CSCS Cards, work is still progressing regarding finalising the exact requirements for CSCS cards for asbestos operatives. The background The position is that in March last year we were advised that the Construction Leadership Council had decided that card schemes carrying the CSCS logo would be the only cards specified by the industry, with no equivalents accepted. One of the requirements of card schemes carrying the CSCS logo was that the minimum standard for skilled occupations is an NVQ Level 2 qualification relevant to the occupation plus a separate health and safety element, for asbestos removal operatives the qualification is the Level 2 NVQ Diploma in Removal of Hazardous Waste (Construction) – Licensed Asbestos. Up until this point the RSPH Level 2 Certificate for Asbestos Removal Operatives had been an accepted qualification for obtaining a CSCS card. ARCA has been lobbying for continued acceptance of the RSPH qualification ever since the new requirements were made known to us. We have recently been advised by the Sector Skills Council that as the RSPH qualification relies on simulated evidence it could not be considered as equivalent to the NVQ as simulated evidence is expressly prohibited from the NVQ. However equivalent qualifications will be accepted if they map to the NVQ requirements. Please be advised that the current RSPH Level 2 Certificate for Asbestos Removal Operatives will currently still be accepted for the purposes of issuing a CSCS card but this route will close once the final decisions on qualifications has been made which is likely to be within the next few months. We have been advising all of our members undertaking the RSPH Level 2 Certificate for Asbestos Removal
Operatives since March 2015 that this will be the case.
Current position w The Level 2 NVQ Diploma in Removal of Hazardous Waste (Construction) – Licensed Asbestos is and will continue to be accepted for the purposes of issuing CSCS cards w The RSPH Level 2 Certificate for Asbestos Removal Operatives is currently still be accepted for the purposes of issuing a CSCS card but this route will more than likely close within the next few months.
Going forward w ARCA will continue to look at more cost effective ways for our members to meet the CSCS card qualification requirements, and there are still options which we are exploring. w A transition process needs to be put in place to bring all existing cardholders up to the minimum qualification requirement by 2020, therefore by 2020 all asbestos removal operatives holding a CSCS card must have a qualification which meets the new requirements. That means that all current holders of the RSPH Level 2 Certificate for Asbestos Removal Operatives will have to undergo additional assessment to meet the evidence requirements of the Level 2 NVQ Diploma in Removal of Hazardous Waste (Construction) – Licensed Asbestos. We have been advised that there may be funding available for this and are currently exploring the feasibility.
Current advice to members w If you need a qualification in the next few months to obtain a CSCS card then the only current guaranteed future proof route is to undertake the Level 2 NVQ Diploma in Removal of Hazardous Waste (Construction) – Licensed Asbestos. Significant grant funding is available for CITB levy payers. w For non CITB levy payers the cost of the NVQ is quite expensive and therefore if you are able to wait 3 months before embarking on a qualification we are quietly confident that we can produce a more cost effective route for you. We will keep you updated as and when there is any further news.

HSE have stated that confusion may have arisen as the Licensed Contractors Guide was due to be issued in the summer and it makes reference to airflow meters. Publication of the Licensed Contractors Guide has been delayed, however when published it will refer to the fact that as new technology becomes available contractors should consider it when hiring or purchasing new equipment.

Launch New Websites In June we were pleased to announce the launch of the newly designed ARCA and ATaC websites. The sites have been designed with a clean fresh look and user friendly navigation … and contain more content. The home pages now feature main imagery banners and five information areas, including ‘Find a Member’ prominent in the middle of the page.
The Training and Qualification pages have been designed to simplify the page format so making the new content easier to view and the locations/ dates tables are dynamically updated via the new CRM so you see the latest information. Visitors to the websites can find Members via search fields on the home page, as well as via the membership and contact sections. New sections include Support, where members can find guidance notes and information on the extensive range of services available from ARCA and ATaC.
Also for clients; property owners, facility managers, estate managers or construction managers; we have created a Clients section. Here clients can find information and guidance on their duties and legal responsibilities relating to asbestos management. We believe our new websites are excellent platforms from which to promote our members, and the additional content will increase the sites importance as a resource for advice relating to asbestos management.

