Short News Guwahati: 19-year-old rapist awarded death penalty Guwahati: A district and session court of Assam on Friday awarded the death penalty to Zakir Husain, the prime accused in the brutal rape and murder of an 11-year old girl at Batadrava in central Assam’s Nagaon district in March this year. Completing the trial within record time, district and session judge Rita Kar pronounced the death sentence to 19-year old Husain under the Protection of Children from Sexual Offences (POCSO) Act for the murder, and to life imprisonment for raping the minor girl. The girl was gang-raped and set on fire by dousing her with kerosene on March 23 when she was alone at her home in Dhaniabheti Lalung Gaon by her 12-year-old classmate, her 11-year-old cousin and 19-year-old neighbour, Zakir Husain. The police had formed a Special Investigation Team, which worked in coordination with the prosecution to complete the trial.

India filled with cautious hope after new govt in Pakistan: Envoy Ajay Bisaria Mumbai: On a day when the Pakistan Army Chief raked up the Kashmir issue, Indian High Commissioner to Pakistan Ajay Bisaria said the new government in Pakistan has opened a political window and India is filled with cautious hope. The statement comes in the background of a brooding atmosphere for resuming of dialogues between the two countries. “Terrorism is a deal-breaker; what is important is a bilateral conversation and that will happen when terrorism ends,” Bisaria was quoted as saying by PTI. Bisaria, who was in IIM Calcutta, said, “Bilateral relations received a setback after the (terrorist) attacks on Pathankot and Uri. But after the new government came in Pakistan, a new political window opened up and we are filled with cautious hope.” The Indian diplomat also said efforts are being made to secure the release of every Indian prisoner in Pakistan and to bring them back on humanitarian grounds.

West Bengal: One injured in fresh bridge collapse in Siliguri

New Delhi : An old bridge collapsed near Siliguri in north Bengal Friday, leaving a truck driver injured, state minister said. This is the second incident of bridge collapse in West Bengal in three days. The Majerhat bridge had collapsed in south Kolkata on September 4, killing three persons and injuring 24. The middle part of the bridge collapsed on a canal below at around 9.30 am when a truck was crossing it and the vehicle was stuck in the broken portion, officials said. The bridge connects the Manganj and Phansidewa areas to Siliguri, a major city in north Bengal. Phansidewa is around 22 kms from Siliguri. “Let the matter be inquired into,” Governor Keshari Nath Tripathi told reporters in Kolkata when asked about the back-to-back collapse of the Majerhat bridge and the one today. North Bengal Development Minister Rabindranath Ghosh said movement of loaded trucks was banned on the bridge but many such vehicles bound for the north-eastern states continued to take it. “This incident is a result of that,” he added. Ghosh also said the bridge was constructed long ago and its papers were not available. The repair work of the structure would be undertaken after the PWD prepared a report, he added.

National nutrition month: PM to hold ‘direct samvad’ with 24 lakh anganwadi, health workers

New Delhi : Prime Minister Narendra Modi will hold a “direct samvad” with 24 lakh anganwadi and health workers next week and also some beneficiaries as part of the Rashtriya Poshan Maah (national nutrition month) events. Two ministries — Women and Child Development (WCD) and Health — are currently identifying themes for the conversation and success stories to be showcased before the PM. Modi is expected to interact with 14-18 workers, and the ministries have been asked to “prepare” 24-30 participants. Modi has earlier held several editions of direct samvad, including with beneficiaries of women self-help groups under the Deendayal Antyodaya Yojana-National Rural Livelihoods Mission (DAY-NRLM). September is being observed as the nutrition month. The month-long campaign is meant to promote antenatal care, breastfeeding, fight anemia, convey messages about the importance of nutrition for girls and the right age of marriage, deliver messages about the importance of growth

