t was encouraging to see a record number of attendees at the Association’s 31st Annual General Meeting (AGM), on the 7th October 2016 at the London Zoo Conference Centre. Almost 200 members and their guests heard what the Association has achieved over the past year, and also heard from Archie Mitchell, Head of the HSE Asbestos Licensing Unit, on the HSE’s expectations of asbestos licence holders. This was followed by an excellent luncheon and an entertaining after dinner speech from Paul Merson, former Arsenal, Aston Villa and England footballer. It would be great to see all those who attended this year’s AGM join us again next year. The 2017 AGM will be held on the 6th October and at a new venue, the Lords Cricket Ground, which is just a stone’s throw from London Zoo. ARCA has developed and piloted the EWPA (Experienced Worker Practical Assessment) route to a Level 2 NVQ for operatives. It is now undergoing the final industry consultation and we now hope to have this route to NVQ available by year end. In addition the first draft of the RSPH NVQ Level 2 qualification has been produced and this should be available from early next year. The RSPH Level 4 Certificate in Asbestos Laboratory / Project Management is also ready to be launched. We are still waiting for UKAS to approve the qualification. Despite discussions at the February UKAS TAC meeting we now understand it has been referred to an internal UKAS committee in December for further discussion. It is disappointing that the UKAS approval process is taking such an unnecessarily long time. ARCA is currently finalising the processes and procedures for the revised ARCA Site Audit Scheme. The main change included in the revised scheme is that the audits will now be
unannounced. This means ARCA members will no longer need to notify ARCA of sites to be audited, and ARCA will select member’s sites to audit from the ASB 5 data supplied on a weekly basis by the HSE. We are still intending to carry out two audits per member next year. The ARCA Charity Week took place between the 24th and 28th of October with a number of members organising events and raising money for Mesothelioma UK and the Indee Rose Trust. The total raised has not been finalised yet but it will be in excess of £21,000 which represents a great effort on everyone’s behalf. Please see pages 28-31 We hope that next year’s Charity Week will be even bigger and better with more members taking part. In October ARCA exhibited at Contamination Expo at Excel in London. This was the first time this exhibition had been run and for ARCA it was a great success. There were numerous visitors to the Association’s stand including clients, members and prospective members. ARCA was able to promote members and training courses, as well as distribute literature, such as the ARCA News and the guidance note for clients. As a result ARCA has booked to attend next year’s event which is scheduled for the 11th and 12th of October 2017, again at Excel London. Finally, I would like to wish all ARCA and ATaC members a very Merry Christmas and a Happy New Year.

Member Portal Developments
A
nother stage of development is now complete! A resources section is available where members can currently find information and forms for booking ARCA audits and for CHAS registration via ARCA / ATaC. Also, in this private members’ portal there is now a training section with information available on a member’s bookings and candidates’ details … information at your fingertips! This means that on a training booking page a member can view all the ARCA / ATaC training courses and qualifications they have booked (when and where) and the names of the candidates on that specific booking. The candidates page displays all the member’s candidates’ training/qualification history with scores. Hopefully this will be an invaluable tool to our members.

RCA is a Trade Association Member of Build UK and now takes a full role in the Build UK Trade Association Forum. The following is a summary of the recent Build UK Trade Association Forum meeting. l Build UK’s priority is encouraging more clients to sign the Construction Supply Chain Payment Charter. The Small Business Minister, Margot James, had confirmed that all central Government Departments were committed to paying 80% of invoices in 5 days and the remainder within 30 days. Furthermore, 30 day payment terms would go down the entire supply chain for all public sector work. Build UK is currently confirming a list of exactly which government clients this would cover. Positive discussions were also being held with private sector clients on payment terms. Once there was further clarification, Build UK would return to Main Contractor members to further promote the Charter. Build UK Contractor Members who have signed the Charter, and Trade Association Members who are supporting the Charter, are named on the Build UK website. l The Safety Helmet Colours Standard had been published and received a great response from across the industry. Following its publication, Highways England contacted Build UK and formally adopted the standard.
l The Build UK Training Standard, launched in May, had been well received by members. Following its publication, a number of new schemes had attained the CSCS logo and now met the requirements of the Build UK standard.
Build UK Update A member Task Group would meet before the end of the year to discuss any issues that had arisen following the publication of the Standard. The Trade Association Forum agreed a proposal setting out the principles of a reformed pre-qualification system. The aim of the proposal was to develop a recognised industry pre-qualification process that provided assurance to clients that the supply chain on their construction projects was competent, thereby releasing valuable resources to improve productivity and output. The main features of the new system would be: w Two levels of accreditation – core and enhanced w An agreed industry question set w A central source of information This would result in a streamlined system that meant companies would only have to be accredited by a single provider on an annual basis. Build UK would continue working with members over the coming months to finalise
the details of the reformed system. Members expressed substantial concerns about CITB’s performance and agreed CITB had to start delivering clear outputs if it was to retain industry support during next year’s consensus process. While there remained support for the principle of an Industry Training Board, CITB had to present a clear strategy which was validated and supported by industry, and put against a timeline and delivery plan. The meeting mandated Build UK to set-out a stronger message in discussions with CITB and to clearly set out the industry’s expectations. l Members identified industry priorities for the Brexit negotiations and asked Build UK to play a role in maintaining market confidence by encouraging public and private sector clients to push ahead with projects. Build UK was working closely with the CBI, and was part of the construction sector group being led by Sir John Armitt which was developing an industry position to inform the Brexit negotiations.

