Continuing Development of Qualifications and Auditing Processes to Meet Members’ Needs

he first quarter of 2017 has been an exceptionally busy period for ARCA finalising new qualifications and introducing electronic auditing as well as producing the foundations for other projects.

I am pleased to report that a choice of options for gaining the NVQ Level 2 qualification for asbestos removal operatives are now coming on stream. ARCA has been working hard with ConstructionSkills to develop the Experienced Worker Practical Assessment (EWPA) route, as well as with the Royal Society for Public Health (RSPH) to establish another awarding organisation for the sector. Both awarding organisations will be able to provide an On-Site Assessment and Training (OSAT) and an Assessment Only option [CITB - Experienced Worker Practical Assessment (EWPA) and RSPH - Experienced Candidate Assessment Route (ECAR)]. Details of the NVQ Level 2 options available for asbestos operatives can be found in this edition of ARCA News (pages 8 and 9) and on the ARCA website. The Asbestos Removal Management Institute (ARMI) has been appointed as the Standard Setting Body for CSCS cards for the asbestos management industry. Therefore, ARMI is currently working to set the requirements for CSCS cards for the industry with the Sector Representative Organisation. ARCA, as part of ARMI, will be operating a Partner Scheme with CSCS to administer CSCS cards for the industry. Build UK were keen to have one card scheme for the industry, i.e. the ARMI scheme operated by the members of ARMI. Both the NFDC and ARCA have agreed to issue the ARMI card and are currently working with the CSCS appointed software provider to put the scheme in place. Until the standards are agreed, CSCS will continue to issue cards to our industry under the existing standards, with ARCA and the NFDC issuing ARMI cards once the new standards have been agreed. Another qualification I am pleased to report is now available, via ATaC, is the RSPH Level 4 Certificate in Asbestos Laboratory and

Project Management. The qualification has been approved by the qualifications’ regulator Ofqual, and accepted by UKAS as meeting the LAB 30 requirement to have a designated competent person at a UKAS accredited laboratory. The proposed qualification has been designed to provide the necessary support for competence defined in Clauses 8.1.1 & 8.1.2 of LAB 30 Edition 3, and consequently the Tables in LAB 30 will be updated as soon as practicable to reflect UKAS’ recognition of the certificate as above. This means that ATaC and RSPH now offer the full suite of UKAS accepted qualifications, and Ofqual approved, for the asbestos testing and surveying industry; surveying, air monitoring, bulk sampling, dutyholder and competent person status. Unannounced site audits commenced in January, so ARCA members must now be able to demonstrate effective management and performance on any site at any time. The site audit scheme is being further enhanced with the introduction of electronic auditing. As I am writing this report most of our auditors are using ARCA’s new electronic auditing app, and this will be rolled out to all auditors by the end of March. Finally, the ARCA National Golf Day this year will be held at Cameron House, Loch Lomond. This is an exceptional venue set in the beautiful Scottish countryside with views of Loch Lomond and Ben Lomond. The facilities at the golf club are first class, so this is an excellent opportunity for ARCA members to play the Carrick course which promises to be a truly memorable experience. I look forward to seeing many ARCA members at the event.

ARCA joins the Contamination Expo Series 2017

Association supports event in its second year

RCA, the UK’s leading association representing asbestos removal contractors, has signed up to the Contamination Expo Series 2017 to be held on 27-28 September at ExCel London. The Contamination Expo Series was launched last year to tackle solutions to contamination across six sectors, including hazardous waste. “Last year we were very pleased with the results following attending the first Contamination Expo,” commented Steve Sadley, Chief Executive of ARCA. “We had a successful event meeting both members and potential members, and talking to end-clients from different sectors, therefore joining the event again this year was an easy decision.” “This event will give us a platform to continue communicating how to safely manage asbestos, highlighting property owners and managers’ legal responsibilities, and how ARCA and its members can support them. Also, it will be an opportunity to promote

the Association’s aim of continually raising professional standards and how ARCA membership is a means of reassurance for end-clients.” “We are delighted to have the support of ARCA again this year as having asbestos experts at the event is crucial,” stated Daniel Rogers, Event Director of the Contamination Expo Series. “We will work closely with this leading trade association to help drive the messages about asbestos to the professionals involved in managing the health and safety risks associated with asbestos in buildings.” This year, due to the expansion of the event, it is to take place on the earlier dates of 27th and 28th September 2017. ARCA retains ISO 9001 with flying colours F

or the last twelve years ARCA has followed and been audited annually under the ISO 9001 quality management system. The ARCA management system describes procedures and processes to be followed in order to prove the Association’s ability to consistently provide quality membership, training and audit services. “In February ARCA was audited as part of this quality management system to check conformity to the standard,” stated Steve Sadley, Chief Executive of the Asbestos Removal Contractors Association. “I’m delighted to say that no nonconformities were reported and no opportunities for improvement identified. This is a great testimony to all the staff who work towards delivering a first-class service.” ARCA has preparations towards ISO 9001: 2015 well underway for meeting compliance within the transition period ending September 2018.

