bviously the COVID-19 virus is still causing a major disruption to almost every facet of people’s lives on a worldwide scale. In my last Chief Executive’s comment I remarked upon the early successes of the COVID-19 vaccine trials and literally 3-4 months later we are now looking at the national roll out of a vaccination programme that is on course to vaccinate all the over 50’s with at least their first vaccination dose by April 15th. Both cases of infection and deaths have reduced dramatically as a result of the current lockdown and vaccination programme. Gradually easing the lockdown, whilst maintaining sensible precautions, and continuing at pace with the vaccination programme, will hopefully see our lives soon start to resemble something like they did prior to the start of 2020. Let us hope so. I mentioned during the most recent round of regional meetings that I was hopeful we may be able to have face to face meetings for the next round of regional meetings. On reflection, whether this will be possible or not, will not be known until very close to the scheduled dates of the meetings. Therefore, to allow us and attendees to plan and not have last minute changes which may inconvenience people we have decided that the ARCA regional meetings scheduled for July will be remote meetings. The dates of these meetings are in the Diary Dates section on page 10. Our rollout of digital solutions for members continues at a pace. In September last year we launched ALFA, enabling member contractors to rate the performance of agency operatives, so providing some reassurance of operatives’ competency and behaviour to those contractors who may engage this operative to work on their asbestos removal site in the future. We have had some feedback from members regarding additional features and we are currently in the process of adding some of these to the system. The Site Audit Portal, where members can log in to view their site audit results, together with an analysis of those results, has been developed and is now in the test phase.
Currently our plan is to launch this in early May subject to modifications and extensive testing being completed by then (page 7). And finally, to complete the roundup of digital solutions currently in development, a TNA system for members directly employed operatives, based on the ALFA system, has been commissioned and the developers are currently working on building it. We hope to be able to showcase this product at the regional meetings in July (page 5). As you can see, despite COVID-19, ARCA has not stood still, we have been working on the digital solutions described above whilst continuing to provide training, NVQs and site audits, as well as the range of other services we offer. As members will be aware, last year we moved from 2 mandatory unannounced site audits for Full Contracting Members per membership year to 3. This was always going to mean that at some point we would need to add to our team of full time auditors. I am pleased to inform members that we have appointed a further site auditor, who will join our team on 6th April. One sign that things are getting back to normal is the fact that, barring any major setbacks in the COVID-19 restriction lifting, the ARCA National Golf Day is due to go ahead. This was originally scheduled for May 13th, but restrictions will still be in place with regards to dining indoors and using hotels. We have now rearranged the ARCA National Golf Day for the 30th of June at Woburn Golf Club. I sincerely hope when I write my next Chief Executive’s comment for the Summer issue of ARCA News the World and our lives will resemble something like we remember prior to COVID-19. This led to some member contractors talking to ARCA about how an ALFA system could be built for employed operatives. That is a system whereby they can ask their site supervisors to rate an employed operative as part of their TNA process, with the flexibility of choosing different types of asbestos

removal work and teams for an operative. ARCA is pleased to announce that a specification for this ALFA system was drawn up and discussed in detail with a number of member contractors. The system’s development work is currently underway with the aim of carrying out testing over the coming weeks. This has been designed to support member asbestos removal contractors in the management and fulfilment of their operative training and development programmes, and certificate management. The roadmap being developed by the working group will include timescales for the introduction of ARMI Member meetings, annual seminars, a revised CPD scheme, and in time a management committee elected from the membership and dedicated entrance exams. Association completes ISO recertification audit with flying colours
T
he Association successfully retained certification to ISO 9001:2015 following a recertification audit which identified no non-conformances and no opportunities for improvement. The auditor from NQA commented in his report; ‘leadership has been effectively demonstrated and commitment levels are evident. Also, documented information to demonstrate that the system is well implemented and well understood throughout the organisation.’ “Over the past year we have had to adapt how we deliver our products and services, and this recertification demonstrates that we have
continued, under extraordinary circumstances, to meet the required level of quality,” stated Steve Sadley, Chief Executive of the Asbestos Removal Contractors Association. “It is clear that every member of staff has made a significant contribution to this result. A big thank you to everyone.” Being an organisation delivering various services to members, the Association is proud to have been following the ISO 9001 quality management standard, and undertaking annual audits, for the last 16 years. The ARCA quality management system (QMS) describes the approach, procedures and processes to be followed in order to demonstrate the