New Portal for our members A
t the time of writing this piece we are in the process of developing a new Members Portal. Our plans are that once a member is logged into a private area the dashboard will highlight some management tools and member specific website traffic statistics. In this first stage of development a few processes are being redesigned with the aim of making things easier and more efficient. Our websites are regularly visited for potential clients to find asbestos removal contractors, surveyors and analysts, and are linked to via
numerous other websites. So for those members who want to increase prominence on member search result pages by upgrading their profile, currently 120+ upgrades displayed, there will be a new simple process. A new online form will have specific information sections so it is easier for our members to complete and submit … and the information will be displayed on newly designed webpages. Numerous members use the ARCA and ATaC websites to advertise job vacancies … it’s a very popular section on the websites. We know we need to update the submission system and the
way the adverts are displayed ... and that is what we are doing. The new submission form will have specific information sections to make it straightforward to complete, and the information will be displayed on the website so potential applicants can easily view. “Following this we have plans for developing further processes and to make more content available in the portal to support our members,” commented Sarah Haslam, Marketing Manager for ARCA and ATaC. “Our aim is to develop an excellent management tool for our members.”
New Customer Relationship Management system A RCA identified the need to update its software systems around 18 months ago, in order to ensure that company data and processes were effectively managed. The system in use at the time had served us well for 7 years but the business had changed, and software solutions had become more advanced. This meant that the whole system had to be rethought and a suitable software platform identified. After looking at several packages and talking to a range of development companies we decided upon Microsoft Dynamics CRM. The Microsoft solution had many advantages but mainly it integrated with our existing software and provided a familiar user interface for our staff. In addition, the online version is constantly updated and therefore the product is future proof and can develop along with our business. The Customer Relationship Management (CRM) system has been developed to manage our membership database, training course data and
site audit data. It also integrates with our website, providing members details, training course availability and other statistics to members via the members portal. One of the main aims of installing a new CRM system was to finally link the training and membership data to the accounts package. Previously they were not linked and therefore a manual process had to be used to request invoices to be raised and to record that the invoices had been paid on the training database. This has been achieved and as well as streamlining operations in this way, training course confirmations and joining instructions are now sent out automatically by email. These automated processes not only save time, but money as well, as far less communication is now sent out by post. For the first time the site audit information is integrated into our data management systems. All audit details can now be entered into the new system, as well as, audit results recorded and various communications produced. Again
invoicing of the site audits is automated between the CRM system and the accounting package. More importantly the system provides and overall view of the activities of the association an can produce a series of management reports to inform on performance. Members will benefit from the system as ARCA can now keep more contact records against each member company enabling us to target information to the right individuals within a member’s business. Additionally, email correspondence with customers is tracked and available to all ARCA staff members to view, which will allow them to see the history with the customer and respond more fully to members needs. Don’t forget to keep us informed of any contact changes for your business so that association communications are received by the right person and correct contact details are displayed on ARCA and ATaC websites.

ARCA Change Approach for
Site Audits I
n April this year, ARCA made some significant changes to the site audit form, with the objective of enabling Full Contracting Members to more effectively manage asbestos removal works, as well as updating in line with current good practice. The audit requirements have been arranged into specific sections that better reflect management principals rather than just asbestos related topics. The revised criteria are assembled under the headings of: w Observed Work Practices and Immediate Site Control: Asbestos Risks w Observed Work Practices and Immediate Site Control: Non-Asbestos Risks w Plan of Work w Measuring and Monitoring w Supporting Documentation
Also more emphasis has been put on several matters that ARCA considered were previously under addressed. One example regards risks on site - while we maintain the importance of risk assessments, greater emphasis has been placed on assessing how well site risks are being controlled. Other changes that strengthen the audit include recording management authorisations

to Plan of Work amendments (where required), increased emphasis on the implementation of air management principles, management involvement in monitoring progress and standards on site, and how arrangements in the Plan of Work convey how management has envisaged the work to be carried out. The new audit form does not comprise of a list of topic related questions, but sets out the ‘Standards’ that are expected. ARCA Membership Compliance Manager, Geoff Silver, commented that, “we haven’t made changes for the sake of change but for the sake of progress. In line with current regulations and good practice, we have set out the standards expected of the industry. We will then audit sites (including unannounced visits) to demonstrate compliance with these standards. Any identified nonconformances or opportunities for improvement are relayed back to the Licensed Asbestos Removal Contractor for management action, with required actions demonstrated and assessed at the next audit.”
The exhibition is attracting delegates from a variety of sectors, such as councils, universities, construction and property development, so will provide a platform for ARCA and ATaC to meet organisations with asbestos removal and management needs.

Workshops for Supervisors on analyst’s work ARCA increases availability due to high demand
D
ue to demand ARCA is pleased to announce the availability of further workshops, for asbestos removal supervisors, which focus on analyst’s work and the supervisors’ responsibilities. Half-day workshops have been scheduled throughout the rest of the year with the next workshops being at Burton on 13th July and Rayleigh on 25th July, morning and afternoon. ARCA created this workshop to support members’ supervisors and managers to gain a better understanding of their responsibilities relating to analyst’s work on an asbestos removal site. The half-day workshop, at £100 (exc vat), covers two specific topics, the 4 stage clearance process and personal monitoring. “The level of interest in this workshop has been very high, so we have arranged further workshops and I’m already discussing in-house workshops with some contractors,” commented Satish Patel, Training Manager for ARCA.
This workshop was just what my team needed. It will help our supervisors work closer with analysts, as it reemphasised the role of the supervisor and what the analysts personal monitoring findings actually mean. Trailblazer Apprenticeship
for Asbestos Analysts and Surveyors
Today employers are at the forefront of the development of apprenticeships and learning; creating people with workplace skills that are relevant to business and industry. The term ‘Trailblazer Apprenticeship’ is used when a group of employers work together to design new apprenticeship standards for occupations within their sectors. As a trade association ATaC is working as part of the Trailblazer Group to produce an apprenticeship scheme for asbestos analysts and surveyors. Who is this apprenticeship for? The Asbestos Analysts and Surveyors Apprenticeship scheme has been designed for any organisation thinking of recruiting new staff to conduct asbestos fibre counting and 4-stage re-occupation tests, bulk asbestos identification and surveying for asbestos containing materials.
What is the status of this new Trailblazer Apprenticeship scheme? The Trailblazer Group has created an industry standard, which has now been approved by the Department of Business Innovation and Skills (BIS). Following this, funding will be confirmed and the Trailblazer Group will produce an assessment plan for the apprenticeship scheme. The Government will be changing the way Apprenticeships are funded and in April 2017 an Apprenticeship Levy will be introduced for employers with a wage bill of >£3 Million. Due to these funding changes, the Trailblazer Group intends to have the apprenticeship scheme up and running in advance of the levy introduction date.
Will funding be available? At present, the funding cap for the Asbestos Analysts and Surveyors Trailblazer Apprenticeship scheme has not been allocated.