The Asbestos Removal Contractors Association (ARCA) introduced an audit scheme in 2000 to support members’ performance and therefore maintain standards. Audits are a method of checking and monitoring both good management and good risk control, and can provide reassurance for all parties; contractors, HSE, ARCA and endclients; of compliance with relevant legislation. In January 2017 ARCA enhanced its audit scheme to take a further step towards supporting consistent high standards. Members

id you know that training credits don’t have to be used just for training? The vast majoirty do but some members have used their training credits for a number of ARCA services such as: • gaining ARCA qualifications • support for license renewal prepartion • additional site audits • in-house training

In fact, training credits can be used for any service ARCA offers that will improve the performance of member companies. We have also had a number of enquiries from member companies for us to deliver training on a Saturday. he Ogden discount rate is used to calculate the amount of compensation a severely injured person will receive to reflect the return they will earn when that money is invested. The objective is to make sure a person has the necessary financial security to provide for their care and loss of earnings. The announcement was made on 27th February that the Ogden discount rate has been reduced from 2.5% to -0.75%, and the change will take effect from 20th March 2017. The reduction means that those suffering from serious injuries will receive significantly higher compensation payments than before. For example, someone who received £2.791m before the discount change, will now receive £6.325m – an increase in the amount the insurer will need to pay of £3.534m or 127%. The substantial increase affects claims costs and therefore premiums for all Policy types which see claims for bodily injury – including Private and Commercial Motor, Motor Trade, Liability and SME. Those clients who operate in high risk liability industries, such as asbestos removal, are likely to be most affected.

ast year, for the first time, the Association held a Charity Week dedicated to fundraising for Mesothelioma UK and Indee Rose Trust. A lot of ARCA and ATaC members and their staff supported the Charity Week by donating, running, biking, baking (and eating), climbing and getting muddy! “A huge thank you to all who took part and made donations to support our charities. The total raised last year was fantastic,” said Grant Beglan, Chairman of ARCA. “You organised and took part in such a range of events and I know from talking to many that fun was had!” “This year I hope many more members and their staff get involved in the Charity Week, so that as a team we can continue to help these charities support men, women and children suffering from life limiting conditions.” The Charity Week 2017 is 11th - 15th September. ARCA Announces the

First NVQ for Experienced Operatives Association delivers routes to CSCS cards

n February ARCA announced the availability of the first National Vocational Qualification (NVQ) for experienced asbestos removal operatives in the UK. For asbestos removal operatives to gain access to work on many construction sites they require a CSCS card. The application criteria to obtain a CSCS card is changing and operatives will need to hold an ‘NVQ Level 2 Diploma in Removal of Hazardous Waste (Construction) - Licensed Asbestos’. Due to these forthcoming requirements ARCA has developed NVQ assessment options for both experienced operatives and for those with less experience in the role. “Changes to the requirements needed for operatives to gain a CSCS card <blue skilled worker card> were announced last year. ARCA immediately began to develop assessment options to enable operatives to gain an NVQ, and thereby apply for CSCS cards. I’m pleased to say, after a lot of work by the team at ARCA, these qualifications are now available to support members and the industry,” commented Grant Beglan, Chairman of ARCA. Operatives, with more than a years’ experience but less than three years’ experience, can gain an NVQ by choosing the On-Site Assessment and Training (OSAT) option, which involves completing five assessment units within a twelve month period.

Operatives with in-depth practical skills and confidence in the role, therefore most likely having three or more years’ experience in the role, could choose an Assessment Only option (CITB EWPA or RSPH ECAR). The candidate will undertake a thorough practical assessment, over one day, at an ARCA centre to demonstrate the skills specified by the NVQ. “We know that operatives’ holding a CSCS card is vital for many of the asbestos removal contracts our members undertake,” stated Satish Patel, Training Manager for the Asbestos Removal Contractors Association. “We are delighted to be able to offer a complete NVQ solution for asbestos removal operatives. As well as offering NVQs depending on the experience of an operative, we are also offering employers cost-efficient routes for those who pay the CITB Levy and for those that don’t.” “We have received a lot of interest in the NVQs. A number of member companies are already committed to enrolling all their operatives, as acting sooner rather than later, means operatives are on route to holding, or holding, a blue skilled workers’ card before the changes come into force,” concluded Satish Patel. ARCA Site Audits go Electronic Report immediately available to manager

ast month ARCA introduced a new app for its auditors to gather information while on-site and to report the site audit findings. After a trial period the app, a unique app developed to follow the Association’s audit criteria, is now being used by all ARCA auditors. As always, the completed audit will be discussed with the site supervisor, then the report will be emailed to the manager. “The main benefit for our member contractors is that reports will be immediately(i) available to the manager via email, along with a corrective action report if required,” commented Geoff Silver, Compliance Manager for ARCA. “This means that the contractor’s management gains reassurance of the work happening on-site at that time, or if necessary the contractor can react quickly to correct an issue, however small.” All audits are reviewed by ARCA, following which the member contractor will be informed of the resulting grade. Before the end of the year, ARCA plans to make the app available(ii) to member asbestos removal contractors, so enabling member’s internal audits to follow the same criteria, making a more consistent measurable tool. ATaC offers New RSPH Competency qualification New qualification in Asbestos Laboratory & Project Management accepted by UKAS and Ofqual regulated

