One solution might be to ask a judge to

appoint an independent conservator, such as a trusted relative or friend, who could legally act on your wife’s behalf. If your wife still has most of her mental faculties intact, the lawyer might instead suggest that the two of you create a basic living trust and put your home and other assets into it. Both of you would be co-trustees while she’s still competent to make decisions on her own. But if her condition worsens and she must move to a full-time care facility, you could sell the home yourself and make other key decisions on her behalf.

the trunk. This will almost always be on the southwest side of the tree. It is caused on cold but sunny winter days when the trunk warms quickly with the low winter sun. The bark wrap serves to prevent this overheating. This is a common problem with maples planted in our area so this is

an important factor that should not be overlooked. However, problems of a different nature can develop when this wraps are left on the trunk throughout the growing season. Just like with excessive mulch, wrap can harbor insects and disease. To prevent this, remove trunk

wrap each April and replace it again each fall (after leaf drop) until the bark begins to develop some signs of maturity. Finally, closely inspect the root flare of the tree once a year or so for the first several years of the tree’s life, looking for signs of girdling roots and cut or remove them as

needed. While this is primarily an issue to be addressed at planting, problem roots can also show up several years later. If the tree has been mulched properly, this is an easy thing to do. Simply rake the mulch away from the root flare for a quick peek and then rake it back into place.

Once the investment of a new tree is made, it is critical to follow a few steps to help insure its long term success. These are not difficult tasks, but based on years of observations, they are steps that appear to be often neglected. For the purposes of this discussion, we will begin with the assumption that the tree has been properly planted and its water needs are being met. If you have yet to plant this fall, contact the Extension office (http:// oces.okstate.edu/ payne) for advice on proper tree planting procedures. • Mulch properly. In addition to serving the important role of moisture management, mulch also helps to limit competition with turfgrass. In our area, bermudagrass is an especially vigorous competitor for water and nutrients and keeping it away from a small tree will pay big dividends over the first few years of the tree’s life. As mulch breaks down over time, it also improves soil biodiversity, which helps to create a healthier plant. • Avoid piling mulch up directly against the trunk of the tree. Volcano mulching, an industry term for poorly installed mulch piled around the base of a tree, acts as a harbor for disease and insects. At the


Negotiating the right price for the right deal You make your money when you buy. Buying right starts with your analysis and then comes down to the negotiations. The thought of negotiating elicits very different feelings for different people. It excites some people. Others loathe the thought of it. For me, I love crafting the deal and figuring out how to satisfy all parties. In my experience, successful negotiations do not come from simply offering low and hoping for the best. Successful negotiation of a deal comes from trying to find the win-win and having the numbers and analysis to justify your offer. If you’re looking at a property that

fication! Providing the “why” for your number greatly increases your chances of making a deal versus just submitting the number. You cannot worry about “offending” the seller by a low offer. The absolute worst case scenario is that they say no. That’s not a bad worst case scenario! So why take it upon yourself to write off a property just because your offer would have to be much lower than their asking price? Don’t just

pass it by assuming a deal isn’t possible. I have offered as little as 61 percent of the asking price of a property with my first offer. The property was in very rough shape and it was going to be a major rehab. I had done all my homework and had solid justification for my number that I submitted along with my offer. It would have been easy to just pass by the opportunity

thinking that they would be offended. Thinking that there would be no way they would accept my offer. But I didn’t concern myself with that. They were actually just happy to receive any offer and we ended the negotiations at 67 percent of the asking price. It’s not all about just offering low all the time either. At times, I have offered the full asking price when it’s

a great deal. Had I tried to offer low just for the sake of shaving a little more off an already great deal, I may not have got the property. I have even offered above asking price for properties a couple times when the numbers supported it and I thought I would have a lot of competition. Negotiating

WASHINGTON – Fraud in connection with home mortgages is on the rise, ranging from little white lies about the intended use of the property all the way up to much more sophisticated schemes. But what, you ask, does this have to do with me? Maybe more than you think, especially if you end up on the wrong end of it and have no clue about what’s going on. Overall fraud risk in the home mortgage field is up by 16.9 percent in the most recent 12-month period tracked by data analytics firm CoreLogic. And of all types of application fraud, the risk of so-called “occupancy” misinformation – when “applicants deliberately misrepresent their intended use” of the property – is rising the fastest. This includes cases in which borrowers lie about whether they intend to live in a house or rent it out. Applicants who promise lenders that they will live in the property generally qualify for lower interest rates and down payments; rental home investors get charged more. Application fraud was found in one of every 122 mortgage applications during the first two quarters of 2017, according to Bridget Berg, CoreLogic’s senior director of fraud