Institute for Apprenticeships The Institute for Apprenticeships (IfA) will be operational from April 2017, to support the delivery of a world-class apprenticeship programme for England, giving employers control and decision-making over content and quality of apprenticeship standards. The IfA will be employer-led; an independent chair will lead the work of a small board made up primarily of employers, business leaders and their representatives, to ensure employers continue to drive apprenticeship quality to the highest level. A shadow Chair will be appointed later this Spring, and the board members will be appointed through a public appointments process by the end of 2016.

wo companies have been fined after asbestos was disturbed during refurbishment work. Westminster Magistrates’ Court heard how two employees of 24-Hour Maintenance Services Limited disturbed asbestos insulating board (AIB) whilst they were doing refurbishment work at a former commercial premises undergoing conversion into flats, in Romford, London. An investigation by the Health and Safety Executive (HSE) into the incident which occurred between mid-July 2014 and 11 August 2014 found that the client had not passed on the details of the presence of asbestos to the contractor, despite prior knowledge. No refurbishment and demolition survey was conducted to determine the presence of asbestos on the site. The two workers stripped out the AIB without any effective precautions and therefore received significant exposure to asbestos fibres. Asbestos can be found in any building built before the year 2000. A refurbishment / demolition asbestos survey is required where the premises, or part of it, need upgrading, refurbishment or demolition. Firestone Estates Limited, of Tolpits Lane, Watford, Hertfordshire pleaded guilty to breaching Regulation 10(1)(b) of the Construction (Design and Management) Regulations 2007 and were fined £10,000 and were ordered to pay £1020.64 in costs with a £1,000 victim surcharge. 24-Hour Maintenance Services Limited, of Linton Avenue, Borehamwood, Hertfordshire pleaded guilty to breaching Section 2(1) of the Health and Safety at Work etc Act 1974 and were fined £5,000 with £974.44 in costs and a victim surcharge of £500.

gas engineer removed potentially dangerous asbestos material during a gas boiler replacement putting himself and others at risk from exposure to asbestos fibres. Brian Hockin, aged 58, was removing an old warm air heating system at a residential property on Williams Close, Wrafton when he disturbed a quantity of asbestos insulation board that surrounded the warm air boiler. The tenants of the property raised their concerns with Brian Hockin that he had disturbed asbestos but he continued to remove the material bagging it and removing it from the property and storing it at his yard. The tenants were so concerned that they contacted Health and Safety Executive (HSE) which prosecuted Brian Hockin at Barnstaple Magistrates’ court. During the hearing the court heard that Brian Hockin used no safety measures to prevent the spread of asbestos and that he used no protective clothing or protective breathing apparatus when he was removing the asbestos. Brian Hockin of Bickington, near Barnstaple, pleaded guilty of breaching Section 3(2) of the Health and Safety at Work etc Act 1974, and was fined £450 and ordered to pay £921.40 in costs.
HSE Inspector Simon Jones, speaking after the trial, said: “Brian Hockin’s negligence could result in serious health effects to both him and anyone else who may have come into contact with the asbestos material that he disturbed. “Given Mr Hockin’s vast experience as a gas engineer he should have realised that there is a very good chance that a 30 year old gas boiler could be insulated with asbestos insulation board but he made no checks before working around the material. He then compounded matters by ignoring concerns raised the tenants that the material that he had disturbed was asbestos and carried on removing the material. “Tradesmen should always be aware that asbestos can be found in any industrial or residential building built or refurbished before the year 2000. “Tradesmen should make enquiries as the presence of asbestos before starting work and if they suspect that they have come across asbestos during work they should stop work immediately and confirm what the material is and arrange for it to be dealt with by properly trained asbestos removers in a safe manner’

Roofer fined for safety failings
A
roofer based in Berkshire has been fined after disturbing and removing asbestos without a licence. Reading Magistrates’ Court heard Michael Wilkie was contracted by a householder to replace the covering of the flat roof of the garage adjoining their house, and subsequent remedial work. This included the installation of a drainpipe through the ceiling below. The ceiling comprised of asbestos insulation boards (AIB) which Wilkie cut a hole in for the pipe. He left the debris that contained asbestos in a waste bag for the householder to dispose of.