TaC, the Asbestos Testing and Consultancy Association, is pleased to announce the availability of the new Royal Society for Public Health (RSPH) competency qualification for laboratory and project management. This new RSPH Level 4 Certificate in Asbestos Laboratory and Project Management, which has been approved by the qualifications’ regulator Ofqual, has been designed to satisfy the LAB 30 requirement to have a designated competent person at a UKAS accredited laboratory. Therefore, it is an assessment of the skills and knowledge of managers, in both laboratory management and asbestos removal project management, to help ensure that their work is to the correct quality standard. Steve Platkiw, Manager of ATaC, commented “After running a successful pilot last year we are pleased to be able to offer this new RSPH competency qualification. This management qualification now offers the asbestos laboratory industry an alternative route to competency, and an Ofqual regulated route.” The qualification consists of two units; laboratory management and project

management which are assessed by assignments; and a professional interview. Before candidates can undertake the qualification, they will attend an ATaC induction day for each unit, during which assignments will be set. Each unit is required to be completed in eight weeks and the first unit will need to be successfully completed before moving to the second unit. Once all assignments have been completed successfully, there is a final professional interview regarding the submitted assignments. “We are delighted that our asbestos laboratory and project management qualification has been given equal standing to the existing certificate in competence by UKAS, and that it has been added to the Register of Regulated Qualifications” stated Richard Burton, Deputy Director (Head of Qualifications) at RSPH. “This means candidates have access to a qualification which has been accepted by UKAS, meets the requirements of LAB 30, and is nationally recognised through Ofqual.” For more information about this qualification please visit www.atac.org.uk

Bury demolition contractor fined for failing to prevent exposure to Asbestos A

demolition contractor has been sentenced after admitting illegally removing asbestos from a building he was working on. David William Briggs, trading as Briggs Demolition was found to have ignored an asbestos survey while demolishing the former Oakbank Training Centre in Chadderton, Oldham. Manchester Magistrates’ Court heard also failed to prevent exposure to asbestos to workers and others on site. The firm from Bridge Works, Wellington Street, Bury, was contracted to demolish the former education centre off Chadderton Park Road and advised the site owners to have the site surveyed for asbestos before demolition could began. Mr Briggs recommended a suitable surveyor and the site owner paid for a full asbestos survey to be carried out on Mr Briggs’ recommendation. The Health and Safety Executive (HSE), prosecuting, told the court that Mr Briggs then chose to ignore the asbestos report which identified approximately 230 square metres of asbestos materials throughout the buildings, and

began demolition without having any of it safely removed. HSE first visited the site in 2015, and met Mr Briggs on site. They found that approximately half of the buildings had been demolished or partly demolished. When Mr Briggs was asked if the asbestos had been removed he denied there was any on site. A HSE Prohibition Notice (PN) was served on Mr Briggs and on the site owners, stopping work until the extent of the asbestos disturbance could be established. HSE visited with scientists from the Health and Safety Laboratory (HSL) and confirmed the findings of the original asbestos survey report and identified hazardous asbestos in the remaining buildings. The court heard that three workers were potentially exposed to deadly asbestos fibres. They also heard that local residents and passers-by to the site were also at risk due to the uncontrolled method of demolition where large amounts of asbestos were present. David Briggs was charged with failing to protect the safety of his employees, failing to protect the safety other persons not employed by him, i.e. members of the public, failure to prevent the spread of asbestos and one count of

illegally removing asbestos materials without a licence. David William Briggs of Wellington Street, Bury, pleaded guilty at Manchester Magistrates’ to breaching Section 2(1) & Section 3(1) of the Health and Safety at Work etc Act 1974 and Regulations 8 (1) and 16 of the Control of Asbestos Regulations 2012 and was sentenced to 24 weeks imprisonment. HSE inspector Matt Greenly said after the case: “Mr Briggs wilfully ignored a professional asbestos survey, instigated by himself, and in doing so failed in his duty to protect his workers and anyone else around this site from a foreseeable risk of serious harm. Asbestos related diseases are currently untreatable and claim the lives of an estimated 5,000 people per year in the UK. “Anyone who worked on this site at this time, due to the lack of care taken by Mr Briggs, could possibly face a life shortening disease at some point over the next 30 years from an exposure which was totally preventable. This case sends a clear message to any individual or company that it does not pay to ignore known risks on site, especially to increase profits at the expense of people’s lives”.

Essex companies fined after workers exposed to asbestos T

wo Essex-based companies have been fined after exposing workers to potentially deadly asbestos over a period of years, despite being alerted to the risks at their premises. Basildon Crown Court heard that asbestos was found in poor condition when Connect Packaging Ltd moved into industrial units in Manor Road Trading Estate, Benfleet in 2007, but that it failed to act to control risk. As a result, its employees were exposed to risk from airborne asbestos fibres. When Connect Packaging Ltd moved out of the units in January 2009, it sublet them to Creo Retail

In 2014, Creo Retail Marketing Ltd undertook its own asbestos survey following the appointment of a new health and safety officer. This confirmed continuing risk of exposure to airborne asbestos fibres from sources including poorly-enscapsulated blue asbestos (crocidolite). Despite this, workers remained exposed to these risks while the companies debated their responsibility for its removal and failed to act

effectively to prevent exposure. Health and Safety Executive (HSE) launched an investigation and its scientists found asbestos fibres at locations including the workers’ clockingin point, on rafters above work areas, and within a stationery cupboard. When asbestos fibres become airborne, they can be inhaled, and these tiny fibres are known to cause respiratory diseases and cancers which can be fatal. The court heard that workers at both companies were exposed to risk over an extended period of time. Connect Packaging Ltd, registered at 91 Soho Hill, Birmingham was fined £65,000 and ordered to pay £8,150.23 in costs after pleading guilty to a breach of Section 4 of the Health and Safety at Work etc Act 1974. Creo Retail Marketing Ltd, registered at 350 Euston Road, London, was fined £150,000 and ordered to pay £8,149.63 in costs after pleading guilty to breaches of Sections 2 and 3 of the Health and Safety at Work etc Act 1974.