ARCA presents Service to the Industry Awards at AGM 2016
A
t the ARCA Annual General Meeting 2016 the ARCA Chairman, Grant Beglan, presented two Service to the Industry Awards. Before presenting the awards Grant Beglan commented, “I am delighted to present these special awards to two people who have had a long and dedicated service to the Association, including being past chairmen and supporting a number of initiatives to improve standards within the industry. It has been a pleasure working with them and I look forward to working with them in the future.� An award was presented to Tony Darsey, Managing Director of Erith Contractors Ltd, for his continual support to the Association; as a Governing Council member and also for serving two terms as ARCA Chairman and currently chairing the Training Committee. His continual drive has supported the Association in its delivery of exceptional training courses and qualifications. A Service to the Industry Award was also presented to Jason Davy, Managing Director of Rhodar Ltd, who, as a Governing Council member, played a leading role in introducing the ARCA site audit accreditation scheme with the aim of raising standards. With his commitment to keeping asbestos removal standards within the Association high, he has supported moving the scheme to unannounced audits, which will be in place for 2017.

ARCA announce winners of Gold Site Audit Award 2016 A
t the Association’s AGM in October, ARCA announced the twenty-three member companies who achieved a Gold Site Audit Award for 2016. To achieve this award, Full Contracting Members needed to fulfil the requirement to undertake two site audits per year within their allocated quarters during the 3 year qualifying period ending 30th June 2016. Also, over all 6 site audits the results, assessed against a standardised marking scheme, needed to be within Grades A-C, with an average of at least a Grade B. The award has been designed to acknowledge consistent performance, demonstrated over a sustained time period. Of the twenty-three companies achieving the award, fourteen have retained the award from 2015, with nine companies being newcomers. “Congratulations to all the award winners,” said ARCA Membership Compliance Manager,
Geoff Silver. “This acknowledges the work that has been put into their participation in the ARCA Site Audit Accreditation Scheme” “2016 marks the fifth year of the Gold Site Audit Award, and there has been a marked improvement in audit results over that time. This improvement has come despite more stringent audit criteria and a toughening up of the marking scheme.” Additional site audits, further to the two per year required under the Scheme, can also be arranged through ARCA. These audits are conducted by approved ARCA auditors to the same standards as the SAAS audits, and allow for direct comparisons to be made across all audits. ARCA hosts Japanese delegation O
n Friday, 25th November 2016, Steve Sadley and Satish Patel had the honour and privilege to receive a Japanese delegation. The delegation included members of the Asbestos Surveyors Association (ASA) Japan, an occupational health consultant, journalists who write on environmental issues, a researcher and their translator who works for an analyst laboratory in Japan. The meeting started with a technical discussion, aimed at expanding ideas on asbestos removal practices and the skills required by asbestos removal workers in the UK. The delegates had visited the HSL research labs in Buxton the day before and were keen to see in practice the ventilation of enclosures and how this can be used as a control measure. The delegation toured the training facilities

at Burton and were impressed with the provision allocated to deliver quality training. In particular, the approach of using water based showers in DCUs as opposed to air showers, which are used in Japan. The entire team went away with a good
understanding of the standards within the UK’s asbestos removal industry and how ARCA supports its members. Following this visit Aspect Contracts arranged for the delegation to visit asbestos removal sites.

Unannounced Audits from January 2017 T
he ARCA Site Audit Accreditation Scheme (SAAS) is designed to support members’ business performance by providing confirmation of compliance or identification of areas for improvement, therefore being a means of measurement and reassurance. Following a pilot of unannounced site audits in 2016, ARCA sites audits will all be unannounced from January 2017 (excluding Ireland). This will mean that ARCA will arrange all audits, so contractors will have no knowledge of when or where an audit will take place. While the

Specialist Interest Group
I
n order to provide a better link between ARCA Associate Members, who manufacture plant and equipment and/or test plant and equipment for the asbestos industry, the Association is establishing a new specialist interest group for this sector. Earlier in the year ARCA sought ‘expressions of interest’ for a specialist group from equipment manufacturing / testing Associate Members, and invited them to register interest. The response to this request was excellent with many expressions of interest.