Troubleshooting Plans of Work ‘Planning’ is a subject causing considerable challenges for many licensed contractors and attracting frequent criticism from the Health and Safety Executive (HSE). This brief article is intended to help contractors critically review their own approach, but it may also be of interest to clients and others with an interest in assessing plans, and health and safety management. Regulation 7 of the Control of Asbestos Regulations requires employers to prepare a written plan before any asbestos work is carried out. Standard licence conditions require the production of a “suitable and sufficient” plan, prior to notification of work, and state that the plan must be followed on site. Licence conditions mean that written plans must be at the heart of licence holders’ safety management systems: plans should clearly show what senior management expects a site team to do. The quality of planning is likely to be a major focus of licence assessments and inspections. There is a problem when gaps open between actual practice and “paperwork”: asbestos removal is a practical job and it is a challenge to ensure that Plans of Work (PoW) are seen to help and guide the removal process. The key to closing this gap often lies in engaging relevant staff (particularly contract managers, supervisors and auditors) in the on-going development of the planning process.

Format and Quality The format of plans often reflects the prompts in an historic Asbestos Liaison Group (ALG) memo, which was used by many contractors as a ‘template’ (the current ALG memo on planning can be found online as referenced at the end of this article). Templates may be useful for those preparing the memo but are not necessarily helpful for those being asked to use the finished plan. Following one format cannot guarantee that a plan will be “suitable and sufficient”: for example, the required section on air management might have been completed, but the contents might be incorrect or difficult to follow; a sketch may be included but it does not reflect site reality etc. In addition, any one particular format is likely to suit some types of jobs more than others. Regardless of format, any reader should be able to quickly identify what the particular challenges are for this job and how management have decided these will be tackled. Where jobs are straightforward and simple, the plan should be. The main emphasis should always be on the quality of the information being given, not the format. Do reviews / audits focus on format or quality? Has the company format(s) been developed with input from those who need to use it? Can a list of quality criteria be developed (with input from users) to help determine good / bad plans?

Why use words?
The current ALG memo and Approved Codes of Practice list what should be considered as part of a plan. However, the immediate purpose of the plan is to clearly address significant risks associated with a particular project. Standard procedures, industry guidance, ‘standard’ training courses, generic assessments etc. deal with the common situations associated with removal work. For example they address:

A site-specific plan would refer to general procedures, but it would provide a very clear focus on, for example: w w w
The particular access equipment for THIS job What lifting aids are needed for THIS job Given the size / fixings of THESE panels, how many operatives will be working together on THAT platform in order to lift, shadow vac, spray and bag etc?
To improve clarity and usefulness, it makes sense to be careful about how generic / standard issues are presented in the plan. Non-specific, generic material will tend to make plans less user-friendly and less likely to be read. Generic information increases the chance of missing important, site-specific items. Are the particular challenges for this job obvious? Is the scope and sequence/phasing of work clear? Could visitors measure site conditions/progress against the plan?
Repeats Templates often encourage repetition. For example, a “Method of Work” section describes what will be done, where and how and then later sections in the plan on “Controls” and “Equipment” repeat much of the same information. Often the location and layout of transit routes, enclosures and airlocks are described in writing and then also shown in a sketch. Repetitions increase the chance of ‘cut and paste’ errors, increase length and complexity and therefore make plans less likely to be read. Could the format encourage repetition? Do POW reviews/audits check for consistency between sections?
Well-constructed sketches and photographs (marked with labels, arrows etc.), supported by flow charts showing the sequence of work and the precise methods expected, can usually be fitted onto a single / double sheet of A3. Could some written information be replaced by diagrams etc.?
Do reviews/audits identify good and bad examples of sketches, photographs etc.?
Who is the plan for? During licence assessments, HSE examines a contractor’s general approach to planning: licences are not granted unless the ALU and ALPI are confident licence conditions can be complied with. Between licence assessments, contractors may often encounter individual HSE inspectors demanding particular changes to plans. Inspectors provide invaluable input into particular controls for particular circumstances. However, if inspectors (or others) are insisting on changes to a contractor’s general approach to assessment and planning, then it would be advisable to discuss the issue with the ALPI (members can contact ARCA for advice in such situations). First and foremost, plans must work for the managers and supervisors etc. being asked to use them: they are central to an organisation’s management system and undue external influence may undermine this.
Are plans primarily produced for supervisors and contract managers, rather than clients / others?
How is it used? The real test of whether or not a plan is ‘suitable and sufficient’ lies with site teams and their managers. Do they find it useful? Could it be improved? If plans are criticised, the response should not be limited to re-writing that particular plan and / or sending staff on a training course; it is much more positive to involve all relevant staff in reconsidering the general approach to producing and using plans. What language? The choice of language is a good indicator of WHO the plan has been written for. The following examples are common: w ‘Access and egress will be via …’ w ‘H-Class vacs will be situated in the enclosure…’ w ‘Work will commence…’ Most people do not usually talk this way and this choice of language does not help to make a user-friendly document. More significantly, the choice of language encourages a perception that the plan is not really for the site team. Perception matters: if we want site teams to use plans, they must be produced in a style that is accessible for them. Are plans written in plain English?