Asbestos removal supervisor fined for exposing workers to deadly fibres

n asbestos removal supervisor has been sentenced after admitting exposing numerous workers to deadly asbestos fibres during licensed asbestos removal works. Manchester Magistrates Court heard that a concern was received by the Health and Safety Executive (HSE) claiming that Alan Burdett was allowing people into the sealed asbestos enclosure, which is designed to keep dangerous fibres from escaping and contaminating people or other areas, without any form or protective clothing or face mask. Alan Burdett was a supervisor for Asbestos Decontamination Services Limited of Erdington, Birmingham and was engaged in large scale asbestos ceiling removal at the vacant Raleigh

House, Discovery Park, and Stockport, where he was in control of a group of removal operatives on a day-to-day basis. HSE’s investigation found that significant amount of metal framework which had supported the asbestos ceiling boards was stacked in the open building without being wrapped or sealed to prevent the spread of asbestos fibres. Alan Burdett had been filmed allowing workers to enter the asbestos enclosure without any face masks or protective clothing to prevent them being exposed to asbestos, as well as potentially releasing the deadly fibres into the main building where there were no controls to prevent exposure. Transportation of Asbestos Waste

Guidance that accompanies the Control of Asbestos Regulations 2012 (CAR 2012) defines asbestos waste as: asbestos products or materials that are ready for disposal, including building materials, dust, rubble, disposable PPE, rags used for cleaning and used tools that cannot be properly decontaminated.

The Approved Code of Practice (ACoP) which accompanies CAR 2102 states that, when packing asbestos waste: w it should be securely sealed in suitable, labelled bags, wrapping or packaging as it is produced; w any bags, wrapping or packaging used must be designed, constructed and maintained to make sure that no asbestos fibres can be released during handling or transport; w for most waste, double plastic sacks are suitable, provided they will not split during normal use; w stronger packages must be used if the waste contains sharp metal fragments or other materials that could puncture plastic sacks; w any waste where the escape of hazardous quantities of respirable asbestos fibres can occur during carriage should be placed in UN-approved packaging. This is available in up to 2 tonnes capacity. (This does not apply to asbestos cement or textured decorative coatings.) Wherever practicable, large items of rigid ACM such as sheets of asbestos cement and textured coatings attached to a board should not be broken up or cut down for disposal in plastic sacks. The intact rigid waste should be double wrapped in suitable polythene sheeting (1000 gauge or equivalent) or other suitable material and labelled accordingly.

here had been some concern that in some cases suitable UN packaging for large items of asbestos waste, where the escape of hazardous quantities of respirable asbestos fibres could occur (fibrous waste) was not available, and therefore rather than break up or cut down the items of waste they were wrapped in polythene and labelled for transportation. Waste which is wrapped in this way is not compliant with the requirements of the Control of Dangerous Goods and Use of Transportable Pressure Equipment Regulations 2009 (CDG) or the International Carriage of Dangerous Goods by Road (ADR) Regulations. Most, if not all, insurance policies held by asbestos removal contractors have a clause, which in some shape or form, requires the holder of the policy to comply with the law when conducting their business. Therefore, there was concern that asbestos removal contractors may be in breach of their insurance policy, and exposing themselves to the risk that an insurance claim may be rejected, if the claim involved spillage of waste which was not correctly packaged in accordance with CDR and ADR.

The Department for Transport (DfT) informed us that most items of ‘large’ fibrous asbestos waste would be considered to be manufactured items (i.e. an asbestos product produced via a manufacturing process). Therefore, as manufactured, the CDG and ADR packaging requirements would not apply as per SP168 of ADR. An item of ‘large’ fibrous asbestos waste (i.e. which would not fit into standard asbestos waste bags) that could be considered as a non-manufactured article, was lengths of ‘wrap and cut’ pipework which were lagged with hand applied insulation. As a result

of this the DfT issued The Carriage of Dangerous Goods and Use of Transportable Pressure Equipment Regulations 2009 Authorisation No 465. The purpose of the Authorisation was: To permit the carriage of UN2212 WASTE ASBESTOS, AMPHIBOLE AND UN2590 WASTE ASBESTOS, CHRYSOTILE when Special Provision 168 cannot be utilised because the waste is neither bonded nor a manufactured article and UN approvedpackaging is not available due to the size of the item to be transported.

w Windsor Waste provided copies of their test certificates for their Hazibag flexible intermediate bulk container (IBC) to demonstrate it met the requirements for packaging groups II and III. The packaging can be used for packaging ‘large’ asbestos waste items that will not fit into traditionally sized asbestos waste bags. The Hazibag comes in a variety of sizes: l

650mm x 430mm x 900mm, max load 250kg, volume 200 litres

1m x 1m x 1m, max load 800kg, volume 1,000 litres

2.5m x 1.5m x 0.4m, max load 550kg, volume 1,500 litres.

The Authorisation, which came into effect immediately and remained valid until 31st January 2017, was granted whilst suitable UN approved-packaging was sourced. Therefore, as suitable packaging for ‘large’ asbestos waste items is now available the Authorisation expired on the 31st January and there is no requirement to extend it. ARCA is aware of two products (see below) for the packaging for ‘large’ asbestos waste items, however, other suitable packaging may be available from other manufacturers or suppliers.

w EASE have developed the ‘pipe bag’, specifically for packaging lengths of ‘wrap and cut’ pipe. Test certificates have been provided to show that this packaging solution meets the requirements for packaging groups II and III. The ‘pipe bag’ can also be used for any asbestos waste where a longer, narrower, bag is more appropriate for the size of the waste. The size of the ‘pipe bag’ is: l Length 2756mm x width 533mm, max load 40kg

Behaviour Change and Worker Engagement (BCWE) in the Construction Industry This framework was further refined following completion of subsequent research into the salient characteristics of construction SMEs that such a toolkit needs to accommodate. The resulting toolkit is due to be trialled by a number of construction SMEs and the evaluation will be published by HSL at a later date.

