Congress terms protests as handiwork of BJP men

Congress vice-president Rahul Gandhi, who had come to `share grief ‘ of floodravaged people in Banaskantha district, was greeted with stones, black flags and boos, triggering a bitter war of words between the Congress and BJP leaders on Friday. The glass pane at the rear of Gandhi’s car was broken after a stone was hurled when he was on way to the helipad from Lal Chowk in the worsthit Dhanera town. The attack broke the glass but Gandhi escaped unhurt, leaving shards of glass pieces in the SUV. His address to people in Lal Chowk was also interrupted with slogans of “Modi Modi’, forcing the Gandhi scion to cut short his speech. Reacting to the protests, Gandhi later said in Runi, where 17 of a family had died, “First they showed black flags and then threw stones at our cars. When they again waved black flags, I got down from the car and went towards them. But they ran away. The truth is they are cowards.“ “Those who understand truth shouldn’t fear anything. This is what Mahatma Gandhi has taught the world. We are not going to back off due to black flags or Modi slogans. I have only come here to share your grief.“ he said, adding that the party will raise people’s plight in the Parliament. Hollywood-Bollywood Judwaa 2 actor Taapsee Pannu: Both hardhitting and commercial films are not easy Agency | New Delhi

Taapsee Pannu says people always overlook the effort it takes for an actor to appear convincing while dancing on a beach, fully decked-up. The actor says commercial films may not be as emotionally draining as intense dramas, but they do demand a certain kind of physical effort from actors. In an interview, Taapsee says, “Having done both commercial and hard-hitting cinema, I can say none of them are easy. In commercial films, you do get the privilege to not get into that intense zone. But looking like a million

bucks onscreen is not effortless. “No matter how beautiful actors are, it is not easy to look drop dead gorgeous in every shot in a commercial film. To carry yourself as if you are the diva, it is not an easy job.” The actor says “dancing on the beach in heels or around the trees, no matter how much fun we make of it, it is not a simple thing to do.” Taapsee, 30, who made a mark with her hard-hitting performances in Pink and Naam Shabana, will next be seen in romantic comedy Judwaa 2. The bubbly girl role from Sasural Genda Phool brought Ragini Khanna a lot of popularity but the actor says it also pigeon holed her as a performer. Khanna, who is making her film debut with Gurgaon, says she hopes the Shanker Raman-directed movie helps her move beyond her established image. “After Sasural Genda Phool, I only got parts in TV that required me to play the happy bubbly girl. So, I was like, ‘Why can’t people see me as an actor?’ and ‘Why are they just so stuck with

the image?’ Because when I did Radha Ki Betiyaan… or Bhaskar Bharti, they were way different characters than Suhana,” Khanna said. The actor says she knew that she had a lot more to her as an actor than just playing the chirpy characters. And that is when Gurgaon happened to her. The film, featuring Pankaj Tripathi and Akshay Oberoi, is a dark family thriller. “This was the film I was looking for. Because I wanted to challenge myself as an artiste and I wanted to tell people that Suhana was not Ragini Khanna. Rag-

ini is an artiste. She is capable of doing all the other parts as well as Suhana.” Talking about her character Preet, Khanna, 29, says, “She is the only person in the family who Kehri Singh (Tripathi) adores and loves.

A number of Bollywood stars have come under the scrutiny of the CAG which has detected at least 156 cases of non-compliance to rules and short payment of service tax during the course of its audit of the service tax department with revenue implication of more than Rs 50 crore. A CAG report, tabled in Parliament on Friday , has pointed out anomalies in collection of service tax from Salman Khan, Ranbir Kapoor, Ajay Devgn, Riteish Deshmukh and Arjun Rampal.