on the Handling and Disposal of Asbestos Asbestos remains a common problem across UK commercial properties and contractors charged with removing it must ensure that every step of the process – from initial examination through to removal and disposal - is of the highest standard and compliant with current health and safety regulations. Paul Casey, regional general manager for Biffa’s Industrial and Commercial division outlines the key considerations when hiring an asbestos disposal service to ensure correct handling of asbestos waste material.
A
ny removed asbestos product or material that is ready for disposal, including contaminated building materials, personal protective equipment and damp rags used for cleaning, is defined as asbestos waste and is subject to strict labelling and transportation controls under the Control of Asbestos Regulations (CAR) 2012. The disposal of this asbestos waste requires specialist expertise to ensure its safe handling, labelling and transportation. Asbestos removal contractors should always ensure it is carried out by a fully compliant service provider who has access to licensed disposal points.
Where is it going? Finding the right supplier While it can be tempting to choose a supplier for a job based primarily on price, for asbestos waste, asbestos removal contractors cannot afford to focus on price only. It is important to ask enough questions about their expertise and credentials to ensure the job will be carried out correctly. Considerations include: w The size and scale of the job w The sector – is this asbestos waste coming from a regular commercial office building or is it from a more specialised / industrial facility that may require more expertise? w Will this be a one off job or a longer term project? w What type of asbestos is involved? Understanding the precise nature of the job in hand and how long it is likely to go on for will ensure asbestos removal contractors match their needs correctly to a supplier who can meet them and understand them fully.

Any vehicle that carries dangerous goods such as asbestos waste must comply with the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR) which sets out a range of vehicle and tank specifications and other operational requirements. In addition to ensuring that a vehicle is fully equipped, drivers carrying dangerous goods must have an ADR training certificate, with the exception of drivers carrying small loads and limited quantities. The approved training course to obtain the ADR certificate equips drivers with the knowledge and skills so that they are aware of the hazards, can take steps to reduce an incident occurring and know what to do if an incident ever does take place. Asbestos removal contractors should ensure suppliers’ drivers have this level of training and are fully aware of the hazards involved with transporting asbestos and are confident in what to do in the event of an incident.
Once asbestos waste has been collected it’s important to know where the asbestos waste disposal supplier is taking it. Do they have access to a network of licensed disposal units? Is the cargo going far? These are conversations that must be had from the outset to ensure that asbestos removal contractors have full sight of the entire process and know that the asbestos is being taken to a suitable place. The compliant removal and disposal of asbestos waste must always be a top priority for asbestos removal contractors and ensuring that their suppliers have the necessary training and equipment to deal with asbestos waste safely and effectively is key to avoiding potential incidents and dangers.

Health & Safety Enforcement
This article is intended as a quick guide on health and safety enforcement for contracting members and also for others involved in assessing health and safety performance, such as clients. Clients often place undue weight on formal enforcement, regardless of the reason it was served. Contractors often may not appreciate why the Health and Safety Executive (HSE) is taking enforcement action and what it means for the Asbestos Licensing Unit’s (ALU) perception of their management capabilities. For example, contractors often say: w “An Improvement Notice would have been more appropriate.” w “The prohibition should have been served on the Principal Contractor.” w “The prohibition should have been served on the supervisor and operative, not the company.”
Enforcement action of any kind is not necessarily an indicator of a general health and safety failure but should always provide a good opportunity for critical review. A company’s response to formal enforcement is often more useful as an indicator of the organisation’s culture and competence.
HSE “enforcement” and licensing The Health and Safety Executive’s role This article focuses on HSE, as it is the health and safety regulator for the majority of asbestos sites and all licensing decisions. HSE’s general aim is to ensure that duty holders manage and control the risks they create. HSE provides published information and verbal advice. Inspectors also enforce by: w w w w
Providing written information on legal breaches; Requiring improvements in risk management (e.g. Improvement Notices); Stopping certain activities (e.g. Prohibition Notices); and Bringing prosecutions where there has been a serious breach of law.
Enforcement enables HSE to tackle immediate risk and ensure anyone breaching the law is held to account, but it also promotes general legal compliance (it ‘sends a message’ to the wider community). HSE’s Policy Statement (referenced at the end of this article) describes the purpose and principles of enforcement. HSE action needs to be “proportionate”, “targeted” and “consistent”. The Enforcement Management Model (referenced at the end of this article) describes a process to help inspectors arrive at consistent enforcement decisions.
The implications of licensing As a licensed industry, asbestos removal contractors receive a high degree of oversight from the regulator: inspectors will write regarding failures to follow industry and management standards, in addition to legal breaches. Licence holders and clients tend to put much greater weight on notices than ALU. Formal notices do receive ALU attention, but licence action is typically associated with a “pattern of poor performance” or suggestions of “ineffective management arrangements”; formal enforcement notices do not necessarily demonstrate this. ALU’s main concern is likely to be the overall effectiveness of an organisation’s management arrangements: written exchanges or inspection reports are the typical sources of evidence.