Outcome/Benefits

The Client Health and Safety Executive (HSE) has the day-to-day responsibility to protect people against risks to health and safety arising out of work activities. They do this through research, information and advice, promoting training, new or revised regulations and codes of practice, inspection, investigation and enforcement.

The Problem The construction industry is one of the UK’s most important economic sectors, with over 250,000 organisations, 99% of which are small to medium sized enterprises (SMEs). It is also one of the most dangerous sectors to work in. The industry is therefore continually seeking to find innovative ways in which it can reduce ill health and accidents by engaging with its workforce and promoting sustainable behaviour change to ensure that health and safety is taken seriously on site. Owing to HSL’s reputation and expertise in the area of behaviour change and worker

engagement (BCWE), we were commissioned to look at the application of BCWE amongst some Principle Contractors within construction, including Bovis Lend Lease, Carillion, Kier, Mace and Laing O’Rourke. Understanding how these larger companies utilise BCWE would help to identify how SMEs could be encouraged to do so in a way that meets their business needs.

What We Did HSL qualitatively investigated BCWE practices within this group of companies all of whom invest heavily in BCWE (e.g. training supervisors in worker engagement skills, observation and feedback techniques, implementing rewards/ penalty systems for safe/unsafe acts, etc.). The contemporary scientific evidence was also reviewed to establish best practice in BCWE. By identifying the best practice undertaken by the largest contractors in the industry, HSL developed a framework for a toolkit suitable for the smaller contractors within construction.

The project has generated significant interest within the construction industry and has lead to a number of practical outcomes including: w Recommendations to help raise the profile of health and wellbeing in the industry as the research identified that current behaviour change programmes tend to focus on safety. w Developing a “rule of thumb” safety culture/climate maturity assessment tool for use by SMEs in the construction industry. w The development of a comprehensive toolkit for SMEs with a range of resources necessary for permitting sustainable behaviour change. This includes: motivating management, providing assessment measures, integrating BCWE practices with the health and safety management system, advice on leadership skills, strategies for motivating the workforce, advice on how to instigate and sustain actual change over time. For each component a range of strategies, easy to use/adapt tools, techniques, information sheets and/or video footage recommendations were produced, the intention being that SMEs select those that best suit their business and workforce needs.

So you want to revamp your audit approach! A

uditing has been around for years and is definitely here to stay. It forms a vital resource for gathering information that can be used to monitor performance. It is also an integral part of health and safety management, as outlined in the HSE publication HSG65, Managing for Health and Safety. But how effective auditing will be is determined by how well planned the programme is. There are some key steps you can take to make your audit approach effective, whether you are designing it from scratch or revamping your existing programme.

Begin with the end in mind What is it that you actually want to achieve? Quality of audits far outweighs quantity. It is all about gathering meaningful information on performance, and measuring improvement, not about filling an audit folder by the end of the year. Audits should be seen as a ‘tool’ to provide reassurance on overall performance, and not just a fault finding exercise.

Internal audits and external audits An audit programme should comprise of a blend of both internal and external audits. Internal audits allow more flexibility in scheduling, particularly if you want to audit a job at a specific stage, and in an industry where timescales are sometimes difficult to predict. Also, an internal auditor will likely be more familiar with company procedures and the intricacies of them; the way the company goes about its business. External audits may turn out to be more expensive, but there are some advantages when compared to internal audits. For example, an external auditor should provide an independent perspective with total impartiality, therefore adding credibility to your audit programme when scrutinised by third parties, such as during licence renewal assessments. Furthermore,

an external auditor may well have extensive experience across the industry, which you can tap into, and which may provide opportunities for improvement that could otherwise be missed. You may find that the advantages and benefits of external auditing, by someone competent to do so, may significantly outweigh any extra monetary cost.

What is a good audit strategy? A robust audit programme will consist of both internal and external audits, though there is no hard and fast rule regarding the ratio of these. A great deal depends on resources and the capacity to work with a fluctuating workload. In any case, the internal audit and external audit programmes should work in tandem to allow synergy in their achievements. Very little will be achieved if the two are not aligned. Also, there is no hard and fast rule regarding the number / percentage of jobs to be audited. For example, a Licensed Asbestos Removal Contractor may have a single job running for 6 months, which may be audited on numerous occasions, whereas another contract may consist of dozens of separate consecutive jobs, all of which are somewhat repetitive, and undertaken by the same site teams, therefore only needing to be audited on several occasions throughout the entire contract.

What should be included in the audit? A site audit should measure performance against specific criteria, usually in the form of a predetermined checklist, whereas a site inspection tends to focus on just what is occurring at the time. Having a predetermined checklist requires extensive consideration as to what needs to be checked, and informed decisions as to what is not on the checklist. An audit doesn’t need to include everything; don’t get caught up trying to cover everything and miss the things that matter most. Site audit criteria should link to relevant current legislation, approved codes of practice, guidance and good practice, as well as your own procedures. A full audit will cover, at least to some extent, all subject areas. For areas that have previously given cause for concern (that may have been highlighted through Training Needs Analysis, previous audits or enforcement authority visits), you may choose to drill down with some very specific criteria to establish that the corrective actions are being fully implemented. You may also want to take a more in-depth look at new requirements for the industry, new procedures adopted by your organisation, or any hot topics. For subject areas where there have been no causes for concern for a long period of time, you may want to just generalise the approach to check that there has

guidance on audits been no deterioration in standards; checking that the established standards are being maintained. Where possible, the site audit criteria should remain constant for as long as circumstances permit, to enable trends and comparisons to be made over time. If the required actions from previous performance monitoring methods have been implemented, this will show. If there has been no measured improvement, then this requires further management intervention. Regular chopping and changing of the audit criteria will not allow trends to readily manifest themselves, so information gathered may be less meaningful and interventions less effective.