CSCS Cards Audits for ARCA Members update holding Scaffolding and

key requirement for all CSCS card applications (new or renewal) is proof that the applicant has passed the relevant CITB Health, Safety and Environment (HS&E) test within the last 2 years. Currently the Pearson Professional test centres in England and Wales are currently open, however due to COVID-19 safeguards the centres cannot run at full capacity and some applicants are experiencing longer wait times than usual. Therefore, in January 2021 the CSCS asked the industry to continue to support the following temporary measures: w Employers and those responsible for site access and card checking procedures to use their discretion towards workers whose cards have expired since March onward. But a worker must always hold the correct card for the job they do on site. w CSCS has extended the grace period for card renewals from 6 months after the card expires to 12 months. This means that the card can be renewed, once the CITB HS&E test has been passed, up to one year from the card’s expiry date. This will assist those applicants struggling to find availability to sit the test and renew their card. Keep up to date at www.cscs.uk.com
Chris Early, An Obituary
O
n the 15th March 2021 we were informed that our friend and colleague Chris Early had passed away peacefully in Glasgow Hospital the previous week. Over the years, Chris was employed as an ARCA sub-contract trainer, delivering many training courses on our behalf. The training courses Chris delivered for us were mostly in Scotland, and that’s where the majority of ARCA members who knew Chris will have met him. Chris was involved in a serious accident late last year and since then had been in Glasgow Hospital receiving treatment for his injuries. Chris was a genuinely nice guy and well known in the industry, and as a result he will be sadly missed by all who knew him.

Site Audit Portal for Contractor Members A
RCA is currently developing a Site Audit Portal for Full Contracting Members, which will enable a member to login to a private portal and review their ARCA Site Audit Accreditation Scheme (SAAS) and additional audit results, view audit reports in full, and more. On a member’s dashboard will be a number of tables showing audit results over 3, 6 and 12 months, and audit criteria have been grouped into the categories of ‘Plan’, ‘Do’ and ‘Check’, making it very clear in which areas the business is performing well or needs improvement. The first table will show the member’s results from their internal audits via the
ARCA Internal Audit App, and the second table will show the member’s ARCA SAAS audit results, along with the results of any additional audits that ARCA has carried out for that member. This information, from both tables (if available), will then be put together to show the overall average result from all of these audits. Finally, there is a further table giving the average result from all ARCA membership SAAS audit results, so providing a benchmark for members on performance compared to the average of all ARCA members. Also, within this Site Audit Portal members will be able to view all of their ARCA audit reports in full, together with any corrective action reports.

The Performance Rating App for Asbestos Labour
ALFA goes from strength to strength Just over six months since the launch(i) of ALFA, the App has proved that its objective is already being met. Before ALFA, feedback from the majority of member contractors was that the quality of agency operatives was their biggest issue. Now member contractors are reporting that the competency and behaviour of the agency operatives they have sourced and rated in ALFA has noticeably improved.

Average performance rating delivers a positive result
Operatives now rated on non-licensed asbestos removal work New functionality in ALFA enables member contractors to rate short-term asbestos removal operatives undertaking non-licensed work. Since its launch, the focus for ALFA was to rate the performance and behaviour of short-term operatives while undertaking licensed asbestos removal work. The App has now been developed further to include non-licensed work, that is work such as, asbestos cement and vinyl floor tile removal, when full face RPE is not required. Licensed work is rated on nine categories covering asbestos removal and safety competencies, and the operative’s behaviour and attitude. Non-licensed work is rated on all but one of these categories, which is not relevant to non-licensed asbestos removal work. An operative’s overall performance rating will be calculated and viewed within ALFA separately for each type of work. “The feedback we have received over the last months about ALFA has been very positive. With the average rating of all agency operatives undertaking licensed work reporting good evidence of competency,” comments Steve Sadley, Chief Executive of ARCA. “I have previously stated that we would continue to support ALFA, and developing the App to enable operatives to be rated for nonlicensed work demonstrates that. This is another step in adding even more value to this tool for all parties, in our commitment to improve professionalism and standards in our industry,” concluded Steve Sadley. From 1st March 2021 agency operatives receive ratings for both licensed and non-licensed asbestos work. Once an operative is assigned by an agency to undertake work for a contractor, the contractor will be able to view the operative’s overall performance ratings(iv) for both licensed and non-licensed work separately.

