Can key real estate issues create a legal love triangle? Real estate law isn’t cold and heartless, but your relationship status sometimes does matter. DEAR DAVE: My credit history is great, but my fiancee’s credit is bad. I have been told that when we marry, our credit histories will be merged, and that I will “inherit” her bad score and become liable for the roughly $60,000 she owes on credit cards and student loans. Is this true? ANSWER: No, it’s not true. But while getting married won’t cause your sterling record to be combined with your future wife’s, it does not mean that her poor credit won’t affect the ability of the two of you to get a mortgage or other type of credit in the future. Each of you always will have separate credit histories, even after the marriage. But, if the two of you jointly apply for a post-wedding home loan or other type of credit, the lender will consider both of your histories when deciding whether to approve or reject the application. That means that her

groom’s family for decades. Discuss your concerns with an attorney. ••• DEAR DAVE: My husband and I are getting divorced and have agreed on everything except what we will do with our house. I want to sell it, but he wants to rent it to tenants. Would it be possible to have the divorce finalized now and then deal with the house later? A: Yes, you can probably get the divorce completed now and figure out what to do with the home later. That’s because most states have a legal process called “bifurcation,” which allows a divorce to be finalized even if a couple’s real estate or other issues haven’t been resolved. Yet, bifurcating a divorce can cause a lot more problems than it solves -- especially when a longtime home is involved. Who would make the monthly mortgage payments while the financial details of the divorce continue to be negotiated? If the home is rented out, who will be responsible for finding a good tenant and how would the monthly

rental income be divided? And God forbid, what would happen if one dies after the divorce is granted but financial details of the split-up haven’t been worked out? The issue could take years in court to resolve. Your letter states that the two of you have already conquered most of the financial issues arising from the divorce, so you should probably avoid the bifur-

cation process and instead redouble your efforts to reach an amicable solution for the use or sale of your longtime home. Selling the house and dividing the profits would be the easiest option. If you remain at loggerheads, you can file a “partition” lawsuit that would ask a judge to order that the property be sold immediately, and the profits divided. – Cowles Syndicate

Our region really has only one standard of comparison for our current cold snap, the record breaker of 2011. Based on that event plus some solid scientific information on plant physiology, here are some things we might expect as our landscape comes out of this winter: The snow cover is beneficial, serving as a ground insulator and preventing even greater damage than if had we not had it. Small victories! Many perennial plants may survive but be very slow to come out of dormancy. When it comes to spring garden cleanup, hold off on removing something you assume has died as it may just need a few extra weeks to perk up. This includes everything from bermudagrass to herbaceous perennials to shrubs and trees. The plants that do survive may very well need some extra pruning to eliminate the dead branches (or in some cases the entire branch canopy), another reason to delay spring garden cleanup. Perhaps our most common landscape plants where this

may come into play will be the crapemrytles and holly families. We would not be surprised to see most of them die back to the ground with only the crown of the plant surviving. Broadleaf evergreens like southern magnolia, nandina, hollies, etc. may drop many of their leaves. Any that remain on the plant may also look dead. You can verify that the plant is still alive be gently scraping off the outer bark to expose the cambium layer. If it has any hint of green tint to it, the plant is still alive. Unfortunately, trees that were damaged in the ice storm may see additional damage as the ragged breaks and tears in the wood may have made them more susceptible to cold kill than we would normally expect. We don’t know for sure yet but we could very well see some significant winter kill on our bermudagrass lawns. Once again, snow cover is our friend here, but since it had already gotten cold before some of you received significant snow, this many vary

