Spouse’s bankruptcy raises thorny issues There are several issues for married couples to consider when applying for a mortgage, especially if one of them has recently filed for bankruptcy protection. DEAR DAVE: I got married last year, and my husband and I would now like to purchase a house. My own credit score is very high, but my husband’s score is extremely low because he filed for bankruptcy shortly before our wedding. How will this impact our ability to get a mortgage? Do you have any ideas to improve our chances of getting the loan approved? ANSWER: Obtaining a mortgage today won’t be nearly as easy as it would have been a few years ago, when home prices in most areas were still rising fast and banks were willing to issue a loan to anyone who had a pulse. But the two of you still might be able to find the needed financing, provided that you’re willing to contact several lenders or can find a good mortgage broker. Banks usually charge a higher interest rate or fees to borrowers who have filed for bankruptcy in the past year or two, and some won’t loan to them at all. So a key issue
here is whether you should apply for the loan in your bankruptcy-free name only or if it would be better to apply as a couple despite your husband’s blemished credit record. Explain your situation to the lenders or mortgage brokers that you contact and ask them for two written quotes -one for the terms you would get if you applied for the loan jointly and the other for the terms that you would get by applying in your name only. If you would get a better deal by applying by yourself, you could take title to the property on your own and then add your spouse’s name to the deed after the transaction closes. Federal bankruptcy laws are complicated, made even more so by state regulations that can impact the rights of property owners and creditors alike. This means that your husband’s name should not go on the title -- whether you apply for the loan together or apply by yourself -- until both of you have talked with a lawyer to determine whether his creditors can slap a lien on the home to collect his unpaid debts. ••• DEAR DAVE: Is

So you’ve decided on a house and your closing day is set. That means you’re finished and can let out a big sigh of relief, right? Not so fast. Since your home most likely is the biggest purchase you’ll ever make, it’s best to make absolutely sure everything is as it should be before the keys are handed over to you. That’s where your final walkthrough comes in. A final walkthrough allows you to make sure the house you committed to buying is in the same condition as when you first looked at it and that everything is in working order. In essence, this is your chance to make sure your new home is absolutely ready for you. Usually, it’s just you and the real estate agent at the final walkthrough. Whatever you do, don’t rush through your final walkthrough. You may want to hurry up and “get to the finish line” of owning your home, but if you rush through this final step, you may overlook something you hadn’t seen before. Calling providers of monthly services to negotiate bills – whether it’s utilities, phone service, cable, internet, or auto insurance – can lead to meaningful savings, said McCallister-Young. Individuals can ask for the best rate, any available discounts,
rebates, or coupons that can lead to a lowered monthly fee. If a provider is competitive with other companies, there’s an even better chance of getting a discount, she added. “If you tell them, ‘I’m thinking of changing’ or that you’re shopping around, that helps – if they know you’re considering leaving, they’ll give you the best rate, and the goal right now is to find as much cashflow as possible,” she said. Check out federal programs such as the Low Income Home Energy Assistance Program, which helps cover bills, and Lifeline, which can assist with phone bills. If you are unsure if you qualify for any federal or state program, you can call 211, which will connect you with a local specialist who can assist you.