A
north west contractor has been sentenced after disturbing asbestos during demolition works and damaging underground cables that resulted in severe disruption to services. Blackpool Magistrates’ Court heard how Peter Walling’s company had been contracted to demolish a former medical centre in Blackburn and clear the land ready for development. Between 15 November and 6 December 2018, four separate incidents occurred on site when an excavator operated by Mr Walling, caused damage to underground cables and a sub-station which caused loss of electricity supplies to the local area and repair costs to the electricity supplier of £49,000. In addition to this, Mr Walling removed asbestos containing materials prior to an asbestos survey taking place, potentially exposing workers to asbestos. An investigation by the Health and Safety Executive (HSE) found that Mr Walling did not ensure all services had been disconnected
Contractor sentenced following safety failings during demolition work prior to starting work. He had ignored warnings from Electricity North West to stop work when low voltage cables were first dug up by the excavator, causing damage to the live substation, and only stopped working in a dangerous area when the police attended the scene. Mr Walling did not implement a safe system of work when operating near to underground cables and failed to ensure that workers on site were not exposed to asbestos. Peter Andrew Walling of Arley Rise, Mellor, Blackburn pleaded guilty to breaching Section 37(1) of the Health and Safety at Work etc. Act 1974. He was sentenced to 200 hours unpaid work and received a ten-month prison
sentence suspended for 18 months and was ordered to pay costs of £7,000. HSE inspector Christine McGlynn said after the hearing: “These incidents could so easily have been avoided by simply carrying out correct control measures and safe working practices. Mr Walling recklessly failed to heed warnings and advice and put not only himself but also others on site at risk of electrocution and risk of exposure to asbestos containing materials. “Contractors should be aware that HSE will not hesitate to take appropriate enforcement action against those that fall below the required standards.”

Construction firms fined due to unsafe removal of asbestos A
construction company and a property management company have both been fined after failing to manage asbestos safely during a refurbishment of a former office block in Stockport. Manchester Magistrates’ Court heard how Samer Constructions Limited had been contracted by Swift Property Management MCR Ltd to refurbish the property in Hazel Grove, Stockport. Materials containing asbestos along with general waste had been discarded from the property, on and before 2 August 2018, and were spread across the roof of a one storey part of the block. Some of the materials had also fallen onto a car park area below that was not segregated from passing members of the public. An investigation by the Health and Safety Executive (HSE) found that an asbestos survey carried out on 31 May 2018 identified the presence of asbestos containing materials (ACM’s) including licensed ACM’s, but this had not been passed to Samer Constructions Ltd prior to work being carried out. failed in its duty to pass the survey onto the contractor prior to work commencing. Samer Constructions Limited failed in its duty to identify whether a survey had been undertaken and went ahead with the work in a reckless manner resulting in two employees being exposed to asbestos fibres. Swift Property Management Limited of Denison Road, Manchester pleaded guilty to breaching sections 2(1) and 3(1) of the health and Safety at Work etc. Act 1974. The company was fined £25,000 and ordered to pay costs of £3,428. Samer Constructions Limited of Platt Lane, Manchester pleaded guilty to breaching sections 2(1) and 3(1) of the health and Safety at Work etc. Act 1974. The company was fined £12,000 and ordered to pay costs of £3,428. Speaking after the hearing, HSE Inspector Phil Redman said: “These risks could so easily have been avoided by acting on the findings of the asbestos survey and carrying out correct control measures and safe working practices. Companies should be aware that HSE will not hesitate to take appropriate enforcement action against those that fall below the required standards.”

S MARKET UPDATE:
ince 2018, Professional Indemnity rates have been steadily increasing to the extent that it is not unusual for firms to struggle to secure quotes, for premiums to increase dramatically, or for the basis of cover to be altered and indemnity for certain activities removed (both going forward and retroactively).
PROFESSIONAL INDEMNITY WHAT HAS CAUSED THIS DRAMATIC SHIFT? Much is being made in the insurance and financial press at present around the availability and cost of Professional Indemnity insurance (PI). For many industries and professions, including the asbestos industry, the cost of Professional Indemnity is spiralling and there are many examples of firms struggling to obtain cover at all.
Lloyd’s of London, one of the global centres for Professional Indemnity, was forced to undertake a profitability review after underwriting results highlighted that PI was the poorest performing area of underwriting. Large claims associated with energy from waste projects, renewables installations and the potential exposure to cladding following the tragic 2017 Grenfell Tower fire have caused significant concern amongst underwriters. In addition, many insurers are no longer writing Professional Indemnity risks for certain industries, whilst others are exiting the PI market altogether. As a result, there is a surplus of demand and scarcity of a supply, so it is proving extremely challenging for some firms to agree indemnity at all, which results in rates increasing substantially. This challenging market has been compounded by the Coronavirus crisis which will inevitably result in an increase in insolvencies and a challenging economy for a sustained period. These economic challenges often result in an increased propensity for actions, again this is likely to increase claims frequency and premiums will also increase as a result. Therefore, the challenges in this market are expected to continue for the foreseeable future.
WHAT CAN BUSINESSES DO? While UK PI market conditions are extremely challenging, it is possible for businesses operating in the asbestos industry to take steps to help manage insurance costs and cover. It is important to engage a broker who has specialist capabilities in PI, and it is also advantageous to work with a broker who can access the Lloyd’s and London Markets in addition to the UK and Global composite insurers.
Renewals We strongly recommend starting the renewal process early as insurers are adopting a robust approach to assessing risks and they are being selective. This is compounded by the challenges of negotiating remotely during periods of lockdown and accessing Lloyd’s underwriters, which means that the renewal process is taking more time. We would encourage firms to leave plenty of time to put together the extra information that insurers may require and answer any additional questions that underwriters may pose. Providing your insurance broker with as much information as possible will ensure they have sufficient time and opportunity to negotiate the best terms possible on your behalf. Claims It is essential that firms carefully consider the status of any on-going claims, ensuring that all outstanding matters are dealt with and verified claims experiences obtained from the existing and previous insurers in good time. Underwriters will also look to understand what lessons have been learned as a consequence of any losses that have led to claims and how improvements are being made. Underwriters will be placing more focus on your business’s internal procedures and risk management controls when considering a risk. Therefore it is often necessary to be able to demonstrate the levels of risk management and control by providing documentation and supplementary information highlighting the extent of risk management and procedures; robust cashflow management measures; client and supplier contracts and supply chain management methods. This shows that your business is well managed, making it more appealing to underwriters which can help to secure robust cover on competitive terms.

