2020 Tumble Creek Club Member Referral Program New Suncadia, LLC (“Suncadia”), the developer of Tumble Creek at Suncadia (the “Community”), is proposing a Tumble Creek Club (the “Club”) member referral program subject to the conditions outlined herein (the “Referral Program”). Under the Referral Program, Suncadia will reward any Club member (the “Referring M ember”) that refers an acquaintance to Suncadia and that acquaintance (the ”Prospect”) (1) purchases a Developer homesite and (2) acquires and activates a Club membership prior to 12/31/2020. If the Prospect acquires and activates a Club membership no later than December 31, 2020, Suncadia will fund a Referring M ember Club Account Credit for the Referring M ember equal to $1,966.20. The Prospect must meet all the qualifications for Club membership including ownership of real estate within the Community and approval of the Prospect for membership by the Club. No referral credit will be granted if the Prospect does not purchase a Suncadia-owned homesite. Additional rules & conditions applicable to the Referral Program: 1. A Referring M ember must submit an official member referral form (the “Form”) to the Club General M anager (the “GM”) to be eligible for the Referral Program. 2. The Form may be submitted via email, mail or in person. 3. GM will record the date and time of receipt of the Form. 4. Only one referral credit paid per Prospect. If more than one Referring M ember refers the same Prospect, then the Referring M ember’s Form identifying such Prospect with the earliest date and time will get the credit provided for by this Referral Program. 5. The Referring M ember Club Account Credit will be applied to the Referring M ember’s account as a lump sum amount upon the activation of their Prospect’s membership. 6. Upon posting of the Referring M ember Club Account Credit, all charges to the Referring M ember’s account will be applied against such credit. This includes meals, apparel, services, food & beverage, etc. 7. This Referral Program only applies to the Prospect membership activated as a result of the Referral Program. It will not apply any future membership upgrades by the Prospect. 8. The Prospect’s membership has to be activated no later than 12/31/2020 for the credits provided by the Referral Program to apply. 9. A Referring M ember can submit an unlimited number of individual Forms. Only one Prospect can be identified on an individual Form. Individual Forms that identify more than one Prospect will not qualify for this Referral Program. 10. There is no limit on the number of Referring M ember Club Account Credits a Referring M ember can receive as long as each Referring M ember’s Prospect’s membership is activated no later than 12/31/2020
11. Referring M ember Club Account Credit may not be converted into cash and may not be refunded to the member if any balance remains at the termination of a member’s Club membership. 12. The credits granted under this Referral Program are subject to receipt by the Club of the credit amount from Suncadia. 13. Due to state laws, if anyone in a Club member’s household has an active real estate license, that member is ineligible to participate in the Referral Program. 14. The Referral Program is subject to compliance with all other state laws, and may be discontinued if found not to be in compliance. 15. The member agrees and acknowledges that the provisions of the Club M embership Plan will apply to any member participating in the Referral Program. 16. This Referral Program will terminate upon the close of business on December 31, 2020.