Unannounced audits or site teams pre-warned? This is entirely up to you. Managers must decide how best to manage the approach. Remember that you invest in auditing to identify areas for improvement by measuring performance, not by putting on a performance. Gathering meaningful information is most likely when the audit is not known to the site teams. However, site teams should have the attitude to expect an audit on any site at any time.

A tale is told of a site team working so remotely from their head office that they knew they wouldnâ&#x20AC;&#x2122;t get audited by them on that job. Then the external auditor showed upâ&#x20AC;Ś!

What is the competence requirement of the auditor? The audit is not just about ticking boxes. The auditor needs to understand the process, the reasons why things are done in certain ways, and how good practice applies in varying circumstances. No two asbestos removal jobs are ever exactly the same, so the auditor will often need to draw on broad industry experience in order to make a fair assessment of the work being undertaken at each site. Their competence is especially required in determining suitable corrective actions when deficiencies in contract management or site practices are observed.

Can ARCA help? ARCA membership requires full contracting members (i.e. licensed asbestos removal contractors) to undertake two ARCA site audits per year under the Site Audit Accreditation Scheme. The audit criteria are well established

and reflect a detailed consultation process with industry leaders, and form a solid base from which further evaluation is possible. These audits are unannounced, and conducted by trained, competent auditors with a proven track record of relevant experience, and who are regularly monitored by ARCA. Many companies choose ARCAâ&#x20AC;&#x2122;s additional audits to provide the external audit portion of their full audit programme. By doing so, information from the required audits is coupled with information from the additional audits, so there is consistency across all reports, therefore delivering a stronger management tool. This would provide a comprehensive assessment of performance of both the site teams and the management system, so delivering a thorough report on performance. ARCA Members support young children with tumours A fund of £27,000 raised for Indee Rose Trust

ast year, through social events and auctions, and for the first time, a Charity Week, many ARCA members and staff got involved to raise funds for the Association’s two charities. One charity ARCA chose to support was the Indee Rose Trust, as through donations this charity supports children, who have been diagnosed with a brain or spinal tumour, and their families. “I became aware of the Indee Rose Trust a few years ago,” said Grant Beglan, Chairman of ARCA. “Jane and Russell, who founded the charity in 2009 in memory of their daughter, do a tremendous job. One way they support children, who spend

such a long time in hospital, is by putting together personlised treasure boxes, with gifts to bring some enjoyment to the children and make them smile.” “A few months ago, I had the pleasure of delivering one of these treasure boxes to two-year old Ben Price while he was in hospital receiving treatment. I found this experience very moving as although he was extremely poorly his little face lit up after opening a few gifts. This confirmed to me that our fundraising activities are so important.” Russell Dopson, co-founded of the Indee Rose Trust, commented; “We are so overwhelmed by your generosity. Thank you to every single person

who took the time to fundraise. ARCA Members donate £22,000 to Mesothelioma UK

People working in the asbestos industry support asbestos cancer patients

embers of the Asbestos Removal Contractors Association (ARCA) have over the years raised funds for a number of charities mainly through social events and auctions. Last year ARCA opened up opportunities for more members to participate by holding a Charity Week. During this week, many member companies and staff got involved in lots of ways to raise funds for the Association’s two chosen charities. One of the charities ARCA chose to support was Mesothelioma UK, as through donations this charity supports many people suffering from Mesothelioma, a cancer caused by exposure to asbestos. The UK has the highest incidence of Mesothelioma in the world, and it continues to rise. Currently over 2,500 people are diagnosed and whilst the treatment options are increasing, hopefully improving outcomes too, the disease remains incurable. “When I met Liz Darlison of Mesothelioma UK last year I learned of the charity’s objective of having specialist nurses based at hospitals across the UK,” stated Steve Sadley, Chief Executive of ARCA. “I understand that the charity is now funding twelve nurses, based at different NHS hospitals across the UK, and is actively looking for more.” “Fundraising to support this objective is vital. Clients’ legal responsibilities ARCA site audits provide reassurance

Asbestos management is an issue faced by property owners, whether owning one premises or a large portfolio of premises, constructed prior to the year 2000. That is, they are responsible for ensuring that employees and non-employees are not exposed to health or safety risks as a result of the presence of asbestos.

he Health and Safety at Work Act 1974 places a duty on every employer to ensure, so far as is reasonably practicable, the health, safety and welfare at work of all employees. This requires a robust management plan which can easily be communicated to and understood by all those who have a duty under the plan. The human cost of asbestos-related disease is devastating and significant exposures are entirely avoidable. Current figures show that approximately 4,500 people die each year in the UK from asbestos related diseases (predominantly mesothelioma, lung cancer and asbestosis). Also the financial and reputational costs of getting asbestos management wrong are substantial. It is vital that organisations take the risks from asbestos seriously and deal with asbestos in a controlled and safe manner. When asbestos is managed well, inadvertent exposure can be prevented so that the health and safety of individuals is not put at risk. The Control of Asbestos Regulations 2012 (CAR 2012), Regulation 4, places a legal duty on those who own, occupy, manage or have responsibilities for premises that may contain asbestos. Those who have these responsibilities will either have a legal duty to manage the risk from this material; or a legal duty to cooperate with whoever manages that risk.

