Govt. rule barring 2nd marriage not violative of Article 25: SC NEW DELHI A government employee cannot take refuge under Article 25 of the Constitution dealing with right to profess religion, to challenge rule barring polygamy, the Supreme Court held today. The apex court said the Conduct Rules of the Uttar Pradesh government for its employees, which mandates prior permission for contracting second marriage during the existence of the first marriage, is not violative of Article 25 of the Constitution. The court was dealing with an appeal filed by a Muslim employee in UP's Irrigation Department challenging a disciplinary authority order removing him from service for proven misconduct of another marriage during the existence of the first marriage, which was upheld by Allahabad High Court. Holding that there was no need to interfere with the

High Court's finding on "proven misconduct", a bench comprising justices T S Thakur and Adarsh Kumar Goel said his contention that such rule was violative of Article 25 was answered by the apex court in Javed vs State of Haryana matter. In this case, it was held that what was protected under Article 25 was religious faith and not a practice which

may run counter to public order, health or morality. "Polygamy was not integral part of religion and monogamy was a reform within the power of the State under Article 25. This Court upheld the views of the Bombay, Gujarat and Allahabad High Courts to this effect. "This Court also upheld the view of the Allahabad High court upholding such a

The revelations are the latest embarrassment for HSBC, which is facing investigations into the past activities of its Swiss unit by the authorities in Argentina, Belgium and France, and which is thought to be facing a similar inquiry in the United States. In a long response, HSBC said that the lender’s Swiss operations “have undergone a radical transformation” in recent years and that tax reporting obligations in the past had fallen to individuals, rather than to their banking institutions.

Delhi election results: AAP confident, BJP cautious The Aam Aadmi Party, rocked by allegations of accepting donations from dubious sources, is set to emerge as the single largest, with its leader Arvind Kejriwal still people’s first choice as chief minister, two separate surveys have found. An ABP News and Nielsen opinion poll predicted that AAP will win in 35 of Delhi’s 70 constituencies. The survey was conducted after interviewing 6,396 respondents between January 25-31 and assumed a margin of error of five percent. The opinion poll projected AAP as the probable winner in Delhi, with a narrow margin victory – just 50 percent of the total Delhi constituencies and 37 percent vote share. BJP is close behind with 29 seats and 33 percent vote share, according to the opinion poll. The party that led Delhi for 15 years – Congress – is facing a rout with six seats and 18 percent of the vote share. The survey also suggested that Kejriwal is the mostpreferred chief ministerial candidate and that BJP’s choice to push Kiran Bedi as CM is not helping the party get additional votes. The stage is all set for counting of votes for Delhi Assembly on Tuesday. Election Commission has made all the necessary arrangements and candidates are anxiously awaiting for the results of the fiercely-contested election. The mood is upbeat in Aam Aadmi Party with the exit polls saying that it will win the polls to 70-member assembly. Bharatiya Janata Party workers appeared apprehensive due to exit poll results predicting a defeat but party leaders have expressed confidence about a comfortable victory. The Congress appears reconciled that it will finish third and party leaders are hoping its tally is not worse than eight it won in the 2013 election. The Election Commission has made elaborate arrangements for counting across 14 centres in the national capital. Counting will start at 8 a.m. and a picture about the likely winner is expected in the next two hours. Though it is a working day for residents of the capital, the trends are expected to be closely followed on radio, television and the web. The result will have wider political ramifications, particularly for the BJP, which is the party in power at the centre and has had a good electoral run since the Lok Sabha election. Over 10,000 security personnel, including from the paramilitary forces have been gaurding 20,000 electronic voting machines (EVM) which contain the votes cast in Delhi polls Saturday. With margins expected to be slim on many seats, political parties have asked their candidates to keep a close watch on counting and immediately raise any suspicion. Volunteers of AAP have been keeping a roundthe-clock watch outside some centres where EVMs have been kept. The process of counting will be video graphed.AAP leader Arvind Kejriwal, who spent a relaxed day Sunday and watched a movie with some party leaders, Monday met party workers and volunteers from New Delhi seat which he is contesting. AAP workers have planned massive celebrations ahead for anticipated victory. Stages have been erected outside the AAP office in East Patel Nagar for the media and volunteers.
