SC verdict has many messages

T he Supreme Court has set the controversy regarding the death of judge Loya at rest by ruling that he died a natural death and there were no grounds to suspect foul play. A bench headed by Chief Justice Dipak Misra also found the petitions demanding a probe into the judge's death as attempts to scandalise the judiciary. In fact, the court came down heavily on the petitioners for making a "veiled attempt to launch a frontal attack on the independence of judiciary". Their action was tantamount to contempt of court, but the bench said it was giving them a reprieve by not proceeding against them. The reference to the 'veiled attempt' set off an instant slugfest, with BJP attributing it to Congress, which under the leadership of Rahul Gandhi had taken a delegation to President Ramnath Kovind to demand an independent probe into the judge's death. Congress described the day of Supreme Court verdict as a 'sad letter day' in the history of the nation and reiterated its demand for a fair probe into the 'mysterious circumstances', about which it said those who believe in the judiciary still have questions to be answered. The verdict also had a clear message for the mutineering judges, under the leadership of Justice Chelameswar, who held an unprecedented 'call of conscience' press conference alleging questionable procedures being followed by Chief Justice Misra in sensitive cases. The judges had talked about instances where cases having far-reaching consequences for the nation and the institution had been assigned selectively to benches without any rational basis and warned that the tendency must be guarded against at all costs. Although a specific mention was meticulously avoided, Justice Loya's case was central to the presser, which raised serious doubts in the public mind about the independence of judiciary in India. By striking down the very basis of the foursome's grievance, the 3-member bench has poured cold water on the simmering discontent, which at one stage threatened to vertically split the judiciary. Congress and the Left parties have even initiated a move to impeach the Chief Justice following the controversial press conference. The court also issued a stern warning against political parties and others using the court to fight out their own battles. The judges said that business rivalries must be resolved in the market and political rivalries settled in the 'hall of democracy' and that it is the court's duty to protect law. The abuse of PIL for frivolous reasons has been a recurring theme in judicial debates. Senior lawyers such as Shanti Bhushan, Indira Jaising and Dushyant Dave are bound to feel hurt by the general observation, but examples of misuse of the great mechanism of PIL are a dime a dozen.

New Delhi: The Reserve Bank is expected to recoup forex reserves despite India being put on currency manipulator watch list by the US, says a report. According to BofA Merrill Lynch Global Research report, RBI will follow an asymmetric forex policy of buying forex when the USD is weakening and allowing Rs 65-66/USD when it strengthens. "We continue to expect the Reserve Bank of India (RBI) to recoup forex reserves if it can, despite being put on the US Treasury Report's currency manipulator watch list," the report noted. Last week, the US added India to the currency practices

and macroeconomic policies monitoring list, saying New Delhi increased its purchase of foreign exchange over the first three quarters of 2017, which does not appear necessary. India is the sixth addition to the watch list which comprises China, Japan, South Korea, Germany and Switzerland. According to the authorities' data, India has generally been a net purchaser of foreign exchange since late 2013, when the RBI sought to build a stronger external buffer in the wake of large emerging market outflows globally. The global brokerage cited three reasons for the RBI to recoup forex

reserves. Firstly, forex reserves are inadequate. Secondly, RBI's forex intervention is unlikely to touch 2 per cent of GDP required to be named currency manipulator; and thirdly, the government will also likely want the RBI to accumulate forex reserves to maintain a stable INR. According to BofAML forex strategists, rupee is expected to be around Rs 64.25 per USD in December. The rupee on Thursday depreciated 15 paise to 65.81 against the US dollar in opening trade at the interbank forex market on Thursday on increased demand for the greenback from importers and banks.

Time not ripe for large scale privatisation of PSBs: SBI Chief New Delhi: Time is not ripe for large scale privatisation of public sector banks (PSBs) given the current socio-economic conditions in the country, SBI Chairman Rajnish Kumar said on Thursday. Privatisation has not always worked well, and ownership does not matter as there are both good and bad companies in both private and public sectors, he said. "On banking, my view is that the social economic conditions in India as of now are not ripe for large scale privatisation of the banks. "May be, you will reach that stage of development in next 50 years if you continue to grow at the pace at which we are growing," Kumar said at the Mindmine Summit 2018 here. Ahmedabad : Vadodara-based businessman Suresh Bhatnagar and his two sons, Amit and Sumit, who were arrested on Tuesday night in connection with Rs 2,654-crore bank fraud, had reportedly checked in as “Vermas” at a hotel in Udaipur, Rajasthan. The three, promoters of Diamond Power Infrastructure Limited (DPIL), had been evading arrest since March 26 when they were booked by the CBI for allegedly cheating a consortium of 11 banks “by falsification of accounts, creation of false documents, forgery of records etc”. “The

remanded them to CBI custody till April 27. The CBI had sought 14 days of custody, arguing that the accused were absconding for the past 10 days and despite several notices they remained incognito following which non-bailable warrant was issued against them. The CBI has alleged that the company, which is engaged in manufacturing cables and other electrical equipment, fraudulently availed credit facilities from a consortium of 11 nanks, public and private both, since 2008, with an outstanding amount of Rs 2654.40 crore as on June 29, 2016.

Rajkot : A month after she was born, the baby girl delivered by 11-year-old rape survivor died after a brief treatment at a government hospital in Rajkot on Wednesday. The infant had congenital defect. The baby girl was handed over to an NGO in the city early this month after the rape survivor’s family refused to claim her custody. “The staff of the NGO rushed the baby girl to hospital this afternoon after her condition worsened. The North is expressing a will for a complete denuclearisation,” Moon said during a lunch with chief executives of Korean media companies. “They have not attached any conditions that the U.S. cannot accept, such as the withdrawal of American troops from South Korea.