unannounced element of site audits will be a new concept for some contractors to get used to, numerous ARCA members have long applied the principle of not informing site teams of an impending audit, as part of their own management strategy. Their view is to expect a visit on any site, at any time, and be prepared to demonstrate the manner in which the job has been planned, and the plan implemented. Site visits could be from an auditor, an inspector, or a well-informed client. The main objective of the group is to give a voice to this industry sector and to give representation to ARCA members, customers and regulators. In addition, the group would be in a position to produce standards for equipment manufacture and use, and provide a forum for interaction between asbestos removal contractors and asbestos plant manufacturing / testing companies. The ultimate goal is to bring the plant manufacturing / testing companies closer to their customers, and to provide ARCA members with better information regarding best practice in the selection / use of plant equipment and testing providers. Regular meetings will be held to facilitate this. The outcomes from these meetings, and any work that this specialist interest group undertake, will be communicated to all members as and when appropriate. It is hoped that in future a regular update on the progress of this group can be reported through ARCA News and via the ARCA regional meetings.

ATaC National T Training Award Winner
he ATaC National Training Award 2015/2016 was presented to Riverside Environmental Ltd as they achieved the highest number of candidate passes on ATaC delivered RSPH qualifications. Jonathan Francis, Managing Director of Riverside Environmental Ltd, received the award from Stephen Platkiw, ATaC Manager, at the ARCA Annual General Meeting in October.

ast month ATaC exhibited and delivered a seminar at the Lucion Conference, Asbestos The Truth, in Birmingham. Numerous delegates, from construction, councils and housing, came to talk to ATaC staff about the Association, guidance and the Ofqual regulated RSPH qualifications available. The ATaC seminar on ‘Communications between all Parties’ was presented by Stephen Platkiw, the ATaC Manager. “Good communciation and cooperation between all parties is a must for a project to
be successful,” commented Stephen. “The law requires clients to make suitable arrangements for managing a project, and maintaining and reviewing these arrangements throughout the project, so work is carried out in a way that manages the health and safety risks. Therefore I looked at the roles of the client, analyst and asbetsos removal contractor, in relation to effective communications to ensure the repsonsibilities of all parties are met.” “I was delighted to see so many delegates attend and for the interesting questions asked.”

Both Association’s exhibited in the hazardous material section of the expo and delivered seminars, highlighting the responsibilities of all parties in asbestos management and removal, including the legal duties of the end-clients. “We are very pleased with the results following attending the first Contamination Expo,” commented Steve Sadley, Chief Executive of ARCA. “We had a successful event meeting both members and potential members, and talking to end-clients from different sectors.” “On the stands we showcased our members and highlighted the legal responsibilities of all parties in asbestos management and removal, including the end-clients. Both seminars were well attended enabling us to continue communicating the hazards of asbestos and how to manage asbestos containing materials safely.”

T
his year’s guest speaker was Archie Mitchell, Head of the HSE Asbestos Licensing Unit (ALU), who spoke about HSE’s expectations of asbestos licence holders, HSE’s views on Training Needs Analysis (TNA) and some current topics. Archie gave an informative presentation and outlined the context of the permissioning regime which dictates how the asbestos licensing regime is operated. He explained that the asbestos licensing regime existed to provide reassurance, ultimately to the public via parliament and Government ministers, that this high hazard work was being carried out safely.
Archie focussed on the need for HSE to be reassured that asbestos licence holders had effective management processes in place to ensure that asbestos work was carried out safely, and that asbestos licence holders could provide evidence of this to HSE. Also, communication between the regulator and the asbestos licence holder is crucial, for example, HSE needs to know of any changes to their company which significantly alter the type of business described to HSE at licence assessment visit. These could be the company growing in size, key staff leaving the business or the type of work undertaken changing considerably. Archie described this as the horse that is seen in the paddock (the company seen at licence assessment visit) not being the horse that is seen on the racecourse (the company which is seen during HSE inspections of licensed asbestos work). HSE needs to be informed of changes in order to reassure themselves that the company still has effective arrangements in place to continue to remove asbestos safely.

Following Archie’s presentation, the Chairman introduced the Association’s Chief Executive, ARCA staff Members and Committee Chairmen to report on the activities of the Association over the past 12 months and to outline the Association’s plans for the future. Members at the AGM heard that a lot of development work had been undertaken during the last 12 months. An alternative route to NVQ for operatives was nearing completion, known as an EWPA (Experienced Worker Practical Assessment) route. This will be a route for experienced workers with relevant experience in asbestos removal and will take the form of an assessment, which will consist of an intense assessment regime carried out at an assessment centre. An operative’s NVQ was being developed with RSPH to provide a choice of awarding bodies for this qualification. This will be a more cost effective way for member’s staff to achieve this qualification if they are not eligible for CITB
grants as a result of not paying the CITB levy. ATaC reported that they have delivered on their statement at last year AGM to develop an alternative qualification to the BOHS W504 and oral, the CoCA qualification. This will be the RSPH Level 4 Certificate in Asbestos Laboratory / Project Management. Verbal confirmation has been received from UKAS that this will be accepted as equivalent to the BOHS W504 and we are now awaiting written confirmation before launching. Members also heard that ARCA were working with ACAD and the NFDC, through ARMI, and alongside Build UK and CSCS to put in place a CSCS card scheme for the industry in line with the Construction Leadership Council’s remit to Build UK. Members were informed of the increased marketing activity undertaken this year including; new websites for ARCA and ATaC, member portals, news articles submitted to client focussed industry publications, ARCA and ATaC exhibiting at Contamination Expo, the
Association’s first Charity Week and the member visits which had been undertaken this year. This was a record year for member attendance and following the presentations the members enjoyed a 3-course silver service lunch in the Prince Albert Room at London Zoo.
2017 will see the ARCA AGM being held, for the first time, at the Lords Cricket Ground, London. As always the AGM will be held on the first Friday of October, so please put 6th October 2017 in your diary.

