos: The Analysts Guide’ for sampling, analysis and clearance procedures and is recognised by UKAS in its document ‘LAB 30’. How can you gain this qualification? Depending on your knowledge and experience, as well as time available to study, ATaC offers three options to gain this RSPH qualification.

Centre-based training and exam day If you have prior knowledge and understanding of all areas defined within the qualification syllabus, you can choose to spend four consecutive days at an ATaC centre.

The first three days will cover the theory and practical elements of the four units of the syllabus, such as, clearance procedures and practical air sampling. On the fourth day you will be assessed on your practical competence, which is followed by a written examination.

Remote training and centre-based exam day This option is for those asbestos analysts who can gain all the required practical experience in the workplace and on site, as the remote training covers all the theoretical knowledge required by this qualification. The remote training will be held for one day a week over four consecutive weeks This gives you time to read further and gain the practical experience you need before undertaking another remote training day Following this there will be an exam day held at an ATaC Centre, which will be arranged for around 10 working days after the last remote training day.

Exam only day If you are an experienced asbestos analyst, there is this shorter route to gain a qualification and have your competency recognised. If you are confident that you have received training to gain the required knowledge and skills required, you have the option to undertake a day of theory and practical assessments to gain the RSPH Level 3 Award in Air Monitoring and Clearance Procedures qualification. Candidates can be assessed and sit the exam at an ATaC centre or at their work premises if the required facilities are available.

From experience in previous roles, Sarah is well equipped to support our members’ with their centre-based training and qualification needs across the UK. Important changes to CITB grants A

short duration grant of £35 is available for companies paying the CITB levy for each candidate undertaking a refresher training course with ARCA. CITB has also introduced a new rule that requires an Approved Training Organisation, such as ARCA, to upload any grant claims within 10 days of the certificate issue date. Therefore, ARCA is now requesting the necessary candidate information, for example, DOB, first line of home address and postcode, at the point of booking. This information is required for ARCA to be able to claim the grant on the Member’s behalf. The new booking form is available within the training pages of the ARCA website. If you would like any further information or support, please register for ARCA’s August CITB Briefing, dates can be found on page 8.

She now helps members’ with their training enquiries and more specifically arranging remote training courses and qualifications. Isabelle Waldron, who has been with ARCA since 2014, has recently returned to work after being on maternity leave. Isabelle is now focusing on managing NVQs, helping members to select the best assessment route and then plan assessments in advance. Over the last 18 months, we have seen a number of changes in how we are delivering asbestos training courses and qualifications, including the development of remote training courses, and the new exam only options for asbestos analysts and surveyors. This means that our team is kept very busy helping our members and thousands of candidates every year. Whether you need advice on training or need to arrange an NVQ assessment or qualification, we are here to help. Satish Patel