We have received an increased number of enquiries over the past few months regarding HSE expectations with regards to air management calculations and enclosure design details within Plans of Work. These enquiries have been raised usually as a result of HSE comments received by members following site inspections or asbestos licence renewal assessments. It is clear that as well as calculating how much air needs to be extracted from the enclosure, the HSE also wants to see the Plan of Work describe how the required volume of air will be allowed to enter the enclosure.
A
llowing for the right amount of air to enter the enclosure is as important as ensuring the correct amount of air is extracted. If you haven’t got the required amount of air entering the enclosure then you will not be extracting the required amount of air, even if the capacity of your negative pressure unit(s) suggests this. For example, a well-sealed enclosure which requires 5,000m3/hr to be extracted to provide 8 air changes per hour, which has negative pressure units with a total capacity of 5,000m3/hr, and a standard size airlock and baglock which each have flap deflections between 200-300mm, and no other inlets for additional make up air, will probably only allow air extraction in the region of 3,000m3/hr. What can be extracted from the enclosure is limited by the amount of air which can physically be drawn into the enclosure. When preparing Plans of Work, licence holders should consider how they are going to ensure sufficient make up air is permitted to enter the enclosure and how they are going to confirm the actual performance of the negative pressure units being used. ARCA strongly recommends that the actual performance of negative pressure units on site is measured using an anemometer. Air Management The specified level of air movement, or airflow, is 1,000m3/hr for small enclosures and at least 8 “air changes per hour” for larger enclosures. This has

been shown by HSE research to be the most reliable factor for good air management. Where this level of air movement is achieved, there is expected to be negative pressure of around minus 5 pascals, which represents good containment, thorough air mixing in the enclosure and, reduced exposure and spread of asbestos. It will also provide an easy method for determining that correct airflow exists, by using airlock door flaps as an indicator. Planning The first stage of planning air management for asbestos enclosures is to calculate the airflow required. The effect of any ducting attached to the NPUs can be significant. As a “rule of thumb”, ducting either side of the NPU, is likely to reduce flow by approximately 1% for each metre and 2% for each bend. Allowances for this need to be made in the calculation. For example, 10m of ducting will reduce the airflow of an NPU by approximately 10%, and 10m of ducting with two bends will reduce the airflow of an NPU by approximately 14%. If there are any voids within the enclosure which will be opened up as the work progresses, the planning will need to consider these, and consider how the airflow will be increased to take account of the increase in enclosure volume and continue to maintain good air management. In a well-sealed enclosure, the volume of air pulled out must be equal to the volume of air allowed in. In other words, where an enclosure has a series of NPUs intended to move 10,000m3/hr of air, it must be
designed to allow 10,000m3/hr in. You will need to ensure that allowance has been made for sufficient make up air to enter the enclosure. The smoke test should confirm that the enclosure is well sealed. You should not rely upon a ‘leaky’ enclosure to supply make up air. For planning purposes, NPUs should be referred to by their last known actual rating rather than the manufacturer’s nominal rating. Standard units of measurement should be used throughout the organisation to minimise confusion: i.e., m3/hr. The planned air management system for an asbestos removal enclosure should be sufficiently detailed in the Plan of Work to enable the supervisor to set it up as required, and to test it to ensure it is effective and performing as anticipated. 1,000m3/hr of airflow through an airlock will deflect a ‘standard’ door flap around 200mm. At 1,500m3/hr, the amount of deflection, around 300mm, starts to restrict the space available for decontamination in the ‘minimum’ 1m square stage. These airlock flap deflections will be consistent for consistent flow rates regardless of enclosure size. Standard Airlocks and Baglocks To provide consistency to their approach, licensed asbestos removal contractors should adopt the standard sizes of airlock and air chambers identified by the HSE. Therefore, airlock and baglock door openings should be 0.7m x 1.7m, giving an aperture with an area of 1.19m2. The width and weight of the flaps are important. Wider, heavier flaps will offer more resistance to air.

