Important Information Concerning Off Road Vehicle and ATV Use Restrictions in Suncadia May 15, 2018 The Boards of Directors of the Suncadia Community Council and Residential Owners Association adopted resolutions banning the use of all ATV’s and ORV’s – EVEN THOSE THAT ARE STREET LICENSED. This means RZRs, side by sides, etc. If the vehicle does not have a unrestricted license plate such as would be used on a car or truck, then it does not qualify. Motorcycles are exempt and may be used on the roads but not off road or on trails. (Golf, Association service vehicles and governmental vehicles are exempt while performing work services.) Any vehicle with the plate below whether or not it has an on-road tab is no longer allowed on the streets of Suncadia or Tumble Creek.
No motorized vehicles are allowed off road anywhere in the Resort. This includes the area beyond the gate on Swiftwater Dr. in Nelson Preserve. As stewards of this land, we also are obliged to take action to preserve our native and conservation areas. The Revised Policy of Washington (RCW) 46.09.455 and Kittitas County Ordinance 2014-006 limit which public roads (and the manner of operation) licensed ATV, ORV and other off-road vehicles may be operated. Suncadia roads are private and are not directly addressed by RCS 46.09.455 nor Kittitas County Ordinance 2014-006. The Amended and Restated Declaration of Covenants and Easements for Suncadia Residential Areas (CC&R), do address the use of Suncadia roads in Section 7.6, Prohibited Vehicles, which provides that “Except to the extent specifically authorized in the Policies and Procedures, snowmobiles, golf carts and other off-road vehicles may not be operated within the Community Improvements.” Section 7.5 lists enforcement remedies and includes “suits for injunctions” and for “specific enforcement.” Therefore, it is the right of the Board to take actions to prohibit the use of all ATVs, ORV’s and other off road vehicles and to impose fines and penalties for violation of this Resolution. Use of ANY ATV, ORV, or other vehicle cited in CC&R Section 7.6, within the Suncadia Residential Areas is strictly prohibited (except to extent such use may be provided for under RCW 46.09.455(3)). This includes any such vehicles with an on-road tab or license. Violators may be subject to a Restraining Order and a Fine (see current Schedule of Fines). | DULY ADOPTED by the Board of Directors on May 7, 2018.
