15 states approve plan that allows sellers, buyers to close deals via webcam

Some lucky folks now don’t have to be physically present in order to finalize a real estate transaction. DEAR MR. MYERS: There is a company in our area that is running TV advertisements claiming their agents can close a real estate sale or a refinancing loan via video or a webcam instead of the customer having to physically go to the bank or escrow company to get it notarized and finalize the deal. Is this legit, or some sort of scam? ANSWER: It’s legitimate, but only if the transaction is made in one of the 15 states that recently agreed to allow it.
About Real Estate DAVID MYERS Until recently, home buyers had to physically appear before a closing attorney or escrow officer to sign all the paperwork needed to close a real estate transaction and to have everything notarized. But now, a nationwide title company called Notarize and Title Resources has obtained permission from the 15 states – stretching from Hawaii to New York and New Jersey – to have all of the documents notarized by use of
a webcam. That’s a huge convenience, especially for those who live far from the new home that they are purchasing. Buyers and refinancers should ask their real estate agent or lending representative if they qualify for this innovative new service. However, it’s important to note that although 15 states now allow it, not every county within those states is currently equipped to accommodate the practice.
Again, the agent or lender should know the answer. *** DEAR MR. MYERS: My wife has dementia. When I tried to refinance our home to help pay for her growing medical bills, the bank turned me down because her name is on the title to our house, and
said her worsening mental condition makes her legally incapable of signing documents. I showed the lender the health and financial powers of attorney that she signed for me years ago, when she still had all of her mental faculties, but the bank refused them. What can I do?
ANSWER: There’s no legitimate reason why the bank should refuse the loan. The two powers of attorney were signed when she still had all of her mental faculties intact, so they’re
perfectly valid. Call the bank again and demand to speak to a supervisor. If worse comes to worst, you’ll need to have an attorney make the call or have the lawyer write a letter.

Large native trees for Payne County Fall tree planting season will be here before we know it. The Payne County Extension Office has received quite a few inquiries lately about good selections for trees native to this area. While selecting a native tree doesn’t necessarily ensure its success, it can be a good start in the right direction. Some of these plants can be hard to find so it’s a good idea to start your search soon. This week we’ll focus on the larger selections and move on to the smaller trees next week. • Baldcypress. Taxodium distichum. This pinelike tree becomes a fantastic specimen as it matures. We say “pine-like” since it has needles, but it is a deciduous tree, meaning it loses its needles in the winter. If you are not familiar with this plant, the most striking examples are around Theta pond on the OSU campus. Those particular trees are noted for the root knees that stick up all around the trees. Not to worry, the baldcypress does not produce the knees in a landscape situation, unless excessive moisture is always present. In addition to being able to grow in water, this tree has prov-

Hickory trees can be hard to find in the nursery trade, but they are common to the hardwood forests of eastern Oklahoma. A large tree, hickory is most well known as a favorite for wildlife. It is a cousin to the pecan and the two can easily be mistaken for each other when young. • Black walnut. Juglans nigra. Another tree readily found in many of our undisturbed areas. A walnut is not a tree for the faint-of-heart landscape as the trees can be very messy.
However, in big landscapes where diversity is important, this large tree should be a consideration. • Cedar elm. Ulmus crassifolia. This large elm, while not immune to Dutch Elm Disease, has shown good resistance to it. Becomes a classic shade tree as it ages. Cedar elms are most easily distinguished from other elms by their small leaves. • Chinkapin oak. Quercus muelenbergii. There are many oaks native to Oklahoma. The chinkapin is one that should probably get more attention. Not as