For the purposes of establishing good air management, ‘standard flaps’ should be 0.8m wide, “weighted” by rolling up excess 1,000-gauge polythene sheeting, which will weigh approximately 380g. A ‘standard’ airlock or baglock will allow 1,500m3/hr each into the enclosure. An enclosure with an airlock as the only opening into the enclosure will allow a maximum of 1,500m3/hr into the enclosure before affecting the operative’s ability to utilise the airlock as intended. If there is a baglock which is open, then that will allow another 1,500m3/hr into the enclosure. It is permissible to have the airlock and baglock open at the same time to facilitate sufficient inlet air. By using standard airlock sizes, flaps and flap weighting, as described, the airlock door flap deflection can be used to confirm that the planned airflow through the enclosure is being achieved and maintained. Air Inlets and Pre-Filters If air chambers are not practical due to site constraints, then filters can be cut into the enclosure wall to create air inlets. The amount of air allowed in through a prefiltered air inlet is difficult to estimate. It is dependent upon the pressure difference between the inside of the enclosure and outside atmosphere, the size of the air inlet/filter and the filter medium. Almost every different size and make of filter will give differing values and therefore there is not a reliable method for calculating the amount of air a pre-filter will allow into an enclosure. However, the amount of air being supplied to the NPU(s) can be confirmed by checking the performance of the NPU using an anemometer, as air in equals air out. These air inlets should have flaps fitted on the inside of the enclosure which close when the NPUs are switched off or the pressure drops. You can confirm that air inlets are providing sufficient make up air by using an anemometer to check how much air is being extracted as air in equals air out. For NPUs with fitted manometers, running the unit in free air, i.e., where air supply to the NPU is not restricted in any way,
such as in an open space, will allow a reading to be taken from the NPU’s manometer when the NPU is running at full capacity. Once connected to an enclosure, if the manometer reading has changed then the NPU will be being choked, i.e., sufficient make up air is not available to allow the NPU to function at its maximum. Additional methods of allowing air into the enclosure can be added until the manometer reading reads the same as in free air. You will then know that the NPU is working at its full capacity and an anemometer reading can confirm what that is. Speed Controllers and Anemometers Some NPUs are fitted with speed controllers to vary the airflow produced by the NPU. Care should be exercised when using these, as unless you have a way of accurately determining the NPU’s actual performance, such as measuring it with an anemometer, you can be unaware of the actual airflow it is delivering. Simply turning the speed control down to achieve 200-300mm deflection of the airlock flaps will rarely mean that you have good air management. Good air management planning requires knowledge of the actual airflow achieved by an NPU. Site teams should establish the actual flow during set up, using an anemometer, if possible, and mark the airlock to show flap deflection with this amount of airflow. During the works, the flap deflection can be used as a reference point to determine that the airflow has not changed. The site team should be trained to do this and the Plan of Work or standard operating procedures should inform and instruct the site team as to what is required.

CITB Grants and Funding...
What is the difference and how can you apply. The CITB’s core purpose is to support the construction industry to maintain health and safety standards on construction sites and ensure the right skills are available for the industry. This is achieved by the CITB collecting a levy from all eligible construction companies that fall within the scope of the CITB Levy order. This is then redistributed throughout the construction industry by funding training, qualifications, apprenticeships, and through advice and guidance.