Head of HSE Asbestos Licensing Unit presents at ARCA AGM Archie Mitchell, Head of HSE Asbestos Licensing Unit, spoke to ARCA Members at the Association’s Annual General Meeting in London on 7th October 2016.
What does HSE expect of Asbestos Licence Holders?
A
rchie Mitchell has now been head of the HSE Asbestos Licensing Unit for three years. A significant period, as every current asbestos licence will now have been approved during Archie’s term in post. Archie has worked for the HSE for about 20 years and prior to that he had a quality assurance background. Therefore, getting things right systematically is the way he likes to work. Archie was asked to give a presentation at the ARCA AGM on what HSE expect of asbestos licence holders, Training Needs Analysis and a little about current topics. This article focuses on ‘what HSE expect of asbestos licence holders’.
Permissioning regimes Archie explained that HSE is driven by law, the law is controlled by parliament and the ministers, and ultimately they are answerable to the general public in the outside world. Asbestos removal contractors are very visible to the outside world and seeing asbestos removal operatives coming out of an enclosure and transiting in RPE and PPE concerns constituents. What HSE expects of asbestos licence holders is driven by what the wider world wants and this is driven through legislation. Ultimately Archie is responsible to parliament and Government ministers. Archie stated that HSE’s usual role as a regulator involved visiting workplaces and looking at the operations at that moment in time. In the case of asbestos licensing it is different as HSE is trying to predict the future. HSE

is having to come to a decision, that for the next period of time, up to 3 years, can HSE be assured that the individuals seen at the licence assessment visit will be capable of running a company that will handle asbestos very safely every time, and that is an enormous expectation. Archie referred to this decision as a ‘bet’ or a ‘punt’. In order to be confident about this ‘bet’ or ‘punt’ HSE are looking for legal compliance from licence holders along with control of risk. In addition, public reassurance is also required as asbestos licensing is a permissioning regime. It should be remembered that asbestos removal is classed alongside nuclear regimes and petro chemical plants, and if these operations are not carried out safely, it’s serious, and that sets the context for how HSE deal with these hazardous industries.
Evidence ‘Evidence’ is where HSE sees the biggest gulf in understanding with regards to asbestos licence holders. HSE are looking for the control of risk. Somehow licence holders have to show evidence of this to HSE, and that can be difficult. HSE need to see the evidence that licence holders are controlling risk, as if something goes wrong MPs, ministers and constituents will be saying ‘why on earth, Archie Mitchell, did you sign your name on the bottom of the licence’. Archie needs to be able to say, here is the evidence on which we based our decision, it seemed like a good ‘bet’ at the time. Clearly HSE are looking for ‘good
management’, although a balance has to be reached as to what management is adequate. A company that is maintaining equipment used on licensed asbestos work (NPU’s etc.) will normally have one controlled environment next to their offices in which the same type of work is carried out day in day out, using a relatively fixed plan of work. The management arrangements, and the management and supervision of the staff, is going to be comparatively simple. If however, all of your equipment needs to be loaded into a container 3 weeks prior to the job starting, and this needs to be put on a ship and later to be offloaded onto an offshore rig, planning, management and organisation is a whole different ball game. Because, if you forget something it will not be delivered quickly. Archie explained that management in the construction industry, in general, is quite an amazing thing. It is a can do industry and there are shifting sands all the time. HSE is looking for systems to be controlled and managed, so that in those shifting sands situations, asbestos removal is carried out safely.
Auditing The degree of control and management required is very difficult to achieve, but HSE is looking to see evidence that it is happening. So when HSE talk about auditing, they mean systems of reassurance. That is, what is it that you do to check and monitor that there is good management and risk control, and how do you check that is happening? To put it another way, how do you check and monitor, and reassure yourself that you are systematic and you are giving yourself the biggest chance ever of being right most of the time. 100% right all of the time is probably not achievable, but HSE is looking for the best that’s possible. In terms of evidence that HSE is looking for it is all stated on the ASB4. When you know the HSE inspector is coming to carry out your licence assessment visit, think about the evidence you can present to demonstrate that you have good management and risk control.