The PN must (a) state the inspector’s opinion that there’s a risk of serious injury and (b) specify what s/he thinks is creating that risk. The activity must stop until the issues giving rise to the inspector’s opinion have been addressed.
Improvement Notice Improvement Notices (INs) are served when, in an inspector’s opinion, there is a breach of law that is likely to continue or be repeated. An IN must explain the reason for inspector’s opinion and the legal breach involved. An IN requires the issue to be put right and specifies a compliance deadline (at least 21 days). Inspectors will usually attach a “Schedule” to the notice, proposing how the issue can be put right. INs address issues such as: w w w
failures to adequately maintain equipment failures to adequately train / supervise / monitor staff failure to have effective arrangements in place for planning / assessing work
When notices are served, recipients should always be given information about how to appeal. INs are suspended until the appeal is heard; prohibition notices are not. Where notices are not complied with, there will normally be a prosecution. PNs deal with immediate risk. An IN is more likely to be an indicator of a more general management / health and safety competence problem. From a licensing perspective, an IN is therefore more likely to dent ALU’s confidence in any particular organisation’s management arrangements.
Sample Situations – formal enforcement notice The following examples of “correctly served” notices raise many questions, but in most cases meaningful judgements about wider management systems can’t be made unless (a) the precise details are investigated further and (b) the company reaction is considered. Was the enforcement met with denial or grudging acceptance, or did it lead to self-examination and review?

Case 2 does not suggest any management failing: using this notice to draw conclusions about health and safety performance would be inappropriate. In Case 1, it is possible that the principal contractor had commissioned a structural engineer prior to any work taking place and that management felt there was no risk: the ‘fault’ would be the ‘failure’ to reference this structural report in the asbestos removal contractor’s documentation, or to be able to access it on request. Case 3 provides the most obvious cause for concern: RPE is the last line of defence for operatives and effective management arrangements should ensure RPE is fit for purpose. Does this breach indicate problems with other management arrangements? A company with a healthy management system might carry out an in depth review of general performance, in addition to complying with this particular notice. The outcome could be a much improved company culture.
Conclusions Licence holders are likely to receive many more enforcement authority inspections than non-licence holders; the number of inspections increases again for asbestos removal contractors who are notifying a very large number of projects. Any kind of enforcement intervention is an excellent source of information: in the highly regulated asbestos industry emails, letters, telephone calls should routinely prompt a review to look for any wider lessons that can be learned. In all cases, the implications of a notice or any other intervention can only be recognised if the details are fully investigated and questioned for underlying causes. For a client, formal enforcement action should be a way “in” to evaluating a contractor’s health and safety management rather than an automatic barrier; a sophisticated client will weigh up the significance of any particular formal enforcement action by examining the incident itself and an asbestos removal contractor’s response to it. Caveat venditor (Seller beware!) D
elivering good quality service on budget and on time should help ensure you remain on good terms with your clients. But it is not always enough and unfortunately unhappy clients can cause problems. Cynics may suggest there is nothing you can do about the eternally discontented, while optimists will say a few simple checks might help you identify the job that will go bad.
1 Does the work fit with your strategy? Euphoria and competitive spirit arising from being ‘in the game’ can cloud an honest evaluation of why you have been selected to bid. This may prevent a reasoned bid/no- bid process being undertaken, resulting in winning work that does not fit with your strategy for a myriad of reasons. As a minimum, you should have a basic process in place to establish whether a tender is worth competing for.
2 Does your organisation have the expertise and resources to do the work accurately and on time? You must always ask this question, whether taking on a new contract in an area in which you have long-standing expertise or diversifying into a new line of work. Irrespective of expertise, an overstretched team is far more likely to make a mistake than one with a manageable workload. You should consider long-term resource levels and their impact on your ability to continuously deliver against a service level agreement. You might be able to service the

