National Court of Appeal regional benches rejected by Modi government

In a setback to lakhs of people in far-flung southern, eastern and western states, the Modi government has rejected fresh demands for setting up a National Court of Appeal (NCA) with regional benches in major cities to hear appeals against orders of high courts. Now it is up to the Supreme Court to take a stand on the issue. Acting on a PIL, which demanded regional benches, the Supreme Court in October 2014 had asked the ministry to take a stand on the issue by April 2015. Shrinagar / Jammu In yet another violation of the bilateral ceasefire, two Indian Army jawans were killed and two other security personnel were injured in a fresh case of cross-border firing by Pakistan Rangers in Tanghdar sector of Jammu and Kashmir on Saturday. "Two soldiers were killed in a blaze triggered by rocket propelled grenades fired by Pakistan at Indian Army bunkers along the Line of Control (LoC) in Jammu and Kashmir Saturday," police said. "The Pakistan Army fired RPGs towards a post of the Indian Army in Tangdhar sector. A blaze was triggered in the tall dry grass around two bunkers of the Indian Army due to these RPGs that quickly engulfed the bunkers," the official added, IANS reported. According to news reports, the injured were flown to a Srinagar hospital. This is the ninth such incident of ceasefire violation in the last ten days. Due to the heavy shelling

The new body, conceived more in the nature of a think-tank that will provide strategic and technical advice, will be helmed by the Prime Minister with a Governing Council of Chief Ministers and Lt. Governors, similar to the National Development Council that set the objectives for the Planning Commission. The NITI Aayog seeks substitute centralised planning with a ‘bottom-up’ approach where the body will support formulation of plans at the village level and aggregate them at higher levels of government. In short, the new body is envisaged to follow the norm of cooperative federalism, giving room to States to tailor schemes to suit their unique needs rather than be dictated to by the Centre. The needs of a State such as Kerala with its highly developed social indicators may not be the same as that of, say, Jharkhand, which scores relatively low on this count. One significant change of note is that one of the functions of the body will be to address the needs of national security in economic strategy. Nowhere is this more relevant than in the area of energy security where India, unlike China, has failed to evolve a coherent policy over the years. Similarly, networking with other national and international think-tanks and with experts and practitioners, as has been envisaged, will add heft to the advice that the NITI Aayog will provide. To deflect criticism that this will be a free-market institution that ignores the deprived, the government has taken care to make the point that the body will pay special attention to the sections of society that may not benefit enough from economic progress. How this operates in practice will bear close watching. Interestingly, though it will not be formulating Central plans any more, the NITI Aayog will be vested with the responsibility of monitoring and evaluating the implementation of programmes. Thus, while the advisory and monitoring functions of the erstwhile Planning Commission have been retained in the new body, the executive function of framing Plans and allocating funds for Plan-assisted schemes has been taken away. But who will now be responsible for the critical function of allocating Plan funds? Hopefully, there will be greater clarity on this aspect in the days ahead.

A new study has revealed that arthritis patients can beat their agonizing pain by exercising three hours a week. Finance minister promises more autonomy to PSU banks

PUNE Finance minister Arun Jaitley on Saturday termed the level of bad assets in the system as "unacceptable" and promised more autonomy for state-run banks to run business with a "commercial mindset". "There are unacceptable levels of NPAs (nonperforming assets) in some cases and the banks have to be given a sufficient amount of leeway ... to deal with commercial issues with a commercial mindset," Jaitley told reporters on the sidelines of a two-day bankers' retreat here. The finance minister said there is a

need to bring about changes in many areas in state-run banks, including giving "far greater autonomy" and allowing them to hire the best talent. The two-day banking conclave, which started on Friday, is being held at a crucial time when India is moving towards accelerating the pace of growth, he said. The government, which a majority owner in 27 public sector banks, that control over 70 per cent of the system, wants to hear the problems plaguing the sector from the bankers and external experts as "they know the best where the shoe pinches", he said.

Racial slur can land you in jail for five years

If the home ministry’s proposal of changes in the Indian Penal Code (IPC) comes through, a racial slur can now land you in jail for five years. According to the proposal, derogatory remarks related to race, culture or physical appearance can attract the sentence. Home Minister Rajnath Singh said the Ministry of Home Affairs (MHA) is looking into the proposal, which was made by a highlevel committee that looked into the attacks on people from the North- East.

Twitter has launched a new ‘while you were away’ service which recaps important tweets users may have missed since their last login. The new feature includes what the micro blogging site thinks to be the best tweets to the top of a user ’s timeline the next time they open their Twitter account, The Guardian reported. It works like Facebook’s news feed that presents status updates and posts in a ranked manner. It is the first major Twitter feature beyond promoted tweets and adverts to sort tweets in a non-chronological fashion, the report added.