While the service tax authorities have told CAG that it has served show cause notices to Devgn, Deshmukh and Rampal, the department has not yet clarified as to what action it has initiated against Salman Khan for the short payment of the levy. “During the examination of records of Salman Khan, Arjun Rampal, Ritesh Vilasrao Deshmukh and Vishal (Ajay) Devgan in in the Mumbai service tax commissionerates, we observed from the agreements between producer and actors that the pro-

32 yrs on, HC orders compensation Forget ‘king can do no wrong’; for death in Army firing this is India, HC tells govt of his home to dry

SS News | Ahmedabad

The Gujarat high court on Friday ordered the state government to pay compensation for the death of 22-yearold Ghulam Rasul Rathod, who was killed in Army firing when the Rath Yatra was passing through Dariapur on June 30, 1985. The compensation is Rs 90,000 with 7% interest since 1986. The high court observed that the state government cannot shirk its responsibility and claim “sovereign immunity“ for the Army’s action by insisting “King can do no wrong“. Rathod lost his life to an Army bullet when he went to the terrace

a quilt. He was not part of the mob pelting stones on the Rath Yatra. The Rathod family fought a legal battle for compensation for 31 years. After a civil court dismissed the case, the family moved the high court. The appeal was turned down in 1996 by a single-judge bench. The order was challenged before a division bench; two judges differed in their opinions in 2011. While Justice S R Brahmb hatt held that the government was not liable to compensate for the death, Justice Jayant Patel concluded that Army’s assis-

tance was sought by the state government to protect the Rath Yatra, which was held without permission in curfewbound areas. And hence, the government was liable for any act committed by the Army .Justice Patel fixed the compensation amount at Rs 90,000. Following the split verdict, the case was referred to a third judge, Justice J B Pardiwala, who concurred with Jus-

tice Patel and directed the government to pay the compensation. In coming to this conclusion, the judge observed that the government could not supply evidence to establish that sto ne-pelting took place at Sajjan Jamadar’s Mohalla, where the victim lived. The court concluded that Army fired indiscriminately , without warning, to disperse the crowds.

Gujarat high court on Friday slammed the state government for resorting to archaic British laws to shirk responsibility for a negligent act of the Army and reminded it that India now is a welfare state and no more under colonial rule. Justice J B Pardiwala discarded the argument put forth by the state government, that the act committed under the sovereign authority has immunity.“Although the maintenance of Army is a sovereign function of the Union of India, yet it does not follow that the Union is immune

from all the liability for any tortious act committed by an army personnel,“ the HC said while holding that the government was liable to compensate the death of Gulam Rasul Rathod of Dariapur during the 1985 Rath Yatra procession, because the Army opened fire on orders from the magistrate deployed by the state government. The HC pulled up the state for claiming immunity from liability for the firing. “The old and

archaic concept of sovereign immunity that the `King can do no wrong’ still haunts us, where the state claims immunity for its tortious acts and denies compensation to the aggrieved party ,“ Justice Pardiwala said, adding that Australia also ignores the doctrine of sovereign immunity . The judge further said, “The government’s defence based on the old and archaic concept of sovereignty immunity as borrowed from

British jurisprudence prevalent during colonial rule is based on old feudalistic notions of justice, namely the “King can do no wrong“. This common law immunity does not exist in the realm of welfare state and is against modern jurispruden ce where the distinc tion between sovere ign or non-sovereign power does not exist and the state like any ordinary citizen is liable for the acts done by its employees.“

They are not fully comfortable with each other. This is what one can guess from the stance taken by chief minister Vijay Rupani and his deputy Nitin Patel on the flood relief package of Rs 1,500, announced by the state government on Thursday. During the cabinet meeting in Gandhinagar on Friday, according to sources, Patel demanded the same package for Kadi, Kalol and Mehsana districts which too had suffered extensive damages in the heavy rains that lashed the state. However, the CM reportedly ignored the suggestion and took up other issues on the agenda. When

The anti-ragging cell of the University Grants Commission (UGC) sought a response from the National Institute of Design (NID) in connection with a complaint of ragging on the Gandhinagar campus of the institute. However, the institute is still clueless about the culprits. According to some insiders, Patel is reportedly unhappy because the CM garnered all credits for the flood-relief measures taken in the state. “When Rupani left for Banaskantha, it was decided that Patel would take

care of the dayto-day functioning of the secretariat. Rupani camped in Banaskantha for five days and met the victims, stealing the media limelight,“ said a senior bureaucrat. “While declaring the package, even officials bypassed Patel and talked to the CM directly. It has been learnt that the CM too did not consult Patel while announcing the package,“ said a source.