contract now, but will that still be the case in a year’s time? If not, how do you intend to fill the resource gap and can you afford to?
3 What percentage of your overall income will the client account for?
Over-reliance on one contract or one client is a high-risk strategy. Aside from the financial downside of losing a customer who accounts for a high proportion of income, over-dependence on one client can have an adverse impact on your ability to negotiate either payment or contractual terms.
4 Is the work profitable? Increasing competition puts many businesses under greater pressure to reduce their fee. Before doing so, ask yourself if you are pricing the job at a level that reflects the resources and expertise required and takes account of the associated risks whilst leaving you with some margin? If you are intending to run the project as a loss leader, establish at the outset the strategy you are going to deploy to convert related opportunities into profitable income.
5 Is the work high risk? Sophisticated firms will put prospects through a due diligence process. This involves gathering intelligence on everything from financial stability and corporate structure to history of litigation and typical payment terms in addition to informal conversations with peer group and professional advisers.
6 Should you notify your insurance brokers and what will the impact be on PI Insurance?
You should always talk to your insurance broker before accepting an unusual instruction, for example, undertaking a category of work. They should be able to advise on the suitability of existing insurance cover, confirm any additional insurance costs and, if required, notify your insurer.
7 Is there a conflict? The purpose of a conflict check is to identify anything that prevents, or could be perceived to prevent, an individual’s or a firm’s ability to act impartially and in the best interests of a client. To carry the checks out effectively, the quality and efficacy of your client relationship management system and processes are critical, particularly in larger firms.
8 Do you know who you are working with? Undertake due diligence on sub-contractors and other contractors. Working with or for disreputable firms or those who produce poor quality work will significantly increase the likelihood of a subsequent allegation of negligence. This should include: w an assessment of their financial standing – this should help to reduce the likelihood of finding yourself in the position of ‘last man standing’ in the event of a claim or, at worst, uninsurable.

9 Do you understand the contractual terms? Read and understand the contract and, if necessary, seek clarification from your insurance broker or solicitor. Pay particular attention to the liabilities you are required to cover and ensure you appreciate the commercial impact of any uninsured exposures. For example, does the contract require cover for ‘all losses, costs, damages or expenses incurred’ – no insurance policy will provide all this. If you are operating under a service level agreement, pay heed to the penalties that apply should you fail to perform to the standard required. Penalties are uninsurable.
10 Do you understand what the client wants and do they understand what you are delivering?
Although this is clearly important on complex instructions, it is equally important when working for members of the public who are unlikely to have an in-depth understanding of technical terminology or appreciate the physical restrictions that
might come into play when undertaking certain instructions, for example, a building survey: “No, sir, we don’t remove cladding to inspect the structure behind.” Manage clients’ expectations from the outset: w do not agree to timelines you cannot meet. w do not promise to deliver the undeliverable to win the business. w if demands are unreasonable, explain your concerns in writing and keep records of all communications. w ensure that uncertainty surrounding the service you are providing is resolved before you start work.

and fit for purpose? Have you sent a letter of engagement outlining the scope of services? Serious consideration should be given to the negotiation of exclusions, limitations of liability and restrictions on the classes of person entitled to claim. Bear in mind that not all exclusions will be effective in law so, if possible, consult a legal adviser at drafting stage. What will and will not be held to be effective will be dependent on a number of factors including: w the identity of the parties w the nature of the transaction w the availability of insurance cover w the reasonableness of the exclusion.
12 Your organisation has won the tender, but why?
The euphoria of winning a new instruction can cloud your judgement about what represents a good opportunity. Before starting work, try and understand why your firm has been selected. You may think it is all about the quality of your business, but an honest appraisal might show the reason why you have been selected is because yours was the cheapest tender or yours is the only firm willing to agree to the contractual terms. Equipped with this insight, you can make an informed decision about whether you are willing to bear the risk and the steps you can take to mitigate it. Know who you are working for. Deliver the product that meets the client’s requirements. Provide great customer service. If you can get all three right and you still get a negligence allegation, then it is time to join the cynics.

Lucion introduces
Radon Risk Management Service
L
ucion Services has expanded its range of workplace and environmental safety services with the introduction of radon gas risk management to help employers meet their safety responsibilities. Under the new service, Lucion will provide an initial risk assessment to identify those areas where radon measurement devices should be installed and develop a schedule to establish the priorities and programming for testing. In situ monitoring will be carried out in designated locations over a three month period to allow for variations in levels of any gas detected. After this period the test results will be assessed and any necessary remediation works determined, depending on the gas levels found. Radon is a naturally occurring colourless, odourless, radioactive gas formed by the decay of the small amounts of uranium that occur naturally in all rocks and soils. It is present in all parts of the UK, although concentrations vary depending on the local geology. To protect employees against this risk, the Ionising Radiation Regulations 1999 apply to workplaces where radon is present. Employers
are legally required to assess the risks to the health and safety of their employees and in the case of radon gas are required to take appropriate action to restrict exposure when its presence is above defined levels. The average radon gas level in UK homes is 20 Bq m-3. For levels below 100 Bq m-3, the individual risk remains relatively low and is not a cause for concern. However, the risk grows as the radon level increases and at levels above 400 Bq m-3 employers are required to take remedial action. Increased exposure to radon increases the risk of lung cancer and, as the single largest source of radiation exposure to the UK population, it is responsible for an estimated 1,100 lung cancer deaths each year. Since introducing the new service, Lucion has already secured work to assist local authorities with radon gas monitoring in a range of council buildings and assets, including local schools. www.lucionservices.com