Bolton night club owner fined over asbestos exposure A Bolton night club owner has been sentenced after admitting a failure to carry out a survey for asbestos before starting on the refurbishment of a local night club. Manchester Magistrates’ court heard how UK Night Life Limited and its sole director, Charles John McGrath, undertook the management of a refurbishment project between 1 August and 12 August 2015 on The Level nightclub, Mawdsley Street, Bolton without an experienced contractor in place to manage the site. Up to 20 workers were potentially exposed to deadly asbestos fibres in order for the club to open in time for Fresher’s week and an influx of students to the club. The site first came to the Health and Safety Executive’s (HSE) attention in August 2015 following a complaint from Bolton Council regarding unsafe construction works throughout the site. The HSE inspector served a total of three Prohibition Notices and two Improvement Notices, along with a Notification of Contravention for a foreseeable risk of asbestos exposure, a lack of competent site manager, risks of falls from height, unsuitable welfare facilities and inadequate fire safety precautions. Charles McGrath, sole director of UK Night Life Limited, of Mawdsley Street, Bolton, pleaded guilty to breaching Section 3(1) of the Health and

Company expose family to risk of asbestos A
Hertfordshire-based home improvement company has been fined after the unsafe removal of asbestos material from a domestic property. St Albans Magistrates’ Court heard how Ace of Hearts Home Improvement Limited (AOH) removed asbestos containing materials (ACM) from a domestic property in St Albans. The Asbestos Insulation Board (AIB) soffits surrounding the underside of the guttering around the front, gable end and back of the property had been dismantled in an unsafe manner creating the serious risk of respiratory exposure of asbestos fibres to the two workers and the residents of the property (family of four including two children).

An investigation by the Health and Safety Executive (HSE) into the incident which occurred on 25 Sept 2015 found that the company were not licensed to remove asbestos. Ace of Hearts Home Improvements Limited, of Alldicks Road, Hemel Hempstead, Hertfordshire, pleaded guilty to breaching Regulation 8(1) and Regulation 16 of the Control of Asbestos at Work Regulations 2012, and The Health & Safety at Work etc. Act 1974, Section 33 (1) (g) in that it failed to comply with an Improvement Notice, and was fined £100,000 and ordered to pay costs of £2,118.50.
Safety at Work etc Act 1974, and Regulations 5(a) and 16 of the Control of Asbestos Regulations 2012, and was fined £5,720.00 with costs of £3,535.86. In his summing up, District Judge Sanders remarked that Mr McGrath had chosen to rush through the works with unqualified and inexperienced people running the site on a dayto-day basis. He went on to say that it was clear that these offences amounted to a ‘degree of cost cutting at the expense of safety’. HSE inspector Matt Greenly said after the case: “Mr McGrath totally failed in his duty to protect his workers, subcontractors and anyone else accessing this site from a foreseeable risk of serious harm. Asbestos related diseases are currently untreatable and claim the lives of an estimated 5,000 people per year in the UK. “The requirement to have a suitable asbestos survey is clear and well known throughout the construction industry. Only by knowing if asbestos is present in any building before works commence can a contractor ensure that people working on their site are not exposed to these deadly fibres. “The cost of an asbestos survey is minimal compared to the legacy facing anyone who worked on this site.

A Level Playing Field? RAISING CONCERNS WITH HSE
I
n a highly regulated industry, it is reasonable for contractors (and clients) to expect consistently high standards. Despite this, contractors often report concerns about the work of others. For example, contractors report concerns about non-licensed companies carrying out sub-standard work and, on occasion, report that competitors are winning contracts: w Based on methods that offer sub-standard control (such as work without “full” enclosure, or without appropriate access equipment) w Using high ratios of temporary labour, without appropriate supervision and / or without robust means of assuring competence w Without properly planning before submitting notifications w Without allowing appropriate time to allow good standards to be achieved. On a more individual level, employees may report that they are not being provided with appropriate equipment, time, resources, training, supervision etc. ARCA aims to represent professionalism and high quality services. It is in the interest of all members to help ensure that everyone involved in asbestos management and removal is “playing by the same rules”. HSE’s process for raising concerns will not disclose company / individual details unless given permission. When concerns relate to a licensed organisation, we can expect HSE to take the matter seriously. HSE has a well-defined system for individuals or companies to raise concerns about any aspect of health and safety. This can be done easily and anonymously, using HSE’s online form (www.hse.gov. uk/contact/how-to-raise-a-workplaceconcern.htm). HSE has limited resources: raising legitimate concerns can help target these resources for maximum impact.

