Tot 30 juni 2015 was er slechts een gerechtelijke instantie in Caribisch Nederland voor belastingzaken Dit betrof een tijdelijke voortzetting van de situatie in de Nederlandse Antillen, voorafgaand aan de staatkundige herziening van 10 oktober 2010 Belastingplichtigen konden dus niet in hoger beroep tegen een uitspraak van de belastingrechter als zi] het daarmee niet eens waren

Voor (fiscale) boetes met een straffend karakter is de verplichting om de mogelijkheid van hoger beroep te bieden neergelegd in een protocol bij het Europese mensenrechtenverdrag dat ook in het Caribische deel van het Koninkrijk der Nederlanden van toepassing is Pas vanaf 30 juni 2015 is in Caribisch Nederland het hoger beroep voor fiscale zaken opengesteld, nadat Aruba die mogelijkheid al met ingang van 1 januari 2015 instelde In de tussentijd hebben ook Curacao en Sint Maarten het hoger beroep in fiscale zaken ingevoerd In hoger beroep kan het geschil tussen de belastingplichtige en de belastingdienst integraal opnieuw worden bekeken

Legal protection in Caribbean Netherlands tax affairs now in line with European Netherlands Until June 30, 2015 there was only one judicial institution in the Caribbean Netherlands for tax affairs. This was a temporary continuation of the situation in the Netherlands Antilles, prior to the constitutional change as per October 10, 2010. Therefore, tax payers could not appeal against a tax court order if they did not agree. For (tax) fines with a punitive character the obligation to provide the possibility to appeal is regulated in a protocol belonging to the European human rights treaty that also applies to the Caribbean part of the Kingdom of The Netherlands Since June 30, 2015 appeal in tax matters has been enabled, after Aruba created this possibility already as per January 1, 2015 Meanwhile, Curacao and Sint Maarten introduced appeal in tax matters as well In appeal the dispute between the tax payer and the tax office can be reviewed entirely

As of July 1, 2016 it is possible in tax cases to initiate cassation proceedings before the Supreme Court of The Netherlands This means that judgments by court of appeal can be appealed to before the Supreme Court However, this only relates to judgments rendered by the court of appeal after June 30, 2016

An appeal in cassation means that a dispute is presented to the Supreme Court in order to determine whether the lower court have correctly applied the law The facts are not being investigated again though The Supreme Court bases its judgment on the facts as determined in appeal The Supreme Court is the highest judicial body within the Kingdom By providing for this possibility, the legal certainty of taxpayers has been enhanced further and no difference with the European Netherlands exists anymore regarding this aspect

The ground floor has three bedrooms - a queen room with 3/4 bath, a queen room and a twin room with a shared 3/ 4 bath . The master bedroom with king bed and full bath is on the second floor. A large living area, an open fully equipped kitchen with dishwasher, microwave and a dining table and a one-half bath complete the second floor. The kitchen and living area open to a large covered patio with table, barbecue grill and a large open deck. From here there is an unobstructed view of the Caribbean Sea, Klein Bonaire and the beautiful Bonairean sunsets. The lower level walks out onto a partially covered deck with a large fresh water swimming pool. A beautifully landscaped garden surrounds the house with a long private drive way.
