Buyers have recourse against ‘as is’ sellers Sellers who offer their property “as is” still must abide by state realty laws. DEAR DAVE: We signed a contract to purchase a home that was listed “as is,” and agreed to go forward with the deal even after a home inspector said it needed about $7,000 in repairs. The seller then proceeded to remove several expensive fixtures from the bathrooms, as well as two ceiling fans, and he refuses to replace them on the basis that we agreed to buy the property as is. What can we do? ANSWER: Though you agreed to purchase the home as is, the seller had no right to subsequently remove the expensive fixtures and ceiling fans without your written permission. When a home is offered as is, it simply means

Banks often order both types of reports before they’ll open a new checking account for a potential customer. ••• DEAR MR. MYERS: We agreed to purchase a condominium in a large development. The mortgage broker who is handling the financing said we will have to pay nearly one-half of a percentage point more on our loan’s interest rate because roughly half of the units in the complex are occupied by renters. Is this some sort of a scam? ANSWER: No. Many lenders charge a higher

interest rate for loans in condo projects where more than 25% or 30% of the units are occupied by tenants instead of owners. That’s because lenders fear that absentee-landlords won’t approve increases in their monthly dues or special assessments that might eventually be needed to keep the development in good shape. In addition, lenders charge higher rates at such developments because renters usually don’t take care of property as well as owner-occupants do. Foreclosure rates at projects with a large percentage of renters are typically much higher than at developments where most units are occupied by their owners, so charging a higher interest rate compensates lenders

for taking the added risk. ••• DEAR MR. MYERS: If I formed the type of inexpensive living trust that you have written about and then put my home and a rental property into it, would I have to open a special checking account for the trust and file a separate tax return for it? ANSWER: No. The Internal Revenue Service does not require separate records for a trust, and no separate trust bank account is needed. You don’t have to file a separate tax return as long as you remain in charge of the trust, but instead merely report any of the trust’s income or transactions on your regular in-

The fact that no special record-keeping is needed is an added incentive. ••• Our booklet “Straight Talk About Living Trusts” can help you determine for yourself whether forming a money-saving trust would be a good idea based on your personal financial situation. For a copy, send $4 and a self-addressed, stamped envelope to David Myers, P.O. Box 2960, Culver City, CA 90231-2960. Send questions to that same address and we’ll try to respond in a future column.

It’s time to watch for bagworms Home Grown

A few bagworms are nothing to be concerned about except to serve as a warning to watch the plant carefully over the next few weeks to see if populations increase. Simply pull off the bags and discard them to eliminate the development of the next generation. If numbers are high and you wish to treat for them, you’ll need to act quickly as the time for good control is short when the insects are actively feeding. Bagworms are a common landscape pest in Oklahoma. The term can mean a few different insects to people so we need to make sure we are all on the same page here: Bagworms form small brown tornado shaped sacks as they mature, often hanging on trees for months. When actively growing, bagworms are small dark caterpillars that are most easily noticed when you walk near a tree and see them hanging from a web as they swing to a new feeding location. If you see heavy webbing covering several leaves or branches, that is a different pest altogether, and the subject of another discussion. Bagworms, like most other tree eating insects, are generally not a problem. If otherwise healthy, a mature tree can withstand a significant defoliation (no matter if it’s from an insect, hail storm, etc.) with no long-term consequences. However, if they attack

How mortgages changed during COVID-19 By Alex Penny RCB Bank

During the COVID-19 crisis, many areas of our lives changed and mortgages were no exception. How banks verify income, how appraisals are done, credit score requirements and cash reserve requirements have all temporarily changed due to market instability. While these changes are more than likely temporary, knowing how the process has changed should

make home buying less stressful.

Closing Before you close on your mortgage, the lender will do a final “soft inquiry” or “soft pull” on your credit. They are generally ensuring no new debts or changes in your finances have occurred since the approval process. Before COVID-19, this inquiry was usually done 10 days before closing. Now that “soft inquiry” is done three to five days before

Prepare to prove finances Since so many people have lost jobs or had their hours cut, lenders may ask you to prove your income more often. Paystubs and bank statements that were once good for 120 days are now only good for 60 days. Lenders may also verify your employment multiple times before approving a new loan. If you are

The planning process is one of the most exciting parts of a home renovation project, and with social distancing keeping us indoors, now is the time to dream big and get ready. Whether it’s a basement makeover, a pool addition or even building a new house from scratch, here are some tips to get started: 1. Factor in your lifestyle. Think about your priorities and lifestyle – do you work from home without a proper home office? Do you enjoy cooking and entertaining? Is your backyard living up to its potential as an extension of your home? Asking these kinds of questions can help you determine the most beneficial focus for your next project. 2. Educate yourself. Take advantage of this extra time you have to learn about materials, processes and new innovations. You can make smarter purchasing decisions by finding out the answers to key questions, such as: Is this material mold-resistant? How long will it last? Is this a passing fad or
