‘Good fences’ don’t always make ‘good neighbors’ A homeowner has a few different options when a neighbor claims that a fence or wall intrudes on the neighbor’s property. DEAR DAVE: We live in a community where most of the houses are on weirdshaped lots. A young man wants to buy the property next to ours, but the bank ordered that he first get a survey of his property to establish the legal boundary lines between his place and ours. The survey report says that the brick wall that separates our respective back yards encroaches about 1 1/2 feet onto his property, so now he wants my wife and I to pay to tear the wall down and build a new one in its proper place. The wall was here when we purchased the home six years ago, and we didn’t know about the encroachment. What can we do? ANSWER: “Good fences make good neighbors,” poet Robert Frost wrote, but he obviously didn’t live in a modern-day subdivision. Countless lawsuits are now filed each year by one homeowner against

another when it’s discovered or alleged that a permanent divider illegally protrudes on the plaintiff’s property. Fortunately, you don’t have much to worry about. The wall was there when you purchased your home, which means you obviously didn’t build it yourself and probably have no legal obligation to tear it down and replace it. And even if the surveyor’s report is accurate, the divider stands just a foot or two over your neighbor’s property line – which makes it his problem, not yours. It would be a nice gesture if you offered to pay half the cost of removing the wall and rebuilding it in the proper place, even though you may have no obligation to do so. If you obtained an “owner’s title insurance” policy to protect your interest in the home when you first purchased the property, call the insurer for additional suggestions. If your neighbor eventually decides to file a lawsuit for what he believes is the extra 18 inches of terra firma that he thinks he owns,

Should you want to get testy, you could even countersue and ask a judge to demand that the wall stay exactly where it is under the state’s “easement by prescription” or “adverse possession” laws -- two related legal concepts that allow people to permanently occupy or use another’s real estate (even if it’s just a brick wall) provided that certain conditions are met. If you and your wife can’t reach a satisfactory agreement about the shared wall with your neighbor over a cup of coffee, you’d be wise to consult a real estate attorney for help soon. ••• REAL ESTATE TRIVIA: “Breach of contract” is the top reason why buyers or sellers

That’s followed by “specific performance” lawsuits (when one party doesn’t live up to the other’s expectations), fraud and then boundary disputes. ••• DEAR DAVE: Watching the recent looting and vandalism on TV got me wondering: Is this type of criminal activity covered by insurance? ANSWER: Usually, yes. A standard homeowners policy will cover damage to a property caused by fire, an explosion, a riot or civil commotion, vandalism or malicious mischief. This would include coverage for the structure of a home, as well as any personal possessions. Insurance coverage for a business works a bit differently. Damage to the physical place

of a business and its contents that is caused by fire, riots, civil commotion or vandalism is covered under a standard business owners policy (also known as a BOP). However, coverage for plate glass windows is often sold separately. Businesses that are forced to suspend operations or to limit hours due to rioting or similar mayhem may have coverage for the loss of income under business income insurance -- also known as business interruption coverage. However, this is usually triggered only if there is direct physical damage to the premises. Some business owners also opt to include a “civil authority provision” in their policies that provides coverage for lost income and extra expenses in the event that the police or fire department bars access to a specific area as a result of the danger caused by a riot or civil commotion. ••• DEAR DAVE: If my husband and I create the type of money-saving living trust that you often recommend and then put our

house into it, would we have to rewrite the whole document and pay lawyer fees again if we later want to add other assets, such as stocks or bonds? ANSWER: No, you wouldn’t have to spend a lot of money to totally rewrite the living trust. Many homeowners create an inexpensive living trust so their heirs can quickly inherit their house or other property without going through the costly, time-consuming and emotionally painful probate process. A well-written trust includes a simple provision, usually just a paragraph or so, stating that the creator of the

Pandemic spikes early retirement withdrawals from young investors ETRADE Financial Corporation announced results from the most recent wave of StreetWise, the ETRADE quarterly tracking study of experienced investors. Results show retirement trends among Gen Z and Millennial investors amid the COVID-19 crisis: • They’re significantly more likely to take an early withdrawal. Nearly three out of five young investors (59%) said they have withdrawn early from their retirement accounts, compared to just onethird of the total population (33%). Since last quarter, early retirement withdrawals among young investors shot up nine

percentage points. • And they’re worried retirement funds may run dry. More than half of investors under 34 (51%) are worried about their lack of retirement savings, compared to almost one third of the total population (32%). In fact, not having enough saved for retirement became young investors’ #1 worry this quarter, outpacing concern over loss of a loved one. • Barriers to retirement loom large. Among young investors, the top barrier to saving for retirement is housing costs (67%), followed by education (64%) and health care costs (62%), compared to 44%, 34%, and 47% of

the total population, respectively. “Young investors have a barrage of financial obligations – whether it’s paying down student debt or a mortgage, saving for retirement, or helping care for their parents,” said Mike Loewengart, Managing Director of Investment Strategy at ETRADE Financial. “The recent health crisis has

A good time for an early summer landscape check-up Here are a few issues dominating problem plant calls to the extension office right now. Skimming through this list might help you self-diagnose problems you are seeing around your own garden or landscape. • Premature leaf drop on trees. For the second year in a row, we’re see a large number of trees infected with rust, a fungal disease. Pear trees have been especially hard hit. Rust is an umbrella terms used to describe a family of leaf-spotting diseases. There are some slight differences from species to species, but in general, they cause leaf spotting, early yellowing, and in some cases, premature leaf drop. The good news is rust is not fatal and your trees (if otherwise healthy) will suffer no long term harm. Treatment is not advised as it is not helpful once the disease is established. • It’s dry! In unirrigated areas, we are starting to see some signs of drought stress. This can also lead to early leaf drop, especially in plants already being compromised

as mentioned above. With no significant change in the forecast, it would be a good idea to keep an eye on your landscape to make sure important plants have adequate irrigation. For those of you with automatic irrigation systems, note that our regular rainfall patterns can sometimes mask deficiencies in coverage of the system.