The Control of Asbestos Regulations 2012 (CAR 2012) places a legal duty to ‘manage asbestos in non-domestic properties’ by: w Finding out if there is asbestos in the premises, the amount and what condition it is in w Presuming the materials contain asbestos, unless there is strong evidence that they do not w Making and keeping an up-to-date record of the location and condition of the Asbestos Containing Material’s (ACM) or presumed ACM’s in premises w Assessing the risk from the material w Preparing a plan that sets out in detail how to manage the risk from this material w Taking the steps needed to put this plan into action w Reviewing and monitoring the plan and the arrangements made to put it in place and w Providing information on the location and condition of the material to anyone who is liable to work on it or disturb it.

The requirement is to manage asbestos. If materials are in good condition and managed so that they cannot be disturbed, a periodic check might be all that is needed. For some premises, that see a large number of employees/students/visitors, maintenance work is inevitable and accidental damage is often possible. Therefore, all premises which were constructed prior to the year 2000, will require an asbestos management plan based on a management survey. The purpose of the management survey is to manage asbestos containing materials (ACMs) during the normal occupation and use of the premises. The dutyholder can compile a management survey where the premises are simple and straightforward. Otherwise, an asbestos surveyor is needed. When a premises, or part of it, needs upgrading, refurbishment or demolition a refurbishment/demolition survey is required. This survey, normally carried out by an asbestos surveyor, is to locate and identify all ACMs before any structural work begins at a stated location or on stated equipment at the premises. Also, the Construction (Design and Management) Regulations 2015 (CDM 2015) places explicit responsibilities on clients. Clients have the final say on the course of action to be taken during a project, as they

are at the head of the procurement chain. So, they have opportunities to set standards for project delivery, including health and safety management. The law therefore requires that clients make suitable arrangements for managing a project, and maintain and review these arrangements throughout the project, to ensure health and safety risks are managed appropriately. Clients are not expected to be ‘experts’ in either construction work or asbestos work and do not need to directly manage or supervise the work themselves. However, they are responsible for ensuring appropriate arrangements are in place to manage and organise projects during both the ‘pre-construction’ and ‘construction’ phases of the project. This means appointing suitably competent people and providing them with sufficient information, time and resources to do the job properly.

“good communication between all parties is vital” If asbestos removal is required, the client, needs to appoint a competent asbestos removal contractor. As clients need to appoint suitably competent people, they need to make reasonable enquiries to satisfy themselves that contractors are appropriately resourced and competent for the work. Guidance on CDM 2015 states: “When considering the requirements for designers and other construction professionals, due weight

should also be given to membership of an established professional institution or body. For example, do these bodies have arrangements in place which provide some reassurance that health and safety is part of the route to membership of their profession?” (i) To provide reassurance for all parties of compliance with relevant legislation, the Asbestos Removal Contractors Association (ARCA) introduced an audit scheme in 2000, to support members’ performance and therefore maintain standards. Member contractors need to participate in ARCA’s audit scheme, which requires two satisfactory site audits every year, to join and maintain membership of the Association. To take a further step towards supporting consistent high standards and a higher level of reassurance, ARCA enhanced its audit scheme in January 2017. Members still need to complete two satisfactory site audits every year, however, ARCA audits are now unannounced. Meaning ARCA members (excluding Ireland) will not have prior knowledge of when, or where, an ARCA auditor will be assessing their performance. Therefore, being unannounced, ARCA site audits are now an even stronger system of reassurance for all parties, including end-clients.

“ARCA site audits are a strong system of reassurance” Once a contractor is appointed, the client will then need to provide the contractor with

sufficient information, time and resources to do the job properly. For example, an asbestos removal contractor will need appropriate preconstruction information in order to prepare a suitable work plan, and contractors need time (and access) to assess the premises properly and discuss key site information with the client. Also, an asbestos analyst must be appointed for licensed asbestos work - it is desirable that the analyst is employed directly by the client. The analyst will be required to verify that a work area has been thoroughly cleaned and that airborne fibres in the work area are as low as reasonably practicable, prior to handover for reoccupation or demolition etc. Good coordination and cooperation between all parties is a must for a project to be successful. Clients’ decisions, actions and inaction have an enormous impact on how work can be delivered. The financial and reputational costs of getting asbestos management wrong are substantial. With a well communicated structured approach to asbestos management, clients can ensure that they meet the challenge to comply with health and safety regulations. ARCA Winter Party 2016 A

RCA was joined by 200 members and their guests at the Association’s Winter Party last November at the award-winning Belfry Hotel & Resort. Guests enjoyed a superb evening’s entertainment hosted by Adger Brown and with music provided by the Boogie Wonderband. Guests took the opportunity to dance the night away into the early hours! During the evening, there was a game of heads and tails, and a charity auction which together raised over £13,500. These funds will go to the Association’s charities, the Indee Rose Trust and Mesothelioma UK. Many thanks to all those who made donations during the evening. Gained ILM Qualification now Member of ARMI

Having gained this Level 4 qualification, Chris met Steve Sadley, Chief Executive of ARCA, to discuss the ARMI application process. Lucion expands with new operation for Ireland