monitoring, and promote hygiene and sanitation. Health Minister J P Nadda is also scheduled start a programme against anemia — anemia-mukt Bharat. Cabinet Secretary P K Sinha has already held a videoconferencing meet with chief secretaries of states and principal secretaries of the Departments of Health and WCD on the PM’s interaction with frontline workers. According to a brief sent out by the Cabinet Secretariat, “The Direct Samvad will provide an opportunity to the frontline functionaries to share their experiences and success stories with the Prime Minister, by various activities being undertaken by them as part of POSHAN Abhiyan, especially as part of Rashtriya Poshan Maah and various schemes of Ministry of Health of Family Welfare).” For the direct samvad, a venue with capacity of 150-200 people will be earmarked in each block. It will be connected to Delhi either through videoconferencing or one-way web case. Each state has to ensure there are at least two locations with such facility.

New Delhi : Attacking the Narendra Modi-led government at the Centre, former prime minister Manmohan Singh on Friday said that the hasty implementation of the Goods and Services Tax (GST) has hurt enterprises and businesses. “Programs like Make in India and Standup India are yet to make a meaningful impact on industrial production growth. Small and marginal enterprises are yet to derive significant benefit from the ease of doing business schemes,” Manmohan Singh was quoted as saying by ANI. Taking on the central government over the promise of creating two crore jobs every year, Singh said, “Our youth are desperately waiting for the promised two crore jobs. Employment growth rate has been declining in the last four years. People aren’t impressed with the figures being put out by Modi govt

Law on anvil to prevent lynchings: Centre to Supreme Court

New Delhi: Even as the Centre stated on Friday that an empowered Group of Ministers (GoM) had been appointed to consider framing a law on mob violence, the Supreme Court warned states to strictly implement the directions issued in July to prevent cow vigilantism and granted a week to file the compliance report. Taking note of the fact that only 11 out of 29 states had filed the compliance report, a three-judge Bench of Chief Justice Dipak Misra and Justices A.M. Khanw-ilkar and D.Y. Chand-rachud warned that it would direct the presence of the respective home secretaries if the defaulting states do not file the report within one week. Acting on a petition filed by Tehseen S. Poonawalla and others the court in July suggested to Parliament to enact a law to make lynching a separate offence including the provision for compensation to victims. The court had then made it clear that mobs could

not take the law into their hands and resort to lynching. It said there can be no shadow of doubt that the authorities that are conferred with the responsibility to maintain law and order in the states have the principal obligation to see that vigilantism, be it cow vigilantism or any other vigilantism of any perception, does not take place. Giving a series of directions, the court had said the states should designate a senior police officer, not below the rank of superintendent of police as nodal officer in each district, for taking measures to prevent incidents of mob violence and lynching.

CEC says did not talk poll dates with K Chandrasekhar Rao

Hyderabad: In a strong rebuttal, Chief Election Commissioner Om Prakash Rawat on Friday denied that Chief Minister K. Chandrasekhar Rao had called him to speak about the TS election schedule. Speaking to mediapersons in Delhi, Mr Rawat said, “Telangana Chief Minister K. Chandrasekhar Rao did not speak with me. It is very unfortunate for a Chief Minister to say this.” He was replying to questions on Mr Rao’s statement at a media conference on Thursday that he had finalised the schedule to dissolve the Assembly after speaking with Mr Rawat and the

two other Election Commissioners and that the TS elections would be held in November along with four other states. Asked if the elections would indeed be held in November as Mr Rao had stated, Mr Rawat shot back: “The Assembly election schedule will be decided by the

Election Commission and not on the basis of astrology.” Mr Rawat said neither the Chief Minister nor anyone could talk about the election dates, and only the Election Commission could do so. He said that the Constitution had empowered only the Election Commission to announce the schedule and conduct the elections and no one should interfere in this. He said the TS elections would be conducted at the earliest and on priority as he did not want a caretaker government to take decisions. Interpol panel to look into Mehul Choksi’s Red Corner Notice