Why you shouldn’t want to be an executor “If you have other professionals involved – an attorney, a CPA, an investment person or wealth advisor – they’re doing most of the heavy lifting,” Weiss says. “Executors are like the quarterback in the administration of the estate.” Executors may also collect a fee, with the amount depending on state law or what’s specified in the estate documents. YOU MIGHT HAVE A TOUGH TIME FINDING ASSETS Even with help, executors should expect to spend many hours finding documents, inventorying assets and debts, arranging appraisals, communicating with financial institutions and government agencies, managing property and keeping careful records. If the estate includes a home, the house may have to be emptied of possessions and readied for sale. The less organized the estate, the more time it may take to track down assets. EstateExec CEO Dan Stickel said his father, who died at 69, rented

multiple storage sheds without telling his children where they were. Finding the various backyard sheds was challenging enough, but then they had to sort through the dusty contents. Those included piles of newspapers, battered furniture and several bars of silver bullion hidden under a dirty tarp. Even then, they missed something. The auction company Stickel hired to dispose of the rest of the sheds’ contents found a box containing $30,000 in savings bonds. Fortunately, the company returned the bonds to the family. YOU COULD BE SUED Executors have a fiduciary duty to the beneficiaries, which means the executor is required to put the beneficiaries’ interests first. People are typically advised to choose executors who are responsible, honest, diligent and impartial. “It’s an honor. If somebody asks you, it’s to say, ‘I trust you, and I trust you implicitly that you will handle my affairs in a way that’s

fair,’” Weiss says. But the fiduciary duty comes with potential legal and financial consequences. Executors can be held personally responsible for mistakes and other problems. For example, one child may remove items from a parent’s home that are bequeathed to another child. The heir whose items were taken could sue the executor for failing to secure the home. Executors also may have to make judgment calls, such as whether to spend the estate’s money to fix up a house for sale and if so, how much. Unhappy heirs can sue over those decisions, as well.

Given everything that can go wrong and the time commitment, people should think carefully about whether they really want the job before agreeing to be an executor, says CFP Kate Gregory of Huntington Beach, California, who has settled both her mother’s and her husband’s estates. Gregory says she would agree to serve again only if a family member asked, and only if there wasn’t likely to be a lot of conflict among the beneficiaries. Even then, she would want to see the will or trust documents to ensure there aren’t any unpleasant surprises that could

cause discord. She also would insist that the documents name alternates in case she can’t or won’t serve. No one can be forced to be an executor, but Gregory says she would feel better about saying “yes” if she knew there was a plan should she later say “no.” “I want to make sure that I could resign,” she says. Turn your quarantine clutter into money says. Other options? Give things away to family and friends. Donate to a local charity. And throw away items that have absolutely no use. TOO MANY TEMPTATIONS? SCALE BACK Once you’ve sold and donated what you can, fight the urge to impulse shop again. Keeping up your current habits could get you right back to where you started. One way to avoid that? Save first and buy later. This approach is the exact opposite of putting something on a credit card and paying it off after the fact, says Pam Horack, a certified financial planner and the owner of Pathfinder Planning LLC, based in Lake Wylie, South Carolina. Save money and wait to place an order until you can afford it in full. Horack says her family has a designated clothing account. When someone needs a new pair of shoes, the money comes from what they’ve set aside. You can do the same with a general spending account.

“If you don’t have money in that account, then you can’t buy it,” Horack says. “That needs to be your rule.” There are also ways to stay busy without spending much, if any, money. Here are some of Horack’s ideas: Redecorate your house by moving around your furniture. Spend time outdoors. Finish up projects around the house. You’ll spend less and accumulate less stuff. TOO EXPENSIVE? BUY USED But you can’t stop

shopping altogether. For things you absolutely need, consider buying on the same websites you used to make extra money. When you list products, you won’t sell them for as much as you originally paid for them. That means you can purchase things at a significant discount, too. Consumers have been buying and selling used during the pandemic, according to Sara Beane, media relations specialist at technology marketplace Swappa.

“Everybody is kind of strapped during this unprecedented time,” Beane says. For example, the site saw a rush on laptops around backto-school season. Search used marketplaces by model and condition of the item. You’ll find many price points to fit your budget. But before you hit the “buy” button, do some organizing, Wolf says. “If you have so much stuff that you can’t see what you have, then you’re going to buy more than you need.”

In some cases, you can deliver in person. To save time and effort, take your stuff to a local consignment store instead. You’ll likely make less, but the store does the selling for you.