HSE process for handling concerns The HSE process covers all concerns about Health and Safety law. An online “workplace concerns form” is used to enter relevant details about you (your details are not given out, unless you explicitly give permission) and your concern. Your contact details are needed at this stage, as it is likely that HSE will want to discuss the information with you before investigating further. The process is not “Construction” or “Asbestos” specific: you should assume that first person to see your completed form is NOT an expert in asbestos matters. The notes below can help ensure that your concerns are taken seriously. There is a general expectation that those with concerns will try to resolve the issue themselves. In many examples given above, this is clearly not appropriate. If you are an employee with concerns about your organisation or about what you are being asked to do, you are advised to speak to the employer / person in control first. Your work / safety representative should be able to try to resolve the issue for you. (Worker consultation and engagement is an expectation for all licence holders, so any licensed contractor should have a working system in place for this. If it isn’t in place, this fact should form part of the concern raised with HSE.) Asbestos is a very high profile hazard and clearly linked to “significant harm”. In addition, HSE will have particular interest in concerns

Provide contact details so that HSE can discuss the concerns with you. Make it clear that concerns relate to potential asbestos exposure and / or an organisation’s capability to manage asbestos work safely. Make it clear that the organisation is licensed by HSE (i.e. it can only work because it has permission from the HSE to do so, on the understanding that good standards are achieved). Licence holders have an obligation to adhere to industry guidance and licence conditions, as well as legal requirements.

Beyond Compliance Moving I
n order to obtain a licence to work with asbestos, an asbestos removal contractor must be able to demonstrate to the Health and Safety Executive that they have excellent health and safety management systems, and that the required knowledge is put into practice on site.
doing the right things right Once a licence has been obtained, the management of the Licensed Asbestos Removal Contractor (LARC) will need to monitor all of their activities to ensure compliance with all relevant legislative requirements and associated guidance. Such compliance is seen within the asbestos industry as a minimum compliance level. As asbestos removal is part of a permissioning regime, the normal forms of regulation (on their own) are considered insufficient, and the extra demands imposed by the regime are considered

justified by the benefits it brings. So, the effective management of a LARC, and therefore licence continuity, depends on moving beyond minimum compliance. For example, licence holders: w must identify the hazards, assess the risks, review the extent to which health and safety is part of the process, develop effective control measures (for those hazards which cannot be eliminated) and record these in their health and safety documentation, which should be reviewed and kept up to date w must ensure that control measures recorded in the health and safety documentation cover design and hardware, systems and procedures, and human organisational factors as a collective whole; and should include the licence holder’s safety criteria and performance standards, as well as plans for improvement w must properly resource their processes for producing and maintaining health and safety documentation w must implement the control measures, review them regularly and keep them up to date with a view to continuously improving them to reduce risks w must make and test arrangements for managing emergencies and mitigating their consequences.

In addition to effective leadership from top management, the HSE would expect LARC’s to demonstrate competence at all levels of the organisation, both office based and on site. They would also expect LARC’s to make full and proper use of all information gathered from site activities, and use their findings to feed their assessments and planning of future jobs. Minimum compliance would require certain records to be kept, e.g. daily inspections of: w enclosures (including airlocks and baglocks) w hygiene facilities w vacuum cleaners w air extraction equipment w wet injection equipment (when in use) w respiratory protective equipment. This would include the reporting of defects and remedial actions taken. Going beyond minimum compliance would ascertain the accuracy of the records kept, as well as patterns, trends, identification of root causes, and implications for the future. Other information gathered and kept from site activities may include air monitoring, which becomes far more meaningful if planned with forethought and purpose. A LARC may consider having leak tests or personal monitoring conducted during asbestos removal works as compliance (i.e. data has been gathered). However, the data is of little use if
it can’t provide much useful information. Leak tests may therefore be planned for the first part of the first shift of actual asbestos removal, in specific locations such as adjacent to air extraction equipment (especially if extracted air cannot be vented directly to external atmosphere) or next to areas of the enclosure that may have been potentially difficult to seal. Such specifics are the level of detail required at the planning stage if LARC’s intend on moving beyond minimum compliance. Personal monitoring, per se, may be thought by some as compliance, but to be meaningful and go beyond mere compliance will require taking personal monitoring a step further. One example could be determining the actual airborne fibre concentration surrounding the operative when removing the first four ceiling tiles, which may disturb debris above or introduce a sudden influx of air from the unsealed, potentially contaminated void above. How does this concentration differ from the operative placing the ceiling tiles into the waste bags? Site audits, well designed, can also be a vital source of meaningful information – to check and reassure. The ARCA Site Audit has been designed with this in mind, and future reviews will continue to investigate further ways to enable the LARC to maximise the usefulness of the audit findings.
LARC’s should not confuse an abundance of data with meaningful information. LARC’s should absolutely meet the minimum compliance criteria, but in addition, should always be seeking ways to exploit the information gathered, thinking through ahead of the job what information is required. A key element of effective health and safety management is leadership. While management may be seen as ‘doing things right’ (i.e. doing things by the book, or the company procedures), leadership is about ‘doing the right things’ (i.e. moving beyond mere compliance and rewriting the book if that is what is required). When leadership and management work effectively together, the end result is ‘doing the right things right’.