New Delhi: More trouble seems to be brewing for Mehul Choksi, as an internal committee of the Interpol will take up the pending Red Corner Notice (RCN) request against the fugitive billionaire next month. According to sources, Indian investigative agencies have made a strong case against Choksi and urged the Interpol to issue the pending RCN against him at the earliest. “The RCN request was put on hold by the Interpol after a representation by Choksi during which he had alleged that the cases against him were a result of a political conspiracy,” sources said. Choksi had also raised questions about jail conditions in India, his personal safety and health among others, they added. “A five-member Inte-rpol committee’s court, called the Commission for Control of Files, which will next month examine contentions of both the sides and give

its ruling on the RCN issue,” sources said. The Interpol had already issued an RCN against Choksi’s nephew Nirav Modi who was allegedly his partnerin-crime and has been located in the United Kingdom after he fled from India in the first week of January this year. After his location was confirmed, Indian investigative agencies sent an extradition request against Nirav Modi to the authorities concerned in the UK through the diplomatic channel.

What the Section 377 verdict says about India

The Supreme Court of India’s decriminalization of homosexuality is a humanistic triumph. It is a redemption of judicial logic. It is, perhaps most importantly, as fine a clarifying moment as any in India’s constitutional history about the relationship between Indian citizens, their elected representatives and the judiciary. The unanimous verdict in Navtej Singh Johar and Ors. vs. Union of India is founded on a simple principle. As Chief Justice of India Dipak Misra put it in his ruling, writing for himself and Justice A.M. Khanwilkar, “The natural identity of an individual should be treated to be absolutely essential to his being.� This is so obvious that it should not need saying. This identity is protected in various ways by Article 14 of the Constitution, granting equality before the law, Article 15, which prohibits discrimination on grounds of religion, race, caste, sex or place of birth, and Article 21, which guarantees protection of life and personal liberty. The legal history of the issue is strewn with counter arguments, ranging from homosexuality not being a part of an individual’s natural identity to the LGBTQ community being a vector for the HIV virus and thus a danger to society. None of them manage to clear even the low bar of a sniff test. They are distractions. The support for Section 377 has always stemmed from the dangerous idea and sentiment of public morality. The landmark 2009 Delhi high court case, Naz Foundation vs. Government of NCT of Delhi and Ors, makes this clear. The government argued that as the LGBTQ community comprised a small minority of the Indian population, the rights of the rest of the population could not be compromised. Casting LGBTQ rights as violative of the rights of the heterosexual population is cockamamie logic. The bench of the then Chief Justice of Delhi high court, A.P. Shah, and Justice S. Muralidhar pointed out the real issue in a fine verdict: “Moral indignation, howsoever strong, is not a valid basis for overriding individuals’ fundamental rights of dignity and privacy. In our scheme of things, constitutional morality must outweigh the argument of public morality, even if it be the majoritarian view.� Constitutional morality and the public morality of the Raj that informs Section 377 have the same roots. The Indian Constitution draws heavily from western constitutions, products of the Judeo-Christian tradition, as Justice D.Y. Chandrachud points out in his judgment. From Augustine of Hippo to Thomas Aquinas, early theologians built the foundations of Western law with the morality of their religious tradition. The condemnation of homosexuality started with this tradition, crossed over into ecclesiastical law and finally into secular law. Modern fundamental rights followed the same trajectory to a point.

Girls with CHD in India find New Hope with Pernod Ricard India Charitable Foundation and Genesis Foundation New Delhi: In a move towards promoting Congenital Heart Defects (CHD) free India and Saving the Girl Child, Pernod Ricard India Charitable Foundation (PRICF) and Genesis Foundation have joined hands to support the surgery of girls suffering from Congenital Heart Defects (CHD). Under this collaboration, PRICF would be supporting surgeries of 20+ girls with a grant of INR 40 Lakhs. According to a report released by UNICEF in 2018 “More baby girls than boys die in India, as parents neglect healthcare” . The report also stated that “a preference for sons encourages sex-selective abortions, which has led to skewed sex ratios” . The sex ratio in the country today stands at a staggering 940 females per 1000 males. According to the data collected by UNICEF in 2017, nearly 60 percent of the infants admitted to across 700 state run hospital facilities were boys. This is because parents are less likely to seek medical treatment for their daughter than their son. CHD is the most common congenital anomaly in newborn babies. With over 2 lakh children born with CHD in the country, it contributes to 10% of child mortality. Due to lack of an efficient tracking system, several kids go undetected and without treatment 60% of CHD are lethal within first two years of life.