Grants The Grant Scheme principles are: w Encourage training specifically related to the construction industry. w Alignment to CITB’s Scope Order. w Focus grants to support employers training their workforce to industry-agreed standards, so that skills achieved are universally recognised and portable. w Support all Levy-registered employers and their full sub-contractor workforce, delivering skills across the whole supply chain. w Use targeted funding to support industry priorities, and enhance support for the areas where the need is greatest. w Prioritise investment in areas where there is a long-term commitment and return on investment. Who can apply for a grant? ARCA members registered with CITB for levy purposes, can claim grants and funding provided they have sent a correctly completed Levy Return to CITB by 30th November each year. Small employers that don’t need to pay the levy, but are registered, can still apply for grants. Grants are paid to the employer who has supported an employee to complete training or to gain qualifications. How do grants work? Grants are for training and qualifications completed in the Grants Scheme year (1st April to 31st March of the next year).
ARCA members registered with CITB, who complete employee training through ARCA, will be paid the CITB grant directly into their bank account. This is because ARCA is a registered ‘Approved Training Organisation’ with CITB, and can therefore upload the details (some details required from members) on members behalf to CITB directly through the Association’s portal. Asbestos training courses eligible for grants are new and refresher courses for Operatives, Supervisors and Licensed Contract Managers. Other grants, for example when an employee achieves an NVQ, will need to be claimed by the employer after the candidate has successfully completed the qualification. Usually, through the submission of evidence of certification and/or invoicing. How to apply? Each grant has slightly different rules. Information on how to apply for the individual grants is available on the CITB web site. When is a grant payment received? If succcessful, grant payments are usually made by bank transfer within four weeks of ARCA uploading the information. CITB Skills and Training Fund The Skills and Training Fund is an additional incentive for employers registered with the CITB regarding the levy, to support the cost of introducing new training to help businesses improve. The aim of the Skills and Training Fund is to provide direct investment into construction businesses, to support a wide range of training or activities which help to develop either construction skills or management skills. From 2020, it also supports a wider range of activity, with a greater emphasis on innovation, and management and leadership training. So for eligible ARCA Full Contracting Members this funding is available towards qualifications/NVQs, and training for asbestos removal operatives, supervisors and managers.

CITB grants and funding Who can apply for funding? A business can apply if: w CITB registered w 1-250 directly employed staff on the payroll w any previous project paid for by the Skills and Training Fund has been signed off as complete. Note that only one application for funding can be made every 12 months. How much can a business apply for? The funding available is banded on how many direct employees the CITB registered employer has: w 1 to 49 directly employed staff can receive up to £5,000. w 50 to 74 directly employed staff can receive up to £7,500. w 75 to 99 directly employed staff can receive up to £10,000. w 100 to 149 directly employed staff can receive up to £15,000. w 150 to 199 directly employed staff can receive up to £20,000. w 200 to 250 directly employed staff can receive up to £25,000.
How to apply? Firstly, ARCA recommends attending a one hour ARCA briefing, held on the first Tuesday of every month at 10am, where Satish Patel, ARCA Training Manager, will go through in detail the application process.

Q&A Personal Air Monitoring
As a source of competent advice to members, ARCA receives a range of enquiries on a broad spectrum of asbestos-related topics. Here we discuss some of the typical questions received relating to air monitoring, particularly testing that is not part of the 4-stage clearance process.
As part of our recent HSE licence renewal, we were asked to describe our personal monitoring strategy. We submitted a table of different material types and the percentage of these types of jobs where we would arrange for personal air monitoring. The assessing inspector wants further details. What else is required here? It is quite common for a Licensed Asbestos Removal Contractor (LARC) to decide on percentages of jobs where personal monitoring will be arranged, depending on material type. However, this is a frequency, and on its own, falls well short of being a strategy. A strategy is a plan of action that is designed to achieve a long-term or overall aim, and so requires significant forethought (i.e. planning) to determine what you want to achieve as your outcome. Consider the scenario where you have 3 operatives within an enclosure, all with differing roles associated with the removal of asbestos insulating board (AIB). The first operative is responsible for applying the dust suppressant to the surfaces and using the H-type vacuum cleaner to ‘shadow vacuum’ during the removal process. The second operative conducts the actual removal, and passes the waste directly to the third operative who immediately bags or wraps the waste. Your overall aim might be to conduct personal monitoring to determine which of these three activities gives rise to the highest airborne asbestos fibre concentration, with a view to adding further control measures to a specific activity should they be required.