big as some of the other oaks, this tree has a nice shape that fits well within the confines of many urban landscapes. Do not plant this tree unless you want to attract deer as they cannot resist the acorns. • Loblolly pine. Pinus taeda. This is the only pine we can recommend for our area. All others suffer from a variety of pest issues. The loblolly is a large fast growing pine that is most well-known for dropping its lower limbs as it matures as well as it’s lime green (sometimes yellowish) color in the winter. • Pecan. Carya illinoensis. This large Oklahoma tree needs no introduction. Another tree that needs a lot of room in the landscape, due in part
to their tendency to self-prune, or drop limbs as they age. • River birch. Beula nigra. Payne County is the western limit for this tree but the cultivar ‘Heritage’ has shown to work well. Avoid this one if you have heavy clay soils. Birch trees are a fantastic tree to add interest to the landscape with their characteristic papery bark. • Sycamore. Platanus accidentalis. A very large tree most noted for its striking bark and the production of thousands of seed balls every year. These trees are like pecans in that they are weak wooded and have a tendency to selfprune. Another tree that should be sited carefully but it absolutely has its place in the Oklaho-

This should be good news for home buyers and owners since, on average, they tend to have greater assets and larger numbers of credit accounts to protect than others. But there’s a real estate-related issue here that hasn’t gotten a lot of attention: Heavier use of credit freezes could create more complications and delays when people with frozen files apply for mortgages. Some lenders say dealing with applicants who keep their files in deep freezes – and want to keep them frozen during as much of

the mortgage process as possible – can be challenging. “It’s a big problem” if consumers don’t understand what lenders, loan processors and investors need in terms of access to their credit files from the application stage through closing, says Joe Metzler, senior loan officer for Mortgages Unlimited in West St. Paul, Minnesota. When Metzler tells applicants that he needs them to unfreeze their credit files “at least a couple of times” during the process, sometimes they “freak out about it,” he says. And when they don’t lift their freezes in a timely manner, their loan closings may be
postponed. John Meussner, executive loan officer for Mason-McDuffie Mortgage Corp. in San Ramon, California, says that when a credit file is frozen, “it does lead to some procedural headaches. Applicants should know that if they have their credit frozen, they will need to act quickly in [contacting] the credit bureaus ... and that the failure to act quickly could lead to delays in their loan processing.” The biggest issue, says Andrew Marquis, senior loan officer at Guaranteed Rate in Lexington, Massachusetts: Home buyers freeze their files and then “for whatever reason, they don’t know how to lift it.” Here’s a quick overview of how the changes coming Sept. 21 might affect mortgage transactions: For consumers, the law spells out how the freeze/unfreeze

procedures are supposed to work. To initiate a freeze, you’ll need to contact each of the three national credit bureaus – Equifax, Experian and TransUnion – specifying how long it should stay in effect. If you contact the bureaus by telephone or email, they’ll each have up to one business day to place the freeze. If you make your request by mail, they’ll have three business days to comply. You’ll be assigned a PIN number for use whenever you want to unfreeze
your file or later re-freeze it. Say you apply for a mortgage or pre-qualification letter to buy a home. Your loan officer will need you to unfreeze your files at the three bureaus in order to pull your credit reports and scores. Once that’s done, you can opt to leave the files unfrozen or immediately re-freeze them by contacting each of the credit bureaus. You’ll need to unfreeze your files at least once more during the process: Within several days of your scheduled
closing, your lender will do what’s called an LQI (Loan Quality Initiative) credit pull to make sure there have been no changes in your report, including inquiries, new accounts, balances or alerts. Bottom line: If you opt for free freezes and plan to get a mortgage, play it smart: Be ready to unfreeze your credit files at least twice during the process, or simply unfreeze for the duration. WASHINGTON – Nearly a year after the catastrophic Equifax hack exposed 147 million Americans’ personal and financial data to cybercriminals, consumers are about to get a break – something especially useful for home buyers and owners. Starting Sept. 21, credit-file “security” freezes will no longer cost you money. For years, you had to pay fees that varied from state to state to enact freezes – which nail down your credit files, rendering them inaccessible not only to crooks but just about everybody else unless you unfreeze them. In the wake of the Equifax debacle, consumers spent an estimated $1.4 billion on freeze fees, according to researchers.