Air India to raise Rs 500 crore via short-term borrowings Mumbai: National carrier Air India is looking to raise Rs 500 crore through shortterm borrowings to meet its working capital requirements. The short-term loan (STL) will be drawn in September in one or more tranches, according to the bid document. “Air India is inviting bids for governmentguaranteed short-term loans (STLs) totalling to Rs 500 crore to meet its urgent working capital requirements,” the bid document said. The tenure of the loan will be for one year (renewable) from the date of availing the STL, it added. The banks have been asked to submit their bids by September 10. In July, the government had sought Parliament’s approval for Rs 980 crore in supplementary grants towards equity infusion in the national carrier. The amount is still awaited by the carrier. This is the second time in this fiscal year that the airline is borrowing for working capital. In June as well, Air India had borrowed Rs 1,000 crore through short-term loans to pay staff salaries and meet other payment obligations following a failed privatisation attempt. Its debt is estimated to be over Rs 50,000 crore. The carrier had borrowed Rs 6,250 crore from various banks between September and March quarters last fiscal for its day-to-day capital needs. Air India is staying afloat on a bailout package extended by the government in 2012, as part of a turnaround plan (TAP) and a financial restructuring plan (FRP).

Ratification of CTBT essential to prevent ‘catastrophic impact’ of nuclear tests: UN chief

United Nations : UN chief Antonio Guterres reiterated his appeal to eight nations, including India and the US, to ratify the Comprehensive NuclearTest-Ban Treaty, saying the failure to bring it into force undermines global efforts to ensure a world free of atomic weapons. Although more than 180 countries have signed the CTBT, and mostly ratified it, the treaty can only enter into force after it is ratified by eight countries with nuclear technology capacity, namely China, Egypt, India, Iran, Israel, North Korea, Pakistan and the United States. “Every effort must be made to bring about the immediate entry into force of the Comprehensive Nuclear-Test-Ban Treaty, CTBT. Yet, more than 20 years since its negotiation, the Treaty has yet to enter into force,” the Secretary-General said at a high-level meeting on Thursday, commemorating the International Day against Nuclear Tests. He said the failure to bring the treaty into force prevents its full implementation and undermines its permanence in the international security architecture.

Australia, New Zealand deploy planes to enforce UN sanctions against North Korea

Wellington : Australia and New Zealand said Friday they are sending three maritime patrol planes to Japan as part of the effort to enforce UN sanctions against North Korea. Japan has been monitoring offshore ship-to-ship transfers of oil allegedly involving North Korean ships, which would violate UN sanctions imposed over the North’s nuclear and missile programs. New Zealand Defense Minister Ron Mark said in a statement it would coordinate efforts with partners to counter North Korean activities that breach sanctions, in particular ship-toship transfers. Australian Defense Minister Christopher Pyne said his country would deploy two Orion aircraft to put economic and diplomatic pressure on North Korea. “Australia continues to work with partners to enforce sanctions to pressure North Korea to take concrete and verifiable steps to denuclearize,” Pyne said in a statement. “A stable and prosperous Indo-Pacific remains Australia’s priority.” New Zealand will deploy one Orion plane. New Zealand Foreign Affairs Minister Winston Peters said in a statement he welcomed the recent dialogue North Korea has had with the US and South Korea, but said that until North Korea abides by its international obligations, it was essential to fully implement the UN Security Council sanctions.
