Supreme Court refuses to entertain Tamil Nadu’s plea on Cauvery

New Delhi: The Supreme Court on Friday refused to entertain the fresh application from Tamil Nadu to direct Karnataka to release 63 tmcft of water being the deficit quantity upto November 15 this year pending final verdict. When counsel Shekar Naphade along with G. Umapthy made a mention before a Bench of Chief justice Dipak Misra and Justices A.M. Kanwilkar and D.Y. Tamil Nadu government mulls extending deadline for regularisation of buildings

CHENNAI: The Housing department is mulling extending the deadline for the regularisation of buildings with violations, owing to no takers for state government’s clemency scheme that was announced to help building owners to get an exemption from implications. This comes in the wake of the window for the much talked about ‘113-C scheme’ closing on December 21.According to a housing department official, there are nearly 5 lakh buildings with building rules and plan violations in Tamil Nadu, of which nearly 1.5 lakh buildings are located in the Chennai metropolitan area (CMA). The scheme has received poor response from the building owners. To enable more to apply under this scheme, the department is contemplating extending the deadline by a further 6 months, the official added.The state government had appended 113-C section to Tamil Nadu Town and Country Planning Act, 1972 by adhering to a High Court direction. The sixmonth scheme, which is ending on December 21, was rolled out on June 22. “In Chennai metropolitan area, only 30 applications are received against 1.5 lakh violated buildings. So, the idea of extending the deadline for 6 more months is on the cards. Penalty and regularization fees will also be reduced and an announcement in this regard will be out soon”, an insider said.

Andhra Assembly passes bill to grant 5 per cent reservation to Kapu community Amravati: The Andhra Pradesh Assembly on Saturday unanimously passed the Kapu reservation bill to give 5 per cent reservation to the Kapu community in education institutions and government jobs. The state cabinet had given a nod in this regard on Friday based on the report submitted by the Manjunath Commission.The state cabinet has decided to include the Balija, Ontari and Telaga communities in the Backward Castes (BCs) and provide them 5 per cent reservation in weducation, employment and welfare schemes. The state government will now send the bill to the Centre as the move to grant 5 per cent quota to Kapus exceeds the 50

per cent reservation limit mandated by the Supreme Court, said Andhra Pradesh Chief Minister N Chandrababu Naidu. The Bill will be first sent to the governor and then to the Union Home Ministry. “As 5 per cent of reservation to Kapus makes total reservation exceed 50%, central govt nod is compulsory. We will send this bill to the centre. We ask them to include this reservation in schedule 9, so that it will become legitimate,” said Naidu. Naidu told the Assembly that the Kapu community said it does not need political reservation. They just demanded quota in education and employment sectors.

Accident-prone: the apathy over enforcing road safety rules

The most effective measure to keep roads safe is enforcement of rules with zero tolerance to violations. But as anyone who uses India’s roads knows only too well, that is not an administrative priority. Even the periodic directions of the Supreme Court in a public interest case, Dr. S. Rajasekaran v. Union of India, have not produced any dramatic change in the official attitude. In spite of the court setting up the Committee on Road Safety and appointing an amicus curiae to help implement its recommendations, it is mostly business as usual for the police in enforcing road rules, for engineers tasked with forming roads and pavements, and transport officials in charge of licensing. The death of 1,50,785 people in accidents in 2016, which represents a 3.2% rise over the previous year, indicates the scale of the challenge. Fortunately, the orders of the court now provide actionable points with deadlines for implementation. Governments should be called to account on these, and civil society must ensure that they act without compromise. The most important among these is the Road Safety Action Plan that each State and Union Territory must announce by March 2018, and roll out after giving due publicity. But police forces and transport bureaucracies need not wait for formalisation of the plan, and should start enforcing rules relating to lane-based driving, using CCTV cameras to penalise offenders, and conducting safety audits along with experts. The absence of a scientific approach to accident investigation in India remains a major factor in fixing responsibility. This was pointed out by the Sundar Committee of the Ministry of Road Transport in 2007, but other than a failed attempt at creating a National Road Safety and Traffic Management Board, no real effort has been made at reform. The orders of the Supreme Court provide a road map, and the direction to States to form a District Road Safety Committee headed by the Collector before January 31, 2018 should ensure that someone is accountable when citizens file complaints on hazardous conditions. It bears pointing out that the court-appointed Committee on Road Safety has written to States on the need to prosecute every case of driving under the influence of alcohol and drugs, seeking imprisonment and fine, and to treat driving on the wrong side of the carriageway as an offence under Section 279 of the Indian Penal Code, which can lead to imprisonment, and not merely under the Motor Vehicles Act. Stringent penalties have a lower chance of being imposed, compared to fines that are proportionate to the offence. Yet, even the existing minor penalties are not being imposed, and road conditions remain hazardous due to poor engineering. This is proof of the apathy of the system. It’s time to shake the system out of its indifference.

New Delhi: Reversing a twoday slide, gold prices rose by Rs 250 to Rs 30,500 for 10 grams at the bullion market on Saturday, largely driven by a firm trend overseas amid pick-up in buying by jewellers at the domestic spot market. Silver, however, continued its fall and lost another Rs 50 to Rs 39,150 per kg owing to reduced offtake by industrial units and coin makers. Bullion traders attributed the recovery in gold prices to a firm trend overseas as the weakness in dollar boosted demand for the precious metal as a safe-haven. Globally, gold rose by 0.39 per cent to USD 1,279.60 an ounce in New York on Friday. In addition, increased buying by local jewellers to meet ongoing wedding season demand fuelled the uptrend, they said. In the national capital, gold

of 99.9 per cent and 99.5 per cent purity rebounded by Rs 250 each to Rs 30,500 and Rs 30,350 per 10 grams, respectively. It had lost Rs 270 in the previous two days. Sovereign, however, held steady at Rs 24,700 per piece of eight

East India Company took over Ahmedabad exactly 200 years ago AHMEDABAD: Today will mark 200 years of the British East India Company taking over administration of Ahmedabad from the “disastrous” Gaekwad-Peshwa rule in 1817.Five years before this takeover, Ahmedabad experienced its worst ever problems of pestilence and famine, according to the Bombay Gazetteer of 1818.In 1811, diseased and famine-stricken people crowded in to the city from Marwar and Kathiawar regions, where crops were damaged by locusts. This was followed by a drought and grain prices rose to “famine pitch”.“A pestilence broke out and raged with such violence that half the people of the city are said to have died, and though houses were pulled down for their timber, the bodies of the dead had to be left halfburnt,” claims the 1818 gazetteer. “On October 23, 1814, Ahmedabad’s administration plunged into disorder. Though the Gaekwads were running the administration by paying the British Rs 5 lakh per annum as lease under the Grant Duff agreement, the insecure Peshwa appointed SarSubedar Trimbakji Dengla who sent his troops to take charge of the city.