With over ten years in the industry, Matt brings a wealth of consultancy experience to AEC, with relevant expertise in asbestos monitoring, surveying & assessment, and project management, including managing the asbestos for the MoD, often in complex and challenging environments. with ARCA ILM Candidate In May I caught up with Chris Dobson as he started his penultimate unit towards gaining the ARCA ILM Leadership and Management qualification.
Q
What is your background and current role?
I have a MSc in Environment and Health & Safety, and have been with Thompsons of Prudhoe for nearly 14 years as their Health, Safety and Quality Manager. I cover H&S management across the business which includes demolition, asbestos removal, earthworks and site clearance & reclamation, across a range of industries, such as nuclear, petrochemical and industrial.
Q
Why did you choose to undertaken the ARCA ILM qualification?
I was looking for a further management qualification, as I have a level 4 certificate in asbestos removal for contract managers, and heard about the ILM qualification at an ARCA regional meeting. I thought this would be ideal as it is tailored to the specialist asbestos industry. Also it is a route to membership of ARMI (Asbestos Removal Management Institute) which I am keen to join. I’m already a chartered member of IOSH and a chartered member of the Institute of Demolition Engineers.
Q
What is the view of your employer?
The company is very supportive of staff development, in fact, they see my ILM studying as a ‘pilot,’ as there are other senior managers who could undertake this qualification with ARCA and become ARMI members too. ARMI membership is very relevant to Thompson of Prudhoe, as the company is a member of both ARCA and NFDC (National Federation of Demolition Contractors) which are two of the three Associations which form ARMI.
Q
What are your thoughts on the ARCA ILM qualification content?
I think ARCA has put together four excellent unit topics. They complement each other and are well structured, with each unit’s assignment relating to the industry. Everything learnt so far has been very relevant and on occasion I’ve found myself referring to my notes.
Q
Is there any advice you could give to those just starting the ILM qualification?
When I started the ILM qualification it took some time to get back into academic work! For the two units I’ve already completed I undertook the assignment straight after the classroom sessions, as you do need to keep momentum. Initially I found one element of the assignments particularly tricky, that was, meeting the word count – I seemed to be able to write too much! My aim is to complete this third unit, communications management, as soon as possible, as I then hope to be able to complete the final unit and gain the qualification before the end of the year.
Q
Would you recommend this qualification?
Yes, I would. As managers we need to continually develop our skills to be the most effective managers we can be. So for existing managers, and those new to the role and industry, I would recommend undertaking this qualification, as there is always something new to learn.

Operative training course supports administration staff I
t is unusual to see a female undertake an asbestos removal operative training course, yet recently two females attended the course at ARCA. Even though their roles are in operational administration, these ladies wanted to understand more about asbestos removal on-site and the operative’s duties, to help them in their roles at Colt Industrial Services Ltd.
After the training course Keira Finnerty commented, “I’ve been working for Colt Industrial for almost 17 years supporting our contract managers and assisting with the documentation required for a licensed asbestos removal project. My colleague and I undertook two of the three days to obtain an overview of the asbestos removal process through theoretical and practical training.”
“This ARCA course was a real eye opener for me as I’m new to the industry, I joined Colt Industrial eight months ago and got promoted to the asbestos division of the company this week,” said Hollie Clarkson. “By taking this course I’ve learnt things that I wouldn’t have been able to in the office and I understand what our operatives actually have to do on-site. It has also highlighted the importance of my role in supporting our on-site teams with tasks such as training needs analysis.” “The trainer, and also all the other candidates, were very welcoming and supportive throughout the course. I never thought I would be building an airlock in my first week of work!” The ARCA trainer, Shaun Wilson, commented, “It’s great that member companies also consider the training needs of their administration staff, as they have an important role to play in the health and safety of the teams on-site.”

would like to introduce you to the ARCA training administration team which has seen some recent changes. Our newest team member is Adam Brown, who joined us in May having worked for Derby College. With a background in Higher Education administration Adam has the ideal skill set to manage bookings for our courses and will manage Oxford, Glasgow and Dublin centres. Adam joins Arlene Hannah, Isabelle Waldron and Nicola Edwards who make up the training administration team. Arlene has been with ARCA since 2001 as one of the first administration team members and today manages all activities at the Rayleigh centre. She has seen many changes as then ARCA provided four training courses and today we administer over 24 courses and qualifications. Isabelle started work at ARCA in 2014 to support the membership department and a year later joined the training admin team to take over from a colleague who retired. Isabelleâ&#x20AC;&#x2122;s previous
experience of handling customers enquiries has helped her manage all activities at the Burton and Manchester centres. Nicola Edwards, who joined the team September 2015, focuses on managing the administration of our qualifications with the Institute of Leadership and Management (ILM) and National Vocational Qualifications with the National Accredited Specialists Centre (NSAC). Over the last few years we have seen a lot of change with the number of courses and qualifications we offer to support our membersâ&#x20AC;&#x2122; requirements. This means our team is kept busy managing and supporting over 4,500 candidates a year. Whether you need to arrange an assessment or need advice on training, we are always here to help.