Earn commission on your beach holiday
I
f calculating holiday pay is complicated, then get ready for more headaches. A new, legal judgment will make a big difference to how much employers pay their workers while they’re on leave. An Employment Tribunal decision, plus rulings from the European Court of Justice, mean that regular, voluntary overtime payments and bonuses should be included in holiday pay calculations. Until recently, normal, contractual hours were used to work out holiday pay and any overtime worked was discarded. The new case of White & Others v Dudley Metropolitan Borough Council 2016, brought on behalf of 56 tradesmen and members of the trade union, UCATT, has changed this. Whilst the law has been moving in this direction for some time, this case jolted it further.
The Employment Tribunal judge ruled that voluntary overtime, standby and call-out payments, when carried out with ‘sufficient regularity’, should count as ‘normal pay’. Such work is relevant, according to the judge, for the first 20 days of annual leave, under regulation 13 of the Working Time Regulations 1998. The workers argued that Saturday overtime work and call-out duties had been done voluntarily for a number of years and that meant that they were part of their normal work and thus, normal pay. Therefore, as well as receiving their normal pay, they should receive commission whilst on holiday, even though the commission was not earned. The judge conceded that a worker who rarely did overtime, should not receive commission whilst on holiday. However, the tribunal reaffirmed previous
employment court decisions that said workers should receive their pay so that they are not put off from taking holidays. But the tribunal judgment failed to define precisely what constitutes ‘sufficient regularity’. The judgment also means that there are potentially large numbers of claims for average holiday pay going back several years. Employees can claim for previous years, if they can establish an unbroken chain of deductions (i.e. failure to pay commission whilst on holiday over a series of holidays). The Government is seeking to introduce new laws to stop tribunals hearing deduction claims going back more than two years. The advice for employers is if you believe claims for back commission are coming your way, break the chain. Pay the commission or bonuses for a period of three months going back. That will leave the claims that go further, orphaned as the chain would have been broken. Claims going back further than three months will then be out of time for the employee to recover.

O
n the 15th November, Grant Beglan, ARCA Chairman, went along to the Addenbrooks Hospital Cambridgeshire to meet two year old Ben Price. At a charity function for the Willow Trust earlier this year, I met Sarah-Jane Thompson, the Events Manager for the charity, and she was interested to hear what the Indee Rose Trust did for children. The fact was that her young nephew, Ben, was undergoing treatment for a brain tumour.

I heard that Ben’s mother had contacted the Indee Rose Trust to see if they could do something for Ben, following which my wife and I were delighted to be asked to present a treasure box to Ben. Ben was extremely poorly when we arrived at Addenbrooks Hospital but after opening the first of several gifts, carefully chosen and

beautifully wrapped, his little face lit up with some big smiles. His Aunt commented that Ben was the happiest and most animated she had seen him since August, and the whole family were very grateful. Then the next day we received some wonderful news, that following the operation and subsequent post treatment, a scan showed the tumour had gone. There is a long way to go with ongoing treatment, but fingers crossed Ben is on the way to a full recovery. I personally found the whole experience a great help in confirming the work we have done and will continue to do, in future events and fund raising, is of great importance in creating smiles on the faces of young children suffering from this dreadful disease. Jane and Russell, who founded the Indee Rose Trust in July 2009 in memory of their daughter, do such a great job and recently won an award for their fund raising at ‘The Daily Mirror Pride of Britain Awards’. Operations director Michael Carmody, who has more than 10 years’ experience at managerial level within the construction sector, will head operations in both Scotland and Yorkshire at Clarke’s Environmental, whose turnover has grown at an unprecedented rate from £600,000 two years ago to a predicted £3.5million this financial year. Kevin Godfrey, with 25 years’ experience of health and safety management within both engineering and public sectors, joins the company as health and safety manager. Richard Clarke, MD of Clarke’s Environmental, said: “Michael has an enviable reputation within the asbestos removal sector, while Kevin has an excellent track record in health and safety within our sector. Their appointments will help to strengthen our expertise, and ensure that we continue to focus on delivering quality service and outstanding customer care.” Employee numbers have quadrupled at Clarke’s Environmental in the last two years, from 10 to 40, resulting in the need to relocate from the office it shares with sister company HCS Mechanical Services.

