812.010 Citation of Chapter.—

This Chapter shall be entitled "Street Vendors".

812.020 Scope.

The provisions of this Chapter shall apply to the area of St. Louis County outside incorporated cities, towns and villages.

812.030 Definitions.—

1. The term "street vendor" is defined as any person who engages in the sale of food or beverages from a motor vehicle as defined in Section 1201.030 (21), SLCRO 1964, as amended.

2. "Food" is defined as any edible substance which may be consumed or ingested.

3. The term "person" as used in this Chapter shall mean any natural person, firm, partnership, association, corporation or organization of any kind.

812.040 License Required.

A person shall not engage in the business of vending or peddling ice cream, frozen desserts, sherbets, ices or other retail food or beverages by means of a motor vehicle in St. Louis County without first having obtained a license for such vending or peddling.

812.050 Issuance of License Procedure.

The Department of Revenue, Division of Licenses shall be responsible for the issuance of street vendor licenses as required by this Chapter. Application for such license shall be made in writing to the Division of Licenses. Such application shall contain the name and address of the applicant, and a description of each vehicle proposed to be used for street vending as provided herein. Before a license shall be issued the applicant therefor must secure the approval of the St. Louis County Department of Public Health which shall inspect said vehicle or vehicles to determine whether or not said vehicle or vehicles conform with the requirements of Chapter 807, SLCRO 1964, as amended, relating to the operation of restaurants. There shall accompany such application a license fee of Twenty-Five Dollars ($25.00). Upon the issuance of such license, it shall be posted in a conspicuous place on said vehicle. Any license issued under the provisions hereof may be revoked by the Division of Licenses upon conviction of the licensee of a violation of any provision of this Chapter.

812.060 Noise Prohibited.—

A street vendor shall not use a gong, bell, whistle, or other sound producing device or other instrument to attract public attention between 10:00 P.M. and 8:30 A.M.

812.070 Outcries, Prohibited.—

It shall be unlawful for any street vendor whether licensed or not to cry out in any manner announcing that his product is for sale so as to attract public attention.

812.080 Impeding Traffic, Prohibited.—

A vending vehicle shall not impede traffic flow, nor violate any traffic or parking regulation of St. Louis County, Missouri.

812.090 Parking—Stopping Prohibited.—

It shall be unlawful for any person to park or stop a vending motor vehicle on any street, road or highway, when not engaged in transacting its business, except for an emergency.

Vending motor vehicles shall be stopped for sales at the extreme right hand edge of a street or roadway. When stopping for sales, vendors shall stop the motor of their vehicle and shall not sell any food or beverage unless the motor on said vehicle is inoperative, unless the operation thereof is essential to producing the product sold therefrom.

812.100 Certain Sales Prohibited.

It shall be unlawful to sell any food or beverage from a motor vehicle to any person standing in a roadway, street or highway.

812.110 Waste Disposal.

A motor vehicle used for vending food or beverage in St. Louis County shall be equipped with an adequate number of receptacles for disposal of waste and debris generated by sales to customers.

812.120 Health Regulations.

A person shall not operate a vehicle licensed by virtue of this Chapter and sell food or beverages to the public without first complying with the rules and regulations of the St. Louis County Department of Public Health relating to the operation of restaurants.

812.130 Miscellaneous Parking Regulations.

A motor vehicle used for vending food or beverages shall be:

(a) Parked at the right curb when legally stopped;

(b) parked at least 8 feet from any other vehicle that may be parked on any street;

(c) customers shall be served only at the curb side of said vehicle; and

(d) said vehicle shall not be parked within 100 feet of any intersection.

812.140 Lights Required.

All vending vehicles licensed pursuant to this Chapter shall be required to meet the minimum regulatory provisions of the State of Missouri and St. Louis County relating to lights which are required on motor vehicles as defined therein.

812.150 Vending Hours.—

It shall be unlawful to sell any food or beverages from a motor vehicle licensed pursuant to this Chapter or otherwise, from 10:00 P.M. to 8:30 A.M.

812.160 Penalties.

Any person convicted of a violation of this Chapter shall be punished by a fine of not less than $25.00, nor more than $500.00 or by imprisonment in the County Jail for not less than ten days, nor more than one year, or by both such fine and imprisonment.