To achieve the aim, a LARC would need to consider: w only engaging a UKAS accredited analytical organisation (or INAB in Republic of Ireland) w communicating the date and time the monitoring is to take place to co-ordinate the monitoring with a particular stage of the work w specifying clearly to the analyst which operative(s) will be subject to the personal monitoring w conveying to the selected operative what their task(s) will be for the sampling duration w communicating with the analyst the desired sampling duration w ensuring the analyst comes prepared with a sufficient number of charged pumps to conduct the monitoring as instructed w keeping an accurate record of what each operative was doing throughout the sampling period, to include finer details such as the pace of the work and the operative’s proximity to the airflow w ensuring that the sampling pumps are correctly worn throughout the sampling period w ensuring analytical results are reported to yourself, regardless of whether the analyst is appointed by the client or not By predetermining what you want your outcome(s) to cover, you can put a plan in place to achieve the desired outcome(s). Thus, you will be beginning to formulate a strategy for your personal monitoring, rather than just doing it because it needs doing. You will be doing it to find out as much as you can about what is going on during your removal job, and how you can learn from the findings to improve your future performance.
I understand about averages, but what is the significance of time weighted averages? The logic in calculating a mean average of a set of figures doesn’t apply when calculating time weighted averages (TWA). As the phrase implies, the time factor applies a ‘weighting’ to the calculated average. If asbestos operative A, on site A, is carrying out a range of activities within an enclosure, we could take one personal sample over a 4-hour sampling period (and shift), and this would equate to a 4-hour TWA for that shift. In other words, there will be a certain number of fibres picked up on the sampling filter, which will give us a fibre concentration across the 4 hours for the range of activities that have been undertaken. In reality, the removal
part of many asbestos jobs will be too short to allow 4-hour sampling periods, and this is where 4-hour TWAs get a little more complicated. Operative B, on site B, might be undertaking exactly the same work as operative A, using exactly the same techniques and control measures, with the only difference being the size of the job and therefore the length of time spent in the enclosure. Although the airborne fibre concentration within the enclosure may be the same as on site A, operative B’s personal exposure will be less than that of operative A, simply by virtue of spending less time within the working enclosure. If operative B spent 80 minutes in the enclosure (compared to operative A’s 240 minutes), his exposure expressed as a 4-hour time weighted average would be one third of that of operative A. Expressing personal exposures as 4-hour time weighted averages is how we would measure compliance with the 4-hour control limit detailed in the Control of Asbestos Regulations 2012. In the Regulations (see ACoP L143, Managing and working with asbestos), the control limit is defined as ‘a concentration of asbestos in the atmosphere … of 0.1 fibres per cubic centimetre of air averaged over a continuous period of 4 hours’. Should this figure be exceeded, despite the use of other control measures, employers must provide (and employees wear) suitable RPE. For licensed asbestos removal work, 4-hour time weighted averages have limited relevance in most cases as suitable RPE is being worn anyway.
As a licensed contractor, would we be required to convert all of our personal monitoring data and exposure estimates into 4-hour time weighted average figures? It would be useful to have some 4-hour time weighted averages (TWA) to be able to show compliance, though it should not be necessary to produce more than a representative number of values, providing these values are well within the protection factor of the RPE in use. In addition, too much focus on comparing 4-hour TWAs can be misleading. In the example above, the 4-hour TWA for operative A will be three times the value for operative B. This may lead to thinking that operative A was not being as careful as operative B in removing the AIB, or perhaps the control measures weren’t being applied correctly. The truth is that the airborne fibre concentrations generated by both operatives were the same – it’s just the time factor that made the 3-fold difference, not poor technique that needs correcting.

How do we maximise the information we can get from our personal monitoring? Time weighted averages (TWA) will not show any peaks and troughs in the amount of fibre that became airborne, such as would naturally occur if a range of different activities had been undertaken. One 4-hour sample, even though it could give us an automatic 4-hour TWA, doesn’t provide us with much useful information for monitoring performance where a range of activities are being undertaken. For example, if we have a job removing AIB ceiling tiles, a 4-hour shift in an enclosure could be broken down into tasks, and if personal sampling were undertaken for each individual task, results could be illustrated as shown below: Task

The 4-hour TWA for these tasks is calculated as follows: (0.5 hr x 0.50)+(2.5 hrs x 0.16)+(1.0 hr x 0.03) = 0.25+0.4+0.03 = 0.68 = 0.17 f/cm3 4

In this example, a 4-hour sample would not show the variance in airborne fibre concentrations for the different tasks, whereas a series of shorter sampling periods covering each distinct activity would. The individual activities monitored with shorter sampling periods are referred to as ‘specific short-duration activities’ and by compiling a database of these, it will better enable you to see where your consistencies and inconsistencies are in your removal techniques. This in turn can lead to targeted improvements to your procedures, identify training needs of individual operatives, and to better inform your estimates when identifying anticipated fibre concentrations in your Plans of Work. Ultimately this should lead to reducing the spread of asbestos and the exposure to it to be as low as reasonably practicable – the two key requirements of asbestos legislation.
On the HSE licence renewal application form there is a question where the applicant is asked to describe their ‘air and personal monitoring strategy’. What is meant by the ‘air’ part of this requirement? The obvious answer is that this is referring to air monitoring other than personal monitoring. In reality, it would also not be referring to air monitoring conducted as part of the 4-stage clearance process, as this is covered elsewhere in the licence renewal application. Also, the air monitoring that is included in the 4-stage clearance process is mandatory for all licensed work within an asbestos enclosure, is so well prescribed, and with the singular aim of leading to the Certificate of Reoccupation it hardly warrants a strategy at all. It just needs to be done. The remaining forms of static air monitoring can be applied as part of a strategy, and would address questions of who, what, when, where, why and how. The typical forms of static air monitoring undertaken for specific purposes can be summarised as follows: w Background sampling, to establish the prevailing airborne asbestos fibre concentration, usually carried out to establish a baseline before an activity that may lead to asbestos contamination w Leak testing, to assess the integrity of an asbestos enclosure to ensure it is intact and that airborne asbestos fibres have not escaped w Reassurance sampling, conducted in certain circumstances (such as following removal work) to confirm that residual airborne asbestos fibre concentrations are not elevated w Near-source static sampling, to assess the release and spread of asbestos near sources, e.g. work without an enclosure, or disturbance of asbestos in soil w Far-source/perimeter sampling, conducted around the perimeter of a site where there may be other workers, public access or residential and commercial buildings Your strategy would include how you would select from the different forms of static air monitoring, what you would want to establish, and what you would do with whatever results are produced.