“Every time you open the Twitter app, you’ll see something great,” Twitter said when it announced the new feature as part of its “Timeline Highlights” improvements. The new feature aims at preserving important tweets that

could get drowned out by the rapid flow of tweets on a daily basis. More than 500 million tweets are sent a daily basis, with many users following hundreds of accounts. Whereas Facebook has 1.3 billion users to Twitter’s 284 million.

Hamas condemns alleged shooting of Gazan by Egyptian guards An Egyptian security official said that troops opened fire on Gazans who had illegally crossed into the Egyptian Sinai, where the army has created a buffer zone to prevent the movement of militants. "Soldiers charged with protecting the frontier fired at six Gazans, of whom three succeeded in returning to Gaza while three were arrested. One was probably hit by the fire," an official said. Gaza emergency services spokesman Ashraf alQudra said that Houbi was 17 years old. He was killed in the Gaza frontier town of Rafah by Egyptian soldiers firing from across the border, Qudra said. The border troops shot the youth "in the back and the bullet settled in the heart. He died on the spot," he told AFP. He was the first Palestinian "to have been killed in a long time" along the

border between the Gaza Strip and Egypt, according to Qudra. An eyewitness told AFP that Houbi and three others scaled a concrete wall on the border hoping to find work on the Egyptian side. His mother, Sarah alHoubi, 35, said that he had "left home to look for work" adding that her husband was unemployed and the family stricken by the poverty rampant in Gaza. She said that he was not a member of any militant group and had tried

Egypt announced on Tuesday that work to double the width of a buffer zone along the Gaza border would begin next week to prevent militants infiltrating from the Palestinian enclave. The party also slammed the BJP for making a "volte-face" as the party had "supported" the clauses, that are being "diluted" now, when the previous UPA government moved the Bill in Parliament. "The government is diluting the 2013 Land Acquisition Act, a product of prolonged struggle by the farmers of the country, by introducing changes through the back door which will impact

thousands of farmers across the country," Yogendra Yadav said. "Ministers in the government like Rajnath Singh and Sushma Swaraj had in fact supported the very clauses, like the provision of consent and Social Impact Assessment. historic step: Parkash Singh Bada Hailing the replacement of Planning Commission with NITI Aayog, Punjab Chief Minister Parkash Singh Badal on Saturday termed it a "historic step" and said it will implement "real federal structure" in the country. Badal said the "unprecedented" step will ensure more participation of states in the policy-making framework. "With the formation of NITI Aayog, the chief ministers will have more involvement in the planning process, which will give boost to the overall development of the country and prosperity of its people," Badal said here on Saturday. He alleged that chief ministers of various states, who are better connected at the grassroot level, were hitherto ignored while framing policies at the national level. He alleged that there was "excessive centralisation of powers" during Congress-run governments at the Centre. During the governments run by Congress at the Centre, the states had hardly "any say" in policy formulation, which resulted in "lopsided" development of the country, he alleged. Citing

an example, Badal said the top brass of erstwhile Planning Commission was not even aware of the problem of waterlogging in some areas of Punjab then how could they allocate the required funds for mitigating the woes of people residing in these areas. "Prime Minister Narendra Modi deserves applause for taking this visionary decision, which will transform the destiny of the countrymen," he added. On January 1, the 65-year-old Planning Commission was replaced by a new body, NITI Aayog or National Institution for Transforming India, which will serve as a policy thinktank for the central as well as state governments and have Prime Minister

Crime branch to probe theatre vandalism case AHMEDABAD The complaints of vandalism at two theatres screening Aamir Khanstarrer 'PK' have been handed over to the city crime branch. AHMEDABAD Kutiyana MLA and the son of 'godmother' Santokben Jadeja, Kandhal Jadeja, has moved Gujarat high court urging that charges be dropped against him in a 1998 arms case in Porbandar district. The HC stayed the trial court from framing charges against Jadeja for possessing a weapon. Jadeja moved HC after two courts in Porbandar declined to drop charges under Section 25(1) of the Arms Act against him. He is facing charges along with others, and the prosecution is relying on a confessional statement by one of the co-accused, who was in police custody when the statement was recorded. Jadeja's case is pending before Porbandar's chief judicial magistrate since 2000. He filed application for discharge and claimed that there was no evidence against him and the confession of another accused is not admissible evidence. Moreover, there was no recovery of

firearms. The magisterial court rejected Jadeja's plea in September 2014, which led him to move a sessions court. The sessions court too rejected Jadeja's application in November 2014, after the prosecution argued that there was sufficient grounds to frame charges against Jadeja. The confession of co-accused Hasmukh Sidi is admissible evidence under Section 10 of the Indian Evidence Act. There was a panchnama drawn about recovery of weapon in the

presence of two witnesses. The judge said that the admissibility of evidence is subject to trial and is a mixed question of facts and law. The court also accepted the prosecution's argument that Jadeja is a sitting MLA and therefore, all criminal proceedings were required to be conducted expeditiously on a day-to-day basis. However, HC has stayed framing of charge till it decides on Jadeja's discharge application. Further hearing is kept on Jaunary 22
