Buyers should be wary of including ‘escalation clause’ in their offers Home sales are still sizzling in most parts of the nation, but buyers sometimes unwittingly telegraph to sellers that their first offer isn’t necessarily their best. DEAR DAVE: The housing market in our area is still hot, with many homes drawing multiple offers. To stay competitive with other buyers, our real estate agent has suggested that we include an “escalation clause” in any offer that we write that says we will increase the price that we are willing to pay (within reason) if another bid is made on the same home. Would this be a good idea? ANSWER: There are a lot of realty agents who say that including an escalation clause is a good idea, but an equal number who say that it’s a bad one. An escalation clause can take many forms. For example, with the housing market still red-hot in many parts of the nation, such a clause may force the buyer, who has already made a full-price offer, to make an even higher bid if a different buyer
would pay more. I tend to side with the agents who say that buyers should never include an escalation clause in their purchase offer because it can put too much negotiating power in the seller’s hands. To illustrate, let’s say that Bob Buyer makes a full-price, $200,000 offer for Sam Seller’s home. Bob knows that the local market is still sizzling, so he includes a provision that allows him to offer an extra $10,000 if Sam gets a competing proposal that tops Bob’s initial $200,000 bid. If Sam Seller is smart, he knows that the escalation clause that Buyer Bob included in the original offer suggests that Bob is willing to pay $10,000 more. Sam would be foolish if he didn’t automatically make a counteroffer for the extra $10K above his original asking price, perhaps even if the “competing bid” came from a relative or friend who had no real intention of purchasing the home. ••• REAL ESTATE TRIVIA: Average rates on 30-year,

If you are a fan of cool season garden crops like broccoli, cabbage, and cauliflower, some important dates are right around the corner. February the 15th is generally considered the opening of the “early planting” window for these crops. Since these crops are usually the most successful when transplanted into the garden as established seedlings, the time to plant indoors and begin growing them out is almost here. Keep the following tips in mind and you will be off to a great start: • Use a seed starting mix for a growing medium. This is NOT the same as potting soil, starting mix is finer and has different water holding characteristics. Also avoid using garden soil as it will tend to hold too much moisture and is more likely to contain soil borne fungi that could be detrimental to the seedlings. Begin with a shallow dish with some means of drainage. One inch or so of growing medium is deep enough as the seeds won’t be in this container very long. • Seed more than you think you will need. Some say they need more latitude to use administrative records to show errors in the head count. “We propose that ‘human error’ during census-taking field operations should have a remedy, if such errors are detected and substantiated,” said Todd Graham, principal demographer for the Metropolitan Council of the Twin Cities, in public comments on the program. Citing concerns about residents being missed in Detroit, the House Committee
on Oversight and Reform on Thursday asked the Census Bureau for a briefing on whether communities might be able to challenge and fix their population counts if an undercount is documented. Local governments will soon have another way to change the numbers. Starting next year, they can hire the Census Bureau to conduct a “special census” in a re-do of the 2020 count, with the locals footing the bill. They can also challenge population estimates that use the census figures as a base upon which births, deaths and migration are added annually. Given the 2020 problems counting people in dorms, military barracks, nursing homes and prisons during the pan-
demic, the Census Bureau has proposed creating a separate program to accept challenges for these “group quarters.” State, city and tribal officials have been sounding the alarm about the counts because students were sent home from campuses, and prisons and nursing homes went into lockdowns when those residents were supposed to be counted. Brumfield called the proposal “a step in the right direction.” Any changes will be incorporated into future population estimates and the bureau’s American Community Survey, under the proposal. “I’m optimistic it will address a lot of concerns,” Brumfield said. “It’s a good sign that the bureau has been listening.”

The Las Virgenes district serves about 75,000 people communities of Agoura Hills, Westlake Village, Calabasas and Hidden Hills – an area that has attracted a growing number of celebrities, including Kim Kardashian and Will Smith. Like much of inland Southern California, the region rarely gets any rain outside the winter months. It’s wealthier than most other parts of the state, with a typical Calabasas home selling for more than $1.5 million, according to the online real estate marketplace Zillow. Despite calls for conservation, water customers in the area increased usage in August and September and then met the state’s 15% reduction goal in October before again missing the target in November. Collectively, customers greatly exceeded their water budgets last year and one of the biggest issues the district faces is “the ability for affluent customers to significantly exceed their water budgets consistently since money is not a deterrent,” said Mi-
chael McNutt, the district’s spokesman. He declined to provide names of the district’s biggest water users. “It appears there has been a lackluster response to the water emergency,” said Calabasas Mayor Mary Sue Maurer, who thinks restricting water flows could provide a needed conservation wakeup call. Due to dry conditions, California regulators said in December they would not provide any water from state supplies beyond what was needed for essentials like drinking and bathing. That could change in the coming months, but allocations likely won’t go up significantly unless it’s a very wet winter. The uncertainty is particularly stressful for Las Virgenes, which gets about 80% of its water from state supplies. The district’s conservation approach is part carrot and part stick. A new advanced water metering system will show customers how much water they’re using in real time. The meters, which will be in place by April except for people who opt out, can show users when they exceed limits so they can adjust their behavior before monthly bills arrive.
Every household has a “water budget,” something used by many California water districts. Budget are based on the number of residents in a household and the property size. Starting this month, customers will face fines if they go 150% over their monthly budgets. Previously, the fine threshold kicked in at 200%, and about 15% of the district’s customers were fined, Pederson said. People get a warning the first time they go over budget. Las Virgenes’ approach of advanced metering, fines and the threat of flow restrictors, stands out among the state’s more than 400 medium to large water agencies, said Mehdi Nemati, an
assistant professor at the University of California, Riverside who works with water agencies on conservation programs but not with the Las Virgenes district. Only a few dozen districts have the advanced metering systems because they are expensive to install, and few use penalties against residents who overuse. Instead, many districts increase the cost of water as customers use more. But richer Californians did not conserve as much as others during the last drought even when the state mandated it, Nemati said. It’s even rarer for a district to threaten flow restrictors for people who use too much water and Nemati speculated
that the Las Virgenes’ policy could invite lawsuits. “The agency’s pretty brave if they really want to do that,” he said. The Las Virgenes district doesn’t want to be heavy-handed with fines or restrictors, said Pederson, the general manager. Fines start at $2.50 and go as high as $10 for every 748 gallons over the 150% threshold. The average house in the district uses 19,448 gallons of water per month, the majority of it outside, and district officials said many customers stay within their water budgets. “Our system helps us to target the message to the people who are really, frankly, the problem,” Pederson said.