What was your first job? My first job was as a Research Associate in Analytical Chemistry at Heriot Watt University in Edinburgh in 1984. I was involved in research into the environmental impact of North Sea oil platforms and installations. I had recently graduated from the University of Glasgow with a PhD from the Department of Forensic Medicine and Science.
How did you get into the world of asbestos? I joined HSE in Edinburgh in 1986 as a Chemical Inspector (later renamed as a Specialist Inspector) with a remit in Occupational Hygiene (OH). A Chemical Inspector’s role involved assessing workplace exposure to hazardous substances and agents including asbestos. This was a period when asbestos products (primarily asbestos cement (AC) materials) were still being manufactured in the UK. My early involvement with asbestos therefore was a combination of inspection of workplaces where there

was potential exposure to asbestos fibres (e.g. manufacturing AC roof sheeting or changing vehicle brake pads) and investigation of incidents of asbestos disturbance. During this time, I was promoted to Principal Specialist Inspector and was managing the Scotland OH specialist team. My asbestos role changed significantly in 1996 when the Asbestos Licensing Unit (ALU) moved to Edinburgh and I was given responsibility to provide “technical” support to the Unit and to Inspectors involved in licensed inspection work. In 1999, my

Shares in demolition and enabling works contractor, Clifford Devlin Limited, are now owned by its employees following an announcement that the London-based company has adopted the employee ownership model. One hundred per cent of the shares previously owned by the second generation of the family-owned business established (1962) by Peter Clifford and Alphonsus (“Foncie”) Devlin, have been transferred to an Employee Ownership Trust (EOT). An EOT is a special form of employee benefit trust introduced by the Government in September 2014 in an

First Agency Operative to gain NVQ through ARCA

ecently Dean Walker obtained a Level 2 NVQ Diploma, via the Experienced Candidate Assessment Route (ECAR), which involved undertaking a day with an ARCA assessor, who assessed his knowledge, understanding and practical skills across all the requirements within the Level 2 standard. “Dean has worked with us for a number of years and has considerable experience in asbestos removal, so I felt we could support him by putting him forward for an NVQ. He jumped at the opportunity,” commented Laura Perry, Director of PB Recruitment Consultants. “We contacted ARCA to arrange the assessment, and as a Labour Supply Member we were able to use our training credits to fund this NVQ.” PB Recruitment Consultants continue to support the Asbestos Labour Feedback App, ALFA.

ARCA supports Rhodar’s NVQ programme P
lanning is vital when you have a lot of operatives who need to gain an NVQ and CSCS card. You will probably have a lot of questions, like what is the best NVQ assessment route for the operatives, and how to arrange the assessments. When Rhodar started to review NVQs they called ARCA for support in planning and executing an extensive NVQ programme for their operatives and supervisors. The first step was to discuss the operatives and supervisors and their experience, so ARCA could match the right NVQ assessment route for each individual. Then, taking a few operatives at a time, they produced an assessment programme whereby the operatives could gain an NVQ in the shortest possible time. Planning where and when the assessments would take place,
making arrangements at venues and/or on site, with the assessor. For example, eight operatives were put forward for the Experienced Candidate Assessment Route (ECAR), which is a full day of assessments, and with ARCA undertaking the planning, the individuals completed their assessments in four days. ARCA has also assessed further operatives at the purpose-built assessment facility at Rhodar’s Leeds Training Centre, dedicated to facilitating ongoing NVQ classroom training and practical assessments.
“Having a large number of operatives and supervisors to put forward for an NVQ is a substantial task. However, the knowledge and support we have had from the team at ARCA has been brilliant, from them planning the assessments to the operatives and supervisors completing the process,” commented Bernard Brannan, Rhodar Technical Support Manager “We will continue to work closely with ARCA we are already on track to complete a lot more NVQs.”