The company is opening a new office in Omagh, from where it will provide specialist asbestos safety services, analysis and consultancy support throughout Northern Ireland and the Irish Republic. orking under the influence of drugs and alcohol is not only dangerous but pretty stupid. It’s a huge issue for any industry to contend with, but particularly so in the asbestos removal sector where there are more work-place dangers to consider than in many areas of main stream construction or redevelopment projects. Operating whilst under the influence in an asbestos removal environment is incredibly high risk due to the fact people are removing a class 1 carcinogen with the obvious associated health risks, coupled with the need to be alert at all times in order to protect the health and safety of all on site including themselves. The construction industry as a whole is incredibly stringent in its approach to alcohol and drugs on site. Operatives in this sector are more likely to fail a test than in any other industry, therefore a zero tolerance and safety first approach

Jim Rider retires from SL Environmental

fter more than 33 years, Jim Rider has retired from SL Environmental Ltd. When Jim started with SL back in 1984, licensing had only just been established, negative air pressure was in its infancy, vacuum equipment was large, cumbersome, and not particularly efficient…how the industry has changed since those early days. Jim Rider joined SL as an operative, where his loyalty and diligence were soon recognised. He progressed into a management role, looking after many projects to successful completion, including contracts at Royal Palaces, Ministry of Defence, hospitals, schools, and a £1.2m project at the North London factory of Heinz Beans. Jim Rider will be missed by not only his work colleagues at SL Environmental, but also by many clients and suppliers who have enjoyed a friendly and professional relationship over many years. Jim can now look forward to enjoying more time with his family. Happy Retirement, Jim.

Rilmac look to a greener future T

he construction and fabrication industries are not known for their environmental credentials, although this is an area the Rilmac Group takes very seriously. Despite working in some challenging and heavily industrial fields, the Rilmac Group as a whole, are making inroads in improving their internal practices while working in the most environmentally friendly way possible in its various commercial projects.

Driving to a greener future First on the agenda was transport. To this end two members of senior staff have upgraded to hybrid electric cars in order to bring down their carbon footprint. As well as using these more

environmentally friendly cars for work purposes the group has installed a free to use charging point at their Crofton Drive headquarters. This allows for both staff, and customers, to charge up on site before heading back out on the roads, saving time, money and the environment. The charging points were installed as part of the Lincolnshire County Council Sustainable Travel Grant Scheme and the Rilmac Group is committed to working with the Council on ensuring that their travel requirements will become more and more environmentally friendly. The aim being to replace other staff vehicles with hybrid models when due for replacement, encourage car sharing and support bicycle use.

Rilmac Insulation and Asbestos Services aim to go paper free by the end of 2017. The scheme began with the on-site teams, who started by using Windows based tablets around the middle of 2015. Today the system makes great use of cloud technology and allows the team at the Lincoln head office to pass on information without the need for paper copies. All the latest certificates, clearances, licences, and worksheets are held securely and digitally in the main office. These are then checked, and updated where required, every morning and uploaded to the cloud. Each operative is then able to remotely download all the appropriate content to their tablet via a secure system before starting work. Also a bespoke database system has been developed for use by head office team members in a variety of ways, depending on the clients or on work requirements. This system allows staff to enter enquiries and new projects directly without the need to use paper. From there on in the process is completely paper free, unless specific requests are made for paper copies, which will, of course, be met happily. The aim of being completely paper free by the end of 2017 is going to be a huge challenge, but one that Rilmac Insulation and Asbestos Services aim to meet and believe that they will. n February, Doug Fox successfully completed his fourth and final ILM unit, and was presented with his ILM Qualification certificate. Doug is the Asbestos Manager for KDC Contractors Ltd, who specialise in providing decommissioning, demolition, asbestos removal and land remediation services to the nuclear, petrochemical, pharmaceutical, energy and utility sectors. During the 28 years Doug has been working in the industry, he has always been looking to progress and develop, gaining qualifications covering asbestos removal and demolition, and becoming a member of industry institutes. After learning about ARCA’s Leadership & Management Qualification it was the next development step for him. “ARCA’s ILM qualification, which they designed specifically for the asbestos removal industry, seemed ideal for my development and for my role, as I manage teams removing hazardous asbestos material, which can be on large and sometimes hazardous sites. As the management at KDC is fully supportive of development, I soon signed up to start,” commented Doug Fox.

“The qualification has been developed well by ARCA, as all four units were very relevant to the asbestos industry and all units complimented each other. During the classroom sessions, it was interesting to learn new concepts and also to have some which I have been using reinforced. I also came to understand more of why and how these skills are so important. “One element I’ve strengthened is communication - with all members of the teams. I now spend even more time on-site and hold review meetings with the whole team not just the supervisor. This has been extremely beneficial to all and the projects. “I’ve also increased the time I spend in coaching and developing members of my teams. Hopefully some operatives will progress up the ladder, like I did. “When I began this qualification, there were some challenging times, especially as the subjects were very involved, but classroom sessions were invaluable and the tutor support was excellent. My thanks to my tutor, Shaun, who was always positive, gave useful feedback and helped drive me to completion,” stated Doug. “I’ve developed some management principles and introduced others into practice, which I believe are all proving to be beneficial. I see my teams being more communicative, more motivated and more productive.” Shaun Wilson, ARCA tutor, commented, “It has been brilliant seeing the development in Doug over the four ILM units. He could see the benefits and developed a very positive attitude. “As a tutor, it is rewarding not only to see a candidate gain this qualification, but also to hear what was learnt is being put into practice. Congratulations to Doug.”