ounded in 1932 by Earl M, Scott, Scott Safety started as an aviation components manufacturer based out of Mr. Scott’s garage in Lancaster, New York.
Scott Safety celebrates 50 years of British manufacturing 2016 marked a 50 year milestone for Scott Safety, where the organisation celebrated not only 50 years of British Manufacturing but also 25 years at the Skelmersdale site.
The company’s first product was a pivoting tail wheel for aircraft, which meant airplanes’ tails no longer had to scrape along the runway on an iron rod - and this malleable iron “skid shoe” was relegated to history. Today, Scott Safety continues to be a leader in innovation with more than 34 products developed in the last five years. Scott Safety’s Skelmersdale plant utilises some of the most advanced technologies in the manufacturing process and in honour of the hard workmanship, the organisation held a week-long celebration for its employees. The week commenced with a site shut down so that the entire workforce could attend an informal company presentation on the weeks festivities,
a look back at the site over the past 25 years and also to present awards to 21 members of the team with a ‘key to the site’ honour, as a thank you for being with the company for over 25 years. Throughout the course of the week there were a number of activities that took place including a history room that included old photos and products from the last 50 years, raffles and lunch for everyone at the organisation. Celebrations also included new product workshops, factory and office tours and a visit from the new Skelmersdale borough Mayor, Cllr. Liz Savage. The week ended on a high with one member of the team shaving her head for Macmillan Cancer Support in honour of her colleague who is suffering from breast cancer. Pete Osborne, Plant Manager says: “It is an honour to work for the Scott Safety family. Over the past 50 years we have grown as a business but we have still maintained our family feel and the mission that we protect what matters most, people. This applies to not only our customers but to the people who work within our walls. Shield expands UK coverage
S
hield Environmental Services are pleased to announce the recent opening of a new branch in Warrington, strengthening their asbestos services in the North. Southern Team regain Golf Trophy A
t this year’s ARCA European Golf Event two intrepid teams representing the North and South of the country ventured to a new venue in Marbella, Spain, to contest the Glen Telford Memorial Trophy. The teams were captained by Richie Powner of Environmental Essentials Ltd (Northern Team) and David Harrison of Keltbray Ltd (Southern Team). The teams were based at the Puente Romano Beach Resort in Marbella, with the Saturday doubles matches being played on the Los Naranjos course a short coach trip away. The golf course is a traditional Robert Trent Jones Sr. design with generous fairways and strategically placed bunkers and water hazards. Since the opening in 1977, the course has been the host of several major competitions, including the Spanish Open. After the first day, the Southern team had already opened up a considerable lead, the Northern team had a lot of work to do on the second day if they were to retain the trophy The Sunday singles matches were played on the
Rio Real course, designed by the legendary Javier Arana, considered to be the best Spanish designer of all time. Its design makes it a spectacular course. With 18 holes (par 72) and more than 6,000 m in length, the Royal Spanish Golf Federation (Real Federación Española de Golf) considers it to be a prestigious golf course and one of the best in Spain, both for its layout, as well as it unique beauty. As the second day progressed it was clear that the Northern team were not going to catch the Southern team. After the final round the Southern team had won convincingly and had regained the Trophy. Richie Powner, Northern captain, presented the Glen Telford Memorial Trophy to David Harrison, Southern captain, during lunch after the tournament. Next year’s event is already being planned, so the date and venue will be advertised as soon as available.

First candidate to gain
ARCA ILM Qualification I
n May, I caught up with Chris Dobson as he started his penultimate unit towards gaining the ARCA ILM Leadership and Management qualification. His aim was to complete this and then the final unit, and gain the qualification before the end of the year. Congratulations to Chris on being the first candidate to gain the ARCA ILM qualification. To gain the ARCA ILM Leadership and Management qualification Chris passed all four units (which took the form of classroom sessions and assignments) which covered; communications management, risk management, developing people and managing people in the workplace. I called Chris to congratulate him on his

achievement. “I’m delighted to have gained this ILM qualification and in the time I set myself!” “I was looking for a further management qualification, so when I heard about the ILM qualification developed by ARCA, it was ideal. I enjoyed the topics and the challenge. I’d like to thank my tutor, James, who was very supportive throughout the whole process, and my employer (Thompsons of Prudhoe) for encouraging staff development.” We also discussed his next step which he is keen to progress as soon as possible, that is membership of ARMI (Asbestos Removal Management Institute). Steve Sadley, Chief Executive of ARCA, met Chris at the Association’s North East Regional Meeting on 9th November. “It’s fantastic to see the commitment Chris has shown in gaining this qualification in the time he has, and the support he has had from our member Thompsons of Prudhoe. t the ARCA Annual General Meeting in October, Clarke’s Environmental was presented with the ARCA National Training Award. The National Training Award 2015/2016 was received as Clarke’s trained 29 asbestos removal operatives and/or supervisors with ARCA, and their candidates achieved the highest average score across all candidates trained in this period. “Congratulations to the team at Clarke’s Environmental. Candidates collectively scored an average of 95.7% which is a great achievement,” commented Satish Patel, ARCA Training Manager.

New low-level electrical isolation course A
RCA members are taking advantage of the new low-level electrical isolation course, which is designed for individuals who have some experience of electrical systems and who may be required to carry out electrical isolation of low voltage systems on an asbestos removal site. Including formal Permit to Work procedures for onsite operation, the course provides the candidates with the knowledge needed to perform safe isolation of low voltage systems and equipment. The first course delivered at Rayleigh last month was well attended with 14 operatives receiving training. This course is available at ARCA training facilities or at member premises, provided suitable facilities are made available. For more information please contact ARCA on 01283 505777.
